RESOLUTION NO. 25-61
APPROVING PUD PRELIMINARY PLAN AND PRELIMINARY PLAT FOR
NATURES REFUGE NORTH
WHEREAS, the City received an application for PUD Preliminary Plan and Preliminary
Plat for Natures Refuge North, hereinafter referred to as "Development", and
WHEREAS, City staff has completed a review of the Development based on the following:
1. Narrative prepared by M/I Homes of Minneapolis/St. Paul dated April 22, 2025
2. Preliminary Plat and Civil Plans prepared by Carlson McCain dated April 25, 2025
3. Land Use Plan prepared by Carlson McCain dated March 4, 2025
4. Sanitary Sewer Exhibit prepared by Carlson McCain dated March 4, 2025
5. Net Area Exhibit prepared by Carlson McCain dated March 4, 2025
6. Phasing Plan prepared by Carlson McCain dated March 4, 2025
7. Surface Water Area Exhibit prepared by Carlson McCain dated March 4, 2025
8. Ghost Plat unnamed and undated
9. Traffic Study, prepared by SSTS, dated 10/15/2024, and revised 03/28/2025.
WHEREAS, a public hearing was held before the Planning & Zoning Board on April 9, 2025,
and the board recommended approval of the Development with conditions,
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that
FINDINGS OF FACT
PUD, Planned Unit Development
Per City Code Section 1007.024(1) the purpose of a PUD is to provide a district that grants
flexibility from certain zoning regulations in order to achieve public benefits that may not
otherwise be obtained under standard zoning regulations.
(2) The PUD, by allowing deviation from the strict provisions of this ordinance related to
setbacks, heights, lot area, width and depths, yards, etc., may be considered by the City when it
would result in one or more of the following public benefits:
(a) Implementation of a master plan consistent with the Planning District objectives of
the Comprehensive Plan.
The need for a formal master plan was not identified for this area in the 2040 Comprehensive
Plan. The proposed development is consistent with the 2006 EA IN concept plan for low density
single family residential conservation development.
(b) Innovations in development that address growing demands for all styles of
economic expansion, greater variety in lot size, configuration, home type, design, enhanced
architectural standards, and siting of structures through the conservation and more efficient use
of land in such developments.
The applicant is proposing a conservation development. The villas provide a housing option with
main -level living with association -maintain yards and snow removal which addresses life -cycle
housing. The project will include enhanced architectural design requirements and an anti -
monotony code.
(c) Preservation and enhancement of desirable site characteristics such as wildlife
habitat, unique natural resources, existing vegetation, natural topography, geologic features and
reduction of negative impacts on the environment.
The conservation development preserves and enhances desirable site characteristics by
minimizing wetland, woodland, and rare plant species impacts. The site will include
approximately 34 acres of open space preserved in a conservation easement.
(d) Creative use of land and related physical development which allows a phased and
orderly transition of varying land uses in close proximity to each other.
The revised plan shifts the villas to the east and creates a 160-390 buffer along the west lot line
near the existing Arena Acres neighborhood.
(e) Efficient use of land resulting in smaller networl<s of utilities and streets thereby
lowering development costs and public investments.
The configuration of the lots preserves open space and as many wetlands as possible and avoids
a gas line easement that spans the site diagonally which results in a smaller network of utilities
and streets.
(f) Mix of land use types.
There is no mix of land use types.
(g) Provision of a housing type or target housing price that is desirable to the City.

The villas provide a housing option with main -level living with association -maintain yards and
snow removal which addresses life -cycle housing.
(h) Other public benefits and values as recognized in the City's Comprehensive Plan.
• Planning District 2 identifies Wollan Park as a natural resource that should be protected.
The proposed development strategically includes a stormwater pond/open space buffer
near the Wollan Park wetland complex. This is a critical link to protecting this sensitive
natural resource area.
• A goal of the sanitary sewer plan is to provide service and capacity to developed areas of
the city currently served by on -site systems. Municipal sanitary sewer and water also
gets extended north which will eventually serve the Olive and Orange Street
neighborhood which are smaller (<0.5 acre) lots on private septic systems and wells.
• A goal of the Parks, Greenways & Trails Plan is to establish greenway corridors. A multi-
functional greenway corridor incorporating stormwater management, trails and open
space is established with the development.
• The project will include a stormwater reuse irrigation system reducing demand on the
City"s water supply system.
Preliminary Plat
Per Section 1001.013, Premature Subdivision:
(1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to
the following criteria shall be denied by the City Council.
(2) Conditions for establishing a premature subdivision. A subdivision maybe deemed
premature should any of the following conditions not be met.
(a) Consistency with the Comprehensive Plan. Including any of the following:
1. Land use plan;
2. Transportation plan;
3. Utility (sewer and water) plans;
4. Local water management plan;
5. Capital improvement plan; and
6. Growth management policies, including MUSA allocation criteria.
Natures Refuge North is consistent with the goals and policies of the comprehensive
plan in regards to resource management, land use, housing, transportation and utilities. The
development is also consistent with the local water management plan; capital improvement
plans and growth management policies.
(b) Consistency with infill policies. A proposed urban subdivision shall meet the city's infill
policies.
Natures Refuge North is consistent with infill policies. The development is within the
current Utility Staging Area 1A (2008-2015) and 18 (2025 — 2030). The cost, operation and
maintenance of the utility system is consistent with the normal costs projected by the water
and sanitary system plans. No future utility costs are proposed.
(c) Roads or highways to serve the subdivision. A proposed subdivision shall meet the
requirements for level of service (LOS), as defined by the Highway Capacity Manual.
The Traffic Study indicates that there are little to no significant impacts on the adjacent
streets and intersections. Level of service requirements are met for both the 2027 and 2040
Build Scenarios with LOS maintained at C or better.
(d) Watersupply. A proposed subdivision shall be deemed to have an adequate water
supply.
Natures Refuge North will have an adequate water supply. A 12" trunk watermain
located along CSAH 14 (Main Street) serves the site. The project will include a stormwater
reuse irrigation system significantly reducing demand on the municipal system.
(e) Waste disposal systems. A proposed subdivision shall be served with adequate waste
disposal systems.
Natures Refuge North will be served with an adequate waste disposal system. A 21"
trunk sanitary sewer main located along CSAH 14 (Main Street) serves the site. A sanitary sewer
lift station will be installed along Haywood Street providing service to the Development and
adjacent properties to the northeast.
BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby provides the
following PUD, Planned Unit Development flexibility for Natures Refuge North:
1. Reduced minor collector road right-of-way width from 80 feet to 60 feet on Haywood
Drive (Street A).
2. Reduced corner lot width from 80 feet to 70 feet.
3. Reduced setback from street (corner lot) to 20 feet on long side of lot.
4. Side yard setbacks shall be 7.5 feet.
5. Garage shall be allowed to protrude forward of the house, without front porch, a
distance of no more than Y) subject to conformance with an anti -monotony plan that

prohibits houses with protruding garages to be placed directly adjacent to or across
from one another.
6. Unless 2nd floor living space extends over the garage, the maximum length of the garage
wall facing the street shall not exceed 57% of the front facade subject to the following:
(a) Decorative garage doors with a strip of windows are required.
(b) Garage width in excess of two stalls will be recessed two feet from the main garage
facade.
(c) Total garage width will not exceed 32 feet.
7. The maximum cul de sac length of Street D shall be 620 feet.
8. Tree preservation requirements offset by the following:
a. Developer shall grant the City a Conservation Easement Over Outlots A,B,C, & D
b. Developer will plant 3 trees per lot (292) in addition to open space plantings
around storm water management areas.
BE IT FURTHER RESOLVED by The City Council of The City of Lino Lakes hereby approves the
PUD Preliminary Plan and Preliminary Plat for Natures Refuge North subject to the following
conditions:
That Street B connect to Andall Street with a minimum width of 24' subject to the
following:
a. The street will be constructed following approval of the 2nd Addition Final Plat,
except for grading and clearing and grubbing activities which may commence
with the initial development phase.
b. Construction limits shall be determined, and a tree preservation plan shall be
submitted for review and approval by City prior to clearing and grubbing
activities on Outlot A, Arena Acres.
c. Street will be limited to emergency vehicles only.
d. Developer shall provide a planting plan for boulevard trees and shrubs for that
portion of Street A within Outlot B, Arena Acres, where appropriate based on
remaining tree canopy. Plan will be reviewed and approved by Environmental
Coordinator.
2. Proposed open space areas should remain in the ownership of the HOA with a
conservation easement granted to the City. Wetland buffers shall be provided around
wetlands as required by RCWD.
3. Outlot E meets the R-2 lot size requirements and should be converted into Lot 11, Block
7 on the preliminary plat or combined with Outlot B.
4. Trail corridors shall be a minimum of 30' wide. A separate easement agreement shall
be provided for trail corridors.
5. Sidewalks shall be provided on Street B and Street D. The point of termination on Street
D will be determined by City Engineer.
6. Cash fee in lieu of land dedication in the amount of $329,000 minus the cost of trail
construction.
7. Compliance with the City Engineer Memo dated April 4, 2025

8. Compliance with the Environmental Memo dated March 27, 2025
9. A stormwater reuse irrigation system is required.
10. Draft homeowner's association documents shall be submitted with the final plat
application.
