Adjourn WS – Item _1 WORK SESSION STAFF REPORT Work Session Item No. _1 Date: November 7, 2022 To: City Council/EDA From: Michael Grochala, Community Development Director Re: Woods Edge Land Sale, Silver Creek Equity PA amendment Background In June, the City’s Economic Development Authority (EDA) approved the purchase agreement (PA) with Silver Creek Equity (Developer) for the acquisition of 6.27 acres in the Legacy at Woods Edge development. The purchase price is $2,376,154.00. Under the terms of the agreement the Developer is required to construct a multi-tenant retail building or restaurant prior to, or concurrent with, the multi-family building. The agreement provided Developer with a 120 day due diligence period which ends on November 22, 2022. At such time the Developer must either terminate the agreement or deposit an additional $40,000 in earnest money. To date the Developer has not been able to secure any firm retail/restaurant commitments. However they would like to move forward with the development of the multi-family building. The Developer has developed a conceptual elevation of the proposed residential project and site plan. An alternative site plan with a 2nd multi-family building has also been developed. The Developer is requesting an amendment to the PA that would allow for construction of a market rate multi-family building prior to retail/restaurant construction. The building would not be age-restricted. The developer is also requesting a 3 year cap on the retail/restaurant restriction in the agreement. If after 3 years (December 31, 2025) developer is unable to obtain retail/restaurant users they would be allowed to proceed with a multi-family development on the balance of the site. Under this scenario the developer would still be purchasing the entire site at the purchase price previously agreed to. The developer will be present at the meeting to discuss their retail/restaurant efforts and continued interest in the development of the site. If the CC/EDA is supportive of these changes staff will have the language drafted and available for consideration on November 14, 2022. If additional time is necessary a special meeting could be held November 21, 2022. Alternatively, action could be taken on the 14th to extend the due diligence period, allowing for additional discussion time. In absence of an amendment the developer can elect to either continue as originally proposed or terminate the contract. Requested Council Direction Staff is requesting CC/EDA direction on whether to amend the purchase agreement with Silver Creek Equity. Attachments 1. This is one of the steps required to implement the 2040 Comprehensive Plan that was adopted by the City Council on November 9, 2020. On May 12, 2021, the Planning & Zoning Board (P&Z Board) kicked off this effort with a discussion of Planned Unit Developments (PUD). The P&Z had a robust discussion about the purpose and intent of PUDs and provided direction to staff about desired changes to the ordinance. On June 9, 2021, the P&Z Board reviewed the first draft of the changes to the general provisions section. P&Z provided input to staff about the proposed revisions to the ordinance. On August 11, 2021, the P&Z Board reviewed the first draft of the Planned Unit Development section of the ordinance. The P&Z Board provided feedback regarding the proposed changes to the ordinance. On October 4, 2021, staff provided an update on the project at the Council work session. On October 13, 2021, the P&Z Board reviewed the first draft of the zoning district sections of the ordinance. The P&Z provided feedback about the proposed changes and provided input on other potential changes to the ordinance. On November 10, 2021, the P&Z Board reviewed driveway width, impervious surface area, brew pub locations, garage area, side yard setbacks and porch depth to provide and input and recommendations on changes to the ordinance. On January 12, 2022, the P&Z Board reviewed the administrative section and provided input on the proposed changes to clean up and refine the section. 2 On February 9, 2022, the P&Z Board reviewed the new zoning districts, agritourism and liquor uses to provide input and recommendations on changes to the ordinance. On March 30, 2022, the P&Z Board held a work session to review the draft zoning map changes and provided feedback on the proposed changes. On April 13, 2022, the P&Z Board received an update on some key items including indoor storage, agritourism, mead, garage size and the urban transition (now called future urban development) district. On June 22, 2022, the P&Z Board discussed rural clusters, the future urban development district and architecture standards. On July 13, 2022, the P&Z Board reviewed updated information on rural clusters and architecture standards and provided input. On August 10, 2022, the P&Z Board reviewed the full draft of the zoning ordinance and provided input. On September 14, 2022, the P&Z Board held the public hearing for the zoning ordinance and provided additional input on the draft ordinance. On October 3, 2022, staff provided an update on the draft zoning ordinance to the Council. On October 12, 2022, the P&Z Board held the public hearing for the zoning map update and provided input on the proposed map changes. PLANNING & ZONING BOARD REVIEW The Planning & Zoning Board held a public hearing and reviewed the zoning map at their October 12th meeting. There were several members of the public present to speak on the item. The resident concerns were primarily focused on the proposed FUD (Future Urban Development) district. The Planning & Zoning Board recommended approval of the zoning map with the removal of the FUD district. The FUD district is exactly the same as the R (Rural) district in terms of allowed uses and setbacks. The only difference is that the minimum lot size is increased from 10 to 20 acres, as a tool to retain large lots until development is proposed. This was one of the implementation items in the 2040 Comprehensive Plan. The City Council should provide feedback on the FUD district. ANALYSIS Minnesota Statutes §473.864 and §473.865 of the Metropolitan Land Planning Act, requires the City to review its official controls and amend, as necessary, any that conflict with the plan. The statutes require that the zoning map be consistent with the land use map. 3 Chapter 12 of the 2040 Comprehensive Plan includes the following implementation strategies: 1. “Review and update the zoning map as needed to eliminate any inconsistencies with the Comprehensive Plan. 3. Consider creating new zoning districts: a. As “holding zones” for urban development. Holding zones would provide a zoning classification appropriate to land planned for future urban development but where municipal services are not yet available. The holding zone would apply until a landowner/ developer makes application for development, at which time the city may rezone the property consistent with its designation on the future land use plan map, provided that the development does not result in the premature extension of public utilities, facilities or services.” The zoning map has been revised to be consistent with the future land use of the 2040 Comprehensive Plan, creates a holding zone for urban development and corrects existing errors in the zoning map. There are 1,965 parcels that will be rezoned as part of this effort; however, the number of substantive changes is far fewer. The zoning map changes fall into four main categories: 1. Planned Unit Development (PUD) District. The City changed Planned Development Overlay (PDO) to Planned Unit Development (PUD) with the zoning ordinance update in 2003. The City is rezoning all properties previously shown as a PDO to a PUD to reflect that change. This change represents 1,225 of the 1,965 properties proposed to be changed with the zoning map updates. Other than the name of the zoning district there is no regulatory change to these parcels. 2. Future Urban Development (FUD) District. The FUD zoning map changes reflect a change planned as part of the 2040 Comprehensive Plan implementation. The change applies to parcels, currently zoned R-Rural, that are located within the planned 2040 Utility Staging Area. The only change from R to FUD is that the FUD zone has a higher minimum lot size of 20 acres to preserve the land for development. The permitted, conditional and accessory uses allowed in the FUD zone will remain the same as the Rural (R) zone. The zoning change will not result in any currently allowed uses to become nonconforming. This change to the zoning map represents 640 of the 1,965 properties proposed to be changed with the zoning map updates. 3. Land Use Consistency. There are a number of parcels which have been rezoned to be consistent with the 2040 future land use for the property. State law required zoning to be brought into compliance with the adopted land use designation. This represents 60 of 1,965 properties being rezoned. If an existing legally established use is inconsistent with the new zoning, the use will become legal non-conforming and may continue, as legally established, until such time as the use ceases or the property is redeveloped. 4 4. Miscellaneous. The remaining 35 properties were identified as mapping errors on the existing zoning map. These changes are being completed alongside the zoning map update. SUMMARY The draft zoning ordinance text amendment was presented to Council at the October 3, 2022 Work Session. The draft zoning ordinance text and map will be presented at the November 14th meeting for the first reading and the November 28th meeting for the second reading. The Planning & Zoning Board recommended approval of the zoning map without the FUD district. If the City Council does not wish to approve the FUD holding zone, the parcels would remain with their current zoning of R (Rural) or R-X (Rural Executive). Parcels currently zoned R-BR, Rural /Business Reserve would be zoned R, Rural since the R-BR district is being omitted. RECOMMENDATION No action is required. The Council should provide feedback on any of the proposed changes for the November 14th meeting for adoption of the Zoning Ordinance and Zoning Map. ATTACHMENTS 1. 2040 Future Land Use Map 2. Watermark is a 372 acre master planned residential community consisting of 692 single family lots and 172 townhome units totaling 864 housing units. The total housing unit count will not change. PUD Concept Plan Review 4 The City’s review and comments on the concept plan’s relation to the Comprehensive Plan and development regulations does not grant any rights to the applicant to develop the property as depicted by the concept plan. Requested Council Direction Staff is requesting Council feedback on the proposed Land Use Plan amendment. Staff suggests leaving the single family lots sizes the same (no 45ft wide lots), allowing for the housing product change from Villas to Heritage and Venture and allowing for the townhome neighborhood. Lennar is proposing to convert what was proposed as Villa lots in the northeast corner of Watermark to Heritage, Venture, and Townhome lots. This change to the product lineup is due in large part to shifts in the housing market. We have found Lino Lakes, and particularly Watermark, has become a very attractive home for young families. The proposed revision to convert from Villas to small single-family homes and townhomes will allow us to offer housing options to more young families as the Villa product is geared more toward retirees and empty-nesters. The change also lowers infrastructure costs to Lennar as material and labor prices continue to rise. This means the City will have less infrastructure to maintain once public utilities become the City’s responsibility. This also expands the total amount of public open space or parkland in the Watermark community from 60.79 acres to 74.65 acres. Trail connections would also be proposed throughout the newly created open space to link up with the neighborhood to the east. Proposed Homes and Architecture (please see exterior renderings and floorplans) All Lennar homes include varying amounts of stone on front facades and siding materials consist of lap siding, shakes, or board and batten. Other architectural features available on selected facades include columns, gables, shutters, accentuated window trim and fascia, and decorative roof brackets and cornices. Architectural renderings are included with this submittal. Lennar’s design team will carefully plan the color packages of each home to avoid monotony and to ensure a visually appealing streetscape. Amendment #4 proposes to change the northeast area of the Watermark PUD to replace Villa Lots with additional Heritage, Venture, and Townhome lot products. Engineering • Erosion Control & Grading The Watermark PUD plans include site grading for the proposed streets, homes, and storm water facilities. PUD Amendment #4 will require an updated grading plan as it is proposed to remove some of the roadways and lots. The switch from Villa lot widths to Heritage and Venture lot widths will also require grading revisions. • Stormwater Management Stormwater management for the northeast area of the Watermark PUD is designed to flow through storm sewer and a series of ponds. PUD Amendment #4 will require revisions to the storm layout and updates to stormwater modeling. PUD Amendment #4 reduces the impervious surface and adds additional open space to the northeast area. The downstream storm sewer systems will be sufficient for the proposed changes. • Water Supply The Watermark PUD proposes 16” water main along Lotus Lane, 12” water main along Rainy Lane, and 8” water main on the other streets within the northeast area. PUD Amendment #4 does not propose any changes to the water main at this time. The proposed 8” watermain will be sufficient to serve the proposed homes and townhomes in PUD Amendment #4. • Sanitary Sewer The Watermark PUD proposes 10” sanitary sewer along Lotus Lane and 8” sanitary sewer on the other streets within the northeast area. PUD Amendment #4 does not propose any changes to the sanitary sewer at this time. The proposed 8” sanitary sewer will be sufficient to serve the proposed homes and townhomes in PUD Amendment #4. Ms. Katie Larsen 10/05/2022 Page 2 Watermark PUD Amendment #4 Engineering Review • Transportation The applicant is proposing to eliminate several legs of proposed city streets and is proposing to add a private street through the townhome area. Street widths, lengths, and profiles will be reviewed with future submittals. • Wetlands and Mitigation Plan Wetlands were delineated for the Watermark PUD development. PUD Amendment #4 does not appear to impact the existing wetlands in this area as the street layout near the existing wetlands in not proposed to change. Wetland impacts will be reviewed with future submittals. • Landscaping Landscaping to be reviewed with future submittals and shall meet City zoning requirements. Landscaping will be reviewed in depth by the City’s Environmental Coordinator. • Floodplain There are no existing floodplains in the area of the proposed PUD Amendment #4. • Drainage and Utility Easements Drainage and Utility easements must meet City Code requirements and will be reviewed with future additions of the plat. • Development Agreement A Development Agreement will be required with any final plats of future additions. • Grading Agreement Grading agreement not required at this time. • Stormwater Maintenance Agreement Stormwater Maintenance Agreements will be required with any final plats of future additions. One option for the additional open space would be to establish park in the north near the property line and use the rest for establishment of mesic prairie. A trail could be added through the prairie area to connect with the park in the north. This would require grading the area flat (aside from the berm on the east perimeter) and preparing for seeding. Any new trees required for buffer and/or screening should be kept east of the crest of the berm, keeping the highpoint of the berm free of trees to allow for future management of the prairie area with fire. The program involves rating of one-fourth of the City roadway system mileage per year, and using pavement management software to project the condition of the remainder of the roadways. The City’s 2022 Overall Condition Index Map is enclosed. OCI Rating Miles of Road Percent of System Adequate 70.01-100 71 miles (68 miles 2021) 70% (68% in 2021) Marginal 40.01-70 25 miles (24 miles 2021) 23% (22% in 2021) Problem 0-40 9 miles (12 miles 2021) 7% (10% in 2021) The City’s roadway system weighted average OCI is 75.5. The findings reflect that majority of the roadways in the City are in adequate condition. The high rating is partially supported by new development construction in the recent years helping keep the average. The problem category has been reduced due to thin overlays, these roadways are expected to degrade back to the problem category within 10-15 years. There are approximately 5 miles of roadways have had thin overlays in the last 3 years. The thin overlays allows the City time to fund these roadways in the future. The pavement ratings along with traffic volumes, maintenance data, and geotechnical information is used for the City’s Roadway Capital Improvement Planning (CIP). The CIP is found on the City’s website under Engineering Resources. Since 2005 the City has completed 71 miles of preventative maintenance including crack filling, chip sealing and reclamite projects. The City has also performed 39 miles of pavement structure improvements including reconstruction, reclamation, mill and overlay and thin overlays. Requested Council Direction Information only. PAVER, an asset management software, was used to record and estimate the condition of each road segment. The software calculates PCI using deduct values that are based on the type, severity, and quantity of the visible pavement distresses on each road. Gravel roads and private roads were not included in the analysis. Each year, WSB inspects approximately a fourth of the road pavement in Lino Lakes to ensure the entire system is surveyed over a four-year span. The condition of the segments that were not inspected this year were extrapolated using the most recent inspection data and the United States Army Corps of Engineers Standard Pavement Degradation Curve. A summary of the pavement condition report is listed below: • Of the 104.7 miles of City pavement included in this analysis, 28 miles were inspected this year. • The current weighted average Pavement Condition Index (PCI) for bituminous roads in Lino Lakes is 75.5. PCI is based on a 0 to 100 scale, with higher PCI values corresponding to better road conditions. This weighted average is calculated from the PCI values generated on each segment of roadway. A road’s PCI is based on the quantity and severity of pavement distresses identified in the field. Any type of road maintenance (i.e. patching or crack sealing) done prior to inspections is accounted for in the PCI value. Figure 1. Table 1 shows how the area weighted average PCI in Lino Lakes has changed over the past five years. These records show the maintenance and construction performed by the City have maintained the network in relatively stable condition. Additionally, the last two years have seen the PCI increase, which is also due to the City adding new roads to the system. Table 2 shows the mileage of pavement in each category. Table 1. Corrective maintenance includes crack sealing and patching. These types of maintenance should be conducted as soon as cracks or distresses surface to reduce the infiltration of water and incompressible materials through the cracks. These fixes are recommended on roads in the upper range of the Adequate category because those roads should not need any major repairs. Preventive maintenance includes surface treatment such as crack sealing, fog sealing, and rejuvenating. These maintenance activities should be performed while the pavement is still in good condition. As roads deteriorate, these cost-effective maintenance strategies become ineffective and more expensive fixes are required. With proper preventative maintenance techniques, the life of an average paved road increases from 20 years to 50 years. Each type of preventive maintenance serves its own function, and project selection depends on the type and severity of distresses observed in the road. For pavements in the upper range of the category, mill and overlays are recommended. Roadways that fall into the lower range of the Marginal category usually require a more thorough rehabilitation. Pavement reclamation or full depth mill/overlay is usually needed to adequately repair road at this point. Prior to any mill and overlay or bituminous removal and replacement, pavement coring is strongly recommended to determine if the pavement base structure is in good enough condition to support the intended project. If there are issues in the base and subgrade layers, many pavement preservation methods are not feasible. Reconstruction is recommended to be performed on streets that fall into the Problem category. Usually, roads in this condition have deteriorated beyond the point where any other maintenance activity is cost effective. Again, pavement coring is recommended prior to any design work to determine the appropriate maintenance project. Reconstruction can also help to address subsurface issues such as drainage or increase in traffic capacity. As pavement deteriorates, certain maintenance strategies are no longer feasible. It is important to address minor distresses before they become worse. Pavement maintenance solutions get exponentially more expensive as the roadways degrade so performing routine maintenance is crucial. Preventative maintenance is the most cost-effective solution for cities looking to maximize their budget and keep their roads in good condition. Appendix A features a PCI map and Appendix B lists the PCI of each surveyed segment. WSB can provide additional analysis, recommendations, or maintenance planning if requested. The Public Services Division is seeking City Council approval to hire a second Mechanic in our Fleet Department. After 22 years of service, Jim Blackbird has retired and created a large void in servicing our fleet within the City. Blackbird served in the role of Maintenance Worker/Mechanic for the City. Staff recommends not relying on our only one-full time Mechanic, Brett Olander. With over 50 vehicles in service, it’s imperative that the vacancy is filled quickly for the following reasons: • The vacancy will likely create backups that will affect all departments, but especially Public Works and Public Safety. • When the Mechanic is on vacation or in need of a sick day the City will have no back-up. • It is vital to have more than one mechanic available during snow plowing operations to fix broken down plows, replace broken blades, etc. • Often Public Safety vehicles need quick turn-around times to get vehicles back in service for the safety of our community. • Having just one Mechanic would require sending vehicles to outside area mechanic shops. • Outsourcing mechanical work would cost the City significantly more than performing the work in-house. Area mechanic shops charge hourly rates at $110 - $130 per hour and have significant mark-up on supplies. • Having two employees dropping off and picking up vehicles creates inefficiencies within the Public Works department. • Timely mechanical repairs, especially evenings and weekends, would also be an issue, especially if there is already a backlog at local mechanic shops. Blackbird who was a Maintenance Worker/Mechanic for the City was earning an hourly wage of $32.54 (50/50 combination of the Maintenance Worker/Mechanic hourly rate) at the time of retirement. Olander who is the City’s only Mechanic is currently at an hourly wage of $33.26. The open Mechanic position would be posted with the wage range of $30.66 - $36.07 per hour. The maximum budget impact of hiring a second Mechanic would be $7,342.40 plus benefits, if the City had to bring in the employee at Step 6 of the wage range. Requested Council Direction Consider approval of hiring a second Mechanic within the City’s Fleet Department. Of the five members, two are appointed from Anoka County, two are appointed from Ramsey County and one is appointed from Washington County. The term of each appointment is three years. Managers are eligible to be reappointed. To be eligible for appointment, a nominee must reside within the watershed district boundaries, be eligible to vote in the district, and not be a public officer of the county, state, or federal government (except that a soil and water conservation supervisor can be appointed). Pursuant to Minnesota Statute §103B.227, Anoka County has published a notice detailing a vacancy will occur on the Rice Creek Watershed District Board of Managers due to the expiration on January 17, 2023, of the term of Steve Patricia Preiner, City of Columbus. Persons interested in being appointed to serve on the Board of Managers may submit their names for consideration to the Anoka County Board of Commissioners, the appointing authority. In appointing a manager to the Rice Creek Watershed District, Minnesota Statute §103D.311 is also applicable. This statute requires a county board, upon the expiration of a term, to appoint managers for a watershed district from an aggregate list of three or more persons nominated jointly or severally by the towns and municipalities within the district if a list(s) is submitted 60 days before the mangers term expires. In absence of a valid list of nominees, the Anoka County Board may appoint any voting resident of the RCWD who is not a public officer of the county, state or federal government and who otherwise complies with the requirements and terms of Minnesota Statute §103D.311. In order for the county to accept nominations for the expiring term, they must be received by November 18, 2022. Lino Lakes resident, Scott Robinson (8179 4th Avenue), has expressed interested in serving on the Rice Creek Watershed District Board of Managers and has been informed of the Anoka County application process. Based on discussions with other municipalities who wish to have representation on the Rice Creek Watershed Board of Managers, the cities of Circle Pines, Blaine, and Fridley will also be nominating an individual. To help ensure the County considers a Lino Lakes nominee, staff is recommending jointly submitting a list with surrounding communities. WS – Item 10 WORK SESSION STAFF REPORT Work Session Item No. 10 Date: November 7, 2022 To: City Council From: Lisa Lamey, Rookery Activity Center Manager Re: Rookery Mural Design Concepts Background Over the past 9 months, The Rookery staff has worked to establish furnishings, paint colors, and design elements to provide an updated and welcoming environment within The Rookery Activity Center. The Rookery Activity Center was awarded funding from the St. Paul Area Association of Realtors - Key Communities program, thanks to Council Member Stoesz’s application. The Key Communities program aims to bring together local, state and national Realtor® programs and resources to enhance the partnership between Realtors® and local communities. This program could allow for the Rookery to meet key realtors in the community, expose them to the Rookery and in turn the Realtors can use the Rookery Activity as a great selling point for any homes that are selling in the surrounding communities. We initially identified that a great use of this funding could go towards an art piece that would tell the story of The Rookery. Since then Rookery staff has worked with Visual Communications, the design company that provided the internal signage in The Rookery, to create some designs that take into consideration the current brand palette, ideas, and talking points presented from Game Day Sports about the Rookery brand. Staff will present 3 designs for feedback and discussion. The mural would be placed on the wall just to the south of the entry/exit doors of the Rookery. Requested Council Direction Staff is requesting feedback on the designs. Staff recommends option #2 to as the design to place on the entry wall as an added aesthetic design element to the Rookery. This is unique to the Lino Lakes community and with the Rec Center in close proximity to the Blue Heron Colony, this unique connection will resonate with residents.
