HomeMy WebLinkAbout25-168 - Resolution - Waldoch Farm Agritourism CUPCITY OF LINO LAKES RESOLUTION NO. 25-168 APPROVING WALDOCH FARM AGRITOURISM CONDITIONAL USE PERMIT AMENDMENT (8174 LAKE DRIVE) WHEREAS, the City received a land use application for a conditional use permit amendment for agritourism ("Development"); and WHEREAS, the November 12, 2025 Planning & Zoning Board Staff Report and the December 8, 2025 Council Staff Report provide supporting narrative and documentation for the Development; and WHEREAS, the property is zoned R, Rural and allows for agritourism with an approved conditional use permit; and WHEREAS, the legal description of the property is described as follows: • PID #04-31-22-31-0003: o S 175 FT OF N 525 FT OF LOT 12 AUDITORS SUBDIVISION NO 138; and • PID #04-31-22-31-0004: o THAT PRT OF LOT 12 AUDITORS SUBDIVISION NO 138 LYG S OF N 525 FT THEREOF; and • PID #04-31-22-34-0001: o ELY 880 EX SLY 425 FT OF ELY 200 FT THEREOF LOT 19 AUDITORS SUBDIVISION NO 138; and • PID #04-31-22-42-0001: o THE N1/2 OF SE1/4 OF SEC 4 TWP 31 RGE 22, EX N1/2 OF N1/2 OF NE1/4 OF SD SE1/4, EX RD, SUBJ TO EASE OF REC; and • PID # 04-31-22-43-0001: o THE SW1/4 OF SE1/4 OF SEC 4 TWP 31 RGE 22, EX SW1/4 OF SD 1/4 1/4, EX RD, SUBJ TO EASE OF REC • PID# 04-31-22-43-0002: o THE SW1/4 OF SW1/4 OF SE1/4 OF SEC 4 TWP 31 RGE 22, EX RD, SUBJ TO EASE OF REC • PID# 04-31-22-44-0002: o W 10 ACRES OF SE1/4 OF SE1/4 OF SEC 4 TWP 31 RGE 22, EX S 330 FT THEREOF, EX RD SUBJ TO EASE OF REC WHEREAS, City staff has completed a review of the land use application based on the following plans: • Aerial Map and Site Plan • Applicant Narrative • Public Spaces Site Location Map • Chapter 1306 Department of Labor and Industry Special Fire Protection Systems; and WHEREAS, the Planning & Zoning Board held a public hearing on November 12, 2025 and the Board recommended approval of a conditional use permit amendment for agritourism. NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that: FINDINGS OF FACT Per City Code Section 1007.016(3): (e) The Planning and Zoning Board shall hold the public hearing and consider possible adverse effects of the proposed conditional use. Its judgement shall be based upon, but not limited to, the following factors: 1. The proposed development application has been found to be consistent with the design standards listed in § 1007.020(4). See below for design standard requirements. 2. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. The Waldoch Farm agritourism conditional use permit amendment will not involve activities detrimental to any person, property, or the general welfare. 3. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. The Waldoch Farm agritourism conditional use permit amendment will not result in the destruction of a natural, scenic, or historic feature of major importance. Per City Code Section 1007.020: (4) Performance Standards. Plans which fail to meet the following criteria shall not be approved. (a) The proposed development application must be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan. The WGIdoch Form agritourism conditional use permit amendment is consistent with the policies and recommendations of Comprehensive Plan and commercial land use. (b) The proposed development application is compatible with present and future land uses of the area. The Waldoch Farm agritourism conditional use permit amendment is compatible with present and future land uses of the area. (c) The proposed development application conforms to performance standards herein and other applicable City Codes. The Waldoch Farm agritourism conditional use permit amendment conforms to City Code performance standards. (d) Traffic generated by a proposed development application is within the capabilities of the City when: 1. If the existing level of service (LOS) outside of the proposed development is A or B, traffic generated by a proposed development will not degrade the level of service more than one grade. 2. If the existing LOS outside of the proposed development is C, traffic generated by a proposed development will not degrade the level of service below C. 3. If the existing LOS outside of the proposed development is D, traffic generated by a proposed development will not degrade the level of service below D. 4. The existing LOS must be D or better for all streets and intersections providing access to the proposed development. If the existing level of service is E or F, the developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 5. Existing roads and intersections providing access to the proposed development must have the structural capacity to accommodate projected traffic from the proposed development or the developer will pay to correct any structural deficiencies. 6. The traffic generated from a proposed development shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer -financed improvements to correct any street deficiencies. 7. The LOS requirements in paragraphs 1. to 4. above do not apply to the I- 35W/Lake Drive or 1-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the proposed development project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange. The Waldoch Farm agritourism conditional use permit amendment meets Level of Service (LOS) requirements. The existing roads and intersections providing access to the proposed development have the structural capacity to accommodate projected traffic from the proposed development. The traffic generated from a proposed development does not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. (e) The proposed development shall be served with adequate and safe water supply. The Waldoch Farm agritourism conditional use permit amendment will have an adequate and safe water supply. (f) The proposed development shall be served with an adequate or safe sanitary sewer system. The Waldoch Farm agritourism conditional use permit amendment will be served with an adequate waste disposal system. (g) The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. The Waldoch Farm agritourism conditional use permit amendment does not require City funds. (h) Fire prevention and fighting equipment acceptable to the Board of Fire Underwriters and City Council shall be readily available when any activity involving the handling or storage of flammable or explosive materials is carried on. The Waldoch Farm agritourism conditional use permit amendment will have fire prevention and fighting equipment readily available. BE IT FURTHER RESOLVED the following specific performance standards of City Code Section 1007.067 have also been met: (4) The site shall comply with the following requirements: (a) Minimum lot area often acres. The site area is over 160 acres. (b) All uses permitted by this section shall have at least one primary access onto a collector street as identified on the functional classification map with the condition that the increase in traffic shall not create a nuisance, to nearby residents by way of traffic or noise or increase the public cost in maintaining the street. The primary access is onto CSAH 23 (Lake Drive) which is an A -Minor Arterial Reliever street. (c) All structure, parking area, and agritourism related activity setbacks shall be 50 feet from any side or rear lot line. Drive aisle setbacks shall be 20 feet to any side or rear lot line. All structures, parking areas, and agritourism related activities are and shall remain 50+ft from any side or rear lot line. Drive aisles are and shall remain at least 20ft from any side or rear lot line. BE IT FURTHER RESOLVED the conditional use permit amendment for agritourism is approved subject to the following conditions: 1. All existing and future agritourism activities shall be consistent and compliant with City Code Section 1007.067. 2. The following Planned Improvements listed on page 9 of the applicant's narrative are not consistent with City Code Section 1007.067 and are not approved under this agritourism conditional use permit: a. Farm market building, restaurant, bal<ery, meat marl<et b. Wedding venue c. Overnight camping, RV parking d. Housing for family and employees Any such uses may only be undertaken in compliance with City Code, which may require separate permits and/or approvals. Any outdoor gathering on the property that assembles individuals with a common purpose other than an agritourism activity, such as for a wedding or live music concert, shall be subject to the Special Events requirements, including permitting from the City Clerk's Office, set forth in City Code Chapter 615. 4. All licenses and permits must be obtained and maintained as required by federal or state law or City Code to engage in the intended agritourism activities on the property, including, but not limited to, a liquor license from the City Clerk's Office for any alcohol service or sales on the property. 5. All zoning and building permits required under state law or City Code for improvements on the property must be obtained and/or maintained. If permits cannot be obtained, the use and/or structure is not allowed. 6. Traffic control measures must be implemented to ensure safe ingress into and egress from the property, including traffic control measures deemed necessary by the Lino Lakes Police Department or Fire Department. 7. All comments from the Building Official Memo dated November 3, 2025 shall be complied with. 8. Documentation, including detailed financial information, related to the use of the property, as necessary to confirm that such use is consistent with and operating within the limits of agritourism as set forth in City Code, must be made available to the city upon request. 9. Lake Drive shall be the main public ingress and egress to the site unless there is an emergency that warrants other temporary ingress or egress is necessary.
