The block party is scheduled to start at 4:00 p.m. and end at 9:00 p.m., July 20, 2001. Attached is a map showing the location of the proposed party and the signed petition from property owners acknowledging they have been notified and do not object to the block party. These property owners are indicated by the slant marks on the map. Please note that Hunter's Ridge is not a cul -de -sac and that the plan is to block it off at both ends. Currently there is nothing in the City Code that prohibits a block party that is not on a cul -de -sac or dead -end street. Both the police department and the streets division of the public services department have been notified of the party. If approved, public works will provide barricades for blocking the street and the police officer assigned to this precinct may stop by to visit the party. In the past, the City Council has encouraged these parties as it presents an opportunity for neighbors to get acquainted with one another. The total which all claimants would be able to recover for a single occurrence to which the statutory tort limits apply would be limited to $1,000,000. These statutory tort limits would apply regardless of whether or not the city purchases the optional excess liability coverage. If the city does waive the statutory tort limits and does not purchase excess liability coverage, a single claimant could potentially recover up to $1,000,000 on a single occurrence. The total which all claimants would be able to recover for a single occurrence to which the statutory limits apply would also be limited to $1,000,000, regardless of the number of claimants. As part of their 2001 building expansion project, their Conditional Use Permit was amended. Rice Creek Watershed District required new drainage easements over the parcel through the new Surface Water Management Plan. ANALYSIS The Molin Concrete parcel is located in the northeast corner of Lilac Street and Fourth Avenue. The Easement Exhibit map shows both sets of easements on it (attached). The new Surface Water Management Plan either over lapped the previous easements or it eliminated the need for them. Therefore, the previous easements (Easements Document #1404034, attached) can be eliminated because the necessary areas are covered with the new easements. Through this process, it was noted that an easement the City previously acquired along Fourth Avenue on the Molin Concrete parcel was not shown to be of record. The City is in the process of determining if the easement was recorded at Anoka County. Approval of the proposed easement vacations will be contingent on confirmation that the City does have the necessary easement along Fourth Avenue on the Molin Concrete parcel. OPTIONS 1. Studenski, City Engineer COUNCIL MEETING DATE: July 8, 2002 TOPIC: Public Hearing, Marshan Lane Utility Improvements. VOTE REQUIRED: 3/5 Vote required to close the hearing BACKGROUND: The City received a petition on September 25, 2001, from residents and property owners on Marshan Lane, east of Lake Drive, for preparation of a feasibility report on sanitary sewer and water service. City Council received the petition and ordered the feasibility report on October 8, 2001. On January 14, 2002, the City Council received the feasibility report. A copy of the report was then sent out to the residents for their determination as to whether or not they want to continue with the Public Improvement process. The City received a Petition from 4 of the 10 residents on May 13, 2002, requesting installation of sanitary sewer and water utilities. The petition meets City Charter requirements that at least 25% of the benefited property owners have signed the petition for the City to proceed with the public hearing. On June 10, 2002, City Council received the petition and called for the public hearing. The estimated cost of the project is $215,403.00. Following the Public Hearing, the City must allow 60 days to elapse before any further action can be taken as required by the City Charter. OPTIONS: 1. Continue the Public Hearing. 2. Close the Public Hearing. RECOMMENDATION: Option No. 2 - Staff recommends closing the Public Hearing. AGENDA ITEM 7C STAFF ORIGINATOR: Tanda Gretz/Jeff Smyser C.C. MEETING DATE: July 8, 2002 TOPIC: Site Plan Review for the proposed expansion of Emergency Apparatus Maintenance Co. ACTION REQUIRED: 3/5 vote BACKGROUND Emergency Apparatus Maintenance, located at 7512 -4th Avenue, is a company that repairs and customizes equipment used by fire departments. The current 5,600 sq. ft. building was approved in 1996 with plans which indicated an area for future expansion. The company would now like to expand into the area indicated in the 1996 plans, and has submitted an application for a Site Plan Review. ANALYSIS Site Description The site is a 1.12 acre triangular piece of property located to the east of 4th Avenue within the Lino Industrial Park. Superior Masonry & Concrete abuts the site to the north, with Nol -Tec located to the south. City Council Meeting July 8, 2002 EAM Site Plan Review Land Use Compatibility The following chart summarizes the land use (according to the proposed 2001 Land Use map) and zoning surrounding the site: Direction Land Use Zoning Site Industrial General Industrial North Industrial General Industrial South Industrial General Industrial East Industrial General Industrial West Public /Semi - Public (prison) Public (prison) Building Issues The existing building measures 5,273 sq.ft. The proposed addition will be located to the east of the current building and measure 5,450 sq.ft. The expanded area will be used exclusively as repair bays. Building elevations show the proposed addition matching the existing building in terms of color and materials, which is rock face concrete block. Building height is similar as well. Setbacks The following chart describes the required and proposed setbacks for the site. Parking for the original building was calculated at one stall for each employee (6), with nine stalls actually constructed. There are now ten employees, with proposed plans showing a total of 19 stalls to actually be constructed. City Ordinance requires light manufacturing areas to provide "one space for each employee or one space for each 2,000 feet of gross floor area, whichever is greater." A minimum of ten parking stalls are thus required for the site, calculating one stall for each employee. Grading/Drainage/Utility The applicant has submitted a preliminary Grading, Erosion Control and Drainage plan. City Engineer Jim Studenski reports that all grading and drainage issues have been resolved to his satisfaction. Rice Creek Watershed Recommendations Rice Creek Watershed has issued a TWAFAA for the proposed project pending receipt of several administrative items, including: 1.) Incorporation of infiltration practices. 2.) Existing versus proposed swale capacity narrative. 3.) Revegetation specifications for incorporated infiltration BMP's (best management practices). Lighting Submitted plans show wall pack style fixtures, which do not comply with City Ordinance lighting standards. The applicant has been directed to use shoebox style, no -spill fixtures which will deliver meter readings within City standards ( <1 foot candle on public streets). Landscaping City Ordinance allows impervious surface coverage up to 90% in a General Industrial Zone. No landscaping is proposed, and staff is not recommending any as the addition is located behind the original structure and is surrounded by similar industrial uses. Trash Enclosure The trash dumpster servicing the original building is located in the area planned for expansion and, as a result, will have to be moved to a new location. Original plans 3 City Council Meeting July 8, 2002 EAM Site Plan Review approved a dumpster without an enclosure; instead four pine trees at the rear of the lot were installed. Since the pine trees are only approximately three feet high and offer no real screening of an otherwise exposed dumpster, and since the previous trash arrangements were made under a previous Ordinance, staff will require that the dumpster be enclosed, as required under Section 3, subd. 4.G.2.c of the current ordinance. Sprinkling/Fire Suppression The building is required to be sprinkled. Review of the fire suppression system will be handled as a building inspection issue. CONCLUSION Plans for the original EAM building, approved in 1996, identify an area to the east of the building to be used for future expansion. The current application describes a 5,450 sq.ft. addition to match the original building, for use as repair bays. Staff would recommend approval of the application, with the following conditions: 1.) Proper building permits be obtained prior to any construction. 2.) Permits be obtained by Rice Creek Watershed prior to any site work or issuance of building permits. 3.) Cut sheets showing a lighting fixture choice meeting City Ordinance (shoebox style, no- spill), as well as a revised photometric lighting plan which reflects the new choice of fixture style, must be submitted prior to issuance of building permits. 4.) Trash/dumpsters must be enclosed within a six -foot high fence or wall. Elevation plans of the enclosure must be submitted prior to issuance of building permits. P & Z RECOMMENDATION The above report was presented at the June 12, 2002 meeting of the Planning & Zoning Board. After consideration of the issues, Board members voted unanimously to recommend approval of the Site Plan Review, with conditions noted by staff. OPTIONS 1.) The City's "first generation" plan was adopted in 1994. Since this time both the Rice Creek Watershed District (RCWD) and the Vadnais Lake Area Water Management Organization (VLAWMO) have updated their watershed management plans. As such the City is required to update its existing plan. The update is also a requirement as part of the Metropolitan Council's review of the City's Comprehensive Plan. TKDA, the City's Engineer, has submitted a proposal to prepare the plan for a not to exceed cost of $43,900. The project is proposed to be funded by the City's Surface Water Management Fund. The City established Surface Water Management Charges in 1992, in part, to cover the costs of local water management planning. It is anticipated that a draft plan will be completed within 90 days of executing the proposal. OPTIONS: 1. Return to staff for further review. 2. PROJECT DESCRIPTION The City of Lino Lakes is required to prepare a Plan that must, at a minimum, meet the requirements for local plans in Minnesota Statutes, Section 103B.235, except as provided by the Watershed Management Organization Plan under Part 8410.0110, Subpart 3. Each such Plan should be adopted within two years of the Board's approval of the last organization plan that affects local units of government. ORGANIZATION PLANS AFFECTING THE CITY OF LINO LAKES The four most immediate entities with Water Management Plans affecting the City of Lino Lakes are Anoka County, the Rice Creek Watershed District (RCWD), the Vadnais Lake Area Water Management Organization (VLAWMO), and the Metropolitan Council (METCO). A. ANOKA COUNTY Anoka County has its own County Comprehensive Water Plan that was completed in accordance with Chapter 103B of the Minnesota Statutes. County Comprehensive Water Plans must be updated once every five to ten years in accordance with current Minnesota legislative requirements. The County plans must be consistent with the Watershed District Plan covering the same geographic area. In addition to the Comprehensive Water Plan, Anoka County also has specific programs and policies relating to drainage issues on its highway systems and county ditch systems. It also has established shore land zoning ordinances for the control of development activity along the shorelines of lakes and the banks of major rivers. These zoning ordinances also regulate established 100 -year flood plains. B. RCWD Late in 1970, Ramsey, Anoka, and Washington Counties formally petitioned the Water Resources Board (WRB) to establish a Watershed District which, after public hearings, was established as the RCWD in 1972. In late 1974, the District prepared an overall Water Management Plan which served as the framework for the subsequent 18 years. Under the Metropolitan Surface Water Management Act (Chapter 509, Laws of 1982, M.S. 103B) requirements were set for preparing watershed management plans within the Twin Cities Metropolitan Area. On October 22, 1997, the RCWD adopted a plan that conformed with these requirements. That Plan adopted objectives and policies in 13 sub - watershed areas of concern. The RCWD has six objectives: 1) Minimize Public Expenditure to Control Runoff, 2) Improve Water Quality, 3) Prevent Flooding and Erosion, 4) Promote Groundwater Recharge, 5) Protect and Enhance Fish and Wildlife Habitat, and 6) Recreation. In June of 2000, RCWD updated and extended its implementation programs through 2005. C. VLAWMO VLAWMO was formed in 1983 through a Joint Powers Agreement ratified by the seven local units of government. The organization was formed to comply with the Metropolitan Surface Water Management Act. The VLAWMO originally adopted its watershed management plan in 1987. The current (second - generation) plan was approved by the Minnesota Board of Water and Soil Resources and adopted by VLAWMO in 1997. This plan sets forth goals, policies, management strategies, and implementation criteria for the watershed. VLAWMO has been authorized by the Minnesota State Legislature to act as the local government unit responsible for administering the Wetland Conservation Act. 2 f D. METCO Minnesota Statutes Section 473.145 required METCO to prepare a comprehensive development guide for the metropolitan area. As partial fulfillment of this requirement, METCO has prepared a Water Resources Management Policy Plan that complies with Minnesota Statutes Sections 473.145, 146, 156, and 157. The plan supersedes the Council's three former Water Resources Management Plans: Part 1, Wastewater Treatment and Handling Policy Plan (dated December 1988); Part 2, Surface Water Management: Nonpoint Source Pollution and Stormwater Runoff (dated September 1982); and Part 3, Water Resources Management Development Guide/Policy Plan (dated May 1986) dealing with water use and availability. Legislation related to metropolitan land use planning (Minnesota Statutes Section 473.858) suggests that comprehensive plans of local governments cannot be in conflict with the metropolitan systems plans. The metropolitan systems plans are defined in Minnesota Statutes Section 473.852, Subdivision 8, as "the airports and transportation portions of the metropolitan development guide, the policy plans, and capital budgets for metropolitan wastewater service, transportation, and regional recreation open space." Their plan for metropolitan wastewater service includes the Water Resources Management Policy Plan. III. SERVICES TO BE PROVIDED BY TKDA Based on TKDA'S understanding of the Project, we propose to provide the following services: A. PROJECT MANAGEMENT /QUALITY CONTROL 1. Develop and maintain a schedule for the Project. The schedule will include: B. • Significant work tasks to be accomplished. • Dates when each task is to be started and completed. • Responsibility for each work task. 2. Attend up to three progress meetings (assumes two attendees per meeting from TKDA). 3. Prepare meeting agendas and minutes for progress meetings. 4. Document all forms of communication (i.e., telephone, fax, e -mail, etc.). 5. Conduct in -house staff meetings throughout the Project (a total of six meetings are assumed). 6. Document review comments and provide responses as appropriate. 3 B. DELIVERABLES 1. Prepare and submit a Draft Water Management Plan (assumes two separate draft submittals each containing five copies). The Draft Plan will include the following major report sections: a. Executive Summary b. Existing Programs and Policies c. Setting d. Identification of Water Related Issues e. Goals, Policies, and Amendments f. Implementation and Amendments 2. Prepare and submit ten copies of the Final Water Management Plan. IV. ADDITIONAL SERVICES If authorized by you, we will furnish or obtain from others Additional Services of the types listed below which are not considered as basic services under this Authorization. Additional Services shall be billable on an Hourly Rate basis as defined in the Master Agreement, and such billings shall be over and above any maximum amounts set forth in this Authorization. A. Field verification of mapping and performance of any necessary topographic surveys or other reconnaissance. B. Hydrologic or hydraulic modeling. C. Wetland analyses. V. OWNER'S RESPONSIBILITIES OWNER'S responsibilities shall be as described in the Master Agreement and as further clarified below: A. Designate one individual to act as the OWNER'S representative with respect to the work to be performed, and such person shall have complete authority to transmit instructions, receive information, interpret and define policies, and make decisions with respect to critical elements pertinent to the Project. B. Provide review of materials furnished by TKDA in a reasonable and prompt manner so that the Project schedule can be maintained. C. Provide TKDA with copies of pertinent water management plans for the City and former Township. 4 D. Provide TKDA with planning document base maps in ArcView, MicroStation, or AutoCAD formats. E. Plan and conduct public review of the Plan and hearing process necessary for adoption. VI. PERIOD OF SERVICE We would expect to start our services promptly upon receipt of your acceptance of this Authorization and to complete a Draft Plan within 90 days of authorization to begin work. VII. COMPENSATION Compensation to TKDA for services provided as described in SECTION II of this Authorization shall be on an Hourly Rate basis in an amount not to exceed $43,900. The level of effort required to accomplish SECTION II services can be affected by factors which are beyond our control. Therefore, if it appears at any time that charges for services rendered under SECTION II will exceed the above amount, we agree that we will not perform services or incur costs which will result in billings in excess of such amount until we have been advised by you that additional funds are available and our work can proceed. Simple Majority Washington County has received federal funding to reconstruct County State Aid Highway (CSAH) 8/14 between I -35E in Lino Lakes, Anoka County, and Trunk Highway 61 in Hugo. As part of the project an alternative analysis, studying alignment alternatives along Main Street connecting with TH 61 was prepared. Four potential alignments through the City of Hugo were reviewed as part of the process including 140th Street, 142nd Street, 145th Street (the existing alignment), and 147th Street. At this point Washington County is in the process of preparing an Environmental Assessment (EA) for the project. This process will involve studying the environmental impacts of the proposed project including the alignment alternatives. However, Washington County is recommending that the 140th Street Alignment Alternative be eliminated from further study because of environmental impacts, right -of -way and construction costs, and travel patterns. The City of Hugo passed a resolution on July 1, 2002 concurring with Washington County's recommendation. OPTIONS: 1. Return to staff for further review. 2.
