City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. CONTINUED PUBLIC HEARING to consider a rezone of property located at 7880 Sunset Avenue (PID #07-31-22-23-0004) from R-Rural to PUD-Planned Unit Development and an Amendment to the Development Stage Plan/Preliminary Plat of Century Farm North to expand project boundary and include certain property located at 7880 Sunset Avenue Katie Larsen, City Planner, stated that the City received a letter from the applicant withdrawing the application for the rezoning and amendment to the Development Stage Plan/Preliminary Plat for Century Farm North be withdrawn at this time. Chair Tralle continued the Public Hearing at 6:32 p.m. Mr. Laden made a MOTION to close the Public Hearing at 6:33 p.m. Motion was supported by Mr. Hyden. Motion carried 4-0. (Tralle abstained.) B. CONTINUED PUBLIC HEARING to consider rezoning and a PUD Development Stage Plan/Preliminary Plat for a 55 lot residential development to be called Saddle Club, located at 1403 Birch Street, PIN 28-31-22-34-0001 Katie Larsen, City Planner, presented the staff report. Ms. Larsen noted that staff received comments from both the Park Board and the Environmental Board. Staff recommended approval of the rezoning and PUD Development Stage Plan/Preliminary Plat. A A Ms. Larsen explained that the connection to the Foxborough development would occur at some point in the future and the developer will be making improvements to the east/west connection of Old Birch Street. Staff is working with Anoka County to address safety concerns on Birch St. and Old Birch St. Improvements will include either the addition of a turn lane or a bypass lane on Birch St. Mr. Wedel noted that staff is awaiting feedback from the county regarding improvement design and costs. He added that preliminary plans include the consideration to eliminate the north/south access to Birch Street from Old Birch Street with a cul-de-sac at the north end of Old Birch St. Mike Black, developer, was present for questions. Mr. Black is prepared to meet with the county if necessary. Mr. Black explained some amendments that were made to the plat including the expansion of outlots. Mr. Black appreciates the comments regarding design and will continue to work with staff to address any remaining issues. He understands that he is responsible for all road improvements. Mr. Wedel noted that the County may participate in a cost share to improve Birch Street if access is eliminated onto the county road. Board member comments included: DRAFT MINUTES Planning & Zoning Board January 8, 2014 Page 3 - Would like to propose additional recommendations regarding road improvements. - If the proposed trail is meant to fulfill the city's plan for a Destination Trail as proposed in the city's Park & Trail Plan, it should not include a road system. - The connection to the Foxborough development is vital to the safety of this project. - Would like more information on road safety concerns and improvements. - One entrance to a development is not in the best safety interests of the citizens. - Concerned with the comments from the Public Safety Dept. regarding transportation safety. Staff noted that there has been discussion with the property owner to the west to encourage the road connection to the Foxborough development as soon as possible. Staff clarified that there is an additional connection to this development through the Preserve development to the east. Chair Tralle declared the Public Hearing open at 7:06 p.m. Joel Fehn, 878 Fox Rd, stated that it is quite dangerous to get onto Birch Street from Old Birch and he has witnessed numerous accidents in the past month. He stated concern for increased traffic. He was also concerned about drainage and standing water in the SW corner of the development. He wondered if this development would increase the probability of flooding onto existing properties. Travis Gervais, 890 Birch St, stated the need for posted speed limit signs on Old Birch Street due to the excessive speed of drivers. He likes the idea of the cul-de-sac to close off access to Birch Street. He is concerned about the safety of his children and others. Chair Tralle requested that city staff alert the Police Department to problems in this area regarding the lack of speed limit signs and need for more patrol in this location. Rick Capocasa 886 Old Birch St, expressed traffic concerns and was in favor of the cul- de-sac to relieve issues and accidents. Randall Graczyk, 886 Fox Rd, stated that a lighted intersection on Birch St. would help reduce speeds and improve access, even though it would cost more money it would be the safest route. He was concerned about additional water flooding into his yard. Staff addressed the drainage concerns. Mr. Graczyk would prefer that the road connection proposed on the SW corner of the development be turned into a cul-de-sac. He would prefer the Fox Road connection in Foxborough continue to the north and connect to a future development. Chair Tralle discussed the road connections, reminding residents that the city posted signs that Fox Road would be connected in the future. Mr. Graczyk stated that he is not opposed to the extension of Fox Road, but was suggesting an alternate route. Mr. Wedel commented that the city did consider an alternate route for the continuation of Fox Rd, but due to the majority of wetlands on the neighboring property, this was the best outcome. Chair Tralle asked about the amount of hauling necessary for this development. Mr. Black stated that a grading plan had not yet been completed. He said there will be a substantial amount of hauling due to fill for house pads and road improvements. Mr. Fehn asked whether or not the traffic situation has to be figured out prior to development. Chair Tralle stated that road improvements happen with development. Mr. Fehn was concerned about the increased danger of the road situation. Chair Tralle reminded residents to contact Anoka County and voice their concerns regarding the road situations. Mr. Fehn agreed that a traffic light would alleviate problems on Birch Street. Mr. Wedel pointed out that traffic lights are installed when warrants are met. Mr. Gracyk asked who paid for the lights at Birch St./Ware Rd. Mr. Wedel responded that a good portion was paid for by the county and a portion was paid by the city. The board pointed out that it is very difficult for the city to get traffic lights installed on county roads. Ms. Larsen noted that the Final Plat will be brought to the board and council for final approval, allowing more time for revisions prior to the final plan. The board and staff further discussed trail maintenance, city review deadlines, and the cost of road improvements. Mr. Root made a MOTION to close the Public Hearing at 7:47 p.m. Motion was supported by Mr. Laden. Motion carried 5 - 0. DRAFT MINUTES Planning & Zoning Board January 8, 2014 Page 5 Mr. Root made a MOTION to recommend approval of a rezoning and a PUD Development Stage Plan/Preliminary Plat for a 55 lot residential development to be called Saddle Club, located at 1403 Birch Street, PIN 28-31-22-34-0001, based on the following conditions, which includes four additional recommendations by the board: 1. All comments from the City Engineer letter dated December 26, 2013 shall be addressed. 2. All comments from the Environmental Coordinated Letter dated January 3, 2014 shall be addressed. 3. A Phasing Plan for development shall be included in the plan set. 4. Easements for road connection to Old Birch Street and Pheasant Run South shall be provided to the City. 5. Conservation easement language shall include allowance for construction of trails, parks, storm water management facilities, retaining walls, etc. 6. Conservation easement shall be drafted by the developer and submitted to the City for review and approval. 7. Comments/Revision to Sheet CO, Title Sheet: a. Old Birch Street shall be renamed Pheasant Run South as required by emergency services. b. Pine Cone Court shall be renamed to eliminate multiple uses of "Pine" throughout the City. 8. Comments/Revision to Sheet C1-1 & C1-2, Preliminary Grading, Drainage & Erosion Plan a. Plan sheet notes sidewalk and bituminous trail by others. Sidewalk and trail shall be installed by developer. b. Sidewalk south of Black Berry Court shall be reviewed by the City Engineer to determine if 8 foot wide bituminous trail is feasible. c. A pedestrian access ramp shall be installed south of Lot 15, Block 1 to provide access to the sidewalk/ trail from Black Berry Court. d. A cost estimate for the trail construction shall be provided. 9. Comments/Revision to Sheet 1 of 9, Certificate of Survey with Resource Inventory: a. The applicant shall submit a Letter of Map Revision to FEMA for review and approval. b. The flood elevation shall be determined now during platting process. c. Letter of Map Revision shall be submitted after site grading. d. It may be possible that some lots will require flood insurance until LOMR approved or City may not issue building permits on lots impacted by floodplain until after LOMR approved. 10. Comments/Revisions to Sheet 4 and 5 of 9, Preliminary Plat: a. Lots 14 and 15, Block 6 shall not extend into the wetland. b. Lot 15, Block 6 shall have PUD flexibility to allow the rear setback to extend to the conservation easement. c. Lot 1, Block 3 shall be revised so the retaining wall is located entirely within the lot and outside of the standard drainage and utility easement. d. Lot 1, Block 2 shall have PUD flexibility to allow the rear setback to extend to the conservation easement. 11. Comments/Revisions to Sheet 7 and 8, Preliminary Landscape and Planting Plan: a. The landscape plan shall include Open Area Landscape calculations as required per ordinance. b. Planting schedule (symbols, quantities, common and botanical names and sizes of plant materials) and Planting Detail shall be included for all Open Area, Buffer, Boulevard and Tree Preservation and Mitigation plantings. 12. Comments/Revisions to Tree Removal Worksheet: a. Actual tree preservation and mitigation calculations shall be provided in chart format as shown on page 3-44 of Tree Preservation and Mitigation Standards ordinance. b. Please include this chart with calculations on the Tree Removal Worksheet. 13. It is strongly recommended that a cul-de-sac should be installed at the northern end of Old Birch Street. (added by the P&Z Board) 14. If a cul-de-sac is not installed at the northern end of Old Birch Street, then the east intersection of Birch St. and Old Birch Street should become a right-in/right-out only. (added by the P&Z Board) 15. The east/west section of Old Birch Street shall be improved with a bituminous overlay per city standards. (added by the P&Z Board) 16. Either a left turn lane or a bypass lane should be installed on Birch Street. (added by the P&Z Board) Mr. Laden stated that he likes the proposed development, but is going to vote against it because he is not convinced that the connection to Foxborough is going to be made. Motion was supported by Mr. Evenson. Motion carried 4 - 1. (Laden voting nay.) Staff noted that this item is tentatively scheduled for the City Council Meeting on February 10, 2014. C. After revisions from the previous submittal, the plat is approximately 94.09 gross acres and consists of a residential density mix of single family lots and an 88 unit senior multi -family residence. The following is a breakdown of unit development: 1 • 216 Single Family Lots • 11 Future Single Family Lots • 88 unit multi -family • 315 TOTAL UNITS A public hearing was held by the Planning & Zoning Board on December 11, 2013 and continued to the February 12, 2014 meeting. The Land Use Application is for the following: • Rezone property from R, Rural to PUD-Planned Unit Development • PUD Development Stage Plan/Preliminary Plat for NorthPointe The Staff Reports dated December 11, 2013 and January 8, 2014 precede this report. The following staff report is based on the Plan Set prepared by Carlson McCain dated January 13, 2014 and received by the City on January 13, 2014. ANALYSIS Rezoning The property is currently zoned R, Rural and requires rezoning to PUD-Planned Unit Development. The PUD provides the following flexibility from the strict standards of the R-2 Two Family Residential District: • Lot size variations from 5,502 s.f. to 21,923 s.f. (Minimum lot size for R-2, Two Family Residential District is 7,500 s.f.). • Reduced right of way for some streets from 60 feet to 50 feet. • Reduced street width for some streets from 32 feet to 28 feet. • Reduced corner lot "side" setback from 25 feet to 20 feet for lots that abut back to back but not abutting an interior lot. • Five (5) foot side yard setbacks for 50 foot wide lots. • Allowance for variation in garage building design standards of the R-2 District. See Building Design Standards below. • Mixed residential density development of single family and multi -family These PUD flexibilities are provided to allow for a variety of detached single family housing products that are in current market demand vs. standard townhome medium density development. The PUD flexibility also compliments walkable neighborhoods, protects the greenway corridor and reduces the development footprint and impervious surface area. The rezoning is consistent with the Comprehensive Plan and meets the purpose and intent of the PUD by encouraging: W • Innovations in development that address growing demands for all styles of economic expansion, greater variety in type, design, architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. • The preservation and enhancement of desirable site characteristics such as existing vegetation, natural topography and geologic features and the prevention of soil erosion. • An efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. The proposed plan of 4.01 units per acre is consistent with the Comprehensive Plan's guided land use and density. Concerns were brought forth at the public hearing regarding the medium density. It is important to note the developer is required to develop at 4.0 to 5.9 units per acre per the City's Comprehensive Plan. The proposed development at 4.01 units per acre is the lowest end of the medium density spectrum. The highest medium density allowed at 5.9 units per acre could create 463 total units which is 148 units more than proposed. The PUD flexibility is not creating anymore density than is allowed. The flexibility actually allows for the lowest possible medium density and single family detached homes. It should also be noted the R-2 District allows for 25 foot front setbacks but the developer is proposing more traditional 30 foot front setbacks on the 65'-70' wide lots. Building Design Standards The developer is proposing several different housing models and product types for both the 65 & 70 foot wide lots and the 50 foot wide lots to provide customers with options and development variations. All dwellings shall comply with the Design and Construction Standards of Section 3, Subd. 4.B. In addition, the following PUD criteria shall be required: a. All single family dwellings shall have a minimum double garage. b. All single family dwellings shall include a front porch that is covered, unenclosed and a minimum of 6 feet in depth. C. All single family dwelling and garage elevations shall include a variation in exterior building materials such as brick, stone, rock face, concrete block, wood, stucco, vinyl, steel, fiber cement and aluminum siding. d. Side or rear loaded garages are permitted. The elevation facing the street shall require a minimum of one (1) window. e. The garage doors shall incorporate architectural design features such as decorative windows, panels, hinges, etc. f. Garages in excess of two stalls shall be broken up so the additional stalls are recessed from the main garage facade. g. The proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance. Blocks and Lots The revised preliminary plat creates 11 blocks with 216 lots and 7 outlots. The outlots are protected wetland/conservation areas, stormwater management ponds, and future residential development. Outlots A, B, D, E, F and G will be deeded to the City. The lots vary in width, depth and lot size as allowed per the PUD flexibility. Public Land Dedication The City will require a combination of land dedication and cash in lieu of land. The proposal dedicates 5.04 acres of parkland and trail which will be deeded to the City. The construction costs of the trail will be credited from the total payment in lieu. Values for land dedication, cash in lieu and trail construction costs will be finalized with the PUD Final Plan/Final Plat. Zoning Tree Preservation and Mitigation Standards A Tree Inventory Report, Tree Preservation Plan and Landscape Plan have been submitted which identifies existing trees, trees to be removed, new plantings, basic use area, natural resource conservation area and natural resource protected area. The plans require minor revisions but in general, are compliant with the ordinance. Based on tree mitigation calculations, 188 new replacement trees will planted. C� Landscaping The Landscape Plan identifies required Boulevard Trees, Buffer/Screen Plantings, Open Area Calculations and Replacement Tree Schedule. The plans require minor revisions but in general are compliant with the ordinance. The Environmental Coordinator shall review the final landscape plan. Comprehensive Plan Transportation Plan A Traffic Impact Study was prepared by Westwood Professional Services (November 2013) on behalf of the developer to analyze traffic impacts to and from 20th Avenue South (CSAH 54) and Cedar Street West. Conclusions from the study include 186 total AM Peak hour trips and 242 total PM Peak hour trips and all development intersections will operate at a Level of Service A (LOS A) in the 2019 No -build and 2019 Build conditions. Anoka County Highway Department has provided a comment letter dated January 24, 2014. In general, the County's comments relate to required additional right of way, proper sight distance, turn lane construction along CSAH 54 and appropriate noise mitigation. Right of way has been dedicated per the plat. Trees are being removed within the CSAH 54 right of way to provide proper sight distances. Turn lanes are being constructed with final approval required by the County. A noise mitigation analysis is being prepared by the developer. In addition, a landscape buffer is being planted in the rear yards abutting CSAH 54. Alternative Urban Areawide Review (AUAR) The project site is within the 2005 I-35E Corridor AUAR and is subject to the AUAR mitigation plan. The proposed development is consistent with development Scenario 1 for residential medium density and complies with the mitigation plan in regards to wetlands, water use, erosion and sedimentation, surface water runoff, wastewater and transportation. The AUAR requires developers to follow all appropriate guidelines and policies related to traffic noise and noise walls. A noise analysis shall be submitted by the developer in accordance to MPCA regulations which takes into consideration both I-35E and CSAH 54. Floodplain The 1982 FEMA Flood Insurance Rating Map (FIRM) indicates the southeast quadrant of the site is located within a designated Zone A flood plain district. Per the Stormwater Management Plan, the 100-year flood elevation is 909.7 which according the RCWD, this would also be the 100-year regulatory flood elevation. With the exception of the ditch, the site is above this elevation and no floodplain fill is proposed for this project. 7 The applicant has started the Letter of Map Revision (LOMR) process with the Federal Emergency Management Agency (FEMA) to verify the floodplain is not impacted by development. Per the Floodplain Ordinance, a Conditional Use Permit is required for any floodplain fill. The low floor freeboard shall be 2 feet above the floodplain elevation. The proposed lowest floor elevations appear to meet this standard. A Letter of Map Revision (LOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any building permits for parcels located within the floodplain. Growth Management Policy Per the Comprehensive Plan (page 3-27), an annual average of 230 units per year over each 5 year phasing period not to exceed 345 units in any 1 year is allowed. At the end of the 5 year phasing period unallocated units will be averaged out over the next 5 years. Phasing Plan A phasing plan has been submitted. Final Plat A land use application for PUD Final Plan/Final Plat of NorthPointe shall be required. At such time, the developer shall enter into a Development Contract and other documents as the City deems necessary. RECOMMENDATION Staff recommends approval of the Rezoning and PUD Development Stage Plan/Preliminary Plat for NorthPointe subject to the following conditions: 1. All comments from City Engineer letter dated February 7, 2014 shall be addressed. N. 2. All comments from Anoka County Highway Department dated January 24, 2014 shall be addressed. 3. All comments from MNDOT letter dated December 5, 2013 shall be addressed. 4. All comments from Environmental Coordinator letter dated February 3, 2014 shall be addressed. 5. Maintenance of the center median at CSAH 54 and Street A will be required from the neighborhood. Documentation confirming Homeowners Association maintenance of this median will be required. Sanitary Sewer and Watermain Comments: 1. The sanitary system has been revised to include a 10-inch line at minimum grade to serve future development to the west via Street A. The sanitary system also needs to accommodate future development to the south and southwest. The proposed lift station design will need to be coordinated with respect to flow and elevation to serve these areas in the future. Low floors are 4' above the highest anticipated water table based on the geotechnical data submitted. 2. Low floors should be 2' above the HWL, there are various areas where it is only 1.5' above. 3. Check that low floors are 1' above the EOF's such as Block 9 and Lot 15 Block 2. 4. The applicant must quantify the water quality benefits provided by the proposed ponds (based on Rice Creek Watershed District Rules) and include this information in the stormwater management plan for the development. 5. Calculations for the water reuse system must be provided for review and approval. In general, calculations must consider irrigation demand, reservoir capacity, and stormwater runoff supply and must address how these components are interrelated to provide volume control consistent with RCWD Rules. 6. As proposed, all lots within this 313-lot plat will access local roadways, which is consistent with county policy and acceptable to this department. A new local street intersection onto CSAH 54 labelled as "Street A" on the plat will be introduced, located approximately mid -point between the Cedar Street and Birch Street intersections. The Right of access along the remaining portions of CSAH 54 should be dedicated to Anoka County. It appears that there are sight distance deficiencies at the Cedar Street and the proposed "Street A" intersection, with the obstructions being trees. The City and/or the developer should ensure that the applicable sight distance requirements are met to the greatest extent possible for these intersections. Please note no business signs or plantings will be permitted within the county right of way, and care should be exercised when locating buildings, structures, plantings, berms, etc. outside of the county right of way, so as not to create additional sight distance obstructions along this section of CSAH 54. The construction of turn lanes on CSAH 54 in conjunction with this development is warranted. Based on the ACHD Development Review Process Manual, NB and SB CSAH 54 left turn lanes and right turn lanes are to be constructed at Birch Street, a NB CSAH 54 right turn lane and SB CSAH 54 left turn lane are to be constructed and the new "Street A" intersection, and NB CSAH 54 right turn lane and SB CSAH 54 left turn lane are to be constructed at Cedar Drive. It is our understanding the development and roadway connections are to be constructed in stages, so we anticipate that the CSAH 54 turn lane construction may also occur in stages. It should be noted that with there being 331 lots within this plat, and CSAH 54 being a high speed single lane roadway, turn movement conflicts should be anticipated at the 3 intersections onto CSAH 54 from this plat should the CSAH 54 turn lane construction lag in relation to the selling of lots and homes within the plat. In addition, as noted in the Northpointe Addition Traffic Impact Study dated November 2013, increases in turn movement conflicts and delays should also be anticipated off -site from the plat at the CSAH 54/CR J intersection, and ACt1D is not aware of any roadway or capacity improvement projects scheduled for this intersection in the foreseeable fixture. Water Resources: The project does not appear to adversely affect MnDOT right-of-way. However, the project area does outlet to an intermittent stream and wetland area that crosses I-35E right-of-way from the south end of the project and potentially to the I-35E ditch on the north end of the project. Therefore, a MnDOT drainage permit is required. The applicant will need to submit plans with hydraulic calculations showing that flows to MnDOT right-of-way remain the same or are reduced when comparing the existing to the proposed conditions. Drainage area maps with flow arrows for the drainage areas that affect MnDOT right-of-way should be included. The maps labeling should relate to the submitted calculations. The current plan also shows proposed lots and a cul-de-sac on the north end of the property adjacent to I-35E. It does not appear that this will be built with the current project. This area will not be included as part of the drainage permit approval, unless plans and calculations for this proposed developed area are included in the permit submittal. If not included at this time, as this area is planned for development, a separate additional drainage permit will be required. Storm Water Management and Erosion and Sediment Control There is no storm water treatment for this area and an infiltration depression capable of storing the additional runoff from a 100-year storm event will need to be constructed. The City Engineer recommends grading the infiltration depression adjacent to the existing wetland on the south end of the property. A drainage and utility easement over this area will be required. The grading plans are to be revised so that none of the drainage is being directed onto the adjacent properties to the east or west. It all needs to be either directed to Linda Avenue or to the wetland in the backyard. This will require a side yard swale to be graded along the lot lines. Likewise, the interior side lot lines also need to include drainage swales directing runoff to the north or south. Appropriate soil erosion and sediment controls shall be employed during construction of the single family homes. Utilities The current residence at 260 Linda Avenue is on private well and public municipal sanitary sewer. All three (3) lots will be required to connect to public water and sanitary which is capable of handling 3 single family homes. Wetlands There is a wet area on the SE side of the property and is identified as a wetland. No delineation has been completed. The delineation will need to be completed prior to final plat of the 3rd lot. Floodplain There is no floodplain on the parcel. RECOMMENDATION Staff recommends continuing the Public Hearing of the rezoning, preliminary plat and final plat of Talan Ridge until the following revisions/conditions have been met: 1. All comments from the City Engineer letter dated February 3, 2014 shall be addressed. 2. All comments from Environmental Coordinator letter dated February 3, 2014 shall be addressed. 3. The Final Plat shall be recorded by the Developer with Anoka County. 4. A Development Contract shall be drafted by the City, executed by the City and the owner and recorded with Anoka County. 5.
