Re: Forest Lake/Town of Columbus Incorporation Requests
Background
In September the City of Lino Lakes received notification from the State of Minnesota
Department of Administration that the Town of Columbus had petitioned the State of
Minnesota to incorporate as a municipality. Shortly, thereafter, the City was contacted by
the City of Forest Lake inquiring as to whether the City of Lino Lakes would oppose the
incorporation in favor of possible annexation of portions of the town into Forest Lake and
Lino Lakes. Staff responded that due to the lack of municipal water and sewer services
in the northern portion of Lino Lakes, current land uses, and comprehensive plan, at this
time the annexation of a significant portion of Columbus Township does not meet the
statutory criteria for the ordering of an annexation by the Director of the Office of
Strategic and Long -Range Planning.
In October the Forest Lake City Council petitioned the State to annex 655 acres of land
located east of I -35 and I -35E, bordering the northern boundary of Lino Lakes. At the
end of November, the Town of Columbus requested the City of Lino Lakes pass a
resolution in support of the incorporation of the Town of Columbus. They have
submitted a proposed resolution for your consideration.
Staff Comments
Both the requests of the City of Forest Lake and Town of Columbus would result in the
City of Lino Lakes supporting one neighboring entity over the other neighboring entity.
In addition to currently working with both entities on transportation issues, the City of
Lino Lakes may find itself in the position of needing to work with whichever entity has
jurisdiction in the future on local road issues, utility connections, etc. The decision on
incorporation and annexation by the Director of the Office of Strategic and Long -Range
Planning is based on 13 factors in cases of incorporation and 14 factors for annexation for

the purpose of determining the most appropriate form of government to serve the area in
question. The only factor related to our opinion is "relationship and effect of the
proposed action on adjacent school districts and communities ". Staff does not feel that
there would be any significant "relationship and effect" from either proposed action to
Lino Lakes and therefore finds no compelling reason to enter into the incorporation or
annexation proceedings.
Requested Council Direction
Staff needs direction as to whether the City Council wishes to have this issue placed on a
future regular meeting agenda for action and the position to be stated in the resolution, or
whether the Council does not intend to take a position.

A RESOLUTION SUPPORTING THE INCORPORATION
OF THE TOWN OF COLUMBUS, ANOKA COUNTY, MINNESOTA
WHEREAS, the Town of Columbus has been an Urban Township since the 1970s; and
WHEREAS, the Town of Columbus provides a full range of municipal services to its residents,
businesses, and institutions; and
WHEREAS, the Town of Columbus is professionally managed by a staff of administrative and
public works personnel; and
WHEREAS, the Town of Columbus has a population of over 4000 persons and for all intents
and purposes has operated as a city for several decades; and
WHEREAS, the Town of Columbus has evaluated the merits of incorporation for several years;
and
WHEREAS, the Town of Columbus has completed a series of engineering studies and has made
substantial investments in establishing municipal sewer and water within the Interstate 35
Corridor; and
WHEREAS, the Town of Columbus believes it is vital to its long range planning and
investments on behalf of it residents, businesses, land owners, institutions, and other stakeholders
to incorporate as a city under the laws of the State of Minnesota.
NOW, THEREFORE, BE IT RESOLVED, the adopts
this Resolution in support of the petition of the Town of Columbus to incorporate as the City of
Columbus. The further requests the Office of
Administrative Hearings, Municipal Boundary Adjustments, to grant the petition by the Town of
Columbus to incorporate.
