This year's Sandburr Days will be held on September 6 -8. This annual event requires a special event permit, 3.2 beer license, and a cabaret license. The Special Event Permit has been submitted and approved by the affected departments. The application for a 3.2 beer license is complete and is accompanied by a certificate of insurance for liquor liability naming the City as additional insured. The III cabaret license application is also complete. This license is required to regulate entertainment where on -sale beer is served. All necessary fees have also been paid. The Circle -Lex Lions Club are required to have a food license from Anoka County. MEETING DATE: August 26, 2002 TOPIC: Resolution 02 -103 Approval of Comprehensive Plan, Including Revisions VOTE REQUIRED: 4/5 BACKGROUND In June 2001, the City Council approved the comprehensive plan. The Council recognized that there could be revisions to the plan before it is implemented. The City Council has had numerous discussions about the plan, and agreed to some revisions. The Metropolitan Council approved the comprehensive plan on August 14. Now, the City Council must give final approval to the plan. ANALYSIS In June 2001, the City Council adopted Resolution 01 -88, which included the statements recognizing: a) that review of the comprehensive plan by the Metropolitan Council, or other information received by the City Council, may result in the need for minor revisions, and b) the potential need to revisit the Comprehensive Plan and approve any such minor revisions before the Plan is implemented As anticipated, a number of revisions have been made to the document. These were discussed at numerous work sessions. In addition, an October letter from the Met Council pointed out some corrections and updates that are necessary to the document. These include updates of bus routes and corrections to maps showing additions to regional park reserve land. The final adoption of the comprehensive plan must include the revisions and corrections, The list attached to Resolution 02 -103 as Attachment A makes it clear what changes are to be included in the approval of the document. The document will be revised in the next few weeks, including the maps. Complete, updated documents will then be available. Staff will distribute copies to the City Council. Copies will be available for sale to the public. As usual, a copy will be available in the library in City Hall. OPTIONS 1. Land Use Plan: Zoning: The project site is currently zoned R, Rural District. Surrounding zoning includes R -1X, Single Family Executive to the north, and R, Rural to the east, west and south. Preliminary Plat: Lot Size. The minimum lot size of the R -1X District is 12,825 square feet of buildable land. All lots meet or exceed this provision. The minimum lot size of the R -1X District is 12,825 square feet of buildable land. All lots meet or exceed this provision. Stoneybrook Page 2 • • • Lot Depth. The minimum lot depth is 135 feet. Double frontage lots are required to have a minimum lot depth of 145 feet. All lots meet or exceed these provisions. Lot Width. The minimum lot width is 90 feet for standard lots and 115 feet for corner lots. All lots meet or exceed these standards. Outlots. There are six outlots included in the proposed subdivision. The outlots cover the majority of ponds and wetland areas. The applicant is proposing to dedicate all outlots to the City. The applicant should be aware that the dedication of outlots to the City will not be accepted in fulfillment of park dedication (payment in lieu) requirements. Setbacks. The required setbacks established in the R -1X District are the greater of the following: 40 feet (Collector or Arterial Street), 30 feet (Local Street), 30 feet (front yard), 30 feet (rear yard), and ten feet (side yard - principal building). The lots have adequate dimensions to meet required setbacks. In addition, pond and wetland areas will mandate a significant setback between proposed building sites and existing homes on adjacent properties. However, the building pad for Lot 2, Block 4 extends to within 18 feet of the existing wetland and proposed 100 year High Water Elevation. While the City has no requirements with regard to wetland setbacks, staff recommends that the building pad, on this lot, be modified to maximize the usable yard space. Street and Block Design. Two accesses to the site, from Birch Street, are proposed at the existing Pheasant Hills Drive and Sherman Lake Road intersections. Street A extends southerly into the development from Birch Street, loops back and ties into Street B. Street B is proposed to extend from Birch Street to the easterly property line of the development to provide a connection for future development to the east. There are five cul -de -sacs proposed that intersect with either Street A or B. The proposed extension of Street B easterly has been evaluated to determine its feasibility. The proposed alignment appears to allow the street to service the adjacent property with minimal potential wetland impacts. Staff is recommending that the curve radius of the street be modified to further minimize potential wetland impacts. The future extension of Street B will require the crossing of the St. Paul Regional Water Services (SPRWS) easement. SPRWS has reviewed the proposal and provided the City with the requirements that will need to be satisfied when the extension takes place. Based on their review the extension does appear to be feasible. The proposed temporary cul -de -sac should be extended easterly to abut the property line. The cul -de -sac design should be modified to extend into Lot 3, Block 2, rather than Lot 46, Block 8 due the larger upland area on Lot 3. A permanent easement will be required Stoneybrook Page 3 • • • to allow a cul -de -sac to be constructed until such time as the street is extended. Signage will be located at the street terminus indicating the future extension of the street. Street A is proposed as a large loop in the southern half of the development. While this section has two access points they form the same intersection and create a situation similar to a long cul -de -sac. Staff has evaluated other alignment options, however it appears that these would cause additional wetland impacts. Staff has reviewed this issue with the Public Safety Department and the Centennial Lakes Fire Department and determined that there are no access concerns with the proposed layout. Staff is also recommending that the applicant provide a street stub alignment to the south of the development in the approximate location of Street G. This would allow for a future connection with East Holly Drive. The 2001 Transportation Plan identifies East Holly Drive as a future Minor Collector and proposes its future connection with Holly Drive to the west and southerly to Ash Street (County J). While these projects are not planned in the near term, it would be practical to reserve the option to connect this subdivision to Holly Street in the future. It appears that an alignment option is available that would minimize impacts to existing properties to the south. It is likely that the connection would not be made until development takes place to the south. Street Width. In response to comments received by Rice Creek Watershed District the Developer is requesting a reduction in the City's standard street width to reduce impervious surface. The City currently requires a thirty -two (32) foot street width. The developer is requesting a twenty -nine (29) foot width. Section 302 of the City Code states that the City Council may permit variations from the street construction standards. Staff has evaluated the request and determined that the proposed twenty -nine foot width would be sufficient to handle local traffic needs within the development. However, it does appear that parking would need to be limited to a single side to insure emergency vehicle access. Additionally, the reduction in street width coupled with a curvilinear design of the subdivision's streets may reduce visibility of on- street pedestrian movements. Sidewalks along Street A and Street B may be necessary to alleviate this concern. The Environmental Board recommended reducing the street width. The Planning & Zoning board recommended that the street width be constructed to the city standard 32 foot width. Grading and Drainage. The City Engineer has completed review of the Grading and Drainage Plan. His comments, dated July 3, 2002, are attached. A Rice Creek Watershed District (RCWD) Land Development Permit is also required. The City's Local Water Management Plan calls for the minimum floor elevation, including basement to be 4 feet above the groundwater, 4 feet above the normal water level, or 2 feet above the 100 year flood elevation, whichever is greatest. The plan appears to satisfy these requirements based on the proposed normal and highwater levels. Stoneybrook Page 4 • • The developer is currently monitoring existing groundwater elevations for verification. Final adjustments will be made with the final grading plans. Mitigation sites are proposed to be fenced off after grading is completed to restrict construction traffic. If soils are to be brought to the site they must be consistent with existing soil types. Utilities. The City Engineer has completed review of the Utility Plans. His comments, dated July 3, 2002, are attached. Sanitary Sewer is proposed to be extended to the site from its existing location in Sherman Lake Road, north of Birch Street. Water will be provided by connection to the existing 16" trunk water main lying adjacent to the property on the south side of Birch Street. The water main is proposed to be looped back to the system by crossing Birch Street at Pheasant Hills Drive. Adequate capacity exists in the sanitary sewer system to service the proposed development. In addition, the Black Duck Lift Station, which services the area, is scheduled for replacement in 2003. Drainage and Utility Easements. Drainage and Utility easements are proposed being five feet in width and adjoining lot lines, and 10 feet in width and adjoining street lines and rear lot lines as required. Drainage and Utility easements covering the 100 year High Water Level and those covering underground storm sewers are subject to review and approval by the City Engineer. Easements should be provided to access all pond and wetland areas. Specifically, an easement should be provided for access to Outlot F and covering the emergency pond overflow on Lot 6, Block 8. Parkland Dedication. The Park Board discussed the proposed subdivision at its February 4, 2002 meeting. The board is recommending 100% cash payment in lieu of parkland dedication. As explained in the Public Services Director's February 5, 2002 memo (attached) the proposed development lies outside the planning limits of the Comprehensive Park and Trail System Plan. The Park Board looked at several alternatives and recommended the payment in lieu as the preferred option. Floodplain. Portions of the site lie within a Flood Plain Zone A. Zone A represents areas of 100 year flood where base flood elevations have not been determined. The City's Floodplain Management Ordinance requires that all principal structures be located no lower than one foot above the regulatory flood protection elevation. The submitted grading plan identifies proposed 100 year High Water Level elevations. The Rice Creek Watershed District's 1998 Calibration Study identifies the regulatory flood elevation for this area as 887.6. As currently proposed, all lot pads are located entirely above this elevation and all first floor elevations satisfy the flood plain requirements. The proposal is subject to the review and approval of the City Engineer and Rice Creek • Watershed District. If the proposed subdivision is approved, the Developer will be Stoneybrook Page 5 • • • required to make application to FEMA for a Letter of Map Amendment (LOMA) or Letter of Map Revision (LOMR) to revise the existing Flood Plain maps consistent with the proposed grading. Wetlands. The project site contains 19.39 acres of wetland. 2.06 acres of wetland are proposed to be impacted by the site development. The wetland mitigation will take place on -site, by creating two new wetlands and three water quality ponds, which will have a total area of 2.51 acres and 3.27 acres, respectively. A portion (.20 acres) of one of the existing wetland areas will be converted from Type 2 wet meadow to a Type 3 shallow marsh wetland to help facilitate site drainage. The developer is proposing to install signs, delineating the wetland edge, at property corners or where the wetland edge changes drastically within a lot. Approximately 35 to 40 signs will be installed (one sign per two homes) along the wetland edge. The signs will designate the area as a protected wetland zone. The sign will also inform homeowners that moving or cutting beyond the sign is not allowed. The plans also delineate a wetland buffer easement adjacent to wetland to provide additional transition from cultured lawns to native vegetation. The developer is proposing the establishment of a Homeowner's Association to maintain all buffer areas and applicable signage. The developer should also make available to all lot purchasers a Best Management Practices/Environmental information brochure identifying purpose of buffer areas, soil and water conditions in infiltration areas, as well as limitations on use of buffer and wetland areas. The application also includes a Monitoring Plan that provides for monitoring of the newly created wetlands for a 5- year period. The report will be submitted to Rice Creek Watershed District (RCWD) on a yearly basis. The RCWD is the Regulatory Government Unit (RGU) for administration of the Wetland Conservation Act. Security should be required within the development agreement to insure installation of signs as well as the required monitoring. This requirement will need to be coordinated with the RCWD. All exposed soils above the Normal Water Level should be seeded with mixes consistent with City of Lino Lakes seed mixtures. The applicant should coordinate seed types with the City's Environmental Specialist. Tree Preservation. The site contains a number of Oaks in the extreme southeast corner, along the westerly property line and one on the north side adjacent to Birch Street. There is no anticipated tree loss as part of this project. The grading plan identifies the installation of fencing along the drip line of the trees. Installation of tree preservation measures will be required before grading activity on the site. The developer should coordinate all tree preservation activities with the City's Environmental Specialist. Stoneybrook Page 6 • CEPTED. Officer Mike Rumpsa prepared a review on January 21, 2002 (attached). He expressed concern with the additional traffic load on Birch Street, particularly with morning rush hour traffic. Landscaping. A landscaping plan for screening along Birch Street has been submitted as required. The plan consists of a combination of deciduous and coniferous trees. The City's Environmental Specialist is recommending replacement of the proposed Colorado Spruce with the White Spruce. The developer is also proposing to add an additional coniferous tree buffer along the northeasterly and westerly property lines in response to adjacent property owner concerns. Wildlife Impacts. The recently completed Wild Land Urban Interface study included a wild life assessment of the City of Lino Lakes. Results of this study indicate that there are no significant wildlife issues identified on the Stoneybrook site. Sandhill Cranes have been sighted in a large wetland complex southeast of the development property. The upland area in the southeast corner of the site will act as a buffer to potential Sandhill Crane nesting in this area. Phasing. The applicant is proposing to phase the development over two years. 52 lots are proposed for development in 2002. The remaining 50 lots would be developed in 2003. Environmental Assessment Worksheet (EAW). The proposed subdivision does not surpass the mandatory thresholds for an EAW and therefore is not required. Rice Creek Watershed District (RCWD). The developer has made application to the RCWD for approval of a Land Development Plan and a Wetland Alteration Plan. The RCWD has approved a TWAFAA (Table with Authorization for Administrative Action) for the proposed development. Anoka County. The County has completed its review of the proposed development. The County will require improvements to Birch Street (CSAH 10) so that there will be left, through and right turn lanes for eastbound and westbound CSAH 10 traffic at both the Sherman Lake Road and Pheasant Hills Drive intersections. The developer will be required to make these improvements as part of this development. MUSA Allocation: The applicant is requesting the allocation of approximately 54.73 acres of MUSA to service the proposed development. In 1996, the Metropolitan Council provided the City of Lino Lakes with a 150 acre "MUSA Reserve ". The reserve was intended to accommodate some limited development within specified areas of the City until the updated Comprehensive Plan, including the transportation element, was completed. There are approximately 15.7 acres remaining in the City's MUSA Reserve. Stoneybrook Page 7 • • • On August 14`h the Metropolitan Council approved the City's 2001 Comprehensive Plan. As part of the plan, the City requested an additional 359 acres of MUSA to service future development through 2010. As such the proposed residential development is eligible for the MUSA Allocation of 54.73 acres based on the following findings: 1. The application for 54.73 acres of MUSA is being made in conjunction with the request for preliminary plat approval. 2. The applicant has requested an R -1X zoning designation be applied to the proposed development consistent with the proposed land use contained in the 2001 Comprehensive Plan. Such request has been made in conjunction with the preliminary plat request. 3. The property lies immediately south of Pheasant Hills Preserve, which is within the existing MUSA. The property lies within a Stage 1 growth area as defined in the 2001 Comprehensive Plan. 4. Development of the property is considered a natural utility extension. Existing utilities are located immediately to the north of the site. 5. Development of the property is considered a natural extension of existing roadways. Proposed roadways into the site will connect with the existing Pheasant Hills Drive and Sherman Lake Road. 6. Development of the property is environmentally compatible with the surrounding area. The proposed development has minimized impacts to existing wetlands and tree cover on the site. Approximately 21.44 acres of the 78.07 acre site (27 %) will remain undeveloped. 7. The proposed development lies outside the scope of the City's 1992 Park and Trail Plan. The City's Park Board has evaluated the proposed development and recommended a 100% cash park dedication. 8. The Development is consistent with the City's Comprehensive Water and Sewer Plan. 9. Development of the property shall not adversely affect the health, welfare, and general safety of the community. 10. Birch Street (CSAH 10) is adequate to handle the additional traffic generated by the proposed development subject to the improvements specified by Anoka County. The developer will be responsible for the necessary upgrades to CSAH 10. 11. The project is proposed to be phased over two years. The phasing plan calls for 52 lots in 2002 and 50 lots in 2003. Stoneybrook Page 8 • • Rezoning: As previously indicated, the applicant has requested the rezoning of the subject property from R, Rural to R -1X, Single Family Executive. In consideration of rezonings, the Planning and Zoning Board must consider possible adverse effects of the proposed amendment based on the following criteria: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found consistent with the official City Comprehensive Plan. Comment: The proposed rezoning is consistent with the City's 2001 Comprehensive Plan. The proposed R -1X zoning is consistent with the Low Density Sewered Residential Land Use designation for the property. The Comprehensive Plan was approved by Metropolitan Council on August 14, 2002. 2. The proposed use is or will be compatible with present and future land uses of the area. Comment: The proposed R -1X single family residential zoning is consistent with existing and proposed land uses of the area. The proposed gross development density of 1.30 units per acre provides for a suitable transition from surrounding large lot residential developments. 3. The proposed use conforms with all performance standards contained herein. Comment: The proposed residential subdivision is in conformance with all applicable performance standards. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Comment: The proposed use can be accommodated by existing public services. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. Comment: The proposed use will require the installation of left and right turn lanes on Birch Street (CSAH 10) at Pheasant Hills Drive and Sherman Lake Road. The developer will be responsible for making these improvements. Environmental Board. The City's Environmental Board reviewed the request on March 27, 2002 and June 26, • 2002 and recommended denial of the request due to excessive wet characteristics of the Stoneybrook Page 9 • • site, and incomplete information needed to process the plat. Note: All information required has been submitted by the developer. They also submitted recommendations to consider if the proposal is approved. These comments are attached and, where applicable, have been incorporated in this report. Planning and Zoning Board The Planning and Zoning Board held a public hearing and reviewed the proposal at its July 10, 2002 regular meeting. The Board recommended approval of the Rezoning and Preliminary Plat with the conditions included in the staff recommendation. The Board also recommended approval of the MUSA allocation with the following conditions: a. Allocation of MUSA shall be subject to the approval of the City's 2001 Comprehensive Plan by the Metropolitan Council. b. That the City demonstrates the need, consistent with the Comprehensive Plan, for the growth population numbers of 3.47 people per home, including the census data of homes built from 2000 to current, as well as what's included in already approved homes for the lot inventory. RECOMMENDATION Based on the findings contained in this report and subject to the conditions listed below, staff recommends the following: A. Approval of the MUSA Allocation subject to the following conditions: 1. The development shall be accordance with the approved phasing plan consisting of 52 lots in 2002 and the remaining lots in 2003. B. Approval of the Rezoning from R, Rural District to R -1X, Single Family Executive District subject to the following conditions: 1. The Rezoning shall not be effective until 30 days following publication of the ordinance. C. Approval of the Preliminary Plat subject to the following conditions: 1. The MUSA Allocation and Rezoning are approved. 2. A revised preliminary plat shall be submitted containing the following modifications: a. The proposed Street B cul -de -sac shall be extended to the easterly property line and modified to reduce the impact on Lot 46, Block 8. c. Soils imported to the site, if any, shall be subject to approval by the City Engineer. 4. The developer shall provide a cash payment in lieu of park dedication. 5. The developer shall provide the City with a Homeowner's Association agreement including an operation and maintenance agreement for the wetland signage and buffer areas. 6. Developer shall prepare a Best Management Practices/Environmental Information brochure with regard to buffer and wetland area requirements. 7. The developer shall submit a revised landscaping plan showing proposed landscaping on northeasterly and westerly property lines. 8. The developer shall provide a Warranty Deed or otherwise dedicate the Outlots to the City of Lino Lakes. The conveyance of outlots shall not constitute satisfaction of the park dedication requirements. 9. The developer shall provide conservation easements covering all proposed wetland buffer areas. 10. The developer shall provide dedicated right -of -way or permanent easements covering all proposed temporary cul -de -sacs. 11. The Developer shall provide signage identifying wetlands and wetland buffer areas. 12. The Developer shall install signage at the end of temporary cul -de -sacs indicating the future extension of such streets. 13. A phasing plan shall be implemented. Phase 1 development shall be limited to fifty -two (52) lots in 2002. Phase II development will consist of the remaining lots in 2003. Nothing herein shall prevent the grading of the entire site in one phase. 14. All modifications as required by the City Engineer shall be satisfied. 15. All required improvements of Birch Street (CSAH 10), as set forth by Anoka County, shall be the responsibility of the developer. 16. The Park Board looked at several alternatives including: 1. Acquire land for a park along the eastern edge of the development. This may be able to be connected to additional parkland that is acquired as the property to the east is developed. However it appears the St. Paul Water Utility Easement would make this difficult. Also, it is our understanding that substantial wetlands are located to the east of the Stoneybrook Plat. 2. Acquire two lots to provide a small park area for playground equipment. However, the Park Board didn't want to simply acquire, "less than one -acre park areas," as each development is created. 3. Designate the recreation complex as the park to service the residents in.the Stoneybrook D evelopment. The recreation complex will provide some leisure opportunities for informal play such as playground e q ui ment basketball and tennis. However, the recreation compek will be used very intensely by all residents. If the upcoming referendum is unsuccessful, the recreation complex will most likely not be developed. When the Comprehensive Park and Trail System Plan was developed, the Stoneybrook property was located outside the anticipated urban development limits. Therefore, the Park Board has not had an opportunity to analyze the parks and trails needs for this area of the city. Without the ability to look at "big picture" it is difficult to determine how this 78 -acre development will fit within the city's overall, long -range parks and trails plan. Therefore the Park Board is recommending 100 percent cash dedication. The submittal included an eight -page revised drawing set dated June 3, 2002, item by item response letter to city comments plus exhibits dated May 29, 2002, supplemental letter dated May 31, 2002, and revised fire flow documentation dated June 10, 2002, for the proposed Stoneybrook Subdivision has been performed. The design generally meets City requirements. The following comments must be addressed prior to final approval given for this subdivision: Watermain: Watermain lines are to be Class 52 ductile iron pipes in final specifications. The City of St. Paul requirements for crossing the aqueduct must be submitted. Confirmation of adequate water system supply is under review. City will confirm size of watermain extension to the west boundary at Birch Street. Utilities shall be extended to the project's south boundary in Street G. The submittal meets all remaining design standards required by the City of Lino Lakes. Upon receiving the plans and specifications for the project, the specific details of materials, construction standards, and testing requirements will be reviewed. Sanitary Sewer: The sanitary sewer crossings of the watermain are to show at least 18 inches of vertical separation in final plans. The pond detail submitted show a 10 foot, 10:1 side slope bench. This detail need to be corrected and the proposed pond adjusted to a 15 foot wide bench. The pond detail has been revised to show a 15 -foot, 10:1 side slope bench. 5. The supporting information, soil types, and land use, used to determine the curve numbers needs to be submitted. Supporting information was included in the response letter. 6. An SCS TR -55 method should be used to determine the Time of Concentrations, not the Lag method. Response letter reiterates the Time of Concentration from the HydroCAD Model, which was a Lag method computation. An SCS TR -55 method is the preferred method to calculate Time of Concentrations. 7. Pond 6 is landlocked, according to the model. The 100 -year flood elevation for the pond will need to be determined allowing for a 100 -year snowmelt, 10 -day runoff of 7.2 inches and a Curve Number of 100. The flood elevation has been revised to reflect a 100 -year, l0 -day snowmelt situation. The supporting computations need to be submitted. • • • Drainage Review Page 3 July 3, 2002 for Stoneybrook 8. Groundwater information was not provided. The City's Local Water Management plan calls for the minimum floor elevation, including basement to be 4 feet above the groundwater, 4 feet above the normal water level, or 2 feet above the 100 -year flood elevation, whichever is greatest. As proposed, the plat will introduce two (2) new city streets south of CSAH 10. These streets will line up directly opposite the existing city streets of Pheasant Hills Drive and Sherman Lake Road, which is acceptable to this department. However, we are concerned with the increase in the number of turning maneuvers which will occur at both intersections. As CSAH 10 is a high -speed route (55 mph), and if vehicular conflicts occur at either intersection as a result of this development, they are likely to be severe in nature. Currently on CSAH 10, there is a westbound right turn lane and an eastbound bypass lane at Pheasant Hills Drive, and a westbound right turn lane at Sherman Lake Road. With the introduction of the south leg of Pheasant Hills Drive with this development, the eastbound CSAH 10 bypass lane will no longer be an acceptable measure to handle traffic at the intersection. In addition, the Anoka County Highway Department has recently had a change in philosophy regarding the accommodation of county highway needs in conjunction with new development. This section of CSAH 10 was recently overlayed by this department, and no capital improvement projects are scheduled or planned to occur within the next five (5) years. Since this development will introduce a significant number of turning maneuvers at the intersections of Pheasant Hills Drive and Sherman Lake Road, the city and /or the developer will be required to make improvements to' the county highway so that there will be left, thru and right turn lanes for eastbound and westbound CSAH 10 at both intersections. The design details for this turn lane construction will need to be reviewed and approved by this department, prior to the issuance of any permits for the new access points or permits for work within the county right -of -way. No driveways will be permitted onto CSAH 10, and all access for this development shall be made via Pheasant Hills Drive and Sherman Lake Road. The right -of- access along CSAH 10 shall be dedicated to Anoka County, with exceptions at the two (2) new local roadways. It appears that there are sight distance obstructions at both new intersections on CSAH 10. The city and /or the developer shall ensure that the applicable sight distance requirements are met to the greatest extent possible for this development. Drainage calculations and detailed grading, drainage and erosion control plans are required and must be submitted to this department for review and approval. The post - developed rate /volume of discharge shall not exceed the pre - developed rate /volume of discharge for the 10 -year frequency storm, utilizing the "SCS Method" of design. If culverts are required within the county right -of -way, they shall include 6:1 safety grates and aprons. If any trails are to be constructed along CSAH 10 in conjunction with this development, the design and location of the trail within the county right -of -way shall be reviewed and approved by this department. It should be noted that residential land use adjacent to highways will usually result in complaints regarding traffic noise. Traffic noise at this location could exceed Noise Standards established by the U.S. Department of Housing and Urban Development and the Minnesota Pollution Control Agency. Anoka County policy regarding new developments adjacent to existing county highways prohibits the expenditure of highway funds for noise mitigation measures. The city and /or the developer should assess the noise situation and take any action deemed necessary to minimize associated impacts at this site from any traffic noise. A permit is required and must be obtained prior to the commencement of any construction. License Permit Bonding, Method of Construction, Design Details, Work Zone Traffic Control, Restoration Requirements and Follow -up Inspections are typical elements of the permitting process. Please contact Roger Butler, Traffic Engineering Coordinator, or Josie Scott, Permit Technician for further information regarding the permit process. Please not that we are concerned with the safety issues that may occur on CSAH 10 as a result of this development. In the past, the neighborhoods along CSAH 10 have been rather vocal in voicing their concerns about this corridor. This review is based on the following attached exhibits: 1. General Location Map 2. Certificate of Survey 3. Applicant Narrative ( "Variance for 1487 Ash St/Finding of Facts ") ANALYSIS The attached Certificate of Survey shows the proposed division of the 29 -acre parcel. Parcel B, approximately 18 acres, contains Mr. Bachman's home, outbuildings and agricultural fields; parcel A, approximately 11 acres, contains the balance of the property. The applicants report they plan to site a home fronting Ash Street and keep the northern 10 acres in agriculture, thereby qualifying for Green Acres status. City Council Meeting Bachman Minor Subdivision & Variance August 26, 2002 The site is almost completely in agriculture at this time, excepting the area immediately surrounding the existing house and outbuildings and the pond/drainage area at the southeastern corner of the property. Both parcels would meet this requirement. Width: the minimum lot width for property in a Rural zone is 330 feet. Lot width is defined in the Lino Lakes Zoning Ordinance as "the horizontal distance between the side lot line of a lot measured at the building setback line and parallel to the front lot line." Additionally, the Subdivision Ordinance, Section 1001.08, subd. 6, requires that "all lots shall abut for their full frontage on a publically dedicated street." Parcel A, at 221.6 feet, does not meet the minimum lot width requirement, and as a result the applicant is asking for a Variance. With less than the required 330' of lot width, then, Parcel A also does not fulfill the requirement of having full frontage on a road. Easements & Right -of -Way All created lots are required to be covered by drainage and utility easements. The applicant will need to dedicate drainage and utility easements to the City in accordance with Lino Lakes Subdivision Ordinance Section 1001.08, subdiv. 4. Such easements shall be five feet in width along rear and side property lines, ten feet in width along front property lines, and cover all ponding and wetland areas. In addition, street right -of -way dedication will be required according to the Lino Lakes Subdivision Ordinance Section 1001.08, subdiv. 10. Buildable Area Lino Lakes City Ordinance Section 3, subd. 3.B.1.b. requires Rural parcels of 10 acres or more to have at least 20% upland area. Both parcels meet this requirement, as there are 2 City Council Meeting Bachman Minor Subdivision & Variance August 26, 2002 • wetlands and/or drainage easements only in the far southeast corner of the proposed 18- acre parcel. Septic Issues Soils tests confirm that the proposed 11 -acre parcel is capable of accommodating a septic system. In addition, there is adequate room for both primary and secondary sites. The 18- acre parcel already contains a septic system, with adequate room for a secondary site. Access Issues The existing 29 -acre parcel contains an access drive onto Ash Street. A second access drive will be required for the proposed 11 -acre parcel. As Ash Street is a County road, plans have been forwarded to the Anoka County Highway Department for review and approval. Future Implications It should be noted, that while the property is Rural now, development is likely at some point in time once utilities become available — post 2010, since this is a Stage 2 Growth Area. In terms of long range planning, ensuring that lot dimension requirements are maintained now will help ensure the orderly facilitation of that probable future development. For example, the area north of the proposed home site is likely to be subdivided at some future time. At such a time, room for road access then becomes a vital issue. In this case, siting a home in the middle of a lot having only 221 feet of width/road frontage may preclude the possibility of servicing the area north of the proposed home with future road access (a home and attached garage measuring 50 feet, sited in the middle of a 221 -foot lot, does not leave enough room on either side for 66 feet of road width and setbacks...). Future road access across the second proposed lot (Parcel B) may also be problematic, as there appears to be only approximately 50 -60 feet between the existing home and the edge of a pond/wetland area at the southeastern corner of the property. Maintaining the required minimum lot width of 330 feet would preclude such future problems. Section 3, subdiv. 3.A.2.b.5 of the Lino Lakes Zoning Ordinance addresses such issues when it states: "All subdivisions in areas without public sanitary sewer shall be designed such that the larger non -sewer lots can be resubdivided to provide smaller sewered lots when sewer becomes available in the future. Homes and accessory buildings shall be located on these lots so as to allow for future resubdivisions." Additionally, utility availability is often financially feasible only when shared among a group of property owners. Thus, limiting future development possibilities in ways such City Council Meeting Bachman Minor Subdivision & Variance August 26, 2002 • as are described above, may limit future utility availability for other property owners along Ash Street by limiting the number of future lots to pay for it. • • FINDINGS FOR VARIANCE In considering all requests for Variance and in taking subsequent action, the City shall make a finding of fact: 1. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. Comment: The property has been, and currently is, being put to reasonable use for agricultural purposes. 2. That the plight of the landowners is due to physical circumstances unique to his property and not created by the landowner. Comment: There is no unique physical circumstance existing on the property; there is simply not enough width and road frontage to meet the minimum lot requirements for a property in the Rural zone, as established under City Ordinance. 3. That the hardship is not due to economic considerations alone and when a reasonable use for the property exists under the terms of the ordinance. Comment: There is no hardship demonstrated or apparent; the lot simply does not meet the minimum lot requirements for a property in the Rural zone. 4. That granting the Variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. Comment: Granting a Variance without the demonstration of hardship or unique physical circumstances would confer special privilege upon the applicant. It should be noted that other parcels along Ash Street which do not meet minimum lot width requirements exist as lots of record, and did not require a Variance from the City Zoning Ordinance for their creation (NOTE: the property which Mr. Bachman references, at 1573 Ash Street, is such a lot of record). 5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. City Council Meeting Bachman Minor Subdivision & Variance August 26, 2002 Comment: The proposed action would not be in keeping with the spirit and intent of the Ordinance, as variances are to be granted only in cases where hardship /unique physical circumstances are present. CONCLUSION The creation of the proposed 11 -acre parcel will not satisfy the 330' lot width requirement for property located in a Rural zone, and thus will also not yield full frontage on a street, as required under the Lino Lakes Ordinance. For these reasons, staff cannot recommend approval of the Minor Subdivision. As there are no hardship issues demonstrated or unique physical circumstances apparent on the property, staff cannot recommend approval of the Variance from the minimum lot width requirements. P & Z RECOMMENDATION The above report was presented at the August 14, 2002 meeting of the Planning & Zoning Board. MEETING DATE: August 26, 2002 TOPIC: Minor Subdivision for property located at 900 Oak Lane Mary Zehowski ACTION REQUIRED: 3/5 vote BACKGROUND Mary Zehowski is applying for a Minor Subdivision of 30 acres, zoned Rural, at 900 Oak Lane. Although the minimum lot size for property in a Rural zone is 10 acres, Ms. Zehowski is seeking to create a 2.5 -acre parcel and a 27.5 -acre parcel, as allowed under Section 3, subd. 3.A.2.b.2 of the Lino Lakes City Code: "Habitable single family homes constructed prior to July 13, 1992 may reduce their lot size to a minimum of one acre if the balance of the property results in a parcel of ten acres, or is serviced by public sewer, and it can be demonstrated by means satisfactory to the City that the division will not result in ground water, soil, or other contamination which may endanger the public health." This review is based on the following attached exhibits: 1. General Location Map II, 2. Certificate of Survey, dated August 5, 2002 • • City Council Meeting Zehowski Minor Subdivision August 26, 2002 ANALYSIS The attached Certificate of Survey shows the proposed division of the 30 -acre parcel. Parcel A, 2.5 acres, contains an existing house and garage, of which 51.7% is upland; Parcel B, 27.5 acres, contains the balance of the property, of which 28.1 % is upland. Width: the minimum lot width for property in a Rural zone is 330', and both lots will meet this requirement. In addition, both lots will have full frontage on a road, as required under the Lino Lakes Subdivision Ordinance, Section 1008.08, subdiv. 6, which states that "all lots shall abut for their full frontage on a publicly dedicated street." Easements and Right -of -Way All created lots are required to be covered by drainage and utility easements. The applicant will need to dedicate drainage and utility easements to the City in accordance with Lino Lakes Subdivision Ordinance Section 1001.08, subdiv. 4. Such easements for shall be five feet in width along side property lines, ten feet in width along front and rear property lines, and cover all ponding and wetland areas. In addition, street right -of -way dedication will be required according to the Lino Lakes Subdivision Ordinance Section 1001.08, subdiv. 10. City Council Meeting Zehowski Minor Subdivision August 26, 2002 Buildable Area Lino Lakes City Ordinance Section 3, subd. 3.B.1.b requires parcels requiring a minimum of 10 acres or more to have a minimum of 20% upland area. Much of this property is wetland, and as a result, it was necessary for the applicant to delineate wetland boundaries. Results of that delineation indicate that both lots meet the minimum upland requirement, with Parcel A at 51.7% upland and Parcel B at 28.1% upland. Septic Issues Soils tests confirm that there are soils on both the proposed parcels capable of accommodating a septic system, with enough room for both primary and secondary sites. Property Boundaries/Encroachment Issues The western property boundary of the parcel is currently being confirmed, as it appears some of the outbuildings belonging to the property are actually sited on the neighboring property. City Attorney Bill Hawkins has advised that such issues should not interfere with the processing of the application for a Minor Subdivision, and should be handled as a separate issue. CONCLUSION The proposed Minor Subdivision would result in two lots: Parcel A, although under 10 acres, conforms to Section 3, subd. 3.A.2.b.2 of the Lino Lakes Zoning Ordinance, and otherwise meets all the minimum lot requirements for property in a Rural zone; Parcel B meets all minimum lot requirements for property in a Rural zone. As a result, staff would recommend approval of the Minor Subdivision with the following conditions: 1.) A park dedication fee of $1,665, to be paid prior to the certification and recording of the Minor Subdivision. 2.) The applicant shall dedicate to the City drainage and utility easements measuring ten feet in width along the front and rear property lines, five feet in width along the side property lines, and covering all ponding and wetland areas. Gor -Em, LLC, the Developer, is now requesting to approval to begin construction of improvements to complete the final phase of the development, to be known as Clearwater Creek 5th Addition. Clearwater Creek 5th Addition consists of 54 single family residential lots. In accordance with the preliminary plat approval and City policy staff has prepared a Development Agreement. The agreement provides for the following: 1. Submittal by the developer of a Letter of Credit in the amount of $906,850.00 representing 150% percent of the development improvement costs to insure completion of the project in accordance with the approved plans. 2. Submittal by the developer of a Letter of Credit in the amount of $117,355.00 representing 35% of the costs to be assessed for the project. 3. Deposit of a cash escrow in the amount of $139,400.00 to reimburse the City for costs incurred by the City related to the development and improvement of the site and developer improvements. WHEREAS, the Developer has received approval from the City Council for a plat of land within the corporate limits of the City known as Clearwater Creek Fifth Addition, hereinafter called "Subdivision ", said land is legally described to -wit Outlot B and C of Clearwater Creek 4th Addition; and WHEREAS, the Developer requested that the City construct and finance certain improvements to service the plat; and WHEREAS, the Developer is to be responsible for the installation and financing of certain private improvements within the plat; and WHEREAS, Minnesota Statute 429 provides a method for assessing the cost of City installed improvements to the benefited property. Improvements to be installed by the City and financed by the Developer are hereinafter referred to as "City Improvements ". II. DEVELOPER'S IMPROVEMENTS A. The Developer's Engineer shall prepare, at the Developer's expense, a grading plan, preliminary street and utility plan, a surface water management plan. The Developer shall secure a contractor to install these improvements, said contractor shall be approved by the City at its ABSOLUTE discretion. All Developer improvements shall require City inspection and approval and, where appropriate, the approval of any other governmental agency having jurisdiction. The Developer will construct and install at Developer's expense the following improvements according to the following terms and conditions: 1. Grading Plan a) A final site grading plan, including certified wetland delineation, with maximum two foot contours and cross sections as necessary shall be submitted and approved by the City prior to commencement of any site grading. b) Other items as listed in the Open Space Management Plan (Attachment C). 2. Erosion Control Plan a) The Developer shall submit an erosion control plan, detailing all erosion control measures to be implemented during construction. Said plan shall be approved by the City prior to the commencement of site grading or construction. b) The Developer shall submit a Turf Establishment Plan which details topsoil placement, seeding, sodding, mulching, fertilizing and watering. Said plan shall be approved by the City prior to the commencement of site grading or construction. 3. Tree Preservation Plan page 2 • • • Development Contract Clearwater Creek 5th Addition a) Developer will provide a tree preservation plan prior to final plat approval which shall be in accordance with the City Tree Preservation Policy and the Open Space Management Plan (Attachment C). Developer shall plant a boulevard tree for each side of a lot which abuts a street. Species, size and location shall be determined by the City Forester. Said plan shall be approved by the City and implemented prior to the commencement of site grading or construction. b) The Developer shall remove, dispose of, or treat all dead and diseased trees in accordance with the City Forester's recommendation before building permits will be issued. 4. Grading and Erosion Control Construction & Maintenance a) Prior to the commencement of site grading and erosion control, the Developer shall complete items II.A.l, II.A.2, and II.A.3 as listed above. b) The Developer shall grade the site to within 0.2 foot of the grades shown on the approved Grading plan. No deviations will be allowed unless a revised plan is submitted and approved by the City and all other regulatory agencies. c) All development shall conform to the natural limitations presented by the topography and soil of the subdivision in order to create the best potential for preventing soil erosion. d) Erosion and siltation control measures shall be coordinated with the different stages of development. Appropriate control measures as required by the City shall be installed prior to development when necessary to control erosion. e) Land shall be developed in increments of workable size such that adequate erosion and siltation controls can be provided as construction progresses. The smallest practical area of land shall be exposed at any one period of time. f) Where the topsoil is removed, sufficient arable soil shall be set aside for respreading over the developed area. The topsoil shall be restored to a depth of at least four (4) inches and shall be of a quality at least equal to the soil quality prior to development. g) The Developer shall install four (4) inches of topsoil on all boulevards and seed or sod as approved by the City. The Developer page 3 Development Contract Clearwater Creek 5th Addition • shall make all necessary adjustments to the curb stops to bring them flush with the topsoil prior to occupancy. • • h) All disturbed areas shall be seeded. i) The front 50 feet of the lots, the street right -of -way, storm water storage ponds, and surface water drainage ways shall be graded prior to commencement of utility construction. j) Drainage swales, ditches, storm water storage ponds and other high risk erosion areas shall be protected from erosion. k) All remaining grading must be completed prior to issuance of building permits. 1) Protect streets from erosion deposits. This should include a combination of roadside silt fences, roadside sod strips, catch basin rock bale inlet protection, rock construction entrances, straw mulch, and/or street sweeping. m) The developer's engineer shall certify, in writing, that all grading complies with the grading plan. 5. Final street grading, subbase, gravel base, bituminous binder course, and concrete curb and gutter. 6. Park trail grading, subbase, gravel base, and bituminous surfacing. If required, installation of boardwalk trails or acceptable substitute or prefabricated walkway panels. 7. Storm sewers when determined to be necessary by the City Engineer, including all necessary laterals, catch basins, inlets and other appurtenances. 8. Sanitary sewer, laterals or extensions, including all necessary building services and other appurtenances. 9. Water, laterals or extensions, including all necessary building services, hydrants, valves and other appurtenances. 10. The Developer shall place iron monuments at all lot and block corners and at all other angle points on boundary lines. Iron monuments shall be placed after all street and lawn grading has been completed in order to preserve the lot markers for future property owners. Lot corner irons on the back property line shall be installed so that the top of the iron corresponds to the finished ground elevation in accordance with the approved grading plan - guard stakes shall be appropriately installed to mark these irons. page 4 • • • Development Contract Clearwater Creek 5th Addition 11. The Developer agrees to maintain, at all times before acceptance of the streets by the City, an access road suitable for use by emergency, police and fire department equipment. The adequacy of such road shall be the sole determination of the City. Furthermore, such access road shall be located no more than 150 feet from any structure built within the subdivision. 12. The Developer shall be responsible for street and storm sewer maintenance, including curbs, boulevards, sod and street sweeping, ditch cleaning and pond dredging until the project is compete and accepted by the City. 13. The Developer shall only be responsible for such maintenance until completion of the subdivision if caused by Developer, its purchasers, builders or contractors. Warning signs shall be placed when hazards develop in streets to prevent the public from traveling on same and directing attention to detours. If and when the streets become impassable, such streets shall be barricaded and closed. The developer shall maintain a smooth, hard driving surface and adequate drainage on all temporary streets. The Developer shall promptly clear dirt and debris resulting from construction by the Developer, its agents or assigns within five (5) days after notification by the City. 14. Street Lighting: a) Residential street lighting shall be owned by the City. Such street lighting system shall be installed, operated, and maintained by the electric utility company. City and electric utility company may enter into a contractual agreement on the rate and maintenance of the street lighting system. b) It shall be the responsibility of the Developer to pay for street lighting operation charges for the initial 15 months of operation of the system. 15. The Developer shall dedicate to the City, prior to approval of the final plat, at no cost to the City, all permanent or temporary easements necessary for the construction and installation of the Developer's Improvements as determined by the City. All such easements required by the City shall be in writing, in recordable form, containing such terms and conditions as the City shall determine. 16. The Developer shall be responsible for securing all site grading and development approvals and permits from all appropriate Federal, State, Regional and Local jurisdictions prior to the commencement of site grading or construction and prior to the City awarding construction contracts for public utilities. page 5 • • • Development Contract Clearwater Creek 5th Addition 17. The Developers shall make provision that all gas, telephone, cable TV and electric utility designs be submitted to the City for review and approval prior to construction of the streets. Following review and approval by the City, the Developer shall insure that all installation comply with applicable City, County and State design standards and show proof of security arrangements with said utility companies. 18. Cost of Developer's Improvements, description and completion dates are as shown on Attachment A. 19. Construction of Developer's Improvements: a) The construction, installation, materials and equipment shall be in accordance with the plans and specifications approved by the City. b) All of the work shall be under and subject to the inspection and approval of the City and, where appropriate, any other governmental agency having jurisdiction. c) Prior to the acceptance of Developer Improvements by the City, the Developer shall obtain final plat approval and record the final plat which will dedicate all permanent easements necessary for the construction and installation of the Developer's and City's Improvements as determined by the City. d) All Construction debris and trash shall be properly disposed of at the developers expense and in a timely manner as determined by the City. 20. Guarantee a) Faithful Performance of Construction Contracts and Letters of Credit (1) The Developer will fully and faithfully comply with all terms and conditions of any and all contracts entered into by the Developer for the installation and construction of all Developer's Improvements and hereby guarantees the workmanship and materials for a period of one year following the City's final acceptance of the Developer's Improvements. Concurrently with the execution hereof by the Developer, the Developer will furnish to, and at all times thereafter maintain with the City, a cash deposit, certified check, or Irrevocable Letter of Credit, based on one hundred fifty (150 %) percent of the total estimated cost of Developer's Improvements. An Irrevocable Letter of Credit page 6 • • • Development Contract Clearwater Creek 5th Addition shall be for the exclusive use and benefit of the City of Lino Lakes and shall state thereon that the same is issued to guarantee and assure performance by the Developer of all the terms and conditions of this Development Contract and construction of all required improvements in accordance with the ordinances and specifications of the City. The City reserves the right to draw, in whole or in part, on any portion of the Irrevocable Letter of Credit for the purpose of guaranteeing the terms and conditions of this contract. The Irrevocable Letter of Credit shall be automatically extended for additional periods of one year from present or future expiration dates unless thirty (30) days prior to such the City Clerk or Administrator is notified in writing by certified mail that the Letter of Credit will not be renewed. b) Reduction of Escrow Guarantee. (1) The Developer may request reduction of the Letter of Credit, or cash deposit based on prepayment or the value of the completed improvements at the time of the requested reduction. Prior to the final acceptance of the Developer's Improvements the City shall require a Performance Bond or Cash Escrow to cover the warranty provisions of the agreement. The amount shall be determined by the City Engineer. III. CITY'S IMPROVEMENTS A. The City shall install the following described improvements to serve the Subdivision on the terms and conditions herein set forth: 1. Storm sewer trunks. 2. Sanitary sewer trunks. 3. Water trunks. 4. Final wear course. B. Construction Procedures 1. All City improvements above shall be instituted, constructed and financed as follows: The City shall commence proceedings pursuant to Minnesota Statute 429 and City Charter providing that such improvements be made and assessed against the benefited properties. After preparation of preliminary plans and estimates by the City Engineer, an improvement hearing, if page 7 Development Contract Clearwater Creek 5th Addition required by law, will be called by the City Council for the purpose of ordering such City Improvements. After preparation of the final plans and specifications by the City Engineer, bids will be taken by the City and contract awarded for the installation of City Improvements under the City's complete supervision. C. Security, Levy of Special Assessments and Required Payment Therefore. 1. Prior to the preparation of final plans and specifications for the construction of said City Improvements, the Developer shall provide to the City a cash escrow or letter of credit in an amount equal to thirty -five (35 %) percent of the total estimated assessments as established by the City Engineer. (See Attachment B) 2. Said letter of credit or cash escrow including accrued interest thereon, may be used by the City upon default by Developer in the payment of special assessments pursuant hereto, whether accelerated or otherwise. That such cash escrow or letter of credit shall remain in full force and effect throughout the term of the special assessments, except, the amount of such escrow or letter of credit may be reduced, upon the request of the Developer, at the City's option, but in no event shall be less than 35% of the outstanding special assessments against all properties within the Subdivision. The entire cost of the installation of such City Improvements, including any reasonable engineering, legal and administrative costs incurred by the City, shall be assessed against the benefited properties within the Subdivision in accordance with City policy existing the date of this agreement, in equal annual principal installments plus interest on the unpaid installments at a rate not to exceed the maximum allowed by law. 3. All special assessments levied hereto shall be payable to the City Clerk in semi -annual installments over fifteen (15) years commencing on April 15 of the year after the levy of such assessment and on each September 15 and April 15 thereafter until the entire balance plus accrued interest is paid in full unless paid earlier. In the alternative, the City, at its option, may certify the entire assessment roll to the Anoka County Auditor for collection with the Real Estate Taxes. In the event any payment is not made on the dates set out herein, the City may exercise its rights granted hereunder for such default. The Developer waives any and all procedural and substantive objections to the installation of the City Improvements and the special assessments, including but not limited to hearing requirements and any claim that the assessments exceed the benefit to the property. In the event the total of all City Installed Improvements is less than originally estimated by the City Engineer in his feasibility report, Developer waives any appeal rights otherwise available pursuant to M.S.A. 429.081. page 8 • • • Development Contract Clearwater Creek 5th Addition D. Required Payments of Special Assessments by Developer. 1. Developer, its heirs, successors or assigns hereby agrees that within thirty (30) days after the issuance of a certificate of occupancy for a residence on a lot located within the Subdivision which is assessed for the cost of such City Improvements, the Developer, its heirs, successors or assigns, agrees, at its own cost and expense, to pay the entire unpaid City Improvement Costs assessed or to be assessed under this agreement against such property. 2. If a certificate of occupancy is issued before the special assessments have been levied, the Developer, its heirs, successors or assigns shall pay the City the sum of cash equal to one hundred twenty percent (120 %) of the Engineer's estimate of the special assessments for such City Improvements that would be levied against the property. Upon such payment the City shall issue a certificate showing the assessments are paid in full. Notwithstanding the issuance of said certificate, the Developer shall be liable to the City for any deficiency and the City shall pay the Developer any surplus arising from the payment based upon such estimate. Developer will be paid interest on all assessments paid before the levy of such assessments by the City at the bond interest rates paid by the City. E. Acceleration Upon Default. 1. In the event the Developer violates any of the covenants, conditions or agreements herein contained to be performed by the Developer, violates any ordinance, rule or regulation of the City, County of Anoka, State of Minnesota or other governmental entity having jurisdiction over the plat, or fails to pay any installment of any special assessment levied pursuant hereto, or any interest thereon, when the same is to be paid pursuant hereto, the City at its option, in addition to its rights and remedies hereunder, after ten (10) days' written notice to the Developer, may declare all of the unpaid special assessments which are then estimated or levied pursuant to this agreement due and payable in full, with interest. The City may seek recovery of such special assessments due and payable from the security provided herein. In the event that such security is insufficient to pay the outstanding amount of such special assessments plus accrued interest the City may certify such outstanding special assessments in full to the County Auditor pursuant to M.S. 429.061, Subd. 3 for collection the following year. The City, at its option, may commence legal action against the Developer to collect the entire unpaid balance of the special assessments then estimated or levied pursuant hereto, with interest, including reasonable attorney's fees, and Developer shall be liable for such special assessments and, if more than one, such liability shall be joint and several. Also, if Developer violates any term or condition of this agreement, or if any payment is not made by Developer pursuant to this agreement the City, at its option, may refuse to issue page 9 Development Contract Clearwater Creek 5th Addition . building permits to any of the property within the plat on which the assessments have not been paid. • • IV. RECORDING AND RELEASE A. The Developer agrees that the terms of this Development Contract shall be a covenant on any and all property included in the Subdivision. The Developer agrees that the City shall have the right to record a copy of this Development Contract with the Anoka County Recorder to give notice to future purchasers and owners. This shall be recorded against the Subdivision described on Page 1 hereof. City shall provide to Developer upon payment of all the special assessments levied against a parcel a release of such parcel from the terms and conditions of this Development Contract subject to provisions contained in this contract. V. REIMBURSEMENT OF COSTS A. The Developer agrees to establish a non - interest bearing escrow account with the City in an amount determined by the City Administrator or his designee for the payment of all costs incurred by the City related to the development of the plat and the Developer Improvements including, but not limited to, the following (See attachment B for Breakdown of costs): 1. If the above escrow amounts are insufficient, the developer shall make such additional deposits as required by the City. The City shall have a right to reimburse itself from the Escrow. VI. BUILDING PERMITS A. The Developer agrees that building permits may be issued upon approval of the Final Plat by the City Council at which time all required Financial Security shall be in place with the City. B. The Developer further agrees that City Sewer, Water, Storm Sewer, and Bituminous Base Construction of the Streets, temporary street signs, gas, electric, and telephone will be completed prior to the issuance of building permits. VII. HOURS OF CONSTRUCTION ACTIVITY A. All construction activity shall be limited to the hours set out in City Ordinances as follows: Monday through Friday 7:00 a.m. to 7:00 p.m. Saturday 9:00 a.m. to 5:00 p.m. Sunday and Holidays No working hours allowed VIII. OWNERSHIP OF IMPROVEMENTS A. Upon completion of the work and construction required by this contract and acceptance by the City, the improvements lying within the public easements shall become City property without further notice or action. IX. INSURANCE A. Developer or all its subcontractors shall take out and maintain until one (1) year after the City has accepted the private improvements, public liability and property damage insurance covering personal injury, including death, and claims for property damage which may arise out of the Developer's work or the work of his subcontractors or by one directly or indirectly employed by any of them. Limits for bodily injury and death shall be not less than Five Hundred Thousand and no /100 ($500,000.00) Dollars for one person and One Million and no /100 ($1,000,000.00) Dollars for each occurrence; limits for property damage shall be not less then Two Hundred Thousand and no /100 ($200,000.00) Dollars for each occurrence; or a combination single limit policy of One Million and no /100 ($1,000,000.00) Dollars or more. The City, its employees, its agents and assigns shall be named as an additional insured on the policy, and the Developer or all its subcontractors shall file with the City a certificate evidencing coverage prior to the City signing the plat. The certificate shall provide that the City must be given ten (10) days advance page 11 Development Contract Clearwater Creek 5th Addition 41, written notice of the cancellation of the insurance. The certificate may not contain any disclaimer for failure to give the required notice. • X. REIMBURSEMENT OF COSTS FOR DEFENSE A. The Developer agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this contract, or any portion thereof, including court costs and reasonable engineering and attorneys' fees if the City prevails in such action. XI. VALIDITY A. If a portion, section, subsection, sentence, clause, paragraph or phrase in this contract is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect or void any of the other provisions of the Development Contract. XII. GENERAL A. Binding Effect 1. The terms and provisions hereof shall be binding upon and insure to the benefit of the heirs, representatives, successors and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Subdivision and shall be deemed covenants running with the land. B. Notices 1. Whenever in this agreement it shall be required or permitted that notice or demand be given or served by either party to this agreement to or on the other party, such notice or demand shall be delivered personally or mailed by United States mail to the addresses hereinbefore set forth on Page 1 by certified mail (return receipt requested). Such notice or demand shall be deemed timely given when delivered personally or when deposited in the mail in accordance with the above. The addresses of the parties hereto are as set forth on Page 1 until changed by notice given as above. C. Final Plat Approval 1. The city agrees to give final approval to the plat of the Subdivision and MUSA allocation of 20.8 acres upon execution and delivery of this agreement and of all required petitions, bond and security. XIII. VIOLATIONS/BUILDING PERMITS A. In the event that Developer violates any of the covenants and agreements contained in this Development Contract and to be performed by the Developer, the City, at its page 12 • • • Development Contract Clearwater Creek 5th Addition option, in addition to the rights and remedies as set out hereunder may refuse to issue building permits to any property within the plat until such time as such default has been corrected to the satisfaction of the City. XIV. PARK DEDICATION A. Park dedication for Clearwater Creek Fifth Addition shall consist of: 1. All trails. 2. Paving of the trails with bituminous surface at Developer's cost. 3. Conveyance of Outlot A, Clearwater Creek 5th Addition to the City of Lino Lakes. B. Should the recording of the Final Plat occur after July 1, any and all property taxes on any public property dedicated as a part of this plat shall be the responsibility of the developer. Dollars shall be incorporated into the escrow agreement to cover the cost of said property taxes. XV. OPEN SPACE MANAGEMENT PLAN A. A wet mixture will be seeded near the NWL and a mesic mixture will be seeded throughout the remainder of the graded areas. This treatment is proposed for areas Al, A6, A9, B2, E3', and E5. Acreage proposed for this treatment is 3.5 acres. Costs are estimated to be $1250. per acre. • Total cost for areas receiving this treatment is approximately $4500. Revegetation activities will be completed concurrent with project phases. Areas B2, A9, and E3 will be completed with Phase 1, Area E5 will be completed with Phase II, and Areas Al l . and A6 will be completed with Phase III. Management activities associated with the establishment of the communities will be completed within approximately 3 years of the seeding date. The long -term viability of these areas is expected to be good, with low to moderate on= going maintenance requirements. C. Existing. Wooded Areas — Invasive Shrub Removal and Management. Wooded areas throughout the property have been subject to historic disturbance.by livestock. As a result, invasive shrubs have become a dominant component of the understory, competing with more desirable native species and shading herbaceous ground cover. Management of these shrubs generally involves shrub removal and direct herbicide application.to prevent regrowth. A second treatment may be required after 1 -2 years, with a light burn, as feasible. • This.treatment is appropriate for areas A10, Bl, B4, Cl, C3; C4, and El. Appro/dinately. 7.5-acres are proposed for this treatment. _ Costs for.this treatment are expected to range from $2,500. _ $5,000 per acre. Total cost for areas receiving this treatment is $ 19,000 — $37,500. •Shrub.ren3oval will begin during April and May, 2000, and be completed by October, '2001. • The long -term-viability of this approach is uncertain. Without ongoing control activities. these, areas are likely to be re- invaded due to the abundance in seed sources on adjacent • properties. D. Wetlatnd Vegetation Restoration Wetland E3 (Wetland E) currently is dominated by a reed canary grass monoculture, which has Iow aesthetic and wildlife habitat values. Proposed: activities would include removal of the existing plant community by. chemical treatment and scraping, if appropriate, the upper 12 inches- of soil. The area would then be reseeded with a suitable wet meadow mixture. • • Estimated cost to complete the restoration of this 0.5 -acre wetland is $3000. • Scraping: and vegetation removal will be completed in spring, 2000. Revegetation will be completed in June, 2000. Management activities associated with the plant community establishment will be completed by October, 2003. Wetland Reconstruction/Restoration Wetlands C, D, and F have been extensively disturbed by past excavation activities. Current conditions include marginal wetland hydrology and low diversity wetland plant • communities. Proposed activities would attempt to restore and supplement wetland hydrology, remove red canary grass, consolidate wetlands, and remove trash, to provide functionally superior„ aesthetically attractive wetland areas. These activities would include excavation, spoil removal, grading, and reseeding with a wet meadow mixture. The estimated cost to complete the reconstruction and restoration of this I.5- acre•area would be. approximately $20,000. • Grading is proposed to occur in April, 2000. RECOMMENDATION: Option 1 • • • • COUNTY OF ANOKA CITY OF LINO LAKES RESOLUTION NO. 02-98 RESOLUTION CLOSING CIVIC COMPLEX CONSTRUCTION FUND WHEREAS, the City of Lino Lakes established a Civic Complex Construction Fund in 1997 for the purpose of undertaking the construction of the Lino Lakes Civic Complex; and WHEREAS, the Civic Complex project is complete and has been accepted; and WHEREAS, no activity has taken place in the fund for the past year; and WHEREAS, a residual balance remains in the fund. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: The City Finance Director is authorized to close the Lino Lakes Civic Complex Construction Fund and transfer the residual balance to the Capital Improvement Projects Fund.
