The letter explains the purpose of the public hearing and the process. In short, the Council will determine whether or not this establishment violated Lino Lakes Ordinance 701 and what, if any, action should be taken. Building: The applicant is proposing to construct a 25,568 square foot office /warehouse building on the eastern one half of proposed Parcel F. Such building placement will allow for a shared access with a future building upon adjacent Parcel G to the west. Based on the building size and placement upon the lot, future building expansion is not anticipated. The office /warehouse building measures 34 feet in height and conforms with the maximum 45- foot height requirement imposed in the L -I District. The building is to be finished in pre -cast concrete wall panels (with a vertical raked finish) which conform to the standards in Section 3, Subdivision 4.B of the City Code. Wall panels are to be accented with a horizontal band consisting of a raked and smooth concrete. Such decorative band serves to add visual interest to the building. To enhance the building' entrance, the applicant has proposed a recessed entry with a canopy and adjacent landscaping. This is in response to recommendations by the Planning and Zoning Board to enhance the building entrance shown on the original plans. Trash Enclosure: As shown on the site plan, a trash handling area is proposed on the west side of the building. According to Section 3, Subd. 4.G of the Ordinance, all refuse stored outdoors must be totally screened from eye level view from neighboring uses and public rights of way. According to the applicant, the north and south walls of the trash enclosure are to match the materials of the principal structure. Signage: Neither the site plan nor building elevations illustrate any signage. Signage is governed by the City's sign ordinance and require a separate permit. All signs will be reviewed with the sign permit applications and must satisfy applicable requirements of the Ordinance in regard to sign type size and location. Landscaping: As shown on the landscape plan, a variety of trees are proposed on site. Specifically, a mixture of Ash, Maple, Crab and Cherry trees have been proposed. Parking: The standards for calculating the off - street parking requirements for office and warehouse uses are outlined in Section 3, Subdivision 5 of the City Code. For the purposes of calculating parking spaces, the ordinance requirement is to use 90% of the gross building area. If outdoor storage is proposed at some future point, the processing of a conditional use permit would be necessary. It is unlikely that the CUP requirements would be met on this site. Grading, Drainage and Utilities: There were a number of unresolved technical design issues listed in a City Engineer's memo dated 5/2/02 related to grading, drainage and utilities. These issues must be resolved. They have been added to the appropriate resolutions as conditions of approval. The conditions require that the issues are resolved either before the minor subdivision is certified or before site work can begin, depending on the particular item. Easements: The submitted "Sketch and Description" illustrates a drainage easement over a ponding area in the western portion of Parcel G. Additionally, drainage and utility easements are shown along the northern and southern boundaries of Parcel F. The acceptability of such easements should be subject to comment and recommendation by the City Engineer. Park Dedication: The proposed minor subdivision will be subject to park dedication requirements. For industrial development, a park dedication requirement of $2,175 per acre is required. With proposed Parcels F and G comprising 3.8 acres of upland area (exclusive of • ponding), a park dedication of $8,265 will be required prior to the City certifying the proposed minor subdivision. Rice Creek Watershed District Review: This application was brought before the Rice Creek Watershed District on April 24, 2002. The Watershed District approved the tabling with authorization for administrative action (TWAFAA). As a condition of site and building plan approval the Watershed District Permit must be received prior to City building permit issuance. Performance Agreement: Prior to the commencement of any site work, the applicant will be required to enter into a performance agreement with the City and post all the necessary securities required by it. ENVIRONMENTAL BOARD The Environmental Board reviewed the proposed development on April 24, 2002. The comments and recommendation of the Environmental Board are attached to this report. PLANNING & ZONING BOARD At the Planning and Zoning Board meeting on May 8, concern was raised regarding the ability of the site to contain hazardous material spills. According to the Fire Chief, both the Building Code • • Raske Building Systems page 6 and Fire Code address hazardous material storage and transportation and appropriate measures will be taken to ensure that hazardous materials are properly contained on site (see attached Fire Chief memo). The revisions have been made per the City of Lino Lakes Planning and Zoning meeting held on May 8, 2002. Per your request the following changes have been made to our plans since our original submittal on April 8, 2002. • Concrete wall panels will have a vertical raked finish instead of a smooth finish. • The wall panels will be accented with a subtle horizontal band consisting of a raked concrete and smooth concrete checker pattern with two horizontal reveals above and below the band. The decorative band will break up the monotony of the wall panel and enhance the aesthetic appearance of the building. • Refined landscape plantings to reinforce main entrance door. • Added decorative canopy to reinforce main entrance door. • Added a tree to the island located in the parking lot and the island located near the NW corner of the building in an effort to screen the visibility of our loading dock area. • Repositioned trees along 35 W and substituted the spruce trees with Canadian Red Cherry Trees per the Environmental Boards Request. • Added a dumpster enclosure along the west side of the building. The north and south walls of the trash enclosure will be constructed out of the same concrete wall panel as the building. We have two businesses on Apollo that are designed just for this issue. One has a separate room with a drain that enters into a containment tank and the other one has a sunken floor that will hold spilled material. Both buildings are equipped with sprinkler systems designed for high hazard. In fact, the one building has a foam system built into the sprinkler system. Drainage outside the building goes into holding ponds before entering the storm sewer. In most cases there is opportunity to stop the runoff before it enters the storm sewers. Both the building code and the fire code address hazardous • materials storage and transportation. • • During the annual inspection by the fire department, we look for any changes in the contents of a building that might violate the codes. An example of this could be a building that is now storing or using hazardous materials but the building was not designed for that purpose. In those cases, the building must be brought up to code or the hazardous materials removed. All of the firefighters are training to the operations level for hazardous materials. We do have some equipment to create dikes and booms across water. We also have access to a Chemical Assessment team from Fridley and a Hazardous Response team from St. Paul. Most of our calls involving hazardous materials occur in gas stations with gasoline or diesel fuel. Another area that we have concern with is the filling of LP bottles by the service station personnel. It seems that the training and respect for the product are lacking. We continually work on this issue but as turnover occurs, new people are constantly being hired and put on the job without proper training. As part of their 2001 building expansion project, their Conditional Use Permit was amended. Rice Creek Watershed District required new drainage easements over the parcel through the new Surface Water Management Plan. ANALYSIS The Molin Concrete parcel is located in the northeast corner of Lilac Street and Fourth Avenue. The Easement Exhibit map shows both sets of easements on it (attached). The new Surface Water Management Plan either over lapped the previous easements or it eliminated the need for them. Therefore, the previous easements (Easements Document #1404034, attached) can be eliminated because the necessary areas are covered with the new easements. Through this process, it was noted that an easement the City previously acquired along Fourth Avenue on the Molin Concrete parcel was not shown to be of record. The City is in the process of determining if the easement was recorded at Anoka County. Approval of the proposed easement vacations will be contingent on confirmation that the City does have the necessary easement along Fourth Avenue on the Molin Concrete parcel. OPTIONS 1. Cree Lane is a 60- foot wide, unimproved public right -of -way, that was platted as part of Shenandoah 3rd Addition. The right -of -way was intended to serve as a connection for future development to the west of the subdivision. ANALYSIS The Spirit Hills residential development, located immediately to the west of Shenandoah 3rd Addition did not use this connection. The Cree Lane right -of- way terminates at the western edge of Shenandoah 3rd Addition and it is no longer possible to extend the road westerly. No utilities are located within the existing Cree Lane Right -of -Way. It is staff's opinion that the right -of -way is no longer needed for public street or utility purposes. VOTE REQUIRED: Simple Majority BACKGROUND: The City received a petition on September 25, 2001, from residents and property owners on Marshan Lane, east of Lake Drive, for preparation of a feasibility report on sanitary sewer and water service. City Council received the petition and ordered the feasibility report on October 8, 2001. On January 14, 2002, the City Council received the feasibility report. A copy of the report was then sent out to the residents for their determination as to whether or not they want to continue with the Public Improvement process. The City received a Petition from 4 of the 10 residents on May 13, 2002, requesting installation of sanitary sewer and water utilities. The petition meets City Charter requirements that at least 25% of the benefited property owners have signed the petition for the City to proceed with the public hearing. The next • step in the process would be to accept the Petition and hold a Public Hearing on the proposed improvements. OPTIONS: 1. Return to staff for further review. 2. The project limits are from 62nd Street to the south end of existing West Shadow Lake Drive.
