II.APPROVAL OF AGENDA The agenda was approved. III.APPROVAL OF MINUTES – October 9, 2002 Ms. Lane made a MOTION to approve the minutes of the October 9, 2002, meeting of the Lino Lakes Planning and Zoning Board, and was supported by Mr. Rafferty. Motion carried 5-0. IV.OPEN MIKE Chair Schaps declared open mike open at 6:32 p.m. There was no one present for open mike. Mr. Corson made a MOTION to close Open Mike at 6:33 p.m., and was supported by Mr. Rafferty. Motion carried 5-0. V.ACTION ITEMS A.PUBLIC HEARING - Ray Benkler, Car Wash, XXX Lake Drive, Conditional Use Permit and Site Plan Review DATE: November 13, 2002 TIME STARTED: 6:30 P.M. TIME ENDED: 7:36 P.M. STAFF PRESENT: Jeff Smyser; Ta nda Gretz; James Studenski; Bob Kirmis (NAC) Planning & Zoning Board November 13, 2002 Page 2 APPROVED MINUTES Staff explained Mr. Benkler had requested approval of site and building plans and a conditional use permit to allow the constructi on of a full service carwash, a self-service carwash and a quick lube facil ity (within a single structur e) upon a 1.6 acre site located west of Lake Drive and between I-35W and Elm Street. Staff stated while the applicab le LI, Light Industrial district provisions do not specifically list carwashes as a permitted or conditional uses , the district does stat e that uses permitted in commercial zoning districts sh all be allowed within LI dist ricts. As a result, the use will be treated as a conditional use and processed accordingly. Staff presented its analysis by explaining th e subject property is described as part of Auditor’s Subdivision # 54 and comprises two individual lots. As part of the CUP processing, the two lots which comprise the su bject property should be legally combined. Staff noted access to the subject site is to be provided via a 30-foot wide curb cut along Lake Drive. Appropriately, the access point is in direct alignment with Church Drive to the east. Staff stated the acceptability of the proposed cu rb cut location and width as well as the need for associated roadway improvements (i.e . turn lanes) should however, be subject to comment and recommendation by the City Engineer and the Anoka County Highway Department. Staff indicated the proposed use includes a full service carwash, a self-service carwash and a quick lube facility. Recognizing the co -existence of these activities, a well- conceived plan for site circulation is both very important and very challenging. Staff noted as shown on the submitted site plan, site circulation is proposed to occur in a counter-clockwise fashion. While the proposed circulation pattern is considered well conceived and follows a natural tendency to “keep right”, some concern exists in regard to a users understanding of th e circulation pattern and a pot ential for congestion at the sites entry point. Staff stated to address this c oncern, the applicants are proposi ng to separate site entry and exit areas with a landscaped median and iden tify desired site circulation routes with freestanding directional signage . To further identify desired traffic movements, it is suggested that pavement directi onal signage also be provided. Staff noted two circulation-related concerns exist in regard to th e by-pass lane on the west side of the property. One concern rela tes to the necessary u-turn maneuvers that will occur west of the building where full service carwash vehicles move from the staging area to the conveyor area. It appears con ceivable that such maneuvers could interfere with access to both the self-service carwash and quick lube facility. Staff indicated a second concern with the by-p ass lane relates to the areas west of the self-service wash and quick lube facility where a potential over lapping of vehicular stacking could potentially occur. The applicant has indicated that the self-serve wash is Planning & Zoning Board November 13, 2002 Page 3 APPROVED MINUTES to accommodate recreational vehicles. It appears likely that a recreational vehicle waiting to occupy the southerl y self-service stall may bloc k access to the quick lube stacking area. Staff noted while the applicant is encouraged to address the aforementioned concerns, it is acknowledged that such circulation issues ar e internal to the site and constitute more of an inconvenience to site patrons than a threat to public safety. Staff stated according to the Ordinance, the architectural appearance of the building may not be so dissimilar to the existing buildings or areas as to cause impairment in property values or constitute a blighting influence. Staff stated the building is to be finished in a combination of colored rock face block, face brick and stucco. Such materials are cons istent with the building material requirements of the Ordinance. While the el evation indicates that the building is to be finished in two varied colors of rock face block, specific building colors have not been indicated. As a condition of site and build ing plan approval, building colors should be specified. Staff noted although the proposed building mate rials satisfy the re quirements of the Ordinance, some concern exists in regard to the presentation of the building to Lake Drive. As proposed, the eastern façade of th e building will consist of ten garage doors. To draw attention away from the garage doors, the applicant has proposed landscaped medians in the front of the building. Asid e from “softening” the appearance of the building to Lake Drive passer sby, the landscape medians also serve to channel traffic throughout the site. Staff stated the Ordinance does not indicate whether or not stacking spaces may be counted toward fulfilling this requirement. While the need for drying and employee stalls is obvious, it is believed that excluding st acking space from the off-street parking requirement for the carwash would result in an excessive off-st reet parking supply. Therefore, stacking spaces are considered acceptable off-street parking spaces. Staff noted including exterior stacking spaces , a total of 56 spaces are provided on site, exceeding that required by Ordinance. Staff stated the site plan illust rates one handicap parking stall. To satisfy applicable State requirements, one additional ha ndicap stall should be provided. Staff noted at 18 feet in depth and 9 feet in width, all off-street parking stalls have been found to meet the minimum dimensional re quirements of Section 3, Subd. 5 of the Ordinance. Staff stated in regard to vehicular stacking space, the Ordinance states that stacking space associated with carwashes should accommoda te the number of vehicles that can be washed during a maximum thirty-minute period and shall be subject to comment by the City Engineer. Planning & Zoning Board November 13, 2002 Page 4 APPROVED MINUTES Staff noted according to the applicant, it is anticipated that the fu ll service carwash can accommodate 30 vehicles in a half hour period. As shown on the submitted site plan, four stacking lanes have been provided for the full serve carwash accommodating a total of 30 vehicles. Staff stated as shown on the landscape pla n, a variety of trees are proposed on site. Specifically, mixtures of Swamp White Oak, Austrian Pine and River Birch trees have been proposed along Lake Drive. Additi onally, shrub plantings have been proposed within the two medians (with in the interior of the si te) and clump grass has been proposed at the northwest corner of the building. Staff noted two concerns exist in regard to the landscape plan. As noted in the attached Environmental Board comments, concern exis ts in regard to the number of plantings provided on site. The Board has specifica lly recommended that additional trees be provided. Staff stated a second concern is the placemen t of trees within the “rainwater garden” in the southeastern area of the property and their ability to survive. As a condition of site and building plan approval, th e tree plantings proposed with in the “rainwater garden” should be relocated. Staff noted the tree preservation plan has b een superimposed on the landscape plan. The plan however, does not specify the types and si zes of trees to be saved and removed. As a condition of site and building plan appr oval, the tree preserva tion plan should be modified to indicate all significant trees on site and those to be saved. Staff indicated as a condition of site and bu ilding plan approval, al l off-street parking areas and associated drive lanes should be provided a continuous concrete curb. This includes the planting medians on the east side of the building where such curbing will both define the drive lanes and serve to pr otect the vegetation within such medians. Staff noted aside from the striping of off-st reet parking stalls (a standard ordinance requirement), it is recommended that the one -way bypass lane around the perimeter of the building be striped and thereby segr egated from adjacent stacking lanes. Staff stated according to Section 3, Subd. 4.G of the Ordinance, all refuse and recyclable materials must be stored within the principa l building or within an accessory structure (within a side or rear yard) th at is totally screened from eye level view from neighboring uses and public rights of way. Staff noted the submitted site plan does not illust rate a trash enclosure. If trash is to be stored outdoors, the location of the enclosure should be il lustrated on the site plan. Staff stated within LI districts, a minimu m green area of 10 percent of the lot area is required. The amount of impervious surface cove rage on the site has not been specified. As a condition of site and building plan approval, the applican t should demonstrate compliance with the minimum green area requirement. Planning & Zoning Board November 13, 2002 Page 5 APPROVED MINUTES Staff stated the site plan il lustrates a freestanding sign in the northeast corner of the site within the “rainwater garden”. The accep tability of the sign placement (within the “rainwater garden”) should be subjec t to comment by the City Engineer. Staff noted details regarding site signage have yet to be submitted. As a condition of site and building plan approval, all site signage mu st comply with the applicable requirements of the Sign Code. Staff indicated the applicant is proposing freestanding directional signage to identify desired traffic movements on the site. In addition to such freestanding signage, it is recommended that pavement directional signag e also be provided to ensure proper site circulation. Staff stated as required by ordi nance, a lighting plan identify ing illumination levels on the subject site has been provid ed. The proposed illumination levels and fixture details have been found to be acceptable. Staff noted according to the plan, freestandi ng shoebox style fixtures have been proposed within parking areas while wall mounted fixt ures have been proposed on the north, south and east sides of the building. Staff indicated according to the Ordinance, the source of lights should be hooded and controlled so as not to illuminate adjacen t properties or public rights-of-way. More specifically, low-impact, downward-focused, lo w spill, low intensity fixtures should be used. Staff stated while the shoebox st yle fixtures meet this requi rement, the source of the light from the wall-mounted fixtures will be visible from adjacent properties. As a condition of site and building plan approval, the wall-m ounted fixtures should be changed such that the source of the light will not be visible from adjacent properties. Staff noted a utility plan has been submitted for review by the City Engineer. As a condition of site and building plan approva l, the utility related modifications and comments as set forth in the C ity Engineer’s memo should to be incorporated into the plans. Staff stated a grading and drainage plan has been submitted for review by the City Engineer. Staff indicated one noteworthy concern rela ted to drainage involves the handling of wastewater from the self-serve carwash. Of particular concern is the potential “dragging” of water toward the site’s eg ress point (on Lake Drive) in the winter months and the potential for the creation of an ice slick. As a condition of site and building plan approval, the issue should be addressed to the satisfaction of the City Engineer. Staff stated as a condition of site and build ing plan approval, th e grading and drainage related modifications and comments as set forth in the TKDA letter dated 11/5/02 should to be incorporated into the plans. Planning & Zoning Board November 13, 2002 Page 6 APPROVED MINUTES Staff noted the primary issues of the CEP TED review regard traffic flow through the development. The development has been redesigned to address these issues. Staff indicated the Environmental Board re viewed the request at their October 30, 2002 meeting and recommended approval. Their co mments are attached to this report. Staff noted is that the Board’s recommenda tions related to lighting and landscaping has been included as conditions of site a nd building plan/conditional use permit approval. Staff stated the Rice Creek Watershed District (RCWD) has determined that the proposed development will not require a Watershed District Permit as the impervious surface coverage on the property does not exceed one acre. Staff noted prior to the commencement of any site work, the applicant will be required to enter into a development agreement with th e City and post all the necessary securities required by it. Staff stated as previously indicated, the appl icant is requesting appr oval of a conditional use permit to allow a carwash within an I-1, Light Industrial zoning District (both drive- through and self-service carwashes ar e listed as conditional uses). Staff stated in considering conditional use pe rmit requests, the Ordinance states that the Planning and Zoning Board shall recommend approval and the City Council shall order the issuance of such permit only if it fi nds that such use at such location: 1.Will not be detrimental to or endanger the pu blic health, safety, comfort, convenience or general welfare of the neighborhood or the City. Comment: The proposed use is not anticipated to be detrimental or endanger the public. 2.Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the City and this ordinance. Comment: The Comprehensive Plan suggests industrial use of the site. Within the applicable LI, Light Industrial zoning district , carwashes are considered a conditional use. Thus, the proposed land use satisfies th e land use directives of the Plan. 3.Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing an d/or intended character of the general vicinity and will not change the essential character of that area. Comment: The building design is consistent w ith material requirements of the Ordinance and therefore will not negativel y affect the essential charac ter of the area. The proposed building is in fact anticipated to improve the appearance of the area. 4.Will be served adequately by essential public facilities and services, including street, police and fire protection, drainage stru ctures, refuse disposal, water and sewer Planning & Zoning Board November 13, 2002 Page 7 APPROVED MINUTES systems, and schools; or will be served adequately by such facilities and services provided by the persons or agencies res ponsible for the estab lishment of the proposed use. Comment: As a condition of pr oject approval, the building wi ll be adequately served by essential public facilities and services. 5.Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. Comment: This development is not expected to increase public costs, nor be detrimental to the economic welfare of the community . 6.Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. Comment: The proposed use of the property is not expected to create any excessive externalities that would be abnorm al to the character of the area. 7.Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic on surrounding public thoroughfares. Comment: The site layout meets standards held within the City’s Zoning Ordinance including turn lanes, access width, and access spacing/location. 8.Will not result in the destruc tion, loss, or damage of a natural, scenic or historic feature of major importance. Comment: The applicant is currently working with the City Engineer to satisfy drainage related issues. 9.Will conform to specific standards of this ordinance applicable to the particular use. Comment: The proposed use will as a c ondition of approval meet the applicable requirements of the Ordinance. Staff stated based on the fi ndings contained in this re port, our office recommends approval of the Site and Building Plan and Conditional Use Permit to allow the construction of a full service carwash, a self-servi ce carwash and a quick lube facility (within a single structure) upon a 1.6 acre site located west of Lake Drive between I-35W and Elm Street subject to the following conditions: 1. The two lots, which comprise the su bject property, be legally combined. 2. The acceptability of the proposed curb cut lo cation and width as well as the need for associated roadway improvements (i.e. tu rn lanes) be subject to comment and recommendation by the City Engineer a nd the Anoka County Highway Department. Revised plans depicting such change shall be provided prior to City Council consideration of the application. 15.The conditions of the TKDA letter (dated 11 /5 /02) related to grading, drainage and utilities are satisfied. The easement issues must be resolved prior to City Council approval of the application. The agreement shall also contain an operation and maintenance agreement. 17.Applicant must address concerns about the dragging of water ther eby turning it to ice at the exit point. Mr. Corson asked if Rice Creek Watershed no t needing a permit was a new requirement. Mr. Kirmis replied this site did not meet the minimum requirements. Mr. Rafferty expressed concern about the co lor scheme of the building and asked what the color scheme was going to be. Chair Schaps invited appl icant to make comment. Gary Raffel, architect, stated the colors of the building would be earth, neutral colors, similar to the coloring of the City Hall bu ilding. He noted there would be no painting requires. Any stucco used would be colored stucco. He stated th ey would get a color scheme to staff as soon as possible. Mr. Rafferty suggested before anything was approved, those colors were represented to the Council at their meeting. Mr. Raffel stated concern for the water co ming off the self-service car wash would be taken care of. He proposed a heated apron a nd a drain so as soon as the vehicle got out of the self-service area, the heat er slab would present it fr om freezing and it would go directly into the drain. He noted the typical heating pad was 10 feet. Mr. Rafferty stated self-service generally sp eaking did not involve dryers. Mr. Raffel replied there were no dryers w ith the self-service facility. Chair Schaps inquired a bout the landscape plan. Chair Schaps asked if there was an example of this building in the City. Mr. Raffel replied there was a similar service in Stillwater. Chair Schaps stated staff was concerned a bout circulation and as ked if there was a specific set up in the area that wa s the same type of facility. Mr. Raffel replied he did not know of a fac ility near here that had the exact same proposal. He noted they had the best circulation possible for this site. Chair Schaps asked how many cars could be in line before they reached the street. Mr. Raffel replied 30 cars could be waiting. Mr. Smyser stated this was a public heari ng and requested the Chair open the hearing at this time. Planning & Zoning Board November 13, 2002 Page 10 APPROVED MINUTES Derek Lash, engineer, replied with respect to landscaping, he antici pated applicant would add more landscaping. He noted the wate r garden (holding pond) would not be an eyesore. He stated there was no reason th e trees could not be removed. He stated applicant agreed with the staff’s recommenda tions. He asked about the removal of the evergreen trees and replacing them with deciduous trees. He noted salt from the road was harder on deciduous trees than evergreens and that was why they had evergreens. Mr. Hyden asked where the trash enclosur e was located and how was that being addressed. Mr. Raffel replied the trash encl osure would be the sa me material as the building, made out of concrete block. He noted there were two sites that could accommodate a trash enclosure, but it would be located behind the building. Chair Schaps asked what type of trash were they likely to have. Mr. Raffel replied cardboard would be one item. Terry Landeen, Specialty Equipment Co., st ated the trash enclosure was located alongside the automatic bay, in side the building. The tras h enclosure would have double doors on it and would be wheeled out to be emptied. Mr. Hyden asked were did all of the water go. Mr. Landeen replied it went inside the carwash base (pits) and from there it went into a waste trap, which catches any excess oil before it went to the City sewer. He stated the pit and trap was cleaned at least once a year. He stated there would be small draina ge areas also, which c ould just evaporate or drain into the carwash pits. He stated they could heat 15-20 feet at the exit and the if they wanted, but the standard was 10 feet. He no ted the full service car wash would have full heat at the exit ends. Chair Schaps opened the Public Hearing at 7:04 p.m. Ray Benkler, owner, stated the purpose of th e self-service was to have high ceilings that would accommodate a larger vehicle, but they would not be marketing to the RV vehicles, it would be an all purpose use. He noted a semi-cab would not be a problem. With respect to circulation, there would be no problems because they would take the cars off themselves onto the conveyor lane. Mr. Corson asked if he has had any problem s at the Stillwater facility regarding circulation. Mr. Benkler replied he did not be lieve so. He stated he had spoken with the owner of the Stillwater facility and this was no an issue there. Rene Quimby, 7319 Lake Drive, asked what th e hours of operation were of the car wash and the types of vehicles using the car wash. Mr. Benkler stated the hours of operation would be 7:00 a.m. to 9:00 p.m. He stated they had the room for semi-cabs and motor homes in the facility, but he did not believe they would have a lot of traffic from these larger vehicles. He noted the use would be all purpose. Planning & Zoning Board November 13, 2002 Page 11 APPROVED MINUTES Ms. Quimby explained her previous comments by stating she wanted to know if semi- trucks would be going through the oil change facility because her CUP restricted them from working on semi-trucks. Mr. Smyser replied the Quick Lube would not accommodate a semi-truck, only the car wash portion. Ms. Lane made a MOTION to close the public hearing at 7:11 p.m. The motion was supported by Mr. Corson. Motion carried 5-0. Mr. Rafferty made a MOTION to table this i ssue until later in tonight’s meeting when they have the further information they need. The motion was supported by Mr. Hyden. Motion carried 5-0. B.Gordon Johnson, UDOR, 500 Apollo Drive, Site Plan Review Staff stated Mr. Johnson of UDO R company is applying for a s ite plan review in order to construct a second expansion ont o their current facility at 500 Apollo Drive. UDOR first constructed their 6,000 sq.ft. building in 1994. In 1999 a 2,400 sq. ft. addition was constructed. The applicant is now aski ng for approval for a second addition of 3,600 square feet, to be used for cold storage/warehousing and testing. Staff presented its analysis by explaining UDOR is located at 500 Apollo Drive, with the rear of the property abutting the 35W inters tate highway. The proposed addition site is immediately adjacent (south) of the 1999 addition. There is a ponding area to the southwest of the proposed addition site. A ccess to the addition is to be completely internal; there are no docking bays, parking, or sidewalks proposed to access the addition. Staff stated the applicant has submitted no full-view elevation plans. The proposed addition is to be constructed of rock faced block to match the existing building in terms of construction material and height. Staff noted since the addition site is at the rear of the lot, with a ponding area to the south of the site and only approximately 15 feet on the north side of the site, access for construction purposes will be via the propert y to the north, with wh ich the applicant has acquired an access agreement. Staff indicated this site is se rved by both City water and se wer. The existing building is, and the proposed addition will be, sprinkled and meet fire code. Planning & Zoning Board November 13, 2002 Page 12 APPROVED MINUTES Staff stated UDOR is a warehouse-type facility with approximately 2,000 sq.ft. of office space. However, parking requirements fo r the initial building approved in 1994 were based solely on warehouse use and square f ootage (1 stall for each 2,000 sq.ft.). The parking calculations made at that time were for 6,000 sq.ft. of warehouse and 6,000 sq.ft. of future warehouse expansion, for a total of 12,000 sq.ft. of warehouse. Thus, 6 parking stalls were required, with 7 stalls actually constructed. As a result, parking for the proposed 3,600 sq.ft. addition has already been provided for. The applicant reports that there are actually eight stalls at the site a nd that parking is not a problem. The applicant further reports that there are seven empl oyees at the company, with no additional employees proposed. Staff indicated access to the site is via a sh ared access driveway off Apollo Drive, which is a County road. As a result, plans have been forwarded to Anoka County for review. Staff noted there is no additional light ing proposed for the addition or site. Staff stated City Code allows impervious site coverage up to 90%, and the proposed addition is within this requirement. Staff indicated approval of the initial building in 1994 came with the following requirement: “Following completion of the proposed expansion, plantings will be located to the rear of the property line to provide an appealing view from I-35W.” Staff stated since this second expansion appear s to use the space limits of the site, with no room for further expansion in the future, it is now appropriate to require the landscaping be done. As a result, the applicant has pr oposed planting 11 trees of various varieties (oak, maple, spruce) in the buffer ar ea between the proposed addition and 35W. Staff noted additionally, there is a ponding ar ea on the site, to the southwest of the proposed addition. This should be protected with silt fencing during construction Staff stated the City Engineer Jim Studenski has reviewed the submitted plans and reports that they generally meet City requirements . The following two outstanding issues need to be resolved, after which final approval can be given: 1. Drainage calculations must be submitted. 2. Documentation allowing access to the construc tion site from the adjacent site must be submitted. In conclusion, staff noted as the proposed addi tion appears to meet all requirements, staff would recommend approval, with the following conditions: 1. Drainage calculations must be s ubmitted prior to City Council review. 2. Documentation allowing access to the construc tion site from the adjacent site must be submitted. No additional lighting is to be added without review. 5. Chair Schaps invited appl icant to make comment. Gordon Johnson, stated they would lose one oa k tree that was “Y” shaped, but he planned on planting four to five maples in its place. He noted he would not be able to save that tree. The maples would go in the rear of the addition and one the side towards the Fogerty building. Mr. Smyser stated they would look at the site to see what tree he was referring to and would make a recommendation to the City Council. Chair Schaps asked if Mr. Johnson agreed with all of the cond itions recommended by staff. Mr. Johnson replied he did. Mr. Johnson noted they would also landscape any of Mr. Fogerty’s property that went down to the curb. Ms. Lane asked if it would be appropriate to change condition six to read to preserve as many trees to the east of th e building as possible. Mr. Johnson stated the tree in question was on his property. This item was discussed earlie r in the meeting.) Mr. Raffel presented samples of the colors and materials they were proposing to use on this project. He noted the roof was a flat , asphalt, and gravel roof. Chair Schaps noted the color schemes were browns, tans, reds (earth tones). Mr. Rafferty recommended they have the color schemes and materials mounted on a board and submitted to staff for presentation at the City Council mee ting. Mr. Raffel noted he would color off the elevations and would have the materials r eady for the City Council meeting. Mr. Corson asked if the facades could be hi ding the air conditioning units. Mr. Raffel replied they would be. Mr. Hyden inquired about signage. Mr. Raffel replied there was a lit sign by the road on the northeast corner of the property. Ther e would also be a sign on the building facing Lake Drive. He noted they would submit the signs drawings and elevations at the time of the building permit.
