Project Updates ADJOURNMENT CITY OF LINO LAKES ADVISORY BOARD MEETING GUIDELINES Advisory boards are fact-finding bodies established to aid the City Council in specific areas. The decisions of any board are considered advisory only and all final decisions rest with the City Council. Board meetings shall operate in accordance with the procedures established by the City Council. The following meeting guidelines are derived from the City Council Rules of Decorum. Members of the Audience – No person in the audience shall engage in disorderly or disruptive conduct such as audible commentary during a meeting, hand clapping, stamping of feet, whistling, using profane language, yelling and similar demonstrations, which conduct disturbs the peace and good order of the meeting. Public Comment– Comments from the public will be accepted on any matter, whether on the agenda or not. Comments will not be accepted during specific agenda items unless a Public Hearing has been noticed. Please remember to be courteous and respectful and abide by the following guidelines: • Sign-in prior to the start of the meeting • Step up to the microphone when recognized by the Presiding Officer (Chair or Vice- Chair) • State your name and address for the record • State the subject to be discussed • Limit comments to 4 minutes • Address comments to the board as a whole, not any specific member • No question may be asked of a board member or staff member without the permission of the Presiding Officer (Chair or Vice-Chair) • Elect a spokesperson for a group of persons who wish to address the board on the same subject Public Hearing – A public hearing is a separate item of business on the agenda. It gives the public an opportunity to comment on the topic identified. Please remember to be courteous and respectful and abide by the guidelines outlined for public comment (although no sign-in required). Typically, a public hearing proceeds as follows: 1. The Presiding Officer (Chair or Vice-Chair) will announce the agenda item and staff will present their report. 2. Board members have the opportunity to ask staff questions about the item. 3. The Presiding Officer (Chair or Vice-Chair) opens the public hearing and will recognize those who want to speak. 4. The Presiding Officer (Chair or Vice-Chair) shall close the public hearing. 5. The Board will then discuss the item. No further public comments are allowed. 6. The Board will make a recommendation and/or decision. After a motion has been made or a public hearing has been closed, no member of the public shall address the board from the audience on the matter under consideration. The Presiding Officer (Chair or Vice-Chair) shall maintain strict order and etiquette at all meetings. DRAFT MINUTES CITY OF LINO LAKES PLANNING & ZONING BOARD MINUTES 1. CALL TO ORDER AND ROLL CALL Chair Root called the Lino Lakes Planning & Zoning Board meeting to order at 6:30 p.m. on October 9, 2024. 2. PLEDGE OF ALLEGIANCE 3. PUBLIC COMMENT Mr. Root declared public comment open at 6:32 p.m. Sam Bennett, 6841 Lakeview Drive, Lino Lakes, MN 55014, Mr. Bennett wanted to speak about the 2040 Comprehensive Plan. He disagrees about the intention of the plan and thinks the plan should promote more sense of community, support businesses and benefit the residents of Lino Lakes. He does not understand why Town Center was zoned industrial and thinks it would be a good opportunity for residential housing. He also thinks the comp plan makes it difficult for residents to enjoy amenities in the City and thinks Town Center would be a good opportunity for residential housing. He does not feel that there is a Town Center. Mr. Bennett disagrees how some areas were labeled and thinks there should be a limitation on the building sizes with restrictions on width and height. He thinks when low rise and mid-rise apartments fall in disrepair it affects a large amount of people. He thinks density using a four plex or smaller allows the resident to own their lots and the density is still achieved. He does not want to see large companies coming in building the same houses. He would like to see more architectural interest. Mr. Laden encouraged Mr. Bennett to become involved in the comp plan process and thought he had some good ideas. Mr. Root informed everyone that to change the comp plan now would require it to be amended. Mr. Kohler moved to close public comment. Motion seconded by Mr. Guthmueller. Public comment was closed at 6:38 p.m. 4. APPROVAL OF AGENDA The agenda was approved as presented. 5. APPROVAL OF MINUTES Mr. Wipperfurth moved to approve the September 11, 2024 meeting minutes with one change. Motion seconded by Mr. Laden. Motion carried 6 – 0. 6. ACTION ITEMS A. Public Hearing: Lino Retail 2.0 Rezoning, Preliminary Plat, Conditional Use Permit and Site & Building Plan Review Ms. Larsen presented the staff report. The applicant, Java Companies, LLC, is proposing to plat and develop three (3) commercial lots near Lake Drive, Marketplace Drive, and 77th Street. The Land Use Application is for Rezoning NB (Neighborhood Business) to GB (General Business), Preliminary Plat for 3 commercial lots, Conditional Use Permit for an Auto repair-major and minor for fast oil change facility, Site & Building Plan Review and Vacation for a portion of 77th Street. Mrs. Hankee, City Engineer, noted in 2020 Anoka County completed a corridor study from Hodgson to Main Street and provided potential improvements along the corridor that have been concerns for the residents. The traffic study showed no significant changes. Mr. Laden had concerns regarding the fenestration and would like to see glass wrap around the east side of the auto parts building. He is in favor of the connection to the American Legion. Planning & Zoning Board October 9, 2024 Page 3 DRAFT MINUTES Mr. Wipperfurth questioned why so many of the retail buildings back up to Lake Drive instead of facing it. Ms. Larsen said there is nothing in the ordinance dictating the direction of the building. Ms. Larsen said due to the where the residential area is it makes sense the direction of the building. Mr. Wipperfurth also questioned how the American Legion reacted to this business accessing their parking lot. Mr. Grochala said when the property was sold to the legion by the City, the City reserved the right to go over the legion parking lot to connect to Lake Drive if an access was needed. Mr. Grochala added that Lake Drive was proposed to be a four-lane divided roadway, but the County has changed the concept to a three lane design so the median will not block the Legion parking lot. Mr. Wipperfurth suggested the developer be mindful of the light that could go over the fence and that it should provide adequate height to block the light out. Ms. Guthmueller questioned if 7671 was included in the proposal as listed on page 22. Ms. Larsen said it should be 7691 and will make the correction. Ms. Guthmueller questioned if there was going to be enough parking spots if for example a restaurant was brought into this space. Ms. Larsen said they review parking during the application process and the applicant would need to demonstrate they can meet the parking requirements per the zoning ordinance. She also said the area east of Lake Drive also met the requirements for what was being proposed at the time. Mr. Root expressed support of the fence and would also like to see vegetation within the islands on building A and B. Mr. Root questioned if the business comes in as a minor repair and turns into a major repair service would the new business require a full amendment. Ms. Larsen said it could be written that way. Mr. Root recommended that change be made for the CUP requirement. He would also like it specified no overnight parking regardless of the reason. Mr. Grochala said it could be a 24-hour limit for the parking. The applicant, Mark Krough with Java Companies, introduced himself and was available for questions. Mr. Wipperfurth expressed concern for the parking at these businesses. Mr. Krough said these tenants are National Credit tenants and the process to get operations to sign off is more intense to meet the requirements. Mr. Wipperfurth inquired who the tenants were. Mr. Krough said one applicant was a quick service restaurant and the other is medical retail. Mr. Wipperfurth said if the businesses are open at different times they can share parking. Ms. Larsen said they do account for joint parking between different owners. Ms. Guthmueller thought it would be detrimental to limit the type of Planning & Zoning Board October 9, 2024 Page 4 DRAFT MINUTES tenant and believes restrictions will come if there is a parking issue. Mr. Krough said there is a risk analysis that is completed and if there was a concern they would not move forward. Ms. Larsen said all the buildings are meeting the requirements. Mr. Grochala said the City does not want to maximize impervious surface if not needed as it could have detrimental impacts. Mr. Laden requested the developer to add windows to the Lake Drive side of the building. Mr. Krough said they would take it into consideration. Mr. Grochala added that it could also be faux windows. Mr. Root opened the public hearing at 7:36 p.m. Mr. Bennett, 6841 Lakeview Drive, Lino Lakes, MN 55014, the town center should be the most valuable part of the City but does not think the location is right for this project. He would like to see locally owned and not a larger chain business come in. He would like to see restaurants or cafes or even chiropractors in the space which he feels is a more responsible use of the space. Mr. Laden moved to close the public hearing. Motion seconded by Mr. Wipperfurth. The public hearing was closed at 7:40 p.m. Mr. Laden moved to approve the land use application subject to the conditions listed in the staff reporting adding that the CUP be limited to minor repairs only and maximum of 24 hour storage of vehicles outside. Mr. Laden also wanted to add the requirement of fenestration to the east side of building C to be more consistent with the other buildings facing Lake Drive. Mr. Laden moved to approve the Rezoning, Preliminary Plat, Conditional Use Permit and the Site and Building Plan with the Staff and Board recommendations. Motion seconded by Mr. Kohler. Motion carried 5 - 0. B. Public Hearing: Spargur Estates Preliminary Plat & Variance Ms. Larsen presented the staff report. The applicant, Mespargur Inc, submitted a land use application for variances and preliminary plat for Spargur Estates. The applicant proposes to subdivide the existing parcel located at 559 Lois Lane into four (4) single family lots for the purpose of constructing three (3) new single family homes. The lot is 1.11 gross acres (48,510 sf). Mr. Laden questioned what they were approving now if it was requested of the developer to reconfigure the area to three lots instead of four. Ms. Larsen said the public hearing could be continued and the recommendation would be for the developer to revise the plan. Planning & Zoning Board October 9, 2024 Page 5 DRAFT MINUTES Mr. Root initiated a discussion regarding lot size and density and thought in the future when the requirements change that the larger third lot could be divided. Ms. Larsen said they calculated the area, and it did not meet the range for a four lot division. Perhaps in the future it will. Mr. Guthmueller did not think they should approve without seeing the 3 lot plan. Ms. Larsen said there were two options, approve it with the conditions that they make all the revisions that they are required to do or continue the public hearing. Ms. Larsen said they could also deny the Preliminary Plan and Variance but is not recommended as she feels they can meet the requirements. The applicant Mr. Mithcell Spargur, 12952 96th Street NE, Otsego, MN 55330. Mr. Spargur said there is already sewer and water for each lot on the property. Mr. Spargur thought the lot should be divided into three lots and farther down the road they could possibly create a fourth lot. Their dilemma was how to break up the lots as to not abandon the sewer and water that is available along with the park dedication fees, the $35,000 assessment on that lot, plus a $400 to $450,000 tax base. It only makes sense to do a four-lot split. If he is not able to, he would abandon the one on Lois Lane because it is financially less expensive to leave the sewer and water. Mr. Root opened the public hearing at 8:11 p.m. No public comments were made. Mr. Wipperfurth moved to continue the public hearing. Motion seconded by Mr. Laden. The public hearing will be continued at the November meeting. Motion carried 5 - 0. 7. DISCUSSION ITEMS A. Project Updates Mr. Grochala provided project updates. The applicant proposed to subdivide the existing parcel located at 559 Lois Lane into four (4) single family lots for the purpose of constructing three (3) new single family detached dwellings. The preliminary plat did not meet density requirements. On October 9, 2024, the Planning & Zoning Board opened and motioned to continue the public hearing to allow the applicant time to revise the plans. 2 This staff report is based on the following submittal information: •Plan Set prepared by Plowe Engineering, Inc. and E.G. Rud & Sons, Inc. revision date October 15, 2024 •Drainage Report prepared by Plowe Engineering, Inc. revision date October 15, 2024 •Title Commitment prepared by Old Republic National Title Insurance Company dated August 23, 2024 •Geotechnical Exploration Report prepared by Haugo Geotechnical Services dated October 2, 2024 BACKGROUND The lot is legally described as Lot 5, Block 1, Mar Don Acres. History Mar Don Acres Mar Don Acres was originally platted in 1978. As part of that plat, eight (8) lots were created north of Lois Lane with each lot being 294.00 feet in depth and approximately 165 feet in width with lot sizes of 48,510 sq. ft. Houses were purposely located on the lots in a manner so that the lot could further subdivided when public water and sewer become available. Three (3) other residential subdivisions similar to the proposed Spargur Estates have since been approved from these 8 lots. Hailey Manor Hailey Manor subdivided Lots 6, 7 and 8, Block 1, Mar Don Acres into 12 single family residential lots (3 original lots subdivided into 4 lots each for a total of 12 lots). The parcel was rezoned and variances were allowed for 132 foot lot depths vs 135 foot required due to required 30 foot right of way dedication along Arlo Lane. The following actions were approved in 2006/2007 by City Council regarding Hailey Manor: •Resolution No. 03-120 for Variance and Preliminary Plat •Ordinance No. 16-03 for Rezoning from R, Rural to R-1, Single Family •Resolution No. 03-208 for Final Plat This plat is directly east of the proposed Spargur Estates. Isabell Estates 3 Isabell Estates subdivided Lot 3, Block 1, Mar Don Acres into 4 single family residential lots. The following actions were approved by the City Council in 2014 regarding Isabell Estates: • Resolution No. 14-66 approving variances for lot depth, lot width and side setback • Resolution No. 14-67 approving the Preliminary Plat • Resolution No. 14-114 approving the Final Plat This plat is west of the proposed Spargur Estates. Golden Acre Golden Acre subdivided Lot 4, Block 1, Mar Don Acres into 4 single family residential lots. The parcel was rezoned and variances were also approved allowing for 132 foot deep lots, lot width reduction and side yard setback reduction due to required right of way dedication and location of existing house on the lot. The following actions were approved by City Council regarding Golden Acre: • Resolution No. 06-181 for Variances and Preliminary Plat • Ordinance No. 11-06 for Rezoning from R, Rural to R-1, Single Family • Resolution No. 07-103 for Final Plat This plat is immediately west of the proposed Spargur Estates. Existing Site Conditions The 1 acre site is a residential lot containing a single family detached dwelling and attached garage. Other than trees and shrubs, there are no significant natural resources on site. The Certificate of Survey indicates a Soderville fine sand and Zimmerman fine sand on the property. Building Requirements At the time of building permit, the single family detached dwellings proposed on Lot 2 and Lot 3 will be reviewed for compliance regarding impervious surface, building footprint area, garage size, and design and construction standards. Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The preliminary plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The subdivision is consistent with the comprehensive 6 plan. It does meet the performance standards of the subdivision and zoning ordinance with the approved variances. Blocks and Lots The proposed preliminary plat creates 1 block with 3 lots. Lot 1, Block 1 will contain the existing house which will remain on site. Lot 2 and Lot 3 will be developed with single family detached dwellings. Streets and Alleys Arlo Lane is a minor collector road and is capable of handling two (2) additional single family detached dwellings. Easements Standard drainage and utility easements are being dedicated along the lot lines. Storm Water Management and Erosion and Sediment Control The proposed development does not require a stormwater management plan under City Code Chapter 1011. Per the Site Drainage Narrative and Calculations report revision date October 15, 2024, a small rear yard depression is shown to help get drainage from west to east. This basin overflows to the east to match existing conditions. It is assumed the basin will drain dry between storm events. Public Utilities The existing house at 559 Lois Lane is connected to public watermain and sanitary sewer. The two (2) new lots will also be connected to public water and sanitary which is capable of handling two (2) single family detached dwellings. Water and sanitary sewer laterals are already stubbed into the two (2) proposed lots. Public Land Dedication The proposed subdivision is within the Highland Meadow Park neighborhood service area. The development is not within the greenway system. Arlo Lane is identified as a future trail corridor that is proposed to extend from Highland Meadows Park to Woodduck Trail and eventually to 4th Avenue. The City will require cash in lieu of land dedication for the two (2) new lots. Lot 1 with the existing house will not be charged a park dedication fee. 7 Park Dedication Fees Total # of Lots = 2 x 2024 Park Dedication Fee $3,300 = Total Due $6,600 Tree Preservation and Landscaping A tree survey was performed that identified: 19 trees were identified in the tree inventory, with 2 proposed for removal. 7 or the remaining 17 are located off site along the western property line of lot 3. The 17 trees planned for preservation must have Tree Protection Zones installed in accordance with the City Tree Protection Fence Detail. The Tree Protection Zones need to be shown on the Grading, Drainage and Erosion Control Plan and Landscape Plan. Tree Preservation and Mitigation Standards have not been met. Open Areas Landscape Standards Open areas standards do not apply to single family residential lots. Buffer and Screen Standards The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. The project property and surrounding properties are zoned R1, so buffer and screen standards do not apply. Canopy Cover Canopy cover standards to not apply to single family residential development. Foundation Landscaping Foundation landscaping standards do not apply to single family residential development. Seed may be provided in lieu of sod in certain cases, including when the area is adjacent to natural areas or wetlands. The ground cover types and locations must be added to the Grading Drainage and Erosion Control Plan and the Landscape Plan. Environmental Assessment Worksheet (EAW) An Environmental Assessment Worksheet is not mandated. The three (3) unattached residential units are under the 250 unattached unit threshold required for a mandatory EAW. Wetlands There are no wetlands on site. FEMA Floodplain There is no FEMA floodplain on site. Shoreland Management Overlay The parcel is not located within a Shoreland Management Overly district. Impervious Surface Coverage The maximum allowed impervious surface coverage per lot is 65%. Lot 1 (existing house) is at 17.6% and compliant. The impervious coverage for Lots 2 and 3 will be evaluated with those individual building permits and surveys. Traffic Study A traffic study is not required for two (2) new single family lots on Arlo Lane. It is a minor collector street and has capacity for two (2) single family detached dwellings. Additional City and Government Agency Review Comments Public Safety Comments 9 Lino Lakes Public Safety Department-Police Division and Fire Division reviewed the preliminary plat and had no comments. Environmental Board The Environmental Board reviewed the development proposal at their September 25, 2024 meeting and noted some with minor revisions are needed. The Environmental Coordinator reviewed the revised plans. Comments are summarized in the attached November 1, 2024 Environmental memo. Agreements Stormwater Maintenance Agreement A stormwater maintenance agreement is not required since a stormwater management plan is not required per City Code Chapter 1010. Development Agreement and Final Plat The applicant shall submit a Land Use Application for final plat after preliminary plat approval. A Development Agreement will then be prepared by the City as part of the final plat application. Comprehensive Plan Spargur Estates is consistent with the goals and policies of the comprehensive plan regarding land use, density, housing, economic development, transportation, local water management plan, sanitary sewer, water supply and parks, greenway and trails. Land Use Plan Per the current 2040 Comprehensive Plan, the lot is guided low density residential development and allows for 1.6 to 3.0 units per net acre. The proposed net density of 2.70 units per acre is consistent with the Comprehensive Plan. The site is in Planning District 2 and is guided for low density residential development. There are no specific planning recommendations for this site. Housing Plan A goal of the housing plan is to maintain existing housing stock to insure a high-quality environment in all residential neighborhoods. It is a policy to encourage in-fill housing where appropriate. 10 Spargur Estates meets the goals of the housing plan by supporting in-fill housing. Economic Development The three (3) lot single family residential development does not negatively impact the City’s economic development plan. Transportation Plan A goal of the transportation plan is to ensure that streets are as safe as possible. Arlo Lane is a minor collector street and has capacity for two (2) single family detached dwellings. Local Water Management Plan The purpose of the water management program is to protect, preserve, and use natural surface and groundwater storage and retention systems and prevent erosion of soil into surface water systems. Spargur Estates protects the natural surface and groundwater storage with the construction of a small rear yard depression. Erosion and sediment control practices will also be implemented. Sanitary Sewer Plan The goal of the sanitary sewer plan is to maintain the city’s residents and businesses with an affordable and safe sanitary sewer system. The existing house is served by an 8” municipal sanitary sewer main along Lois Lane. The two (2) new lots will be served by 8” municipal sanitary sewer along Arlo Lane. The existing sanitary sewer system has capacity for two (2) new single family detached dwellings. Water Supply Plan A goal of the water supply plan is to provide residents and businesses with affordable potable water that is safe and of high quality for daily consumption and fire demand. The existing house is served by an 8” municipal watermain along Lois Lane. The two (2) new lots will be served by 8” municipal watermain along Arlo Lane. The existing water supply system has capacity for two (2) new single family detached dwellings. 11 Parks, Greenways and Trails A goal and policy of the parks, greenways and trails plan is to continue to development and fund recreational activities in the City. The City will require cash in lieu of land dedication for the two (2) new lots. Findings of Fact-Variances The lots are zoned R-1, Single Family Residential District. The required R-1 lot depth is 135 ft. The following variances are required for the Spargur Estates preliminary plat: •Lots 1, 2, and 3: o A three (3) foot variance to reduce the required lot depth from 135 feet to 132 feet. All lot areas exceed the minimum 10,800sf. As previously noted, similar lot depth variances were approved for Hailey Manor, Isabell Estates, and Golden Acre. Per City Code Section 1007.018(3): (a)Criteria and findings of fact. No variance shall be granted unless it meets all the criteria in divisions 1. through 6. below, or unless division 7. below applies. The city shall make findings regarding compliance with these criteria. 1.The variance shall be in harmony with the general purposes and intent of this chapter. The general purpose and intent of the R-1, Single Family Residential District is to provide a residential atmosphere for those persons desiring a single family neighborhood with a suburban density. The district is intended for development of single family detached homes on lots served with public sanitary sewer and water. The three (3) lot residential subdivision proposed for Spargur Estates meets the general purpose and intent of providing single family housing. All three (3) lots will be served by public water and sanitary sewer. The development will not be detrimental to the public health, safety or general welfare of the neighborhood. 2.The variance shall be consistent with the official City Comprehensive Plan. The variance is consistent with the City Comprehensive Plan. 12 3.There shall be practical difficulties in complying with this chapter. “Practical difficulties,” as used in connection with the granting of a variance, means that the property owner proposes to use the property in a reasonable manner not permitted by this chapter. Economic considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. The subdivision of an existing parcel and creation of three (3) residential lots are reasonable uses of the property. The practical difficulty in complying with the lot depth, lot width and setback standards of the zoning ordinance would only allow for the creation of two (2) lots. This would not be consistent with the intent of the Mar Don Acres plat or the previously approved Hailey Manor and Isabell Estates subdivisions. 4.The plight of the landowner shall be due to circumstances unique to the property not created by the landowner. The plight of the landowner is created by the requirement to dedicate 30 feet of road right-of-way on Arlo Lane which reduces the lot depths to 132 feet. The need for the variances was not created by the landowner. 5.The variance shall not alter the essential character of the locality. The variance shall not alter the essential character of the locality. The proposal to create three (3) single family residential lots for the purpose of constructing two (2) new single family detached dwellings is compatible with the surrounding existing single family detached dwellings. Similar variances were approved for the two adjacent subdivisions, Hailey Manor and Golden Acre. 6.A variance shall not be granted for any use that is not allowed under the ordinance for property in the zoning district where the subject site is located. Single family detached dwellings are permitted uses in the R-1, Single Family Residential District. 7.In accordance with M.S. § 462.357, Subd. 6, variances shall be granted for earth sheltered construction as defined in M.S. § 216C.06, Subd. 14, when in harmony with the zoning ordinance. Not applicable. Findings of Fact-Preliminary Plat Per City Code Section 1001.013, Premature Subdivision: 13 (1)General. Any concept plan, preliminary plat or final plat deemed premature pursuant to the following criteria shall be denied by the City Council. (2)Conditions for establishing a premature subdivision. A subdivision may be deemed premature should any of the following conditions not be met. (a)Consistency with the Comprehensive Plan. Including any of the following: 1.Land use plan; 2.Transportation plan; 3.Utility (sewer and water) plans; 4.Local water management plan; 5.Capital improvement plan; and 6.Growth management policies, including MUSA allocation criteria. Spargur Estates is consistent with the goals and policies of the comprehensive regarding resource management, land use, housing, transportation and utilities. The development is also consistent with the local water management plan, capital improvement plans and growth management policies. (b)Consistency with infill policies. A proposed urban subdivision shall meet the city's infill policies: 1.The urban subdivision must be located within the Metropolitan Urban Service Area (MUSA) or the staged growth area as established by the city's Comprehensive Plan; 2.The cost of utilities and street extensions must be covered by one or more of the following: a.An immediate assessment to the proposed subdivision; b.One hundred percent of the street and utility costs are privately financed by the developer; c.The cost of regional and/or oversized trunk utility lines can be financed with available city trunk funds; and d.The cost and timing of the expenditure of city funds are consistent with the city's capital improvement plan. 3.The cost, operation and maintenance of the utility system are consistent with the normal costs as projected by the water and sewer rate study; and 4.The developer payments will offset additional costs of utility installation or future operation and maintenance. Spargur Estates is consistent with infill policies. The development is within the current Utility Staging Area 1A=2018-2025. No new utility or street extensions are required. The cost, operation and maintenance of the utility system is consistent with the normal costs projected by the water and sanitary system plans. No future utility costs are proposed. 14 (c)Roads or highways to serve the subdivision. A proposed subdivision shall meet the following requirements for level of service (LOS), as defined by the Highway Capacity Manual: 1.If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade; 2.If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C; 3.If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D; 4.The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better; 5.Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies; 6.The traffic generated from a proposed subdivision shall not require city street improvements that are inconsistent with the Lino Lakes capital improvement plan. However, the city may, at its discretion, consider developer-financed improvements to correct any street deficiencies; 7.The LOS requirements in divisions (2)(c)1. to 4. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At city discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Department of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange; and 8.The city does not relinquish any rights of local determination. Spargur Estates meets the requirements for level of service (LOS). Arlo Lane is a minor collector road and has structural capacity to handle two (2) additional single family detached dwellings. No street improvements are proposed that are inconsistent with the City’s capital improvement plan. The city does not relinquish any rights of local determination. (d)Water supply. A proposed subdivision shall be deemed to have an adequate water supply when: 1.The city water system has adequate wells, storage or pipe capacity to serve the subdivision; 2.The water utility extension is consistent with the Lino Lakes water plan and offers the opportunity for water main looping to serve the urban subdivision; 15 3.The extension of water mains will provide adequate water pressure for personal use and fire protection; and 4.The rural subdivision can demonstrate that each of the proposed lots can be provided with a potable water supply. Spargur Estates will have an adequate water supply. The subject site is served by an 8” DIP watermain along Lois Land and Arlo Lane. The water supply system has capacity to handle two (2) new single family detached dwellings. (e)Waste disposal systems. A proposed subdivision shall be served with adequate waste disposal systems when: 1.The urban sewered subdivision is located inside the city's MUSA or is consistent with the MUSA allocation criteria; 2.The city has sufficient MUSA and pipe capacity to serve the subdivision if developed to its maximum density; 3.The subdivision will result in a sewer extension consistent with Lino Lakes sewer plan and capital improvement plan; 4.A rural subdivision can demonstrate that each lot can be served by an adequate sanitary sewer disposal system; and 5.A rural subdivision with a proposed communal sanitary sewer or water system has an effective long range management and maintenance program with proper financing. Spargur Estates will be served with an adequate waste disposal system. The subject site is in Sanitary Sewer District 2 (Sub-district 2B) and is served by MCES Interceptor 83-61, a 24 inch gravity sewer located in North Road. The subject site is also in the current 1A (2018-2025) Utility Staging Area. An 8” PVC sanitary sewer main exists along both Lois Lane and Arlo Lane. The sanitary system has capacity to handle two (2) new single family detached dwellings. RECOMMENDATION Staff recommends approval of variances and preliminary plat for Spargur Estates subject to the following conditions: 1.Comments from City Engineer Memo dated November 6, 2024 shall be addressed. 2.Comments from Environmental Memo dated November 1, 2024 shall be addressed. 3.Sheet S2, Preliminary Plat: a.The gross and net density information under Area is incorrect and shall be revised. The public right of way is not subtracted when calculating density. Please see the staff report for the correct information. 4.Sheet C1.2, Removals Plan: 16 a.The area east of the existing driveway off Lois Lane labeled “Remnants of Old Gravel Area Now Overgrown with Grass” shall be shown as being removed. The following items shall be addressed prior to November 30, 2025 or at time of building permit issuance: 1.As shown on Sheet C1.2, Removals Plan: a.The existing fence and pavers shall be removed. b.The old gravel area now overgrown with grass adjacent to the existing driveway off Lois Lane, the random dirt piles, and the gravel driveway off Arlo Lane shall be restored with proper ground cover in compliance with City Code Section 1007.049(8). The area is an existing residential neighborhood with 29 homes known as Colonial Woods. A majority of the property owners petitioned for the extension of sewer service, which requires a comprehensive plan amendment, as part of the City’s proposed street reconstruction project. The 2040 Comprehensive Plan includes a Full Build Land Use Plan and a 2040 Land Use plan. The Full Build plan guides the area as low density residential, and the 2040 Future Land Use plan shows the area as Urban Reserve. To provide sanitary sewer, the 2040 Land Use plan will need to be amended to match the Full Build Land Use Plan. The 2040 Utility Staging Plan also needs to be amended to change from Stage 3 Planned Service Area to Stage 1A Planned Service Area. ANALYSIS We have reviewed the application for consistency with the Comprehensive Plan, as well as City policies. 2 Existing Conditions The 29 subject parcels are owned by multiple parties. The parcels are developed with single family homes. The area is currently served by onsite septic systems and private wells. Septic systems within the project area have an average age of 35 years. Most systems are original to the construction date of the homes with four replaced in the last 10 years. The City published notice of the proposed change in the official newspaper and mailed notice to the property owners whose property is proposed to be reclassified. Land Use Amendment One change from the 2040 Land Use Plan is proposed: 1. 39 acres will be reclassified from Urban Reserve to Low Density Residential. Staging Plan Amendment One change to the 2040 Staging Plan is proposed: 1. 39 acres will be changed from Stage 3 Planned Service Area to Stage 1A Planned Service Area on the Utility Staging Map. Consistency with the Comprehensive Plan The proposed amendments are supported by and consistent with the Land Use (Chapter 3) goals and policies as noted below: Existing Unsewered Single-Family Subdivisions The urbanized area of the City of Lino Lakes surrounds several large-lot single family subdivisions that are not connected to the public sewer and water systems. These pockets of homes use subsurface sewage treatment systems (SSTS) and some use private wells. The Utility Staging Plan maps these areas in Staging Area 3. Even though the staging plan indicates that these areas will not receive service within the 20-year span of the plan, it is the city’s policy to extend public utilities to these neighborhoods when either requested by the homeowners or when necessary to replace failing SSTS, to preserve and maintain existing neighborhoods. The city’s sewer and water systems have been designed to serve these areas. As part of the Staging Plan update, the city considered changing these neighborhoods to Stage 1A on the 2040 Staging Plan and changing them from “Urban Reserve” to “Low Density Residential” on the Land Use Plan Maps. Including them in the staging plan would remove an extra bureaucratic step (a Comprehensive Plan Amendment) from the process of extending 3 utility service. However, the Metropolitan Council’s formulas for calculating compliance with regional density policies would penalize the city for including these existing neighborhoods unless there is current documentation of SSTS failures. Therefore, case-by-case plan amendments will be necessary before service can be extended to these existing neighborhoods. 1. The City will create a fully integrated Comprehensive Plan and keep it up to date with biannual reviews. The City will perform an intensive review at least once every five years to ensure the plan addresses changing needs and conditions. The need for a Comprehensive Plan amendment to provide municipal services has been petitioned by the residents. The amendment will allow utilities to be provided to replace failing septic systems and wells. 2. The Comprehensive Plan will include a staging plan defining development staging areas sized to accommodate forecasted growth. The proposed amendment to the staging plan will allow the land to be brought into the current staging plan phase. The adjacent areas to the north, south and east are all in the current staging area. 3. The City will monitor the ten-year staging areas and annually determine if adequate land remains available. The City is comfortable that with the proposed amendment adequate land remain available in the staging areas. 4. All development must be located within the current ten-year staging area unless a Comprehensive Plan amendment is approved that redefines the current ten-year staging area. If approved as proposed the amendments would bring the area into the current staging area to allow utility services to be provided. 5. All development must be phased within each ten-year staging area in accordance with the staging plan unless the City Council determines, by resolution, to redefine the location of the current five-year phase. No development is proposed outside of the current staging area. 6. Prior to reaching the time threshold for the next ten-year staging area, or five-year phase within a ten-year staging area, depicted on the staging plan, the City Council will determine by resolution if the next area is to be opened to development. The following criteria will be used to determine where and when to open up the next ten-year staging area, or five-year phase within a staging area, in accordance with the timing indicated on the staging plan: 4 a. Adequate infrastructure must be available to support development. Appropriate analysis will determine if adequate infrastructure is available and what utility extensions and transportation improvements are required to support new development. If infrastructure is not available and cannot be made available in a timely manner to support expanding into the next ten-year staging area or five year phase within a staging area, the city may refrain from opening up the next staging area, or portions thereof. b. Different areas of the city can be considered independently. A decision to open one area of the city to development does not automatically open a different area of the city. Decisions to open new areas to development should clearly define and map the area being opened. c. This process does not require a comprehensive plan amendment because it is in accordance with the timing indicated on staging plan. Staff finds that adequate infrastructure can be provided to serve these areas in conjunction with a formal development proposal. Infrastructure and utility improvements as identified in the Comprehensive Plan will be required to be installed by the developer when development is proposed following a detailed analysis by City staff as a recommendation to the City Council. 7. The following criteria will be used to determine if the city should allow a specific development project to occur early in a ten-year staging area, or five-year phase within a staging area, prior to the timing indicated on the staging plan. a. The proposed development must be located within both the current and the next ten year staging area, or five-year phase, or located adjacent to the current staging area. b. The proposed development must be master planned. Small, piecemeal developments do not justify redefining the ten-year staging area, or five-year phase. c. The proposed, master planned project must provide discernable public values. d. Adequate infrastructure must be available to support development. Appropriate analysis will determine if adequate infrastructure is available and what utility extensions and transportation improvements are required to support new development. e. There must be a commitment that the development will pay its proportionate share of infrastructure improvement costs associated with development. Not applicable. 8.All development must adhere to the Greenway System plan, including all its components, as this plan provides a conservation design framework for growth within the city. This request will adhere to the Greenway System Plan. 9. Include standards in subsequent ordinance updates to ensure quality development that minimizes negative impacts on natural and cultural features of the community. 5 Not applicable. 10. The City will plan to accommodate an annual average of 230 units per year over each 5 year phasing period not to exceed 345 units in any one year. At the end of the 5 year phasing period unallocated units will be averaged out over the next five year phase. Not Applicable. The proposed area includes developed parcels and no new development would occur with the amendment. Findings of Fact The following are Findings of Fact for the Comprehensive Plan Amendment: 1.The proposed 2040 Comprehensive Plan amendments are needed to provide municipal services to existing residents of the City. 2.The proposed land use and staging plan changes are consistent with the policy text for the 2040 Comprehensive Plan. 3.The proposed amendment is consistent with Sanitary Sewer Plan planned infrastructure improvements and simply allows those improvements to occur earlier. 4.The proposed amendment is consistent with Water Supply Plan planned infrastructure improvements and simply allows those improvements to occur earlier. Next Steps 1.If the Comprehensive Plan Amendment is approved by the City, it will be submitted to the Metropolitan Council for review. RECOMMENDATION Staff recommends approval of the Colonial Woods Neighborhood Comprehensive Plan Amendment. PUD Concept Plan Review The City’s review and comments on the concept plan’s relation to the Comprehensive Plan and development regulations does not grant any rights to the applicant to develop the property as depicted by the concept plan. If the Board and Council support the proposed amendment, the applicant will formally submit an amendment to the PUD Plan. The amendment seeks approval to modify the original proposal from a two- story, 51,780 square-foot building with 56 units to a three-story, 48,888 square-foot building with 57 units. The revised design maintains the essential character and intent of the original proposal while improving the eMiciency of land use and enhancing the facility’s capacity to serve the community. Background The original PUD, allowed for the development of a two -story skilled nursing home, providing 56 units across a gross floor area of 51,780 square feet. Our comments were made on the following documents: •Lyngblomsten – Skilled Nursing Addition Concept Plan prepared by Wold, dated September 10, 2024. The following review comments should be responded to in writing by the applicant. Engineering •General The Lyngblomsten Nursing Home is proposing a skilled nursing wing to their campus located west of Hodgson Road (CSAH 49) and south of Blanchard Boulevard. It is a 12,000 SF addition to their 290,000 SF main building and includes 57 private rooms together with offices, conference rooms and both an underground and outdoor parking areas. •Grading The Lyngblomsten Nursing Home Campus addition includes limited site grading for the building outdoor parking area and blending into the streets and driveways. The lot was rough-graded with the grading of the overall campus. A grading plan meeting City requirements will need to be submitted as part of the preliminary and final plats. •Stormwater Management Additional onsite treatment will not be required as the existing ponding areas were designed for drainage from this area. It is presumed that conveyance to these basins will be through an internal storm sewer system and overland swales. The system shall meet the City’s and RCWD Stormwater Management requirements. Attachment 6: Engineering Memo Ms. Katie Larsen 11/06/2024 Page 2 Lyngblomsten Nursing Home – Skilled Nursing Addition - Engineering Review •Water Supply/Sanitary Sewer A detailed utility plan for the Lyngblomsten Nursing Home Campus addition has not yet been proposed and will need to be submitted for preliminary plat by the applicant. There are existing 6” sanitary sewer and water stubs to the lot. The number of units and demand is within the anticipated capacity of the original campus design for the area and is supported with the existing infrastructure. •Transportation Traffic from the addition is consistent to what was approved with the preliminary plat for the overall campus traffic study. Underground parking will utilize the existing entrance drive on the south side of the general building while the outdoor parking area will utilize a connection to the existing entrance drive off of Blanchard Boulevard on the west side of the general building. Trails and sidewalks Additional trails/ sidewalks are not proposed on the submitted Concept Plan as all required ones have already been installed with previous phases of the overall campus construction. •Wetlands and Mitigation Plan No wetlands are proposed to be impacted with the proposed addition. •Landscaping A Landscape Plan for the Lyngblomsten Nursing Home Campus addition has not yet been submitted. One will need to be submitted and reviewed by staff and the City’s Environmental Coordinator. The Environmental Coordinator will provide separate comments. •Floodplain The submitted concept plan does not impact floodplain. •Drainage and Utility Easements All needed drainage and utility easements have been provided with the approved preliminary plat. •Development Agreement A development agreement will be required with the final plat. •Grading Agreement Ms. Katie Larsen 11/06/2024 Page 3 Lyngblomsten Nursing Home – Skilled Nursing Addition - Engineering Review Grading agreement not required at this time. •Stormwater Maintenance Agreement The stormwater maintenance for public facilities are already in place with the main building. •Permits Required Required permits will be determined at the time of preliminary plat submittal.
