The City Council also approved Resolution No. 02 -88 Approving Site and Building Plans, with conditions, and Conditional Use Permits for a Motor Fueling Station, Accessory Drive- through and Day Care Facility on November 25, 2002. The conditions for Site and Building Plan approval included a requirement that the developer enter into a Site Improvement Performance Agreement (Development Contract) with the City to insure the completion of improvements in accordance with the approved plans. Staff has prepared an agreement for council consideration. The agreement provides for the following: Submittal by the developer of a Letter of Credit representing one hundred and twenty-five (125) percent of the on -site improvement costs to insure completion of the project in accordance with the approved plans. 2. Submittal by the developer of a Letter of Credit representing one hundred and twenty-five (125) percent of the off -site improvement costs including Birch Street, Ware Road and Hodgson Road improvements. This includes $75,000 towards the installation of a signal at Hodgson and Birch. 3, Deposit of a cash escrow to reimburse the City for costs incurred by the City related to the development and improvement of the site and developer improvements. The developer is reviewing the agreement. His comments will be available at the City Council meeting. OFF -SITE WORK A. Off -site Work. The Developer shall design and install, at the Developer's Expense, certain Off -site Work as follows: 1. Eastbound and Westbound CSAH 10 (Birch Street) left and right turn lanes at Ware Road. 2. Easterly extension of Ware Road, from Sioux Lane to its intersection with CSAH 49 (Hodgson Road) and southbound Ware Road right turn lane onto CSAH 10 (Birch Street). 3. Southbound CSAH 49 (Hodgson Road) left tum lane , north of the CSAH 49 /CSAH 10 intersection and northbound CSAH 49 right turn lane onto Ware Road. Such improvements shall be completed in accordance with Section IV., herein. B. Right -of -Way. The Developer shall be responsible for acquiring any right -of -way, temporary easements, or permanent easements necessary for the making of such improvements. C. Plans & Specifications. The Developer shall prepare plans and specifications for the making of such improvements. Said plans and specifications shall be subject to review and approval by the City of Lino Lakes and Anoka County. D. Construction Observation. The Developer shall instruct its engineer to provide adequate field inspection personnel to assure an acceptable level of quality control to the extent that the Developer's engineer will be able to certify that the construction work meets the approved City and County standards as a condition of City /County acceptance. In addition, the City and or County, shall have one or more City inspectors inspect the work on a full or part-time basis. The Developer, its contractors and subcontractors, shall follow all reasonable instructions received from the City's/County inspectors. Prior to construction, the Developer or its engineer shall schedule a preconstruction meeting at a mutually agreeable time at the Lino Lakes City Hall, located at 600 Town Center Parkway, Lino Lakes, Minnesota with contractors, subcontractors, the City staff, and other parties specified by the City to review the program for the construction work. E. Record Plans. An electronic copy of the plans shall also be submitted in an AutoCad DWG format. F. Traffic Signals. The developer agrees to participate financially towards the installation of either temporary or permanent traffic control devices (signals) at the intersection of CSAH 10 (Birch Street) and CSAH 49 (Hodgson Road). The Developers financial participation of the cost of such traffic control devices shall be $75,000. The Developer agrees to make such payment to the city immediately prior to the City entering into a contract to install such traffic control devices. The Developer further agrees to post a security in the amount of one hundred and twenty -five percent of such participation in the form setforth in Section V. G. Cost Estimates. Spirit Hills Performance Agreement 12/0002 4 V. GUARANTEE. A. The Developer will fully and faithfully comply with all terms and conditions of any and all contracts entered into by the Developer for the installation and construction of all Developer's Off -site Work and hereby guarantees the workmanship and materials for a period of one year following the City's final acceptance of the Developer's Off -site Work. Concurrently with the execution hereof by the Developer, the Developer will furnish to, and at all times thereafter maintain with the City, a cash deposit, certified check, or Irrevocable Letter of Credit, based on one hundred twenty -five (125%) percent of the total estimated cost of Developer's On -site and Off -site Work. An Irrevocable Letter of Credit shall be for the exclusive use and benefit of the City of Lino Lakes and shall state thereon that the same is issued to guarantee and assure performance by the Developer of all the terms and conditions of this Development Contract and construction of all required improvements in accordance with the ordinances and specifications of the City. The City reserves the right to draw, in whole or in part, on any portion of the Irrevocable Letter of Credit for the purpose of guaranteeing the terms and conditions of this contract. The Irrevocable Letter of Credit shall be automatically extended for additional periods of one year from present or future expiration dates unless thirty (30) days prior to such the City Clerk or Administrator is notified in writing by certified mail that the Letter of Credit will not be renewed. B. The Developer may request reduction of the Letter of Credit, or cash deposit based on prepayment or the value of the completed improvements at the time of the requested reduction. Prior to the final acceptance of the Developer's Improvements the City shall require a Performance Bond or Cash Escrow to cover the warranty provisions of the agreement. The amount shall be determined by the City Engineer. VI. REIMBURSEMENT OF COSTS. A. The Developer agrees to establish a noninterest bearing escrow account with the City in an amount established by the City Engineer or his designee for the payment of all City fees and costs incurred by the City related to the On -site and Off -site Work, including, but not limited to, the following: Spirit Hills Performance Agreement 5 12/04/02 1. The City shall have a right to reimburse itself from the Escrow. If it appears that the actual costs incurred will exceed the estimate, then Developer and City shall review the costs required to complete the project. In such case, Developer shall deposit additional sums with the City to pay for the agreed upon increase. VII. REMEDIES FOR BREACH A. The City shall give prior notice to the Developer of any default hereunder before proceeding to enforce such financial guarantee or before the City undertakes any work for which the City will be reimbursed through the financial guarantee. If within ten (10) days after such notice to it, the Developer has not notified the City by stating in writing the manner in which the default will be cured and the time within which such default will be cured, the City will proceed with the remedy it deems appropriate. B. At any time after the completion date and any extensions thereof, if any of the work is deemed incomplete, the City may proceed in any one or more of the following ways to enforce the undertakings herein set forth, and to collect any and all expenses incurred by the City in connection therewith, including, but not limited to, engineering, legal, planning and litigation costs and expense. The enumeration of the remedies hereunder shall be in addition to any other remedies available to the City. Spirit Hills Performance Agreement 6 12/04/02 1. Specific Performance. The City may in writing direct the surety or the Developer to cause the Work to be undertaken and completed within a specified reasonable time. If the Developer fails to cause the Work to be done and completed in a manner and time acceptable to the City, the City may proceed to bring an action for specific performance to require work to be undertaken. 2. Completion by the City. The City, after notice, may enter the premises and proceed to have the Work done either by contract, by day labor or by regular City forces. The Developer may not question the manner of doing such work or the letting of any such contracts for the doing of any such work. Upon completion of such work, the Developer shall promptly pay the City the full cost thereof as aforesaid. 3. Deposit of Financial Guarantee. In the event the financial guarantee has been submitted in the form of a Letter of Credit, the City may draw on the Letter of Credit the sum equal to the estimated cost of completing the Work, plus the City's estimated expenses as defined herein, including any other costs, expenses, and damages for which the surety may be liable hereunder, but not exceeding the amount set forth on the Letter of Credit. The money shall be deemed to be held by the City for the purpose of reimbursing the City for any costs incurred in completing the Work as hereinafter specified. Any funds remaining after completion of the project shall be returned to the Developer. VIII. OCCUPATION OF PREMISES The Developer agrees that it will not cause to be occupied any portion of the building or improvements to be constructed upon the premises until completion of the building and site improvements as more fully described in the approved plans and following issuance of a Certificate of Occupancy. IX. INSURANCE Developer or all its subcontractors shall take out and maintain until one (1) year after the City has accepted the private improvements, public liability and property damage insurance covering personal injury, including death, and claims for property damage which may arise out of the Developer's Work or the Work of its subcontractors or by one directly or indirectly employed by any of them. Limits for bodily injury and death shall be not less than Five Hundred Thousand and no /100 ($500,000.00) Dollars for one person and One Million and no /100 ($1,000,000.00) Dollars for each occurrence; or a combination single limit policy of One Million and no /100 ($1,000,000.00) Dollars or more. The City, its Spirit Hills Performance Agreement 7 12!04/02 employees, its agents and assigns shall be named as an additional insured on the policy, and the Developer or all its subcontractors shall file with the City a certificate evidencing coverage prior to the City signing the plat. The certificate shall provide that the City must be given ten (10) days advance written notice of the cancellation of the insurance. The certificate may not contain any disclaimer for failure to give the required notice. X. REIMBURSEMENT OF COSTS FOR DEFENSE The Developer agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this Agreement, or any portion thereof, including court costs and reasonable engineering and attorneys' fees if the City prevails in such action. VALIDITY If a portion, section, subsection, sentence, clause, paragraph or phrase in this Agreement is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect or void any of the other provisions of the Site Improvement Performance Agreement. GENERAL A. Binding Effect. The terms and provisions hereof shall be binding upon and inure to the benefit of the heirs, representatives, successors and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Property and shall be deemed covenants running with the land. B. Notices. Whenever in this Agreement it shall be required or permitted that notice or demand be given or served by either party to this Agreement to or on the other party, such notice or demand shall be delivered personally or mailed by United States mail to the addresses hereinbefore set forth on Page 1 by certified mail (return receipt requested). Such notice or demand shall be deemed timely given when delivered personally or when deposited in the mail in accordance with the above. The addresses of the parties hereto are as set forth on Page 1 until changed by notice given as above. C. Incorporation by Reference. All plans, special provisions, proposals, specifications and contracts for the improvements furnished and let pursuant to this Agreement shall be and hereby are made a part of this Agreement by reference as fully as if set out herein in full. D. Final Plat, The Developer shall prepare and submit to the City, for approval, a Final Plat of the subject property in accordance with the City Subdivision Ordinance and conditions of approval. The city agrees to give final approval Spirit Hills Performance Agreement 12/O4/02 8 to the plat of the Subdivision upon execution and delivery of this agreement and all required security. E. Hours of Construction Activity. All construction activity shall be limited to the hours set out in City Ordinances as follows: Monday through Friday 7:00 a.m. to 7:00 p.m. Saturday 9:00 am. to 5:00 p.m. Sunday and Holidays No working hours allowed XIII. VIOLATIONSBUILDING PERMITS In the event that Developer violates any of the covenants and agreements contained in this Site Improvement Performance Agreement and to be performed by the Developer, the City, at its option, in addition to the rights and remedies as set out hereunder may refuse to issue building permits to any property within the development and/or stop building construction within the development until such time as such default has been corrected to the satisfaction of the City. While the applicable LI, Light Industrial district provisions do not specifically list carwashes as a permitted or conditional uses, the district does state that uses permitted in commercial zoning districts shall be allowed within LI districts. As a result, the use will be treated as a conditional use and processed accordingly. This review is based on the following plan submittals: Preliminary Site Plan dated 11/22/02 Grading, Drainage & Erosion Control Plan dated 11/22/02 Utility Plan dated 11/22/02 Landscape/Tree Preservation Plan dated 11/22/02 Floor Plan dated 11/22/02 Building Elevations dated 11/22/02 Lighting Plan dated 10/16/02 TKDA Engineering Comments dated 11/5/02 Environmental Board Comments dated 11/4/02 Benkler Carwash Page 2 of 9 ANALYSIS Site and Building Plan Review Property Legal Description. The subject property is described as part of Auditor's Subdivision # 54 and comprises two individual lots. As part of the CUP processing, the two lots which comprise the subject property should be legally combined. Access. Access to the subject site is to be provided via a 30 foot wide curb cut along Lake Drive. Appropriately, the access point is in direct alignment with Church Drive to the east. The acceptability of the proposed curb cut location and width as well as the need for associated roadway improvements (i.e. turn lanes) should however, be subject to comment and recommendation by the City Engineer and the Anoka County Highway Department. Circulation. The proposed use includes a full service carwash, a self- service carwash and a quick lube facility. Recognizing the co- existence of these activities, a well - conceived plan for site circulation is both very important and very challenging. As shown on the submitted site plan, site circulation is proposed to occur in a counter - clockwise fashion. While the proposed circulation pattern is considered well conceived and follows a natural tendency to "keep right ", some concern exists in regard to a users understanding of the circulation pattern and a potential for congestion at the sites entry point. To address this concern, the applicants are proposing to separate site entry and exit areas with a landscaped median and identify desired site circulation routes with freestanding directional signage. To further identify desired traffic movements, pavement directional signage has also been proposed. Finally and since the Planning and Zoning Board meeting, the applicants have added a third stall to the full service wash preparation area as a means of lessening potential congestion at the site's point of entry Two circulation - related concerns exist in regard to the by -pass lane on the west side of the property. One concern relates to the necessary u -turn maneuvers that will occur west of the building where full service carwash vehicles move from the staging area to the conveyor area. It appears conceivable that such maneuvers could interfere with access to both the self- service carwash and quick lube facility. A second concern with the by -pass lane relates to the areas west of the self - service wash and quick lube facility where a potential overlapping of vehicular stacking could potentially occur. The applicant has indicated that the self -serve wash is to accommodate recreational vehicles. It appears likely that a recreational vehicle waiting to occupy the southerly self- service stall may block access to the quick lube stacking area. Benkler Carwash Page 3 of 9 While the applicant is encouraged to address the aforementioned concerns, it is acknowledged that such circulation issues are internal to the site and constitute more of an inconvenience to site patrons than a threat to public safety. Lot Size and Setbacks. The lot and building performance standards for properties within the LI District are listed below. As shown above, all applicable lot and building performance standards have been satisfied. Architecture/Building Materials. According to the Ordinance, the architectural appearance of the building may not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. As shown on the submitted building elevations, the building is to be finished in a combination of colored rock face block, face brick and stucco. Such materials are consistent with the building material requirements of the Ordinance. Although the proposed building materials satisfy the requirements of the Ordinance, some concern exists in regard to the presentation of the building to Lake Drive. As proposed, the eastem facade of the building will consist of ten garage doors. To draw attention away from the garage doors, the applicant has proposed landscaped medians in the front of the building. Aside from "softening" the appearance of the building to Lake Drive passersby, the landscape medians also serve to channel traffic throughout the site. Benkler Carwash Page 4 of 9 Off- street Parking. The standards for calculating the off -street parking requirements for the proposed uses are outlined in Section 3, Subdivision 5 of the City Code. While the need for drying and employee stalls is obvious, it is believed that excluding stacking space from the off -street parking requirement for the carwash would result in an excessive off -street parking supply. Therefore, stacking spaces are considered acceptable off - street parking spaces. Including exterior stacking spaces, a total of 56 spaces are provided on site, exceeding that required by Ordinance. In accordance with applicable State requirements, two handicap stalls have been provided. At 18 feet in depth and 9 feet in width, all off -street parking stalls have been found to meet the minimum dimensional requirements of Section 3, Subd. 5 of the Ordinance. In regard to vehicular stacking space, the Ordinance states that stacking space associated with carwashes should accommodate the number of vehicles that can be washed during a maximum thirty - minute period and shall be subject to comment by the City Engineer. According to the applicant, it is anticipated that the full service carwash can accommodate 30 vehicles in a half hour period. As shown on the submitted site plan, four stacking lanes have been provided for the full serve carwash accommodating a total of 30 vehicles. Benkler Carwash Page 5 of 9 Landscaping. As shown on the landscape plan, a variety of trees are proposed on site. Specifically, mixtures of Northwoods Red Maple and Hackberry trees have been proposed along Lake Drive. Additionally, shrub plantings have been proposed within the two medians (within the interior of the site) and clump grass has been proposed at the northwest corner of the building. As noted in the attached Environmental Board comments, concern existed in regard to the number of plantings provided on site. The Board has specifically recommended that additional trees be provided. As part of the revised submission, additional on -site plantings have been provided Tree Preservation. The tree preservation plan has been superimposed on the landscape plan. In consideration of the request, the Planning and Zoning Board recommended as a condition of site and building plan that the tree preservation plan be modified to indicate all significant trees on site and those to be saved. Such modification is not considered applicable as all tress are to be removed from the site. Curbing and Striping. As a condition of site and building plan approval, all off- street parking areas and associated drive lanes should be provided a continuous concrete curb. This includes the planting medians on the east side of the building where such curbing will both define the drive lanes and serve to protect the vegetation within such medians. Aside from the striping of off - street parking stalls (a standard ordinance requirement), it is recommended that the one -way bypass lane around the perimeter of the building be striped and thereby segregated from adjacent stacking lanes. Trash Enclosures. According to Section 3, Subd. 4.G of the Ordinance, all refuse and recyclable materials must be stored within the principal building or within an accessory structure (within a side or rear yard) that is totally screened from eye level view from neighboring uses and public rights of way. The applicant has indicated that trash will be stored indoors. Signage. The site plan illustrates a freestanding sign in the northeast corner of the site. As previously indicated, the applicant is proposing freestanding and pavement directional signage to identify desired traffic movements on the site. As a condition of site and building plan approval, all site signage must comply with the applicable requirement s of the Sign Code. Benkler Carwash Page 6 of 9 Lighting. As required by ordinance, a lighting plan identifying illumination levels on the subject site has been provided. The proposed illumination levels and fixture details have been found to be acceptable. According to the plan, freestanding shoebox style fixtures have been proposed within parking areas while wall mounted fixtures have been proposed on the north, south and east sides of the building. According to the Ordinance, the source of lights should be hooded and controlled so as not to illuminate adjacent properties or public rights -of -way. More specifically, low- impact, downward - focused, low spill, low intensity fixtures should be used. Utilities. A utility plan has been submitted for review by the City Engineer. As a condition of site and building plan approval, the utility related modifications and comments as set forth in the City Engineer's memo should to be incorporated into the plans. Grading and Drainage. A grading and drainage plan has been submitted for review by the City Engineer. One noteworthy concern related to drainage involves the handling of wastewater from the self - serve carwash. Of particular concern at the Planning and Zoning Board meeting was the potential "dragging" of water toward the site's egress point (on Lake Drive) in the winter months and the potential for the creation of an ice slick. To address such concern, the applicant has proposed a 20 foot heated apron at the self - service carwash exit. As a condition of site and building plan approval, the grading and drainage related modifications and comments as set forth in the TKDA letter dated 11/5/02 should to be incorporated into the plans. As an additional condition of approval, the applicant should secure a utility easement from the school district to allow the proposed sewer pipe to overlay school district property. Such easement should be secured prior to building permit issuance. CEPTED Review. The primary issues of the CEPTED review regard traffic flow through the development. The development has been redesigned to address these issues. Environmental Issues. The Environmental Board reviewed the request at their October 30, 2002 meeting and recommended approval. Their comments are attached to this report. Rice Creek Watershed District Review. The Rice Creek Watershed District (RCWD) has determined that the proposed development will not require a Watershed District Permit as the impervious surface coverage on the property does not exceed one acre. Benkler Carwash Page 7 of 9 Development Agreement: Prior to the commencement of any site work, the applicant will be required to enter into a development agreement with the City and post all the necessary securities required by it. Conditional Use Permit As previously indicated, the applicant is requesting approval of a conditional use permit to allow a Carwash within an I -1, Light Industrial zoning District (both drive- through and self - service carwashes are listed as conditional uses). In considering conditional use permit requests, the Ordinance states that the Planning and Zoning Board shall recommend approval and the City Council shall order the issuance of such permit only if it finds that such use at such location: 1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. Comment: The proposed use is not anticipated to be detrimental or endanger the public. 2. Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the City and this ordinance. Comment: The Comprehensive Plan suggests industrial use of the site. Within the applicable LI, Light Industrial zoning district, carwashes are considered a conditional use. Thus, the proposed land use satisfies the land use directives of the Plan. 3. Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. Comment: The building design is consistent with material requirements of the Ordinance and therefore will not negatively affect the essential character of the area. The proposed building is in fact anticipated to improve the appearance of the area. 4. Will be served adequately by essential public facilities and services, including street, police and fire protection, drainage structures, refuse disposal, water and sewer systems, and schools; or will be served adequately by such facilities Benkler Carwash Page 8 of 9 and services provided by the persons or agencies responsible for the establishment of the proposed use. Comment: As a condition of project approval, the building will be adequately served by essential public facilities and services. 5. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. Comment: This development is not expected to increase public costs, nor be detrimental to the economic welfare of the community. 6. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. Comment: The proposed use of the property is not expected to create any excessive externalities that would be abnormal to the character of the area. 7. Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic on surrounding public thoroughfares. Comment: The site layout meets standards held within the City's Zoning Ordinance including turn lanes, access width, and access spacing/location. 8. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. Comment: The applicant is currently working with the City Engineer to satisfy drainage related issues. 9. Will conform to specific standards of this ordinance applicable to the particular use. Comment: The proposed use will as a condition of approval meet the applicable requirements of the Ordinance. Benkler Caro/ash Page 9 of 9 OPTIONS. At their meeting on November 13, 2002, the Planning & Zoning Board considered the site and building plans and conditional use permit application and recommended approval subject to the conditions listed in resolution 02 -174. In consideration of the request, the following options are available to the City Council: A. Approve the site and building plans/conditional use permit request based on the findings in Resolution 02 -174 and subject to the conditions in the resolution. B. Deny the site and building plans/conditional use permit request. C. Table the application and request more information. RECOMMENDATION Staff recommends that the City Council approve the site and building plans/conditional use permit request as outlined in Resolution 02 -174 (Option A). CITY OF LINO LAKES RESOLUTION NO. 02-174 RESOLUTION APPROVING SITE AND BUILDING PLANS AND A CONDITIONAL USE PERMIT FOR A FULL SERVICE CARWASH, A SELF - SERVICE CARWASH AND A QUICK LUBE FACILITY WHEREAS, the City has received an application for a site and building plan review and a conditional use permit to allow a full service carwash, a self - service carwash and a quick lube facility; and WHEREAS, the legal description of the property is: (see ATTACHMENT A) WHEREAS, the subject property is zoned LI, Light Industrial; and WHEREAS, the site and building plan/conditional use permit approval request is based on the following plans prepared by Designery Architecture, Glen Rehbein Companies and LSI Industries and related correspondence: Preliminary Site Plan dated 11/22/02 Grading, Drainage & Erosion Control Plan dated 11/22/02 Utility Plan dated 11/22/02 Landscape/Tree Preservation Plan dated 11/22/02 Floor Plan dated 11/22/02 Building Elevations dated 11/22/02 Lighting Plan submitted 11/25/02 TKDA Engineering Comments dated 11/5/02 Environmental Board Comments dated 11/4/02 WHEREAS, at their meeting on November 13, 2002, the Planning & Zoning Board considered the site and building plans and conditional use permit application and recommended approval subject to the conditions listed in the meeting minutes; and WHEREAS, the City Council of the City of Lino Lakes makes the following findings of fact, as required by Section 2 Subd. 2.B.7 of the Zoning Ordinance which establishes conditional use permit evaluation criteria. a. This application will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. b. This application will be harmonious with the general and applicable specific plans and policies of the Comprehensive Plan of the City and the Zoning Ordinance. c. This application will be designed, constructed and operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. d. This application will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems, and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. e. This application will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. f. This application will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. g. This application will have vehicular approaches to the property that are so designed as not to create traffic congestion or an interference with traffic on surrounding thoroughfares. h. This application will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. This application will conform to specific standards of the Zoning Ordinance applicable to the particular use. WHEREAS, the City Council of the City of Lino Lakes makes the following findings of fact, as required by Section 7 Subd. 5.H.2 of the Ordinance which establishes "commercial carwashes" as conditionally permitted uses in LI, Light Industrial zoning districts provided that: a. The site is serviced by municipal sanitary sewer. b. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. c. Magazining or stacking space is constructed to accommodate that number of vehicles that can be washed during a maximum thirty (30) minute period and shall be subject to the approval of the City Engineer. d. At the boundaries of a residential use or district, a strip not less than ten (10) feet shall be landscaped and screened in compliance with Section 3, Subd. 4.S of the Ordinance. e. Parking or magazine storage space shall be screened from view of abutting residential districts in compliance with Section 3, Subd. 4.S. of the Ordinance f The entire area other than occupied by building or plantings shall be surfaced with a concrete or bituminous material which will control dust and drainage which is subject to the approval of the City Engineer. g. The entire area shall have a drainage system which is subject to approval of the City. h. Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the City Engineer. i. All signing and informational or visual communication devices shall be in compliance with Appendix C of the City Code. J. Provisions shall be made to reduce noise. NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the site and building plans and a conditional use permit to allow a full service carwash, a self - service carwash and a quick lube facility subject to the following conditions: 1 The two lots, which comprise the subject property, be legally combined. 2. The acceptability of the proposed curb cut location and width as well as the need for associated roadway improvements (i.e. turn lanes) be subject to comment and recommendation by the City Engineer and the Anoka County Highway Department. 3. Building colors be as specified on building elevations dated 11/18/02. 4. All off - street parking areas and associated drive lanes (including the planting medians on the east side of the building) be provided a continuous concrete curb. 5. The one -way bypass lane around the perimeter of the building be striped and thereby segregated from adjacent stacking lanes. 6. The source of all site lighting be hooded and controlled so as not to illuminate adjacent properties or public rights -of -way. More specifically, low- impact, downward - focused, low spill, low intensity fixtures shall be used as specified lighting plan submitted 11/25/02. 7. All trash be stored indoors. 8. All site signage comply with the applicable requirements of the Sign Code. 9. The conditions of the TKDA letter (dated 11/5/02) related to grading, drainage and utilities are satisfied. 10. Prior to building permit issuance, the applicant secure a utility easement from the school district to allow the proposed sewer pipe to overlay school district property. 11. Prior to the commencement of any site work, the applicant enter into a development agreement with the City and post all the necessary securities required by it. The proposed infiltration swale along the northerly development property line is shown with a 2% slope but computes to only a 1.6% slope between the rainwater garden and the west infiltration basin. Correct on plans and in stormwater calculations. 5. Correct and revise parking stall grades as water appears to be trapped in the northerly stall of six (6) stalls on the east of the site and south of access road from Lake Drive. 6. Recommend that when on -site or imported soils are used to fill low areas that they must be a minimum "SCS - Soil Group B" material. 7. All development site concrete curb and gutter is to be Mn/DOT B618. For the proposed "flat" areas, it is recommended that a pattern be established to maintain the back of the curb to the maximum extent possible. This will be a better guide to vehicle drivers and will protect the adjacent stormwater system from damage. The pattern should consist of a three (3) foot opening with one (1) foot tapers along areas designated for "flat" curb, as shown on the plans. 8. Provide to the City a copy of the Anoka County Highway Department permit (approval) for driveway access requirements prior to construction start-up. B. Watermain: This extension and service would require plans and specifications that follow City standards for utility construction in public rights -of -way. It would also require Anoka County, Lino Lakes, and Minnesota Department of Health permits. C. Sanitary Sewer. In general, the proposed sanitary sewer alignment from 4th Avenue to the Development site is acceptable with the following comments: 1. Provide the City with a permanent 20' wide easement that is parallel to the proposed sanitary line. Also, grading along the easement that provides future maintenance access. 2. A sanitary manhole will be needed at the junction of the N-S 8" sanitary pipe and the 6" sanitary service pipe to the building. Also, check with the City regarding the size and material of the service pipe to the building as well as clean-out or other manhole requirements. Mr. Jim Studenski, P.E. City of Lino Lakes November 5, 2002 Page 3 3. There are concerns regarding wetlands possibly crossing the sanitary sewer alignment. If there are wetlands that will need to be crossed, then these areas should be identified in plan and specification format including solutions for addressing any wetlands crossing issues. Generally, crossing a wetland with a sanitary sewer pipe is discouraged. 4. Since the 8" sanitary sewer line will be owned and maintained by the City, plans and specifications following City standards for utility construction in public rights -of -ways and/or easements. This work will require a permit (approval) from the Minnesota Pollution Control Agency for sanitary sewer extensions. D. Erosion Control: 1. Label and list on the plans an erosion control schedule for the project. 2. The City reserves the authority to site - inspect and provide instruction to the Owner for the installation, maintenance, repair and removal of all erosion control devices. This is regardless of whether it has been shown on the plans or not, if it is deemed to be in the best interests of the City. Owner to provide unlimited site inspection access to designated City Staff until such time as erosion control devices are no longer deemed necessary by City forces. 3. Owner's civil engineer to provide design for the type and depth of the growing medium material to be placed at the labeled infiltration basins, infiltration Swale and other sod/seed areas throughout the development site. E. Storm Sewer System: 1. Storm calculations (Ray - 2nd Revised Carwash Site and dated October 10, 2002): • Page 3 under Subcatchment 3S, change Curve Number (CN) for pervious parking area from 10 to 49. Page 5, revise calculations for Reach1R: NSWALE as outlet invert cannot be 896.4 as this is lower than any elevation throughout the storm system. Page 7 under Pond 3P, West Infiltration Area and Routing #4: The modeling says that a "27" Horiz Orifice/Grate" is being used to convey stormwater to the existing pond along the westerly property line. From the information shown on Plan Sheet 1, an 8" PVC pipe would be the controlling factor. Please modify to fit the plan sheet or provide an explanation for how this component works. 2. Contours shown along westerly property line do not show enough detail and would fall into the adjacent private property. If as Plan Sheet 1 indicates, an 897 contour (not shown) would be needed on private property in order to construct to the 897.75 top of Mr. Jim Studenski, P.E. City of Lino Lakes November 5, 2002 Page 4 berm. If this is the case, then easement documents need to be submitted to the City. Also, rip -rap and an 8" PVC. storm outlet pipe along the westerly property line are shown on property that is not on the development site. This would require an easement to be submitted to the City. 3. MH with R-4342 casting and 8" PVC outlet located along the westerly development property line. The 8" PVC is recommended to be changed to a 15" RCP with fixed end section and set at the normal water elevation of 895.7 (instead of 895.00 shown on the plans). That is, the outlet structure and pipe are recommended to be re- designed. 4. Provide stormwater calculations for the 2 -year design rainfall event, the 10 -year design rainfall event and the 100 -year (revised) designed rainfall event. 5. Determine if 4" or 6" perforated draintile (or both) will be used on the project. Either correct the plans and/or re- compute the stormwater runoff/routing calculations to match the sizing. 6. Provide the City Engineer with literature and technical data describing the proposed "4- inch Netlon Advanced turf" and "Netpave 50 backfilled with 3/8" clear - washed dresser trap bit. admix rock" for review. There are concerns about permeability and bituminous component of the Netpave regarding compaction over time. 7. Prior to construction conunencement, provide the City Engineer with a completed copy of the MPCA -NPDES permit. 8. Regarding separation between groundwater elevation and the mostly westerly infiltration basin base or finish elevation. Groundwater elevations have been established by two (2) soil borings as described by a Braun Intertec Report (May 8, 2002). The groundwater elevations were 890.5 and 892.5. These groundwater elevations provide greater than the three (3) foot separation from all of the development site proposed basins or swales base elevations. It is also recommended that nearby private water supply wells be located for adjacent properties to determine the proximity of the water wells to the stormwater system. The location of the adjacent private wells along with well log information needs to be provided to the City Engineer for his review. 9. Pretreatment features, such as basin slope geometry, ponding water depths and detention time, length/width for ponds, swale slope and overflow issues have been addressed on the revised plans. It is recommended that these plan items be accepted as shown. Mr. Jim Studenski, P.E. City of Lino Lakes November 5, 2002 Page 5 10. Provide Construction Sequencing and Maintenance Plan for review and consequent approval. It is recommended that these items be provided to the City Engineer for review prior to plan approval. In specific, it is recommended as part of the Maintenance Plan that the Owner be required to file yearly reports to the City describing the working condition of the stormwater system by a qualified person capable of recommending corrective measures as they become apparent. It should be expected that the rainwater gardens would need removal and replacement for plugging on an average of three (3) years. F. The Environmental Board recommended that an additional boring be drilled at the Westem most infiltration pond to ensure that this 3 foot separation will exist. This additional boring is requested at the discretion of the City Engineer. • That the lighting plan be changed to reflect our City standard for low- impact, downward - focused, low- spill, low- intensity fixtures. • That the project applicant submit a sequence plan and Best Management Practices Plan. Best management should include a plan for periodic sweeping of the parking areas, trash and litter pick -up, proper storage of any materials that may spill into the environment, and a plan to maintain the pervious surfaces in the design.
