As this franchise agreement is an ordinance it will require a public hearing and two readings. Tonight I am asking you to have the second reading. A synopsis of the ordinance is attached to this cover sheet. The length of the franchise agreement is fifteen years. OPTIONS 1. Hold the second reading tonight, 28 October 2002. Subd. 7. Combination License. A combination On -Sale and Off -Sale License shall be issued only to an exclusive liquor store. Subd. 8. Temporary Set Up License. A one -day intoxicating liquor consumption and display permit may be issued to any non -profit organization in connection with a social activity occurring within the city and sponsored by the organization. No more than ten such licenses shall be issued in the city in any year. The fee for such license shall be $25.00. A permit shall allow consumption or display of intoxicating liquor and the serving of liquids for the purpose of mixing with intoxicating liquor, but shall not allow the sale of intoxicating liquor. This permit shall be valid only for the day indicated on it. No permit issued pursuant to this subdivision shall be valid unless first approved by the Commissioner of Public Safety. (Amended by Ordinance 3 -83, passed 7/11/83.) Subdivision 9. Licenses Reserved. Of the number of on -sale liquor licenses that the City is allowed to issue under Minnesota Statute 340A.413, three licenses shall be reserved for the following uses in the specified locations only: two shall be issued only to restaurants or hotels with restaurants in the Town Center area at Lake Drive and I -35W; one shall be issued only to a restaurant or a hotel with a restaurant in the I -35E and Main Street business area. These areas are shown on the map in Section 701.11. These restaurants shall have facilities to serve meals at tables to the general public and have seating capacity to serve a minimum of 50 guests at one time, and at least 50% of gross revenue shall be from the serving of food and non - alcoholic beverages. No license shall be granted within 1,000 feet of any school or within 1,000 feet of any church. The distance shall be measured from the main entrance of the school or church to the main entrance of the applicant's place of business. For the purposes of the separation restriction in this subdivision, a school is a building that is principally used as a place where twenty -five (25) or more persons receive a full course of educational instruction and the educational instruction is provided on a daily basis by an established school board or church. This doe not include any post - secondary or post -high school educational building, including any college or any vocational- technical college. Nor does the separation apply to a daycare or early childhood facility, where children typically are under constant supervision while at the facility and when traveling to and from the facility. Subdivision 1. Conviction or Revocation. No license shall be granted for sale on any premises where a licensee has been convicted of the violation of this chapter, or of the state beer or liquor law, or where any license hereunder has been revoked for cause until one year has elapsed after such conviction or revocation. Subd. 2. Amusement Places. No license shall be granted for any theater, recreation hall or center, or licensed dance hall. Subd. 3. Delinquent Taxes and Charges. No licensee who is not also licensed to sell intoxicating liquor and who does not hold a consumption and display permit shall sell or permit the consumption or display of intoxicating liquors on the licensed premises or serve any liquids for the purpose of mixing with intoxicating liquor. The presence of intoxicating liquors on the premises of such a licensee shall be prima facie evidence of possession of intoxicating liquors for the purpose of sale; and the serving of any liquid for the purpose of mixing with intoxicating liquors shall be prima facie evidence that intoxicating liquor is being permitted to be consumed or displayed contrary to this chapter. 13 Subd. 9. On September 9, the City Council authorized expenditures of $26,000 to install carbon monoxide detectors at several locations, a centralized electronic monitoring system that alerts us to problems and allows us to check those areas from one location, and a programming control override to help dehumidify air brought in from outside. The Institute for Environmental Assessment evaluated the damage to the building interior and obtained quotes from contractors qualified to perform decontamination. Cleanup began in the Early Childhood Center which had the most damage. We have received invoices totally $26,411 for these services. We will incur additional costs as the other two sections of the Civic Complex are decontaminated. We are requesting authorization to use $26,411 from the Capital Improvement Program Fund (401) to pay for cleaning up mold in the Early Childhood Center. The Finance Director has advised us to use the same fund for all expenses related to mold problems in order to simplify documentation as we seek reimbursement. We are currently gathering information to assist us in an insurance claim or legal action. OPTIONS: 1. Again, thanks for all your support of the Centennial School District. • • • YOUTH RESOURCE OFFICER CITY OF LINO LAKES /CENTENNIAL SCHOOL DISTRICT SERVICE AGREEMENT This Agreement is made this 7th day of October , 2002, pursuant to M.S. 471.59 by and between the City of Lino Lakes (City) and Independent School District #12 (School District). 1. PITRPOSE The City of Lino Lakes and the Centennial School District wish to participate in a Youth Resource Officer Program. Both the City and the School District agree that a more formalized approach to the Youth Resource Officer Program is needed to improve understanding and promote mutual respect between police, school, staff, counselors, parents and students. The purpose of this Agreement is to set forth in writing the terms and conditions of the mutual duties and obligations and to create, fund and implement the position of Youth Resource Officer. 2. =ME The School District will fund the following expenses in connection with the Youth Resource Officer: Officer's salary and related benefits are estimated at $47,870.24 for the 2002 -03 school year (see attached detail sheet for the cost breakdown). This expenditure shall be determined by the number of hours assigned to the school district. The hourly rate for 2002 -2003 shall be $34.59. The School District officials and Lino Lakes Police Chief shall determine the specific days/hours of work. 3. ,SERVICES The City shall provide the services of one licensed police officer and related support services and supplies to assist the School District in establishing a Youth Resource Officer Program. The Officer will have primary responsibility in serving as a resource person to faculty, classroom members and school administrators in the promoting of positive juvenile behavior. The School District agrees to provide adequate office space, telephone and other reasonable clerical support services. 4. PAYMENT The City shall provide billing to the School District for services provided in this Agreement on a quarterly basis. 5. TERM This Agreement shall commence on the day of September, 7 7, and shall end on/or about Tune 6, 2001 Thereafter, it shall be renewed on a yearly basis by mutual agreement. This Agreement may be canceled by either party by a 30 day written notice. • Police Liaison Agreement Page 2 6. GENERAL PROVISIONS It is expressly agreed that the Youth Resource Officer is a City employee and shall not be considered an employee of the School District for any purpose including but not limited to salaries, wages, other compensations or fringe benefits, Workers Compensation, Unemployment Compensation, P.E.R.A., Social Security, Liability Insurance, keeping of personnel records, termination of employment, individual contracts or other contractual rights. The City shall assume all liability for the actions taken by the Officer in the performance of his/her duty as a Peace Officer. The Officer will report to and be directed by the Chief of Police, but will consult regularly with School District Officials. Resolution of unforeseen problems arising in this program shall be negotiated by representatives of the School District and the Chief of Police. 7. SCHEDULING The duty hours of the Youth Resource Officer are flexible and will be primarily coordinated with the school day and activities. The Officer will make daily contact with the Police Department for the purpose of keeping abreast of incident reports and other City activity. During non - school periods, the Officer duties and schedule will be determined by the City. • 8. Debra G. Woods 4/5 vote BACKGROUND Ordinance No. 12 -02 was approved on the first reading before the City Council on October 14, 2002. It is now before the Council for the second reading. Debra Woods lives at 73 Lilac Street, a two -acre lot which is zoned Rural. The property contains a home with an attached garage, and Ms. Woods would like to construct an additional detached garage to the rear of the home. There is an existing 42' X 190' ponding easement area on the east part of the property. This easement area is where the applicant would like to site the proposed garage, and so she is asking for a Vacation of the easement. This review is based on the following attached exhibits: 1. General Location Map. 2. Certificate of Survey, prepared by Kurth Surveying, August 16, 2002. City Council Meeting Woods Vacation October 28, 2002 ANALYSIS The existing ponding easement at 73 Lilac Street (Lot 11, Block 2, Sunset Oaks) covers portions of the eastern part of the property and extends onto the neighboring property to the east. In reviewing documents from the time the Sunset Oaks subdivision was constructed (1970's), it appears that the ponding easement area was designated in anticipation of a pond being constructed or needed. Thirty years later, such a pond has never .materialized. City engineer Jim Studenski has reviewed the site and found no need for the ponding easement area, as there is no drainage to the area and the land is relatively level. In addition, a portion of the existing septic system of the home is sited in the easement area, which would thus make it impractical for ponding purposes. CONCLUSION As the ponding easement area does not appear to be necessary for drainage purposes, staff would recommend its vacation. OPTIONS 1.) Approve Ordinance No. 12 -02, vacating the easement. 2.) Deny Ordinance No. 12 -02. 3.) Return to staff with direction. RECOMMENDATION Option #1. CITY OF LINO LAKES ORDINANCE NO. 12-02 ORDINANCE VACATING A PONDING EASEMENT ON PROPERTY LOCATED AT 73 LILAC STREET (LOT 11, BLOCK 2, SUNSET OAKS) WHEREAS, the City Council of Lino Lakes has determined to vacate the ponding easement existing on property located at 73 Lilac Street (Lot 11, Block 2, Sunset Oaks); and WHEREAS, a public hearing was held on October 14, 2002 before the City Council in the City Hall Council Chambers after due published and posted notice had been given on October 1, 2002, and a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; and WHEREAS, it appears to be in the best interests of the City to vacate such a ponding easement; and WHEREAS, four -fifths of all members of the City Council concur in this ordinance NOW, THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: Section 1. Thom) Raymond & Beverly Chavez 3/5 vote Mr. Raymond Chavez owns Lots 1 & 2, Block 1, Arthur E. Thom Acres, which is located at the intersection of Lauren Avenue and White Pine Road. The property is approximately 2.5 acres in size and is zoned R -1 (Residential Single Family). Currently there is an existing home and two detached garages on the westem part of the property, which is accessed via a driveway off Lauren Avenue. Mr. Chavez is applying for a Minor Subdivision of the property, which would result in two lots: Parcel A, containing the existing buildings, consisting of 2.18 acres, and Parcel B, consisting of .40 acres. Mr. Chavez then plans to sell Parcel B to Mr. Lipoff (see agenda item 5B). This report is based on the following attached exhibits: C.C. Meeting Chavez Minor Subdivision October 28, 2002 1. Minor Subdivision Survey, for Raymond Chavez ANALYSIS Land Use & Zoning Location Guided Land Use Existing Zoning Site Low Density, Unsewered Residential R -1 (Residential Single Family) West Park " North Low Density, Unsewered Residential " East " LL South Low Density, Sewered Residential R -1X (Residential Single Family Executive) Although the property is guided Low Density, Unsewered Residential, there is City Sanitary sewer available on both Laurene Avenue and White Pine Road. The property is within the existing MUSA. Minimum Lot Requirements Size: the minimum lot size for sewered property in an R -1 zone is 10,800 square feet. Proposed Parcel B meets this requirement, being 17,370 sq.ft. in size. Parcel A, while 95,081 sq.ft. in size, is not sewered, and is thus a non- coforming lot. Width: the minimum lot width requirement for property in an R -1 zone is 80 feet for interior lots and 100 feet for comer lots. Both proposed lots will meet this requirement. Depth: the minimum lot depth requirement for property in an R -1 zone is 135 feet. Both parcels, having a depth of 174 feet, will meet this requirement Lot Combination: each of the proposed parcels will actually consist of two separate lots (Lot 1 & Lot 2), since Mr. Chavez owns both Lot 1 and Lot 2 and has not combined them into a single tax parcel with a single Property Identification Number (PIN). As a result, if approved, a lot combination form should be filed with Anoka County for both Parcel A and Parcel B. This will result in each parcel being identified as a single tax parcel with a single, unique PIN. Sanitary Sewer: Section 6, subdiv. 1.F states "no R -1 subdivision creating a lot less than ten acres shall be permitted in this district without public sanitary sewer and water." City sanitary sewer and water are available along both Laurene Avenue and White Pine Road. C.C. Meeting Chavez Minor Subdivision October 28, 2002 While any created lots would be serviced by such utilities, the existing home is not connected to either City sewer or water. It is the interpretation of the City that Section 6, subdiv. 1.F requires that all R -1 lots must be serviced by both services. As a result, the existing house would be required to connect to sewer and water as a condition of subdivision. To allow the parcel to be subdivided without connecting to City sewer and water would be to exacerbate, or increase, its non - conformity. Buildable Area Both lots meet the minimum buildable area requirement of 10,800 square feet. Easements There are no easements noted on the survey submitted by the applicant. The City will require the dedication of standard sized drainage and utility easements along all property boundaries. Additionally, as a point of information, there is a powerline that runs the length of the property along White Pine Road. This powerline is not identified with any easements, and is thus interpreted to exist within the road right -of -way. City Services /Septic Issues Parcel B will connect to City sanitary sewer and water, which is available via both Laurene Avenue and White Pine Road. Parcel A, however, is not currently connected to either City sanitary sewer or water. The City interprets Section 6, subdiv.1.F of the zoning ordinance to require all R -1 lots to be serviced with City sanitary sewer and water. As a result, the applicant would be required to connect to both services as a condition of subdivision. Access Issues The driveway for Parcel A (the existing home) is currently via Laurene Avenue, running across proposed Parcel B. As a result, if the minor subdivision is approved, the driveway for Parcel A will need to be relocated to access White Pine Road, rather than Laurene Avenue. P &Z RECOMMENDATION The above report was presented at the October 9, 2002, meeting of the Planning & Zoning Board. After consideration of the issues, the board voted to approve the proposed Minor Subdivision, with the conditions noted below. 3 C.C. MEETING DATE: October 28, 2002 TOPIC: Resolution No. 02 -152: Site Plan Review for a Relocated Structure, To Be Located on the 62XX Block of Lauren Avenue Dennis Lipoff ACTION REQUIRED: 3/5 vote BACKGROUND Dennis Lipoff has applied for a Site Plan Review for the relocation of a single -story, 1,550 sq. ft. (62' X 25') house onto the proposed new lot of Mr. Chavez (agenda item 5A). The house is currently sited at 1475 Main Street in Centerville on land which has been purchased for development. The house currently exists with a tuck -under garage, but Mr. Lipoff plans to construct a new 23' X 33' attached garage, thus creating a rambler -style home. This review is based on the following attached exhibits: 1. General Location Map 2. Certificate of Survey, dated September 13, 2002 3. Proposed Floor Plan 4. Elevation 5. Elevation C.C. The Lino Lakes City Ordinance, however, defines lot frontage as "the narrowest lot boundary abutting a public street that meets minimum lot width requirements." Such a defmition would thus designate the frontage along White Pine Road as the official, technical front lot line, rather than the frontage along Laurene Avenue. The applicant, however, proposes to orient the house and driveway toward Laurene Avenue. It should be noted that while such an orientation may change what is perceived as the "functioning, practical" frontages, such an orientation does not change, or supercede, what the frontages are defined as under City Ordinance. C.C. Meeting Lipoff Site Plan Review October 28, 2002 For example, the western lot line of the property would NOT be the rear yard lot line, but rather the side yard lot line. The following chart specifies the property boundary lines, as they are identified under the definitions within the Lino Lakes City Ordinance: Western Property Boundary Is Equal To: Side Yard Lot Line Northern Property Boundary Is Equal To: Rear Yard Lot Line Eastern Property Boundary Is Equal To: Side Yard Lot Line Southern Property Boundary Is Equal To: Front Yard Lot Line Access Access to the site will be via a driveway off Lauren Avenue, which is classed as a minor collector street under the Lino Lakes Transportation Plan. In addition, Section 3, subdiv. 5.C.8.f states that "no curb cut/driveway access shall be located less than 30 feet from the intersection of two or more street rights -of- way." Utilities City sanitary sewer and City water are available to the site, and the applicant will be servicing the site with both. Building The proposed 1,550 sq.ft. house is currently sited at 1475 Main Street (Co. Rd. 14) in Centerville, on property due to be developed. The house will be moved without the tuck - under garage. It is the intention of the applicant to relocate the structure, put a new roof on, build a new 23' X 33' attached double garage, and side both house and garage (to include an apron of brick or stone). Building official Pete Kluegel has inspected the house and found it to be structurally sound, estimating it to be approximately 40 years old. He notes that, in addition to the work the applicant plans to do, the house will need a new furnace in order to meet mechanical code, with the plumbing and heating to be upgraded. P & Z RECOMMENDATION The above report was presented at the October 9, 2002 meeting of the Planning & Zoning Board. After consideration of the issues, the board voted to approve the proposed Site Plan Review, with the conditions noted below. 3 C.C. Meeting Lipoff Site Plan Review October 28, 2002 CONCLUSION As the proposed site plan appears to meet all requirements of the Lino Lakes Zoning Ordinance, staff would recommend approval of the Site Plan Review with the following conditions: 1. The necessary minor subdivision must be completed and recorded prior to moving the house onto the lot. 2. All necessary building permits must be pulled. OPTIONS 1.) Approve the proposed Site Plan Review, with conditions. 2.) Deny the proposed Site Plan Review. 3.) Return to staff with direction. Mr.Brown is asking for a Variance from the Lino Lakes Ordinance requirement (Section 3, subdiv. 4.D.8.e.5) which states that "no metal corrugated siding or roof, except upon tool sheds less than 150 square feet in area" are allowed on accessory buildings. Mr. Brown constructed an approximately 36' X 24' (864 sq.ft.) metal accessory building without pulling a building permit. As a result, building official were not given the chance to review plans and inform Mr. Brown that the building was prohibited for property of his size and zone. Building official Peter Kluegel noticed the building while out on routine inspection, and notified me of the situation. C.C. Meeting Brown Variance October 28, 2002 Pete and I had an initial conversation with Mr. Brown when he stopped by City Hall to discuss the matter. That conversation was followed by several letters over a period of approximately 3 months, culminating in the matter being handed over to the City Attorney on July 29, 2002, for resolution. Mr. Brown then contacted City Attorney Bill Hawkins and myself, asking that prosecution of the violation be postponed until he was allowed to apply for a variance. This report is based on the following attached exhibits: 1. General Location Map. 2. Map of Site (blow up from 1/2 sections). 3. Narrative From Applicant. 4 -9. Correspondence With Applicant. The total accessory building square footage allowed for Mr. Brown's property is 2,020 square feet. The three existing accessory buildings total 1,584 square feet. P &Z RECOMMENDATION The above report was presented at the October 9, 2002 meeting of the Planning & Zoning Board. After consideration of the issues, the board voted to deny the proposed Variance. CONCLUSION The subject building is a metal building, sided and roofed with a corrugated metal, which is prohibited under City ordinance for a property of this size and zone. Further, the building was constructed without application of a building permit, thus never giving staff the chance for review and subsequent notification to the applicant that such a building was prohibited. OPTIONS 1.) Approve the proposed Variance. 2.) Deny the proposed Variance. 3.) Return to staff with direction. RECOMMENDATION Option #2. The application is incomplete, however, as the City received no application fee ($250). In addition, a narrative and sketch of some kind are also usually submitted (I believe this was explained in the application materials sent to you in April). As a result, staff are unable to proceed with processing the application until all required materials have been submitted. . I would like to take this opportunity to again reiterate that it is certainly your option as a property owner to apply for a Variance. As a staff person dealing with land use issues, however, I must continue to advise you that such a request for this particular situation/reason cannot be supported by staff. VOTE REQUIRED: 3/5 Vote required to close the hearing Simple majority to authorize plans and specifications BACKGROUND: Due to the deteriorating condition of Elm Street between Sunset Road and Grey Heron Drive, the City Council order a feasibility study for the reconstruction of the street. This segment of roadway is designated as a Municipal State Aid Street and serves as a minor collector within the City's Comprehensive Transportation Plan. In addition, some properties adjacent to and beyond Elm Street do not have access to sanitary sewer or water. The street reconstruction portion of the project will be funded mostly through Municipal State Aid. Sanitary sewer and watermain will be mostly funded through assessments. The next step in the process is to close the Public Hearing and authorize the plans and specifications for the street and storm sewer portion of the project. This segment of roadway is designated as a Municipal State Aid Street and serves as a minor collector within the City's Comprehensive Transportation Plan. In addition, some properties adjacent to and beyond 62nd Street do not have access to sanitary sewer or water. The street reconstruction portion of the project will be funded mostly through Municipal State Aid. Sanitary sewer and watermain will be mostly funded through assessments. The City has received a petition from the residents to exempt them from any road assessments and a petition to install sanitary sewer and water with the street reconstruction (copies attached). The next step in the process is to close the Public Hearing and authorize the plans and specifications for the street and storm sewer portion of the project. The City must allow 60 days to elapse following the Public Hearing before any further action can be taken on the sanitary sewer and watermain portion of the proposed project as required by the City Charter. RECOMMENDATION: • Staff recommends Option No. 1. • • • CITY OF LINO LAKES RESOLUTION NO. 02 -156 RESOLUTION ADOPTING ASSESSMENT FOR THE LAKE DRIVE/APOLLO DRIVE IMPROVEMENT PROJECT WHEREAS, pursuant to proper notice duly given as required by law, the City Council met and heard and passed upon all objections to the proposed assessment for the improvement of Lake Drive /Apollo Drive, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LINO LAKES, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of fifteen years, the first installment to be payable on or before the first Monday in January, 2003, and shall bear interest at the rate of seven percent (7 %) per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2002. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of fifteen years, the first installment to be payable on or before the first Monday in January, 2003, and shall bear interest at the rate of seven percent (7 %) per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2002. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. Studenski, City Engineer COUNCIL MEETING DATE: October 28, 2002 TOPIC: Resolution No. 02 -161, Accepting Feasibility Report, 12th Avenue /Holly Drive Street Reconstruction. VOTE REQUIRED: Simple Majority BACKGROUND: Due to the continued development and growth of the area increasing the traffic on this roadway and the deteriorating condition of 12th Avenue and Holly Drive between Ash Street and Birch Street, the City Council order a feasibility study for the reconstruction of the street. This segment of roadway is designated as a Municipal State Aid Street and serves as a minor collector within the City's Comprehensive Transportation Plan. In addition, some properties adjacent to and beyond 62nd Street do not have access to sanitary sewer or water. The street reconstruction portion of the project will be funded mostly through Municipal State Aid. The utility extensions will be minimal at this time. The study will be delivered to the City Council at the meeting Monday evening. The next step in the process will be to accept the feasibility study for the proposed improvements. Construction of these improvements is projected to start in 2004. OPTIONS: 1. Return to staff for further review. 2. Adopt Resolution No. 02 -161, Accepting the Feasibility Report for the 12th Avenue /Holly Drive Reconstruction project. VOTE REQUIRED: Simple Majority BACKGROUND: The City has received a petition from residents and property owners on Thomas Street, west of 4th Avenue, for preparation of a report on sanitary sewer and water service. A copy of the petition is attached. Sanitary sewer and water main are close to the project area at the west side in the Behm's Century Farms subdivision. When the City has received utility petitions from neighborhoods in the past, the first step has been to hold a neighborhood meeting before any formal study is prepared. At the neighborhood meeting, we discuss the public improvement process, the City Charter, the location of existing utilities, and an overview of the construction process. The study would follow the neighborhood meeting. The study will address, on a preliminary basis, design, cost, assessment, schedule, and other issues as they relate to providing City utility service to this area. OPTIONS: 1. As part of that improvement, the RCWD has required a Stormwater Maintenance Agreement between the owner and the City of Lino Lakes (copy attached) The City Attorney and Emergency Apparatus Maintenance attorney have reviewed and approved of the agreement. This will be a RCWD requirement for all ponding areas developed on private parcels within the City. Under this agreement the Owner assumes full and sole responsibility for the condition, operation, repair, maintenance, and management of the system. In the event the Owner doesn't maintain the system; the City can rectify the deficiency and be reimbursed by the Owner. OPTIONS: 1. Return to staff for further review. 2. Bergeson, Mayor • • OPERATION AND MAINTENANCE AGREEMENT FOR STORMWATER TREATMENT FEATURES THIS AGREEMENT made and entered into this day of , 2002, by and between David Schreier and Cynthia Schreier, hereinafter referred to as "Owner" of the below described Property; and the City of Lino Lakes, a political subdivision of the State of Minnesota, hereinafter referred to as "City ". (Lot 1, Block 1, Apollo Business Park, Anoka County, Minnesota) WHEREAS, the City has required the Owner to provide an on -site infiltration basin to accommodate storm water and the rate of flow of area run -off, and WHEREAS, the Owner agrees to construct an infiltration basin on the above described Property and do all related grading, slope work and restoration. NOW THEREFORE IT IS AGREED AS FOLLOWS: 1. The Owner assumes the full and sole responsibility for the condition, operation, repair, maintenance and management, at no cost to the City, for an on -site infiltration basin (System) which meets Rice Creek Watershed District (RCWD) standards originally approved RCWD permit #02 -033 for the purpose of receiving, retaining, treating and transporting all storm sewer water which may be collected within the System. 2. The City shall not under any circumstances be responsible for the on -going physical performance of any repairs, changes or alterations whatsoever to the System and appurtenances and the City shall not be liable for the cost thereof. 3. The Owner agrees, at no cost to the City, to regularly: (1) Remove accumulated sediment from the System to maintain dead storage volume equivalent to the volume originally approved by RCWD permit #02 -033, (2) maintain all native perennial • • • vegetation in the System area in a way which does not compromise the effectiveness of the infiltration System, (3) maintain and trim all other shrubs and vegetation in the System area, (4) remove all litter and debris from the System, (5) repair or replace any grass or other vegetation in the System area disturbed by maintenance, (6) maintain the System outlet structure, (7) disc or aerate soils as necessary to maintain soil infiltration capacity, and (8) take all other and further steps which would be reasonably necessary for the purpose of maintaining the stormwater management feature. 4. The Owner agrees to indemnify, and hold harmless and defend the City from all present and future claims that may arise from the construction and maintenance of the System located on the Owner's property. 5. In the event that the City believes that the Owner is not maintaining the Detention Pond improvement in a fashion reasonably consistent with this Agreement, then the City may give written notice to the Owner detailing the deficiency in the manner in which the owner is maintaining the Pond. If, within 60 days after receipt of this notice, the deficiency described in the notice has not been corrected by the Owner, then the City may, without further notice, take any steps which it deems reasonably necessary in order to correct the deficiency; provided, however, that if the deficiency complained of in such notice is of such a nature that the same can be rectified or cured, but cannot with reasonable diligence be completed within said 60 -day period, then such deficiency shall be deemed to be rectified or cured if Owner shall, within said 60 day period, commence to rectify and cure the same and shall thereafter complete such rectification and cure with all due diligence. If the Owner does not rectify or cure as provided herein, and the City corrects the deficiency, the Owner agrees to then reimburse the City within 30 days of receipt of invoice for all reasonable costs incurred, to include administrative overhead, by the City in correcting the deficiency. If this invoice is not paid within 30 days of receipt, or the Owner has not commenced an action to contest the reasonableness of the invoice, then the Owner agrees that the City may assess the cost against the Owner's property. In the event that it becomes necessary for the City to assess the cost of correcting the deficiency as provided herein, then the City is authorized to direct the County Assessor to certify this assessment against the Owner's real property described above, and the Owner waives any right to a public hearing and appeal of such assessment which may statutorily or constitutionally provided for. 6. In 1990, the Environmental Protection Agency (EPA) established Phase I of the National Pollutant Discharge Elimination System (NPDES) storm water program. Polluted storm water runoff is often transported to municipal separate storm sewer systems (MS4s) and ultimately discharge into local rivers and streams without treatment. The purpose of NPDES Phase I was to implement a storm water management program as a means to control polluted discharges to (MS4s). MS4s are categorized as a state, City, County, Township, Watershed District or other public agency who discharges to waters of the U.S. using systems they own that are designed or used for collecting or conveying storm water. Phase I relied on NPDES permit coverage to address storm water runoff from: (1) large (MS4s) generally serving populations of 100,000 or greater, (2) construction activity disturbing 5 acres of land or greater, and (3) ten categories of industrial activity. NPDES permits for construction activities within Lino Lakes are currently administered by the Minnesota Pollution Control Agency (MPCA). NPDES Phase II is intended to further reduce adverse impact to water quality and aquatic habitat by extending coverage to small MS4s, including Lino Lakes, and construction activities disturbing one to five acres. MS4 cities are required to complete their Notice of Intent (permit application) and draft Storm Water Pollution Prevention Program (SWPPP) by March 10, 2003. The SWPPP must include the following elements: 1. Public Education and Outreach. Distributing educational materials and performing outreach to inform citizens about the impacts polluted storm water runoff discharges can have on water quality. • 2. Public Participation /Involvement. Providing opportunities for citizens to participate in program development and implementation, including • • effectively publicizing public hearings and /or encouraging citizen representation on a storm water management panel. 3. Illicit Discharge Detection and Elimination. Developing and implementing a plan to detect and eliminate illicit discharges to the storm sewer system (includes developing a system map and informing the community about hazards associated with illegal discharges and improper disposal of waste). 4. Construction Site Runoff Control. Developing, implementing, and enforcing an erosion and sediment control program for construction activities that disturb 1 or more acres of land (controls could include silt fences and temporary storm water detention ponds. 5. Post Construction Runoff Control. Developing, implementing, and enforcing a program to address discharges of post- construction storm water runoff from new development and redevelopment areas. Applicable controls could include preventative actions such as protecting sensitive areas (e.g. wetlands) or the use of structural BMP's such as grassed swales or porous pavement. 6. Pollution Prevention /Good Housekeeping. Developing and implementing a program with the goal of preventing or reducing pollutant runoff from municipal operations. The program must include municipal staff training on pollution prevention measures and techniques (e.g., regular street sweeping, reduction in the use of pesticides or street salt, or frequent catch -basin cleaning). In response to individual city concerns, regarding the requirements, the League of Minnesota Cities (LMC) is in the process of completing a guide plan to help MS4 cities complete 50% to 65% of their Phase II Permit Application and Storm Water Pollution Prevention Program. The cost to individual cities is $5,000.00. However, the LMC is anticipated to remit between $1,000 to $2,500 per community, depending on the total number of cities contributing. There are currently 73 local government units collaborating with LMC on the project. Participating in the guide plan program offers several advantage to the city including: 1. Efficiency. The guide plan will stream line the program development by providing the initial framework. 2. Cost Savings. Using the Guide Plan will allow approximately half of the permit and SWPPP to be completed in house. 3. MPCA is strongly supporting the plan, which will help expedite the approval process. • 4. Consistency. The Lino Lakes plan will be generally consistent with other LGU's preparing the plan. Staff is proposing to use Surface Water Management Funds to cover the cost of participation. COUNCIL ACTION Motion to authorize execution of agreement with LMC to participate in the NPDES Phase II Guide Plan Development. RECOMMENDATION: Staff is recommending approval of the motion. 1 •
