MEETING GUIDELINES
Open Mike – The purpose of a Board Meeting is to accomplish the business of the city. When
presenting at a meeting please remember to be respectful and follow these guidelines:
• Please address the meeting chair.
• State your name and address for the record.
• Please observe a 4-minute limit.
• The topic must relate to city business.
• Open Mike is for items not on the agenda.
• A spokesperson must represent a group of five or more – groups will have 8 minutes.
• The Presiding Officer may limit duplicative presentations.
• Remember, the meeting is to discuss city business only.
Public Hearing – Held as a separate item of business on the agenda. The public hearing
segment is your opportunity to tell the Board how you feel about issues scheduled to be heard.
Typically, a hearing follows these steps:
• The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask
for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings.
• Staff will present their report on the proposal.
• Board members will then ask City Staff questions about the proposal.
• The Presiding Officer will then open up the public hearing for anyone present who wishes to
comment on the proposal. This is the time for the public to make comments or ask questions
about the proposal.
Comments should be limited to four (4) minutes unless further time is granted by the Presiding
Officer. All comments should be directed to the Board as a body and not to any individual Board
Member or City Staff Member unless permission is granted by the Presiding Officer. No person
shall be permitted to enter into any discussion, either directly or through a member of the Board
without the permission of the Presiding Officer.
• After everyone in the audience wishing to speak has given his/her comments, the Presiding
Officer shall close the public hearing.
• The Board will then discuss the proposal. No further public comments are allowed.
• The Board will then make a recommendation(s) and/or a decision.
When you are called upon for your comments, please step to the microphone at the podium and
state your name and address for the record.
Occasionally, the Board may continue a hearing to another meeting before taking action.

The Planning & Zoning Board must preserve order and decorum while the meeting is in
session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings

Vice Chair Root called the Lino Lakes Planning & Zoning Board meeting to order at 6:30
p.m. on May 10, 2023.

seconded by Mr. Wipperfurth. Mr. Root was elected Chair and Mr. Laden was elected
Vice Chair.
5. APPROVAL OF MINUTES
Mr. Kohler moved to approve the March 8, 2023 meeting minutes with one correction.
Motion seconded by Mr. Vojtech. Motion carried 5 – 0. Mr. Laden and Mr. Wipperfurth
abstained.

Mr. Root declared open mike at 6:33 p.m.
There were no public comments.
Mr. Vojtech moved to close open mike. Motion seconded by Mr. Laden. Open mike was
closed at 6:33 p.m. Motion carried 7-0.
ACTION ITEMS
A. Public Hearing Milestones Addition Preliminary Plan and Lil Explorers
Childcare Center Conditional Use Permit
Ms. Larsen presented the staff report.
The applicant, MEP Lino Lakes, is preliminary platting one 1.93 acre commercial lot for
the purpose of constructing a 16,941sf commercial day care facility. The name of the
preliminary plat is Milestones Addition. The name of the day care facility is Lil’
Explorers Childcare Academy.
The Board asked several questions and expressed concern for the possible bottlenecking
that may occur at the only entrance and exit. Ms. Larsen stated the Fire Chief also
expressed concerns and said this entrance/exit will need to be reconfigured to
accommodate the fire trucks.
Mr. Laden asked how current our level of service is and if it was from the time during
covid. Ms. Larsen stated the study is from August 2020. Ms. Larsen said it would be
sufficient for this purpose. Mr. Laden stated his concern was for future projects. Ms.
Larsen said it would be part of their analysis.
Mr. Root asked if there was any concern for people cutting through the gas station
parking lot? Ms. Larsen said if there was, not much could be done at a City level. If
Casey’s came to the City and expressed that there was an issue, they may have to close
the access to Lake Drive. Mr. Root stated that should be part of the analysis at the four
way stop.
Mr. Wipperfurth moved to close the public hearing. Motion seconded by Mr. Vojtech.
The public hearing was closed at 6:58 p.m. Motion carried 7-0.
Mr. Michael Thomas, the Architect, was in attendance. Mr. Root opened up questions
for Mr. Thomas. Mr. Evenson asked him how our new architectural standards impacted
this project. Mr. Thomas said it was more expensive than they typically do. Mr. Thomas
estimated it to be about $200,000 more.

Mr. Evenson moved to approve the preliminary plat subject to the conditions listed in the
staff report. Motion seconded by Mr. Wipperfurth. Motion carried 7-0.
7. DISCUSSION ITEMS
A. Sign Ordinance-Dynamic Display Sign Size
The amended City Code Chapter 1010: Signs ordinance went into effect May 4, 2023.
The amendment included increasing the size of dynamic display signs from 20 sf to 32 sf
with an 8 second hold.
B. Text Amendment-Backyard Chickens
Planning and Zoning member Mr. Wipperfurth requested a discussion item regarding
backyard chickens be added to the agenda. The current zoning ordinance allows for
farm animals such as chickens in rurally zone properties (R-X, Rural Executive). There
are over 8,000 acres of rurally zoned property in the City that allows for farm animals.
The City adopted a new ordinance on January 5, 2023. During the 24 month update
process, there was no interest by the City Council to revise the zoning ordinance to
allow chickens in other zoning districts.
After discussion and review of the material presented, the Board recommended the
discussion move forward to the City Council to review the allowance of chickens in
residential areas with a 6-1 vote. The Board thinks guidelines to be considered are the
number of chickens one could own and to monitor the ratio of chickens to lot size,
where the chickens are kept and how far away from the property line the coup would
need to be constructed. This would be necessitated to govern and mitigate some of the
issues that may arise.
C. Project Updates
Staff provided an update on projects.

BACKGROUND
The applicants, Steve and Rye Gaustad, represent House of Praise, Inc. They are final
platting a one (1) acre outlot into a lot for the purpose of constructing one (1) single
family house. The name of the final plat is Bluebill Ponds Second Addition.

ANALYSIS
History
The subject site is legally described as Outlot A, Bluebill Ponds. The outlot was platted
in 2000 as part of the 77 lot Bluebill Ponds single family residential development. The
developer, Heritage Development, deeded the outlot to House of Praise in exchange for
land to access CSAH 14 (Main Street). House of Praise then owned three (3) parcels
(PID#08-31-22-21-0006, #08-31-22-21-0002, and #08-31-22-21-0084). In 2022, House
of Praise deeded PID#08-31-22-21-0006 (566 Main St church) to Bethel Moldovian
Baptist Church.
Existing Site Conditions
The one (1) acre site is located on Woodduck Trail and will be addressed 580 Woodduck
Trail. The site is currently vacant residential land with grass and trees. Groundwater was
encountered at 10-13ft. Topography is general flat.
Per Sheet S1, Boundary Survey/Preliminary Plat, there are two (2) encroachments (shed
and concrete pad) from 566 Main Street on the subject site. The shed shall be relocated
onto 566 Main Street. A Zoning Permit is required. The deck/stairs concrete pad shall
either be relocated or an Encroachment Agreement shall be drafted by the applicant and
recorded against the property. If the concrete pad is proposed to be relocated, the owner
shall submit a building permit and construction plan prepared by a licensed architect.
PID# 08-31-22-21-0002 is a 10 foot wide strip of land adjacent to 566 Main Street owned
by House of Praise, Inc. This parcel shall be deeded to 566 Main Street (Bethel
Moldovian Baptist Church) and combined into one (1) parcel.

Conformity with the Comprehensive Plan and Zoning Code
The final plat is consistent with the comprehensive plan for low density residential
development and zoning code requirements for R-1, Single Family Residential as detailed
below. No building permits can be issued for an outlot and hence the need to final plat
into a lot and block.

Standard drainage and utility easements at least 10 feet wide have been provided along
the west, east, and south lot lines. A 10 foot drainage and utility easement shall be
provided along the north lot line. These easements shall be shown on all plan sheets.
Public Land Dedication
Park dedication fees were paid in full with the development of Bluebill Ponds based on
value of 10% of the development’s total area which included Outlot A. No additional
park dedication fees are required.

Grading Plan and Stormwater Management
Per the City Engineer Memo dated June 7, 2023, stormwater management for the site was
addressed as part of the original Bluebill Ponds development. No additional water
treatment is required with the site.
Public Utilities
The single family home will be municipally served by an 8” sanitary sewer main and an
8” watermain located along Woodduck Trail.
Tree Preservation and Mitigation Standards
A tree inventory is not required because the only tree removals proposed are within the
basic use area.
Open Areas Landscape Standards
The single family lot does not require open area landscaping.
Buffer and Screen Standards
The single family lot does not require buffer and screening.
Canopy Cover
The single family lot does not require canopy cover.
Foundation Landscaping
The single family lot does not require foundation landscaping.
Sod and Ground Cover Standards
All areas not otherwise improved in accordance with the approved site plans shall have a
minimum depth of 4 inches of topsoil and be sodded including boulevard areas. Seed
may be provided in lieu of sod in certain cases, including when the area is adjacent to
natural areas or wetlands.
The area at the base of the infiltration basin will be seeded with MN DOT 33-261
stormwater mix. The rest of the site will be turf sod, aside from an area northwest of the
infiltration basin that is scheduled for native seeding, though the mix is not specified.
Boulevard Trees

One (1) boulevard tree is required and it should be a bur oak.
Signage
No signage is anticipated with construction of a single family house.
Impervious Surface Coverage
The proposed impervious surface coverage is approximately 8% which is less than the
maximum allowed 65%.
Traffic Study
A formal traffic study is not required. Driveway access will be from Woodduck Trail, a
minor collector road. CSAH 14 (Main Street) is a Principal Arterial road. Both roads are
capable of handling traffic from one (1) single family home.
Environmental Review
No environmental assessment is required for a single family house.
Wetlands
A wetland delineation report was completed by Jacobson Environmental, PLLC on May
1, 2023. A WCA Notice of Decision shall be issued by RCWD prior to release of the
final plat.
Per the report, one basin was delineated outside of the project area on the lot to south of
the subject site. No impacts to this wetland are proposed. The wetland is not part of the
Wetland Management Corridor so no wetland buffer is required.
Shoreland District
The site is not in the Shoreland Management District Overlay of Rice Lake.
Floodplain
There is no FEMA floodplain on site.

Public Safety Comments
Public Safety had no comments on the final plat.

City Attorney
The City Attorney reviewed the title commitment and final plat and had no comments.
Agreements
Stormwater Maintenance Agreement
A stormwater maintenance agreement is not applicable for this site.
Development Agreement
A Development Agreement will be drafted by the City as it relates to the final plat.
Comprehensive Plan
Resource Management System
The Resource Management System Plan goal of preserving surface water quality is
supported by the construction of stormwater management BMP’s such as curb, gutter,
and stormwater pond.
Land Use Plan
The Comprehensive Plan guides this property for low density residential use. The
proposed final plat for a single family house is consistent with low density residential
land use.
Housing Plan
The goals and policies of Housing Plan are met with the proposed final plat for a single
family house.
Transportation Plan
Goals of the Transportation Plan are to ensure that street and roads are as safe as possible
and to reduce unnecessary traffic. Woodduck Trail is a minor collector road and CSAH
14 (Main Street) is a Principal Arterial road. Both roads are capable of handling traffic
from one (1) single family home.
Sanitary Sewer and Water Supply Plan
The proposed final plat for a single family house will be municipally served by an 8”
sanitary sewer main and an 8” watermain located along Woodduck Trail. The existing
sanitary sewer and water supply system have capacity for one (1) single family house.

Findings of Fact-Final Plat
The Planning and Zoning Board shall consider the final plat and the Community
Development Department shall forward the Planning and Zoning Board
recommendations to the City Council. The following requirements shall be met before
consideration of the final plat by the Planning and Zoning Board:
1. The final plat shall substantially conform to the approved preliminary plat and
phasing plan.
The final plat substantially conforms with the preliminary plat.
2. For plats that consist solely of individual single family residential lots, final plat
applications for subsequent phases shall not be approved until building permits
have been issued for 40% of lots in the preceding phase. This division applies
only when the preceding phase consists of 40 or more lots; and
Not applicable. There is only one (1) phase of development proposed with the single
family house.
3. Conditions attached to approval of the preliminary plat shall be substantially
fulfilled or secured by the development agreement, as appropriate.
Securities will be required with a Development Agreement.
RECOMMENDATION
Staff recommends approval of the Bluebill Ponds 2nd Addition final plat with the
following conditions being addressed prior to release and recording of the final plat:
1. As shown on Sheet S1, Boundary Survey/Preliminary Plat prepared by Kurth
Surveying, Inc. revision date May 5, 2023, the following encroachments shall be
corrected:
a.The shed encroaching onto the subject site shall be relocated onto 566
Main Street property.
i.A Zoning Permit is required.
b.The deck/stairs concrete pad shall either be relocated or an Encroachment
Agreement shall be drafted by the applicant and recorded against the
property.
i.If the concrete pad is proposed to be relocated, the owner shall
submit a building permit and construction plan prepared by a
licensed architect.
2. PID# 08-31-22-21-0002 shall be deeded to PID# 08-31-22-21-0006 (566 Main
Street-Bethel Moldovian Baptist Church) and combined into one (1) parcel.
3.A Development Agreement shall be executed.
4. A WCA Notice of Decision shall be issued by RCWD.

5.All comments from the City Engineer Memo dated June 7, 2023 shall be
addressed.
6. All comments from the Environmental Coordinator Memo dated June 7, 2023
shall be addressed.
7.All plan sheets and final plat shall show a 10 ft wide drainage and utility easement
along the north lot line.

Ponds 2nd Addition in Lino Lakes, MN, prepared by Plowe Engineering and received May 9, 2023.
Our comments were made on the following documents:

The following review comments should be responded to in writing by the applicant.
Engineering
•Grading
The Bluebill Ponds 2nd Addition grading consists of grading the original Outlot A from
Bluebill Ponds to create a single-family lot.
Comments:
1.The proposed 909 contour is shown midway across the back of the house
where the lowest opening is proposed at 908.6
•The building pad will need to be raised or the grade will need to be held
up to allow for adequate drainage away from the house in the back
2.Include the driveway grade on the plan
3.The overflow for the depression, currently shown at 906.30, should be at or
slightly below 906.25 per the proposed contours
•Stormwater Management
Stormwater management for the site was addressed as part of the original Bluebill Ponds
development. No additional water treatment is required with the site.

The proposed water will be supplied by the existing 1-inch Type K copper service extended
to the lot.

The proposed sanitary sewer will be supplied by the existing 4-inch diameter Schedule 40
PVC service pipe extended to the lot.

•Transportation
There is no impact to traffic or roads as this plat contains the development of one single
family lot which will not generate significant traffic. Woodduck Lane can handle the
additional traffic volume produced by the single-family lot.
Trails and sidewalks
Private trails have evolved over time within and across the site that can be removed.
The City has no plans to extend trails or sidewalks across the site at this time.
•Wetlands and Mitigation Plan
Wetlands and mitigation plan reviewed during the original Bluebill Ponds Addition. There
are no proposed wetland impacts on the Bluebill Ponds 2nd Addition plat.
•Landscaping
The site is proposing removing three trees as part of constructing the building pad. All
remaining trees are shown as being protected with site grading. The Bluebill Ponds 2nd
Addition Site Landscape Plan has been reviewed by staff and the City’s Environmental
Coordinator. The Environmental Coordinator will provide separate comments.
•Floodplain
The Bluebill Ponds 2nd Addition does not impact the existing floodplain.
•Drainage and Utility Easements
The current Outlot A from the original Bluebill Ponds Addition includes standard drainage
and utility easements (10’ front and back; 5’ sides).

BACKGROUND
Watermark is a 372 acre master planned residential community consisting of 692 single family
lots and 172 townhome units totaling 864 housing units. U.S. Home, LLC (aka Lennar)
submitted a Land Use Application for Watermark 6th Addition PUD Final Plan/Final Plat. The
plat proposes 48 single family lots and 2 outlots.
Previous Council approvals include:
• June 13, 2016: Resolution No. 16-51 approving PUD Development Stage
Plan/Preliminary Plat
• October 9, 2017: Resolution No. 17-95 approving Amendment #1 to Land Use Plan

Design Standards
At the November 7, 2022 Council Work Session, a PUD Concept Plan to amend the Watermark
Land Use Plan was presented to the Council. The amendment proposed converting some of the
villas lots to townhomes and introduced a 45ft wide lot housing product. The applicant, U.S.
Homes, LLC has not submitted a land use application formally requesting to make these changes
and those changes are not part of the 6th Addition.

ANALYSIS
PUD Development Stage Plan/Preliminary Plat
The PUD Development Stage Plan approved by Resolution No. 16-51 establishes Watermark’s
overall land use plan, street and utility layout, parks and open space plan, architectural design
standards, landscaping and lot development standards. These standards are summarized in the
PUD Master Plan Booklet and are incorporated as part of the Master Development Agreement.
Each phase (i.e. addition) of development shall submit a PUD Final Plan consistent with the
PUD Development Stage Plan.
In October 2017, Council approved an amendment to the PUD Development Stage Plan’s overall
Land Use Plan. The Land Use Plan established 871 housing units. As the applicant has worked
through final plan design to address City and RCWD comments from the preliminary plat, the
number of 55’ wide villas was reduced from 127 units to 120 units. The net number of housing
units is now 864.
The net density is 3.39 units per acre and is consistent with the 2030 Comprehensive Plan’s
required 3.0 to 4.5 units per acre.

Grading and Trunk Utility Improvements
Lennar commenced grading and trunk utility improvements in September 2018. Phase I grading
was approximately 140 acres and Phase II grading was approximately 20 acres. Phase III grades
out the balance of the site, approximately 212 acres. The 6th Addition final plat is within the
Phase III grading limits.
PUD Final Plan
Watermark 6th Addition creates 48 single family lots and 2 outlots. The PUD Final Plan is
consistent with the PUD Development Stage Plan in regards to the land use plan, street and
utilities, parks and open space, lot standards and landscaping.
The following housing types and products proposed for the 6th Addition are consistent with the
approved Land Use Plan.

Architectural Standards
Resolution No. 17-133 and Resolution No. 19-131 detail architectural design standards for the
entire Watermark development. As required, a Watermark 6th Addition Home Plans summary
booklet and Architectural Standards Matrix were submitted. The booklet and matrix detail
compliance of the housing products with the resolutions in regards to exterior materials and
styles, house elevations and garage and porch requirements. There are over 8 different single
family house plans with multiple facade and elevation options for a combination of over 50
different housing styles proposed for the 6th Addition.

Color packages and anti-monotony plans will be included with each building permit application
to ensure that the homes elevations are varied with a minimum of five different styles and those
homes in proximity to each other not look alike in terms of the combination of color of siding,
accent and roofing materials. Coventry by Alside vinyl siding with .042” panel thickness is
proposed on all the housing units. All houses have minimum 4” window trim on the side and
rear elevations to meet resolution requirements to incorporate an architectural feature into those
elevations that are visible from 20th Avenue (CSAH 54), 21st Avenue N. and the public park.
In summary, the Watermark 6th Addition single family housing types and products meet the
architectural design standards requirements of Resolution No. 17-133 and Resolution No. 19-
131.
HOA Clubhouse
Lot 1, Block 3, Watermark 4th Addition was platted for the future construction of the HOA
clubhouse. Per the Master Development Agreement, the developer shall construct a private club
house for the use of the residents of the Development once final plat approval for 518 lots has
been granted by the City. With the approval of the 5th addition final plat, there were 613
approved lots.
Per the 5th Addition Development Agreement, “The Watermark HOA clubhouse and related site
improvements shall be completed and operating prior to Council approval of Watermark 6th
Addition PUD Final Plan/Final Plat.” Site and architectural plans for the clubhouse have been
approved and the building permit has been issued. Construction started in May 2023 and should
be completed by late Fall. Staff will evaluate progress on the clubhouse construction before
presenting the 6th Addition PUD Final Plan/Final Plat to City Council for consideration.
Subdivision Ordinance
Conformity with the Comprehensive Plan and Zoning Code
The Watermark 6th Addition final plat has been reviewed for compliance with the comprehensive
plan, zoning and subdivision ordinance. The proposed final plat meets the performance
standards of the subdivision and zoning ordinance and is consistent with the PUD Development
Stage Plan/Preliminary Plat and Final Plan.

Northbound and southbound right turn lanes on CSAH 54 (20th Avenue N) at Rainy Lane are
shown on the turning lane construction plans. Anoka County Highway Department is also
requiring a southbound left turn lane. Plans shall be revised accordingly.
Watermain, sanitary sewer main, stormwater facilities, streets, sidewalks and trails are being
constructed consistent with the PUD Development Stage Plan.

The north 150 acres of the Watermark development is located in Utility Staging Area 1B (2025-
2030). A portion of Watermark 5th Addition and 6th Addition is within this utility staging area.
The City Council shall pass a resolution to allow the development to occur early in a 10-year
staging area.
Public Land Dedication and Fees
As approved with Resolution No. 16-51, the City will require the following combination of land
dedication and cash in lieu of land dedications:
1. Land dedication for the public and private parks will be credited from the total payment
in lieu.
2. Costs for public park improvements and trail construction will be credited from the total
payment in lieu.
3. Improvements to the private parks and recreational center will not be credited from the
total payment in lieu.
An 8.5 ft wide bituminous trail approximately 1,250lf in length will be constructed in the road
right-of-way along 20th Avenue, Rainy Lane and into Outlot B. A Permanent Trail Easement
over the trail section on Outlot B is required. The easement and exhibit shall be drafted and
recorded after the trail has been constructed to ensure the trail is within the easement. Trail
construction costs will be credited. No land is being dedicated in the 6th Addition.

Plans and specs for Watermark Park are complete and construction is scheduled for Spring 2023
with substantial completion by Fall 2023.
Wetlands
Wetland delineations were approved by RCWD and USACE in 2015. The delineation identified
28 wetlands totaling approximately 20 acres in size. The original approved WCA Sequencing

Application proposed wetland impacts, wetland creation, wetland restoration and upland buffer
establishment. In April 2018, the developer revised the application to purchase 3.3671 acres of
wetland banking credits as the proposed compensatory mitigation action. The wetland fill,
impacts and mitigation (wetland bank credits) occurred within the Phase I grading limits and are
complete.
In December 2020, the developer submitted another Wetland Replacement Plan to RCWD for
the balance of the site. Phase 3 grading impacts 5.9784 acres of wetland which require a 1:1
mitigation. The plan was to buy wetland credits for mitigation; however, viable wetland
restoration and creation opportunities exist within Phase 3; therefore, onsite restoration and
creation will be used for mitigation. This is consistent with the Parks and Open Space Plan and
the establishment of the greenway corridor including wetlands, trails and open space.
To date, wetland mitigation and restoration has been completed on Wetland Restoration Area
RA1. Wetland RA2 and RA3 are partially graded. Wetland mitigation and restoration shall be
substantially completed in Restoration Area 2 (RA2) prior to Council approval of Watermark 7th
Addition.
Open Space Easement
Section 7.2 of the Watermark Master Development Agreement states the owner shall provide the
City with a perpetual open space easement. The easement protects the parks, open space,
wetlands etc. from any land disturbance that is not consistent with the Restoration and
Management Plan. Currently, a “blanket” easement is in place that covers all outlots in
Watermark. As each such outlot is further subdivided, the blanket easement area is re-defined
with a detailed open space easement.
An Open Space Easement shall be recorded over Outlot B, Watermark 6th Addition.
The Watermark 6th Addition Final Landscape Plan details the location of required “Protected
Open Space Area” signs.
Development Agreement
Master Development Agreement
A Master Development Agreement was recorded in March 2019. The Agreement covers the
entire 372 acre site and details the terms and conditions of City approvals, the Development
Plans, the required public and private improvements as part of the first and subsequent phase, the
standards for the timing and financing of the improvements, required HOA documents and the
terms of payment.
Development Agreement and Planned Unit Development Agreement

The City will also require our standard Development Agreement specific to each phase of
development. This agreement further details required improvements and securities. The City
Engineer will draft this Agreement and it shall be approved by the City Council.
Per Watermark 5th Addition Development Agreement,
18. c. At the discretion of the City outstanding punch list items from Watermark 1st and 2nd
Addition shall be finalized prior to Council approval of Watermark 6th Addition PUD
Final Plan/Final Plat. This clause shall exclude punch list items identified during the
warranty period.
Per the City Engineer, the street and utility punch list items have been completed. The City will
continue to work with the developer regarding open space and landscaping restoration items.
Securities will not be reduced until these items have been addressed.
Homeowner’s Association (HOA)
The City Attorney reviewed the HOA documents and had no comments.
Title Commitment
The City Attorney reviewed the title commitment and final plat and notes the existence of
several mortgages that either need to be resolved and removed or mortgagees must consent to
plat. The title commitment shall be updated to within three (3) months.
Stormwater Maintenance Agreement
The stormwater facilities will be covered under the City’s Programmatic Stormwater
Management Agreement after they have been installed and accepted by the City.
RECOMMENDATION
Staff recommends approval of the Watermark 6th Addition PUD Final Plan/Final Plat subject to
the following conditions:
1. Outlot B, Watermark 6th Addition is preserved as permanent Open Space and shall be
improved by the Developer in accordance with the approved plans and upon completion
and acceptance by the city of such improvements, they shall be owned and maintained by
a Homeowner’s Association in accordance with an approved Restoration and
Management Plan.
2. A Permanent Trail Easement covering the trail on Outlot A, Watermark 6th Addition shall
be recorded after the trail has been constructed. A copy of the recorded easement shall be
provided to the City prior to Council approval of Watermark 7th Addition.
3. A deed restriction shall be recorded over Lots 2-8, Block 1, Watermark 6th Addition
stating that these lots have limited ability to construct accessory structures due to
drainage and utility easement.

4.Wetland mitigation and restoration shall be substantially completed in Restoration Area 2
(RA2) prior to Council approval of Watermark 7th Addition.
5.Financial securities will not be reduced until City punch list items related to Watermark
1st Addition and Watermark 2nd Addition items have been addressed.
6. The City Council shall pass a resolution to allow the north 150 acres of the development
to occur in Utility Staging Area 1B (2025-2030).
The following comments shall be addressed prior to City Council approval:
1.Title Commitment:
a.The City Attorney reviewed the title commitment and final plat and notes the
existence of several mortgages that either need to be resolved and removed or
mortgagees must consent to plat.

Comments:
1.Shift the highpoint on Rainy Lane near Osakis Street to the centerline of
Osakis Street to eliminate the need for a cross gutter, or applicant to contact
the City Engineer to discuss. Note this comment is tied to Comment 1 in
Stormwater Management.

•Stormwater Management
Stormwater management for the Watermark 6th Addition was reviewed and approved with
the Watermark 4th Addition and the phase 3 grading. This was in coordination with the
RCWD permit approvals. A RCWD permit is in place for the remainder of the development
phases in conformance with the preliminary plat. Any changes to proposed future
development phases would require an amendment to the permits. The stormwater system
includes a storm sewer conveyance system and rear yard drainage systems. Lennar has
rerouted the ACD systems with through the previous grading permits. Associated
easements and restrictions will addressed as development phases proceed.
Comments:
1.Rainy Lane will be designed as a Municipal State Aid street and thus the
stormwater catch basin spacing shall meeting minimum spread and run by
requirements.
2.Applicant to confirm is rear yard drainage system can be within Anoka Co
Ditch easement/that close to drain tile line.
3.Note on plans to coordinate with the property owner (7590 20th Ave) and
show storm sewer/draintile connections.
•Water Supply
The proposed water system extension is consistent with the preliminary plat. This addition
of the development is being served by either 12- inch or 8- inch diameter ductile iron pipe
(DIP) water main with 1-inch Type K copper services being extended to each lot. A future
stub that is fused PVC C900 is being directionally drilled and extended under 20th Ave/
CSAH 54
Comments:
1.The applicant shall space all fire hydrants at a maximum distance of 400 feet
2. The future stub being directionally drilled and extended under 20th Ave/
CSAH 54 will need to be reviewed and approved by the County.
•Construction will need to be coordinated with the County and a County

The proposed sanitary sewer is consistent with the preliminary plat. This addition of the
development is being served by 8- inch diameter poly-vinyl chloride (PVC) pipe along with
4-inch diameter Schedule 40 PVC service pipe to each lot.
•Transportation
The proposed roadways are consistent with the preliminary plat. The work in this addition
includes constructing Rainy Lane, Victoria Circle, Norway Lane (from 5th Addition limits to
Rainy Lane), and Osakis Street. Rainy Lane is proposed to be 36’ wide from back-of-curb
to back-of-curb (this will need to be increased to 38’ wide back-of-curb to back-of-curb),
Norway Lane and Osakis Street are proposed to be 32’ wide from back-of-curb to back-of-
curb, and Victoria Circle is proposed to be 30’ wide from back-of-curb to back-of-curb.
The applicant is proposing to add a designated right turn lane to Rainy Lane from
northbound 20th Avenue (CSAH 54). The applicant is also proposing to add a designated
right turn lane to Rehbein Street for southbound traffic on 20th Avenue (CSAH 54). The
applicant will coordinate with Anoka County as to whether left turn lanes are warranted
from 20th Avenue (CSAH 54) onto either Rainy Lane and/or Rehbein Street.
Trails and sidewalks
Trails and sidewalks are shown extending on both sides of all streets except for Victoria
Circle. The trail extending east from Rainy Lane between Blocks 2 and 3 is shown
terminating with a temporary turnaround that is not required and can be removed.
Comments:
1.The Rainy Lane typical street section needs to be adjusted to be 38’ back-
to-back (minimum 36’ face to face required)
2.Provide truck turning movements for the cul de sac across from Osakis
Street. Verify to see if the cul du sac throat can be narrowed near Rainy
Lane and still line up with Osakis Street to the south
3.Applicant appears to meet typical street light installation requirements (every
400 to 500 ft, at intersections, and at the end of cul-de-sacs)
4.Provide a left through lane and a right only lane at the intersection of Rainy
Lane with 20th Avenue/CSAH 54
5.Applicant to verify whether the pedestrian ramp at the northeast corner of
Rainy Lane and Norway Lane can meet ADA requirements with the steeper
grade (~4%).
6.The culverts at the 20th Avenue intersection shall have a safety grate and
the maximum slope of the ground leading up to them from the road is 6:1.
Coordinate with all Anoka County requirements.
7.Rainy Lane striping is being reviewed and additional information will be
provided by the City Engineer. There will be a no parking area to meet state
aid standards.
8. The mid-block pedestrian crossing shall be removed.

The Watermark 6th Addition Site Landscape Plan has been reviewed by staff and the City’s
Environmental Coordinator. The Environmental Coordinator will provide separate comments.
Comments:
1.Trees shall not be placed over utility pipes. Applicant to review boulevard
tree locations to make sure they are planted an adequate distance (ideally
10 ft) from water and sanitary services.
2.Elevated landscaping (fences, trees, shrubs, etc.) will need to be kept out of
the sight triangles at each of the intersections
•Floodplain
The Watermark 6th Addition does not impact the existing floodplain.
•Drainage and Utility Easements
Roadways are proposed within right-of-way and lots include standard drainage and utility
easements. Larger drainage and utility easements are provided over surface water
management features as required.
Comments:
1.Applicant to provide confirmation that RCWD will allow storm sewer pipe
within their draintile easement along the northern development line.
2.We recommend a deed restriction on the RCWD/Anoka County ditch
easement.
3.On the plat, define the right of way for Rainy Lane as 66’ that is centered 33’
and 33’.

•Stormwater Maintenance Agreement
The stormwater maintenance for public facilities in the Watermark 6th Addition will be
covered under the City’s Programmatic Stormwater Management Agreement after the
facilities have been installed and accepted by the City. Rear yard sump connections are to
be privately maintained.

1.Ensure that trees scheduled to be preserved in Outlot A will be protected by
tree protection fence installed in accordance with the City Tree Protection
Fence Detail.
If the protection fence cannot be maintained at a radius of 1 foot per inch DBH
(diameter at breast height), individual trees for which the protection area
cannot be properly maintained should be removed. In other words, if grading
or other construction activities will encroach into the tree protection fence
area, these individual trees should be removed.
Areas to verify include: Block 1, lots 2-4, 6-8, and 10-11
Block 6, lots 1-4
2.Shift boulevard trees away from the corners to ensure clear lines of sight for
traffic at the intersections of Osakis Street and Osakis cul-de-sac and Rainy
Lane.
