The City staff has prepared cost and revenue projections for the next three years and is prepared to recommend utility rates for 2001 through 2003. Sanitary Sewer The City's sewer rates are based on a quarterly charge per REU. An REU is a residential equivalent unit that represents the daily volume required by a typical residential connection. One house equals one REU. Commercial, industrial, and institutional use is converted to REU's based on the volume of flow they generate. The major expenses related to sewer charges include the cost of operating the system, Metropolitan Council charges, and depreciation. Depreciation relates to the cost of replacing the system after it has reached the end of its useful life. The rate computation has assumed a 220 unit increase in the number of connections on an annual basis. This includes connection by existing houses as well as new construction. However, if this increase does not occur our costs should also be proportionally lower. Our current sewer rate is $51.00 per quarter per REU with no usage charge. The proposed sewer rate increase is as follows: Effective March 26, 2001: $50.00 per quarter per REU + $1.00 per 1,000 gallons over 10,000 gallons (based on winter usage) Effective January 1, 2002, $51.00 per quarter per REU + $1.00 per 1,000 gallons over 10,000 gallons (based on winter usage) Effective January 1, 2003, $52.00 per quarter per REU + $1.00 per 1,000 gallons over 10,000 gallons (based on winter usage) Water The City's water rates are based on a quarterly charge per REU and a charge on water usage. The usage charge is based on 1,000 gallon units. The major expenses related to water charges include the cost of operating the system, bond expenses, and depreciation. The bond expenses would be offset by a transfer from the Area and Unit fund. The water rate computation also assumes a 220 unit increase in the number of connections on an annual basis. In order to satisfy the Department of Natural Resources concerns regarding water appropriation (pumping) the proposed rate structure increases the rate per gallon for heavier water use. This also keeps the base rate for the lower water users very close to the existing level. Our current water rate is $10.00 per quarter per REU and $1.63 per 1,000 gallons. MEETING DATE: March 26, 2001 TOPIC: Resolution 01 -46: Variance From Collector Street Setback Rick Boschee, 1205 Peregrine Circle Lot 8 Block 1 Peregrine Pass BACKGROUND Mr. Rick Boschee of Boschee Homes, Inc., has applied for a variance from a setback requirement for a lot in Peregrine Pass. Mr. Boschee is a builder who prepared a plan for a house on Lot 8. The plan does not fit within the setbacks, which is the reason for the variance application. This report is based on the certificate of survey by Metro Land Surveying & Engineering dated February 13, 2001. ANALYSIS Peregrine Pass is an unusual development in that the developer worked very closely with staff to incorporate many environmentally friendly design elements. These resulted in some unique aspects to the development. In many ways, the project is an experiment utilizing several conservation subdivision elements. The site is zoned PDO Planned Development Overlay, and the unique design elements are part of the approved plat. Standards in the zoning ordinance apply if not specifically altered by the approved plat. For example, the conditions of approval for the plat state that the minimum house footprint size is that of the R -1X zone. However, no mention is made of altering building setbacks, so the setbacks in the ordinance apply. Setbacks are identical in both the R -1 and R -1X zones. In this case, there is a park trail strip along the side of Lot 8, on 12th Ave. The trail strip is owned by the City, so the property line is the edge of the trail corridor. The side yard setback is measured from that. This poses no conflict with the proposed house plan. The standard 40 ft. building setback from a collector street also applies because 12th Avenue is a collector street. The setback from the road, which applies to all buildings, is measured from the edge of the right of way. The trail strip is 15 ft., and the proposed garage is shown 13.5 ft. from that, for a total setback from the road of 28.5 ft. This encroaches into the required setback by 11.5 ft. (40 — 28.5 = 11.5). Lot 8 does include some unusual elements. The lot is rather narrow at its front line. As noted, the trail corridor exists along 12th Ave., which reduces the lot width from what it would be without the trail. There is a drainage and utility easement covering a large portion in the northeast corner of the lot. In addition, there is an extra 30 feet covered by a wetland conservation buffer easement which further reduces the buildable area of the lot. Moving the house toward the back of the lot would leave very little backyard. Mr. Boschee's letter states that the problem arises due to a larger setback on a corner lot. It would be more accurate to state that the street setback is greater than the side yard setback, which results in a de facto larger setback on a corner lot, though it is not listed as a "corner -lot setback." During the review of the plat in 1999, City staff and the developer discussed the building pads for the lots. The building pad location on Lot 8 of the approved preliminary plat and associated grading plan meets the 40 ft. road setback. Nothing has changed between the time of plat approval and the house design. No additional requirements have been added, nor are there any hidden requirements. All easements are recorded with the property and show up on a survey. The house pad location is a standard element of plat approvals. The setback requirements have not changed in the past two years. Findings for Variance In considering all requests for variance and in taking subsequent action, the City shall make a finding of fact: 1. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. 2. That the plight of the landowners is due to physical circumstances unique to his property not created by the land owner. 3. That the hardship is not due to economic considerations alone and when a reasonable use for the property exists under the terms of the ordinance. e • • Boschee Variance page 3 4. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. 5. That the proposed actions will be in keeping with the spirit and intent of the ordinance. Though the builder should have known the requirements of the site and designed the house to fit within them, Lot 8 is a relatively difficult lot. • Its shape and the double street setbacks combined with the wetland and extra buffer easements create unusual circumstances. • It is not reticence to spend extra money to avoid the variance, but rather the desire to build a home of a high enough value to fit in with the neighborhood. While this is an "economic consideration" of a sort, it is the desire for a higher expenditure rather than a lower one. • The other lots in the development do not have the same combination of constraints. Lot 1, which has several road setbacks, is wider and can accommodate a house within the setbacks. Lot 4 is narrow, but does not have the collector road setback or the extensive wetland easements. • Higher value homes are the reason for the R -1X district compared to the R -1, and the house proposed is in keeping with that goal. For these reasons, staff recommends approval of the variance request. Staff notes that the recommendation on this variance request is based on the unique attributes of Lot 8 and in no way implies support for variances on the other lots in the development. PLANNING & ZONING BOARD ACTION The P & Z considered the application on March 14 and recommended approval. OPTIONS 1. The property was originally about nine acres but was cut in two by Apollo Drive. The result is one large tax parcel divided by a road easement. The application is to split the property into three lots which will better reflect the real situation. Land on the north side of Apollo Drive will be split into two lots, one 1.47 acres and one 1.5 of acres. Land on the south of Apollo will be a separate parcel of 4.1 acres. The VFW will sell the 1.5 -acre lot to Lino Lakes Dentistry, which wants to build a new office building on the site in the near future. The goal is to sell the other lots in the future. ANALYSIS The site is zoned GB General Business. The minimum lot area is 20,000 sf, with a minimum lot width of 100 ft. As shown on the survey, there will be 1.47 acres remaining on the north and 4.1 acres on the south. Both have adequate area and road frontage. The City and Anoka County have a joint powers agreement regarding access management on Apollo Drive. To comply with this agreement, we are requiring a joint driveway on the new parcels on the north of Apollo Drive. This driveway easement is shown on the survey. We also are requiring a shared driveway agreement between the two parcels. On February 13, 2001, the Planning & Zoning Board recommended approval of the minor subdivision with two conditions: 1) a revised survey document is provided indicated a shared access drive with the piece to the west and 2) a shared driveway agreement is provided for the access drive. This agenda item was postponed at the March 12 City Council meeting because we had not received the shared driveway agreement.. We expect to have it for the March 26 meeting. • • so MUSA Issue: Lake Drive Site of Existing VFW In 1999, the City approved a site plan and CUP for a new building addition to the existing VFW post on Lake Drive at Lois Lane. However, that site is not within the MUSA. A condition of approval for that site plan and CUP approval was that "the MUSA designation for this parcel shall be resolved prior to the utility connection." That is, the new building won't be connected to utilities until it has MUSA. This prevents the building from being constructed without MUSA. The City will not have MUSA to allocate for the site until the comprehensive plan is approved by both the City and the Metropolitan Council. One option was for the VFW to take the MUSA from their Apollo Drive site and put it on the Lake Drive site for the new building. However, that could interfere with the ability to sell the Apollo land. Staff has discussed this with Mr. Dean Johnson, Post Commander of the VFW. Mr. Johnson informs us that they would prefer to keep the MUSA on the Apollo site and wait for new MUSA for the Lake Drive site. Therefore, the new building at the existing Lake Drive VFW will wait until the comprehensive plan is approved by the City and the Met Council. The City can then allocate MUSA to the VFW site. The grant program funds a maximum of 50% of the total eligible project costs not to exceed a maximum grant of $20,000. Applications are due by March 31, 2001. The City of Lino Lakes Conservation Partners Grant Program submittal is intended to restore a woodland in the Birchwood Acres neighborhood area by removing existing buckthorn from the understory. City maintenance staff and neighborhood volunteers will perform this work. The grant is also intended to initiate a 3 to 5 year volunteer education and maintenance "follow -up ", with the residents in Birchwood Acres and the Clearwater Creek areas. Clearwater Creek is presently under an initial invasive plant removal program funded through the Conservation Development Management Plan Agreement. The grant request to The Minnesota Department of Natural Resources is for $8197.97. The City portion of the grant is $4098.98, of which $2,203.69 is a soft match of our labor hours and equipment costs. The rest of the monies would be to purchase the necessary chemicals for invasive removal, provide for an updated Environmental Board education packet to be distributed to residents involved, and a contingency of $1500 for ground story replacement plants should a sufficient seed bank be unavailable. Project Purpose — The purpose of this proposal is to implement a starting program aimed at the management of invasive woodland plants, to restore historic oak woodland, and to educate and involve residents in the management process. From the Technical Report/Applied Ecological Services: "Historic oak savannas...are remnant, formerly -open communities of drier sand and morainal ridge tops in the township. They represent approximately a third of the mapped forest cover, but only 5% of the total cover of the township... most oak savanna systems have experienced severe degradation following the cessation of fire and the subsequent development of a closed- canopy, overstocked with early - successional species, as described above (see recently - developed forested systems, 3C)... (Recently- developed forested systems (3C) represent a little over half of the forested cover of the township... A dense sub - canopy can develop, which can include dense growths of common buckthorn, Tartarian honeysuckle, and other shrubs that are semi- to completely shade - tolerant. The combined influence of shading by young, woody growth in both ;a6 layers has contributed to the decline of the native,'soil- stabilizing vegetation... the loss of a seed source in systems where oak regeneration is already compromised by heavy shade - suppression is critical. ") Goals: 1. Remove exotic (buckthorn) from proposed area 1, expose seedbed, restore diversity and viewsheds, and increase trail user safety. 2. Educate residents in area 1 and 2 and create Tong -term monitoring and action plan for buckthorn control in these two areas. Benefit: The City of Lino Lakes has spent a good amount of money and time in planning and developing an environmental management plan and Geographic based inventory, and are currently trying to take the planning phase to higher levels of detail with participation in the MNDNR Wildland Urban Interface project. The Environmental Board has set a goal implement a demonstration project. Another goal of the Environmental Board is to educate the public on issues concerning environmental issues. The City of Lino Lakes Environmental Board has also desired to connect with other existing or forming Environmental Boards in the Twin Cities Area. The city needs and the greater region needs concrete management plan implementation projects. This project and the results of this project can be shared with other government agencies who are contemplating the usefulness of Environmental Management Plans and Geographic Information Systems. Summary of Key Proposed Activities —The Project would involve the removal of invasive buckthorn in a woodland along at trail in the Birchwood Acres Neighborhood, and follow -up education program for Area 1 (Birchwood Acres), and Area 2 (Clearwater Creek). Area one is composed of approximately 6.8 acres, in a greenway area adjacent to a city trail. Residents have indicated an interest in buckthorn removal from a visibility standpoint. Area 2 is in the Clearwater Creek 3rd subdivision and was the first conservation development project that was planned in conjunction with or Environmental Inventory and Management Plan. This plan was accepted by the City in 1999, and will be incorporated into the City Comprehensive Plan. Area 1, was identified as a historic oak savanna (degraded). Clearwater Creek has a management plan and budget to restore greenway areas throughout the subdivision. Part of this management plan includes the removal of about 7.5 acres of invasive buckthorn. • • • It is the intention of this proposal to follow up management procedures in Clearwater Creek with educational material and a volunteer removal program for both area 1 and area 2. Required Attachment #2: Outline in a one to two page work plan the 1) key activities to be performed, 2) who will carry out each activity, 3) methodologies used, 4) time frame for carrying out the project and 5) final quantifiable deliverables. Volunteers may also be used to salvage plants, and or transplant plants from other areas of the City to reintroduce biodiversity should there be little or no seedbank.
