An additional class was held on December 7th. • On November 20th and December 1st, Officer Mobraten gave Heart Safe presentations at Centennial Middle School and the Pines School. • On November 27th, staff participated in a Feed my Starving Children service project. • During 4th quarter staff gave 3 Drug Recognition and Education Presentations. • Police and Fire staff participated in the Heroes and Helpers Holiday shopping spree for community youth at the Blaine Target store. • On December 6th, staff hosted Coffee with a Cop at Starbucks in the Lino Lakes Target. • On December 16th, the Snowmobile Safety Practical was held at Centerville Lake. Comprehensive Plan Update, Michael Grochala, Diane Hankee 18 a. Winters Property Land Use Change – Community Development Director 19 Grochala reviewed the location of the Winter’s property. He noted that the property 20 owner, Les Winter, is requesting that the land use be redirected from industrial to mixed 21 use. He reviewed, on a map, land surrounding the Winter property and implications for 22 future development and infrastructure. The matter has been discussed with the Planning 23 and Zoning Board, including the fact that the area surrounding the property is all guided 24 industrial (it was pointed out that there is residential nearby in Hugo). Ultimately the 25 Planning and Zoning Board recommended converting the Winter property to mixed use 26 (residential 20% and 80% business mix) and property to the south would become 27 business mix. He reviewed the residential density concept that is being recommended. 28 He noted that there is a domino impact within the plan if a change occurs. The council 29 discussed the 8 – 15 units per acre that is seen nearby in Hugo. The council reviewed 30 the ratio of wetland to buildable land within Mr. Winter’s approximately 140 acres. 31 32 The mayor said he’s not hearing council concern about the change to mixed use but he’d 33 like to see the plans for development; he pointed out that the Comp Plan update currently 34 under consideration doesn’t have to be approved for a couple years. Mr. Grochala 35 explained that the land use guiding would occur through the Comp Plan Update process 36 while a rezoning would be considered as part of a development proposal. With the 37 mayor requesting a “ghost plat” for the development, Mr. Grochala explained that it 38 wouldn’t necessarily be a part of this process; he fears that, timing wise, the owner’s 39 needs and the city’s needs may not mesh. 40 41 Les Winter introduced Mr. Pratt, his developer representative. Mr. Winter explained that 42 his property doesn’t lend itself to an industrial use so that’s why it’s seen as more 43 CITY COUNCIL WORK SESSION January 2, 2018 DRAFT 2 attractive as residential. Mayor Reinert said his idea is to tighten up plans, without the 44 level of flexibility that’s occurred, and he will call for that overall discussion. On this 45 property, the mayor said he’d like to see more conversation/definition on how this land 46 would be used. 47 48 Mr. Pratt said he knows that a ghost plat is being requesting but at this point he is going 49 to request that 20% of the property be designated residential with some latitude. He 50 understands the units per acre and he isn’t proposing to pile in too much. 51 52 Mayor Reinert said he sees that the council generally agrees on the request to change 53 how the Winter property is guided for development. 54 55 Community Development Director Grochala explained the status of the Comp Plan 56 update and the schedule and information needed to send that document out for review. 57 Mr. Pratt used the map to show the amount of buildable land that could possibly be 58 needed for a residential development and he explained his vision in general for 59 commercial/industrial creeping up from the south. Mr. Grochala explained that the 20% 60 figure was intended to keep the number of units down so you can go less dense and more 61 land and end up with the same. 62 63 Community Development Director Grochala pointed out that the sewer and water is a 64 half a mile away so it’s clear this development won’t be coming quickly. 65 66 Mayor Reinert said there’s no final decision being made tonight – but the council could 67 say medium density and 35 acres. 68 69 Council Member Rafferty said he is impressed with Mr. Winter’s desire to work with 70 staff and commitment to that. 71 72 Staff and the council discussed with the land size and density calculations. Mayor 73 Reinert recommended 35% to be guided medium density to give the parameters 74 necessary to keep moving forward on both sides. The council concurred. 75 b. Sanitary Sewer/Water Plans – City Engineer Hankee reviewed the proposed 76 city’s goals and policies on sanitary sewer. The existing sanitary sewer system was 77 overviewed. 78 79 Maps were reviewed indicating the existing sanitary sewer system and how it flows to the 80 Metropolitan Council main system, as well as future system build out plans. She noted 81 that the plans presented are draft at this point and public meetings are planned to be 82 upcoming. The mayor asked for a review of the plan compared to the last update. Ms. 83 Hankee said it is basically that the system has been modeled, so not changed but outlined 84 better. The mayor remarked that service to north Lino Lakes seems to be slowed by the 85 slower development that occurs in the City of Columbus. Council Member Stoesz asked 86 if there are plans for sewer on Lake Drive, from Trappers to City Hall. Ms. Hankee said 87 CITY COUNCIL WORK SESSION January 2, 2018 DRAFT 3 that would be served by a branch line eventually but ultimately the whole city would 88 have go get served. Mr. Grochala pointed out on the map that the entire city is planned 89 to have sewer service eventually, except park. 90 91 Ms. Hankee reviewed the water system plans, including goals. The city is working with 92 grant funds on an irrigation project. She reviewed the city’s current water system and 93 how plans for the future are being developed. 94 2. Local Water Management Plan, Michael Grochala, Katy Thompson (WSB) – 95 Ms. Thompson reviewed the elements of the plan that the council will receive in their 96 packet next week. Mr. Grochala pointed out that staff is on target for turning the plan 97 over to the watershed district for the required review, and that should happen in January. 98 99 The mayor called for discussion of the maximum non-impervious service requirements 100 that were set last update. It has been a problem as far as use of land. He believed that 101 staff would work that out for this update but understands that may not be recommended. 102 Community Development Director Grochala remarked that the city’s concern is run off 103 (from development) and that is one area that is impacted by the impervious surface 104 discussion. In this plan, staff doesn’t intend to call out impervious surface but rather 105 note that the city will be evaluating. To change the percentages, you would have to 106 change the zoning code. The mayor indicated he is supportive of a change. Director 107 Grochala explained that the comp plan comes before an ordinance amendment. 108 109 Mayor Reinert said he will meet with Director Grochala individually because he really 110 believes a change is warranted. 111 3. West Shadow/LaMotte Street Reconstruction Update –City Engineer Hankee 112 provided an update. She recalled the council’s recent actions establishing public hearings 113 on utility projects. Public meetings have also been scheduled for property owners and 114 staff will be prepared to answer questions about that utilities. Information was sent out 115 with the cost specifics that are available. A survey was also sent out to WSL residents 116 with a deadline of January 5; the Lamotte neighborhood was surveyed earlier. Ms. 117 Hankee added that staff will be meeting with the one property owner who has storm 118 water questions later this week. 119 120 Council Member Rafferty asked why sewer and water is being proposed to the park area. 121 That could be very expensive. Ms. Hankee said there would be options on that and also 122 explained that a portion coming to the area would be funded by the city trunk fund. 123 There was discussion of the possible loop to Birch Street which would also serve to avoid 124 having a dead end to the water main; Mayor Reinert remarked that perhaps that element 125 could be included when development that would be served actually occurs. Public 126 Services Director DeGardner remarked that the intent is not now nor never to provide 127 utilities to the park. 128 CITY COUNCIL WORK SESSION January 2, 2018 DRAFT 4 4. Beyond the Yellow Ribbon – Council Member Rafferty explained that he is 129 involved with this group. He doesn’t think that when the council authorized funding for 130 the group, it was meant to be anything other than startup assistance. After meeting with 131 the group, he heard that city funding for the group may not be appropriate according to 132 what other cities have done. Mayor Reinert suggested that it isn’t illegal but he 133 understands that the city should consider the situation. Council Member Rafferty 134 suggested getting a legal opinion on the situation, including if the past funding should be 135 returned. City Administrator Karlson concurred and said that he would seek legal 136 advice. Mayor Reinert suggested that the opinion should really be based on whether or 137 not the city can help 501(c)3 groups (including when there is a benefit to the city). 138 139 Council Member Rafferty said he’s also curious about where the group’s mail is 140 delivered – that location is currently city hall. Mayor Reinert remarked that the address 141 here at city hall was just a way to get started. The address can be the decision of group. 142 Administrator Karlson will investigate that also. 143 5. Advisory Boards – Administrator Karlson said that staff is ready to schedule 144 interviews with the applicants. Mayor Reinert recalled that the council decided to 145 interview all applicants. Council Member Rafferty concurred; he sees getting Planning 146 and Zoning members in place as a priority. 147 148 Mayor Reinert remarked that he’d like to have a joint meeting with the boards once again 149 (pizza, hand shaking, update, etc). 150 151 The times suggested for advisory board interviews– prior to every council meeting (one 152 hour). 153 6. Council Updates on Boards/Commissions - There were none. 154 7. Monthly Progress Report – Administrator Karlson reported on the video room 155 upgrade. He noted the situation of working into the video tech schedule the current 156 Scanner Tech person who has experience in the area. He reviewed the status of that 157 project and the schedule for completion. 158 8. 49/J Sewer & Water Extension, Land Use discussion – Community 159 Development Director Grochala reviewed a PowerPoint presentation outlining: 160 161 - Water and sewer options 162 - extending services to provide for future use; 163 - will require a city lead (right of way acquisitions, etc) to expedite; 164 - asking council if plans and specs should be authorized for improvements. 165 166 Mayor Reinert asked for an update on development plans for the area. Mr. Grochala 167 CITY COUNCIL WORK SESSION January 2, 2018 DRAFT 5 noted that a convenience store proposal has been broached in the area. The council did 168 not express interest in such a development. Mayor Reinert remarked that he envisioned 169 something on the site that would serve as a gateway to the city. Community 170 Development Director Grochala noted the master plan prepared in 2007. The council 171 asked about an estimate of the cost for WSB & Associates to prepare plans and 172 specifications. Staff explained that they would investigate costs further. 173 174 The council heard from residents of the area. Concern about noise and closeness to 175 residential properties remains a concern. The mayor remarked that it’s the council’s job 176 make sure that developments that occur in the city are appropriate to the city. 177 9. NE Drainage Area Land Acquisition – Community Development Director 178 Grochala reported. His report relates to the big channel project. The watershed district 179 has the project under review. He’s seeking council direction to get a proposal from WSB 180 to move on land acquisition. This would be a corridor acquisition and potentially 181 acquisition relating to remnants. The Lennar project will be somewhat dependent on the 182 project. Council Member Rafferty asked how the city will recoup costs – Mr. Grochala 183 explained fees. 184 185 The council concurred with staff’s request; Mayor Reinert asked about the wisdom of 186 going out for bids for something like this. Community Development Director Grochala 187 remarked that the city has pretty much stuck with WSB, for different reasons such as they 188 are already involved in the projects making their services generally more efficient. Mr. 189 Grochala explained his process that includes overview of the city engineer (already on 190 contract). 191 10. Review Regular Agenda 192 193 Regarding the consent agenda, Council Member Stoesz remarked that the expenditure list 194 can be difficult to read as far as how all the expenditures relate to the actual city budget. 195 For instance, how do the expenditures fit into the overall line items in the budget that 196 they represent? Mayor Reinert asked Administrator Karlson what he uses to follow the 197 budget as a manager. Mr. Karlson explained the budgeting document that each 198 department director receives. The council concurred that they’d like that made 199 available. 200 201 Council Member Rafferty asked questions about expenditures to Century College for 202 training (law enforcement and fire). Public Safety Director Swenson remarked that one 203 is an annual training situation; for people that can’t get into that class, they may be sent 204 to other classes. 205 206 Council Member Rafferty noted expenses related to utility bill envelopes and asked about 207 how to reduce those costs – is there a cheaper way to provide bills. He also asked about 208 range expenses for police shooting activity. And he asked about petty cash in the Police 209 CITY COUNCIL WORK SESSION January 2, 2018 DRAFT 6 Department and how much that is used? Public Safety Director Swenson explained that 210 the petty cash is used for parking, meeting expenses, etc. He assured the council that the 211 funds are tracked and coded to a line for budgeted funds. 212 213 Annual Appointments – Administration Karlson remarked that he has filled in the 214 appointments based on existing, except where that wasn’t possible. He asked Council 215 Member Stoesz if he is interested in rejoining the North Metro Board and he was. 216 Council Member Manthey asked if he could join the fire advisory group; Mayor Reinert 217 concurred. 218 219 Council Member Stoesz remarked that he will abstain from voting on the list of 220 depositories since he works for US Bank. 221 222 Regarding the personnel issue, Administration Karlson explained that staff for the Parks 223 and Recreation program is the subject. The city has attempted to work with the school 224 district on their proposed rental charges for city parks and recreation activities, but no 225 avail. Mayor Reinert concurred. He has worked with staff on this issue and it’s very 226 unfortunate that the school district is choosing to impose facility use charges and also that 227 they are duplicating city programming. Recreation programming will be 75 reviewed and amended as a result and as is appropriate. Council Member Rafferty explained what a 76 difficult decision this has been. Council Member Manthey said he understands the difficulty of 77 letting someone go but the change is evident and he hopes the impacted person will be able to move 78 to a good position elsewhere. 79 Council Member Manthey moved to approve the elimination of one Recreation Supervisor position 80 and termination of employment of Ali Lukin as recommended. CITY OF LINO LAKES RESOLUTION NO. 18-06 AUTHORIZING A SPECIAL EVENT FOR AN OUTDOOR EVENT AT TRAPPERS BAR AND GRILL. BACKGROUND The application submitted to the City is complete, the related fees have been paid and insurance information has been provided to the City as required. In addition, the Lino Lakes Public Safety Department has conducted the required background investigations on the new applicants. In accordance with the Lino Lakes Code of Ordinances, Section 701 relating to Liquor Licensing, this application requires approval by the City Council. Background On December 11, 2018 the Council accepted the Amended Feasibility Report and called the Public Hearing for the West Shadow Lake Area Municipal Utility Extension. The Amended Feasibility Report includes the scope of proposed improvements, a unit price cost estimate, a preliminary assessment roll, and assessment analysis. Staff will present the proposed West Shadow Lake Area Municipal Utility Extension project. Council will then open the Public Hearing on Improvements and receive comments from the public. After the Public Hearing there is a 60 day period where a petition may be filed, and the Council may take no action on the project. The 60 day period ends on March 23, 2018. The City staff are planning on providing a petition template. RECOMMENDATION Open the Public Hearing on Improvements for the West Shadow Lake Area Municipal Utility Extension. ATTACHMENTS 1. Amended Feasibility (Appendix E and F) APPENDIX E WEST SHADOW LAKE DRIVE WATERMAIN & SANITARY SEWER IMPROVEMENTS AMENDMENT TO THE FEASIBILITY On May 8, 2017, the Lino Lakes City Council passed Resolution 17-42 accepting the Feasibility Report for the West Shadow Lake Drive and LaMotte Neighborhood improvements. Due to design considerations and input from residents adjacent to the project regarding the extension of water and sanitary sewer, the following additions are intended to be included as an amendment to the Feasibility Report. The proposed project with the amendment as outlined below, is necessary, cost effective, and feasible. Feasibility Report Section 3.3 - Watermain Improvements - 3.3.3 Alternative Improvements The proposed watermain improvements on West Shadow Lake Drive include extending an eight- inch diameter water line north along West Shadow Lake Drive from Birch Street to Sandpiper Drive and along Shadow Court, a total of approximately 7,800 feet. Improvements would also include hydrants, gate valves, and water service extensions to the right-of-way / property line. Water services are proposed from both the new and existing water main to each property line, buildable lot, or sub-dividable lot. Due to a high ground water table and to minimize impacts to private property, the watermain is proposed to be directionally drilled. Property owners may keep their existing well for irrigation if it remains in compliance. There are some wells along the project that we anticipate will need to be sealed per the Minnesota Department of Health due to the proximity of new sanitary or storm sewer. Feasibility Report Section 3.4 - Sanitary Sewer Improvements - 3.4.3 Alternative Improvements Two types of sanitary sewer systems were evaluated for the northerly area of the project serving the existing homes along West Shadow Lake Drive and Sandpiper Court. The first system was a conventional 8-inch gravity sanitary sewer system with a City owned and operated lift station and the second system a 3-inch pressure main system where each home is serviced by a small lift (or grinder) pump connection. Due to the high groundwater table and the narrow road right-of-way, the conventional gravity sewer system is not a feasible option to serve the properties on the north end of West Shadow Lake Drive (north of the culvert crossing were Reshanua Lake outlets to Rice Lake). The depth required to install the sewer would be well below the groundwater table and significantly deeper than the pressure system alternative. City staff contacted a local contractor, with experience installing utilities within this area of Lino Lakes, to review the geotechnical report and site conditions. It was their recommendation to directional drill utilities due to high ground water and soil types. Directional drilling of the gravity system would not be practical as the shallow grades preclude this type of construction technique. Due to the narrow right-of-way, excavated materials from an open cut trenching method would need to be hauled and stockpiled offsite. The width of the trench would extend beyond the existing road right-of-way in many locations; temporary easements would be required from property owners. In addition, existing wells and septic systems are in close proximity, or in some cases, within the road right-of-way and would conflict with an deep open cut installation method. The pressure system alternative also provides greater flexibility for connecting to existing properties. Unlike a gravity system, the pressure pipe services are not required to be placed at a down gradient from the home; a minimum pipe grade is not required for grinder pump service installations. The pressure system alternative was also evaluated for an open cut versus directional drilling installation method. Due to the high groundwater table and the smaller forcemain pipe diameter, the directional drilling operation is a more cost effective and less impactful method of installation. This would also minimize impacts to trees, driveways and other landscaping in the corridor. The proposed sanitary sewer system improvements for the West Shadow Lake Drive project area include both a gravity sewer collection system and a low-pressure force main system. The project area located north of the culvert crossing would be served by 4,500 lineal feet of 3-inch High Density Polyethylene (HDPE) sanitary sewer force main and extend through West Shadow Lake Drive, Sandpiper Drive, and Shadow Court. A connection would be made at the existing forcemain located at West Shadow Court/Sandpiper Drive intersection. The 8-inch gravity sewer collection system is proposed to be installed on West Shadow Lake Drive from Birch Street north to County Lakes Park, approximately 1,000 feet; The relatively shallow depth of this system does not preclude the use of a gravity line. Sanitary sewer service laterals would be extended to the right-of-way / property line from both the new and existing force main to each existing property, buildable lot, or sub-dividable lot. Feasibility Report Section 5.1 – Opinion of Cost A detailed opinion of probable cost is included with this report. The opinion of probable cost is based on projected construction costs for 2018, and includes a 10% construction contingency and 20% indirect costs. Trunk utility costs were not included with the per-unit cost for either the sanitary sewer or watermain. Lots determined to be unbuildable, without direct access to the proposed utilities, or with no benefit provided were not included in the calculation. Existing parcels will be charged a single per-unit cost. On subdividable parcels, the per-unit cost for each additional buildable unit will be charged to the property owner at the time of subdivision / connection. The per-unit cost for subdividable parcels will be equal to the base cost plus the Engineering News Record (ENR) Construction Cost Index increase; the ENR Construction Cost Index for 2017 was approximately 5% and will vary from year to year. The analysis was based on 66 existing parcels and 7 sub-dividable parcels that would be receiving municipal utility services. The total number of lots used in the per-unit calculation was 73 (66 + 7). Actual buildable lots will be determined by the City when applications for subdivisions are submitted. The assessment calculation for the sanitary sewer is: $337,101.60 / 73 units = $4,617.83 per unit The assessment calculation for the watermain is: $706,292.40 / 73 units = $9,675.24 per unit The combined assessments per unit are as follows: $4,617.83 + $9,675.24 = $14,293.07 per unit In addition to the proposed special assessments, residents would be responsible for the following additional costs. holding the Public Hearing on Improvements for the LaMotte Area Water System Extension. Background On December 11, 2018 the Council accepted the Amended Feasibility Report and called the Public Hearing for the LaMotte Area Water System Extension. The Amended Feasibility Report includes the scope of proposed improvements, a unit price cost estimate, a preliminary assessment roll, and assessment analysis. Staff will present the proposed LaMotte Area Water System Extension project. Council will then open the Public Hearing on Improvements and receive comments from the public. After the Public Hearing there is a 60 day period where a petition may be filed, and the Council may take no action on the project. The 60 day period ends on March 23, 2018. The City staff are planning on providing a petition template. RECOMMENDATION Open the Public Hearing on Improvements for the LaMotte Area Water System Extension. ATTACHMENTS 1. Amended Feasibility (Appendix E and F) APPENDIX E WEST SHADOW LAKE DRIVE WATERMAIN & SANITARY SEWER IMPROVEMENTS AMENDMENT TO THE FEASIBILITY On May 8, 2017, the Lino Lakes City Council passed Resolution 17-42 accepting the Feasibility Report for the West Shadow Lake Drive and LaMotte Neighborhood improvements. Due to design considerations and input from residents adjacent to the project regarding the extension of water and sanitary sewer, the following additions are intended to be included as an amendment to the Feasibility Report. The proposed project with the amendment as outlined below, is necessary, cost effective, and feasible. Feasibility Report Section 3.3 - Watermain Improvements - 3.3.3 Alternative Improvements The proposed watermain improvements on West Shadow Lake Drive include extending an eight- inch diameter water line north along West Shadow Lake Drive from Birch Street to Sandpiper Drive and along Shadow Court, a total of approximately 7,800 feet. Improvements would also include hydrants, gate valves, and water service extensions to the right-of-way / property line. Water services are proposed from both the new and existing water main to each property line, buildable lot, or sub-dividable lot. Due to a high ground water table and to minimize impacts to private property, the watermain is proposed to be directionally drilled. Property owners may keep their existing well for irrigation if it remains in compliance. There are some wells along the project that we anticipate will need to be sealed per the Minnesota Department of Health due to the proximity of new sanitary or storm sewer. Feasibility Report Section 3.4 - Sanitary Sewer Improvements - 3.4.3 Alternative Improvements Two types of sanitary sewer systems were evaluated for the northerly area of the project serving the existing homes along West Shadow Lake Drive and Sandpiper Court. The first system was a conventional 8-inch gravity sanitary sewer system with a City owned and operated lift station and the second system a 3-inch pressure main system where each home is serviced by a small lift (or grinder) pump connection. Due to the high groundwater table and the narrow road right-of-way, the conventional gravity sewer system is not a feasible option to serve the properties on the north end of West Shadow Lake Drive (north of the culvert crossing were Reshanua Lake outlets to Rice Lake). The depth required to install the sewer would be well below the groundwater table and significantly deeper than the pressure system alternative. City staff contacted a local contractor, with experience installing utilities within this area of Lino Lakes, to review the geotechnical report and site conditions. It was their recommendation to directional drill utilities due to high ground water and soil types. Directional drilling of the gravity system would not be practical as the shallow grades preclude this type of construction technique. Due to the narrow right-of-way, excavated materials from an open cut trenching method would need to be hauled and stockpiled offsite. The width of the trench would extend beyond the existing road right-of-way in many locations; temporary easements would be required from property owners. In addition, existing wells and septic systems are in close proximity, or in some cases, within the road right-of-way and would conflict with an deep open cut installation method. The pressure system alternative also provides greater flexibility for connecting to existing properties. Unlike a gravity system, the pressure pipe services are not required to be placed at a down gradient from the home; a minimum pipe grade is not required for grinder pump service installations. The pressure system alternative was also evaluated for an open cut versus directional drilling installation method. Due to the high groundwater table and the smaller forcemain pipe diameter, the directional drilling operation is a more cost effective and less impactful method of installation. This would also minimize impacts to trees, driveways and other landscaping in the corridor. The proposed sanitary sewer system improvements for the West Shadow Lake Drive project area include both a gravity sewer collection system and a low-pressure force main system. The project area located north of the culvert crossing would be served by 4,500 lineal feet of 3-inch High Density Polyethylene (HDPE) sanitary sewer force main and extend through West Shadow Lake Drive, Sandpiper Drive, and Shadow Court. A connection would be made at the existing forcemain located at West Shadow Court/Sandpiper Drive intersection. The 8-inch gravity sewer collection system is proposed to be installed on West Shadow Lake Drive from Birch Street north to County Lakes Park, approximately 1,000 feet; The relatively shallow depth of this system does not preclude the use of a gravity line. Sanitary sewer service laterals would be extended to the right-of-way / property line from both the new and existing force main to each existing property, buildable lot, or sub-dividable lot. Feasibility Report Section 5.1 – Opinion of Cost A detailed opinion of probable cost is included with this report. The opinion of probable cost is based on projected construction costs for 2018, and includes a 10% construction contingency and 20% indirect costs. Trunk utility costs were not included with the per-unit cost for either the sanitary sewer or watermain. Lots determined to be unbuildable, without direct access to the proposed utilities, or with no benefit provided were not included in the calculation. Existing parcels will be charged a single per-unit cost. On subdividable parcels, the per-unit cost for each additional buildable unit will be charged to the property owner at the time of subdivision / connection. The per-unit cost for subdividable parcels will be equal to the base cost plus the Engineering News Record (ENR) Construction Cost Index increase; the ENR Construction Cost Index for 2017 was approximately 5% and will vary from year to year. The analysis was based on 66 existing parcels and 7 sub-dividable parcels that would be receiving municipal utility services. The total number of lots used in the per-unit calculation was 73 (66 + 7). Actual buildable lots will be determined by the City when applications for subdivisions are submitted. The assessment calculation for the sanitary sewer is: $337,101.60 / 73 units = $4,617.83 per unit The assessment calculation for the watermain is: $706,292.40 / 73 units = $9,675.24 per unit The combined assessments per unit are as follows: $4,617.83 + $9,675.24 = $14,293.07 per unit In addition to the proposed special assessments, residents would be responsible for the following additional costs. ANALYSIS The SS Properties Addition final platting process requires that existing drainage and utility easements be vacated on Lot 1, Block 1, Pine Glen. The vacation includes the standard property line easement, a drainage and utility easement over an existing stormwater retention pond on the east side. These existing easements will be vacated as detailed in the enclosed drainage and utility easement vacation sketch. 2 New easements will be included with the SS Properties Addition final plat to cover the entire site and expanded stormwater facilities. The existing retention pond will be expanded and included in a new drainage and utility easement. An Ordinance is required to vacate the easement. On January 8, 2018 the City Council held the 1st Reading of Ordinance 01-18 and a Public Hearing. There were no comments received at the Public Hearing. The existing north parcel is unplatted and has a metes and bounds legal description. The vacant south parcel is platted and legally described as Lot 1, Block 1, Pine Glen. The third parcel is a remnant triangular parcel along Lake Drive. The parcels will be combined via plat to provide clear title and dedicate required easements. The name of the plat is SS Properties Addition. Conformity with the Comprehensive Plan and Zoning Code The preliminary plat is consistent with the comprehensive plan for commercial development and zoning code requirements for GB, General Business as detailed in the July 12, 2017 Planning & Zoning Staff Report. The final plat substantially conforms to the preliminary plat and therefore, is also consistent with the comprehensive plan. Blocks and Lots The proposed final plat contains Lot 1, Block 1, SS Properties Addition. There are no outlots. Lot 1 is 2.19 acres. Streets and Alleys The front lot line is along CSAH 23/Lake Drive. The south lot line is along Kelly Street. No street improvements are required. Easements Standard drainage and utility easements at least 10 feet wide have been provided along all lot lines. Easements are also provided over both stormwater management facilities. A recorded 15 foot trail easement (Document #1986693.003) exists along a section of CSAH 23/Lake Drive. A new trail easement has been drafted and will be recorded over the existing 3 easement granting to the City a perpetual easement for trail purposes over and across the Northwesterly 15.00 feet of Lot 1, Block 1, SS Properties Addition. There are existing drainage and utility easements along the lot lines of Lot 1, Block 1, Pine Glen. These easements will be vacated by the City Council via Ordinance No. 01-18. The first reading was held on January 8, 2018 and the second reading on January 22, 2018. Stormwater Management and Erosion and Sediment Control The existing retention pond on the east side of the site was constructed in 2005 with the Pine Glen development. This pond is being expanded to accommodate the new development. A new infiltration pond is also being constructed on the west side of the site. Public Utilities The existing building at 7932 Lake Drive is on private well and septic system. Sheet C1, Utility Plan notes the services will be abandoned at property line and the well will also be abandoned. The new facility will be municipally served by an 8” PVC sanitary sewer and a 12” DIP watermain located along Kelly Street. Public Land Dedication Commercial park dedication fees for Lot 1, Block 1, Pine Glen were paid in 2005 with that development. No additional park dedication fees are required. Site & Building Plans The exterior materials have changed from brick facing, accent units and pre-colored block to precast concrete panels with brick, cultured stone, exposed aggregate and sandblasted smooth exterior finishes. These revised materials are acceptable. The garage doors on the south (front) and east (side) elevations have been removed. This is acceptable. Resolution No. 17-81 approving the Conditional Use Permit and the December 13, 2017 Planning & Zoning Staff Report state that all driveways and parking lot areas shall be paved. The applicant has requested a portion of the rear yard driveway be allowed to use bituminous recycle millings for up to 5 years from the final plat approval. Staff is agreeable to this request. As a final note, outside services, sales and equipment rental are only allowed in those designated areas noted on Plan Sheet A1.1 Site Development Plan. No outdoor storage is allowed on site. Wetlands and Floodplain There are no wetlands on site. 4 There are no floodplains located on site. Anoka County Highway Department Staff has distributed materials to Anoka County Highway Department and is waiting their comments. The applicant shall submit the final plat to the County for plat review. Stormwater Maintenance Agreement A Declaration of Stormwater Maintenance is required and shall include the City of Lino Lakes as a party to the agreement. Development Agreement A Development Agreement will be drafted by the City and shall be executed by the Developer. Title Commitment The City Attorney is satisfied with the title commitment. Subdivision.  Developer received preliminary plat approval from the City by Resolution No.  17‐80 for a plat known as SS Properties Addition (“Subdivision”). Unless otherwise stated,  all terms and conditions of this Agreement relate to work within the Subdivision.  2. Final Plat Approval.  The City’s approval of the final plat of SS Properties Addition, as  legally described on Exhibit A attached hereto, is contingent upon execution and delivery  of this agreement and all required petitions, bonds, security, and documents, and  satisfaction of all conditions of approval required by Resolution No. 18‐03. The Final Plat  is attached hereto as Exhibit B.    3. Phased Development.  The City may refuse to approve final plats of subsequent additions  of the plat if the Developer has breached this Agreement and the breach has not been  remedied. Development of subsequent phases may not proceed until Development  Agreements for such phases are approved by the City.  4. Developer Plans.  a. The Subdivision shall be developed in accordance with the following Developer  Plans, original copies of which are on file with the City Engineer.  The Developer  Plans may be prepared and revised after entering into this Agreement but must  be approved by the City before commencement of any work.  If the plans vary  from the written terms of this Agreement, this Agreement shall control.   b. The Developer Plans as of the date of this Agreement are:  i. SS Properties Addition/All Seasons Rental plan set containing the final  plat and 21 plan sheets, prepared by Jamb Architects, E.G. Rud & Sons,  and Roshell Engineers, revised November 10, 2017 and received  November 16, 2017.  5. Permits.  The Developer shall be responsible for securing all site grading and  development approvals and permits from all appropriate Federal, State, Regional and  Local jurisdictions prior to the commencement of site grading or construction and prior  to the City awarding construction contracts for public improvements.  All Seasons Rental  Development Agreement  January 22, 2018   page 2 6. Developer Improvements.  The Developer shall secure a contractor to install these  improvements, hereinafter referred to as the “Developer Improvements,” which  contractor shall be approved by the City in its absolute discretion.  The cost of  Developer Improvements is as shown on Exhibit C attached hereto.  All Developer  Improvements shall require City inspection and approval and, where appropriate, the  approval of any other governmental agency having jurisdiction. The Developer shall  construct and install at the Developer's expense the following improvements according  to the following terms and conditions:  a. Site Grading  i. No grading shall commence until requirements of the Rice Creek  Watershed District (RCWD) have been satisfied.    ii. Site grading shall be conducted in accordance with the grading plan as  approved by the City and in accordance with NPDES and RCWD  requirements.  The Developer shall perform the work in accordance with  a Storm Water Pollution Prevention Plan (SWPPP) pursuant to Minnesota  Pollution Control Agency (MPCA) requirements.  b. Grading and Erosion Control  i. The Developer shall grade the site to within 0.2 foot of the grades shown  on the approved grading plan. No deviations will be allowed unless a  revised plan is submitted and approved by the City and all other  regulatory agencies.    ii. The street right‐of‐way, storm water storage ponds, and surface water  drainage ways shall be graded prior to commencement of utility  construction.  iii. The Developer shall be responsible for ascertaining that site geotechnical  and groundwater conditions are adequate and conforming with the  grading and site improvement as proposed.  iv. The Developer’s engineer shall certify in writing, with an as‐built survey,  that all grading complies with the approved grading plan prior to issuance  of any building permits.  v. The Developer shall promptly clear dirt and debris within public right‐of‐ ways and drainage and utility easements resulting from construction by  the Developer, its purchasers, builders and contractors within five (5)  days after notification by the City.  The Developer shall be responsible for  all necessary street and storm sewer maintenance, including street  All Seasons Rental  Development Agreement  January 22, 2018   page 3 sweeping, until all home construction is completed, unless otherwise  released by the City.   Warning signs shall be placed when hazards  develop in streets to prevent the public from traveling on them, including  detour signs if necessary.  If and when the streets become impassable,  such streets shall be barricaded and closed.  The Developer shall maintain  a smooth, hard driving surface and adequate drainage on all temporary  streets.  c. Final site grading, subbase, gravel base, concrete curb and gutter, and  bituminous base course and wear course shall be furnished and installed.  d. Sidewalks, paths and lighting as required by the City.  e. Storm sewers, when determined to be necessary by the City Engineer, including  all necessary laterals, catch basins, inlets and other appurtenances, shall be  furnished and installed.  f. Sanitary sewer mains, laterals or extensions, including all necessary building  services and other appurtenances, shall be furnished and installed.  g. Water mains, laterals or extensions, including all necessary building services,  hydrants, valves and other appurtenances, shall be furnished and installed.    h. The Developer shall place iron monuments at all lot and block corners and at all  other angle points on boundary lines.  Iron monuments shall be placed after all  street and lawn grading has been completed in order to preserve the lot markers  for future property owners.  Lot corner irons on the back property line shall be  installed so that the top of the iron corresponds to the finished ground elevation  in accordance with the approved grading plan. Guard stakes shall be  appropriately installed to mark these irons.  i. Landscaping shall be furnished and installed in accordance with the approved  plans.  j. The Developer shall arrange for all gas, telephone, cable TV and electric utility  services to the Subdivision in accordance with City Code and State law.  The  Developer is solely responsible for the cost of utility installation.  7. Time of Performance.  The Developer shall install all required improvements  enumerated in Paragraph 6 by November 30, 2018.  The Developer may request a  reasonable extension of time from the City.  If the extension is granted, it shall be  conditioned upon updating the security posted by the Developer to reflect cost  increases and the extended completion date.  All Seasons Rental  Development Agreement  January 22, 2018   page 4 8. City Improvements.  No City improvements are proposed to be constructed for this  subdivision.  9. Record Drawings.  a. Upon project completion, Developer shall submit record drawings, in electronic  format, of all public and private infrastructure improvements, including grading,  sanitary sewer, watermain, storm sewer facilities, and roads, constructed by  Developer.  The files shall be drawn in Anoka County NAD 83 Coordinate system  and provided in both AutoCAD .dwg and Adobe .pdf file formats.  The plans shall  include accurate locations, dimensions, elevations, grades, slopes and all other  pertinent information concerning the complete work.  The Developer shall also  submit certified compaction testing results for the site grading operations.  b. A summary of the record plan attribute data for the storm sewer, watermain,  and sanitary sewer structures and pipes shall be submitted in the form of an  Excel Spreadsheet as provided by the City Engineer.  c. No securities will be fully released until all record drawings have been submitted  and accepted by the City Engineer.  10. Faithful Performance of Construction Contracts and Security.  a. The Developer will fully and faithfully comply with all terms and conditions of any  and all contracts entered into by the Developer for the installation and construction  of all Developer Improvements. Concurrent with the execution hereof by the  Developer, the Developer will furnish to, and at all times thereafter maintain with  the City, a cash deposit, certified check, or Irrevocable Letter of Credit, based on  one hundred fifty (150%) percent of the total estimated cost of Developer's  Improvements.    b. Irrevocable Letter of Credit.  If an Irrevocable Letter of Credit is utilized, it shall be  for the exclusive use and benefit of the City of Lino Lakes and shall state that it is  issued to guarantee and assure performance by the Developer of all the terms and  conditions of this Development Agreement and construction of all required  improvements referenced therein in accordance with the ordinances and  specifications of the City.  The letter shall be in a form, and from a bank, as  approved by the City.  The City reserves the right to draw, in whole or in part, on  any portion of the Irrevocable Letter of Credit for the purpose of guaranteeing the  terms and conditions of this agreement.  The Irrevocable Letter of Credit shall be  automatically extended for additional periods of one year from present or future  expiration dates.  The Irrevocable Letter of Credit may not be terminated without  the City’s written consent.  All Seasons Rental  Development Agreement  January 22, 2018   page 5 c. Alternatively, the Developer may enter into a Public Improvement Surety  Agreement, subject to City approval.  d. Reduction of Security. The Developer may request reduction of the Letter of Credit  or cash deposit based on prepayment or the value of the completed improvements  at the time of the requested reduction.   11. Warranty.  The Developer warrants all utility work required to be performed by it against  poor material and faulty workmanship for a period of two years after its completion and  acceptance by the City.  All new streets shall be warranted by the developer for a period  of one year from the time the final inspection of the street is completed and accepted  by the City. All trees, grass and sod shall be warranted to be alive, of good quality and  disease free for 12 months after planting.  Prior to final acceptance of the Developer  Improvements the City shall require a Performance Bond or Cash Escrow to cover the  warranty provisions of this Agreement.  The amount shall be determined by the City  Engineer.  12. Dedication.  The Developer shall dedicate to the City, at no cost to the City, any  permanent or temporary easements that may be necessary for the construction and  installation of the Developer Improvements. All such easements required by the City  shall be in writing, in recordable form, containing such terms and conditions as the City  shall determine.  13. Ownership of Improvements.  Upon completion and City acceptance of the work and  construction required by this Agreement, the public improvements lying within public  right‐of‐way and easements shall become City property without further notice or action  unless the improvements are to be deemed private infrastructure.  14. Recording and Release.  The Developer agrees that the terms of this Development  Agreement shall be a covenant on any and all property included in the Subdivision.  The  Developer agrees that the City shall have the right to record a copy of this Development  Agreement with the Anoka County Recorder to give notice to future purchasers and  owners.  This shall be recorded against the Subdivision described on Page 1.    15. Escrow for City’s Costs.  a. The Developer agrees to establish a non‐interest bearing escrow account with  the City in an amount determined by the City Administrator or his designee for  the payment of all costs incurred by the City related to the development of the  Subdivision including, but not limited to, the following (See Exhibit C for  breakdown of costs):  i. If the above escrow amounts are insufficient, the Developer shall make such  additional deposits as required by the City.  The City shall have a right to  reimburse itself from the Escrow upon notice to the Developer, with suitable  documentation supporting the charges.  16. Developer Fees.  At the time of execution of this Agreement, the Developer shall pay  the following fees related to the development of the Subdivision (See Exhibit C for  breakdown of costs):  a. Park Dedication. Not Applicable.  b. Street lights. Not Applicable.  c. Sealcoating.  Not Applicable.   d. GIS Mapping Fees  e. Assessment of Charges and Waiver of Rights.  a. In consideration of the construction of City Improvements listed in Paragraph 8  and /or provision of sewer, water and storm water services, the Developer  agrees that the costs of City Improvements together with Trunk Sewer Unit  Charge, Trunk Water Unit Charge and the Surface Water Management Area  Charge (collectively, “the Charges”) may be assessed against the Subdivision  parcels.  The Developer hereby waives any and all procedural and substantive  objections to the special assessments, including notice and hearing  requirements, any claim that the assessments exceed the benefit to the  properties, and any right to appeal.  b. Unless the Developer pays the entire balance owed for the Charges  contemporaneously with the execution of this Agreement, the Developer shall  provide to the City a cash escrow or irrevocable letter of credit in an amount  equal to 35% of the total assessments for the Charges as estimated by the City  Engineer (see Exhibit C).  The letter of credit shall be in a form, and from a bank,  as approved by the City.  The letter of credit or cash escrow may be used by the  City upon default by Developer in the payment of special assessments.  The cash  escrow or letter of credit shall remain in place throughout the term of the special  assessments.  The letter of credit may not be terminated without the City’s  written consent.  c. Developer, its heirs, successors or assigns, agrees that within 30 days after the  date of sale of a lot, the Developer, its heirs, successors or assigns, at its own  cost and expense, shall pay the entire unpaid charges assessed or to be assessed  under this agreement against such property.  d. If a certificate of occupancy is issued before the special assessments have been  levied, the Developer, its heirs, successors or assigns shall pay the City the sum  of cash equal to 120% of the Engineer's estimate of the special assessments for  such Charges that would be levied against the property.  Upon such payment the  All Seasons Rental  Development Agreement  January 22, 2018   page 9 City shall issue a certificate showing the assessments are paid in full.   Notwithstanding the issuance of said certificate, the Developer shall be liable to  the City for any deficiency and the City shall pay the Developer any surplus  arising from the payment based upon such estimate.    e. Acceleration upon Default.  In the event the Developer violates any of the  covenants, conditions or agreements herein, violates any ordinance, rule or  regulation of the City, County of Anoka, State of Minnesota or other  governmental entity having jurisdiction over the plat or development, or fails to  pay when due any installment of any special assessment levied pursuant to this  agreement, or any interest thereon, the City at its option, in addition to its rights  and remedies hereunder, after 10 days written notice to the Developer, may  declare all of the unpaid special assessments which are then estimated or levied  pursuant to this agreement due and payable in full, with interest.  The City may  seek recovery of such special assessments due and payable from the security  provided herein.  In the event that such security is insufficient to pay the  outstanding amount of such special assessments plus accrued interest the City  may certify such outstanding special assessments in full to the County Auditor  pursuant to Minnesota Statutes section 429.061, subdivision 3, for collection the  following year.  The City, at its option, may commence legal action against the  Developer to collect the entire unpaid balance of the special assessments then  estimated or levied pursuant hereto, with interest, including reasonable  attorney's fees, and Developer shall be liable for such special assessments and, if  more than one, such liability shall be joint and several.  In addition to any other  rights and remedies upon Developer’s default, the City may refuse to issue  building permits and/or Certificates of Occupancy for any property within the  Subdivision until such time as such default has been corrected to the satisfaction  of the City.  The Developer agrees to reimburse the City for all costs incurred by  the City in the enforcement of this agreement, or any portion thereof, including  court costs and reasonable engineering and attorneys' fees, if the City prevails in  any enforcement action.  18. Building Permits. No building permits shall be issued until:  a. Site grading, City sewer, water, storm sewer, and bituminous base construction  of the streets, temporary street signs, gas, electric, and telephone are completed  and approved by the City, except as provided below.  i. Model Homes: Not Applicable   ii. Not Applicable  19. Special Provisions.  All Seasons Rental  Development Agreement  January 22, 2018   page 10 a. Well sealing record to be provided to City prior to closing the building permit.   b. The conditions of Resolution No.  17‐80, Resolution No. 17‐81 and Resolution  No. 18‐03 shall be met.  c. A portion of the rear yard driveway may be allowed to use bituminous recycle  millings for up to 5 years from the date of final plat approval.  The area shall then  be surfaced with bituminous or concrete.  20. Hours of Construction Activity.    All construction activity shall be limited to the hours as follows:  Monday through Friday  7:00 a.m. to 7:00 p.m.  Saturday      9:00 a.m. to 5:00 p.m.  Sunday and Holidays    No working hours allowed    21. Insurance.  Developer or its general contractor shall take out and maintain until one  year after the City accepted the Developer Improvements, public liability and property  damage insurance covering personal injury, including death, and claims for property  damage which may arise out of the Developer's or general contractor’s work, as the  case may be, or the work of its subcontractors or by one directly or indirectly employed  by any of them.  Limits for bodily injury and death shall be not less than Five Hundred  Thousand and no/100 ($500,000.00) Dollars for one person and One Million and no/100  ($1,000,000.00) Dollars for each occurrence; limits for property damage shall be not less  than One Million and no/100 ($1,000,000.00) Dollars for each occurrence; or a  combination single limit policy of Two Million and no/100 ($2,000,000.00) Dollars or  more. The City, its employees, its agents and assigns shall be named as an additional  insured on the policy, and the Developer or its general contractor shall file with the City  a certificate evidencing coverage prior to the City signing the plat.  The certificate shall  provide that the City must be given ten days advance written notice of the cancellation  of the insurance. The certificate may not contain any disclaimer for failure to give the  required notice.    22. Developer’s Default.  In the event of default by the Developer as to any of the work to  be performed by it hereunder, the City may, at its option, perform the work and the  Developer shall promptly reimburse the City for any expense incurred by the City,  provided the Developer is first given notice of the work in default, not less than 48 hours  in advance.  This Agreement is a license for the City to act, and it shall not be necessary  for the City to seek a court order for permission to enter the land.  When the City does  any such work, the City may, in addition to its other remedies, levy the cost in whole or  in part as a special assessment against the Subject Property.  Developer waives its rights  to notice of hearing and hearing on such assessments and its right to appeal such  assessments pursuant to Minnesota Statutes, chapter 429.  All Seasons Rental  Development Agreement  January 22, 2018   page 11   23. General.    a. Binding Effect    The terms and provisions hereof shall be binding upon and inure to the benefit  of the heirs, representatives, successors and assigns of the parties hereto and  shall be binding upon all future owners of all or any part of the Subdivision and  shall be deemed covenants running with the land, unless otherwise released  pursuant to section 14 of this Agreement.    b. Validity.    If a portion, section, subsection, sentence, clause, paragraph or phrase in this  agreement is for any reason held to be invalid by a court of competent  jurisdiction, such decision shall not affect or void any of the other provisions of  the Development Agreement.    c.
