The law was designed to reduce the inequity that was occurring between male and female dominated job classes. Minnesota Rules Chapter 3920 specifies the procedure for measuring and reporting compliance. Every three years, cities are required to conduct an analysis of their pay program to determine compliance with the act. MEETING DATE: January 28, 2002 TOPIC: Resolution No. 01- 185 Minor Subdivision, NE 1/4 NE 1/4 of Section 9 SSR & W Development, LLC (Willard Morton) VOTE: 3/5 BACKGROUND Mr. Willard Morton's firm, SSR & W Development, LLC, owns property in Lino Lakes. The SSR & W property includes 80+ acres in Section 9. The application is to split off 11 acres from an existing 40 -acres parcel, and combine the new 11 -acre piece with a one - acre strip that connects to Main St. SSR & W would then sell the new lot to allow for a new home site. Staff understands that Mr. Brad Racutt wants to buy the property and build a new home. The application raises numerous important issues regarding implementation of the long - range plan for the City, as represented in the 2001 comprehensive plan. The City Council discussed this application at its work session on November 20, 2001. The Council asked Mr. Racutt and the residents of the abutting property to discuss their issues and differences to see if they can agree to some compromise regarding access to Main St. City staff has received no information regarding any such discussions between those parties. However, we did receive a letter from Mr. Racutt's attorney challenging the staff recommendation. ANALYSIS The land use and zoning are shown in the following table. That is, the long -range plan for the site and much of its immediate area is to serve it with utilities to allow for residential development. It is in a stage 2 area, so utilities will not be available until after year 2010. It is important to protect the long -range plan by ensuring the ability to serve future development with appropriate services. This includes road access and circulation as well as utilities. There is a conceptual greenway indicated over much of the area. A greenway is an area that may be appropriate as protected open space because of environmental features. Greenways are conceptual because creating them is opportunity based: short of actually purchasing the land, the City must depend on the development proposals submitted. The long -range plan for a road in the area will, at the appropriate time, need to consider the potential for preserving a greenway. Zoning, Subdivision Requirements The site is zoned Rural, with a minimum lot size of 10 acres with a minimum of 20% upland. The proposal meets the lot size requirements. Park dedication is $1665 for each lot created by a subdivision. The City's subdivision ordinance requires all lots to have their full frontage on a publicly dedicated street (Sec. 1001.08 Subd. 6(1)). The intent is to prevent flag lots and provide for safe, efficient access and circulation within the City, including adequate police and fire department access. In past discussions regarding this application, City staff has suggested a means to address this requirement. Staff recommended creating a road easement along the eastern edge of the property, including the one -acre strip leading to Main St. The applicant took a different approach by proposing a road easement along the southern portion of the property. Access to the property would be from Main St. This is discussed more fully below, under "Transportation ". Transportation As noted above, the City requires that all new lots have the full frontage on a public road. City staff recommended creating a road easement along the eastern edge of the property, including the one -acre strip leading to Main St. This would provide frontage on a public road right of way, though there would be no need to actually construct the road now. Recommendations for Planning District 3 from the 2001 Comprehensive Plan include investigating the possibility of an easterly connection to Main St.. The Transportation Plan recommends this connection in the vicinity of the eastern end of Oak Lane and West Rondeau Lake Rd. • • SSR & W Minor Subdivision page 3 An access management study was prepared for Main St. by Anoka County and participating cities including Lino Lakes. The study, completed in 1999, recommends a full access intersection at West Rondeau Lake Rd. Because W. Rondeau Lake Rd. already exists, this is a logical location. The Metropolitan Council also requires the City to preserve right of way to accommodate future development. The road easement dedication recommended by staff along the east edge of the site best responds to this requirement. The proposal submitted by SSR & W is to dedicate additional right of way for Dupont Ave. along the southern edge of the property. This road would not be constructed. The prospective buyer of the new 11 -acre lot would use the one -acre strip for access to Main St. There are several problems with this proposal. Currently, both Dupont Ave. and Duffee Drive are'% rights of way (33 ft. wide). Dupont runs along the southern edge of the site. Duffee Drive meets Dupont at the southeastern corner of the site. The proposed additional easement would extend along Dupont to Lois Lane. There is no connection to Main St. Currently, an electric power transmission line easement follows the Dupont Ave. alignment: the location for the road easement proposed by the applicant. It would be very difficult to convert this location to a road. In contrast, Oak Lane is a full 66' right of way now except 200 feet just west of the freeway. The option recommended by staff would use this to plan the future Main St. connection. Much of the land in the area is wetland. Construction of the future road connection would involve wetland impacts regardless of the alignment. Adjacent Property Access Access to future development is an important issue. Another important issue is the current access situation for the adjacent land owner. The property at 1196 Main St. currently accesses Main St. via a driveway in the one -acre piece. The current residents there, Steve Martichuski and Kathy Matzke, have explained to staff that it was their understanding that a public road was to be constructed there. The deed to their property refers to a road easement, they say. For this reason, they oriented their garage to the east, with their driveway connecting to the long driveway that runs to Main St. The fact that the one -acre piece is 66 feet wide indicates that, sometime in the past, someone planned the strip for a road. However, we have no information indicating that the City has any rights or ownership in the property now. The staff recommendation accommodates the need for access to this property. As stated in the conditions in the resolution, the City will allow this property to use the road easement for access to Main St.. SSR & W Minor Subdivision page 4 • PLANNING & ZONING BOARD RECOMMENDATION The P & Z considered the application on November 14. The staff report included the recommendation that the minor subdivision be approved only if a road easement is dedicated to the City that includes the one -acre piece and the eastern 66 feet of the larger 11 -acre portion. The P & Z agreed that a road easement is appropriate. The P & Z thought the full 66 feet should be dedicated on the north, which would include the one -acre strip. However, the P & Z recommendation is to reduce the right of way dedication on the southern portion of the site to 33 feet instead of the full 66 feet. The other 33 feet is to be acquired when and if property to the east develops. This would distribute the burden of supplying land for the future right of way. Staff supports this minor change to the recommendation, and this is what appears in the resolution as a condition of approval. Staff has added two conditions regarding use of the road easement by the two properties to protect these property owners. Condition three states clearly that these properties can use the easement for access. Condition four ensures proper emergency vehicle access. • SUMMARY Approval of the application as submitted is to forego an opportunity for implementation of the City's long -range plan. If the City is to implement its long range plan, as represented in the 2001 comprehensive plan, it must recognize opportunities to put together the individual pieces. The 2001 comprehensive plan, the transportation plan which is a key element, and the 1999 access management plan all point to providing for a future road connection. This would provide safe access and circulation for existing properties and for future development, if it occurs. The subdivision ordinance supports this by prohibiting the creation of flag lots. Access to the new lot will be from Main St. As long as this is the access intended by both the City and the applicant, it is reasonable to make the access a public right of way that accomplishes a number of public purposes. Although Gethsemane United Methodist Church was a permitted use in an R -3 zone under the Zoning Ordinance in effect during its construction in 1989, a subsequent change in the Ordinance now requires a Conditional Use Permit for any Church located in an R -3 zone. As a result, the desire of the Church to construct a picnic shelter will need to be handled administratively as a Conditional Use Permit Amendment since it is an alteration of the site; and according to City Zoning Ordinance Section 2, Subd. 2.B.13, "any enlargement, structural alteration, or intensification of such use shall require an amended conditional use permit." ANALYSIS The proposed picnic shelter will be considered an accessory building (see Exhibit #2). It is anticipated the picnic shelter would be used for the Church's annual Booya Festival, Vacation bible School classes, Youth Events, Church picnics, and reunions. Under City Zoning Ordinance Section 3, Subd. 4.D.8.f., accessory buildings for property located within an R -3 zone, greater than one and one - quarter acres in size, are limited in number to a maximum of one attached garage and two detached accessory structures. The maximum total square footage for accessory buildings in an R -3 zone for a lot of this size is limited to 2,020 sq. ft. • • There are already two detached accessory buildings on the property: an 8' X 10' tool shed and a 24' X 30' detached garage. The construction of the proposed picnic shelter would result in three detached accessory structures, one more than is allowed under City Ordinance. The total square footage of the existing two accessory buildings is 800 sq. ft. The proposed picnic shelter would measure 1,380 sq. ft. (30' X 46'), resulting in a total accessory square footage of 2,180 sq. ft. This is 160 sq.ft. more than is allowed under City Ordinance. If the 8' X 10' tool shed is eliminated — which the applicant has indicated he is willing to do - total square footage drops to just 80 sq.ft. over what is allowed under City Ordinance. Construction of the proposed picnic shelter would violate the City's Zoning Ordinance in terms of both number and size of accessory structures. Removing the 8' X 10' tool shed already on site, and possibly decreasing the size of the proposed picnic shelter by 80 -sq. ft. are options to resolving this zoning issue. It should be noted that the City's Zoning Ordinance reaches a cap, or threshold level, of 2,020 sq.ft. for accessory buildings in ANY size lot of one and one - quarter acre or greater in an R -3 zone. That is, unlike zoning for Rural and PSP zones, R -3 zones do not allow more accessory square footage as lot size increases. As a result, even though the proposed site is approximately 5.2 acres in size (approx. 8 acres when the adjacent church -owned property is counted) , the proposed picnic shelter would not be allowed under City Zoning Ordinance, and would thus require approval of a Variance for construction. A last issue of note is the roof material, a galvanized ribbed metal, noted on plans for the proposed picnic shelter. City Zoning Ordinance Section 3, Subd. 4.D.8.f.4 states that accessory buildings should contain "no metal corrugated siding or roof, except upon tool sheds less than one hundred fifty (150) square feet in area," with 4.D.8.f.6 going on to require that "roof and exterior color and material be compatible with home (except manufactured metal tool shed)." The applicant has been made aware of these zoning regulations in discussions with staff, and has indicated that the roofing material could be changed to match that of the church. Since current plans still reflect the metal roofing, however, this issue should be clarified. OUTSTANDING RELATED ISSUE In 1997 the Gethsemane United Methodist Church site underwent a Rezoning, Minor Subdivision, and Comprehensive Plan Amendment in order to construct a parsonage. The above requests were all approved at that time, subject to the condition that "the subdivision include the formal dedication of the Stage Coach Trail right -of -way, with the understanding that Parcels B and C will be financially responsible for the future construction of the street" (see Exhibit #3 & #4). In other words, subdivision was granted on condition that street right -of -way be granted for the future subdivision. • • On inspection of the records in preparation of this report, it was found that such right -of- way was never legally recorded (see Exhibit #5). Staff would suggest that the City use the opportunity presented by the current request for a Conditional Use Permit Amendment to correct this oversight. Such action is prudent for several reasons. First, it corrects an administrative oversight made in the past: the Re- Zoning, Minor Subdivision, and Comprehensive Plan Amendment granted in 1997 were approved with conditions, and those conditions were never carried out. It is only fair that, this being discovered to be the case, corrective action be taken to carry out what was previously approved by Council. Second, it is important from a planning and engineering perspective to have right -of -way dedication through the future subdivision. Such dedication assures access and allows for the planning of neighboring future subdivisions so that road alignment and other such issues can be effectively resolved. The applicant has reservations about granting such right -of -way. It is the feeling of church board members at this time that they would like to keep the land as undeveloped open space, rather that subdivide and develop it. It is their feeling that granting the City right -of -way through the property puts at risk their ability to safeguard the land as open space. The above report was presented at the January 9, 2002 meeting of the Planning and Zoning Board. The board discussed possible ways to decrease number and total square footage of accessory buildings. It was felt that by both eliminating the 8' X 10' tool shed and decreasing the footprint of the proposed picnic shelter (approximately one foot on each side) the proposed project could be brought into line with the City's Zoning Ordinance. The Planning and Zoning Board voted unanimously to recommended approval, with the following three conditions: 1. Elimination of the 8' X 10' tool shed (or attach it to the existing garage) so that there will be no more than two detached accessory buildings on the site once the proposed picnic shelter is constructed. 2. Decrease the size of the proposed picnic shelter so as not to exceed the total accessory square footage maximum of 2,020 sq.ft. cited in the City's Zoning Ordinance. 3. Dedicate and record the formerly approved dedication of the Stage Coach Trail right - of -way. To conclude, staff cannot recommend approval of the Conditional Use Permit Amendment as presented, since it violates the City Zoning Ordinance in terms of number, size, and materials used for accessory structures. However, if granted, staff would recommend any approval of this Conditional Use Permit Amendment include the following conditions: 1. If the Council finds the proposed land use to be acceptable, staff would recommend approval of the rezoning request. This rezoning approval should, however, be made contingent upon the City amending its Comprehensive Plan (Land Use Plan) such that low density residential use is guided upon the subject site. If considered for approval, Mr. Brixius recommended the following conditions: 1. The subdivision include the formal dedication of the Stage coach Trail right -of -way with the understanding that Parcels B and C will be financially responsible for the future construction of the street. 2. The City Engineer provide comment and recommendation in regard to utility issues. 3. Any other comments of City staff. Council Member Bergeson asked why the Planning & Zoning Board's recommendation is for approval but staffs recommendation is open. Mr. Brixius noted the recommendation of the Planning & Zoning Board and explained any land use change is ultimately a Council determination. Council Member Bergeson noted sometimes churches grow and need more area for parking. He asked if this is an adequate piece of property for future needs. Mr. Brixius stated this is difficult to estimate but Parcel A, as shown, appears to have adequate room and setback to accommodate an expansion with some parking. He noted with utilities in the immediate vicinity, land becomes available for expansion. Mr. Brixius stated it appears the site serves the needs of the church and there is area for expansion. Council Member Bergeson asked if the entire parcel is tax exempt and when this would change in status. Mr. Hawkins advised this occurs when title is changed from the church. Council Member Lyden moved to approve the FIRST READING of Ordinance No. 15 - 97, Rezone, Gethsemane United Methodist Church property, and to approve a Comprehensive Plan Amendment (Land Use Plan) such that low density residential use is guided upon the subject site (as shown on draft town Center Land Use Plan) subject to three conditions as presented. Council Member Kuether seconded the motion. Motion carried unanimously. The ordinance resolved two easement issues on this lot by completing actions approved by the City years ago that were never officially recorded. ANALYSIS It is common practice to require easements around the perimeter of platted lots for utility and drainage purposes. Lakes Addition No. 3, platted in 1973, includes such easements. The plat dedicates easements ten feet in width on the front and north side of the lot. At the time of a legal settlement between the City and a developer in 1989, the intent was to vacate part of the easements on Lot 1 Block 10. This was done to accommodate the placement of a home closer to the front and side lot lines than would have been allowed under the ordinances in effect at that time. In order to make the lot buildable, it was necessary to vacate the easements and grant setback variances. The City Council in 1989 approved the necessary easement vacations and setback variances. Subsequently, a house was built on the lot according to the reduced setbacks: five feet rather than ten feet. However, the easement vacation was never recorded. In addition to the partial vacation of the lot line easements, a separate drainage and utility easement covering a large portion of the back of the lot was to be dedicated to the City. This was to cover a wet area. This easement was never recorded, either. We have received a new easement grant document from the current owner. The City should accept this easement so it can be recorded. • • • Exhibits 2 and 3 show the easements in question. The adoption of the Ordinance No. 01 -02 will correct these oversights from years ago. It will accept the easement over the wet area and vacate the lot line easements as approved by the City in 1989. According to the city charter, the vacation of an easement requires an ordinance. Accepting the other easement does not require an ordinance, but staff has incorporated this action into the ordinance. This simplifies it all into one action and one document. OPTIONS 1. Approve the second reading of Ordinance No. 01 -02. 2. Return to staff with direction. RECOMMENDATION Open public hearing, take comment, close public hearing. 1. The Lakes Addition No. 3 plat was approved by the Village of Lino Lakes in 1973. Utility and drainage easements around the lot perimeters, 10 feet wide, were dedicated and recorded as part of that plat. 2. On March 27, 1989, the Lino Lakes City Council granted an "easement variance" and vacation of a portion of an easement on Lot 1, Block 10, Lakes Addition No. 3 to allow a house to be built closer to the lot lines than would be allowed by the easements around the perimeter of the lot (Attachment A). No easement vacation was ever recorded. 3. A house has been built within the existing 10' easements. 4. It is necessary to vacate a portion of the existing 10' easements to finalize the action taken in 1989 but never recorded. 5. A separate drainage and utility easement was to be dedicated in 1999 covering the southeastern portion of Lot 1, Block 10. This easement was not recorded. 6. The City has received an new document dedicating this easement to the City (Attachment B). It is necessary to accept this easement and record it. Mr. Stahlberg said yes and it appears to best in the long haul for Lino Lakes.' It also is•most logical in terms of availability in terms of maintenance. PUBLIC REARING — VARIANCE AND VACATION OF SOLE EASEMENTS — LOTS IN LAKES ADDITION NO. 3, ROGER•NELSON.. Mayor Benson opened the public hearing at 7:47 P.M. Mr. Miller explained the background of this request. The City has attempted to sell fourteen lots on Black Duck Drive to Mr. Nelson. These lots were tax forfeit and were purchased by the City for resale to recoup some of the assessments_ Mr. Nelson was the successful bidder on the lots and he is in the process of obtaining all the necessary permits to build on some of the lots. Mr. Miller pointed to a map behind the Council which indicates the setback variances needed and easement vacations needed to make the lots buildable_ If setback variances are granted, Mr. Nelson will be able to build house twenty nine feet from the road surface. The P & Z Board has recommended denial, of the variances. However due to the litigation currently surrounding these lots Mr. Miller suggested that the Council re— examine the issue. Mr_ Reinert noted that at one time the Council was told that these lots were not acceptable because of environmental reasons and asked what has changed to.make them more suitable. Mr. Schumacher explained that the City does have documentation indicating that several of the Iots. are_ buildable. He also noted that this request is before the Council so that the lawsuit regarding the lots can be settled. Mr. Hawkins gave a brief explanation of the lawsuit and suggested that since this matter is in litigation, the Council meet in closed session either ziow or at a'latter date to discuss the matter.. Mr_ Reinert said he was concerned that we do not get ourselves or *future buyers into trouble with possible flooding. Mr. Neal noted that barrow material for filling these lots is proposed to be taken from Outlot F. He explained that residents around Outlot F have been maintaining this property and have been told that.in the future they.may have the opportunity to purchase portions of the Outlot and add to their lots. PUBLIC HEARING, REZONE — 'HENRY LASSA Mayor Benson opened the public hearing at 8.20 P.M.- Mr. Miller explained that this request is to rezone a parcel of land at 8312 Lake Drive from Suburban Residential to *General Business'.. Mr. Laska lives at this address and is operating a construction business from this property. Mr. Kluegel has advised Mr. Laska that outside storage of the commercial equipment is prohibited_ Mr. Laska then agreed to have the equipment moved by December 1, 1988 but has since submitted a rezone request. Mr. Miller listed the six findings of fact for denial that are detailed in the February 8, 1989.P & Z Board minutes. lie noted that the Council can deny the request based on the findings, but direct the Economic Development Committe and P & Z Board to study the area adjacent to Lake Drive north of Main Street for possible rezonings. Mr. Miller recommended that the rezone request be denied_ Mr. Laska explained that he felt the entire area should not be zoned residential due to the large amount of traffic on Lake Drive and because the area' just north in Columbus Township is being developed commercially and the existing commercial area across the street from him. He noted that he has submitted a petition to all of his neighbors regarding the rezone request and everyone has signed it. Mx-. Neal asked how many people are employed by his business. Mr. Laska explained about fifteen during the summer season with a payroll of about $200,000.00. Mr. Bohjanen noted that the entire length of Lake Drive was zoned until just a few years ago. Mr. Reinert asked Mr. Laska if he knew what the zoning was when he purchased the property. Mr. Laska -said he did not check but assumed it was commercial because of the adjoining commercial property_ -Mr. Reinert moved to close the public hearing at 8:28 P.M. Not adopt Resolution No. 02 -07 RECOMMENDATION: Option No. 2 - Staff recommends that Resolution Number 02 -07 be adopted. • • • - Resolution No. 02 -07 CITY OF LINO LAKES RESOLUTION NO. 02-07 RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS AND AUTHORIZING ADVERTISEMENT FOR BIDS — LAKE DRIVE /APOLLO DRIVE IMPROVEMENTS WHEREAS, the City Engineer has prepared plans and specifications for the Lake Drive /Apollo Drive project, and has presented such plans and specifications to the Council for approval; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. Such plans and specifications, a copy of which is attached hereto and made part hereof, are hereby approved. 2. The City clerk shall prepare and cause to be inserted in the official paper and in the Construction Bulletin an advertisement for bids for the making of such improvement under such approved plans and specifications. The advertisement shall be published for ten days, shall specify the work to be done, shall state that bids will be received by the Clerk until 1:00 p.m. on Monday, March 4, 2002, at which time they will be publicly opened in the City Hall by the City Clerk and Engineer, will then be tabulated, and will be considered by the Council at 6:30 p.m. on Monday, March 11, 2002, in the Council Chambers of the City Hall. Any bidder whose responsibility is questioned during consideration of the bid will be given an opportunity to address the Council on the issue of responsibility. No bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the Clerk for five (5) percent of the amount of such bid.
