Wilkinson Waters Concept Plan (verbal update) ADJOURNMENT CITY OF LINO LAKES ADVISORY BOARD MEETING GUIDELINES Advisory boards are fact-finding bodies established to aid the City Council in specific areas. The decisions of any board are considered advisory only and all final decisions rest with the City Council. Board meetings shall operate in accordance with the procedures established by the City Council. The following meeting guidelines are derived from the City Council Rules of Decorum. Members of the Audience – No person in the audience shall engage in disorderly or disruptive conduct such as audible commentary during a meeting, hand clapping, stamping of feet, whistling, using profane language, yelling and similar demonstrations, which conduct disturbs the peace and good order of the meeting. Public Comment– Comments from the public will be accepted on any matter, whether on the agenda or not. Comments will not be accepted during specific agenda items unless a Public Hearing has been noticed. Please remember to be courteous and respectful and abide by the following guidelines: • Sign-in prior to the start of the meeting • Step up to the microphone when recognized by the Presiding Officer (Chair or Vice-Chair) • State your name and address for the record • State the subject to be discussed • Limit comments to 4 minutes • Address comments to the board as a whole, not any specific member • No question may be asked of a board member or staff member without the permission of the Presiding Officer (Chair or Vice-Chair) • Elect a spokesperson for a group of persons who wish to address the board on the same subject Public Hearing – A public hearing is a separate item of business on the agenda. It gives the public an opportunity to comment on the topic identified. Please remember to be courteous and respectful and abide by the guidelines outlined for public comment (although no sign-in required). Typically, a public hearing proceeds as follows: 1. The Presiding Officer (Chair or Vice-Chair) will announce the agenda item and staff will present their report. 2. Board members have the opportunity to ask staff questions about the item. 3. The Presiding Officer (Chair or Vice-Chair) opens the public hearing and will recognize those who want to speak. 4. The Presiding Officer (Chair or Vice-Chair) shall close the public hearing. 5. The Board will then discuss the item. No further public comments are allowed. 6. The Board will make a recommendation and/or decision. After a motion has been made or a public hearing has been closed, no member of the public shall address the board from the audience on the matter under consideration. The Presiding Officer (Chair or Vice-Chair) shall maintain strict order and etiquette at all meetings. Environmental Board July 31, 2024 Page 1 CITY OF LINO LAKES ENVIRONMENTAL BOARD MEETING 1. CALL TO ORDER AND ROLL CALL Chair Sullivan called the Environmental meeting to order at 6:30 p.m. on Wednesday July 31, 2024. 2. PLEDGE OF ALLEGIANCE 3. SETTING THE AGENDA: Addition or Deletion of Agenda Items The agenda was approved as presented. 5. APPROVAL OF MINUTES: May 29, 2024 Ms. Holmes made a motion to approve the May 29, 2024 minutes. Mr. Parsons seconded. Motion carried 6 – 0. 6. DISCUSSION ITEMS A. MS4 Annual Report and Public Comment Opportunity Mr. Nelson, Environmental Coordinator, introduced Tom Hoffman, the Engineering Technician with WSB. DATE: July 31, 2024 TIME STARTED: 6:30 p.m. TIME ENDED: 7:30 p.m. MEMBERS PRESENT: John Sullivan, Shawn Holmes Julia Nelson, Lindsay Buchmeier, Jonathan Parsons, Cassondra Cavegn MEMBERS ABSENT: Alex Schwartz STAFF PRESENT: Andrew Nelson, Dana Rozan Environmental Board July 31, 2024 Page 2 DRAFT MINUTES Mr. Hoffman clarified that the NPD MS4 permit is the National Pollution Discharge Elimination System, which allows the city to discharge stormwater within the city. Whether it is for new developments, storm sewer, or everything where stormwater is being discharged must meet the regulations set forward by the Minnesota Pollution Control Agency (MPCA). Mr. Hoffman reviewed the six minimum control measures (MCM) requirements, as well as 2023 municipal maintenance activities, construction inspections, and stormwater projects. The Board discussed and asked questions about the six minimum control measures. The Board also brainstormed public outreach techniques, specifically reaching out to the youths in the community to take part. B. 2024 Metropolitan Council Water Efficiency Grant Mr. Nelson presented his staff report. Ms. Buchmeier asked for clarification on how the program would work. Mr. Nelson clarified that residents could purchase any clothes washer, dishwasher, and toilets and then come into City Hall with the receipt that the appliance is a water sense device, then they would have to send in a picture of the installation to quality for the rebate. Mr. Parson expressed concerns about lawn irrigation enforcement on non-watering days. He suggested to include the irrigation controller flyer to the door tags Public Works post on violators doors. Ms. Buchmeier agreed, as well as including the flyer on electronic water bills. The Board showed support for the rebate program as it was presented. 7. UPDATES A. Shenandoah Park Improvements Mr. Nelson presented his staff report. Ms. Buchmeier asked if the plan presented is the final design. She expressed concern that the ditch would be close to a play area, and if it could be moved over a bit. Mr. Nelson said he would make it a note to pass on. Environmental Board July 31, 2024 Page 3 DRAFT MINUTES Mr. Parsons asked what the value is of expanding the ditch if it does not have an outflow. Mr. Nelson replied that the value of expanding the ditch is to reduce erosion. By expanding the ditch, it will slow down water flow and create a natural condition with vegetation and habitat. 8. ADJOURN Ms. Buchmeier made a motion to adjourn the meeting at 7:30 p.m. Motion was seconded by Ms. Holmes. Motion carried 6 – 0. Respectfully submitted, Dana Rozan – Office Specialist 1 ENVIRONMENTAL BOARD AGENDA ITEM 6A STAFF ORIGINATOR: Michael Grochala, Community Development Director MEETING DATE: August 28, 2024 REQUEST: Slater Addition Preliminary Plat APPLICANT: Boulder Contracting Attn: Brian Jansen 16522 Wake Street NE Ham Lake, MN 55304 OWNER: George and Jenelle Slater 7869 Meadow View Trail Lino Lakes, MN 55014 BACKGROUND The applicant, Boulder Contracting, submitted a land use application for preliminary plat for Slater Addition. The applicant proposes to subdivide the existing parcel located at 7869 Meadow View Trail into three single family lots for the purpose of constructing two new single family homes. The lot is 1.31 gross acres (61,295 sf). The Land Use Application is for the following: Preliminary Plat • 3 lots This staff report is based on a review of the following documents: • Certificate of Survey, Preliminary Plat, and Tree Survey prepared by E.G. Rud and Sons, Inc., dated July 30, 2024 • Civil Plan Set prepared by Plowe Engineering, dated July 31, 2024 ANALYSIS 2 General Site Characteristics The proposed project includes dividing and existing developed 1.31 acre parcel into 3 lots to accommodate the existing house and two new single family residential lots. Land Cover Pre-settlement land cover (Marschner) was aspen-oak land, an oak-dominated transitional area between deciduous forest and prairie. Current land cover (Minnesota Land Cover Classification System) on the site includes mostly planted mixed coniferous/deciduous trees with 11-25% impervious cover. The site contains an existing house and driveway with turf lawn. The tree survey identified a mix of planted oak, maple, boxelder, elm, pine, and spruce. Rare, Unique, or Significant Resources While several rare, threatened, or endangered plants have been observed within a mile of the project site, the suitable habitat for these species is separated from the project site by roads, houses, and other development. The plants are unlikely to be found on or near the site, which has been mowed and maintained as turfgrass for many years. No additional surveys should be required. Soils The Natural Resource Conservation Service Web Soil Survey notes the following soil types on the project site: Zimmerman fine sand on 2-6 % slopes. This is a hydrologic group A soil that is excessively drained with rapid permeability and negligible to low surface runoff. Soderville fine sand on 0-3 % slopes. Also a hydrologic group A soil that is moderately well drained. Permeability is rapid to moderately rapid with negligible runoff. Ground water is 5 to 7.5 feet below ground level. Stormwater Management The proposed development does not require a stormwater management plan under City Code Chapter 1011. Existing Conditions 3 The site currently drains toward the north side, the property and Meadow View Trail Proposed Conditions Drainage under the proposed conditions will be similar to existing conditions, with runoff heading to the northeast corner of the site. Small amounts of runoff from front and side yards are directed to Lois Lane. The sandy site soils will provide for the majority of stormwater to infiltrate onsite. Stormwater Pollution Prevention The Grading, Drainage, and Erosion Control Plan calls for silt fence and a rock construction exit. Flood Plain Site does not fall within the flood management zone. Shoreland District Site does not fall within the Shoreland District. Wetlands There are no wetlands indicated on this site. Greenway System, Parks and Trails The site is not part of the Greenway System. Alternative Urban Areawide Review (AUAR) Considerations The site is not within the 2005 I-35E Corridor AUAR environmental review boundary. Drinking Water Protection The site is not within the Drinking Water Supply Management Area (DWSMA). The site will be connected to City sewer and water. LANDSCAPE PLAN 4 Boulevard Trees Boulevard trees are required for all new residential subdivisions at a rate of one tree per lot frontage. A 26” caliper oak tree is being preserved in the front yard of Lot 1. No additional boulevard tree is proposed for this lot or recommended. A boulevard tree is shown on the landscape plan for lot 2. This tree should be relocated to the right-of-way. The existing house (lot 3) has a tree in the right-of-way area and will not require an additional boulevard tree. Boulevard tree requirements are met provided the boulevard tree is relocated to the right-of-way. Tree Preservation and Mitigation Standards The purpose of these standards is to protect valuable trees and stands of vegetation while not interfering with landowners’ reasonable use and development of property. The goal is to minimize unnecessary loss of habitat, biodiversity, and forest resources and to replace removed trees in areas where tree cover is most critical. A tree survey was performed that identified: Of the 67 total trees in the inventory, 30 trees will be removed, 37 will be preserved. The 37 trees planned for preservation must have Tree Protection Zones installed in accordance with the City Tree Protection Fence Detail. 29 of the tree removals are in the Basic Use Area (BUA) and do not require mitigation. One tree planned for removal is in a non-BUA and non-ESA (14” maple on Lot 2). This tree will require mitigation at a one to one ratio. Overall, for the 30 removals, 1 mitigation trees will be required. This tree must be added to the Landscape Plan. Total Trees 67 Total Trees Removed 30 Total Trees Preserved 37 Mitigation Trees Required 3 5 Tree Preservation and Mitigation Standards are met with the addition of 1 mitigation tree. Open Areas Landscape Standards Open areas standards do not apply to single family residential lots. Buffer and Screen Standards The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. The project property and surrounding properties are zoned R1, so buffer and screen standards do not apply. Canopy Cover Canopy cover standards to not apply to single family residential development. Foundation Landscaping Foundation landscaping standards do not apply to single family residential development. Sod and Ground Cover Standards All areas not otherwise improved in accordance with the approved site plans shall have a minimum depth of 4 inches of topsoil and be sodded including boulevard areas. Seed may be provided in lieu of sod in certain cases, including when the area is adjacent to natural areas or wetlands. Lighting The purpose of the lighting requirements in the Zoning Code is to reduce light pollution, promote energy conservation, and increase night time safety, utility, security, and productivity. Lighting is reviewed by the City Planner. Per Section 1007.043(6)(d), no light source shall exceed 1.0 foot candle onto right of way or 0.4 foot candle onto adjacent property. Per Section 1007.043(6)(f), in residential districts, any lighting used to illuminate a structure, an off-street parking area, or other area shall be arranged as to deflect light away from any adjoining residential property or from any public right-of-way. While photometric plans aren’t required for single residential houses, City Code requirements still must be met. 6 RECOMMENDATIONS Staff recommends that the Preliminary Plat for the Slater Addition be forwarded to the Planning and Zoning Board and City Council with the following comments: 1. Tree Protection Zones (TPZs) for the 37 trees scheduled for preservation must be shown to scale on the Grading, Drainage, and Erosion Control Plan (Sheet C1.1), Removals Plan (Sheet C1.2), and the Landscape Plan (Sheet C1.3). The TPZs must be in place prior to issuance of grading permit and will be reviewed by staff concurrently with inspection of sediment and erosion control measures. 2. Replace note on Grading, Drainage, and Erosion Control Plan about installing tree protection with “Tree Protection Fence installed in accordance with City Tree Protection Fence Detail”. 3. The Landscape Plan (Sheet L1) should include a note that “Existing Trees shall be protected in accordance with City Tree Protection Fence Detail. City Tree Protection Fence Detail should be added to Sheet C3.1. 4. The tree planting detail shall include comments about exposing root flare so it is visibly at grade to ensure trees are installed at proper depth, and that mulch is pulled back 3 inches from the trunk (mulch is not left touching the trunk). 5. 1 mitigation tree is required. These trees must be added to the Landscape Plan (Sheet C1.3). 6. The boulevard tree shown for Lot 1 must be moved north into the right-of-way. 7. Ground cover types must be added to the Landscape Plan (Sheet C1.3). This includes cover type for all exposed soil areas (ex: sod for the lots) ATTACHMENTS 1. Resource Inventory Map 2. The Environmental Board first reviewed a concept plan for the project at the October 25th, 2023, meeting. Since the initial review the developer, M/I Homes, has been working through advisory board, City Council and neighborhood comments to further explore the feasibility of the project. In April of 2024, the Environmental Board, staff and developer discussed a potential collaborative effort to address tree mitigation requirements. That discussion centered on the idea of restoring/establishing the native plant to resemble historical conditions. This would include developing a long-term management and stewardship plan for the open space. Due to concerns over support, uncertainty over the restoration outcome and measurement of success, along with neighborhood desire to preserve a more intact wooded area, M/I Homes refocused design efforts on minimizing impacts. The revised concept plan prioritizes open space preservation, minimizes the development footprint and results in a substantial reduction in tree removal. M/I Homes is currently proposing a 92-lot subdivision, that: 1. Provides approximately 8.5 acres of wooded open space adjacent to the Arena Acres neighborhood. 2. Preserves approximately 34 acres of open space in perpetuity as either public park land or private open space under a conservation easement in lieu of tree mitigation while still providing a per lot payment in lieu of park dedication. 2 3. Creates an association-maintained neighborhood plan designed for empty nesters and seniors looking for single level living. 4. Proposes a three tree per lot tree replacement. ANALYSIS Through the concept planning process, the development team and City have attempted to find a balance between achieving the desired public values while still maintaining an economically viable project. This is consistent with the City’s Handbook for Environmental Planning and Environmental Design (1999) and subsequent Parks, Natural Open Space/Greenways and Trail System Plan (2004) that recognized the need to address competing objectives. The documents were based on the following planning model: While preservation of trees has been the primary discussion point of this project there is no guarantee that, absent development, those trees remain. 3 Through this planning process the City has leveraged its regulatory process to maximize public benefits. The City preserves a large part of the site in its existing state as preferred by abutting property owners. The City continues to expand a connected greenway system linking with adjacent property that can be expanded in the future. At the same time both the property owner and developer can make reasonable use of the property consistent with the City’s Comprehensive Plan. The proposed design provides other benefits including: 1. Reduction of overall site disturbance. 2. Reduction in infrastructure. The current concept plan reduces the road length nearly 1,000 feet over the previous design, also reducing water main and sanitary sewer infrastructure. 3. Less hardscape and manicured turf than what would be allowed in a larger lot configuration. 4. Opportunity for stormwater reuse system for lawn irrigation. M/I Homes is requesting City direction and support for the following: 1. The future PUD and neighborhood plan allow for 92 villa lots consistent with the attached concept plan. 2. The minimum lot width requirements conform to the R-2 zoning except as identified in the PUD. 3. In lieu of tree restitution, the City agrees to accept the approximately 34 acres of open space for tree preservation provided that M/I Homes plants a minimum of 3 trees on each lot. 4. The open space property be deeded to the City as park land for the preservation of the open space and wetland, in perpetuity. As an alternative, the open space property can be owned by the HOA and protected by deed restrictions or restrictive covenants. Additional considerations: Trails. The concept extends the existing trail system from the south around the eastern side of the project and connects with Street A on the north side. Extensions through the open space adjacent to Arena Acres should be considered. Street C Extension to Andall Street. The concept accommodates the proposed extension to Andall Street. This segment will require additional evaluation based on transportation needs identified in a traffic study. Water Supply. - The ability of the City to service the site under existing constraints will need to be evaluated should the project move forward. The City is currently in discussions with the Minnesota Department of Natural Resources regarding the replacement of Well No. 2. Senior/empty nester homes have lower overall water use than typical single-family residences. 4 The proposed smaller lot sizes and opportunity for storm water reuse greatly reduces overall municipal water consumption for irrigation purposes. RECOMMENDATIONS Staff recommends that the Concept Plan for Natures Refuge North be forwarded to the Planning and Zoning Board and City Council with the following comments: 1. Consideration be given to the proposal to retain permanent open space in lieu of tree mitigation subject to the 3 trees per lot requirement. 2. Open area landscape requirements be adhered to in areas around stormwater and borrow ponds. 3. A new rare plant and animal survey must be completed for the project area. 4. If rare species are found on site, design layout should be revised to avoid impacts to these species. 5. If rare species are found on site and impacts are unavoidable, include features that minimize impacts (ex: buffers around rare plant locations for any that can be preserved, surmountable curbs to facilitate Blanding’s turtle movement, restoration of undisturbed project areas). DNR permits may be required for any impacts to rare species. 6. Coordinate with the Rare Plant Rescue group (contact Carrie Taylor at Anoka Conservation District) to allow for transport of any rare plants for which impact is unavoidable to a donor site, such as Wollan’s Park Wetland Bank in Lino Lakes. 7. A final tree survey and inventory must be completed. 8. Tree protection zones in accordance with the City Tree Protection Fence Detail must be shown for all trees that are being preserved. These zones must be shown on the Tree Preservation Plan and Grading Plans submitted at the Preliminary Plat phase. 9. Consider extension of trails into the area abutting Andall Street. 10. Consider incorporation of a stormwater reuse system for lawn irrigation. 11. Haywood Drive should be adjusted to minimize potential wetland impacts to the east of the site. ATTACHMENTS 1. The original concept plan, with 108 proposed single-family and villa lots on an approximately 59.30-acre site, was reviewed by the City at its Planning Commission meeting on November 8, 2023 and City Council meeting on December 4, 2023. The revised concept plan proposes 92 villa lots. The revised plan accomplishes the following: 1. Approximately 8.5 acres of open space adjacent to the Arena Acres neighborhood. 2. Approximately 34 acres of open space to be preserved in perpetuity as public park or private open space, as determined by the City. 3. A neighborhood plan and homes designed for empty nesters and seniors looking for single level living with association maintenance. PLANNED UNIT DEVELOPMENT We are requesting a PUD for this development to introduce a villa home option to the Natures Refuge neighborhood. Villa homes offer single level living and provide a low maintenance living option for older adults. Natures Refuge, to the south of this proposed neighborhood, has 80-foot-wide lots with traditional single-family homes. This neighborhood is proposed to include all slab on grade 60-foot-wide villa lots with main-level living with association-maintained yards and snow removal. The City of Lino Lakes allows for development through a PUD if it results in public benefit as outlined in the City’s PUD ordinance. Nature Refuge North provides the following public benefits: • Addressing growing demands for all styles of economic expansion, greater variety in lot size, configuration, home type, design, enhanced architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. o The single level living provided by villa homes include association-maintained yards and snow removal and therefore are popular with our senior buyers who are looking for a low maintenance home. It is not financially feasible to offer association-maintained yards and snow removal in the current neighborhood given the size of the lots. o The configuration of the lots works to preserve as many wetlands and trees as possible, and avoids a gas line easement that spans the site diagonally. • Preservation and enhancement of desirable site characteristics such as wildlife habitat, unique natural resources, existing vegetation, natural topography, geologic features and reduction of negative impacts on the environment. As mentioned, the site design preserves over half the acreage in open space, which preserves as many wetlands and trees as possible. We believe the general requirements for a PUD are met in the following ways: • Public or common open space to meet minimum requirements established in the ordinance. The site provides approximately 34 acres of open space. • If PUD includes preservation of natural habitat, those habitats shall be permanently protected through a conservation easement or other legally binding agreement. We have preserved approximately 57% open space within the site in order to preserve natural habitat. We are proposing to deed these outlots to the City as permanent open space to be preserved in perpetuity as public park. If the City elects not to accept the land as parkland, the HOA will own the land. Deed restrictions or restrictive covenants will preserve the land as open space. • Homeowners Association Required. The lots will be governed by a homeowner’s association (HOA) as further explained below. Natures Refuge North Concept Plan Submittal Page 2 SITE PLAN There are four proposed street connections. One connecting from the south from Natures Refuge via Haywood Drive and connecting to future development to the north, one to the west to Arena Acres, and one to the east for future development. If the City desires, M/I Homes would be open to other options to provide connections to Andall Street. The proposed development has a total of 92 60-foot-wide villa lots. The following table compares the proposed standards to the Two Family Residential (R-2) zoning district. The site is currently zoned Rural Executive (R-X). Haywood Drive from Natures Refuge was granted this flexibility, and the proposed development will extend Haywood Drive to the north. This flexibility is being requested for both Haywood Drive and Street A. Natures Refuge North Concept Plan Submittal Page 3 **This was previously requested with the original concept plan. The Homeowners Association (HOA) establishes rules and regulations prohibiting the use of garages solely for storage and requires parking of at least one automobile in the garage and that trailers and other recreational equipment be kept in garages when not in use. Additionally, many of our villa plans have storage in the attics above the garages for additional storage. ***Our homes provide enhanced architectural features that allow for visual interest throughout the community, and we offer a wide variety of materials and colors to break up the façade. Further, this is an extension of the existing Natures Refuge, and we want to create a cohesive neighborhood. Most of our plans are not garage forward, and the garage protrudes less than six feet beyond the front façade. The Watermark development was granted similar flexibility with their garages. ****We are requesting this because we have anti-monotony standards that ensure a wide variety of elevations that result in pleasing streetscapes. The garage doors will be decorative and have a strip of windows. *****We will provide at least 15 feet between homes. The City currently allows a five-foot setback for garages, so this is consistent with R-2 zoning. DENSITY The total site area is 59.30 acres with 5.63 acres of wetlands and 4.83 acres of wetland buffers. The planned density for this area is 1.6-3 units per acre. Netting out wetlands and wetland buffers, we are proposing a density of 1.88 units per acre, well below the maximum-allowed density. PUD flexibility and the R-2 zoning lot standards are necessary to meet the minimum density allowed in the City’s Comprehensive Plan and to minimize tree removal. It is not possible to meet the minimum density with 80-foot lots given the wetlands and their required buffers, as well as the gas line easement. With this site plan, 80-foot lots would yield 67 lots as shown in the Yield Plan Density Exhibit, which would result in a density of 1.37 units per acre, which is well below the minimum density planned for this area. Furthermore, these lots would result in greater tree removal. CHANGES SINCE PREVIOUSLY SUBMITTED CONCEPT PLAN The following changes were made from the previously submitted site plan: • The number of lots has been reduced from 108 to 92. • The buffer from Arena Acres has been significantly increased from 50 feet to over 160 feet at its narrowest, increasing to almost 400 feet to the north of Street C. • Open space was increased from just under 30 acres to over 34 acres (increasing from approximately 50% to approximately 57% of the total area of the site). • There are significantly less trees being removed. The previous layout required removal of 4,702 trees, and this revised layout has reduced that number by approximately 1,400 trees down to 3,309. TREE PRESERVATION AND OPEN SPACE As mentioned above, we have designed our neighborhood plan to conserve as many trees as possible. Of the 6,494 trees on the site, we are saving 3,185 trees: almost 50%. We are proposing to preserve these trees in permanent open space to be dedicated to the City for public park, or as open space to be owned by the HOA. Given the extensive dedication of open space/park for permanent tree preservation, we are requesting that the City accept the land dedication and tree preservations areas in lieu of paying tree restitution. As part of this request, M/I Homes will agree to plant three trees per home for a total tree replacement of 276 trees. Natures Refuge North Concept Plan Submittal Page 4 We are proposing this for a number of reasons. First, the proposed plan preserves a little over 57% open space, conserving as many trees as possible. This is a heavily wooded site that is guided for a density of 1.6- 3 units per acre, and we are proposing a very low density, almost near the lowest density allowed. Additionally, almost 50% of the trees on site are Quaking Aspen, which do not survive long due to Cankers, which will kill the trees in 3-8 years. Finally, we have received extensive feedback from the residents of Arena Acres regarding the preservation of trees on this land. The dedication of public land would allow them to enjoy this land and the trees that are being preserved. If the City chooses not to accept the land dedication, an alternative option would be to place a deed restriction on the open space area prohibiting the removal of trees, and the land would be left in its natural state. The HOA would own the open space property. ELEVATIONS Example elevations of our villa product have been provided. These are just an example of the many elevations we offer. We also have anti-monotony requirements to ensure that very similar elevations are not adjacent to one another within the community to preserve visual interest. RESTRICTIVE COVENANTS The development will have an HOA that will provide for the maintenance of the overall common elements in the community, including landscaping of the common areas as applicable and management of the natural resources. The HOA will also provide lawn care and snow removal for villa lots. Additionally, restrictions will be placed on outdoor storage and parking (no boats, campers, or trailers) in order to keep the community looking orderly and well maintained. REQUEST AND CONCLUSIONS M/I Homes is requesting Board and City Council feedback and direction on the proposed revised concept plan. We believe that the revised concept plan proposes a reasonable use of the property in conformance with the City’s Comprehensive Plan. We respectfully request that the City Council provide direction and support of the revised concept plan with the following considerations: 1. The future PUD and neighborhood plan allow for 92 villa lots consistent with the attached concept plan. 2. The minimum lot width requirements conform to the R-2 zoning except as identified in the PUD. 3. In lieu of tree restitution, the City agrees to accept the approximately 34 acres of open space for tree preservation provided that M/I Homes plant a minimum of 3 trees on each lot. 4. The open space property be deeded to the City as park land for the preservation of the open space and wetland, in perpetuity. As an alternative, the open space property can be owned by the HOA and protected by deed restrictions or restrictive covenants. Main Street Corridor Master Plan Public Engagement Process APPLICANT: N/A OWNER: N/A BACKGROUND On July 8, 2024 the City Council adopted Ordinance 11-24 establishing a moratorium on residential development around the Main Street corridor between Sunset and 4th Avenue. The purpose of the moratorium is to allow for the completion of a master plan and Alternative Urban Areawide Review (AUAR) for the area. The moratorium will go into effect on August 15 and will last for one year. Staff is currently working on consultant selection to assist with the planning process. A key component with the project will be community engagement. In preparation for developing an overall project scope staff is seeking input from the Environmental Board on potential stakeholders. Our initial thoughts include the following stakeholders: • Property Owners • Adjacent Neighborhoods/Community at large • Developers • Resident advisory boards o EDAC o P&Z o Environmental o Park • Public agencies i.e., County Highway Dept, Watershed District, School Districts 2 Staff is also interested in the Environmental Board’s thoughts on the type of information, types of media, and forms of outreach. Is there a need for a baseline information, such as What do we already know? How does the development process work? What does the Comp Plan mean and say? Broadcast, print or electronic/social media – what do you as board members use the most or prefer? The consultant team will certainly have expertise and suggestions with this component, but it is helpful hearing from the Board as we move to develop a scope of services.
