HomeMy WebLinkAboutResolution 23-126 CITY OF LINO LAKES RESOLUTION NO. 23-126 APPROVING LYNGBLOMSTEN PUD DEVELOPMENT STAGE PLAN AND PUD FINAL PLAN AMENDMENT#2-NORTH LOT LINE FENCE AND PICKLEBALL COURT WHEREAS, the City received an application for PUD Development Stage Plan and Final Plan Amendment#2 for Lyngblomsten hereafter referred to as Amendment#2; and WHEREAS, on April 8, 2019 the City Council passed Resolution No. 19-42 approving the PUD Development Stage Plan/Preliminary Plat; and WHEREAS, on July 26, 2021 the City Council passed Resolution No. 20-94 approving the PUD Final Plan/Final Plat; and WHEREAS, the PUD Development Stage Plan and Final plan included a fence along the north lot line and no pickleball court was included in the approved plans; and WHEREAS, Amendment#2 proposes to omit the north lot line fence and construct a pickleball court in the southwest corner of the development; and WHEREAS, Amendment#2 consists of the following documents: • PUD Amendment Application, narrative, and photos submitted by the applicant on October 16, 2023; and WHEREAS, a public hearing was held before the Planning & Zoning Board on November 8, 2023. The Board recommended with a 7-0 vote to not require fence along the north lot line with the condition that the landscape plan be revised by a professional landscape architect. The Board also recommended with a 7-0 vote to not allow construction of the pickleball court. NOW,THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: FINDINGS OF FACT Per City Code Section 1007.024: (2) The PUD, by allowing deviation from the strict provisions of this ordinance related to setbacks, heights, lot area, width and depths, yards, etc., may be considered by the City when it would result in one or more of the following public benefits: (a) Implementation of a master plan consistent with the Planning District objectives of the Comprehensive Plan. 1 Amendment#2 continues to implement the Hodgson Road& CR J Master Plan. (b) Innovations in development that address growing demands for all styles of economic expansion, greater variety in lot size, configuration, home type, design, enhanced architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. Amendment#2 does not change Lyngblomsten's innovation in development. (c) Preservation and enhancement of desirable site characteristics such as wildlife habitat, unique natural resources, existing vegetation, natural topography,geologic features and reduction of negative impacts on the environment. The existing wetland on site will not be impacted by Amendment#2. (d) Creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. Amendment#2 continues to transition development from existing low density single family homes to cottage home to a senior living campus consisting of independent living, assisted living and skilled nursing facilities to restaurant and commercial use. (e) Efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. Amendment#2 does not change the existing utility and street network. (f) Mix of land use types. Amendment#2 does not change the existing mix of land use types. (g) Provision of a housing type or target housing price that is desirable to the City. Amendment#2 does not change the Lyngblomsten housing types or target housing prices. (h) Other public benefits and values as recognized in the City's Comprehensive Plan. BE IT FURTHER RESOLVED the requirements of Ordinance No. 07-19, Resolution No. 19- 42, Resolution No. 20-44, and Resolution No. 20-94 are still in effect; and BE IT FURTHER RESOLVED the Lyngblomsten PUD Development Stage Plan and PUD Final Plan Amendment#2 is approved as follows: 1. The fence along the north lot line is not required to be installed with the condition that additional landscaping is planted. 2 a. The landscape plan shall be revised by a professional landscape architect and submitted to City staff for review and approval. 2. The pickleball court may be constructed per the Lyngblomsten Pickleball Courts plans prepared by Bolton & Menk dated August 17, 2023 as revised with the following conditions: a. Outdoor lighting of the court is not allowed. b. Hours of operation shall be 8am to 8pm. c. Access control to the court to Lyngblomsten residents only shall be provided. d. The court shall be shifted to the east as much as civil design will allow. i. The plans shall be revised. e. Noise abatement construction methods such as acoustic panels shall be added to all sides of the court's chain link fence as recommended by manufacturer. f. The existing privacy screen fence shall be extended along west lot line to the south lot line. i. The landscape plan shall be revised to show the location of the fence.
