When presenting at a meeting please remember to be respectful and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more—groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing—Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer(Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four(4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments,the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally,the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Environmental Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. APPROVAL OF AGENDA The agenda was approved as presented. 4. APPROVAL OF MINUTES Ms. Holmes made a motion to approve the January 31, 2024 meeting minutes. Motion was seconded by Mr. Parsons. Motion carried 6-0. 5. OPEN MIKE Chair Sullivan declared open mike at 6:32 p.m. There was no one present for open mike therefore it was closed at 6:32 p.m. Environmental Board February 28,2024 Page 2 6. ACTION ITEMS A. 440 Park Court (Lino Lakes Tech Center and Storage Facility) Conditional Use Permit and Site Plan Review Mr. Nelson presented the staff report. The applicant, Lariat Companies, Inc., submitted a land use application for conditional use permit and site plan review. The development proposes a 36,000 sf multi-tenant industrial and indoor self-storage building on the south end of the site. The north end of the site is the existing Lino Lakes Storage. The architect, Greg Kinney with Amcon Construction was in attendance with no comments or questions asked. The Board discussed the proposed 440 Park Court Conditional Use Permit and Site Plan Review and requested to add the 71" recommendation that was not in the staff report but was on the slide show concerning perimeter control near the wetland. Motion was made by Ms. Buchmeier and seconded by Ms. Cavegn to approve the Conditional Use Permit and Site Plan Review with the addition to the 71n recommendation. Motion carried 6-0. B. 2024 Annual Work Plan and Ongoing Tasks List—2nd Draft Mr. Nelson presented the staff report. The Environmental Board serves to provide aid and advice to the Council in its efforts to encourage productive and enjoyable harmony between people and their environment; to promote efforts which will prevent or eliminate damage to the environment and stimulate the health and welfare of people; to enrich the understanding of the ecological systems and natural resources important to the city; to advise the city in the use and management of its natural resources in order to preserve and enhance the environmental amenities for present and future residents, and to improve and ensure a lasting quality of life within the City. (City Code Chapter 217.01). Chair Sullivan mentioned that the term 'biodiversity' didn't appear in the work plan. Ms. Holmes stated that the term wasn't included but that the concept was covered. Chair Sullivan also pointed out a typo on the numbering of the ongoing tasks list under natural resources. Number "3" should be changed to number "1". Mr. Nelson responded that the typo would be corrected. TOPIC: Natures Refuge North—Restoration and Tree Mitigation Plan BACKGROUND Natures Refuge North is a proposed subdivision with 99 single-family residential lots on an approximately 59.3 acres site located just north of the Natures Refuge development on Main Street. The Environmental Board first reviewed a concept plan for the Natures Refuge North project at the October 25th, 2023 meeting. Since the initial meetings with the Environmental Board and Planning and Zoning Board,the developer, M/1 Homes, has been working through the recommendations and requirements to further explore the feasibility of the project. A tree inventory has been completed that identified 6,400 trees on the site, with approximately 4,600 removals. The developer's estimate for replacement trees required is 3,900 trees. This would equate to a tree mitigation cost ranging from $1.3-$2.3 million dollars. While all of these numbers are approximate and refinement of the project plan is ongoing, these numbers could impact the feasibility of the project. The developer has reached out to the City in the hopes of finding a collaborative solution that may lead to a better long-term outcome for the outlots and natural areas. Additionally,the developer continues to find ways to minimize impacts to existing trees. Emily Becker, Land Development and Entitlements Manager with M/l Homes, will be present at tonight's meeting to discuss the development and potential alternatives/supplements to the tree mitigation. While the tree mitigation section of the landscape ordinance works well for most projects, there are sites for which strict adherence to mitigation numbers may not lead to the best outcome from the perspective of native plant communities. Natures Refuge North, for example, is located in an area with many rare and protected species of plants and animals that rely on certain habitat conditions for their survival. Many wetland plants are adapted to full sunlight and may not persist beneath heavy tree canopy. Oak savanna habitat, which was also common in the area historically, is characterized by sparse tree canopy cover(5-50%)with prairie grasses and forbs in the understory. Wetlands and oak savanna ecosystems both exhibit higher biodiversity than the closed-canopy woodland currently on the site. The restoration of these historic and rare ecosystems may be preferable to strict adherence to the tree mitigation numbers required by the Zoning Ordinance. Flexibility is provided for in the ordinance language and supported by precedence set by other sites (including Natures Refuge). • City Code Section 1007.049 (10)(e) states "Areas where trees are being removed for ecological restoration in accordance with a city approved restoration plan are not subject to the tree preservation and mitigation." 1 Sites that have higher restoration potential, long-term management agreements, or connectivity with high-value greenway corridor components may all be areas for which alternatives to tree mitigation numbers may be acceptable. Also, alternatives considered should exhibit some higher value results than the tree planting alone would provide. Increased biodiversity; habitat enhancement for rare, threatened, endangered, or special concern species; and expansion and/or creation of key habitats, such as oak savanna; are all benefits that could be weighed against strict adherence to tree mitigation numbers. Alternatives to the tree mitigation described in ordinance have been utilized in the Foxborough, Saddle Club, and Preserve conservation developments. In these areas, long-term stewardship plans were prepared to achieve a more ecologically sound outcome. In these cases, planting the required amount of trees would have been detrimental to the goals of restoring the native plant communities that were historically present on the land. In the Natures Refuge development,which is currently under construction just south of the proposed project site, the mitigation requirement for removal of aspens in wetland buffer areas was waived in recognition of the fact that native wetland plants would not be able to thrive under aspen canopy. The same situation occurred in Saddle Club, with aspen removals in wetland buffers not subject to mitigation. Some ideas for consideration: • Restoring/establishing native plant communities that resemble historical conditions would be beneficial to rare plants and animals on or near the site and beneficial to biodiversity on the site in general. • Long-term management and stewardship would bring about a better result than would be typical of natural areas or outlots in sites with less restoration potential. Establishment of a stewardship fund would promote active management to benefit the land over time, as opposed to installation of a manicured landscape that would provide minimal environmental benefit. • Other aspects of the landscape ordinance will still be in effect. Highly valued landscape components for the site, such as buffers in the northwest corner,will still be required. • Baseline conditions of the site (current species list and abundance) should be gathered to measure the outcome of management activities and gage success. • The idea is not to eliminate mitigation tree planting, but to supplement tree planting with more focus on native plant community restoration and establishment. This is particularly important in areas that have connectivity with the larger wetland complex that extends from the site to the northeast to the Wollan Park wetland bank. At this point, staff would like to gather feedback from the Board on your willingness to support an alternative to the estimated tree mitigation numbers for this site. Staff is recommending a collaboration with the developer in the interest of achieving a final product that supports native plant communities, rare plants and animals, and the historically significant ecosystem types that would have been present on the land. If the Board is in favor of the latter option, a collaborative process will begin with opportunities for input as the project progresses. 2 ENVIRONMENTAL DIRECTION Discussion only. ATTACHMENTS 1. The lot is 1.37 gross acres (59,796 sf). The total impervious area will be 0.115 acres (11.1%), total pervious area 1.22 acres (88.9%). Land Cover Pre-settlement land cover (Marschner) was oak openings and barrens, an oak-dominated transitional area between deciduous forest and prairie. Current land cover (Minnesota Land Cover Classification System) on the site includes 26-50% impervious cover with coniferous trees. The tree survey identified a mix of red pine, cedar, ash, elm, and oaks. Rare, Unique,or Significant Resources Blanding's turtle (Emydoidea blandingii) has been observed within a one-mile radius of the site. Highways, roads, and other development separate the project site from suitable habitat for this species. Any sightings of this species, while unlikely, should be reported to City staff so that the turtles can be safely relocated. Project-related impacts to this species are unlikely, and additional protection measures are not required. Forster's tern (Sterna forsteri) has been identified within a mile of the project site. This species utilizes open water and marsh for feeding and breeding habitat. The project is not expected to impact this species. Soils The Natural Resource Conservation Service Web Soil Survey notes the following soil types on the project site: Soderville fine sand on 0-3 % slopes (98.8%). Also a hydrologic group A soil that is moderately well drained and not hydric. Permeability is rapid to moderately rapid with negligible runoff. Zimmerman fine sand on 2-6 %slopes (1.2%). This is a hydrologic group A soil that is excessively drained, not hydric,with rapid permeability and negligible to low surface runoff. Stormwater Management Stormwater management will be reviewed by the City Engineer. 2 Stormwater Pollution Prevention The Grading, Drainage, and Erosion Control Plan calls for silt fence on the south/down-gradient perimeter of both lots. A construction exit is shown for Lot 1. A construction exit must be added for Lot 2 unless all construction traffic will be routed through the exit at Lot 1. Inlet protections should be added to the up-gradient flared end sections on the west side of both lots. Flood Plain Site does not fall within the flood management zone. Shoreland District Site does not fall within the Shoreland District. Wetlands There are no wetlands indicated on this site in the National Wetlands Inventory. A 4,145 square foot wetland was delineated on the east perimeter abutting Hodgson Road. No impacts are proposed to this wetland. Greenway System, Parks and Trails The site is not part of the Greenway System. Alternative Urban Areawide Review(AUAR)Considerations The site is not within the 2005 I-35E Corridor AUAR environmental review boundary. Drinking Water Protection The site is not within the Drinking Water Supply Management Area (DWSMA). The site will be connected to City sewer and water. LANDSCAPE PLAN Boulevard Trees Boulevard trees are required for all new residential subdivisions at a rate of one tree per lot frontage. Boulevard trees are shown on the landscape plan for both lots. Boulevard tree requirements have been met. 3 Tree Preservation and Mitigation Standards The purpose of these standards is to protect valuable trees and stands of vegetation while not interfering with landowners' reasonable use and development of property. The goal is to minimize unnecessary loss of habitat, biodiversity, and forest resources and to replace removed trees in areas where tree cover is most critical. A tree survey was performed that identified: Total Trees 45 Total Trees Removed 7 Total Trees Preserved 38 Mitigation Trees Required 0 The trees planned for removal are in the Basic Use Area and will not require mitigation trees to be planted. An ash tree planned for removal is outside of the Basic Use Area but will not require mitigation due to the prevalence of Emerald ash borer in the area. There are 7 other infested ash trees that must be removed from the property as well. The trees planned for preservation on the west perimeter must have Tree Protection Zones installed in accordance with the City Tree Protection Fence Detail. This is noted on the Grading, Drainage, and Erosion Control Plan (Sheet C1.1). The same note must be added to the Landscape Plan (Sheet L1) in place of landscaping note#3. Tree Preservation and Mitigation Standards have been met. Open Areas Landscape Standards Open areas standards do not apply to single family residential lots. Buffer and Screen Standards The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. A 6-foot buffer and screen will be required for the east perimeter abutting Hodgson Road. This screen can be trees, shrubs, a fence, or some combination of these as described in City Code Section 1007.049 (6)(b). Buffer and screen standards have not been met. Canopy Cover Canopy cover standards to not apply to single family residential development. 4 Foundation Landscaping Foundation landscaping standards do not apply to single family residential development. Sod and Ground Cover Standards All areas not otherwise improved in accordance with the approved site plans shall have a minimum depth of 4 inches of topsoil and be sodded including boulevard areas. Seed may be provided in lieu of sod in certain cases, including when the area is adjacent to natural areas or wetlands. Seed mix for ground cover must be specified on the Landscape Plan and Grading, Drainage, and Erosion Control Plan. Sod and Ground Cover Standards have not been met. Lighting The purpose of the lighting requirements in the Zoning Code is to reduce light pollution, promote energy conservation, and increase night time safety, utility, security, and productivity. Lighting is reviewed by the City Planner. Per Section 1007.043(6)(d), no light source shall exceed 1.0 foot candle onto right of way or 0.4 foot candle onto adjacent property. Per Section 1007.043(6)(f), in residential districts, any lighting used to illuminate a structure, an off-street parking area, or other area shall be arranged as to deflect light away from any adjoining residential property or from any public right-of-way. While photometric plans aren't required for single residential houses, City Code requirements still must be met. RECOMMENDATIONS Staff recommends that the Preliminary Plat for the Linda Avenue Addition be forwarded to the Planning and Zoning Board and City Council with the following comments: 1. A 6-foot buffer and screen will be required for the east perimeter abutting Hodgson Road. This screen can be trees, shrubs, a fence, or some combination of these as described in City Code Section 1007.049 (6)(b). 2. Remove 7 additional Emerald ash borer infested trees from the site. 3. The trees planned for preservation on the west perimeter must have Tree Protection Zones installed in accordance with the City Tree Protection Fence Detail. This is noted on the Grading, Drainage, and Erosion Control Plan (Sheet C1.1). The same note must be added to the Landscape Plan (Sheet L1) in place of landscaping note#3. 5 4. The tree planting detail on the Landscape Plan (Sheet L1) shall include comments about exposing root flare so it is visibly at grade to ensure trees are installed at proper depth, and that mulch is pulled back 3 inches from the trunk(mulch is not left touching the trunk). 5. Seed mix for ground cover must be specified on the Landscape Plan and Grading, Drainage, and Erosion Control Plan. 6. A construction exit will be required for Lot 2 unless all construction access will be routed through Lot 1. 7.
