ADJOURN City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike – The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more – groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. CALL TO ORDER AND ROLL CALL Vice Chair Michael Root called the Lino Lakes Planning & Zoning Board meeting to order at 6:30 p.m. on February 8, 2023. 2. PLEDGE OF ALLEGIANCE 3. APPROVAL OF AGENDA The agenda was approved as presented. 4. APPROVAL OF MINUTES Mr. Isaac Wipperfurth moved to approve the January 11, 2023 meeting minutes. Motion seconded by Mr. Neil Evenson. Public Hearing: Sign Ordinance Amendment Ms. Kristin Nierengarten with Rupp, Anderson, Squires, Waldspurger & Mace, presented the staff report. City Code Chapter 1010: Signs regulates signs. In 2014, the City amended the sign ordinance. Staff is proposing another amendment to the ordinance to reflect changes that have transpired from a federal court case. Mr. Perry Laden asked at what point can the City regulate when a sign is obscene, violent or pornographic in nature. Ms. Nierengarten stated the bar is high to enforce that issue. She stated it has to be truly egregious in nature. Mr. Laden stated the City should have some language in the ordinance to address it. Ms. Nierengarten stated it was possible to add language to cover prohibited signs. Mr. Nathan Vojtech questioned if business owners have to remove signs when a business closes? Ms. Nierengarten stated the City could send out letters for an ordinance violation or the City could do it if shown to be a safety risk. Mr. Vojtech asked if the City had any definition of light pollution. Mr. Michael Grochala, Community Development Director, indicated lighting is covered in the zoning ordinance. Mr. Vojtech asked if there was anything in the ordinance preventing the recognition of a private individual on a sign. Ms. Nierengarten stated there was not and concluded that we cannot regulate it within the sign ordinance. She did state the individual would have other resources available to them if this were to occur. Mr. Vojtech understood that a sign needed to be removed 10 days after the election. Ms. Nierengarten said you can have a sign in your yard any time of year and that it does not matter what the sign says. She went on to say it also means you are permitted to have more signs during the time allowed for the election process regardless of content or size. Mr. Evenson did not think the City required a permit for sandwich boards. He thought the Board had eliminated them and he concluded it should be eliminated. Ms. Larsen stated it is required but the City does not receive many requests. Ms. Larsen said weather it is required or not we will still have the same number of signs around the City. Mr. Wipperfurth questioned if the City cannot regulate content, can anyone put up as many signs as they want for any reason. Ms. Nierengarten confirmed they could and that there are some enforcements that can be taken in these instances. For example, if they are in the right of way, a setback or safety concern. Mr. Wipperfurth asked if flags are Planning & Zoning Board February 8, 2023 Page 3 DRAFT MINUTES regulated and if this could be used to circumvent the ordinance. Ms. Nierengarten stated they were regulated and that it could be used to evade the ordinance. Mr. Root would like a provision placed that neighborhood identification signs list the City of Lino Lakes on them. Ms. Nierengarten said you could do it, but it could be challenged. She thought it should be discussed with the builder. She did say a solution would be to put a City of Lino Lakes sign in the right of way. Mr. Root opened the public hearing at 7:09 p.m. Mr. Mike Kasbohm, 12918 Cardinal Creek Road, Eden Prairie, is a digital sign consultant and wanted the City of Lino Lakes to increase the size that is allowed in the sign ordinance. He said due to the speed limit in that area the sign will need to be bigger in order for it to be read. Paul Selbitschker, 7910 Lake Drive, Lino Lakes MN 55014. Mr. Selbitschker informed the Board that Mr. Kasbohm had a site analysis for his property if the Board would like to review it. The Board received the analysis. Mr. Vojtech moved to close public hearing. Motion seconded by Mr. Laden. The public hearing was closed at 7:15 p.m. The consensus with the board was to get further analysis for increasing the dynamic display sign size and approve the ordinance as presented. Mr. Laden moved to adopt the ordinance with exploration into an obscenity clause. Motion was seconded by Mr. Evenson. Motion carried 5 – 0. There will be further discussion in the future regarding the change in dimensions for dynamic display signs. B. Villas on Vicky PUD Revised Concept Plan Review Ms. Katie Larsen, City Planner, presented the staff report. The applicant, Jon Blattman with Ranger Development, submitted a land use application for PUD Concept Plan review in June 2022. The proposed residential development is located on a 5-acre parcel west of CSAH 23 (Lake Drive) and south of Vicky Lane. The applicant is proposing varying lot sizes, setbacks, and building design standards that would require PUD flexibility. The applicant has submitted a revised concept plan for review. Mr. Wipperfurth questioned if the developer is responsible for the development of Vicky Lane. Ms. Larsen stated they were responsible. Mr. Laden asked about the road alignment. Ms. Larsen said it is a requirement to develop the land. Planning & Zoning Board February 8, 2023 Page 4 DRAFT MINUTES Mr. Root asked if changing the density would be just for this parcel. Ms. Larsen stated that was correct. Mr. Evenson asked what the estimated cost of the houses were. The developer, Jon Blattman, 4247 117th Avenue NE, Blaine MN, stated they would start in the low $400,000 range. Mr. Blattman discussed the reason for the density request. Mr. Evenson asked if twin homes could go into this development. Mr. Blattman believes building twin homes would not achieve the density that the City is looking for. Ms. Larsen asked questions to receive feedback regarding the development. The Board agreed to adding infill, the concept of custom built homes, creative use of land and Vicky Lane realignment would be beneficial to the City. The Board was also in agreement of the PUD rezoning, comp plan amendment to lower the density by one degree, holding a neighborhood meeting and decreasing the size of the garage. 7. DISCUSSION ITEMS A. Project Updates Staff provided an update on projects. Mr. Evenson moved to adjourn the meeting. Motion seconded by Mr. Vojtech. The applicant is proposing to relocate the tennis court and a parking lot. The property is zoned PSP, Public and Semi- Public and allows for schools (public and private) with a conditional use permit. Any change involving a structural alteration requires an amendment to the conditional use permit. The project will include the construction of a new parking lot at the location of the existing tennis courts on the south side of the school. Eight (8) new tennis courts will be constructed in the existing parking lot located southeast of the school. The tennis courts will also be striped for pickleball. A stormwater management basin will be constructed on the west side of the new parking lot. Existing Site Conditions The existing site contains the Centennial Middle School, Blue Heron Elementary School and associated parking lot and athletic fields. Per the Geotechnical Evaluation Report prepared by Braun Intertec, dated December 22, 2022, native soils in the area consist of very fine-to medium-grained sand. Groundwater was not observed at 11 foot boring depths. Zoning and Land Use The property is zoned PSP, Public and Semi-Public and allows for schools with a conditional use permit. The parking lot addition, will consist of 134 parking stalls, surrounding landscaping, and a stormwater infiltration basin located on the west side of the parking lot. The proposed parking lot will provide better use of parking area on the site and closer access to the athletic fields. The second area, is a portion of the existing parking lot (129 parking stalls), located on the east side of the school. This parking lot doesn’t get used much due to the located from the school and athletic fields. The existing parking lot will be demoed and the area will be converted to tennis courts. The new tennis courts will be 2 sets of 4 courts with a 13’ wide walkway between them. Outdoor Lighting City Code Section 1007.043(6) details requirements for Outdoor Lighting. Four (4) light poles with downlit hoods are proposed for the new parking lot. They are 27ft in height which is less than the 30ft maximum allowed. The photometric plan shows 0.1 foot candle compliance at the adjacent residential rear lot lines. This is less than the allowed 0.4 foot candle. Lighting performance standards are met. One (1) new light pole and three (3) existing light poles are proposed for the new tennis courts. They are 27ft in height which is less than the 30 ft maximum allowed. The photometric plan shows 0.4 foot candle compliance at the east lot line. This is equal to the allowed 0.4 foot candle. Lighting performance standards are met. Off-Street Parking Requirements The existing parking lot has 129 stalls. The new parking lot has 134 stalls. Existing trail will be reconstructed near the new parking lot. Off-street parking requirements are met. Grading Plan and Stormwater Management Per the City Engineer’s Memo dated March 1, 2023: Stormwater from the existing tennis court area drains to the east and west of edges of the existing tennis courts. Stormwater from the existing parking lot area drains to storm sewer located in the northeast and southeast corners of the parking lot. The stormwater from both areas ultimately drains through the 399 Elm Street site through private storm sewer to the public pond. The project is proposed to rehabilitate approximately 1.89 acres of impervious surface and add new or reconstruct approximately 0.57 acres on the impervious area, according to the Stormwater Management Report. The surface water from proposed improvements will still ultimately flow to the existing pond, but the applicant is proposing to treat stormwater at the proposed parking lot site through an infiltration basin. The proposed tennis courts include a draintile system that outlets to existing private storm sewer. A geotechnical evaluation report prepared by Braun Intertec was submitted with the application. The report included soil borings which indicated that the native soils in the area consist of very-fine to medium-grained sand and is locally silt-rich. Groundwater was not observed in the borings. The applicant used a HydroCAD model based on the Atlas 14, 24-hour storms to design the storm sewer and infiltration basin. The proposed improvements are designed to 6 reduce site runoff rates for the 2-, 10-, and 100-year rainfall events. Runoff rates for the 10-day snow melt event were not provided at this time and are not required as basin outlets are below the 100-year HWL. Public Utilities The tennis court and parking lot do not require municipal water or sanitary sewer utilities. Tree Preservation and Mitigation Standards The Environmental Coordinator’s Memo dated March 1, 2023 addresses tree preservation and landscaping. All tree removals planned for this project are within the basic use area. A survey, tree preservation plan, and mitigation plan will not be required for this project. Open Areas Landscape Standards The open space for this project is the approximately 4,000 sq.ft. in and around the stormwater infiltration basin west of the proposed parking lot. This would require 2 large trees and 4 large shrubs. There are shrubs and trees provided along the fence to the south of the parking lot that exceed the requirements for screen planting. The additional plants along the fence will satisfy the open space planting requirements. Open space planting requirements have been met. Buffer and Screen Standards A 6 foot fence with trees and shrubs is proposed to provide continuous, year-round screening between the parking lot and the residential lots to the south. Buffer and screen standards have been met. Canopy Cover 7 Canopy cover standards call for a minimum of 40% canopy coverage. Canopy coverage values are calculated per tree based on the anticipated size 15 years after planting, and the distance to hardscape edge from the planting location. Vehicular hardscape planned: 42,662 sq. ft. Canopy cover requirement: 17,064 sq. ft. Canopy cover provided: 17,125 sq. ft. Canopy cover requirements have been met. Foundation Landscaping The foundation landscape requirements are not applicable for this project. Sod and Ground Cover Standards The site will be seeded with Mn DOT 25-131, a low maintenance fescue mix, and Mn DOT 33-261, a native plant mix for use in stormwater ponds. The seed mix types are appropriate for the site. Note that the city native plant establishment requirements will be in effect for the areas receiving native seed. The sod and ground cover standards have been met. Signage No new signage is proposed. Impervious Surface Coverage The PSP, Public and Semi-Public zoning district allows for 65% impervious surface coverage. The proposed impervious surface is 2.7 acres of the 80 acre site which is 3%. Impervious surface coverage is met. Traffic Study A traffic study is not required. Elm Street is a local road and is capable of handling the additional traffic volume generated by the five (5) additional parking spaces. Public Land Dedication Park land dedication or fees in lieu are not required. This is an existing lot of record and not being subdivided. Alternative Urban Areawide Review (AUAR) 8 The site is not within the AUAR environmental review boundary. Wetlands There are no wetlands located on site. Shoreland District The parcel is not located within the Shoreland District. Floodplain There are no floodplains located on site. Comprehensive Plan Resource Management System The Resource Management System Plan goal of preserving surface water quality is supported by the construction of stormwater management BMP’s such as curb, gutter and infiltration basins. Land Use Plan The Comprehensive Plan guides this property for civic use. The proposed tennis court and parking lot reconstruction are consistent with civic (school) land use. Housing Plan The goals and policies of Housing Plan are not negatively impacted by the proposed PTAC development. A 6 feet high privacy fence with landscaping is provided between the parking lot and the adjacent rear residential lot lines. Transportation Plan Goals of the Transportation Plan are to ensure that street and roads are as safe as possible. Elm Street is a local road and is capable of handling the additional traffic volume generated by the five (5) additional parking spaces. Sanitary Sewer and Water Supply Plan The tennis court and parking lot do not require municipal water or sanitary sewer utilities. Anoka County Highway Department Elm Street is a local road. Anoka County Highway Department did not need to review. 9 Public Safety Comments The Fire and Police Divisions reviewed the plans and had no issues that needed to be addressed. Environmental Coordinator The Environmental Coordinator reviewed the project and recommended approval with conditions. Those conditions are summarized in the attached Environmental Memo dated March 1, 2023. Storm Water Maintenance Agreement A Declaration for Maintenance of Stormwater Facilities is required. Site Improvement Performance Agreement A Site Improvement Performance Agreement and securities are required. Findings of Fact-Conditional Use Permit The property is zoned PSP, Public and Semi-Public and allows for schools with a conditional use permit. Per City Code Section 1007.016(3): (e) The Planning and Zoning Board shall hold the public hearing and consider possible adverse effects of the proposed conditional use. Its judgement shall be based upon, but not limited to, the following factors: 1. The proposed development application has been found to be consistent with the design standards listed in City Code Section 1007.020(4). See below. 2. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. The proposed tennis court and parking lot reconstruction will not involve activities detrimental to any person, property, or the general welfare. 3. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. 10 The proposed tennis court and parking lot reconstruction will not result in the destruction of a natural, scenic, or historic feature of major importance. Per City Code Section 1007.020: (4) Performance Standards. Plans which fail to meet the following criteria shall not be approved. (a) The proposed development application must be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. The proposed tennis court and parking lot reconstruction are consistent with the civic (school) land use. (b) The proposed development application is compatible with present and future land uses of the area. The proposed tennis court and parking lot reconstruction is compatible with present and future land uses of the area. The facilities are already existing and are just being relocated on site. (c) The proposed development application conforms to performance standards herein and other applicable City Codes. The proposed tennis court and parking lot reconstruction conforms to City Code performance standards with minor revisions as noted in this staff report. (d) Traffic generated by a proposed development application is within the capabilities of the City when: 1. If the existing level of service (LOS) outside of the proposed development is A or B, traffic generated by a proposed development will not degrade the level of service more than one grade. 2. If the existing LOS outside of the proposed development is C, traffic generated by a proposed development will not degrade the level of service below C. 3. If the existing LOS outside of the proposed development is D, traffic generated by a proposed development will not degrade the level of service below D. 4. The existing LOS must be D or better for all streets and intersections providing access to the proposed development. If the existing level of service is E or F, the developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 11 5. Existing roads and intersections providing access to the proposed development must have the structural capacity to accommodate projected traffic from the proposed development or the developer will pay to correct any structural deficiencies. 6. The traffic generated from a proposed development shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer-financed improvements to correct any street deficiencies. 7. The LOS requirements in paragraphs 1. to 4. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the proposed development project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange. The proposed tennis court and parking lot reconstruction is within the capabilities of the City. Elm Street is a local road and is capable of handling the additional traffic volume generated by the five (5) additional parking spaces. (e) The proposed development shall be served with adequate and safe water supply. The proposed tennis court and parking lot reconstruction does not require a water supply. (f) The proposed development shall be served with an adequate or safe sanitary sewer system. The proposed tennis court and parking lot reconstruction does not require sanitary sewer. (g) The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. The proposed tennis court and parking lot reconstruction does not require City funds. (h) Fire prevention and fighting equipment acceptable to the Board of Fire Underwriters and City Council shall be readily available when any activity 12 involving the handling or storage of flammable or explosive materials is carried on. The proposed tennis court and parking lot reconstruction does not involve any activity involving the handling or storage of flammable or explosive materials. Specific Conditional Use Permit (CUP) Requirements In addition to the above administrative requirements of a conditional use permit, the following specific performance standards of City Code Section 1007.130(8) must also be met: (a) All schools (public and private) provided that: 1. Side yards shall be double that required for the district. The side yard setbacks for the tennis courts and parking lot are more than doubled. 2. Adequate screening from abutting residential uses and landscaping is provided in compliance with City Code Section 1007.043(17) of this ordinance. A six (6) foot high privacy fence with landscaping to the south of the new parking lot will provide adequate screening from the residential lots. 3. Adequate off-street parking and access is provided on the site or on lots directly abutting or directly across a public street or alley to the principal use in compliance with City Code Section 1007.044 and that such parking is adequately screened and landscaped from surrounding and abutting residential uses in compliance with City Code Section 1007.043(17) this ordinance. The tennis courts and parking lots are existing facilities and are just being relocated. Five (5) additional parking spaces are being added to provide adequate off-street parking and access. A six (6) foot high privacy fence with landscaping to the south of the new parking lot will provide adequate screening from the residential lots. 4. Adequate off-street loading and service entrances are provided and regulated where applicable by City Code Section 1007.045. Off-street loading and service entrances currently exist and are not being reconstructed. 5. The provisions of City Code Section 1007.016 are considered and determined to be satisfied. 13 The provisions of City Code Section 1007.016-Conditional Use Permits are satisfied. RECOMMENDATION Staff recommends approval of the conditional use permit and site plan review for Centennial Middle School Tennis Court Relocation and Parking Lot Addition subject to the following conditions: 1. Stormwater from the existing parking lot area drains to storm sewer located in the northeast and southeast corners of the parking lot. The stormwater from both areas ultimately drains through the 399 Elm Street site through private storm sewer to the public pond. The project is proposed to rehabilitate approximately 1.89 acres of impervious surface and add new or reconstruct approximately 0.57 acres on the impervious area, according to the Stormwater Management Report. The surface water from proposed improvements will still ultimately flow to the existing pond, but the applicant is proposing to treat stormwater at the proposed parking lot site through an infiltration basin. The proposed tennis courts include a draintile system that outlets to existing private storm sewer. A geotechnical evaluation report prepared by Braun Intertec was submitted with the application. The report included soil borings which indicated that the native soils in the area consist of very-fine to medium-grained sand and is locally silt-rich. Groundwater was not observed in the borings. The applicant used a HydroCAD model based on the Atlas 14, 24-hour storms to design the storm sewer and infiltration basin. The proposed improvements are designed to reduce site runoff rates for the 2-, 10-, and 100-year rainfall events. Runoff rates for the 10-day snow melt event were not provided at this time and are not required as basin outlets are below the 100-year HWL. WSB staff does not have any comments at this time. • Transportation The proposed improvements are completely within the 399 Elm Street (Centennial Middle School) site and do not affect any public roadways or intersections. A traffic study is not required. The proposed improvements are not anticipated to affect traffic volumes at the site. The proposed parking lot has two access points off of another parking area on the school site. The entrances to the proposed parking lot and the drive lanes are all proposed to be 24-ft wide. All parking stalls are shown at 9 ft x 18 ft. The curb and gutter is proposed as a B612 design along the north and west sides of the lot and a surmountable design along the west and south sides of the lot. The parking lot has five handicap accessible stalls proposed near the west entrance. A bituminous trail is proposed to be reconstructed and realigned with the parking lot improvements. The existing parking lot has a total of 129 parking stalls and the proposed lot has 134 parking stalls. New curb and gutter is proposed along the western edge of the proposed tennis court area. Concrete sidewalk is proposed between the two court areas (four courts to the north and four courts to the south). A bituminous trail is proposed to be reconstructed and realigned with the tennis court improvements. These repairs must be madewithin 24 hours of discovery, or as soon as field conditionsallow access. Previous Council approvals related to the PUD Development Stage Plan include: • June 13, 2016: Resolution No. 16-51 approving PUD Development Stage Plan/Preliminary Plat • October 9, 2017: Resolution No. 17-95 approving Amendment #1 to Land Use Plan • December 11, 2017: Resolution No. 17-133 approving Amendment #2 to Architectural Design Standards 2 • October 14, 2019: Resolution No. 19-131 approving Amendment #3 to Architectural Design Standards ANALYSIS Watermark is a 372 acre master planned residential community consisting of 692 single family lots and 172 townhome units totaling 864 housing units. Lennar is proposing an amendment to the north end of the Watermark PUD Development Stage Plan and Land Use Plan to modify lot sizes and housing product types to address demand changes in the housing market. The proposed amendment does not change any architectural requirements or the total number of housing units. Current Land Use Plan dated August 27, 2018 The current Land Use Plan details 55ft, 60ft, 65ft and 75ft lot widths and associated housing products. • 94 lots @ 65 ft • 67 lots @ 55-60 ft • 1.05 acre private park PUD Concept Plan dated September 9, 2022 On October 12, 2022, the Planning & Zoning Board reviewed the PUD Concept Plan dated September 9, 2022. Those proposed changes included: • 74 townhome units • 6 lots @ 65 ft • 37 lots @ 60 ft • 26 lots @ 55 ft • 18 lots @ 45 ft • 14.7 acres open space Staff comments: • Less street and utility infrastructure maintenance costs to the City • A tot lot shall be included in the townhome private park similar to existing townhome neighborhood • A trail connection shall be added from existing trail to townhome neighborhood then to the north. • The ditch easement along the north lot line of the development shall be shown and accounted for on the lots • All lot sizes shall be continuous buildable land and at a minimize size of Lot Width x 130ft. • Setbacks will remain the same o Front = 25ft 3 o Side = 7.5 ft o Rear = 25ft • All housing products shall meet Watermark architectural standards The Planning & Zoning Board had the following questions and comments. Applicant and staff responses are in italics. • Why is Lennar proposing amendment now? o Forest Lake School District expressing more interest. o Villa product not performing as well as Lennar expected. o Amendment process takes time and all civil plans would need to be revised. • Concern that eliminating the villas homes takes away from the mixed use of housing types • How many 45ft wide do we have now? o None but the original approved Watermark land use plan under Mattamy had 84 lots that were 44ft wide. • Lack of general support for 45ft wide lots. • Additional townhomes would require variation in exterior colors. • The same number of housing units but closer together making it feel denser. • What is PUD benefit? o More open space o Less street and utility maintenance costs for City • General support for dog park and tot lot near townhome neighborhood. • Would garage sizes need to meet previously approved Watermark standards as shown in chart above or the proposed zoning ordinance update of 520sf (20ft wide x 26ft deep)? At the November 7, 2022 Work Session, the Council reviewed the same concept plan and had the following comments: • Lack of support for smaller lot sizes • Potential support for swapping out some of the housing styles (from villa to Heritage and Venture). • Potential support to allow 50 foot lots instead of the 45 foot lots proposed if they were disbursed through the development and not all side by side. • The Council was divided on the change to townhomes. Amendment #4 proposes to change the northeast area of the Watermark PUD to replace Villa Lots with additional Heritage, Venture, and Townhome lot products. Engineering • Erosion Control & Grading The Watermark PUD plans include site grading for the proposed streets, homes, and storm water facilities. PUD Amendment #4 will require an updated grading plan as it is proposed to remove some of the roadways and lots. The switch from Villa lot widths to Heritage and Venture lot widths will also require grading revisions. • Stormwater Management Stormwater management for the northeast area of the Watermark PUD is designed to flow through storm sewer and a series of ponds. PUD Amendment #4 will require revisions to the storm layout and updates to stormwater modeling. PUD Amendment #4 reduces the impervious surface and adds additional open space to the northeast area. The downstream storm sewer systems will be sufficient for the proposed changes. • Water Supply The Watermark PUD proposes 16” water main along Lotus Lane, 12” water main along Rainy Lane, and 8” water main on the other streets within the northeast area. PUD Amendment #4 does not propose any changes to the water main at this time. The proposed 8” watermain will be sufficient to serve the proposed homes and townhomes in PUD Amendment #4. • Sanitary Sewer The Watermark PUD proposes 10” sanitary sewer along Lotus Lane and 8” sanitary sewer on the other streets within the northeast area. PUD Amendment #4 does not propose any changes to the sanitary sewer at this time. The proposed 8” sanitary sewer will be sufficient to serve the proposed homes and townhomes in PUD Amendment #4. Ms. Katie Larsen 10/05/2022 Page 2 Watermark PUD Amendment #4 Engineering Review • Transportation The applicant is proposing to eliminate several legs of proposed city streets and is proposing to add a private street through the townhome area. Street widths, lengths, and profiles will be reviewed with future submittals. • Wetlands and Mitigation Plan Wetlands were delineated for the Watermark PUD development. PUD Amendment #4 does not appear to impact the existing wetlands in this area as the street layout near the existing wetlands in not proposed to change. Wetland impacts will be reviewed with future submittals. • Landscaping Landscaping to be reviewed with future submittals and shall meet City zoning requirements. Landscaping will be reviewed in depth by the City’s Environmental Coordinator. • Floodplain There are no existing floodplains in the area of the proposed PUD Amendment #4. • Drainage and Utility Easements Drainage and Utility easements must meet City Code requirements and will be reviewed with future additions of the plat. • Development Agreement A Development Agreement will be required with any final plats of future additions. • Grading Agreement Grading agreement not required at this time. • Stormwater Maintenance Agreement Stormwater Maintenance Agreements will be required with any final plats of future additions. Public facilities will be covered by the City’s Programmatic Maintenance Agreement. • Permits Required No permits are required at this time. One option for the additional open space would be to establish park in the north near the property line and use the rest for establishment of mesic prairie. A trail could be added through the prairie area to connect with the park in the north. This would require grading the area flat (aside from the berm on the east perimeter) and preparing for seeding. Any new trees required for buffer and/or screening should be kept east of the crest of the berm, keeping the highpoint of the berm free of trees to allow for future management of the prairie area with fire.
