In 2000, Ms. Anderson would assist with the presidential election process. In 2001, she would assist with the redistricting process. An agreement was reached with Ms. Anderson and formalized by our employment attorney. Both Ms. Anderson and the City Administrator have reviewed the agreement and find it acceptable. Ms. Anderson would be paid $5,000 in each of the two years she provides assistance to the City Clerk. While this was not included in the 2000 operating budget, the Finance Director has indicated that 2000 revenues are running slightly ahead of projections and should be sufficient to cover the 2000 portion of the contract. The 2001 amount will be included in the 2001 operating budget. OPTIONS: 1. RECOMMENDATION: Option #1 INDEPENDENT CONTRACTOR AGREEMENT This Agreement made and entered into effective the day of , 2000, by and between the City of Lino Lakes (hereinafter referred to as "The City ") located at 600 Town Center Parkway, Lino Lakes, Minnesota 55014 -1182 and Marilyn G. Anderson (hereinafter referred to as "Anderson" or "Contractor ") with an address of WHEREAS, the City is required to provide governmental services associated with the November 2000 general election; and WHEREAS, the City will be required to review and, if necessary, redraw voting districts based upon the results of the 2000 census; and WHEREAS, Anderson is experienced and knowledgeable in assisting in preparations for and implementation of general elections (hereinafter referred to as election services) and activities associated with redrawing voting districts (hereinafter referred to as redrawing voting district services); and WHEREAS, the City wishes to engage Anderson to assist in providing these services; NOW, THEREFORE, the parties agree as follows: 1. The City hereby engages the Contractor to provide expertise and assist the Lino Lakes City Clerk in meeting the City's duties and responsibilities in preparing for and implementing the November 2000 general election (election services). The Contractor represents that with her expertise and assistance, the City will meet its duties and responsibilities in preparing for and implementing the November 2000 general election. 2. The City hereby engages the Contractor to provide expertise and assist the Lino Lakes City Clerk in meeting the City's duties and responsibilities in redrawing voting districts based upon the results of the 2000 census. The Contractor represents that with her expertise and assistance, the City will meet its duties and responsibilities in redrawing voting districts based upon the results of the 2000 census. 3. The Contractor shall perform under this Agreement as an independent contractor and nothing contained herein is intended or shall be construed to make or constitute the Contractor as the City's agent, employee, partner, joint venturer, or representative, but rather the Contractor shall act and perform hereunder according to her own means and methods and in and under her exclusive charge and control. 4. The Contractor will provide these services as a skilled professional. Accordingly, she shall not be limited nor assigned to any fixed days or hours of work, but rather may render performance of her obligations hereunder at such times as she in her best business judgment may choose. The parties have estimated that the Contractor will spend approximately one hundred (100) hours on each project. 5. The Contractor will be compensated on a per project basis. A. The Contractor will receive the sum of five thousand dollars ($5,000) for providing election services. The Contractor has indicated that these services will be provided from August through November in the year 2000. The parties agree that this payment will be made in four equal payments of one thousand two hundred fifty dollars ($1,250) for each month August through November, 2000. B. The Contractor will receive the sum of five thousand dollars ($5,000) for providing redrawing voting district services. The Contractor has indicated that these services will be provided from May through August of 2001. The parties agree that this payment will be made in four equal payments of one thousand two hundred fifty dollars ($1,250) for each month May through August of 2001. 6. The Contractor acknowledges that as an independent contractor she has sole responsibility to obtain workers' compensation insurance and for payment of all unemployment, F.I.C.A., social security, income and/or other taxes relating to fees earned by the Contractor hereunder. The City agrees to prepare and provide the Contractor with an annual 1099 form for tax reporting purposes. 7. This Agreement shall not restrict the parties from engaging in any other business or personal pursuits and it is expressly anticipated that the Contractor will continue to engage in other business or personal pursuits while a party to this agreement. 8. In the event that the Contractor is not performing the services in a manner acceptable to the City, the City will give the Contractor written notice of any deficiency and permit Contractor fourteen (14) calendar days to correct the deficiency. In the event that the City is not meeting its obligations in a manner acceptable to the Contractor, the Contractor will give the City written notice of any deficiency and permit the City fourteen (14) calendar days to correct the deficiency. In the event that the deficiency is not corrected within the fourteen (14) calendar days, the objecting party may terminate this agreement and any further payments or obligations called for by this agreement will be forfeited. This provision does not limit either party from bringing a separate action alleging breach of this agreement. 9. This Agreement constitutes the entire agreement between the parties hereto pertaining to the subject matter hereof and supercedes all prior agreements, understandings, negotiations and discussions, whether oral or written. There are no warranties, representations or agreements among the parties in connection with the subject matter hereof, except as set forth or referred to herein. No supplement, modification, waiver or termination of this Agreement or any provision hereof shall be binding unless executed in writing by the parties to be bound. No waiver of any of the provisions of this Agreement shall constitute a waiver of any other provision, nor shall such waiver constitute a continuing waiver unless otherwise expressly provided. 10. The validity, interpretation, and performance of this Agreement shall be governed by the laws of the State of Minnesota. 2 11. This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. 12. In the event that any provision of this Agreement conflicts with the law under which it is to be governed, said provision shall be severed from this Agreement without affecting the remaining provisions thereof. Believing that cities are the means to "community," and major contributors to the quality of life in Minnesota, the LMC Board of Directors worked with a public relations firm to obtain candid feedback from citizens to determine what quality of life means to them and how city government contributes to that quality of life. From their findings, the LMC developed a program called Building Quality Communities. The program's mission is to enhance the perception of Minnesota city governments and city officials, to reinvigorate and increase citizen involvement in city government and to reinstill a sense of pride in public service. Presentations about the program were made at the LMC annual conference last week. The first step in joining the program is to adopt the attached resolution affirming the city's participation. The hearing was opened and continued to June 26 in order to provide notice to the property owners in accordance with State statutes. The necessary notices have been mailed to property owners indicating the amount of the assessment and the date of the hearing. They have also received a copy of the entire assessment roll for their subdivision. Summaries of the project costs and assessments, as well as the actual assessment rolls, are attached. The proposed assessments are based on the project costs. Appraisals for the properties to be assessed could not be prepared in time for the project to proceed this construction season. The actual amount which can be assessed to each property cannot exceed the benefit to the property as defined by State statute. After the assessment hearing is held, and the proposed assessment is adopted, the property owners have 30 days to appeal the assessment amounts. Only after the appeal period expires, and the City is able to determine the funding to be derived from assessments, will the City be able to consider award of the contract. OPTIONS: 1. Such proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of fifteen years, the first installment to be payable on or before the first Monday in January, 2001, and shall bear interest at the rate of eight percent (8 %) per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2000. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County. The first parcel is immediately north of the school and was originally a part of a triangular piece of property sold by Rehbein to the School District. The request is to split off the easterly 7.54 acres of this parcel of property with ownership retained by Rehbein Companies. When the School District property was rezoned to PSP, this parcel remained Zoned Industrial at the City's recommendation. This parcel will remain a part of the Rehbein Industrial area to the north and east. The property is currently owned by Rehbein but will be transferred to the School District upon approval of the subdivision. Staff would recommend approval of this minor subdivision as requested with the following condition: 1. Twenty feet (20') of additional right -of -way shall be dedication from Parcel A to Anoka County providing a total of 60' from the centerline of Lake Drive. However, numerous engineering issues remain unresolved which are significant enough PURCHASE AGREEMENT This Agreement for the exchange of real property is made and entered into by and between, Glenn Rehbein Excavating, Inc., Glenn R. Rehbein and Myrna L. Rehbein, 7374 Lake Drive, Lino Lakes, Minnesota 55014 (hereinafter referred to as "Rehbein ") and Centennial Schools, Independent School District #12, 4707 North Road, Circle Pines, Minnesota 55014 (hereinafter referred to as "ISD # 12 "). WHEREAS, the parties have agreed to exchange real property (hereinafter collectively referred to as "premises" or "real property "), situated in the City of Lino Lakes, County of Anoka, State of Minnesota, and described in the attached exhibit, labeled "Exhibit A ", and by reference made a part hereof. NOW THEREFORE, in consideration of the mutual promises and covenants contained herein, and other good and valuable consideration, it is agreed as follows: 1. Consideration. The parties hereby agreed that the real property to be exchanged and the services to be provided as a part of this exchange shall constitute good and sufficient consideration for mutual performance and each shall convey to the other by warranty Deed, all of its right, title, interest and equity in and to the property in consideration for the receipt of property held by the other and in consideration for the excavation work to be performed by Rehbein. 2. Closing. A. Obligations. The parties agree to execute and deliver a Warranty Deed conveying marketable title to said real property subject only to the following exceptions: (1) Covenants, conditions, restrictions declarations and easements of record, if any; (2) Reservations of minerals or mineral rights by the State of Minnesota, if any; (3) Building, zoning and subdivision laws and regulations; and (4) Any covenants or agreements entered into by Buyer, its successors or assigns. C. Date of Closing. Closing shall take place as soon as possible. 3. Title. The parties shall furnish all abstracts of title or registered property abstracts certified to date to include property searches covering bankruptcies, and state and federal judgments and liens. If the any party desires to purchase title insurance, the premium for said title insurance shall be the responsibility of that party. Each party shall be allowed ten (10) days after receipt thereof for examination of said title and the making of any objections thereto, said objections to be made in writing or deemed to be waived. If any objections are so made pursuant to this paragraph, the transferor shall be allowed one hundred twenty (120) days to make such title marketable. Pending correction of title, the closing shall not be postponed. If said title is not marketable and is not made so within one hundred twenty (120) days from the date of written objections thereto as provided above, this party now in title shall undertake such proceedings as is necessary to make such title marketable at the expense of the other. Special Assessments and Real Estate Taxes The parties shall pay in. full .all unpaid special assessments against the property for all public improvements, levied, pending or assessed as of this Purchase Agreement. It is the intention of the Parties that assessments due as the result of the Centennial Middle School Street and Utility Improvement, City of Lino Lakes, shall . be the responsibility of new property owners. To the best of the knowledge and belief of the parties, there are no environmental proceedings, applications, ordinances, petitions, court resolutions, investigations by public or private agencies, or other matters pending which could prohibit, impede, delay, or adversely affect the use of the property. D. To the best of the knowledge and belief of each party, there are no wells located on the premises. E. Environmental Laws. Except to the extent disclosed herein, to the best of the knowledge of each party, no toxic or hazardous substances or wastes, pollutants or contaminants (including, without limitation, asbestos, urea formaldehyde, the group of organic compounds known as polychlorinated biphenyls, petroleum products including gasoline, fuel oil, crude oil and various constituents of such products, and any hazardous substance as defined in the Comprehensive Environmental Response, Compensation and Liability Act of 1980 ( "CERCLA "), 42 U.S.C. 59601 -0657, as amended) have been generated, treated, stored, released or disposed of or otherwise placed, deposited in or located on the property, nor has any activity been undertaken on the property that would cause or. contribute to; (i) the property to become a treatment, storage or disposal facility within the meaning of, or otherwise bring the property within the ambit of, the Resource Conservation and Recovery Act of 1976 ( "RCRA "), 42 U.S.C. S6901 et sea., or any similar state law or local ordinance, (ii) a release or threatened release of toxic or hazardous wastes or substances, pollutants or contaminants, from the property within the meaning of, or otherwise bring the property the ambit of, CERCLA, or any similar state law or _local ordinance, or (iii) the discharge of pollutants or effluents into any water source or system,•the dredging or filling of any waters or the discharge into the air of any emissions, that would require a permit under the Federal Water Pollution Contract Act, 33 U.S.C. S1251 et seq., or the Clean Air Act, 42 U.S.C. 4701 et seq., or any similar stat law or local ordinance. To the best of Seller's knowledge, there are no substances or conditions in or on the property that may support a claim or cause of action under RCRA, CERCLA or any other federal, state or local environmental statues, regulations, ordinances or other environmental regulatory requirements, including without limitation, the Minnesota Environmental Response and Liability Act, Minn. Stat. §115B ( "MERLA ") and the Minnesota Petroleum Tank Release Cleanup Act, Minn. Stat. §115C. 6. Survival of Terms. The representations and warranties contained in this Agreement shall survive the closing of the transaction contemplated herein and shall not be merged in the closing documents. 7. Condition of Property. The premises are sold as is with no warranties on the part of either party except warranties specifically set forth herein. The parties further acknowledge that the nature and scope of its investigation is solely within the discretion of each and that any matters that are not disclosed based upon the failure to make a complete and thorough investigation is a risk borne solely by that party. 8. MEETING DATE: June 26, 2000 TOPIC: Site & Building Plan Review PUBLIC HEARING: Conditional Use Permit Dairy Queen, 21st Ave. at Northern Lights Blvd. ACTION: 3/5 vote BACKGROUND The application includes a site plan and conditional use permit for a new Dairy Queen on 21St Ave. at Northern Lights Blvd. The site is zoned GB General Business. Restaurants with a drive - through facility require a conditional use permit in the GB district. This site is part of a preliminary plat that was approved by the City in December 1997. No final plat was approved. It is best to clean up this situation by requiring that a final plat be approved as a condition of approval for the Dairy Queen. To this end, this report addresses the site plan, CUP, and also discusses platting issues. The applicant for the Dairy Queen project is not the landowner who is responsible for the platting requirements. However, the plat issues must be resolved before additional development occurs. Staff did not bring this project to City Council immediately after the hearing at the Planning & Zoning Board. We were hoping the plat issues could be resolved sooner so that several conditions of approval could be eliminted. However, in order to comply with the deadline law, the City must act on the applications by July 11. The proposed elevations originally submitted showed predominantly corrugated metal panels with red glazed brick around the foundation. The City does not allow metal panels to comprise more than 50% of the entire building (all elevations). On elevations facing a street, metal panels may not exceed 20% of the wall surface. (Sec. 3 Subd. 4.B.1. of the zoning ordinance.) The applicant's architect submitted revised elevations on April 4. The new elevations show EFIS rather than metal panels. EFIS is a simulated stucco, which is acceptable. The building's tallest point will be 18 ft., though the proposed sign will be 19+ ft. (Sec. 3 Subd. 4.B.1. of the zoning ordinance.) The applicant's architect submitted revised elevations on April 4. The new elevations show EFIS rather than metal panels. EFIS is a simulated stucco, which is acceptable. The building's tallest point will be 18 ft., though the proposed sign will be 19+ ft. Sign permits are required for all signs. All signs will be reviewed with the sign permit applications. A preliminary look raises a concern regarding the number of signs. One building sign is allowed totaling 20% of the building face area. The building elevations show signs on three sides of the building in addition to the larger building sign with the Dairy Queen name and ice cream cone. Any pylon sign must be five feet from the lot lines and there is a size maximum. The revised landscaping plan shows plantings instead of a pylon sign. This must be clarified. • Landscaping The original landscaping plan included a very minimal amount of plantings. We received a revised landscaping plan April 4. Though there are numerous trees added, staff will work with the applicant to improve the plan. • Plat Issues This site is part of a preliminary plat that was approved by the City in December 1997. No final plat was approved. It is not clear how or why the Amoco convenience store was approved without a final plat. At any rate, is best to clean up this situation by requiring that a final plat be approved as a condition of approval for the Dairy Queen site plan and CUP. The draft proposed final plat is attached. On the submitted final plat, Block 2 includes two lots where the preliminary plat had only one larger lot. Staff does not view this as a problem at this time because the remainder of the site is to be platted as a large outlot. In the future, if the landowner wants to create more lots overall than were approved by the preliminary plat, we will require a new preliminary plat. However, since we do not know how many lots will ultimately be created, staff is comfortable with the number of lots on the submitted final plat. We are not technically reviewing a final plat application. However, because the final plat will be a condition of approval for the Dairy Queen, it is appropriate to discuss the preliminary plat conditions. Failure to meet the conditions of approval of the preliminary plat will delay approval of the final plat, which will delay the Dairy Queen project. Dairy Queen June 26, 2000 page 4 Conditions of Approval for Preliminary Plat, 1997: 1. Consideration is given to expanding the width of Lot 2 Block 1 in a manner such that it is consistent with other lot widths within the subdivision. This was not a strict requirement, rather a suggestion. Lot 2 meets the minimum lot width at the setback line. 2. The right -of -way width of Northern Lights Blvd is expanded from 60 feet to 80 feet in accordance with City Subdivision standards for commercial /industrial streets. This condition was eliminated by the City Council. Sixty feet was deemed acceptable based on the recommendation of the City Engineer at the time. 3. A wetland mitigation plan is submitted and approved by the City Engineer. The Rice Creek Watershed District has permitting authority over wetland impacts. A wetland plan was approved by the RCWD in 1997 and amended in 1998. However, RCWD has sent numerous letters to the landowner regarding lack of compliance with the permit conditions. An October letter to the landowner states: "Your permit on this site is a rough graded and wetland alteration plan only. You must obtain a final site grading permit before any additional impervious surfaces or buildings are installed." A February 2000 letter states that the RCWD will be drawing from the landowner's financial security to complete required activity because the landowner did not comply with the permit conditions. 4. Consideration is given to identifying full development of the property (future lot configuration) on the preliminary plat and establishing an outlot (or outlots) on the final plat to accommodate future development phases. This is exactly what is being proposed with the submitted final plat drawing. S. The preliminary plat and grading plan depictions of Outlot A are revised to be graphically consistent. This will be reviewed. 6. Soil borings are taken which demonstrate the buildability of the subject property. This will be reviewed for final plat approval. Dairy Queen June 26, 2000 page 5 7. The 100 year floodplain elevation, building pad elevations, and street elevations are identified. The floodplain map shows the floodplain covering the current Amoco site and a corner of the Dairy Queen site. We have not received floodplain elevations. See condition 10 below. 8. The Park Board provide recommendation in regard to park dedication requirements. Park dedication will occur per standard City policy. 9. The City Engineer provide comment and recommendation in regard to the following :: City maintenance responsibilities associated with 21st Ave. Grading and drainage. Easement establishment. Utilities. Floodplain containment. Hydric soil limitations. These will be addressed per standard review procedure. See attached memo from the City Engineer, dated April 6, 2000. 10. That there be a letter of map revision obtained by the applicant from FEMA relating to the floodplain. The floodplain map shows the floodplain covering the current Amoco site and a corner of the Dairy Queen site. We have not received a copy of a FEMA map revision for this site. We understand the applicant's engineer is preparing the map revision application. 11. Joint powers agreement regarding 21st Ave. This agreement is now in place. • Utilities Sanitary sewer and water service exist in the Northern Lights Blvd. alignment. However, an easement must be dedicated to the City in this alignment. The utilities themselves have not yet been dedicated to the City. This will be reviewed as part of the final plat approval. An easement for utilities in the future Northern Lights Blvd. location is shown on the draft final plat. Stormwater management must be properly addressed. The current ditch draining east to a pond near the freeway was a temporary measure. Complete stormwater facilities must be constructed to accommodate the Dairy Queen project. The City Engineer's memo addresses these issues further. Dairy Queen June 26, 2000 page 6 • Parking For fast food restaurants, our code requires at least 15 parking spaces per 1000 sf of gross floor area. For the purposes of calculating parking spaces, the ordinance requirement is to use 90% of the floor area. That is, 90% of approx. 1655 sf is 1490 sf, or 1.49 x 1000. Fifteen parking spaces x 1.49 = 22 spaces required. This site plan shows 22. • Roads, Access, Circulation There will be one driveway access to the Dairy Queen site on Northern Lights Blvd. Entering vehicles can either proceed into the parking area or turn right for the drive - through. Northern Lights Blvd., like the utilities, has not been dedicated to the City. This will be addressed as part of the final plat review. The City Council discussed the right of way width in 1997. While our current standard is 80 ft for a commercial road, the City Engineer in 1997 recommended 60 ft.. The Lino Lakes side of the 21st Ave. right of way will be dedicated as part of the final plat, as shown on the draft final plat. Work on completing this portion of 21st Ave. and Northern Lights Blvd. can begin with the completion of a developer's agreement, which typically is part of the platting process. The City Engineer's memo addresses these issues further. • Park Dedication The Park Board met April 3 and agreed to the cash dedication per City policy of $200 per 1000 sf. For the Dairy Queen with 1655 sf, the dedication would be $331. • Conditional Use Permit Findings As stated in Sec. 2 Subd. 2.B.7., the Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it can make findings that the proposed use at the proposed location: a. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. b. Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the City and this ordinance. c. Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. d. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems, and schools; or will be served adequately by such facilities and Dairy Queen June 26, 2000 page 7 services provided by the persons or agencies responsible for the establishment of the proposed use. e. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. f. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. g. Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic on surrounding public thoroughfares. h. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. i. Will conform to specific standards of this ordinance applicable to the particular use. In addition to those findings, Sec. 7 Subd. 3.H.5. states that accessory drive - through facilities are allowed as a conditional use in the GB zone provided that the following findings can be made: a. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or area so as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. b. At the boundaries of a residential use or district, a strip of not less than ten (10) feet shall be landscaped and screened in compliance with Section 3, Subd. 4.S. of this Ordinance. c. Parking areas shall be screened from view of abutting residential districts in compliance with Section 3, Subd. 4.S. of this Ordinance. d. Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movements, shall comply with Section 3, Subd. 5. of this Ordinance and shall be subject to the approval of the City Engineer. e. The entire area shall have a drainage system which is subject to the approval of the City Engineer. f. All signing and information or visual communication devices shall be in compliance with Appendix C of the City Code. g. Provisions shall be made to control and reduce noise from any exterior audio equipment. With the recommended conditions of approval, the project will comply with these required findings. Dairy Queen June 26, 2000 page 8 ENVIRONMENTAL BOARD ACTION On March 29 the Environmental Board recommended approval of the Dairy Queen site plan subject to continued work on the landscape plan and lighting plan. The Environmental Board minutes are attached to this report. PLANNING & ZONING BOARD ACTION The P & Z considered the project on April 12, 2000. The Board recommended approval of the applications with the conditions listed below. Those minutes are attached. CONDITIONS OF APPROVAL: SITE PLAN AND CONDITIONAL USE PERMIT If the P & Z recommends approval of this project, staff recommends the following conditions apply: 1. The final plat must obtain approval from the City before a building permit is issued for the Dairy Queen. The conditions of approval for the preliminary plat must be met before final plat approval. 2. Building material shall be as shown on revised exterior elevations received April 4, 2000, showing EIFS as the primary material, rather than corrugated metal. The fence around the cooler and the trash enclosure shall be painted cedar wood, not corrugated metal. These materials shall be reflected on building permit submittals. 3. A lighting plan for the Dairy Queen site must be submitted and must meet City lighting requirements before a building permit is issued. Lighting information shall include a photometric plan as well as figures of any lot and exterior building fixtures. Lighting shall be directed downward and not up into the night sky. 4. Approval of the site plan and conditional use permit is not an implied approval of signage. All signs require a sign permit and must comply with the sign ordinance. 5. Proper building permits must be obtained prior to any construction and 1% of the construction costs must be put in escrow to insure completion of all site improvements. Prior to issuance of building permits, building plans must be reviewed by the City CSO for compliance with CPTED recommendations. 6. All permits required by the Rice Creek Watershed District shall be obtained prior to additional grading on the Dairy Queen site. Our comments are as follows: 1. The final plat for Clearwater Creek Business Center will be considered and discussed in a separate action from the Dairy Queen. Issues related to the plat are not presented. 2. This project is located on the southeast corner of existing 21St Avenue and Northern Lights Boulevard; neither of these roads has been constructed to their final sections. Construction of these roadways must be concurrent with the completion of these site improvements. 3. The runoff from this site currently drains via a ditch to the east, then south, eventually reaching a temporary pond north of Clearwater Creek. The intersection of 21st Avenue and Northern Lights Boulevard will drain directly south via storm sewer to a regional pond located on the north side of Clearwater Creek. This regional pond can be sized to accommodate the Dairy Queen water quality needs. Rate control should be provided on site through a flow restriction in the storm sewer. 4. The drainage calculations do not show pre - development conditions. 5. The site is just south of the 1 'ENVIRONMENTAL BOARD MEETING MARCH 29, 2000 Tschida Convenience Store and the applicant is Don Rolf of Archnet, Inc. The proposed lot area is 29,223 square feet and the required "green area" is 30% or 8,767 square feet. The proposal indicates 37% green area or 10,945 square feet. Surface water for the Dairy Queen will be diverted via storm sewer pipe to a proposed ponding area adjacent to Rice Creek. There are no zone - one /zone two areas on the site. There are no significant ecological delineations on the site. Soils are classified as BD (moderate infiltration rate [drained] / high runoff potential [undrained]) and B (moderate infiltration rate). The LW soil classification to the south is a loamy soil type. Site elevations gradually slope to Clearwater Creek. Davidson asked if the revised landscape plan has been submitted. Asleson stated it has not and that could be placed as a condition of approval, if desired. MEETING DATE: June 26, 2000 TOPIC: FIRST READING: Ordinance 10 -00 PCS Tower Moratorium ACTION: 4/5 vote BACKGROUND On May 22 the City Council adopted Resolution #00 -67 directing staff to initiate the process for adopting a moratorium on new towers for personal wireless services, such as wireless telephone services. The resolution also set a public hearing at the June 14 P & Z meeting. A moratorium on new tower applications will be treated as an amendment to the zoning ordinance, which requires a 4/5 vote. The attached Ordinance No. 10 -00 establishes the moratorium. MN Statute 462.355 Subd. 4 authorizes a municipality to adopt an interim ordinance (moratorium) for the purpose of protecting a planning process when conducting a study. Staff has begun a towers location study. This study will inventory existing facilities in the area with the goal of determining where new facilities likely will be needed. To the extent we can do this, we can plan for those locations and minimize the number of towers. The intent is to include tower location planning in the larger land use planning of the City to ensure: one, consistency with the policies and provisions of the Comprehensive Plan; two, compatibility with present and future land uses; and three, that official controls and performance standards are adequate. We are also asking surrounding communities to join in the study. With their cooperation, we hope to minimize the number of new towers in all our communities and still provide for full PCS service in compliance with federal law. We also will ask for the cooperation of the providers of wireless services, such as the firms that lease space on our water towers. We hope the study will be beneficial to all involved, including the participating cities and the wireless service providers. Our City Attorney advises us that once the City Council initiated the process by directing staff to prepare a moratorium ordinance, we can forestall approvals of applications for new towers until the study is completed. RECOMMENDATION Option 1 Council Member introduced the following ordinance and moved its adoption. CITY OF LINO LAKES ORDINANCE NO. 10 -00 AN ORDINANCE ESTABLISHING A MORATORIUM ON THE PERMITTING AND CONSTRUCTION OF NEW TOWER STRUCTURES FOR THE PROVISION OF PERSONAL WIRELESS SERVICES The City Council of the City of Lino Lakes, Anoka County, Minnesota does hereby ordain: Section 1. Findings The City Council finds that current demand for personal wireless services in the metropolitan area is creating the need for new antenna locations. The antennae may be located on buildings, water towers, and other tall structures, including towers constructed specifically for the antennae. The City Council finds further that a study is warranted to examine the demand for new towers and the potential tower sites for provision of personal wireless services. The purpose of the study is to create a plan of how best to provide for the provision of personal wireless services while minimizing the number of tower structures and protecting the public health, safety, and welfare. The City Council finds, therefore, that a moratorium is required in order to protect the planning process and to prevent the construction of new towers pending the completion of the study and the consideration and, if necessary, implementation of new regulations. Section 2. Moratorium Established In accordance with the findings set forth in this ordinance and pursuant to the authority of Minnesota Statutes 462.355 Subd. 4, there is hereby established a moratorium on the permitting and construction of new personal wireless services towers within the City. During the period of the moratorium, applications for new towers shall not be accepted by the City nor shall any building permits for such work be issued. For the purposes of the moratorium, the term "tower" shall mean "any ground mounted pole, spire, structure, or combination thereof, including supporting lines, cables, wires, braces, masts, intended primarily for the purpose of mounting an antenna or similar apparatus above grade." Section 3. Applicability The moratorium shall be applicable to property throughout the City. The moratorium applies only to new tower structures for personal wireless services. Section 4. Exceptions The moratorium shall not apply to (1) personal wireless service antennae mounted on existing structures; (2) the repair and/or maintenance of any existing tower provided that such work does not enlarge or expand that tower; (3) work on a tower necessary to preserve health, safety, life, or property in the face of an emergency, or (4) amateur radio towers. Section 5. Effective Date This ordinance shall be in force and effect upon its adoption and publication according to the Lino Lakes City Charter. This ordinance shall be effective for 90 days after its effective date and shall expire at that time unless further extended. Passed by the Lino Lakes City Council this day of , 2000 John J. AGENDA ITEM 6H STAFF ORIGINATOR: John Powell, City Engineer COUNCIL MEETING DATE: June 26, 2000 TOPIC: Resolution No. 00 -68, Construction Contract, Apollo Drive Phase 4 Improvements VOTE REQUIRED: Simple Majority BACKGROUND: Bids for the referenced project were opened on May 19, 2000; and were received by the City Council at the May 22, 2000, meeting. The City has 60 days after the bid opening to award the contract otherwise the contractors may withdraw their bids without penalty. 60 days from the bid opening date ends on July 18, 2000. The latest regular City Council meeting for award of the contract will be July 10, 2000. The City has neither possession of the right -of -way or a right -of -entry agreement at this time. Without control of the property, the City cannot authorize a contractor to proceed with construction. The City Attorney will be present at a closed City Council meeting, prior to the Work Session, to discuss this project.
