Introduction
The Comprehensive Plan, adopted this summer, lays the foundation for future growth
management and land use planning for the City of Lino Lakes. The Comprehensive Plan
outlines suggestions for updating both the Zoning and Subdivision Ordinances. The update of
these regulations is necessary to implement the stated growth strategies, landuse and
environmental policies established in the Comprehensive Plan and to address both processing
and performance issues identified in recent development applications.
Scope
The ordinance update will include a complete rewrite of the City's Subdivision Ordinance and
amendment of the City's Zoning Ordinance to incorporate the policy requirements of the
Comprehensive Plan. The proposed revisions are more fully described as follows:
Subdivision Regulations
The Subdivision Ordinance is a technical document with limited application to the subdivision of
land. The ordinance establishes the process, design, dedication and information requirements
necessary to subdivide property within the City. The subdivision ordinance is the primary tool
used to manage the city's growth and insure that development takes place in an orderly fashion.
The revision of the subdivision ordinance will include the following:
Information Requirements
Review of information requirements to determine adequacy of existing submittal requirements.
Additional information will include:
1. Resource inventory of existing natural conditions (i.e., topography, wetlands,
drainageways, floodplains, woodland resources, etc.).
2. Soil information pertaining to hydric soils, high water tables, and strategies for soil
correction.
3. For conservation subdivisions, a yield plan illustrating a standard subdivision and a base
lot count.
4. Sketch plan information.
5. Additional Information. The City will need to review the preliminary plat and final
submission information to determine if additional information should be required or if
some of the existing information is not needed.
Plat Review Process
Update review process and schedule. Process should include:

1. Sketch plan submission and pre - application meeting with the applicant prior to
submission of a preliminary plat. This meeting would lay out the review schedule,
submission requirements and fees associated with the preliminary plat application. Staff
may identify design concerns identified in review of the sketch plan.
2. City Staff Development Review. Following the submission of the preliminary plat
application, City staff shall meet to review the application to determine if the application
is complete. The application shall be reviewed against City checklist and development
regulations to determine completeness. Staff shall also outline initial review comments
pertaining to plat design or changes to the plat that would be required to receive approval.
The applicant would be notified of the completeness of the preliminary plat application
and if changes need to be made.
3. Advisory Committee Review. Upon completion of a preliminary plat, staff shall outline
a review schedule and public hearing date that would allow the City' s advisory
committee, as well as outside agencies (i.e., Rice Creek Watershed, VALMO, Anoka
County, DNR, etc.) the opportunity to review and comment on the preliminary plat prior
to public hearing at the Planning and Zoning Board. The review schedule should be
arranged to allow for the Planning and Zoning Board to have complete information on the
preliminary plat prior to making the recommendation to City Council.
4. Following Planning and Zoning Board recommendation, the City Council should review
and take action on the preliminary plat. The City Council should review the same
application as the Planning and Zoning Board.
5. Prior to or in conjunction with the submission of the final plat, the City may wish to
S require a final version of the preliminary plat and working plans (i.e., grading, drainage,
landscaping, utilities) that reflect all the recommendations and conditions of approval.
This would help to improve the City's ability to track approval history and enforcement.
Premature Subdivisions
The City will need to review and update the language for premature subdivisions. This section
of the ordinance presents findings that may be used to justify denial of a subdivision application.
Performance Standards
Through the comprehensive planning process and recent reviews, numerous suggestions were
offered as to subdivision performance standards that should be considered to create better
neighborhoods. The following is a partial list that may be expanded through the ordinance
review:

The aforementioned list of issues is not all inclusive, rather it provides initial direction and
understanding for the anticipated changes. Additional issues may be identified and responded to
through the work program.
Zoning Ordinance
The Zoning Ordinance establishes the zoning districts and applicable landuse requirements.
These requirements include, but are not limited to, permitted, conditional, interim and accessory
uses, setbacks, lot dimensions, architectural standards, landscaping, etc. Through the update of
the City's Comprehensive Plan, a number of Zoning Ordinance changes were suggested. The
current Zoning Ordinance was reformatted in 1997. As such the update of the ordinance will
most likely involve amendments to specific sections. Changes identifed in the Comprehensive
Plan and by staff include the following:

1. Greenway Performance Standards. Establish zoning standards that outline the conditions
for the creation of greenway corridors. Standards would include development densities,
clustering, open space protection, and buffer areas.
2. Stormwater Drainage Standards.
• Establish vegetation buffers along lakes, creeks, wetlands, and water courses.
• Develop performance standards for stormwater management emphasizing infiltration
and bio- retention.
• Refine stormwater standards of the Lino Lakes Local Water Management Plan.
3. Landscaping / Tree Preservation
• Develop standards for preserving existing tree cover.
• Landscape screen between incompatible land uses.
• Buffer yards and screening along major arterial collector streets.
• Requirement for use of native landscape planting.
• Prohibition of invasive or exotic plant species.
• Standards for deep rooting of new landscaping.
• Establish irrigation requirements.
Zoning Design Standards

seaplane base and Lino Airpark.
5. Introduction of graphic diagrams that illustrate zoning concepts (i.e., fence setbacks,
buffer yards, accessory building locations, etc.).

Approach
The ordinance revision process is proposed to be completed within twelve months to coincide
with the expiration of the proposed moratorium. The City will begin the update of its
development regulations with the Subdivision Ordinance and then progress into the Zoning
Ordinance. The attached schedule outlines the review sequence for the development regulations.
Ordinance Project Start Up and Organization
1. Meeting with City staff, engineering, public works, building and housing inspection staff
to identify issues, concerns, conflicts or enforcement problems pertaining to the existing
Subdivision Ordinance and Zoning Ordinance. The discussion would expand on the list
of issues outlined in this memorandum.
2. Formulation of Task Force for ordinance review. The City is establishing a Development
Regulations Task Force comprised of members of each City advisory committee and
chaired by a Council member. This task force composition will provide an excellent
means of communicating progress back to the balance of the City Council and advisory
committees. The task force that will guide the ordinance review and direct City staff and
consultants on preferred ordinance changes.
By -Laws shall be established by the City Council governing the Task Force.
Ordinance Task Force Workshop
City staff has identified a preferred process for undertaking the review of the ordinances. Six
workshop meetings are scheduled over the next six months where the task force will meet to
discuss the various components of the subdivision regulations that require modification.
Starting with workshop meeting 4, the Task Force shall begin its review of the Lino Lakes
Zoning Ordinance. The schedule anticipates project completion by January 2003.
The existing schedule and anticipated project discussion items are identified in Exhibit A. This
schedule will be fairly rigid to meet the City Council expectations for project completion.
Project agendas will allow for flexibility based on discussions and recommendations of the task
force. Consultant will provide ordinance handouts at the end of each meeting for discussion at
the next meeting. This would allow the task force members a month to evaluate the discussion
items. The process also envisions opportunities for the task force to identify issues, ideas, or
questions at each meeting that the staff may research and respond to at subsequent meetings.
As the task force concludes the review of topics, staff shall complete draft ordinance language
for subsequent task reviews and approvals. At the end of the six month review period, a
completed draft Subdivision Ordinance shall be presented to the City Council. At the end of
year 2002, a completed draft of the Zoning Ordinance shall be presented to the City Council.

Draft Ordinance Review
Following the Task Force completion of the draft Subdivision and Zoning Ordinances, City staff
shall formally present the ordinance to each of the City's advisory boards for their review and
comment. The draft ordinance, along with a summary of comments, shall be presented to the
City Council at a Council workshop. The ordinance shall be modified per City Council
directive.
The second draft ordinances shall proceed to Planning Commission public hearing and
subsequent City meetings for adoption. NAC will prepare a final draft of the development
regulations consistent with the conditions of approval by the City Council
Ordinance Project Schedule
Based on the work program outline, the total update of the Lino Lakes Subdivision and Zoning
Ordinances is anticipated to take 12 months to complete. Assuming a start up date of January
2002, the Subdivision Ordinance completion would occur in July 2002 and Zoning Ordinance
completion would be January 2003.
Ordinance Project Personnel
The City will utilize NAC for ordinance preparation. Alan Brixius, a Principal of NAC, will be
the primary staff person assigned to updating the Lino Lakes Subdivision Ordinance. Mr.
Brixius has been involved in Lino Lakes' planning since 1992 and most recently was involved in
drafting the 2001 Lino Lakes Comprehensive Plan. This provides him with a unique historical
perspective for the project. Mr. Brixius will be responsible for ordinance production work and
the majority of the public meetings.
Bob Kirmis and Daniel Licht will assist Mr. Brixius in the ordinance preparation and will be
back -up for meetings.
City staff will be coordinating the review process with Michael Grochala and Jeff Smyser as the
principle participants. Marty Aselson, Environmental Specialist, Mary Alice Devine, Economic
Development Specialist, and John Powell, City Engineer will provide technical assistance
throughout the process.
Ordinance Project Budget
Based on the work program, NAC has estimated that the production costs associated with
drafting the Lino Lakes Subdivision Ordinance along with six workshop meetings with the Task
Force should not exceed $8,200.00. Production costs associated with updating the Lino Lakes
Zoning Ordinance including eight workshop meetings is anticipated not to exceed $21,100.00.
Total project budget for both ordinances is $29,300.00

The budget does not include ordinance reproduction costs. NAC will provide reproducible
copies of the draft ordinance for staff review. Additional copies for distribution shall be the
responsibility of the City. NAC will provide the City will one reproducible copy of the final
Subdivision Ordinance and Zoning Ordinance and a copy on diskette in word processing
software compatible with the City.
The project budget includes 11 Task Force meetings with the Zoning Ordinance Task Force.
Any additional meetings beyond the 11 by NAC personnel shall be charged at a flat rate of
$200.00 per person per meeting for meeting attendance.

DEVELOPMENT REGULATIONS TASK FORCE
Under the authority vested by the City Council of Lino Lakes, the duties and structure of the
Development Regulations Task Force shall be as follows:
ARTICLE I. NAME OF TASK FORCE
The Task Force shall be called the Development Regulations Task Force, and will be referred to
as the DRTF throughout the remainder of this document.
ARTICLE II. PURPOSE AND POLICY
Section 1. Purpose
The purpose of the DRTF is to make recommendations to the City Council regarding revisions to
the Zoning and Subdivision Ordinances based on the policies and goals set forth in the 2001
Comprehensive Plan.
Section 2. Policies
The DRTF shall meet its purpose through the review of ordinance revisions prepared by the
City's planning consultant and City staff. In addition to the requirements set forth herein the
purpose shall be carried out in conformance with the following:
The review process shall be conducted within the timeline set forth by the City Council.
The DRTF shall limit its review to the ordinance revisions based on the goals and policies of the
Comprehensive Plan. Modification of the Comprehensive Plan is outside the scope of the DRTF
purpose.
Recommendation of revisions shall be decided by a simple majority vote as more clearly defined
in Article V.
The DRTF shall provide the council with a bi- monthly status report indicating task force
accomplishments in accordance with the prescribed schedule. In the event that progress has not
been made, the DRTF shall provide reasons for such delays.
Section 3. Range of Action
The DRTF shall serve as an advisory group, and shall make its recommendations directly to the
City Council on all matters.
ARTICLE 111. STRUCTURE AND ORGANIZATION

The DRTF shall consist of seven (7) voting members. The task force shall consist of two (2)
members from each of the following boards /committee:
Economic Development Advisory Committee
Environment Board
Planning and Zoning Board
and one member from the City Council.
The City Park Board, while not represented on the DRTF, shall serve as a resource to the task
force in matters that pertain to park, trail, and greenway development.
Section 2. Appointment
Appointments will be made by the City Council following nomination of board members by the
individual boards. The City Council representative shall be selected by the City Council.
Section 3. Removal from Office
Any DRTF member may be removed from the task force with cause by request of the Chair and
simple majority consent of the City Council. A member that misses two consecutive meetings
will be removed from the DRTF without a vote. Vacancies shall be filled by simple majority
vote of the City Council.
Section 4. Compensation
All appointed DRTF members shall serve without remuneration.
Section 5. Membership rights and responsibilities
All members must attend meetings of the DRTF, participate fully in DRTF discussion, and have
one vote. No member of the DRTF, with the exception of the Chair, may speak or act on behalf
of the DRTF without prior authorization from the task force.
ARTICLE IV OFFICERS
Section 1. Officers of the DRTF shall be the Chair and Vice - Chair.
Section 2. Election
The Chair shall be the City Council representative. The Vice -Chair shall be elected by a simple
majority of those present and voting.

The Chair shall preside at all scheduled meetings, set the agenda, oversee the implementation of
decisions made by the DRTF, and serve as primary liaison with City Staff and City Council.
The Chair shall serve as the primary spokesperson for the DRTF.
The Chair will be responsible for providing monthly updates to the City Council.
Section 4. Vice -Chair
The Vice -Chair shall perform the duties of the Chair during the temporary absence of the Chair.
The Vice -Chair shall perform such other duties as may be assigned by the Chair.
ARTICLE V. MEETINGS
Section 1. Regular Meetings
The DRTF shall hold monthly meetings as prescribe by the process schedule approved by the
City Council. The date, time, and location of meetings shall be established by agreement of the
DRTF members. All meetings shall be open to the public, however such meetings shall not be
public hearings. Public testimony will not be heard by the DRTF with the exception of technical
advisors requested by the task force for specific topics of discussion.
Section 2. Special Meetings
Special meetings may be called by the Chair, or by the Vice -Chair in the absence of the Chair for
the purpose of maintaining the process schedule as set forth by the City Council.
Section 3. Quorum
The presence of a simple majority of the voting members shall constitute a Quorum. A simple
majority vote of the quorum is required to pass a motion before the DRTF. Proxy voting is not
permitted.
Section 4. The Chair shall preside over DRTF meetings in accordance with Robert's Rules
of Order, when necessary or appropriate.
ARTICLE VI. SUNSET CLAUSE
The DRTF shall terminate on November 30, 2002 or by simple majority vote of the City
Council. In the event that the DRTF terminates prior to the completion of its charge the
responsibility of completing its purpose shall fall to the City Council or its designee.
