City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike – The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more – groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. DRAFT MINUTES CITY OF LINO LAKES PLANNING & ZONING BOARD MINUTES 1. CALL TO ORDER AND ROLL CALL Chair Root called the Lino Lakes Planning & Zoning Board meeting to order at 6:30 p.m. on January 10, 2024. 2. PLEDGE OF ALLEGIANCE 3. NOMINATION OF CHAIR & VICE CHAIR Mr. Evenson made a motion to nominate Mr. Root for Chair and Mr. Wipperfurth nominated Mr. Laden for Vice Chair. Mr. Root confirmed they would proceed with the nominations for Mr. Root as Chair and Mr. Laden as Vice Chair. 5. APPROVAL OF MINUTES Mr. Vojtech moved to approve the November 8, 2023 meeting minutes. Mr. Vojtech moved to close open mike. Motion seconded by Mr. Evenson. Open mike was closed at 6:32 p.m. 7. ACTION ITEMS A. Jansen Addition Preliminary Plat Ms. Larsen presented the staff report. The applicant, Boulder Contracting, submitted a land use application for preliminary plat for Jansen Addition. The applicant proposes to subdivide the existing parcel located at 523 Lois Lane into three (3) single family lots for the purpose of constructing two (2) new single family homes. The lot is 1.11 gross acres (48,510 sf). Mr. Evenson questioned the verbiage requiring sod in all areas not improved. He recalls a new state law that cities cannot require that. Ms. Larsen said that is correct they could do native plantings. Ms. Larsen went on to say we could add that to our standard language. Josh Mattson, 3656 236th Lane NW, St Francis, MN 55070. Mr. Mattson was in attendance representing the applicant, Boulder Construction. There were no questions or comments for Mr. Mattson. Mr. Root opened the public hearing at 6:44 p.m. No public comments were made. Mr. Evenson moved to close the public hearing. Motion seconded by Mr. Vojtech. The public hearing was closed at 6:45 p.m. Mr. Evenson moved to approve the preliminary plat subject to the conditions listed in the staff report. Motion seconded by Mr. Laden. Motion carried 6-0. B. Water Treatment Plant Property Rezoning from R-1X to PSP Ms. Larsen presented the staff report. Planning & Zoning Board January 10, 2024 Page 3 DRAFT MINUTES The City is rezoning the property located at 6590 12th Avenue from R-1X, Single Family Executive to PSP, Public and Semi-Public for the purpose of constructing the City’s water treatment plant. Mr. Laden questioned why the City is rezoning. Ms. Larsen stated it was to be consistent with other public buildings. Mr. Evenson asked if there would be noise from the facility. Ms. Larsen stated there would be no noise and there would be minimal employees. Mr. Root opened the public hearing at 6:51 p.m. Lisa Beckman, 6524 White Oak Road, Lino Lakes, MN 55038. Ms. Beckman questioned if anyone on the Board had been to a water treatment facility? She had heard that they are quite a bit louder. Mr. Grochala stated there would be no noise. Jack Burch, 6572 White Oak Road, Lino Lakes, MN 55038. Mr. Burch questioned if the City had purchased the property. Mr. Root confirmed that it had been purchased. Mr. Burch also inquired about the five other well locations and why they were not selected as the location for the water treatment plant. He asked if there were going to be any other uses for the property such as wildlife ponds or bike trails. Mr. Burch asked where the funding came from and if taxes would go up. Mr. Burch also wanted to know why he was not informed of the meeting. He stated when he called the City he was told the City would be sending out notices. He said he did not receive the notice. Mr. Burch also wanted to know the cost of the project. Mark Groff, 6613 Ruffed Grouse Road, Lino Lakes, MN 55014. Mr. Groff said Ms. Larsen stated the tax accessor said the plant would not have an effect on property value but he wanted to know what realtors say about it affecting the value. Barb Christensen, 6520 White Oak Road, Lino Lakes, MN 55038. Ms. Christensen does not understand why the City needs to rezone and would like to see the property also preserve wildlife. She also wanted to know if any studies were done on the sound level at water treatment plants. Wendy Kufner, 6606 Wild Turkey Trail, Lino Lakes, MN 55014. Ms. Kufner had questions about cost, location choice, emanating odors and if other uses are planned for the building. Ms. Kufner wanted to know if the public would have input on the design of the building and outside landscaping. She stated there are deer that leave her backyard and go into the direction of the water treatment plant and wanted to know if that was Planning & Zoning Board January 10, 2024 Page 4 DRAFT MINUTES going to be addressed. She feels it is a safety issue where they are crossing. Ms. Kufner also questioned the possibility of increased traffic in the future. Chris Kufner, 6606 Wild Turkey Trail, Lino Lakes, MN 55014. Mr. Kufner thought after having a conversation with the Mayor, he got the impression that the plant would be set lower on the property but this is not shown in the rendering. He said he would like to see it also set further back on the property if that is a possibility. He added screening on the property would be appreciated to decrease noise. Lisa Grone, 6624 Wild Turkey Trail, Lino Lakes, MN 55014. Ms. Grone wanted to know why the parcel was being rezoned and why they did not select the area near the water tower for the water treatment plant. Mark Braun, 6625 Wild Turkey Trail, Lino Lakes, MN 55014. Mr. Braun questioned if the existing land behind the water treatment location would remain open land or would it be used for a housing development. He also wondered if it would affect the runoff with the Rice Creek Watershed District going into the wetland across the street. Jack Burch, 6572 White Oak Road, Lino Lakes, MN 55038. Mr. Burch wanted to know how the water flow is going to work the water towers to the water treatment plant and back to the water towers. Marcella Raine, 1205 Chokecherry Road, Lino Lakes, MN 55038. Ms. Raine wanted to know what the treatment plant would look like from 12th Avenue. Charles Grafstrom, 6495 White Oak Road, Lino Lakes, MN 55038. Mr. Grafstrom asked if there would be any hazardous chemicals that could catch on fire at the plant. Gloria Pederson, 6658 Ruffed Grouse Road, Lino Lakes, MN 55014. Ms. Pederson requested more environmental information due to the creek that runs through the property. She also said Ms. Larsen stated that property value would not be impacted due to the water treatment plant and wanted to know if research has been done by anyone other than realtors. She wanted to see the reports and not just take the City’s word for it. Mr. Kohler moved to close the public hearing. Motion seconded by Mr. Wipperfurth. The public hearing was closed at 7:07 p.m. Planning & Zoning Board January 10, 2024 Page 5 DRAFT MINUTES Mr. Wipperfurth stated the P & Z Board did not have input on the design of the building and it was their first time seeing the rendering of the building. He questioned if the design would be coming to them in the future. It was determined that it would not be coming to the P & Z Board for review and that it is more administrative. Mr. Grochala said the City has few months before bids are open for the project and there is the possibility of having an open house. Mr. Root also addressed the concern of the notification of the project to the public and questioned how we would get notice to the public regarding an open house. Ms. Larsen stated we would come up with a way to get notification to the public. She further stated in regard to the public hearing that notices were sent out to residents within 600 feet of the property, and it was published in the Quad Press, which is the official City newspaper. There were concerns regarding noise emanating from the property. Mr. Grochala said the facility was made of enclosed concrete walls. He stated he would follow up and verify the noise level and the only noise level that was addressed was the backup generator that will be located outside. They have decibel readings on the generator which is equivalent to a lawnmower noise level. It would be in the perimeter of the noise level ordinance. He also addressed the concern of property values. Mr. Burch approached the mike and stated there were many people that did not receive the notice and that he was more than 600 feet from the property and had no idea it was in the paper. Mr. Grochala stated it was in the Quad Press. Mr. Root asked staff to verify that the mailing went out. Mr. Root again stated the concern of property values. Mr. Grochala stated there was no evidence to show it affects property values. Mr. Grochala stated they checked with the County Assessor’s office as a courtesy as they are familiar with these types of facilities. They indicated no impact. Mr. Root addressed the question as to why this location was selected and if there are other uses planned for the property. Mr. Grochala stated the property is zoned R1-X. Mr. Grochala stated that absent the City purchasing the six acres, the rest would be developed as single family housing throughout that area. The area south of the property is zoned R1-X and he anticipates that area will also be single family housing. Mr. Grochala explained how the water system works and explained this area was selected due to the location of the wells we have now and future wells. He said it was most cost effective to tie this building into the infrastructure that was already in place. Mr. Grochala said the estimated cost of the facility is about $30 million dollars. The City Planning & Zoning Board January 10, 2024 Page 6 DRAFT MINUTES received a state appropriation of around 13.5 million dollars and the City is also eligible for a couple million dollars additionally due to the Manganese levels in the City water. A portion also comes from development charges that pay for the trunk utility system as well as water rates. There is a fixed fee on the water bill that residents have been paying for years that will go to pay for this system. Mr. Root asked if there were any additional uses for the property. Mr. Grochala stated there was not. He said there will be a stormwater pond going in on the west side of the property which was created due to the new impervious surface. He also stated due to the wetlands that are there, wetland buffers will be incorporated. Mr. Grochala said regarding the landscaping, it will be native prairie on the south and west sides. Turf will be used in the front of the building on the northeast side. Mr. Grochala said there will be a lot of trees around the building. Mr. Grochala addressed the raised elevation of the building and said it was due to the minimum elevation between the ground water and the basin and that there is a storage tank on the south side of the building and it must be above those. This is what dictated the elevation of the building. It will show a slight incline from 12th Avenue and more visible from Birch. Mr. Root asked if the area would remain sand hill crane friendly? Mr. Grochala stated it would especially on the west side of the building. Mr. Root asked what the project would look like from 12th Avenue. Mr. Grochala said the view from 12th Avenue will be the front of the building. It will consist of a lot of glass and two garage doors. The overall size of the building is approximately 17,000 square feet. Mr. Laden asked what the purpose of the green roofing material was. Mr. Grochala stated it was proposed roofing made of plant material. They are still reviewing the benefits of this type of material. Mr. Root questioned other uses for the building. Mr. Grochala stated there would be none. There are no other community facilities in the building and will mainly consist of one person checking the facility each day. Mr. Root asked if there would be chemicals stored at the facility. Mr. Grochala stated the facility uses biological treatment and not chemicals. The system is designed to remove manganese and iron and it is not a water softener. Mr. Root asked if there would be an odor emanating from the facility. Mr. Grochala said not that he was aware of. Mr. Laden moved to approve the rezoning from R-1X to PSP subject to conditions listed in the staff report. Motion seconded by Mr. Evenson. Motion carried 6-0. This open house would be used to receive feedback from the community regarding the water facility. Mr. Wipperfurth seconded the motion. Motion carried 6 – 0. C. ZOTA Renumeration and Codification Ms. Larsen presented the staff report. The City is renumbering and codifying the zoning ordinance. The development proposes a 36,000 sf multi-tenant industrial and indoor self-storage building on the south half of property located at 440 Park Court. The north half of the site is the existing Lino Lakes Storage. Rud & Sons, Inc. dated January 26, 2024 • Stormwater Management Plan prepared by Elan Design Lab dated January 26, 2024 • Wetland Delineation Report prepared by Jacobson Environmental, PLLC dated May 11, 2023 ANALYSIS History On September 10, 2018, the City Council passed Resolution No. 18-103 approving a conditional use permit for the mini self-storage facility located on Phase I, the north half of the 440 Park Court site. Phase II, the south half of the site, was contemplated for additional mini self-storage facilities; however, in January 2023, the new zoning ordinance was adopted and mini self-storage facilities are no longer allowed in the LI, Light Industrial zoning district. The applicant is proposing to construct an industrial building with eleven (11) multi- tenant industrial units to be used by construction related businesses. The building will also have an indoor self-storage facility. See the attached applicant’s narrative for a detailed project description. Existing Site The 5.74 acres site is legally described as Lot 4, Block 1, Marshan Lake Industrial Park. The north half of the site has 12 mini self-storage facilities. In August 2018, a Response Action Plan/Contingency Action Plan (RAP/CCP) was completed by American Engineering Testing, Inc. summarizing the actions proposed to manage the impacted fill soil/concrete debris and construction materials encountered during redevelopment of the site. The RAP/CCP was approved by MPCA in October 2018. The remediation work was completed in December 2021. The applicant shall 3 submit an MPCA RAP Implementation approval letter confirming the site was properly remediated prior to City Council decision. Zoning and Land Use The subject site is zoned LI, Light Industrial. Construction related business and indoor self-storage are permitted uses; however, a conditional use permit is required to allow for two (2) or more principal buildings on site (existing mini-storage facilities and industrial building/storage). Current Zoning LI, Light Industrial Existing Land Use Industrial Future Land Use per 2040 Comp Plan Industrial Utility Staging Area 1A=2018-2025 Only permitted uses listed in the LI, Light Industrial zoning district shall be allowed to operate in the multi-tenant industrial building units. Conditional uses would not be allowed. 1. For example, automobile repair-major or minor would not be allowed. Indoor self-storage or storage of personal items in the multi-tenant industrial building units shall not be allowed. 1. The intent of the units is to provide a location for smaller industrial users to operate. 2. Per City Code Section 1007.001 Definitions, outdoor access to individual units is prohibited for indoor self-storage. SELF-STORAGE, INDOOR. A fully enclosed, climate-controlled building that contains separate, individual and private storage spaces of varying sizes, leased or rented on an individual basis for the storage of personal property. Individual renters’ control and access individual storage spaces and each unit must be directly accessed from the interior of the building via its own access door. Outdoor access to individual units is prohibited. Ancillary retail sales of related items, such as moving supplies, and facility offices may also be included. Such facilities to be used for storage only. This general area east of Lake Drive has been zoned for residential use since at least the 1987 zoning map. Site and Building Plan Review Site Plan The total site is 5.74 acres. The Phase II area is approximately 2.5 acres. Per the Sheet A011, Site Plan, the 36,000 sf building contains: • Eight (8) 26’ x 58’(1,500sf) industrial units on the north side • Three (3) 25’ x 40’ (1,000sf) industrial units on the east side • Indoor self-storage area = 110’ x 165’ (19,997 sf) The industrial units have individual bathrooms. The mechanical room and trash enclosure is located inside the building. Access to Phase II is proposed through the Phase I mini self-storage private driveways. No additional access onto CSAH 23(Lake Drive) is allowed. Fence A six (6) foot high wood fence currently extends from the southeast corner of the mini self-storage building 80ft along Lake Drive. It then extends 300ft west along the southside of the existing mini self-storage buildings. The wood fence is weathered and in need of maintenance. The fence currently provides perimeter control around the mini self-storage buildings. The applicant is proposing to relocate the south section of fence to Lake Drive in front of the new building. The wood fence would then extend 300+ft along Lake Drive. This proposed 6ft fence in the Lake Drive yard is not allowed. Per City Code Section 1007.043(18) Fences and Retaining Walls: 5 (a) Business and Industrial District Fences. (See Diagram 3) Diagram 3 1. A fence not exceeding four (4) feet in height may be located in any yard. 2. A fence not exceeding eight (8) feet in height may be located parallel to the front lot line from a front corner of a principal building to a side lot line that is not adjacent to a street. City code does not require a fence for perimeter control. The applicant may install a 4ft high black chain link fence along Lake Drive similar to the fence along Park Court if perimeter control is desired. The existing 6ft wood, weathered fence shall be removed from the entire property. Lot Size and Setbacks The front lot line is along Park Court. Lot size, lot width and setback requirements are met. Each unit has a window. The exterior materials, colors, and percentages are compliant with performance standards. The proposed building height is 18’ 2” to the top of the wall. The proposed height is less than the maximum allowed 45ft. The trash & recycle room is located inside the building. Mechanical equipment is located inside the mechanical room. Any proposed or future rooftop mounted or ground units may require screening. Per Sheet A101, Floor Plan, an automatic sprinkler system shall be provided throughout the building for fire suppression. 7 A building permit for change of use is required for any new tenant that occupies an industrial unit. Outdoor Lighting Per City Code Section 1007.043(6)(d), no light source shall exceed 1.0 foot candle onto right of way or 0.4 foot candle onto adjacent property. Per Sheet E-0.1, no light sources exceed 1.0 foot candle along Park Court and Lake Drive. No light sources exceed 0.4fc along the west or rear lot line. The parking lot light pole is 20ft tall which is less the 45ft maximum allowed. The parking lot light fixture is down lit and cutoff as required by city code. Downlit wall pack mounted lights are provided on the exteriors of the building. The outdoor lighting performance standards are met. The applicant is proposing 11 proof of parking spaces on the west side of the building. City Code Section 1007.044(7) details requirements for Parking Deferment. The applicant shall detail compliance with these requirements. Personal vehicles and delivery trucks cannot access, load, or turnaround near the 3 units on the east/southeast side of the building. The staging area for the indoor self-storage building also conflicts this area. The drive aisle in the east/southeast corner of the site accessing the staging area and 3 units shall be a minimum of 47ft wide to accommodate a 24ft wide drive aisle and 23ft deep parking stall. This matches what is provided on the north side of the building. 8 An ADA accessible route shall be provided to all units. The route cannot be behind parking stalls. Vehicles parking in the stalls in front of the unit doors cannot block accessibility. Grading Plan and Stormwater Management Per the City Engineer Memo dated March 6, 2024: The stormwater management for the Lino Lakes Tech Center consists of the installation of storm sewer structures and pipes to convey the site’s runoff to a new BMP (basin) on the west side of the parcel. The runoff is generated from the one 36,040 square foot storage building and associated driveway and parking that is proposed to be constructed on the site. The development of the site will result in 0.156 acres of reconstructed impervious, and 1.329 acres of new impervious for a total of 1.485 acres of total impervious. Tree Preservation and Mitigation Standards The Environmental Coordinator and Environment Board reviewed the tree preservation and landscaping requirements. The following comments are from the February 28, 2024 Environmental Board staff report. Additional comments are provided in the attached March 5, 2024 memo. A tree survey was performed that identified: Total Trees Removed 37 Trees Preserved 60 Trees Planted 56 Total Trees Planted or Preserved 116 9 In addition to the 56 large trees planted for the site, there will be 10 trees spaded and moved, and 50 trees preserved with Tree Protection Fence. The majority of the trees planned for removal are in the Basic Use Area, not in Environmentally Sensitive Areas, and will not require mitigation trees. Tree Preservation and Mitigation Standards have been met. Open Areas Landscape Standards The purpose of these standards is to provide general site beautification and high aesthetic quality with a mix of plant materials in open areas. Open area landscape standards call for 1 large tree and 2 large shrubs per 2500 sf. Required for 29,175 square feet of open space: 12 large trees 24 large shrubs Or 24 large trees Provided: 125 large trees Total provided trees includes 35 planted in open space and 37 existing trees along the west perimeter provide approximately 90 large trees of credit for this category. Open Areas Landscape Standards have been met. Buffer and Screen Standards The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. Continuous, year-round planting screens require, at the minimum, a double row of plants with triangulated spacing. A 6-foot high continuous planting screen will be required for the east perimeter (along Lake Drive). This requirement will be met with a combination of 4-foot berm, trees and shrubs planted in triangulated double row, and a fence on the downslope side of the berm closer to the parking lot. Buffer and Screen Standards have been met. Canopy Cover Canopy cover standards call for a minimum of 40% canopy coverage. Canopy coverage values are calculated per tree based on the anticipated size 15 years after planting, and the distance to hardscape edge from the planting location. 10 Vehicular hardscape planned: 21,765 sq. ft. Canopy cover requirement: 8,706 sq. ft. Canopy cover provided: 7,200 sq. ft. Canopy cover credit is given for 7 deciduous trees along the east parking lot perimeter and 5 deciduous trees along the perimeter of the proof of parking area. Replacing the 3 conifers on the east parking lot perimeter and 2 conifers on the proof of parking area perimeter with deciduous tree species will provide additional canopy cover credit to meet the standard. Canopy cover requirements have not been met. Foundation Landscaping The purpose of these standards is to soften and enhance building architecture, define access points, add color and seasonal interest, and to blend buildings in with the natural environment. These standards apply to building fronts and sides facing public or private streets. 2 large trees and 6 large shrubs are required per 100 linear feet of building. These plants should be within 30 feet of the building. The following substitutions are allowable: 1 large tree = 1.5 medium or 2 small trees 1 large shrub = 1.5 medium or 3 small shrubs Also, one large tree may be substituted for every 2 large shrubs in lieu of the shrub requirement at the discretion of the City. The applicable building faces requiring foundation landscaping for this project are the north and east sides. Large Trees Large Shrubs (or equivalents) Required-North 2 6 Provided-North 2 6 Required-East 2 5 Provided-East 2 6 The north building face (the front) will have 5 large trees planted near the northwest corner of the building. This will provide the 2 large trees required, with the remaining 3 large trees substituting for the required 6 large shrubs. 11 The east building face (along Lake Drive) will have 5 large trees planted near the southwest building corner. This will provide the 2 large trees required, with the remaining 3 large trees substituting for the 6 large shrubs. The foundation landscape requirements have been met. Sod and Ground Cover Standards All areas not otherwise improved in accordance with the approved site plans shall have a minimum depth of 4 inches of topsoil and be sodded including boulevard areas. Seed may be provided in lieu of sod in certain cases, including when the area is adjacent to natural areas or wetlands. The grading and landscape plans note the following cover types and quantities for disturbed areas: Sod 4,350 sf Turf at proof of parking area 6,280 sf No Mow Fescue Mix 21,805 sf Native Seeding 7,257 sf Stormwater Seeding 4,185 sf The stabilization plan includes 76% either native species or low-maintenance alternative turf varieties. This includes Mn DOT 33-261 for the stormwater basin area, a mesic prairie mix for the upland areas around the stormwater basin, and a low-maintenance fescue mix for the berm that runs along Lake Drive. A cover type should be specified for the proof of parking area. The landscape plan notes irrigation in front of buildings and boulevard areas. Signage A Comprehensive Sign Plan as required by City Code Chapter 1010 has been submitted as Sheet A302, Comprehensive Sign Plan. A separate Sign Permit Application with detailed sign information is required for the proposed signage and any future permanent, replacement, or temporary signage installation. Impervious Surface Coverage The east portion of the parcel is located in the Shoreland Management Overlay District of Marshan Lake. A maximum of 60% impervious surface is allowed. The remainder of 12 the site allows for 75% impervious surface coverage per the LI, Light Industrial zoning district. During site plan review for Phase I, Sheet EX3, Shoreland District indicated a total of 3.98 acres of impervious surface is allowed for the entire 5.73 acre site. Per Sheet C-101, Site Plan, the proposed impervious surface of the entire Phase I + Phase II site is 3.39 acres. Impervious surface requirements are met. Impervious Surface Coverage Total Parcel Size 249,763 sf 5.73 acres Allowed Impervious Surface 173,368 sf 3.98 acres Phase I + II Impervious Surface 147,885 sf 3.39 acres Traffic Study A trip generation statement was prepared by Traffic Impact Group, LLC dated June 13, 2023. The analysis estimates 165 daily trips. CSAH 23 (Lake Drive) is an A-Minor Arterial Reliever and has capacity for these additional trips. Level of Service is not impacted. Environmental Assessment Worksheet (EAW) An EAW is not required for the 36,000 sf industrial building. Wetlands A Wetland Delineation Report was completed by Jacobson Environmental, PLLC in May 2023. The wetland boundaries have changed since the first Wetland Delineation Report completed in August 2017. RCWD has not issued a formal Notice of Decision (NOD) approving the new delineation. There appear to be no wetland impacts proposed with the Phase II industrial building. An official RCWD NOD is required prior to City Council action on the Conditional Use Permit and Site & Building Plan Review. Drainage and utility easements at least 10ft from the approved wetland delineation boundary is required. The existing easements do not appear to cover the minimum 10ft. A separate Drainage & Utility Easement Agreement shall be recorded. Shoreland District As previously discussed, the east portion of the parcel is in the Shoreland District of Marshan Lake (Natural Environment). The amount of impervious surface allowed in the Shoreland District is 60 % and the LI, Light Industrial District is 75%. The impervious surface requirements are met as discussed under Impervious Surface above. 13 Floodplain There is no FEMA floodplain on site. Additional City and Government Agency Review Comments Anoka County Highway Department Anoka County Highway Department reviewed the site plan and provided comments in their February 12, 2024 email. A right-of-way permit from the County is required. Public Safety Comments Lino Lakes Public Safety Department-Fire Division notes concerns regarding access to the westside of the building and possible blocked exit door by the snow storage pile. Lino Lakes Public Safety Department-Police Division reviewed the site & building plans and had no comments. Environmental Board The Environmental Board reviewed the development proposal at their February 28, 2024 meeting and noted some with minor revisions are needed. These are summarized in the attached March 5, 2024 Environmental Coordinator memo. Agreements Stormwater Maintenance Agreement The stormwater facilities will be privately maintained and a Declaration for Maintenance of Stormwater Facilities will be required. Site Improvement Performance Agreement A Site Improvement Performance Agreement is required and will be drafted by the City. Comprehensive Plan Resource Management System The Resource Management System Plan goal of preserving surface water quality is supported by the construction of stormwater management BMP’s such as curb, gutter, and stormwater pond. 14 Land Use Plan The Comprehensive Plan guides this property for industrial use. The proposed multi- tenant industrial and indoor self-storage building is consistent with industrial land use. Housing Plan The goals and policies of Housing Plan are not negatively impacted by the multi-tenant industrial and indoor self-storage building. Transportation Plan Goals of the Transportation Plan are to ensure that street and roads are as safe as possible and to reduce unnecessary traffic. The multi-tenant industrial and indoor self- storage building does not change the level of service along CSAH 23/Lake Drive or Park Court. Customers will egress/ingress the site from Park Court to CSAH 23/Lake Drive. CSAH 23 (Lake Drive) is an “A” minor reliever road and has capacity to handle minimal traffic volumes created by the development. Sanitary Sewer and Water Supply Plan An 8” sanitary sewer main will be installed along CSAH 23 (Lake Drive) and service the industrial building. A 12” watermain located along Park Court will also service the building. The sanitary sewer and water supply systems have capacity for the proposed industrial building. Findings of Fact Conditional Use Permit The subject site is zoned LI, Light Industrial. Construction related business and indoor self-storage are permitted uses; however, a conditional use permit is required to allow for two (2) or more principal buildings on site (existing mini-storage facilities and industrial building/storage). Per City Code Section 1007.016(3): (e) The Planning and Zoning Board shall hold the public hearing and consider possible adverse effects of the proposed conditional use. Its judgement shall be based upon, but not limited to, the following factors: 15 1. The proposed development application has been found to be consistent with the design standards listed in City Code Section 1007.020(4). See below. 2. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. The proposed multi-tenant industrial and indoor self-storage building will not involve activities detrimental to any person, property, or the general welfare. 3. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. The proposed multi-tenant industrial and indoor self-storage building will not result in the destruction of a natural, scenic, or historic feature of major importance. Per City Code Section 1007.020: (4) Performance Standards. Plans which fail to meet the following criteria shall not be approved. (a) The proposed development application must be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. The proposed multi-tenant industrial and indoor self-storage building is consistent with industrial land use. (b) The proposed development application is compatible with present and future land uses of the area. The proposed multi-tenant industrial and indoor self-storage building is compatible with present and future land uses of the area. (c) The proposed development application conforms to performance standards herein and other applicable City Codes. The proposed multi-tenant industrial and indoor self-storage building conforms to City Code performance standards with minor revisions as noted in this staff report. (d) Traffic generated by a proposed development application is within the capabilities of the City when: 16 1. If the existing level of service (LOS) outside of the proposed development is A or B, traffic generated by a proposed development will not degrade the level of service more than one grade. 2. If the existing LOS outside of the proposed development is C, traffic generated by a proposed development will not degrade the level of service below C. 3. If the existing LOS outside of the proposed development is D, traffic generated by a proposed development will not degrade the level of service below D. 4. The existing LOS must be D or better for all streets and intersections providing access to the proposed development. If the existing level of service is E or F, the developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 5. Existing roads and intersections providing access to the proposed development must have the structural capacity to accommodate projected traffic from the proposed development or the developer will pay to correct any structural deficiencies. 6. The traffic generated from a proposed development shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer-financed improvements to correct any street deficiencies. 7. The LOS requirements in paragraphs 1. to 4. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the proposed development project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange. The proposed multi-tenant industrial and indoor self-storage building is within the capabilities of the City. CSAH 23 (Lake Drive) is an “A” minor reliever road and has capacity to handle minimal traffic volumes created by the development. Level of service is not impacted. (e) The proposed development shall be served with adequate and safe water supply. 17 The proposed multi-tenant industrial and indoor self-storage building will be municipally served by a 12” watermain located along Park Court and will have an adequate water supply. (f) The proposed development shall be served with an adequate or safe sanitary sewer system. The proposed multi-tenant industrial and indoor self-storage building will be municipally served by an 8” sanitary sewer main installed along CSAH 23 (Lake Drive) and will have an adequate waste disposal system. (g) The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. The proposed multi-tenant industrial and indoor self-storage building does not require City funds. (h) Fire prevention and fighting equipment acceptable to the Board of Fire Underwriters and City Council shall be readily available when any activity involving the handling or storage of flammable or explosive materials is carried on. The proposed multi-tenant industrial and indoor self-storage building does not involve any activity involving the handling or storage of flammable or explosive materials. Specific Conditional Use Permit (CUP) Requirements In addition to the above administrative requirements of a conditional use permit, the following specific performance standards of City Code Section 1007.120(9) must also be met: (g) Two (2) or more principal buildings on same lot provided such buildings relate to a permitted or conditional use that is operated as a single business or enterprise. The Phase I-Lino Lake Storage mini self-storage facility and Phase II multi-tenant industrial and indoor self-storage building shall be operated as a single business or enterprise. Planning & Zoning Board Consideration 1. Does the Board support the name Lino Lakes Tech Center? 18 RECOMMENDATION Staff recommends approval of the 440 Park Court conditional use permit and site & building plan review subject to following conditions: 1. Permitted uses listed in City Code Section 1007.120(7), LI, Light Industrial zoning district shall be allowed to operate in the multi-tenant industrial building units. 2. Conditional uses as listed in City Code Section 1007.120(9), LI, Light Industrial zoning district shall not be allowed to operate in the multi-tenant industrial building units. 3. Indoor self-storage or storage of personal items in the multi-tenant industrial building units shall not be allowed. 4. The Phase I-Lino Lake Storage mini self-storage facility and Phase II multi-tenant industrial and indoor self-storage building shall be operated as a single business or enterprise as required per City Code Section 1007.120(9)(g). 5. A Parking Deferment Agreement shall be recorded. a. If the proof of parking area is constructed in the future, the parking spaces in front of the west unit shall be striped “No Parking” to allow for a 24ft wide drive aisle 6. A Site Improvement Performance Agreement shall be executed. 7. A Declaration for Maintenance of Stormwater Facilities in favor of RCWD and the City shall be recorded. 8. A Permanent Drainage and Utility Easement 10ft above the delineated wetland boundary, 10ft above the stormwater pond 100 year HWL, and over the sanitary sewer pipe shall be granted to the City and recorded. 9. If installed, rooftop or ground mounted mechanical equipment shall be screened per City Code Section 1007.043(2)(d)14. 10. Annual inspections may be conducted by the City to ensure City Code compliance. 11. A separate sign permit application shall be submitted and approved by the City prior to any permanent, replacement, or temporary signage installation. 12. A building permit for change of use is required for any new tenant that occupies a multi-tenant industrial building unit. 13. An Anoka County right-of-way permit is required. The following items shall be addressed prior to City Council action: 1. All comments from the City Engineer memo dated March 6, 2024. 2. All comments from the Environmental Coordinator memo dated March 5, 2024. 3. Electronic copies of the following items shall be submitted to the City: a. Geotechnical Report b. The attached application and associated materials are for the Site & Building Plan CUP Review Submittal. BACKGROUND FOR LINO LAKES PROJECT Lariat Companies, Inc. was formed in 1989 by owner and founder, Ed Flaherty. He has a significant business background that includes starting four companies that grew to over $100M in sales. Applebee’s and Rapid Oil Change are companies that Ed started which you would recognize. As part of his investment strategy, he started Lariat as a family office and real estate company. In 1990 he purchased 40+ acres around the Eden Prairie Center. He built that out over a period of 10 years (all speculative buildings) and owns and manages seven buildings today on that land, Lariat has been a long-term owner of real estate and has mostly done speculative development as an owner and rehab/turnaround of troubled real estate. Currently, lariat owns and manages approximately 1M square feet of retail, industrial, commercial office-warehouse, and self- storage. All this real estate is in Minnesota. As a small business owner, Ed has seen the need for commercial small tenant space and is now creating a number of projects addressing this need. Most office/warehouse for lease space starts at 5,000 square feet and increases from there. That size space is too large for emerging business. Current Lariat projects include buildings in Waconia, Coon Rapids and in Chaska. There are three buildings in Waconia; one building is 12,000 square feet, one building is 9,000 square feet and a third building is 8,000 square feet. There are also two buildings in Bloomington near the Mall of America. The tenant mix in Waconia includes the following uses: plumbing contractor, manufacturer’s rep/showroom, auto restoration, environmental company, flooring distribution and installation, small parts manufacturer, on-line retailer (e-trailer), dry wall contractor, aviation equipment, repair and sales and disaster repair contractor. All these tenants, but one, came out of operating in their home and/or self-storage spaces. We also have two buildings in Bloomington which have larger bays (2,200 – 2,800 square feet). The tenant mix in these two buildings include granite showroom and fabricator, internet contractor, kitchen cabinet showroom and distributor, apparel goods wholesaler and retailer, printer, small parts manufacturer, CPA, Hispanic spice distributor, T-Shirt screen printer, overhead garage door company, photographer, industrial tool repair and distributor, HVAC contractor, audio visual contractor and distributor, and orthopedic appliance fabricator and repair. Most of these businesses in Bloomington were mature enough they just needed larger space. Lariat has developed management systems that allow us to manage these small users efficiently and effectively. Attachment 2: Applicant Narrative With the “GIG” economy claiming 25% of Americans have a side business or “GIG” and the younger generation expecting to have up to a dozen jobs in a lifetime, the days of a person working for one larger company is less likely. The younger generation have unfavorable attitudes towards large companies and hence some of the impetus to the “GIG.” LINO LAKES CORE VALUES Minimize Light Pollution The nature of the project is small in height, therefore the amount of light emitted will be close to the ground with the minimum of site lighting, the amount of light spillage will be minimal. Welcoming Building This project is accessed on one level and that is the street level only, there are eleven entry doors, one for each suite & one main entry for the inside storage, plus an exit door on the west side of the building. Zoning The current zoning is L1 and will not be changed. Sustainable Initiatives The building will be in full compliance with the Minnesota Energy Code requirements. These standards are summarized in the PUD Master Plan Booklet and are incorporated as part of the Master Development Agreement. Each phase (i.e. addition) of development shall submit a PUD Final Plan consistent with the PUD Development Stage Plan. In October 2017, Council approved an amendment to the PUD Development Stage Plan’s overall Land Use Plan. The Land Use Plan established 871 housing units. As the applicant has worked through final plan design to address City and RCWD comments from the preliminary plat, the number of 55’ wide villas was reduced from 127 units to 120 units. The net number of housing units is now 864. In August 2023, Council approved PUD Amendment #4-PUD Development Stage Plan/Preliminary Plat. The amendment reconfigured the north end of the preliminary plat in regards to lot sizes and housing products. The total number of housing units remains 864 and does not change. 3 Density The 2030 Comprehensive Plan was in effect at the time of original approval. The Plan guided the area for mixed use and required a density of 3.0 to 4.5 dwelling units per net acre. The current 2040 Comprehensive Plan guides the area for Low Density Mixed Residential and requires a density of 3.0 to 4.0 units per net acre. The development meets both density requirements. Phase I grading was approximately 140 acres and Phase II grading was approximately 20 acres. Phase III grades out the balance of the site, approximately 212 acres. The 7th Addition final plat is within the Phase III grading limits. PUD Final Plan Watermark 7th Addition creates 106 single family lots and 8 outlots. The PUD Final Plan is consistent with PUD Amendment #4 in regards to the land use plan, street and utilities, parks and open space, lot standards, and landscaping. The following housing types and products proposed for the 7th Addition are consistent with the approved Land Use Plan. As required, a Watermark 7th Addition Home Plans summary booklet and Architectural Standards Matrix were submitted. The booklet and matrix detail compliance of the housing products with the resolutions in regards to exterior materials and styles, house elevations and garage and porch requirements. There are over 30 different single family house plans with multiple facade and elevation options for a combination of over 275 different housing styles proposed for the 7th Addition. Color packages and anti-monotony plans will be included with each building permit application to ensure that the homes elevations are varied with a minimum of five different styles and those homes in proximity to each other not look alike in terms of the combination of color of siding, accent and roofing materials. Coventry by Alside vinyl siding with .042” panel thickness is proposed on all the housing units. All houses have minimum 4” window trim on the side and rear elevations to meet resolution requirements to incorporate an architectural feature into those elevations that are visible from 20th Avenue (CSAH 54), 21st Avenue N. and the public park. In summary, the Watermark 7th Addition single family housing types and products meet the architectural design standards requirements of Resolution No. 17-133 and Resolution No. 19- 131. HOA Clubhouse Lot 1, Block 3, Watermark 4th Addition was platted for the construction of the HOA clubhouse. Construction started in May 2023 and is scheduled to open in Spring 2024. Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The Watermark 7th Addition final plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed final plat meets the performance standards of the subdivision and zoning ordinance and is consistent with PUD Amendment #4-Development Stage Plan/Preliminary Plat and Final Plan. Public Land Dedication and Fees Per Resolution No. 16-51, the City will require the following combination of land dedication and cash in lieu of land dedications: 1. Land dedication for the public and private parks will be credited from the total payment in lieu. 2. Costs for public park improvements and trail construction will be credited from the total payment in lieu. 3. Improvements to the private parks and recreational center will not be credited from the total payment in lieu. An 8.5 ft wide bituminous trail approximately 4,850lf in length will be constructed throughout the plat. A Permanent Trail Easement with exhibit shall be drafted and recorded after the trail has been constructed to ensure the trail is within the easement. Trail construction costs will be credited. Park dedication fees will also be credited for the 1.06 acre private park land platted as Outlot G, Watermark 7th Addition. Per the Master Developer Agreement (MDA), the parkland dedication fees are based on an appraisal of fair market value. The appraisal was prepared in December 2018 by Insight Realty Advisors, Inc. The comparable appraisal price for this private park is $37,647 per acre. The total park dedication fee is $39,906 (1.06 acres x $37,647). The following is a summary of the public land dedication and fees: 7 Watermark 7th Addition Total # Units = 106 x Park Dedication Fee $3,300 = Cash in Lieu Value $349,800 (Trail Construction Costs) ($150,350) (Land dedication value (Outlot G, Watermark 7th) ($39,906) TOTAL CASH FEE DUE = $159,544 Wetlands Wetland delineations were approved by RCWD and USACE in 2015. The delineation identified 28 wetlands totaling approximately 20 acres in size. The original approved WCA Sequencing Application proposed wetland impacts, wetland creation, wetland restoration and upland buffer establishment. In April 2018, the developer revised the application to purchase 3.3671 acres of wetland banking credits as the proposed compensatory mitigation action. The wetland fill, impacts and mitigation (wetland bank credits) occurred within the Phase I grading limits and are complete. In December 2020, the developer submitted another Wetland Replacement Plan to RCWD for the balance of the site. Phase 3 grading impacts 5.9784 acres of wetland which require a 1:1 mitigation. The plan was to buy wetland credits for mitigation; however, viable wetland restoration and creation opportunities exist within Phase 3; therefore, onsite restoration and creation will be used for mitigation. This is consistent with the Parks and Open Space Plan and the establishment of the greenway corridor including wetlands, trails and open space. To date, wetland mitigation and restoration has been completed on Wetland Restoration Area RA1. Wetland RA2 and RA3 are partially graded and restoration will be substantially completed in 2024. Open Space Easement Section 7.2 of the Watermark Master Development Agreement states the owner shall provide the City with a perpetual open space easement. The easement protects the parks, open space, wetlands etc. from any land disturbance that is not consistent with the Restoration and Management Plan. Currently, a “blanket” easement is in place that covers all outlots in 8 Watermark. As each such outlot is further subdivided, the blanket easement area is re-defined with a detailed open space easement. An Open Space Easement shall be recorded over Outlot A, Watermark 7th Addition. Sheet 3, Watermark 7th Addition Site Landscape Plan details the location of required “Protected Open Space Area” signs. Development Agreement Master Development Agreement A Master Development Agreement was recorded in March 2019. The Agreement covers the entire 372 acre site and details the terms and conditions of City approvals, the Development Plans, the required public and private improvements as part of the first and subsequent phase, the standards for the timing and financing of the improvements, required HOA documents and the terms of payment. Development Agreement and Planned Unit Development Agreement The City will also require our standard Development Agreement specific to each phase of development. This agreement further details required improvements and securities. The City Engineer will draft this Agreement and it shall be approved by the City Council. Homeowner’s Association (HOA) The City Attorney is reviewing the HOA documents. Any issues shall be resolved prior to City Council action. Title Commitment The City Attorney is reviewing the title commitment and final plat. Any issues shall be resolved prior to City Council action. Stormwater Maintenance Agreement The stormwater facilities will be covered under the City’s Programmatic Stormwater Management Agreement after they have been installed and accepted by the City. RECOMMENDATION Staff recommends approval of the Watermark 7th Addition PUD Final Plan/Final Plat subject to the following conditions: 9 1. Outlot A, Watermark 7th Addition is preserved as permanent Open Space and shall be improved by the Developer in accordance with the approved plans and upon completion and acceptance by the city of such improvements, they shall be owned and maintained by a Homeowner’s Association in accordance with an approved Restoration and Management Plan. 2. A Permanent Trail Easement with exhibit covering the trail shall be recorded after the trail has been constructed. 3. An annexation amendment to neighborhood declaration of covenants and supplemental declaration of covenants citing deed restriction shall be recorded stating lots with oversize drainage and utility easements may have limited ability to construct accessory structures. 4. Grading and seeding per the approved RCWD Permit 20-115 shall be substantially completed in Restoration Area 2 (RA2) prior to Council approval of Watermark 8th Addition. The following items shall be addressed prior to release of final plat mylars: 1. The 7th Addition Development Agreement shall be approved by the City Council, executed, and recorded against the property. 2. The PUD Master Plan Booklet dated August 31, 2018 shall be revised accordingly to reflect changes approved with PUD Amendment #4. 3. Final Plat: a. A drainage and utility easement shall cover Outlot A. 4. Land Use Plan: a. Revision date shall be corrected to 08/16/2023.
