BACKGROUND Staff have been in the process of implementing recommendations of the Citygate report which included establishing a stand alone Police Department and Fire Department. Therefore, we are requesting the repeal of Chapter 208 which created a Public Safety Department which no longer aligns with the current organizational structures. RECOMMENDATION Staff recommends approval of 1st Reading of Ordinance No. 06-25 Repealing City Code Chapter 208: Public Safety Department. The City Council has adopted separate ordinances to establish a Police Department and Fire Department to replace the combined Public Safety Department functions. DUTIES It shall be the responsibility of the Lino Lakes Police Department to provide a healthy and safe community, preserve peace and public order, prevent and detect crime, respond to and assist with emergency medical needs, and enforce state and county laws and City ordinances, within the City of Lino Lakes, as authorized by the City Council. POLICE PERSONNEL The Lino Lakes Police Department shall be directed and supervised by the Chief of Police. The members of the Lino Lakes Police Department shall consist of the Chief of Police and police officers as the City Council shall hire. CHIEF OF POLICE The Chief of Police shall be responsible to the City Administrator and shall make complete reports on the operation of the Lino Lakes Police Department as requested by the Administrator or City Council. Other members of the Lino Lakes Police Department shall be responsible and accountable to the Chief of Police, who shall be responsible for the proper training and disciple of other members. The Chief of Police may recommend to the City Administrator a suspension without pay of any member of the Lino Lakes Police Department for just cause only. Suspensions without pay in excess of 30 days and recommendations for termination will require final action by the City Council. RANKS Members of the Lino Lakes Police Department, other than the Chief of Police, may be given a rank or designation as determined by the Chief of Police. The order of command shall flow from the Chief of Police downward in order as listed, each member being responsible to his or her superior officer. The ranks and the rules of qualification for any of the positions shall be as established by the Chief of Police and approved by the City Council. 2 RECORDS The Lino Lakes Police Department shall keep a daily record of all Police Department activities within the City, as prescribed by the City Council. Access to Police Department records shall be in accordance with the Minnesota Government Data Practice Act. UNIFORMS AND EQUIPMENT All city property issued to any member of the Police Department shall be returned in good condition to the City promptly upon termination of employment or as otherwise directed by the Chief of Police or City Administrator. Each member shall be responsible for and liable for each item and the proper care thereof while same is in his or her possession. Uniforms and equipment to perform duties will be provided to Police Department personnel. UNIFORMS – WHEN WORN Uniforms are only to be worn while on duty, while in transit to or from work, for court, or at other official department functions or events. COMMUNITY SERVICE OFFICER A person holding the position of community service officer in the Lino Lakes Police Department may, under the direction of the Chief of Police, issue citations in lieu of arrest for violations of the following Chapters: 503 Animal Control Regulations, 802 Parking, 901 General Nuisance and 1006 Building Numbers. FIRE CHIEF The Fire Chief shall be responsible to the City Administrator and shall make complete reports on the operation of the Lino Lakes Fire Department as requested by the Administrator or City Council. Other members of the Lino Lakes Fire Department shall be responsible and accountable to the Fire Chief, who shall be responsible for the proper training and discipline of other members. The Fire Chief may recommend to the City Administrator a suspension, without pay of any member of the Lino Lakes Fire Department for just cause only. The Fire Chief shall be responsible for the annual inspection, testing and maintenance of all fire apparatus. The Fire Chief shall maintain a replacement schedule of all fire apparatus in accordance with National Fire Protection Association guidelines. BACKGROUND At the April 28, 2025 City Council meeting, Citygate Associates presented its final recommendations, advising the City Council to restructure the Public Safety Department into independent Police and Fire Departments. This proposed change necessitates amending the City Ordinance and establishing two new leadership roles: Chief of Police and Fire Chief, who would oversee their respective departments. Boehme joined the Lino Lakes Police Department in 2006 as a Patrol Officer. In 2018, he was promoted to Sergeant and subsequently led the department's new officer training program. From December 2020 to December 2024, Boehme served as Investigations Unit Supervisor, overseeing a team of investigators and an investigative assistant. He successfully completed the Northwestern School of Police Staff and Command in the fall of 2023. Since February 1, 2025, Boehme has been serving as Interim Public Safety Director. Boehme holds a Bachelor of Arts in Criminology from the University of Minnesota Duluth, with a minor in Political Science. The wage for Boehme will be $73.96 per hour, which is Step 10 in a 10-step wage scale for the Chief of Police position. With Council approval, Boehme’s promotion to Chief of Police will be effective May 12, 2025. RECOMMENDATION Please approve the promotion of Curt Boehme to the position of Chief of Police within the Police Department. ATTACHMENTS None 1 CITY COUNCIL REGULAR MEETING STAFF REPORT AGENDA ITEM SPECIAL PRESENTATION E STAFF ORIGINATOR: Meg Sawyer, Human Resources and Communications Manager MEETING DATE: May 12, 2025 TOPIC: Promotion of Fire Chief VOTE REQUIRED: Simple Majority ______________________________________________________________________________ INTRODUCTION The City Council is being asked to approve the promotion of Dan L’Allier to the Fire Chief position within the newly created Fire Department. BACKGROUND At the April 28, 2025 City Council meeting, Citygate Associates presented its final recommendations, advising the City Council to restructure the Public Safety Department into independent Police and Fire Departments. This proposed change necessitates amending the City Ordinance and establishing two new leadership roles: Police Chief and Fire Chief, who would oversee their respective departments. L'Allier brings over 40 years of experience in Firefighting, Emergency Medical Services (EMS), and Emergency Management. Since joining in 2014, he has led the development of the Fire Division, including staffing models, apparatus acquisition, and the construction of Fire Station 2. Prior to coming to Lino Lakes, he served as Fire Chief/Emergency Manager/Tactical Paramedic for the Virginia Fire and EMS Department, overseeing a team of 32 full-time personnel. He has successfully led fire departments with a mix of full-time, part-time, and paid-on-call firefighters. Since February 1, 2025, L'Allier has been serving as Interim Fire Chief for the City of Lino Lakes. The wage for L'Allier will be $70.38 per hour, which is Step 8 in a 10-step wage scale for the Fire Chief position. With Council approval, L'Allier’s promotion to Fire Chief will be effective May 12, 2025. RECOMMENDATION Please approve the promotion of Dan L'Allier to the position of Fire Chief within the Fire Department. Call to Order and Roll Call Mayor Rafferty called the meeting to order at 6:00 p.m. 2. Setting the Agenda: Addition or Deletion of Agenda Items The agenda was adopted as presented. 3. Administration Update The Interim City Administrator provided the following updates. • Staff have been preparing for the City Council Work Session discussion topics. • The annual spring office cleaning was completed. • Draft ordinances for the establishment of the police department and fire department have been sent to the attorney for review and will be brought forward to the Council at a future meeting. • Staff reviewed the Citygate final report which is scheduled for prestation this evening. • With the new BS&A financial software the process for entering and reviewing over-time and comp-time has been streamlined. • Community Development has been managing construction projects and road closures and working with impacted neighborhoods. • The Fire Department responded to four structure fires recently. The response was impressive from the Lino Lakes Department in addition to mutual aid. • The Fire Chief secured radios from the City of Fridley and as a result all new firefighters will be issued a radio. • The Police Department is purchasing ballistic plates for police officer vests. The new vests have a varying warranty period, up to 15 years. These are a daily wear vest. Page 2 of 3 • North Metro TV reviewed the organizational chart and determined to maintain the current co-executive director leadership structure. • A construction meeting was recently held for the new public works facility. • The May 5th Work Session agenda has a number of development project topics, and as a result it is requested that the Council schedule a special work session for either May 14th or 15th to discuss the implementation of the Citygate report. The Council discussed the public works facility construction plans. Councilmember Lyden questioned if a carport should be added for the police department to the public works facility. Mayor Rafferty stated that he preferred to keep the public works facility separate from the police department carport. Councilmember Ruhland asked if there was the need for a sub-station for the police department. The Interim City Administrator noted that the department had a sub-station at a local bank in the past. He reviewed that as identified by the Council at a prior meeting, the police department could be expanded to the space at City Hall that is currently leased out with notice to terminate the lease. Council Consensus It was the consensus of the City Council to schedule a Special Work Session for May 14, 2025, at 6 p.m., to be held at City Hall. 4. Review Regular Agenda The City Council reviewed the regular agenda. The City Council reviewed the Building Inspector appointment scheduled for the regular meeting. Citygate representatives will be present this evening to provide an overview of the Citygate final report for the Public Safety Department and will be available to answer any questions. The Community Development Director will be presenting the engineering items on the agenda this evening. It was noted that there is a resolution approving a publication summary as part of agenda Item 6B “Consider 2nd Reading of Ordinance No. 05-25, Vacating certain street, drainage and utility easements on 70th Street and Otter Crossing South”. PUBLIC COMMENT Mayor Rafferty opened the public comment period at 6:32 p.m. Scott Coggins, 15043 Thrush Street, Andover, representing the citizen group, Anoka County Election Integrity Team (ACEIT), presented a handout for the consideration of the Council. The handout addressed the approval process for the poll pads with Anoka County, city liability for damages to the poll pad under the agreement with Anoka County, and liability for any violation of MN Statute 201.225 Subd. 2 (11) related to the use of poll pads. Chris Harvey, 14845 60th Street N., Oak Park Heights, spoke about the proposed Madinah Lakes project and universal self-interest at a family and community level. Citygate Final Report Representatives of Citygate presented a PowerPoint presentation overviewing the Final Report of the Operational Study of the Public Safety Department. They presented their findings, the project scope elements, and the stakeholder assessment and contributions to the report. They then presented the Police Division Assessment followed by the Fire Division Assessment. Motion to accept the Citygate Final Report to be used as a tool for the future growth of the Lino Lakes Fire Department and Police Department. 5. Board of Appeal / Open Book Meeting Options Anoka County Assessor Alex Guggenberger reported that there are two options for the City related to property assessments. Lino Lakes currently holds a Local Board of Appeal and Equalization meeting, and the alternative is an Open Book meeting. The Open Book meeting has the advantage of additional time to accept appeals. He stated that currently the Open Book meetings are being held at the Anoka County Government building, however, satellite locations such as city hall could be established as more cities move to an Open Book format. He stated that a resolution to move to an Open Book meeting is the procedural step to change formats. He stated that the City could return to holding a Local Board of Appeal and Equalization meeting in the future by adopting an amending resolution. The Council was generally in favor of moving to an Open Book format. Councilmember Ruhland stated that he appreciated the additional time allowed for appeals under the Open Book format but preferred the Local Board of Appeal and Equalization meeting as it provided the Council with more local control over the appeal decision. This item will be brought forward to a regular meeting for formal consideration. Page 2 of 8 4. Natures Refuge North PUD Preliminary Plan/ Preliminary Plat The Community Development Director stated that the applicant, M/I Homes of Minneapolis/St. Paul, LLC, has submitted an application for Rezoning to Planned Unit Development (PUD), PUD Preliminary Plan (PPP), and Preliminary Plat (PP) approvals. The project proposes to create 93 lots on 60 acres located north of Natures Refuge and is called Natures Refuge North. He noted that the applicant has been working with the City on this project for the past two and a half years. The Community Development Director stated that the Planning and Zoning Board held a public hearing on April 9, 2025, and recommended approval with several conditions. The Community Development Director stated that this evening the Council is requested to review their plan and provide direction regarding: 1. Building Design flexibility a. Garage setback requirements / option for a decorative garage door 2. Connection to Andall Street a. Outlot B Platted for future roadway The Community Development Director stated that the builder was present and available to answer any question about the project. He stated that this item is scheduled for formal action at the May 12, 2025, City Council meeting. Council Consensus To allow for building design flexibility by allowing for the garage construction extending in front of the house, without the requirement for a porch. With a limit on the percentage of homes constructed with this exemption to the code requirements. To construct a road connecting to Andall Street to improve public safety access. With limits on construction traffic and holding on the final access/construction until the time of occupancy within the new subdivision. The Community Development Director stated that this project would be brought to the May 12th meeting for formal action. 5. Wilkinson Waters PUD Preliminary Plan/Preliminary Plat The City Planner provided a PowerPoint presentation overviewing the Wilkinson Waters project. She stated that the applicant, Wilkinson Waters LLC, is proposing a master planned development located on North Oaks Company Inc. property south of County Road J/Ash Street/CSAH 32, west of Centerville Road/CSAH 21 and north of Wilkinson Lake Boulevard. The development contains four parcels totaling approximately 76 gross acres and consists of a mix of 340-unit residential housing types and commercial development. It was noted that they first approached the City about this project in 2015. Page 3 of 8 The City Planner stated that the Comprehensive Plan Amendment requires notice to affected jurisdictions. They have 60 days to review and comment. The 60-day deadline is May 17, 2025, so the City Council meeting date for consideration is May 27, 2025. The Planning and Zoning Board held a public hearing on April 9, 2025. Unfortunately, the notice was not mailed to all property owners within 600 ft of the development boundary so a second hearing will be held on May 14th. The City Planner introduced the developer, contractor, engineer, architect, and senior building manager who were present this evening to answer any questions about the proposed project. The City Planner reviewed the site design and amendments to the project that have been made through the planning process. She stated that there are four main questions for the Council this evening, one is the height of the proposed senior building at 55’, the other is a request for an exception to the requirement to wrap the side of the four- plex’s with decorative brick, the third is a question of requiring a horizontal variation in the design at the first level for the apartment, and the four is the set-back between the apartment building and four-plex. The Council reviewed the height requirements and decorative elements of the proposed buildings. The height of the building was reviewed, and it was noted that there were several decorative elements to the roofline, that the senior building would be having activities on the first floor and a 10’ ceiling was requested. It was noted that the four- plex siding faced inward towards each other and the decorative siding would not therefore be as essential. The apartment building did not have horizontal design variation but did have significant vertical design variation and had varying construction design sufficient for variety. The set-back between the apartment building and four-plex may be achieved with moving the road, however, the future senior building would be impacted. The senior building future manager stated that the additional land for the senior building would allow for less slope in the parking lot and sidewalks, which would be better for residents using a wheelchair or walker. Council Consensus It was the consensus of the Council to: - Support the 55’ height exemption for the building. - Support an exemption from the design requirement to wrap the four-plex with decorative brick along the side of the buildings. - Support accepting the vertical design variation of the apartment building in consideration of the horizontal design elements presented. - Direct staff to further review the set-back requirement between the apartment building and four-plex in relation to the road design and location. The City Planner stated that this project will be brought back for formal action at the May 27th Council meeting. Page 4 of 8 6. Watershed Based Implementation Funding (WBIF) Grant The Environmental Coordinator reported that in 2022 the City Council authorized a partnership with the Rice Creek Watershed District to identify potential water quality improvements to reduce volume and sediment/nutrient loading to Rice Lake. The study evaluated potential improvements to Shenandoah Park. The City partnered with Rice Creek Watershed District to fund the final report, which was completed in December of 2022. The report included four alternatives. The Board of Water and Soil Resources (BWSR) has established the Watershed Based Implementation Funding (WBIF) Grant Program. The grant program allocates funding to each watershed area for allocation in a collaborative local process. City staff and RCWD have proposed the Shenandoah project for funding through this program. The City of Lino Lakes was selected as one of the projects moving forward as part of the grant program. The grant in the amount of $52,650 is to complete plans for a stormwater improvement project. Grants must be completed and signed no later than June 1, 2025. Grant documents should be available for final signature at the May 12, 2025, City Council meeting. Once the design is completed the City and RCWD will pursue additional construction funding through the program to complete the proposed project. 7. Birchwood Acres Pond Treatment The Environmental Coordinator stated that staff have received feedback from concerned residents regarding the aesthetic quality of storm pond RLA-010-B located in Birchwood Acres Park. This pond treats stormwater runoff from nearly 70 properties located primarily on Hawthorn Road and Lonesome Pine Trail in the Park Grove development. Communication has gone back several years to deal with concerns of vegetation, smell, and stormwater management. The main concerns include the vegetation that covers the surface of the pond and odor. The vegetation present on this pond is primarily duckweed, which provides water purification by incorporating nutrients. It is also an important food source for wildlife. The odor is primarily due to decomposition of plants and algae. The Environmental Coordinator stated that in response to residents’ concerns, city staff took steps to ensure the pond was functioning properly. The city also initiated water quality sampling to check phosphorous levels in September of 2020. The phosphorus detected was at levels typical for stormwater ponds. The pond was also surveyed in July of 2021 to determine its functionality in terms of stormwater management. The survey and associated analysis found that the pond is functional and does not require additional maintenance at this time. Page 5 of 8 The Environmental Coordinator stated that the question for the Council, is given that this pond is part of the city stormwater system and any amendment to one pond may impact the overall system, is there support for allowing a pilot project by private residents to improve the aesthetic quality of the pond. Council Consensus It was the consensus of the Council to support a privately funded pilot project for stormwater pond RLA-010-B located in Birchwood Acres Park. 8. I-35E Joint Powers Agreement The Community Development Director stated that Ramsey County is preparing to solicit bids and award a contract for the improvements for I-35E/CR J interchange improvements. The overall project cost is estimated at $23,761,410.60. Federal funds are available for the Project and are capped at $19,000,000.00. The City’s share of the proposed improvements is $318,509.60. The Community Development Director stated that staff are still reviewing responsibilities with maintenance of the interchange roundabouts and street lighting. The City will be entering into the agreement with Anoka County. Anoka County and Ramsey County will have a master agreement in place covering the overall project costs. Landscaping improvements to the Centerville/CRJ roundabout are in addition to these costs. The portion of the project will likely be bid in 2026. Council Consensus It was the consensus of the City Council to schedule a review of the JPA for May 12, 2025, pending resolution of the interchange roundabout and street lighting maintenance and electric costs. 9. Special Assessment Senior Deferral Code Update The Community Development Director reported that Minnesota Statutes Chapter 435.193 allows cities to provide a hardship assessment deferral, provided standards are adopted establishing guidelines for determining the existence of hardship. City Code section 303.10 allows for the City Council to defer payment of special assessments on homestead property owned by a person that is 65 years of age or older or retired by virtue of permanent and total disability. The deferment is subject to certain income- related conditions. The Community Development Director stated that the ordinance has not been updated since 1983. He noted that the ordinance has three considerations for determining income and it’s recommended that the city delete the two static factors and keeps the first factor that is annually adjusted as it relates to the low-income limits in effect at the time of the application for the metro area. Page 6 of 8 Councilmember Ruhland stated that there are county/state programs that the City could follow. The Community Development Director stated that staff would research other governmental programs and prepare an amendment as needed for the future consideration of the Council. 10. Liquor License Fees The City Clerk stated that business license renewal time is approaching, and the City has received a request from a local restaurant to split the payment of the annual license fees. It is requested that the Council provide direction regarding allowing the annual On- Sale Intoxication Liquor and Sunday Sales license fees to be paid in part at the time of application and then in full by or before December 31, 2025. This would be available to all restaurants upon request and the full license fee would be indicated on the renewal notice. Council Consensus It was the Consensus of the City Council to approve a split payment for On-Sale Intoxicating Liquor and Sunday Sales licenses with half payment due at the time of application and half payment due by or before December 31, 2025, upon request of the applicant. 11. Citygate Report – Interim Titles (Added Item) Mayor Rafferty requested that the staff holding the Interim titles for Public Safety Director, Fire Chief and Acting titles for the Sergeant title be confirmed as regular positions, removing the interim and acting titles, based on the future direction recommended by the Citygate report. Council Consensus It was the consensus of the City Council to schedule the appointment of the Police Chief, Fire Chief and Sergeants for the May 12, 2025, meeting, including the recognition ceremony for the Fire and Police Chief appointments. 12. Administration Report The Interim City Administrator provided the following updates. • The City Attorney has been researching and will have a draft prepared for the May 12th meeting of the ordinance amendments for the establishment of a police department and fire department and repeal of the ordinance establishing a public safety department. • Administration, Human Resources and Finance staff have been reviewing the Citygate study implementation costs and processes. The Council will be presented with options and associated costs at the May 14th Work Session. Page 7 of 8 • The Human Resources Department has reviewed the process for removing the Interim titles for the public safety staff. • The Human Resources and Communications Manager and Community Development Director revised the Community Development Specialist job description. This person is identified as the back-up for the Community Development staff. • The Administrative Assistant role has been reviewed as this person should become knowledgeable about all administrative operations so that they can fill in if needed due to a vacancy or absence in the administration department. • The Finance Department has been working on streamlining the “Injury on Duty” policies and procedures. • The Administration and Human Resources Departments have been working on the new recruitment and promotional process for the Police Department. The promotional process information will be made available to all staff. • The contract with the new City Administrator has been signed. The new Administrator is being notified of upcoming events and key meetings and will be attending certain meetings based on topic and availability. • The Community Development Director responded to the draft State Senate File 2229 regarding city zoning authority. • The public works facility construction manager contract is scheduled for the next Council meeting. • The contract with Citygate was extended to July 1, 2025, at no cost. This will allow the new City Administrator, the Council and staff to contact Citygate for more information about the report during the time of implementation. Councilmember Ruhland reported that there are several cities hiring Finance Directors and asked about the timing and process for hiring a Finance Director, following the conclusion of the contract for services with the Lino Lakes Interim Finance Director. The Interim City Administrator stated that the Human Resources Department has recommended that the hiring process be conducted in-house vs. hiring a firm to complete the search. The Interim Finance Director has reported that there are several qualified candidates that she would anticipate would be interested in the position. The timing of the hiring is proposed to correspond with the onboarding of the new City Administrator so that she can be part of the selection process. 13. Citygate also advised making organizational changes within the Police Department, which requires removing the Deputy Director of Police and Police Captain positions. With Council approval, the Deputy Director of Police and Police Captain will transition to the role of Police Sergeant as of May 17, 2025. RECOMMENDATION Please approve the restructuring of the Police Department and eliminating the positions of Deputy Director of Police and Police Captain. BACKGROUND Staff has provided a conditional offer and is recommending the approval of Miller for the part- time position. Miller has completed Firefighter 1 & 2 as well as Hazardous Materials training and certification, and has been working as a Paid On-Call Firefighter for the City of Lino Lakes since January 16, 2025. The starting wage for Miller will be $26.27 per hour, which is Step 1 of a 7 step wage scale for the Part-Time Firefighting position. With the Council’s approval, Miller would start in the position on May 19, 2025. The Public Safety Department currently has 14 Part-Time Firefighters on staff. RECOMMENDATION Please approve the appointment of Benjamin Miller to the Part-Time Firefighter position. BACKGROUND Staff has completed the recruitment process, provided a conditional offer, and is recommending the approval of McKinney for the full-time position. McKinney will earn an Associate’s Degree in Criminal Justice and Law Enforcement Transfer Pathway through Century College and complete her POST mandated Law Enforcement curriculum in Summer of 2025. McKinney has been working as a part-time Community Service Officer in the Lino Lakes Public Safety Department since February 2024. The starting wage for McKinney will be $42.22 per hour, which is Step 1 in a 7-step wage scale for the Police Officer position. With the Council’s approval, McKinney will start in the Police Officer position once she receives her POST licensure. There are currently two vacant Police Officer positions within the Public Safety Department. The 2025 Approved Budget is funded for 28 sworn positions. The hiring of McKinney as an officer will bring the police department to 28 sworn staff. Approval of this request will not result in an increase to personnel cost for the police department. RECOMMENDATION Please approve the appointment of Kayla McKinney to the Police Officer position. ATTACHMENTS None 1 CITY COUNCIL REGULAR MEETING STAFF REPORT AGENDA ITEM 5A STAFF ORIGINATOR: Justin Williams, Public Works Superintendent MEETING DATE: May 12th, 2025 TOPIC: Consider Resolution No. 25-59 Replacement of 2004 Olympian 30kW Generator – Lift Station 53 Backup Power VOTE REQUIRED: Simple Majority ______________________________________________________________________________ INTRODUCTION Requesting approval for the replacement of a 2004 Olympian 30kW natural gas generator that provides emergency power to Lift Station 53 (6300 Laurene Ave), a critical lift station, using funds from the Sewer Capital Equipment account. BACKGROUND The existing generator was installed in 2004 and has served as the primary backup power source for lift station 53. Due to its age and wear, the reliability of the unit has become inconsistent, raising concerns about its ability to operate when needed during power outages. The short retention time at this lift station allows for only a narrow window before backups occur, making dependable emergency power essential to prevent sanitary sewer overflows and protect public health and the environment. This generator is currently scheduled for replacement in 2026 as part of the long-term capital replacement plan. However, due to its declining reliability and the critical nature of the lift station it serves, staff recommends advancing the replacement timeline. RECOMMENDATION Staff recommends the immediate replacement of the 2004 Olympian 30kW generator. New 40kW generators are currently in stock and available for purchase, which allows for timely procurement and installation. Turn key generator replacement cost is $37,375.00. For purposes of this paragraph “Buyer” shall include any corporation controlling, controlled by, or under the common control with Buyer. 3.7 All costs incurred by the Seller as a result of non-payment or delay in payment by the Buyer, including, without limitation collection costs and reasonable attorney’s fees, shall be paid by Buyer. 4. DISCLAIMER OF WARRANTY THE SELLER WARRANTS THAT THE PRODUCTS CONFORM TO THE SPECIFICATIONS SET FORTH ON THE FACE HEREOF OR AS THE MANUFACTURER MAY PROVIDE. Remedies of Buyer 5.1 Seller shall not be liable for any claim arising in connection with the products sold to the Buyer hereunder unless written notice is given by the Buyer to the Seller as provided in paragraph 5.2 below. 5.2 Written notice of any objection, complaint or claim concerning the product must be given: (a) with respect to claims of damage to the products which occurred in transit, within thirty (30) days after the date on which risk of loss with respect to the products passes to the Buyer. (b) with respect to claims of non-conformity to specifications, within ninety (90) days following the date on which risk of loss with respect to the products passes to the Buyer, provided however, that no claim of non-conformity will be honored if the Buyer has previously notified the Seller of its acceptance of the product following inspection thereof. 5.3 Failure to give such notice in the manner and within the time provided herein shall be deemed a waiver by the Buyer of all claims with respect to such products. 5.4 Seller will, at its sole discretion, either reimburse Seller’s Invoice value to the Buyer of products found to be defective, or replace free of charge all products found to be defective, within thirty (30) days after the date of notice with respect to any such product was given in accordance with www.istate.com paragraph 5.2 above; provided, however, that such products have not been abused by the Buyer or used in conditions for which the products were not intended. The aforesaid right of replacement or reimbursement shall be the Buyer’s sole and exclusive remedy in the event of non-conformity or defect in the products. The Seller shall not be liable for the incidental or consequential damages to the Buyer as a result of the Seller’s breach of Contract. In no event shall the Seller’s liability exceed the Seller’s Invoice value to the Buyer of the products sold regardless of the nature of the claim of the Buyer. 6. Passage of Title – Security Interest 6.1 Seller shall retain title to ownership of, and security interest in the products until the contract purchase price set forth on the face hereof shall have been paid in full and all covenants and agreements of Buyer herein shall have been performed. Seller shall have all common law and statutory lien rights available in the state where goods or services are provided and Buyer hereby agrees that if Buyer takes possession of the related equipment without making payment to Seller and thereafter Seller regains lawful possession of the equipment that was once subject to lien claims while there remains a balance due Seller, all such lien rights shall be reinstated as if Seller had always maintained lawful possession of all such equipment. 6.2 At the request of Seller, Buyer shall execute and deliver to Seller all such financing statement and other instruments and documents as may be requested by Seller to evidence and to perfect its security interest in the products. Expenses of filing financing statements or other security documents with the appropriate state and local governmental authorities shall be for the account of the Buyer. 7. Force Majeure 7.1 If because of force majeure the Seller is unable to carry out any of its obligations under this agreement and if the Seller promptly notifies the Buyer in writing expressly claiming such force majeure, then the provisions of paragraph 7.2 shall apply. The term “force majeure” as used herein shall mean any causes reasonably beyond the control and without fault or negligence of the Seller which holly or in substantial part prevent the manufacture, transportation, loading, unloading, delivery or storage of the products sold hereunder. Examples, without limitation, of force majeure are acts of God, acts of the public enemy, acts of war, riot or civil commotion, labor disputes, labor or material shortages, accidents, fire, explosions, floods, breakdowns of or damage of plants, equipment or facilities, partial or complete embargoes imposed by originating or connecting inland carriers, interruptions to or contingencies of transportation, orders or acts of any governmental authority, acts, rules, regulations or expressed policies of any government. 7.2 If force majeure notice is given under paragraph 7.1 above, the obligations of the Seller shall be suspended to the extent made necessary for such force majeure and during its continuance, if the obligations of the Seller remain suspended hereunder for a period amounting to forty-five (45) consecutive days measured from the dates of performance and at any time thereafter, then either party may terminate the agreement without liability by giving fifteen (15) days notice to the other party. At the expiration of said fifteen (15) days, unless such condition shall have been ended, the party giving such notice may terminate this agreement forthwith. 8. LIABILITY FOR DAMAGES 8.1 THE SELLER SHALL NOT BE LIABLE FOR ANY DAMAGES CAUSED BY THE PRODUCTS DELIVERED OR TO BE DELIVERED TO THE BUYER, OR BY THE www.istate.com BUYER’S OR ANY THIRD PARTY’S USE OF SUCH PRODUCTS, AFTER THE PRODUCTS HAVE BEEN IDENTIFIED TO THE CONTRACT. 8.2 THE SELLER’S OBLIGATIONS HEREUNDER ARE EXPRESSLY SUBJECT TO THE OCCURRENCE OF EVENTS OF FORCE MAJEURE, AND NO LIABILITY SHALL BE INCURRED BY SELLER FOR DAMAGES OF ANY NATURE RESULTING FROM SUSPENSION, REDUCTION OR TERMINATION OF DELIVERIES FOR REASONS OF FORCE MAJEURE, OR FROM SELLER’S COMPLIANCE WITH ANY GOVERNMENT ACTION. 8.3 THE BUYER SHALL HOLD THE SELLER HARMLESS FROM ALL CLAIMS OR ACTIONS BROUGHT BY THIRD PARTIES WITH RESPECT TO ANY DAMAGES DESCRIBED IN THIS ARTICLE 8. 9. Waiver – Severability of Terms 9.1 Waiver by the Seller of any default of the Buyer shall not be deemed a waiver of any other default of the Buyer. The express provision herein for certain rights and remedies of the Seller shall not be construed to deprive the Seller of any other rights and remedies to which it would otherwise be entitled under applicable law. 9.2 The invalidity of any provision of these Terms and Conditions shall not affect the remaining provisions hereof. 10. Governing Law – Notice 10.1 This Invoice shall be interpreted in accordance with the internal laws of the State of Minnesota (without giving effect to its conflicts of laws rules) including, without limitation, the Uniform Commercial Code as enacted and in force from time to time in the State of Minnesota and no presumption shall be deemed to exist in favor or against either party as a result of the preparation and/or negotiation of this Invoice. 10.2 This Invoice and all the terms and conditions hereof shall be binding upon the Parties and their respective successors and assigns, however, the Buyer shall not assign or otherwise transfer any of its rights or obligations hereunder without the prior written consent of the Seller. 10.3 The parties hereto submit to the jurisdiction of the courts of the State of Minnesota (including Hennepin County Conciliation Court), and the Minnesota Federal Courts. The parties hereto also agree to service of any complaint by certified mail. To the extent that the Buyer or any of its property has or may hereafter acquire any right of sovereign immunity from suit, the Buyer hereby irrevocably waives any such right of sovereign immunity in respect of its obligations, rights and duties under this agreement. 10.4 Notices or other communications shall be given by telex or telegram, or by registered or certified mail, return receipt requested. Telex or telegram notice shall be deemed received twelve hours after transmission. Mail notice shall be deemed received on the fifth day after mailing (or on the next business day if the fifth day is not a business day). Where both methods of notice are used, the earlier shall establish the effective date of notice. In addition to advisory board and City Council review a neighborhood meeting was held on February 6, 2024. Concerns raised during the review process included development density, proximity of new housing to existing Arena Acres neighborhood, traffic and safety concerns with connection to Andall Street, impact on trees, wetlands and wildlife and garage sizes. Based on comments received from advisory boards, City Council review and the neighborhood meeting a revised concept was received in July of 2024. The revised concept plan application reduced the number of lots by 16 (converting them all to 60-foot-wide villa lots), increased the buffer to Arena Acres by at least 110 feet, reduced the proposed tree removal, and reduced the net density by 0.38 units per acre. The concept plan was reviewed by the City’s Advisory Boards and City Council. The applicant has now submitted a PUD Preliminary Plan (PPP), Preliminary Plat and Rezoning to PUD for consideration. Project Phasing The project is proposed to be constructed in two phases. Phase 1 includes approximately 62 lots with the extension of Haywood Drive and Street D. Phase 2 will include the balance of the development along Street A, northwest of the pipeline. 3 Existing Conditions The property is wooded with aspens dominating the canopy intermixed with birch, oak, maple, and red pine. Approximately 10 acres remain in agricultural use. Wetlands are located on site, including wetlands located withing the Rice Creek Watershed District Wetland Management Corridor. A natural gas pipeline crosses the property diagonally from the northeast corner to the southwest. The property will be rezoned to PUD, Planned Unit Development to implement a conservation development by allowing for zoning flexibility. A summary of PUD public benefit vs PUD flexibility is provided at the end of this staff report. Conventional Zoning Requirements vs. PUD Guidelines Per City Code Section 1007.024(4) for PUD, Planned Unit Development, the development guidelines for land guided low density residential development are either R-1, R-1X, or R-2. Of the 34 house elevations proposed by the applicant – 6 elevations protrude in front of house. Yes PUD Flexibility Provided: 6 Collector road right of way. The right-of-way width of Haywood drive (Street C) will be reduced from 80’ to 60’ along Haywood Drive (Street C). This is consistent with previous flexibility to applied to the Natures Refuge to the south. The reduction in width minimizes the development footprint and increases the area of preservation. Sidewalk will still be included within the 60’ right-of-way to accommodate pedestrians. Cul de sac length. The cul de sac length of Street D is proposed at 620’. 500’ is the maximum length allowed. The street will be 32 feet wide instead of typical 30’ and include hydrants and midpoint and end of cul de sac. Corner Lot width and Corner Setback. The applicant has requested a reduction in Corner Lot width from the required 80’ to 70’ and Corner Lot setback from 25’ to 20’. Corner lot widths are generally wider to accommodate building setbacks from both streets and provide uniformity between lots fronting different streets. The city has generally allowed for reduced width and setback where corner lots back up to another corner lot or open space. Staff is supportive of this request. Side Setbacks. Side yard setbacks will be 7.5’ instead of the typical 10’ and 5. This maintains a uniform side yard setback between homes. Garage Requirements. The applicant originally requested flexibility from the garage area (520 SF), width (20’), and garage architectural design standards. The Planning & Zoning Board recommended that no flexibility be granted. The applicant has revised plans to meet or exceed both the garage area and garage width requirements. However, they continue to request flexibility to allow the garage to protrude 5’ in front of the house without the front porch requirement. They also request flexibility on the maximum length of the garage wall facing the street from 50% of the front façade width to a maximum of 57%. The garage architectural requirements are intended to minimize the visual impact of garage dominated streetscapes and avoid monotony on narrow lots of the R-2 zoning district. Of the 34 home different elevations proposed by M/I, only six include the protruding garage. Given the number of architectural choices the concern over a repetitive layouts being used throughout the development is minimized. However, there is no specific requirement that would prevent this. With the expansion of the maximum garage width percentage all of the houses to accommodate the garage size adjustments. The villas are intended to provide single level living so a majority of units do not provide the 2nd level living space required to exceed the 50% maximum garage length. With the increase to 57% all products would comply and the developer would agree to meet all the same requirements including: 7 • Decorative garage doors with a strip of windows • Garage width in excess of two stalls will be recessed two feet from the main garage facade. • Total garage width will not exceed 32 feet. Subdivision Ordinance Conservation Development Per City Code Section 1007.007: Subdivision Ordinance Definitions CONSERVATION DEVELOPMENT. The development pattern and technique whereby lots are arranged in closely related groups to preserve the natural amenities of the land through the creation of common open space. Natures Refuge North is a proposed conservation development. The villa lots preserve woodland and wetland areas, create more protected accessible public open space and establish the greenway corridor. The trail system is also incorporated into the greenway system vs. along the street creating a more enjoyable, safer, and valued recreational experience. The purpose of using the PUD zoning is to create a conservation development that establishes the defined public values of preserving and enhancing the on-site natural resources. The PUD also creates and enhances the greenway corridor and trails that are accessible to the public. Blocks and Lots The proposed development contains 93 single family lots and 5 outlots. The outlots contain wetlands, buffers, stormwater ponds etc. Outlot E, located on the northern end of the plat, meets the size requirement of an R-2 lot but cannot be constructed upon without a grading easement from the property to the north. This outlot shall be platted as a lot bringing the total single family lot count to 94. Staff Comments: 1. City Code Section 1007.024 (5)(c) requires that if a PUD includes preservation of natural habitat those areas shall be permanently protected through a conservation easement or other legally binding agreement with the City. The proposed open space areas should remain in the ownership of the HOA with a conservation easement granted to the City. 2. Since Outlot E meets the R-2 lot size requirements, Outlot E should be converted into Lot 11, Block 7. 8 Streets and Alleys Haywood Drive is identified as a minor collector road in the Transportation Plan and provides a north-south corridor from CSAH 14 (Main Street) to eventually Pine Street. All proposed street right-of-way widths are 60ft and the street is proposed to be 32ft wide from back of curb to back of curb. Street B is recommended to connect to Andall Street. Arena Acres was platted in 1981 and a 60 ft wide Outlot B was platted for future road connection to the east. This outlot is owned by the City. The extension will connect the neighborhoods and transportation system. This street connection is further supported by the following City Code Sections: § 1001.100 STREETS AND ALLEYS. (3) Streets, continuous. Except for cul-de-sacs, streets shall connect with streets already dedicated in adjoining or adjacent subdivisions or provide for future connections to adjoining unsubdivided tracts, or shall be a reasonable projection of streets in the nearest subdivided tracts. The arrangement of thoroughfares and collector streets shall be considered in their relation to the reasonable circulation of traffic, to topographic conditions, to runoff of storm water, to public convenience and safety, and in their appropriate relation to the proposed uses of the area to be served. This standard transportation practice has been implemented throughout the City such as the Foxbourough connection to Fox Road, Saddle Club connection to Fox Road and the St. Clair Estates connection to Hokah Drive and Sioux Lane. The Andall Street connection is supported by Lino Lakes Public Safety-Police Division and Fire Division in order to provide faster and more direct emergency response to the entire area. The connection is also supported by Public Works to provide better efficiency for street maintenance and snow plowing. Following discussion at the Monday, May 5, 2025, Council Work Session staff is proposing additional conditions regarding the access as follows: a. The street will be constructed following approval of the 2nd Addition Final Plat, except for grading and clearing and grubbing activities which may commence with the initial development phase. b. Construction limits shall be determined, and a tree preservation plan shall be submitted for review and approval by City prior to clearing and grubbing activities on Outlot A, Arena Acres. 9 c. Street will remain closed to through traffic until paving of wear course on Street A with the 2nd Addition. d. Developer shall provide a planting plan for boulevard trees and shrubs for that portion of Street A within Outlot B, Arena Acres, where appropriate based on remaining tree canopy. Plan will be reviewed and approved by Environmental Coordinator. Sidewalks and Trails Sidewalks are proposed on the east side of Haywood Drive and Street A and the south side of Street C. Sidewalks shall be provided on Street B and Street D. The termination point of the sidewalk on Street D shall be determined by the City Engineer. A trail is proposed to connect to the trail in Natures Reserve to the south through the stormwater ponds south of Street D to the eastern edge of the property across Street C and then north between the wetlands and across the gas easement to the northern property line. Before the trail reaches the northern property line, a trail connection is constructed west to Street A between Lot 4 Block 1 and Lot 1 Block 2. The maximum length of a cul-de-sac is 500 ft. Street D cul de sac is 620 ft. The street will be 32 ft wide (vs 30 ft wide) and a sidewalk shall be installed. Public safety is in approval with the cul de sac length. Staff Comments: 1. A temporary turnaround will be required at the north end of Street A. 2. Sidewalks shall be included on Street B and Street D. 3. The trail corridor between Lot 4 Block 1 and Lot 1 Block 2 and east of Lots 1-4 Block 4 shall be widened to 30 feet wide. 4. Andall Street connection can be reduced to 24 feet wide. Easements and Outlots The applicant has provided 10 feet wide drainage and utility easements along the right-of-ways and along the rear property lines. 5 feet wide drainage and utility easements are provided along the side property lines to provide a total easement wide of 10 feet through both side yard easements, while where a stormwater utility pipe will be located between two lots, the applicant has provided 10 feet wide drainage and utility easements to accommodate the infrastructure. Drainage and utility easements will be dedicated over Outlots A, B, C and D. Outlots A, B, C and D will be owned and maintained by the development homeowner’s association (HOA). As 10 stated above, Outlot E should be converted into Lot 11, Block 7. There is a 100-foot-wide gas line easement that runs from southwest to northeast through Outlots A and C. Outlot F has been created on the revised April 25, 2025, plan set to accommodate a city lift station, formerly proposed to be located within an easement on Outlot D at the intersection of Street C and Street D. A conservation easement will be required for all protected open space areas (Outlots A, B, C and D). Staff Comments: 1. The portion Outlot D that is occupied by the lift station should be separated from Outlot D through the creation of a new outlot that would be dedicated to the City. 2. Conservation easements and wetland buffers shall be required over Outlots A, B, C and D. Stormwater Management and Erosion and Sediment Control The Preliminary Plat shows three stormwater ponds, one within Outlot C to the east of Block 2 and two located within Outlot D located to the south Block 4. The proposed trail runs between the two stormwater ponds within Outlot D and the southern of the two ponds will connect and expand the existing stormwater pond within Natures Reserve. The revised April 25th plan set shows the addition of a stormwater retention area northwest of Street A to address Rice Creek Watershed and City Engineer comments. Utilities 11 Public water, sanitary and storm sewer utilities will be installed within the development. Water and sanitary will extend north along Haywood Drive. Water main is also proposed to be extended to Andall Street as part of the road construction. The site is located in Sanitary Sewer District 2 (Sub-district 2K). Flow is collected southward to MCES Meter M211 and Gravity Interceptor 8361 along North Road which passes southwest through Circle Pines. PID# 05-31-22-42-0003 is located in Utility Staging Area 1A (2018-2025) and PID#05-31-22-13- 0001 is located in 1B (2025-2030). By resolution, the Council may move the one (1) parcel from Stage 1B (2025-2030) to Stage 1A (2018-2025). A sanitary sewer lift station is located along Haywood Street, east of Street D. This will provide service to the development as well as future service to the Olive and Orange Street neighborhood which are smaller (<0.5 acre) lots on private septic systems and wells. Proposed water use is within the capabilities of the City’s existing water supply. The project will include a stormwater reuse irrigation system that will significantly reduce water use and impact on maximum day demands. Weekly summer water savings are estimated at 487,000 gallons. Parks, Greenways and Trail Plan Per the City’s 2040 Parks, Greenways and Trails Plan, this development is within the Arena Acres and Wollan Park service areas. Arena Acres is a smaller 1-acre neighborhood park. Wollan’s Park is an 18-acre open space wetland and not an active park. The Plan indicates a Future Neighborhood Park centrally located within the service area. Greenway corridors exist on site. Linear trails are proposed to provide connectivity to the existing Nature’s Refuge trail to the south and a future trail connection when the property to the north is developed. The trail locations through open space and stormwater provide for a multifunctional greenway corridor. Staff Comments: 1. Trail corridors shall be a minimum 30ft wide. Tree Preservation and Landscaping The purpose of these standards is to protect valuable trees and vegetation stands while not interfering with landowners’ reasonable use and development of property. The goal is to 12 minimize unnecessary loss of habitat, biodiversity, and forest resources and to replace removed trees in areas where tree cover is most critical. A tree survey was performed that identified: April 2025- PUD Preliminary Plan and Preliminary Plat Total Trees Surveyed 6009 Trees Removed (BUA) 2234 Trees Removed (non-BUA) 1262 Trees Preserved 2375 Mitigation Trees Required 292 The majority of trees on site are aspen with a mix of birch, oak, maple, and red pine. As discussed at the October 2024 meeting the applicant is proposing to dedicate approximately 34 acres of open space for tree preservation and future management. The applicant agrees to plant a minimum of 3 trees per lot throughout the development. One boulevard tree is required per lot. Staff will work with the developer on the two remaining trees to ensure that there isn’t conflict with infrastructure and overplanting. Tree Preservation and Mitigation Standards have been met with the dedication of open space for preservation. Open Areas Landscape Standards The purpose of these standards is to provide general site beautification and high aesthetic quality with a mix of plant materials in open areas. Open area landscape standards call for 1 large tree and 2 large shrubs per 2500 sf. Topsoil salvaged from the area prior to construction will be spread over the new ponds and open space. The established seed bank should provide native species to thrive along with native seed mix. To allow sunlight and promote growth of the existing rare and unique species onsite, minimal tree planting is being requested throughout the open space. Sparce plantings of oaks will be planted within open space areas adjacent to the stormwater ponds. A revised landscape plan will be required detailing location and species. No planting within the existing pipeline easement and proposed storm sewer pipe locations are allowed. Rare, Unique, or Significant Resources 13 An initial habitat assessment was conducted by MNR in September 2023 after which follow-up surveys for the 2024 field season were recommended. Accordingly, MNR completed surveys in May and July 2024 resulting in observations during the early and mid-growing seasons. In total six species of threatened or endangered species were found onsite and are listed in the table below: Species Classification Rubus fulleri Threatened Rubus semisetosus Threatened Trichophorum clintonii Threatened Viola lanceolata Threatened Rubus stipulates Endangered Carex pallescens Endangered A take permit application has been submitted to DNR for proposed impacts to onsite protected plant species. Opportunities for transplant of some species to the adjacent Wollan’s Park wetland bank with approval from the DNR. Stockpiling and using existing topsoil onsite will help preserve native plant communities and possibly extend the range of threatened species. Environmental Review Record As previously noted, in 2006 a mandatory Environmental Assessment Worksheet (EAW) was prepared for the original Natures Refuge concept because the proposed 278 housing units exceeded the 250 housing unit threshold. The EAW thoroughly analyzed potential impacts to wetlands, rare plant and animal species, floodplain, water quality, noise, traffic and archeology. It was determined the project did not have the potential for significant environmental effects and the Council passed Resolution No. 07-06 making a Negative Declaration on the Need for an EIS. The scope and size of the existing Natures Refuge and revised Natures Refuge North (152 housing units on 155 gross acres) is smaller than the original 2006 proposal (278 housing units on 232 gross acres). A revised EAW is not required because the 152 housing units do not exceed the 250 housing unit threshold. # Lots Acres Natures Refuge 60 95 Natures Refuge North 94 60 TOTAL 154 155 14 Wetlands Per the Wetland Delineation Report, sixteen (16) wetlands were delineated on site, totaling 7.17 acres. As shown within the Preliminary Plat: April 2025 Total Wetlands 7.17 acres Total Wetland Impacts 1.93 acres WMC Wetland Buffer (Ave. 50ft) 4.54 acres City Wetland Buffer (10ft min.) 0.64 acres For the 1.93 acres of wetland impact, the developer will need to obtain 2.43 acres of wetland replacement. Some of the delineated wetlands are in the Rice Creek Watershed District (RCWD) Wetland Management Corridor. Wetlands preserved on site will have to meet RCWD and City buffer requirements. Impacts will require mitigation and will be reviewed by RCWD. Floodplain There is no FEMA floodplain on site. Traffic Study A Traffic Impact Study was prepared by SSTS, dated October 15, 2024, and revised March 28, 2025. The study analyzed two design years: • Year 2027 to correspond to the year after completion of the Proposed Project with full construction of the original Nature’s Refuge site (61 single family homes) assumed. The following access scenarios are considered: o Two Access Scenario - Access at the existing Main St/Glenwood Dr intersection and access at a proposed Andall St connection. o Single Access Scenario – Access only via the existing Main St/Glenwood Dr intersection. • Year 2040 to correspond with a planning year horizon. In year 2040 the Pine Oaks Addition development, adjacent to the east side of the Proposed Project, is assumed to be developed. Two additional access points are considered, a northern connection to Pine St through the future Pine Oaks Addition and a connection of Haywood Dr to Wood 15 Duck Tr. Due to the feasibility concerns with the Andall St Access, access scenarios with and without the Andall St connection are considered. This study focuses on the roads and intersections that provide direct and indirect access to and from the site and details the existing and future roadway conditions at studied intersections and access points and includes traffic volumes, lane geometrics and traffic operational analysis results. The intersections reviewed included: • Main Street/Glenwood Drive • Main Street/Woodduck Trail • 4th Avenue/Andall Street • Andall St/Proposed Access The study results indicate there is little to no significant impact on the adjacent streets and intersections due to trips expected to be generated by the proposed development. Trip generation for the proposed development is estimated at 868 daily. Approximately 8% or 70 vehicles a day is expected to use the Andall Street connection. This is well within the capacity of Andall Street and Woodduck Trail based on the engineering review. Per City Code Section 1001.013(2)(c)4. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. Based on the study Level of service requirements are met for both the 2027 and 2040 Build Scenarios with LOS maintained at C or better. Homeowners Association A homeowner’s association will be established and provide both association maintained yards and snow removal. Staff is also recommending that the open space be owned by the association with the City retaining a Conservation Easement over the property. Additional City and Government Agency Review Comments Lino Lakes Public Safety The Police Division supports connection to Andall Street. The connection is important for public safety response to and from the development. 16 The Fire Division also supports the Andall Street connection to improve response times to the entire area. Environmental Board The Environmental Board reviewed the PUD and Preliminary Plat on March 26, 2025. Their comments are provided in the attached memo dated March 27, 2025. Park Board The Park Board reviewed the Preliminary Plat on April 2, 2025. The Board recommends cash fee in lieu of land dedication. The amount of cash dedication would be $329,000 ($3,500 per lot times 94 lots) minus the cost of trail construction. As discussed during concept plan review, the Park Board recommended designating the remaining cash dedication balances from Natures Refuge and Natures Refuge North to explore providing trails and leisure opportunities at Lino Lakes Elementary School. A collaborative arrangement with the Forest Lake School District to share resources could provide tremendous benefits for the students and general public. Planning and Zoning Board The Planning and Zoning Board held a public hearing on April 14, 2025. The board debated various aspects of the development resulting in two failed motions. The board approved a motion on a 5-1 vote to recommend approval with the conditions included in the staff recommendation, no flexibility from the garage requirements, and 24’ foot connection of the road for emergency access only. City Engineer The City Engineer provided comments in the attached memo. Developer responses received following the Planning and Zoning board have been included. PUD Public Benefit vs PUD Flexibility Summary Per City Code Section 1007.024: (2) The PUD, by allowing deviation from the strict provisions of this ordinance related to setbacks, heights, lot area, width and depths, yards, etc., may be considered by the City when it would result in one or more of the following public benefits: (a) Implementation of a master plan consistent with the Planning District objectives of the Comprehensive Plan. 17 The need for a formal master plan was not identified for this area in the 2040 Comprehensive Plan. The proposed development is consistent with the 2006 EAW concept plan for low density single family residential conservation development. (b) Innovations in development that address growing demands for all styles of economic expansion, greater variety in lot size, configuration, home type, design, enhanced architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. The applicant is proposing a conservation development. The villas provide a housing option with main-level living with association-maintain yards and snow removal which addresses life-cycle housing. (c) Preservation and enhancement of desirable site characteristics such as wildlife habitat, unique natural resources, existing vegetation, natural topography, geologic features and reduction of negative impacts on the environment. The conservation development preserves and enhances desirable site characteristics by minimizing wetland, woodland, and rare plant species impacts. (d) Creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. The revised plan shifts the villas to the east and creates a 160-390 buffer along the west lot line near the existing Arena Acres neighborhood. (e) Efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. The configuration of the lots preserves as many wetlands as possible and avoids a gas line easement that spans the site diagonally which results in a smaller network of utilities and streets. (f) Mix of land use types. There is no mix of land use types. (g) Provision of a housing type or target housing price that is desirable to the City. The villas provide a housing option with main-level living with association-maintain yards and snow removal which addresses life-cycle housing. 18 (h) Other public benefits and values as recognized in the City’s Comprehensive Plan. • Planning District 2 identifies Wollan Park as a natural resource that should be protected. The proposed development strategically includes a stormwater pond/open space buffer near the Wollan Park wetland complex. This is a critical link to protecting this sensitive natural resource area. • A goal of the sanitary sewer plan is to provide service and capacity to developed areas of the city currently served by on-site systems. RECOMMENDATION Staff is recommending that the City Council provide the following PUD flexibility for Natures Refuge North: 1. Reduced minor collector road right-of-way width from 80 feet to 60 feet on Haywood Drive (Street A). 19 2. Reduced corner lot width from 80 feet to 70 feet. 3. Reduced setback from street (corner lot) to 20 feet on long side of lot. 4. Side yard setbacks shall be 7.5 feet. 5. Unless 2nd floor living space extends over the garage, the maximum length of the garage wall facing the street shall not exceed 57% of the front façade subject to the following: a. Decorative garage doors with a strip of windows are required. b. Garage width in excess of two stalls will be recessed two feet from the main garage facade. c. Total garage width will not exceed 32 feet. 7. The maximum cul de sac length of Street D shall be 620 feet. The proposed plan includes 93 villa homes on an approximately 59.30-acre site. The original concept plan for this development was reviewed at by the City in late 2023, and a neighborhood meeting was held in February 2024. With feedback received from both city staff and officials as well as the neighborhood meeting, M/I Homes presented a revised concept plan, consistent with the proposed Preliminary Plat and PUD plan. This revised concept plan was reviewed by the Environmental Board, Planning Commission and City Council in late 2024. That revised concept plan and this proposed Preliminary Plat and PUD Plan accomplish the following: • Approximately 8.5 acres of open space adjacent to the Arena Acres neighborhood. o We revised the original concept plan to pull back lots from Arena Acres to the center of the development, increasing the buffer width from Arena Acres from 50 feet to 160-400 feet, and reduced the number of lots from 108 to 93 homes. • Approximately 34 acres of open space (58% of the site) and preserves natural features. o We provided 4 more acres of open space from the original concept plan. Providing this additional open space reduced the number of trees removed by 1,400. The site plan also takes care to avoid as many wetland impacts as possible. • A neighborhood plan and homes designed for empty nesters and seniors looking for single level living with association maintenance. PLANNED UNIT DEVELOPMENT We are requesting a PUD for this development to introduce a villa home option to the Natures Refuge neighborhood. Villa homes offer single level living and provide a low maintenance living option for older adults. Natures Refuge, to the south of this proposed neighborhood, has 80-foot-wide lots with traditional single-family homes. This neighborhood is proposed to introduce all 60-foot-wide villa lots with main-level living with association-maintained yards and snow removal. The City of Lino Lakes allows for development through a PUD if it results in public benefit as outlined in the City’s PUD ordinance. Nature Refuge North provides the following public benefits: • Addressing growing demands for all styles of economic expansion, greater variety in lot size, configuration, home type, design, enhanced architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. o The single level living provided by villa homes include association-maintained yards and snow removal and therefore are popular with our senior buyers who are looking for a low maintenance home. It is not financially feasible to offer association-maintained yards and snow removal in the current neighborhood given the size of the lots. o The configuration of the lots works to preserve as many wetlands and trees as possible, and avoids a gas line easement that spans the site diagonally. • Preservation and enhancement of desirable site characteristics such as wildlife habitat, unique natural resources, existing vegetation, natural topography, geologic features and reduction of negative impacts on the environment. As mentioned, the site design preserves over half the acreage in open space, which preserves as many wetlands and trees as possible. • Creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. o The development abuts rural lots, and smaller lots allow a significant buffer from the rural lots while continuing to meet density requirements. • Provision of a housing type that is desirable to the city. Natures Refuge North Preliminary Plat and Planned Unit Development Plan Submittal Page 2 o The villa target buyers are older adults who value low maintenance living. It is not viable for an association to maintain a larger lot. • Other public benefits and values as recognized in the city’s Comprehensive Plan. o The proposed development will provide a lift station that is able to serve homes in the Stage 1B Planned Service Area as outlined in the City’s Comprehensive Plan. We believe the general requirements for a PUD are met in the following ways: • Public or common open space to meet minimum requirements established in the ordinance. The site provides approximately 34 acres of open space. • If PUD includes preservation of natural habitat, those habitats shall be permanently protected through a conservation easement or other legally binding agreement. We have preserved approximately 58% open space within the site in order to preserve natural habitat. We are proposing to deed these outlots to the City as permanent open space to be preserved in perpetuity as public park. If the City elects not to accept the land as parkland, the HOA will own the land. Deed restrictions or restrictive covenants will preserve the land as open space. • Homeowners Association Required. The lots will be governed by a homeowner’s association (HOA) as further explained below. • Recreational open space or trail corridors intended as public parks or public trails shall be dedicated to the city or granted through an easement. o We intend to grant an easement over the public trails once built as was done in Natures Refuge. We will either dedicate the open space to the city or place deed restrictions over the lots. SITE PLAN There are four proposed street connections. One connecting from the south from Natures Refuge via Haywood Drive and connecting to future development to the north, one to the west to Arena Acres, and one to the east for future development. If the City desires, M/I Homes would be open to options to provide connections to Andall Street. The proposed development has a total of 93 60-foot-wide villa lots. The following table compares the proposed standards to the Two Family Residential (R-2) zoning district. The site is currently zoned Rural Executive (R-X). The garage shall then not protrude forward of the front porch. We are requesting this be waived but agree that the garage cannot protrude more than five feet forward the house (further explanation in the paragraph below). Garage Design The length of the garage wall facing the street shall not be greater than 50 percent of the length of the entire front façade of the structure for street-facing garage doors Garage walls shall not be greater than 58 percent of the length of the entire front façade (further explanation in the paragraph below). *This flexibility was granted for Natures Refuge. Haywood Drive from Natures Refuge was granted this flexibility, and the proposed development will extend Haywood Drive to the north. This flexibility is being requested for both Haywood Drive and Street A. **We will provide at least 15 feet between homes. The City currently allows a five-foot setback for garages and ten feet for homes, so this is generally consistent with R-2 zoning. GARAGE DESIGN STANDARDS In order to minimize impacts to trees, wetlands, and wildlife, we are proposing lot sizes consistent with the R-2 zoning standard with a lot width of 60 feet. R-2 zoning has different garage design requirements than the R- 1 zoning district and does not allow the length of the garage to be greater than 50 percent of the length of the entire front façade unless the second floor living space extends over the two-car portion of the garage; the garage doors are decorative and have a strip of windows; garages in excess of two stalls are broken up so the additional stalls are recessed two feet from the main garage stall; and garage width does not exceed 32 feet. We are proposing to be allowed garages that are up to 58 percent of the length of the entire façade. We agree to provide decorative garages with a strip of windows; not exceed two stalls or 32 feet in width; and to recess the garage doors two feet from the front of the garage. Some of our plans have living space above the garage, and we will provide a window above the garage where there is faux living space. This is further explained in the illustrations below. Because villas provide single-level living, we cannot provide the living space above the garage on all plans; we only have a few villa plans that are one and a half stories. We are also requesting that we be allowed some flexibility for some of our plans to have garages that protrude no more than five feet forward the house façade. The reason for these requests in flexibility is we cannot get to the 520 square foot garage size with meeting the design standards that are currently in place with single level living homes. In order to meet these requirements, we would need to make the house wider, and we cannot do that with the smaller lots we are proposing in order to conserve as much open space as possible. The planned density for this area is 1.6-3 units per acre. Netting out wetlands and wetland buffers, we are proposing a density of 1.98 units per acre, well below the maximum-allowed density. PUD flexibility and the R-2 zoning lot standards are necessary to meet the minimum density allowed in the City’s Comprehensive Plan and to minimize tree removal. It is not possible to meet the minimum density with 80-foot lots given the wetlands and their required buffers, as well as the gas line easement. With this site plan, 80-foot lots would yield 69 lots as shown in the Yield Plan Density Exhibit, which would result in a density of 1.41 units per acre, which is well below the minimum density planned for this area. Furthermore, these larger lots would result in greater tree removal. TREE PRESERVATION AND OPEN SPACE As mentioned above, we have designed our neighborhood plan to conserve as many trees as possible. Of the 6,494 trees on the site, we are saving 3,060 trees: almost 50%. We are proposing to preserve these trees in permanent open space to be dedicated to the City for public park, or as open space to be owned by the HOA. Given the extensive dedication of open space/park for permanent tree preservation, we are requesting that the City accept the land dedication and tree preservations areas or allow the space to be owned by the HOA and protected by a conservation easement and left natural in lieu of paying tree restitution. As part of this request, M/I Homes will agree to plant three trees per home for a total tree replacement of 279 trees. The Environmental Board, Planning Commission, and Council agreed during the revised concept plan review that this flexibility should be granted. We are proposing this for a number of reasons. First, the proposed plan preserves a little over 58% open space, conserving as many trees as possible. This is a heavily wooded site that is guided for a density of 1.6- 3 units per acre, and we are proposing a very low density, almost near the lowest density allowed. Additionally, almost 50% of the trees on site are Quaking Aspen, which do not survive long due to Cankers, which will kill the trees in 3-8 years. Finally, we have received extensive feedback from the residents of Arena Acres regarding the preservation of trees on this land. The dedication of public land would allow them to enjoy this land and the trees that are being preserved. If the City chooses not to accept the land dedication, an alternative option would be to place a deed restriction on the open space area prohibiting the removal of trees, and the land would be left in its natural state. The HOA would own the open space property. ELEVATIONS Example elevations of our villa product have been provided. These are just an example of the many elevations we offer. We also have anti-monotony requirements to ensure that very similar elevations are not adjacent to one another within the community to preserve visual interest. TIMING We plan to begin grading the site in late spring/early summer after approval of preliminary plat and other applicable agency approvals. We understand a grading-only development agreement will be required in order to accomplish this and therefore request that this agreement be reviewed concurrently with this Preliminary Plat and PUD application. Installation of utilities will occur when final plat has been approved and all conditions of final plat approval have been met. A phasing plan has been provided and is in draft form. The phasing plan will ensure that the lift station is up and running with the first phase of the development. The HOA will also provide lawn care and snow removal for villa lots. Additionally, restrictions will be placed on outdoor storage and parking (no boats, campers, or trailers) in order to keep the community looking orderly and well maintained. Responses Carlson Engineering 4/25/2025 Engineering • General The Natures Refuge North Addition is the second phase of the overall Natures Refuge development which includes 60 acres north of CSAH 14 (Main Street), west of CSAH 23 (Lake Street) and east of Wood Duck Trail. The project proposes 92 villa lots and associated infrastructure. This property was originally part of a larger development of which an Environmental Assessment Worksheet (EAW) was prepared. The evaluation concluded that the project did not have the potential for significant environmental effects. • Grading The Natures Refuge North Addition includes site grading for the 92 units as well as extensions of Haywood Drive and three local streets that are yet to be named. Comments: 1. Show EOF elevations , locations, and routes for all low points in the paved and green spaces. EOF’s have been added to all low points and ponds. a. C O M Ms. Katie Larsen 04/04/2025 Page 2 Nature Refuge North Addition Engineering Review • Stormwater Management Stormwater management for the Natures Refuge North Addition consists of storm sewer draining streets and yards, two sedimentation basins, and a large basin excavated for fill material. The stormwater systems shall meet the City’s and Rice Creek Watershed District’s (RCWD) Stormwater Management requirements. All proposed future public streets must meet City design standards. Existing and proposed discharge rates are summarized below. Outflow rates increase for all modeled storm events beyond what can be attributed to model accuracy. Further attempts at providing rate control must be made. For example, ditching flows from back yards to the inlets routing to BMPs, lowering the FES north of Wetland 50 to better route flows into Pond 500, or small rate-control basins at areas that cannot reasonably be routed into a BMP. a. If increases cannot be avoided, it must be demonstrated that they will not cause an adverse downstream impact. Flows have been adjusted and plans modified. 2. The SWMP water quality calculations show 0.90 acres of existing impervious, however the HydroCAD existing modeling has 3.57 acres of unconnected roof land cover. Please clarify these differences. Existing impervious adjusted within water quality calculations. 3. Please revise the Water Quality calculations in the SWMP as they do not match HydroCAD modeling. For instance, HydroCAD modeling shows 16.86 total acres and 7.52 acres of impervious routed to Pond 600, but the SWMP has a total area of 9.77 acres and 0.196 acres of impervious. Water quality calculation updated. 4. NURP criteria specify a maximum depth of 10’. Pond 500 has a depth of 11’, raising the bottom elevation to 10’ will bring it into NURP compliance and still keep the majority of its dead volume. Pond 500 has been revised to a depth of 10’ 5. Per new RCWD standards, any new impervious flowing to a pond designed in accordance with NURP criteria counts as full water quality treatment, therefore the full volume credit can be claimed for new impervious flowing to Pond 500 and 600 if properly designed. Water quality revised. 6. Pond 300 should be renamed to Lake 300 as its depth is well in excess of the 10’ max depth outlined in NURP criteria. Additionally, it cannot be counted as providing water quality treatment. Note has been revised. 7. Please clarify why drainage area 26S is modeled. It is offsite and has no change from existing to proposed conditions. 26S was modeled assuming the Street B connection to Andall may occur. We are assuming the new street will have ribbon curb and there will be no drainage increase to 26 (for now) 8. The 2.5” event should be modeled in HydroCAD to determine runoff volumes needed for pond dead storage. Ms. Katie Larsen 04/04/2025 Page 3 Nature Refuge North Addition Engineering Review The 2.5” event is calculated within our pond spreadsheet which gives us our required dead storage through calculations within this spreadsheet. 9. As many wetlands receiving runoff are Type 1, they are classified as highly susceptible and therefore must have no increase in bounce or inundation period for the 2- and 10-year events. Kjolhaug environmental reviewed the wetland susceptibility and all wetlands were adjusted. No wetlands are considered highly susceptible. 10. Detailed storm sewer plans, profiles, and calculations will be needed in future submittals. This should include all utility crossings to confirm constructability and any need for insulation. It should also include structure type and sizing to confirm constructability with pipe alignments. It is likely that more storm sewer design comments will be generated at that time. The plan and profiles will be provided with final plans. Design spreadsheet and structure map provided until final plans are made. a. The pipe run from FES to 503 as shown has a velocity under the minimum of 3 ft/s. FES removed as it does not provide a benefit. No surface water can be directed towards pond 500 in this location. 11. All proposed storm sewer serving public roads must be a minimum 15” diameter and consist of RCP. Noted. 12. Inlet spread and run calculations, especially at sag points, will be needed to confirm public roads are designed in accordance with City standards of maintaining an 8’ drivable lane during the 3-year storm event. Spread calcs added – based on 3-year event. 13. Erosion control blankets must be shown on slopes 4:1 and steeper, such as around proposed basins. Erosion control blanket added where necessary. • Water Supply The development will include a water system with 8 to 16 inch diameter ductile iron pipe (DIP) water main with 1-inch Type K copper services being extended to each lot. Additional sanitary sewer stubs will be extended to the north, and east. A lift station is proposed to serve the development and future sewer districts to the east in conformance with the City’s Comprehensive Plan. Comments: 1. Connect to existing 10" PVC SDR 35 sanitary sewer main a. Match existing slope Note added. Existing invert and slope based on proposed stub elevation from Natures Refuge. 2. [Lift Station] a. The lift station can be raised by 2 feet. Per discussion, the lift station was raised 4-feet. b. Projected peak hourly flow from 228 residential units is about 120 gpm, so 8” sewers shown are sufficient. Noted. i. Forcemain will be 4”. Noted. c. Deep 35’ build at the lift station, but looks like it’s needed to serve the northeast corner by gravity. Noted. i. Looks like about 50’ radius around wet well for excavation during construction, hopefully enough unless Geotech requires shallower embankment. Noted. Assuming sandy soils – 1:1 minimum will be needed. Easement does cover a 50’ radius from the center of lift station. Future maintenance should be covered. Sheet piling or trench box should cover any embankment issues along the street side if for some reason the lift station needed to be repaired. d. Can the 12’ build at the northwest corner serve the street extending north outside the service area if desired? No. Currently it does not. Please advise if this sanitary line needs to service the area to the north. 3. Insulate all sewer with less than 7' cover a. Consider lowering the watermain to limit conflicts between services and mains Watermain will be lowered as-needed for service conflicts – this will be shown with final plans. • Transportation The proposed development will have a primary access from Haywood and Glenwood Drives. Which is the shortest route out the proposed neighborhood. The City also requires a connection to Andall St. to the existing Arena Acers Development. The City has an existing right of way to provide access to the easterly property. Per the traffic study the connection to Andall St will receive minimal traffic, however it will provide connectivity for public safety and the neighborhoods it serves. This connection is in conformance with the City’s Ordinances for adjoining adjacent subdivision for reasonable circulation of traffic. The City of Lino Lakes’ Comprehensive Plan requires neighborhood street connections for reduced travel times and linking neighborhoods together. The City’s Engineering and Public Safety departments submit that the roadway connection to Andall Street shall be constructed as detailed below. Trails and sidewalks Ms. Katie Larsen 04/04/2025 Page 5 Nature Refuge North Addition Engineering Review A trail is proposed extending from the south end of the development at the connection with Natures Refuge, to the north end of the development and branching west to one of the new streets. Reference the City Planner’s report for trail and sidewalk detail. Comments: 1. There is little to no significant impact on the adjacent streets and intersections due to the trips expected to be generated by the proposed development. Noted. 2. There is no difference in operations with or without the Andall Street access. The benefits of connecting the development to Andall Street are: a) Improving Fire and Life Safety response to both neighborhoods (providing additional means of access). b) Connectivity of neighborhoods which generally results in a reduction of overall vehicle miles traveled. c) Provides access for the existing neighborhood to sidewalks and trail system. Also, can provide a safer route to/from the school with almost no need to walk/bike on CSAH 14. Noted. Street added. 3. It may be beneficial to look into providing a trail extension from the school to Basswood to provide a non-motorized connection to the school completely independent from CSAH 14. Noted. 4. The CSAH 14/Wood Duck intersection is expected to operate acceptably during full- build scenarios. In the future the City should consider working with Anoka County to providing exclusive left-turn lanes on CSAH 14. Noted. 5. Andall Street should be constructed as a 24 foot wide roadway within the cleared path from the watermain / fire hydrant extension to the Arena Acres Development. BACKGROUND Ramsey County is preparing to solicit bids and award a contract for the improvements for I- 35E/CR J interchange improvements. The overall project cost is estimated at $23,761,410.60. Federal funds are available for the Project and are capped at $19,000,000.00. The City’s share of the proposed improvements is $318,509.60. This includes pro rata share of right-of-way, drainage, utility and roadway improvements. The City’s share is funded primarily from Municipal State Aid Street funds with a small portion of funding from the Area and Unit Trunk Utility funds. Area and Unit funds will be reimbursed from developer fees charged with development of the northwest quadrant of the Centerville Road/CRJ intersection. The City will be entering into the agreement with Anoka County. Anoka County and Ramsey County will have a master agreement in place covering the overall project costs. Under the terms of the agreement the City is responsible for maintenance of the storm water pond in the NE quadrant of Centerville Road/CRJ intersection, the cost of which is split between City and Ramsey County based on contributing area. Lino Lakes will also be responsible for the trail on the west side of Centerville Road along with the crosswalk pavement markings on City streets, if applicable. The City will be responsible for maintenance of Centerville Road/CRJ roundabout 2 (RAB) maintenance. The ramp RAB’s will be maintained by MnDOT. Staff is meeting with Anoka County to discuss responsibilities and electricity costs for street lighting. Any changes will be presented at the Council meeting. Landscaping improvements to the Centerville/CRJ roundabout are in addition to these costs. That portion of the project will likely be bid in 2026. Stat. § 471.59 authorizes political subdivisions of the state to enter into joint powers agreements for the joint exercise of powers common to each. SP 062-601-017 and SP 062-659-020 Anoka County Project Nos. SP 002-621-012, SP 002-654-005 and SP 210-020-015 THIS AGREEMENT is made by the parties on the last date executed below, by and between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue, Anoka, Minnesota 55303, hereinafter referred to as "County", and the City of Lino Lakes, 600 Town Center Parkway, Lino Lakes, MN 55014, hereinafter referred to as "City". WITNESSETH WHEREAS, the parties to this agreement agree it is in the best interest of the traveling public to reconstruct CSAH 21 (Centerville Road), CSAH 54 (20th Ave S) and CR 84 (Otter Lake Road) as part of the County Road J and I-35E interchange project led by Ramsey County and, WHEREAS, said parties mutually agree that CSAH 21, CSAH 54 and CR 84 are in need of reconstruction; and, WHEREAS, Ramsey County as the lead agency of the County Road J and I-35Interchange project has prepared preliminary design plans for the reconstruction of CSAH 21 (Centerville Road), CSAH 54 (20th Avenue S.) and CR84 (Otter Lake Road) in accordance with Anoka County and the Minnesota Department of Transportation standards to a staff approved layout condition; and, WHEREAS, Anoka County has jurisdiction over CSAH 21 (Centerville Road), CSAH 54 (20th Avenue S.) and CR86 (Otter Lake Road) and, WHEREAS, the parties agree that it is in their best interest that the cost of said project be shared; and, WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the state to enter into joint powers agreements for the joint exercise of powers common to each. NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: I. PURPOSE The parties have joined together for the purpose of reconstructing the roadway, drainage and trail as well as other utilities for County Road J (Ramsey County State Aid Highway 1) from Centerville Road (Ramsey County State Aid Highway 51/Anoka County State Aid Highway 21) to Otter Lake Road (Ramsey County State Aid Highway 60/Anoka County Road 84) including the I-35E interchange and intersection of County Road J (Ramsey County State Aid Highway 1) and 20th Avenue South (Anoka Anoka County Contract No. C00011514 2 County State Aid Highway 54). The Minnesota Department of Transportation (MnDOT) state project numbers are SP 6281-53 and SP 0282-47; the Ramsey County project numbers are SP 062-601-017, SP 062-659-020; the Anoka County project numbers are SP 002-621-012, SP 002-654-005 and the Lino Lakes project number is SP 210-020-015 (collectively the “Project”). Said engineering plans are filed in the office of the Ramsey County Public Works Department and Anoka County Highway Department and incorporated herein by reference. The parties to this Joint Powers Agreement (JPA) agree in principle that the Project is in the best interest of the traveling public and that the Construction Plan Title Sheet as shown in Exhibit "A" defines the final design of the Project. All Exhibits attached to or referred to in this JPA are incorporated by reference and made part of this Agreement. II. METHOD Ramsey County as lead agency for the project shall cause the construction of State Project number SP 6281-53 and SP 0282-47 Anoka County Project CP21-15-00, SP 002-621-012, SP 002-654-005, Ramsey County Project SP 062-601-017 and 062-659-020 and City project number SP 210-020-015. IMPROVEMENTS: It is agreed by the parties that in 2025/2026, County Road J will be reconstructed from Centerville Road (Anoka County State Aid Highway 21, Ramsey County State Aid Highway 59) to Otter Lake Road (Ramsey County State Aid Highway 60/Anoka County Road 84)including the I-35E interchange and intersection of County Road J (Ramsey County State Aid Highway 1) and 20th Avenue South (Anoka County State Aid Highway 54), as shown in "Exhibit A". Improvements include, but are not limited to: roadway widening, roundabout construction, bridge construction, concrete median, storm sewer and associated ponding, turn lanes, shoulders, lighting, bituminous trails, retaining walls and concrete curb & gutter. . INTERSECTIONS: As agreed by the parties, improvements to the following intersections have been incorporated in the Exhibit "A" design: Ramsey County State Aid Highway 1 / Anoka County State Aid Highway 60 / Anoka County Road 84 / I-35E east ramps: Roundabout Ramsey County State Aid Highway 1 / Anoka County State Aid Highway 54 / I-35E west ramps: Roundabout Ramsey County State Aid Highway 1 / Ramsey County State Aid Highway 59 / Anoka County State Aid Highway 21 /: Roundabout RIGHT OF WAY: The parties agree that the County will acquire all necessary right-of-way and easements for the Project. Acquisition of any additional right-of-way and/or easements needed for improvements to the city street Anoka County Contract No. C00011514 3 intersections beyond what is defined in the Exhibit “A” Layout will be the responsibility of the city. It is agreed by the parties that all necessary right of way and easements will be in legal possession of the County lead agency prior to acceptance of bids for the project. Any City owned property or easements required for the construction will be conveyed to the County at no cost. DRAINAGE: The City shall pay for a percentage of the cost of the storm sewer system, including the detention basins and their outlet structures. The city portion of the cost is based on contributing flow through the storm sewer system to the detention basin determined by contributing area. The City of Lino Lakes shall pay Anoka County for a portion of the costs of the areas in the properties acquired by Anoka County specifically for ponding for the project, the costs will be determined based on contributing flows at the following percentages for the Centerville Pond Property. Contributing Flow Percentage: Anoka County 40%, Lino Lakes 7%, Ramsey County 53% Anoka County: $126,829.18 Lino Lakes: $22,195.11 Ramsey County: $168,048.66 SIDEWALK: The parties agree that the construction of the sidewalk along the west side of Centerville Road (CSAH 21) and within the Roundabout in the Anoka County side of the intersection is eligible for federal funds and that the City will be responsible for the local match in areas where no sidewalk exists, and the County will be responsible for the local match where a sidewalk currently exists. This sidewalk location has been agreed to by the city. The parties understand that the cost for the sidewalk includes concrete surfacing, aggregate base, excavation (including muck excavation), borrow material (granular and topsoil), and turf establishment. TRAFFIC CONTROL: The parties understand and agree that portions of CSAH 21 will be closed to thru traffic during construction. The parties agree and understand the cost share for traffic control for the city shall be a prorated share based on the city project cost divided by the total project cost. III. COSTS The contract costs of the work, or if the work is not contracted, the cost of all labor, materials, normal engineering costs and equipment rental required to complete the work, shall constitute the “actual construction costs" and shall be so referred to herein. "Estimated construction costs" are good faith projections of the costs, which will be incurred for this project. Actual costs will vary and those will be the costs for which the relevant parties will be responsible. The estimated construction cost of the total project is $23,761,410.60. Anoka County Contract No. C00011514 4 Federal funds available for the Project are capped at $19,000,000.00. The federal funds shall be split based on the ratio of eligible cost incurred by each party to the total eligible project cost. Eligible costs are the costs of items that can participate in federal funding as shown on Exhibit B. Any overruns in quantities beyond the federal funds will be charged to the local entities who are contributing to that portion of the project. After federal funding percentage is applied, the cost to the city for their share of the construction items of the Project is $274,365.27 The City participation in construction engineering will be at a rate of eight percent (8%) of their designated construction share of $274,365.27. The estimated cost to the City for construction engineering is $21,949,22. The total construction cost to the city after federal funds have been applied including construction engineering is $296,314.49 In summary, the total Lino Lakes Cost share of this project is $318,509.60 (Includes construction and Lino Lakes contribution for ponding properties in Anoka County) Upon award of the contract, the City shall pay to the County, upon written demand by the County, ninety five percent (95%) of its portion of the cost of the project estimated at $302,584.12 Prior to billing, this estimate will be updated by the County to reflect the actual bid prices as awarded. An updated cost estimate shall be provided to the City at the time of billing. The City's share of the cost of the project shall include only construction and construction engineering expense and does not include engineering design and administrative expenses incurred by the County. After final completion of the project, the City's share of the construction cost will be based upon actual construction costs. If necessary, adjustments to the initial ninety five percent (95%) charged will be made in the form of credit or additional charges to the City's share. Also, the remaining five percent (5%) of the City's portion of the construction costs shall be paid at that time. The County agrees to submit to the city for review final quantities and cost within one year of project substantial completion. IV. TERM / TERMINATION This Agreement shall become effective immediately upon execution and will remain in effect until the Project and all restoration activities are completed, with exception of the ownership and maintenance provisions within this Agreement which shall continue indefinitely. V. DISBURSEMENT OF FUNDS All funds disbursed by the County or City pursuant to this Agreement shall be disbursed by each entity pursuant to the method provided by law. VI. CONTRACTS AND PURCHASES All contracts let and purchases made pursuant to this Agreement shall be made by the County in conformance to the State laws. Anoka County Contract No. C00011514 5 VII. STRICT ACCOUNTABILITY A strict accounting shall be made of all funds and report of all receipts and shall be made upon request by either party. Prior to city payment to the County, Anoka County shall provide the City a copy of all cost participation documents submitted to MnDOT State Aid to assist the city in their application for MSA funding. IX. MAINTENANCE A. Maintenance of the completed watermain, sanitary sewer, storm sewer (except catch basins and catch basin leads), and detention basins (including ponds and their outlet structures and grit chambers/collectors) shall be the sole obligation of the City. a. The City shall maintain the components of the storm sewer system. b. The cost for maintenance of trunk line outfalls and BMPs shall be distributed as follows: Centerville Wet Pond, City of Lino Lakes 47 %, Ramsey County 53 %, MnDOT 0%. c. The City of Lino Lakes shall notify Anoka County and Ramsey County of upcoming maintenance one year in advance to allow for proper notice and budgeting to Ramsey County. d. Within 30 days of completion of the maintenance, submit invoices to Ramsey County setting forth the share of the maintenance expense. Which invoice shall be paid within 30 days of submission. B. Maintenance of the bituminous trail on the west side of CSAH 21 shall be the responsibility of the City. The City shall be responsible for general routine maintenance, such as sweeping, clearing, plowing, trash removal and other incidental items. C. Maintenance of crosswalk pavement markings shall be the responsibility of the City and the County. The County will be responsible for the maintenance of the crosswalk pavement marking for the crossings at the Roundabout intersections. The City will be responsible for all crosswalk pavement markings for any trail/sidewalk crossings at all city streets. D. Maintenance of streetlights, including Roundabout lights and cost of electrical power to the streetlights shall be the sole obligation of the City. The City will be responsible for long-term maintenance and replacement of the complete street light system including items such as: poles, fixtures, luminaires, and control cabinets. E. The City shall be responsible for the maintenance and up-keep of the center islands located within the roundabout(s). X. NOTICE For purposes of delivery of any notices herein, the notice shall be effective if delivered to the County Administrator of Anoka County, 2100 Third Avenue, Anoka, Minnesota 55303, on behalf of the County, and to the City Administrator of Lino Lakes, 600 Town Center Parkway, Lino Lakes, MN 55014, on behalf of the City. INDEMNIFICATION The City and County mutually agree to indemnify and hold harmless each other from any claims, losses, costs, expenses or damages resulting from the acts or omissions of the respective officers, agents, or employees relating to activities conducted by either party under this Agreement. XII. ENTIRE AGREEMENT REQUIREMENT OF A WRITING It is understood and agreed that the entire agreement of the parties is contained herein and that this Agreement supersedes all oral agreements and all negotiations between the parties relating to the subject matter thereof, as well as any previous agreement presently in effect between the parties to the subject matter thereof. Any alterations, variations, or modifications of the provisions of this Agreement shall be valid only when they have been reduced to writing and duly signed by the parties. XIII. COUNTERPARTS This Agreement may be executed in any number of counterparts, each one of which shall be deemed to be an original, but all such counterparts together shall constitute one and the same instrument. This provision may be waived by agreement with the County Board if the roadway replaces an existing alignment and the local unit of government takes jurisdiction of that existing alignment. In addition, any costs, including right-of-way costs, incurred by the County because a Township or City did not acquire sufficient right-of-way during the platting process or redevelopment process as requested by the County shall be paid by the Township or City. *5 Notification includes any letter to the agency indicating that noise will potentially be an issue in the future, likely received during the Plat Review Process.
