City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike – The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more – groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing – Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. DRAFT MINUTES CITY OF LINO LAKES PLANNING & ZONING BOARD MINUTES 1. CALL TO ORDER AND ROLL CALL Chair Root called the Lino Lakes Planning & Zoning Board meeting to order at 6:30 p.m. on October 11, 2023. 2. PLEDGE OF ALLEGIANCE 3. APPROVAL OF AGENDA The agenda was approved as presented. 4. APPROVAL OF MINUTES Mr. Kohler moved to approve the September 13, 2023 meeting minutes. Mr. Root wanted to change the verbiage in the last paragraph of Action Item A to read “…did not express support for the ordinance text changes”. Motion seconded by Mr. Wipperfurth. Motion carried 6 – 0. 5. OPEN MIKE Mr. Root declared open mike at 6:32 p.m. There were no public comments. Mr. Evenson moved to close open mike. Motion seconded by Mr. Laden. ACTION ITEMS A. Public Hearing: Conditional Use Permit for Agritourism at 1415 Ash Street (Kavan Christmas Tree Farm) Ms. Larsen presented the staff report. The applicant, Stephen Kavan, submitted a Land Use Application for a Conditional Use Permit (CUP) for Agritourism to operate Kavan Christmas Tree Farm on their property located at 1415 Ash Street. Opening the discussion, Mr. Wipperfurth asked if other people currently doing agritourism were grandfathered in? Ms. Larsen confirmed they were and if they wanted a change to the existing CUP, they would need to complete a CUP amendment. Mr. Wipperfurth questioned if other agritourism businesses were using a sign for traffic. Ms. Larsen said it was due to this site being on the “s” curve. Ms. Larsen said she does believe Waldoch Farms, during their peak season, use signage and traffic control. She said it would be case dependent on location. Mr. Wipperfurth questioned the requirement for the room to be open on three sides. Ms. Larsen indicated if it was enclosed it would be a violation of the building code and would cause more work and expense for the applicant. Mr. Wipperfurth disagreed with it being in the CUP. Mr. Laden agreed they would need to change the CUP and obtain a building code permit. Ms. Larsen suggested if the Board wanted the verbiage removed, they could do that. Mr. Laden questioned recommendation #4 and thought the “minor changes” should be removed so that applicant does not have to bring it before the Board and that it could be done administratively. Mr. Kohler expressed concern for traffic and thought it should be addressed if traffic indicated the need for additional control. It should also be added the cost would be absorbed by the tree farm. Ms. Larsen stated this could be added to the CUP. Ms. Hankee suggested that if the traffic gets too much that they be required to put in a turn lane would also be a recommendation. Ms. Larsen believed it was possible to add these recommendations. Mr. Root addressed recommendation #3 and thought there should be a lighted sign to identify the tree farm and lighting at the entrance. Ms. Larsen said the applicant can change the hours of operation so lighting is not needed. Mr. Root would like it added that a lighted sign is required. Ms. Larsen stated it has already been addressed with Anoka County as a requirement. Ms. Hankee said she would explore it further and follow up with Ms. Larsen. Planning & Zoning Board October 11, 2023 Page 3 DRAFT MINUTES The applicant, Mr. Kavan, 1415 Ash Street, conveyed it was his intent to only be open during daylight hours. He also mentioned that the traffic study that was completed was based on weekday traffic. Mr. Root opened the public hearing at 7:05 p.m. Eric Wruck, 1443 Ash Street Lino Lakes, MN 55014. Mr. Wruck’s concerns were regarding the increased traffic, any destruction or trespassing to his property and that he maintains ownership of his property. Mr. Wruck was in favor of the tree farm but does not think a sign will help the traffic situation. Mr. Wruck wanted assurance that the area would be closed off during closed business hours so vehicles would not be lingering in the parking lot. Mr. Kavan stated he had a chain there now but would be using something more substantial. Mr. Wipperfurth moved to close the public hearing. Motion seconded by Mr. Laden. The public hearing was closed at 7:11 p.m. Mr. Laden conveyed the location of the gate should not be part of the CUP. Ms. Larsen agreed that it did not need to be a condition of the CUP. She stated depending on the placement of the gate, the permit would need to be applied for by the owner who owns the property where it was placed. Mr. Wipperfurth wanted to know if Anoka County could put in more formal signage on the brown tourist signs from the County stating “tree farm ahead”. Ms. Larsen said the applicant could inquire with the County. In conclusion, the recommendations from the Board are as follows. • Omitting recommendation #5 • Deleting the word “minor” on recommendation #4 • Adding a recommendation of traffic control when warranted. • Requirement of a lighted entrance and a lighted sign if the hours continued past sundown. • Requested clarification of a changeable sign and for it to include “lighted”. Mr. Wipperfurth moved to approve the conditional use permit subject to the conditions listed in the staff report with the recommendations from the Board. Motion seconded by Mr. Kohler. They are requesting the proposed fence along the north lot line not be required. They are also requesting a pickleball court be constructed in the southwest corner of the development. This staff report is based on review the following plan sets and documents: •PUD Amendment Application, narrative, and photos submitted by the applicant on October 16, 2023 2 Previous Council Action •April 8, 2019: Ordinance No. 07-19 rezoning property from GB, General Business to PUD, Planned Unit Development o Details permitted, accessory, conditional and administrative uses specific to the 20 acre site •April 8, 2019: Resolution No. 19-42 approving PUD Development Stage Plan/Preliminary Plat o Establishes development’s framework in regards to lot and yard requirements, height regulations, impervious surface and design guidelines •May 11, 2020: Resolution No. 20-44 approving PUD Development Stage Plan Amendment #1-Site Plan and Grading & Drainage Plan o This amendment omitted the clubhouse and revised the site plan and grading & drainage plans •July 26, 2021: Resolution No. 20-94 approving PUD Final Plan/Final Plat ANALYSIS North Lot Line Fence A 6ft high wood privacy fence along the north lot line (except across the wetland) is required per the approve PUD Preliminary Plan and PUD Final Plan. See attached Site Plan-North Lot Line Fence. The intent of the fence is to provide a 6ft high screen between any development (Lyngblomsten cottage homes) and adjacent, less intense, residential land uses (Rohavic Lane neighbors). Per the applicant’s narrative, Lyngblomsten would like to omit the installation of the fence because the current topography limits the effectiveness of the fence as a screening tool. Lyngblomsten spoke with the 5 property owners abutting the north lot line (258-298 Rohavic Lane). Four of the property owners stated they were okay with omitting the fence. The property owner at 288 Rohavic Lane would like the fence to be installed. Lyngblomsten is proposing to install additional landscaping in some areas. See attached Applicant’s Narrative for additional information and photos. Pickleball Court Lyngblomsten would like install one (1) pickleball court on the parcel addressed 275 Ash Street, south of the lift station. Per the applicant’s narrative, the court would be for private use by the Lyngblomsten community. The average age of their community is 83 years old. A row of arborvitaes exists along the west lot line. Four (4) black hills spruce trees are proposed along the south lot line. An eight (8) foot tall chain link fence is proposed around the court. Sport courts are allowed in rural and residential zoning districts and performance standards are detailed in City Code Section 1007.043(4)(b). Although Lyngblomsten is zoned PUD, Planned Unit Development and has residential and commercial components, the sport court ordinance 3 requirements can be used as a baseline for discussion. Staff notes the proposed pickleball court will probably be utilized more than a private residential court but not as much as a public court with multiple courts. Sound Per Minnesota Administrative Rule 7030.0040 Noise Standards: NAC Daytime (7:00 a.m. – 10:00 p.m.) Nighttime (10 p.m. – 7 a.m.). 1-Residential L10 = 65 L50 = 60 L10 = 55 L50 = 50 During the one-hour period of monitoring, daytime noise levels cannot exceed 65 dBA for more than 10 percent of the time (six minutes) and cannot exceed 60 dBA more than 50 percent of the time (30 minutes). For reference, 60 dBA is normal speech. The property owner at 255 Ash Street (immediately west of the court) has expressed concern regarding the pickleball court and noise. The house is approximately 47ft from the lot line and the court is 17ft from the lot line for a total separation distance of 64ft. The applicant did not submit a formal noise study. Online research notes pickleball noise can range from 40 to 70 dBA at a distance of 100ft. The City of Shoreview provided comments and suggested using acoustic fence buffering, screening and/or site treatment be required. Environmental Board The Environmental Board reviewed the proposal on October 25, 2023. Staff and the Board provided comments regarding tree species to plant if the north lot line fence is removed. 4 RECOMMENDATION Staff seeks input from the Planning & Zoning Board and the public regarding: 1. Removal of the north lot line fence 2. Installation of one (1) pickleball court a.Shall a noise study be required? b. If supported, should acoustic fence screening be required? The following items shall be addressed: 1. Comments from the Environmental Coordinator Memo dated October 20, 2023 shall be addressed. 2. If removal of the north lot line fence is approved by City Council, the landscape plan shall be revised by a professional landscape architect. Environment Coordinator Memo dated October 30, 2023 North Property Line Fence: The applicant wishes to amend the PUD to omit the installa4on of a fence along the north property line. The current topography of the area limits the effec4veness of the fence as a screening tool. As the property line, that divides the Lyngblomsten townhomes from the proper4es on Rohavic Lane, runs from east to west, the majority of that topography is at a significantly lower eleva4on than the finished floor of the townhomes, making a 6’ privacy fence ineffec4ve as a screening tool. The exis4ng tree line is dense, providing a nice buffer and visual screening between the single-family homes and the new Lyngblomsten development. Proposed addi4onal plan4ngs, some on the Lyngblomsten property and some on the neighboring proper4es, are intended to be installed, as an alterna4ve to the privacy fence and a more effec4ve way to visually screen between the two uses in areas where there is less dense tree coverage. A person standing on the pa4os of the townhomes would stand several feet above the 6’ fence in most of this area. The applicant has had discussions with the property owners of 258, 268, 278, 288 and 298 Rohavic Lane. The property owner of 288 Rohavic Lane originally indicated that he prefers the fence but aOer further discussion, he is reviewing the proposed landscape addi4ons and will let us know if he finds those to be an acceptable replacement for the fence. The other four agree that addi4onal landscaping could be used as an effec4ve alterna4ve for screening, rather than using a fence. Further, a few of the property owners specifically expressed concern about the installa4on of a fence ac4ng as an unnecessary barrier for wildlife. We have aRached several photos to illustrate exis4ng condi4ons, finished floor eleva4ons in rela4on to the exis4ng grade and to show the tree buffer and landscaping that is already in place. The proposed residential development is a 108 lot single family conservation subdivision. The development contains 2 parcels totaling approximately 60 gross acres. It is located north of Natures Refuge and is called Natures Refuge North. The original site was 232 gross acres (approximately 100 acres upland and 132 acres wetlands/conservation easements) and 278 single family units were proposed. A mandatory Environmental Assessment Worksheet (EAW) was prepared because the 278 housing units exceeded the 250 housing unit Environmental Review Record (ERR) threshold. It was determined the project did not have the potential for significant environmental effects and the Council passed Resolution No. 07-06 making a Negative Declaration on the Need for an EIS. The original project did not materialize past the EAW process due to the decline in the housing market and no preliminary plat was ever submitted. A smaller phase of Natures Refuge was approved in January 2022 with 60 single family units on 95 gross acres. This proposed second phase (Natures Refuge North) proposes 108 single family units on 60 gross acres. # Lots Acres Natures Refuge 60 95 Natures Refuge North 108 60 TOTAL 168 155 3 Current Proposal The applicant is proposing the following mix of residential lot widths and housing unit types: Housing Type Lot Width # Units Large Single Family Lots = 80 ft 9 Single Family Lots = 65 ft 39 Single Family Villa Lots = 50 ft 60 TOTAL = 108 The development transitions the larger 80ft wide lots along the west lot line near the existing Arena Acres to the 65ft wide lots to 50ft wide villas as you move east. The villas provide a life cycle housing option with main-level living with association-maintain yards and snow removal. Wetlands and stormwater ponds are integrated throughout the development creating approximately 30 acres (50%) of open space. See the attached applicant’s narrative for a detailed description of the project. Existing Conditions The site is wooded with aspens and oaks dominating the canopy. Several wetlands were delineated on site, included wetlands in the Rice Creek Watershed District Wetland Management Corridor. The site is relatively flat with elevations ranging from 904 to 908 feet mean sea level. A 100ft wide natural gas pipeline easement runs from the northeast corner to the southwest perimeter. Arena Acres to the west is a large lot (>1 acres lots) residential subdivision that was platted in 1981. Pine Oaks Addition to the east was platted in 1980 but never developed. Surrounding Zoning and Land Use Direction Zoning Current Land Use 2040 Future Land Use North R, Rural Rural Residential Urban Reserve South PUD (Natures Refuge) Single Family Residential LDR, Low Density Residential East R-1, Single Family (Pine Oaks Addition) Vacant Residential LDR, Low Density Residential West R, Rural (Arena Acres) Rural Residential Urban Reserve 4 Comprehensive Plan and Housing Density Planning District #2 The site is located in Planning District 2 which identifies Natural Resources such as Woolan Park. The Comprehensive Plan states: “The 17 acre Woolan Park Wetland Bank, located north of Main Street and west of Lake Drive, is part of a larger 60 acre wetland complex. Opportunities to protect and restore the balance of the wetland should be evaluated with any adjacent development.” The proposed development is adjacent to this wetland complex. The site also contains other wetlands and natural resources such as existing vegetation and trees and potentially rare and endangered species. The PUD, Planned Unit Development process provides the opportunity to protect and enhance these public values (natural resources) with a conservation subdivision and development standard flexibility. Density Per the City’s 2040 Comprehensive Plan the site is guided for low density sewered residential development which requires 1.6 to 3.0 units per net acre. The range of the allowed housing units is 72 to 135. The proposed net density is 2.41 units per acre which is consistent with the Comprehensive Plan’s guided land use and density range. The following chart implements Met Council’s formula for calculating net density. The R-X zoning is a holding district until municipal water and sanitary sewer are available to develop the site. The property would need to be rezoned to PUD, Planned Unit Development in order to allow for a variety of lot widths, lot sizes, and housing types. A summary of PUD public benefit vs PUD flexibility is provided at the end of this staff report. Conventional Zoning Requirements vs. PUD Guidelines Per City Code Section 1007.024(4) for PUD, Planned Unit Development, the development guidelines for land guided low density residential development are either R- 1, R-1X, or R-2. The following chart is from the applicant’s narrative. It uses the R-2, Two Family Residential as the development guideline; however, the R-1, Single Family Residential requirements could be applied to the Large Single-Family Lots (80ft wide x 135ft deep). Per the subdivision ordinance, minimum lot area for urban lots shall consist of buildable land exclusive of utility transmission easements or water course easements that encumber lot development. 6 The Large Single-Family lots (80ft wide) appear to meet to the R-1, Single Family Residential district requirements. The Single-Family Lots appear to exceed the R-2, Two Family Residential requirements except for side and corner lot setbacks. The Villa Lots require the most PUD flexibility in regards to lot width, size, and setbacks. Building Design Standards The applicant’s narrative details the requested flexibility from the City’s building design standards. General Building and Use Provisions: Single Family Detached Dwellings Per City Code Section 1007.043(2)(a): 3. All dwellings shall have a garage that is a minimum of 20 feet in width and has a minimum footprint of 520 square feet. The proposed Villas homes are 19.5ft wide and 400sf. R-2, Two Family Residential District These requirements would be applied to the Single Family and Villa lots. The Large Single Family lots meet the R-1 zoning requirements which do not have these garage standards. Per City Code Section 1007.092(4): (b) Garages. All single family dwellings shall have a garage and shall comply with the following: 1. Compliance with the Building Type and Construction Standards of City Code Section 1007.043(2); and 2. All garages, except side or rear loaded garages, shall not protrude forward of the front wall of the house, unless the house includes a front porch that is unenclosed, a minimum of six (6) feet in depth, and extends across 100 percent of the front façade of the house. The garage shall then not protrude forward of the front porch, and 3. If the garage door faces the street, the length of the garage wall facing the street shall not be greater than 50 percent of the length of the entire front façade of the structure; except on houses that comply with all of the following conditions: a. The second floor living space extends over the two-car portion of the garage; and b. The garage doors are decorative and have a strip of windows; and 7 c. Garages in excess of two (2) stalls shall be broken up so the additional stalls are recessed two (2) feet from the main garage façade; and d. Garage width does not exceed 32 feet. The applicant is requesting the garage be allowed to protrude forward of the front wall of the house and the garage wall be allowed up to 67% of the length of the entire front façade. The applicant notes similar flexibility was provided in the Watermark development. The applicant submitted nine (9) single family house plans and 15 villa house plans. Each plan set then has 4 or 5 different elevation choices for a total of over 100 different house plans and elevation options. Staff Comment: 1. The R-2 zoning ordinance at the time of Watermark approval required 8ft deep porches and flexibility was provided to reduce down to 6ft. Ordinance 08-22 adopted in January 2023 changed the 8ft requirement to 6ft. The Watermark homes meet the current 6ft porch requirement. 2. PUD flexibility was allowed for 67% garage wall in Watermark for one-story, single level homes, not single family (multi-level) homes. Subdivision Ordinance Blocks and Lots The proposed development provides a mix of single family lots. The lots vary in width, depth and lot size as may be allowed per the PUD flexibility. Outlots would contain wetlands, buffers, stormwater ponds etc. Staff Comments: 1. All lots on the west side of Street A should be 80ft wide lots. 2. A protected tree buffer shall be established along the west and north lot lines. The width of the buffer should be a minimum of 25 ft wide but could be greater depending on existing trees and tree protection zones. Staff suggests this buffer be contained in an outlot owned and maintained by the HOA. 3. A ghost plat shall be submitted showing street and lot layouts north and east of the proposed development. Streets and Alleys 8 Street A (Haywood Drive) is identified as a minor collector road in the Transportation Plan and provides a north-south corridor from CSAH 14 (Main Street) to eventually Pine Street. All proposed street right-of-way widths are 60ft and the paved surface appears to be 32ft wide. Street E shall connect to Andall Street. Arena Acres was platted in 1981 and a 60ft wide Outlot B was platted for future road connection to the east. This outlot is owned by the City. The extension will connect the neighborhoods and transportation system. This standard transportation practice has been implemented throughout the City such as the Saddle Club connection to Fox Road and the St. Clair Estates connection to Hokah Drive and Sioux Lane. The Andall Street connection is supported by Lino Lakes Public Safety-Police Division and Fire Division in order to provide faster and more direct emergency response to the entire area. The connection is also supported by Public Works to provide better efficiency for street maintenance and snow plowing. This street connection is further supported by the following City Code Sections: § 1001.096 LAND REQUIREMENTS. (2) Proposed subdivisions shall be coordinated with surrounding properties and/or neighborhoods so that the city as a whole may develop efficiently and harmoniously. § 1001.100 STREETS AND ALLEYS. (3) Streets, continuous. Except for cul-de-sacs, streets shall connect with streets already dedicated in adjoining or adjacent subdivisions or provide for future connections to adjoining unsubdivided tracts, or shall be a reasonable projection of streets in the nearest subdivided tracts. The arrangement of thoroughfares and collector streets shall be considered in their relation to the reasonable circulation of traffic, to topographic conditions, to runoff of storm water, to public convenience and safety, and in their appropriate relation to the proposed uses of the area to be served. Staff Comments: 1. Street A and Street C shall be a stronger north-south collector street. 2. Street A north of the gas line easement should “T” into the collector street. 3. Street right-of-way shall be a minimum of 60 ft wide. The paved road surface widths may be reduced in the cul de sacs. 4. Cul de sacs shall not exceed 500 ft in length and bulbs shall meet City standards. 5. A traffic study shall be required. 6. Trails and sidewalks shall be incorporated throughout the development. Easements Staff Comments: 9 1. Standard drainage and utility easements at least 10 feet wide shall be provided along all lot lines. 2. Drainage and utility easements shall also be dedicated over stormwater management facilities. 3. Oversized easements for stormwater management may not be included in the minimum established lot size. 4. Conservation easements and wetland buffers shall be required over wetlands and greenway corridors. Stormwater Management and Erosion and Sediment Control The concept plan shows several stormwater management facilities, ponds, and wetlands throughout the development creating a multi-functional greenway corridor. Staff Comments: 1. Street D should be flipped to the north and a larger open space/stormwater pond created in the southeast quadrant of the site. This will result in more buffer protections to the Woolan Park wetland complex and less tree impacts and mitigation in the northeast quadrant. 2. The multi-functional greenway corridor shall incorporate trails and open space into the development. The trail shall extend from the existing trail in Natures Refuge around the north side of the pond in Outlot B, Natures Refuge and throughout Natures Refuge North and eventually connect to Andall Street. Utilities Public water, sanitary and storm sewer utilities will be installed within the development. Water and sanitary will extend north along Haywood Drive. The site is located in Sanitary Sewer District 2 (Sub-district 2K). Flow is collected southward to MCES Meter M211 and Gravity Interceptor 8361 along North Road which passes southwest through Circle Pines. PID# 05-31-22-42-0003 is located in Utility Staging Area 1A (2018-2025) and PID#05- 31-22-13-0001 is located in 1B (2025-2030). By resolution, the Council may move the one (1) parcel from Stage 1B (2025-2030) to Stage 1A (2018-2025). Municipal sanitary sewer and water also gets extended closer the Olive and Orange Street neighborhood which are smaller (<0.5 acre) lots on private septic systems and wells. Parks, Greenways and Trail Plan Per the City’s 2040 Parks, Greenways and Trails Plan, this development is within the Arena Acres and Wollan Park service areas. Arena Acres is a smaller 1 acre neighborhood park. Wollan’s Park is an 18 acre open space wetland and not an active 10 park. The Plan indicates a Future Neighborhood Park centrally located within the service area. The Park Board reviewed the concept plan on November 1, 2023. The Board recommended a 100% cash dedication in lieu of dedicating land for a neighborhood park. The cash dedication could be utilized for trails, providing leisure opportunities at Lino Lakes Elementary, and making enhancements to Arena Acres Park. Staff Comments: 1. The multi-functional greenway corridor shall incorporate trails and open space into the development. The trail shall extend from the existing trail in Natures Refuge around the north side of the pond in Outlot B, Natures Refuge and throughout Natures Refuge North and eventually connect to Andall Street. 2. A public value gained with a PUD is more fees collected through negotiated parkland dedication. Typically in a PUD, only parkland dedication and trail construction costs are credited back to the developer. The actual land costs of the 20ft wide trail corridor land is not credited back to the developer. This results in more parkland dedication fees collected by the City to be utilized in developing the park system. For example, in Natures Refuge approximately 2,350lf of trail were constructed. The approximate one (1) acre trail corridor (2,350lf x 20ft wide) is valued at approximately $50,000 that the City was able to collect and not credit back to the developer. Tree Preservation and Landscaping A Tree Preservation Plan and Landscape Plan in compliance with Section 1007.043 (17), Required Screening, Landscaping and Buffer Yards shall be submitted. Additional landscaping may be required as a condition of the PUD. Traditional/Conventional Development vs Conservation Development A traditional or conventional development uses the standard zoning district requirements that can result in a street grid development. Per City Code Section 1007.007: Subdivision Ordinance Definitions CONSERVATION DEVELOPMENT. The development pattern and technique whereby lots are arranged in closely related groups to preserve the natural amenities of the land through the creation of common open space. Per City Code Section 1001.026: (4) Yield plan. If the project includes a conservation subdivision or planned unit development, the applicant shall submit a yield plan showing the maximum number of dwelling units that would be permitted given the minimum lot size and lot widths for 11 conventional subdivisions and other requirements of the Lino Lakes Zoning and Subdivision Chapters. A conservation development is the same as a conservation subdivision. The applicant submitted a yield plan utilizing a similar street layout and 80ft wide lots. The plan generated 69 single family lots and a net density of 1.52 units per acre. This does not meet the required low density residential range of 1.6 to 3.0 units per acre. Additional lots would be required resulting in potentially greater wetland impacts. Another yield plan could have been submitted showing the maximum number of R-2 twins homes (approximately 135 units) that would be permitted using traditional zoning requirements. Attached is another example of a Traditional Development vs Conservation Development of the original 2006 Natures Refuge Concept Plan. The Traditional Development has 300 lots that extend into the wetlands, stormwater ponds, woodland areas, and open space and provides limited protection or public access to these amenities. The Conservation Development has 278 smaller lots that creates more protected accessible public open space and establishes the greenway corridor. The trail system in the conservation development is also incorporated into the greenway system vs. along the street creating a more enjoyable, safer, and valued recreational experience. The purpose of using the PUD zoning is to create a conservation development that establishes the defined public values of preserving and enhancing the on-site natural resources. The PUD also creates and enhances the greenway corridor and trails that are accessible to the public. Environmental Review Record As previously noted, in 2006 a mandatory Environmental Assessment Worksheet (EAW) was prepared for the original Natures Refuge concept because the proposed 278 housing units exceeded the 250 housing unit threshold. The EAW thoroughly analyzed potential impacts to wetlands, rare plant and animal species, floodplain, water quality, noise, traffic and archeology. It was determined the project did not have the potential for significant environmental effects and the Council passed Resolution No. 07-06 making a Negative Declaration on the Need for an EIS. The scope and size of the existing Natures Refuge and proposed Natures Refuge North (168 housing units on 155 gross acres) is smaller than the original 2006 proposal (278 housing units on 232 gross acres). A revised EAW is not required because the 168 housing units do not exceed the 250 housing unit threshold. 12 # Lots Acres Natures Refuge 60 95 Natures Refuge North 108 60 TOTAL 168 155 Wetlands Per the Wetland Delineation Report, thirteen (13) wetlands were delineated on site totaling 7.17 acres. As shown on the Wetland Buffer Exhibit: Acres Total Wetlands 7.17 Total Wetland Impacts 1.14 Wetland Buffer (Ave. 50ft) 4.24 Wetland Buffer (10ft min.) 1.32 Some of the delineated wetlands are in the Rice Creek Watershed District (RCWD) Wetland Management Corridor. Wetlands preserved on site will have to meet RCWD and City buffer requirements. Impacts will require mitigation and will be reviewed by RCWD. Floodplain There is no FEMA floodplain on site. Shoreland District The site is not located within the Shoreland Management Overlay District. Additional City and Government Agency Review Comments Lino Lakes Public Safety The Police Division supports connection to Andall Street. The connection is important for public safety response to and from the development. The Fire Division also supports the Andall Street connection to improve response times to the entire area. Environmental Board 13 The Environmental Board reviewed the PUD concept plan on October 25, 2023. General comments included the need for a rare plant and animal survey, tree preservation, wetland protection and restoration. Park Board The Park Board reviewed the concept plan on November 1, 2023. The Board recommended a 100% cash dedication in lieu of dedicating land for a neighborhood park. The cash dedication could be utilized for trails, providing leisure opportunities at Lino Lakes Elementary, and making enhancements to Arena Acres Park. City Engineer The City Engineer provided comments in the attached letter dated November 1, 2023. PUD Preliminary Plan/Preliminary Plat The City’s review and comments on the concept plan’s relation to the Comprehensive Plan and development regulations does not grant any rights to the applicant to develop the property as depicted by the concept plan. A land use application for PUD Preliminary Plan/Preliminary Plat shall be required. The developer should have a neighborhood meeting prior to submittal of a PUD Preliminary Plan/Preliminary Plat. PUD Public Benefit vs PUD Flexibility Summary Per City Code Section 1007.024: (2) The PUD, by allowing deviation from the strict provisions of this ordinance related to setbacks, heights, lot area, width and depths, yards, etc., may be considered by the City when it would result in one or more of the following public benefits: (a) Implementation of a master plan consistent with the Planning District objectives of the Comprehensive Plan. The need for a formal master plan was not identified for this area in the 2040 Comprehensive Plan. The proposed development is consistent with the 2006 EAW concept plan for low density single family residential conservation development. (b) Innovations in development that address growing demands for all styles of economic expansion, greater variety in lot size, configuration, home type, design, enhanced architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. 14 The applicant is proposing a conservation development with a mix of residential unit types on varying lot sizes. The villas provide a housing option with main-level living with association-maintain yards and snow removal which addresses life-cycle housing. (c) Preservation and enhancement of desirable site characteristics such as wildlife habitat, unique natural resources, existing vegetation, natural topography, geologic features and reduction of negative impacts on the environment. The conservation development preserves and enhances desirable site characteristics by minimizing wetland, woodland and rare plant species impacts. (d) Creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. The applicant is proposing single family detached lots adjacent to existing single family detached lots. The development transitions the larger 80ft wide lots along the west lot line near the existing Arena Acres to the 65ft wide lots to 50ft wide villas as you move east. (e) Efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. The configuration of the lots preserve as many wetlands as possible and avoids a gas line easement that spans the site diagonally which results in a smaller network of utilities and streets. (f) Mix of land use types. There is no mix of land use types. (g) Provision of a housing type or target housing price that is desirable to the City. The villas provide a housing option with main-level living with association-maintain yards and snow removal which addresses life-cycle housing. (h) Other public benefits and values as recognized in the City’s Comprehensive Plan. • Planning District 2 identifies Woolan Park as a natural resource that should be protected. The proposed development strategically includes a stormwater pond/open space buffer near the Woolan Park wetland complex. • A goal of the sanitary sewer plan is to provide service and capacity to developed areas of the city currently served by on-site systems. Municipal sanitary sewer and water also gets extended north which will eventually serve the Olive and Orange Street neighborhood which are smaller (<0.5 acre) lots on private septic systems and wells. 15 • A goal of the Parks, Greenways & Trails Plan is to established greenway corridors. A multi-functional greenway corridor incorporating stormwater management, trails and open space is established with the development. Summary Public Benefit Gained: 1. Conservation development with a mix of residential house types on varying lot sizes that protects and enhances the on-site natural resources such as wetlands, woodlands, rare plant species, and open space that are accessible to the general public. 2. Main-level living with association-maintain yards and snow removal which addresses life-cycle housing 3. Preserved wetlands and established wetland buffers/conservation easements 4. Orderly transition from existing large lot single family neighborhood to smaller single family detached lots 5. Efficient use of land resulting in smaller network of utilities and streets 6. Protection of Woolan Park wetland complex 7. Extension of sanitary sewer to eventually serve Olive and Orange Street neighborhood currently served by on-site systems. 8. The proposed concept plan proposes 108 lots on an approximately 59.30-acre site. ABOUT M/I HOMES M/I Homes has been in business for over 40 years and has built over 140,000 homes in 17 markets within the United States. We entered the Twin Cities Market in 2015 by purchasing Hans Hagen Homes. Hans Hagen Homes was founded over 50 years ago and was one of the largest and oldest home builders in the Minneapolis market. PLANNED UNIT DEVELOPMENT We are requesting a PUD for this development in order to provide a variety of housing types. Our development to the south, Natures Refuge, has 80-foot-wide lots, and this proposed development will provide opportunity for those who desire smaller lots with less maintenance. The villa lots will also provide a housing option with main-level living with association-maintained yards and snow removal. The City of Lino Lakes allows for development through a PUD if it results in public benefit as outlined in the City’s PUD ordinance. We believe this proposed development provides the following public benefits: • Addressing growing demands for all styles of economic expansion, greater variety in lot size, configuration, home type, design, enhanced architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. As previously mentioned, the site offers a variety of lot sizes to accommodate the different needs and desires of our customers. Additionally, the main-level villa homes that have association-maintained yards and snow removal are popular with our senior buyers who are looking for a more care-free living lifestyle. The configuration of the lots works to preserve as many wetlands as possible and avoids a gas line easement that spans the site diagonally. • Preservation and enhancement of desirable site characteristics such as wildlife habitat, unique natural resources, existing vegetation, natural topography, geologic features and reduction of negative impacts on the environment. As mentioned, the site design works to preserve as many wetlands as possible. We believe the general requirements for a PUD are met in the following ways: • Public or common open space to meet minimum requirements established in the ordinance. The site provides approximately 30 acres of open space. • If PUD includes preservation of natural habitat, those habitats shall be permanently protected through a conservation easement or other legally binding agreement. We recorded a conservation easement and WMC Buffer Declaration in Natures Refuge and are willing to record similar documents against the open space. • Homeowners Association Required. The lots will be governed by a homeowner’s association (HOA) as further explained below. SITE PLAN The proposed development has a total of 108 lots consisting of nine 80-foot-wide single-family lots; 39 65- foot-wide single-family lots; and 60 50-foot-wide villa lots. The following table compares the proposed standards to the Two Family Residential (R-2) zoning district. The site is currently zoned Rural Executive (R-X). The proposed plan takes care to avoid as many wetlands as possible and contemplates a 100-foot-wide gas line easement spanning the site diagonally. GARAGE ARCHITECTURAL STANDARDS AND SIZE In addition to the flexibility in standards outlined above, we are requesting flexibility from garage requirements outlined in Sections 1007.043: R-2, Two Family Residential District and 1007.043: General Building and Use Provisions. Below outlines the standards from which we are requesting flexibility and the reasoning behind the requests. Requested Flexibility for Villa (One-Story) Lots • Standard (1007.043(2)(a)(3)): All dwellings shall have a garage that is a minimum of 20 feet in width and has a minimum footprint of 520 square feet. o Request: We are requesting a minimum garage width of 19.5 feet and a minimum footprint of 400 square feet for our villa homes. The garages on our single-family homes meet these city standards, and so we are only requesting this flexibility on the villa lots. M/I Homes understands that Lino Lakes has this regulation in order to avoid outdoor storage of extra vehicles, boats, trailers, etc., but we do not foresee this to be an issue in these homes. First, many of these The Homeowners Association that establishes the rules and regulations for this community strictly prohibits the use of garages solely for storage. It requires the parking of at least one automobile in the garage and that trailers and other recreational equipment be kept in garages when not in use. The association is responsible for the enforcement of these rules, and so enforcement by the city would not be required. The association also provides snow and lawn care, so the need for storage is reduced compared to a single-family home where there may be more than two cars and the need for storing lawnmowers, snowblowers, etc. Additionally, villa home buyers are more often than not empty nesters, snowbirds, or single owners. Therefore, it is not common for these households to have more than two cars, so there is less need for storage than a nuclear family might have. Finally, many of our villa plans have attics in the garages for additional storage. Requested Flexibility for both Villa (One-Story) and Single Family (Multi-Story) Lots • Standard (1007.092 (4)(b)(1): All garages, except side or rear loaded garages, shall not protrude forward of the front wall of the house, unless the house includes a front porch that is unenclosed, a Natures Refuge North Concept Plan Submittal Page 3 minimum of six (6) feet in depth, and extends across 100 percent of the front façade of the house. The garage shall then not protrude forward of the front porch. o Request: We are requesting that this standard be waived. M/I Homes has several elevations for each floor plan that provide enhanced architectural features that allow for visual interest throughout the community. We offer a wide variety of materials and colors to break up the façade. This is an extension of the existing Natures Refuge, and we want to create a cohesive neighborhood that will be pleasing to the homeowners. Additionally, the Watermark development was granted similar flexibility with their garages, which is appropriate when introducing different housing styles. • Standard (1007.092 (4)(b)(2): If the garage door faces the street, the length of the garage wall facing the street shall not be greater than 50 percent of the length of the entire front façade of the structure; except on houses that comply with all of the following conditions: o The second floor living space extends over the two-car portion of the garage; and o The garage doors are decorative and have a strip of windows; and o Garages in excess of two (2) stalls shall be broken up so the additional stalls are recessed two (2) feet from the main garage façade; and o Garage width does not exceed 32 feet.  Request: We are requesting that this standard be amended to allow garage walls to be up to 67% of the length of the entire front façade. M/I Homes has internal anti- monotony rules in our communities to ensure a wide variety of elevations and finishes that result in a pleasing streetscape. The garage doors will be decorative and have a strip of windows, and garages in excess of two (2) stalls will be offset by a minimum of two (2) feet. This will apply to all lots. This is also a flexibility that has been granted in the Watermark development. ELEVATIONS Example elevations of our single-family and villa product have been provided. These are just an example of the many elevations we offer. We also have anti-monotony requirements to ensure that very similar elevations are not adjacent to one another within the community to preserve visual interest. DENSITY The total site area is 59.30 acres with 6.05 acres of wetlands and 4.31 acres of wetland buffers. The planned density for this area is 1.6-3 units per acre. Netting out wetlands and wetland buffers, we are proposing a density of 2.21 units per acre, well below the maximum-allowed density. Netting out the gas line easement, which is 3.45 acres, we are at a density of 2.41 units per acre, however, the Metropolitan Council does not net out utility easements when calculating density. The wetlands and their required buffers as well as the gas line easement create a challenge in being able to meet the required minimum density without creating smaller lots. With this site plan, 80-foot lots would yield 69 lots as shown in the Yield Plan Density Exhibit, which would result in a density of 1.52 units per acre, which is below the minimum density planned for this area. RESTRICTIVE COVENANTS The development will have an HOA that will provide for the maintenance of the overall common elements in the community, including landscaping of the common areas as applicable and management of the natural resources. The HOA will also provide lawn care and snow removal for villa lots. Our comments were made on the following documents: •Natures Refuge North Concept Plan prepared by Carlson McCain, dated October 2, 2023. The following review comments should be responded to in writing by the applicant. Engineering •General The Natures Refuge North Addition is the second phase of the overall Natures Refuge development which includes 60 acres north of CSAH 14 (Main Street), west of CSAH 23 (Lake Street) and east of Wood Duck Trail. The current conceptual project proposes 48 single family houses, 60 villa lots and associated infrastructure. This property was originally part of a larger development of which an Environmental Assessment Worksheet (EAW) was prepared. The evaluation concluded that the project did not have the potential for significant environmental effects. •Grading The Natures Refuge North Addition includes site grading for the 108 units as well as extensions of Haywood Drive and three local streets that are yet to be named. •Stormwater Management Stormwater management for the Natures Refuge North Addition has not yet been proposed and will need to be submitted for preliminary plat by the applicant. It is anticipated that the development will include a storm sewer conveyance, rear yard drainage, and ponding systems, consistent with the original Natures Refuge development. The systems shall meet the City’s and Rice Creek Watershed District’s (RCWD) Stormwater Management requirements. Attachment 8: City Engineer memo - Natures Refuge North Ms. Katie Larsen 11/01/2023 Page 2 Nature Refuge North Addition Engineering Review •Water Supply Water supply for the Natures Refuge North Addition has not yet been proposed and will need to be submitted for preliminary plat by the applicant. It is anticipated that the existing 16” DIP trunk main on Haywood Drive will need to be extended north through the development to the eastern boundary similar to what is shown in the City’s 2040 Comprehensive Plan. A 12” stub will need to be extended to the west towards Arena Acres and Andall Street. Otherwise, the development will include a water system with predominately 8- inch diameter ductile iron pipe (DIP) water main with 1-inch Type K copper services being extended to each lot, consistent with the original Natures Refuge development. •Sanitary Sewer Sanitary sewer collection for the Natures Refuge North Addition has not yet been proposed and will need to be submitted for preliminary plat by the applicant. It is anticipated that the existing 10- inch diameter poly-vinyl chloride (PVC) trunk main on Haywood Drive will be extended north to serve a portion of the proposed addition. The remainder of the addition will need to be evaluated by the applicant as to whether a lift station as shown in the City’s 2040 Comprehensive Plan is necessary. If necessary, the lift station will need to be oversized to accommodate the remaining sanitary sewer district 2K and a portion of 2A. Oversizing costs for the lift station will be credited by the City. The site will otherwise be served by 8- inch diameter main along with 4-inch Schedule 40 PVC service pipe to each lot. Additional sanitary sewer stubs will be extended to the west, north, and east. The proposed sanitary sewer is consistent with the with the original Natures Refuge development. •Transportation A general street layout has been proposed with the Concept Plan. The City of Lino Lakes Comprehensive Plan calls for neighborhood connections and to that end the applicant is showing a connection to Andall Street in the westerly Arena Acres neighborhood. The City’s Engineering and City Public Safety departments submit that the roadway connection to Andall Street shall be constructed. The roads stubbed to the north and east development limits will need to be evaluated for feasibility with future connections and potential wetland impacts. The Pine Oaks Addition that will be connected to in the east has been previously platted and is anticipated that it would likely be replatted as many of the conditions and requirements have changed. Trails and sidewalks Trails and sidewalks are not shown on the submitted Concept Plan. One will need to be submitted and reviewed by staff and the City’s Environmental Coordinator. The Environmental Coordinator will provide separate comments. •Floodplain The Natures Refuge North Addition does not impact the existing floodplain. •Drainage and Utility Easements Roadways are proposed within right-of-way and lots include standard drainage and utility easements. Larger drainage and utility easements will be required to be provided over any utilities outside the right of way and any surface water management features •Development Agreement A development agreement will be required with the final plat. •Grading Agreement Grading agreement not required at this time. •Stormwater Maintenance Agreement The stormwater maintenance for public facilities in the Natures Refuge North Addition will be covered under the City’s Programmatic Stormwater Management Agreement after the facilities have been installed and accepted by the City. Borrow areas / Lakes area will be maintained by the HOA. •Permits Required Required permits will be determined at the time of preliminary plat submittal. A new rare plant and animal survey must be completed for the project area. 2.If rare species are found on site, design layout should be revised to avoid impacts to these species. 3.If rare species are found on site and impacts are unavoidable, include features that minimize impacts (ex: buffers around rare plant locations for any that can be preserved, surmountable curbs to facilitate Blanding’s turtle movement, restoration of undisturbed project areas). DNR permits may be required for any impacts to rare species. 4.Coordinate with the Rare Plant Rescue group (contact Carrie Taylor at Anoka Conservation District) to allow for transport of any rare plants for which impact is unavoidable to a donor site, such as Wollan’s Park Wetland Bank in Lino Lakes. 5. A tree survey and inventory must be completed. 6.Preserve as many trees as possible, particularly along the west and north perimeters of the site to provide buffer and screening between project site and existing residential lots. Tree protection zones in accordance with the City Tree Protection Fence Detail must be shown for all trees that are being preserved. These zones must be shown on the Tree Preservation Plan and Grading Plans submitted at the Preliminary Plat phase. 7. Consider restoration of upland and wetland areas as a community benefit. Impacts to trees, wetlands, and rare plants and animals should be avoided or minimized wherever possible. DATE: November 2, 2023 TO: Katie Larsen, City Planner FROM: Rick DeGardner, Public Services Director RE: Natures Refuge North Park Board Recommendation The Park Board discussed the Natures Refuge North concept plan during the November 1, 2023 Park Board meeting. The Park Board has recommended a 100% cash dedication in lieu of dedicating land for a neighborhood park. The cash dedication could be utilized for trails, providing leisure opportunities at Lino Lakes Elementary, and making enhancements to Arena Acres Park. As indicated in the 2040 Lino Lakes Comprehensive Plan, trails establishing a linear greenway should be incorporated into plans that include connectivity to the north, east, south, and west of the project site. Obviously, any improvements at Lino Lakes Elementary would require discussions with the Forest Lake School District. The Park Board feels this collaborative arrangement of sharing resources could provide tremendous benefits for the students and general public. While a majority of the potential park amenities would conceptually be located at Lino Lakes Elementary, the Park Board felt it was important to ensure Natures Refuge North connects to Andall Street to provide pedestrian access to Arena Acres Park.
