This is a short form application that is judged on whether or not a proposed project meets certain criteria that are important to the creation of a livable community. The guiding principles for the selection of grant awards are: • Make development compact by connecting uses and building a mix of mid -to high density housing • Mix uses, such as workplaces, residences, shopping, civic buildings, schools, parks and public spaces • Design for people by putting buildings within walking distance, designing streets for cars and people, and promoting public gathering places. This application is a repeat of the one made last year, requesting funding for the extension of Town Center Parkway to provide access to the residential neighborhood as shown on the development plan, and to construct the neighborhood streets, alleys, sidewalks, and streetscape amenities. The intent is to enable the city to lower the development costs, making it feasible for the developers to acquire the land needed to complete the Village plan. If the city meets the criteria for the Livable Communities, a more detailed Phase II application is required. That application is due September 14. OPTIONS: 1. Concept /6oals /Scope Lino Lakes' goal since 1995 has been the creation of a Traditional Neighborhood Development in the 50 -acre Village that ensures a new "downtown" with a true identity, genuine character and appeal. Based on a Master Plan and Design Standards developed by Calthorpe Associates, the Village plan is a model of a compact, neighborhood- oriented mix of uses — including diverse housing opportunities —in a developing suburb. Pedestrian linkages will create a human - scale, walkable environment connected to the commercial area, the future YMCA, the Centennial middle school and new elementary school, the industrial park, the Lino Lakes Civic Complex and the regional park reserve. Process to date /status 1997: City initiates extension of utilities to the Village, and purchases a portion of the Village site to control future development. 1998: City receives a 1997 Livable Communities planning grant; hires Calthorpe Associates to complete Town Center Master Plan and • design standards. City commits $1.5 million, plus land and infrastructure, to the completion of a YMCA community center 1999; City and school district invest $7.8 million in Lino Lakes Civic Complex (City Hall, Police Station, Centennial School District Early Childhood Center designed by The Leonard Parker Associates); Calthorpe Associates Master Plan complete 2000: Commercial and housing development team is formed for Phase I of Village Development; StudioWorks is hired for refinement of development plan (see attachment); city awarded Livable Communities implementation grant. 2001; Developers and city completing draft of development agreement that will include neo- traditional design standards. City has contacted and will make application to MnDOT for access ramp off 35W into the Village site. • Next Steps: Complete and approve development contract and timetable; develop marketing strategies, pre - leasing and financial approvals; create abatement district; Phase I implementation of public infrastructure, senior apartments, retail, office and service in The Village. • • • Project Components /Thresho /d Criteria Proposed Densities: The Lino Lakes draft comprehensive plan allows Village housing densities between 10 and 24 units per acre. Phase I development plan for 7.5 acres of city -owned property includes 48,000 5F of retail, 15,000 5F of office, a daycare and 90 units of rental housing. The complete development plan calls for an overall housing density of approximately 18.5 units per acre. Mix of Uses: The complementary mix of land uses includes retail, restaurant, entertainment, daycare, civic facilities, recreation (park and YMCA), employment, housing, and community open space to encourage pedestrian traffic and support future transit use. These uses are intensified through narrower streets, on- street parking, shared parking requirements, "build -to" lines, office above retail, and pedestrian connections. The Village preliminary site plan (see attachment) includes: Completed: Civic Complex 50,672 SF Bank: 5,000 SF Clinic: 9,613 SF Phase I: YMCA 45,000SF Office /Service 15,000 SF Retail 48,000 SF Daycare 5,000 SF Phase II: Retail Office Hotel 25,000 SF 16,000 SF 75,000 SF Housing Mix and Integration: The housing mix for all phases has an anticipated 380 units of diverse housing opportunities in the Village upon completion, including: • 175 rental apartment units (80% market rate and 20% affordable at 50% of the median income.) Apartments to include studios, one - and two - bedrooms (Phase II) • 90 units of rental "empty nester" apartments with the same mix of market rate and affordable (Phase I) • 115 for -sale townhomes (80% market rate and 20% affordable at a range of 80 -115% of the median income. Townhomes will include several unit types, including single level and two -story with two or three bedrooms; and approximately 10 live /work units (Phase II) Employment Proximity: Current employment within one mile of The Village, plus a conservative estimate of anticipated employment in the completed Town Center, is 2,650. Within several years, ancillary development within one mile will likely increase employment to more than 3,000. Project Features 1. Integration of transportation, housing mix, commercial, employment: The Land Use Plan concentrates development at intensities that bring the mix of land uses within walking distance, the longest being one -half mile. It regulates boundaries for housing, mixed use and civic /public locations, and a minimum framework of required streets. Street standards, shared parking, pedestrian walkways, open space amenities, build -to and setback lines, etc., are specified. Rental units, apartments and live /work provide housing previously not available in Lino Lakes. Townhomes have front porches and access to parking from alley /courts. Senior apartments are located above service uses, just around the corner from nearby neighborhood commercial, one block from the clinic and bank, and across the street from the YMCA. 2. Linkages (See attachment): • Public Transit: The Land Use Plan includes a proposed new access from the 35W off -ramp, with a future transit stop within a quarter -mile of Village housing. • Pedestrian linkages within the Village: The Land Use Plan establishes a network of interconnected local streets with on- street parking, and connecting walkways. Traffic calming features will encourage pedestrian and bicycle traffic. • Trails: County plans for rebuilding Lake Drive at 35W include marked walking /biking paths to connect the north and south quadrants. Direct pedestrian /bicycle linkages under a joint county /city trail plan will connect The Village to neighborhoods on the south end of the park, the City of Centerville, and high density housing on Lake Drive. The Village will also be accessible via a regional trail connection to cities to the west. 3. Access to employment, transportation, housing, services, recreation, etc. • Employment: The Town Center will be the city's first major retail /service employment center within walking distance of the city's major business park. Live /work units will provide opportunities for living and working in the same neighborhood, and on -site day care is planned. • Transportation: The transit stop will offer a "kiss- and - ride" opportunity close to a coffee shop, bank and gas /convenience store. The Village will accommodate greater population densities with direct access to 35W and public transit. • Housing: Village housing will provide diversity, rental opportunities and affordable options. • Services: residents will have the opportunity to meet many of their daily shopping, recreation and service needs on site. • Recreation: All residents living in the Village will have pedestrian access to the YMCA and the Rice Creek Regional Park Reserve trail system. • Community /public spaces: The Civic Complex has public meeting rooms and community room. The YMCA will provide recreational, health and fitness opportunities, plus a teen center. The Village Green will provide space for public gatherings and open markets. 4 Funding Request Last year's Demonstration Account award made to the city will be used to write down the cost of public improvements for Village Phase I development of retail, office, daycare and rental apartments geared towards empty nesters. The city owns the land planned for Phase I development, but the viability of this phase is dependent, in part, on the integration of the remaining housing in The Village. The 29 acres planned for the majority of housing, including the townhomes, live /work and rental apartments, is privately owned. Public assistance with infrastructure costs will be necessary to enable the developers to purchase the land. Development pressure has made the acquisition of the remaining land in The Village even more critical. A conventional shopping center on the northeast quadrant of 35W has been proposed. This is likely to bring additional commercial interests to the Village site. The key to making The Village development successful is providing a means for the city to assist a development team that is willing to follow the Calthorpe development guidelines to gain site control of the remaining land. Covering the cost of infrastructure for the next phase is necessary for financial feasibility of the project. Phase II development of the Village plan requires the following improvements: • Extension of Town Center Parkway to provide access to the housing sites • Design, engineering and construction of new residential neighborhood streets, alley /courts and connections, such as pedestrian walkways, mews and bikeways • Design and installation of streetscape amenities, including sidewalks and special paving The cost of these improvements is estimated at $1.5 million Amount requested $1.5 million It is the city's and developers' intent to complete this plan in two phases. The 2000 Livable Communities award will assist in the completion of infrastructure to Phase I. The intention was to have the Arbor Day Proclamation formally accepted by the City Council the week of the celebration, however that week was one of those times the City had an extended period of times between meetings. Therefore, and since the proclamation was read at the celebration, and Arbor Day proclaimed for that day, the City needs to retro -act on this proclamation to formalize it for Tree City USA qualification. MEETING DATE: May 14, 2001 TOPIC: FIRST READING: Ordinance 01 -06 Amending City Code Regarding Park Dedication Requirements VOTE REQUIRED: 4/5 BACKGROUND The City has conducted a study of park needs and land values to determine appropriate park dedication requirements in Lino Lakes. Section 1001 of the City Code makes up the requirements for the subdivision of land. Park dedication requirements are included in the subdivision regulations, as authorized by state statute. Minnesota Statutes 462.358 Subd. 2b. states in part that ...the regulations may require that a reasonable portion of any proposed subdivision be dedicated to the public or preserved for conservation purposes or for public use as parks, recreational facilities..., playgrounds, trails, wetlands, or open space; provided that (a) the municipality may choose to accept an equivalent amount in cash from the applicant for part or all of the portion required to be dedicated to such public uses or purposes based on the fair market value of the land no later than at the time of final approval The park dedication study conducted by Northwest Associated Consultants resulted in a reasonable estimate of land values at final approval (final plat) and the park dedication that can be justified based on those values. The result differs from what is currently included in our regulations for park dedication. The attached Ordinance 01 -06 amends the current ordinance. It clarifies than only upland will be used to calculate park dedication requirements, and only uplands will be accepted for park dedication (see Subdivisions 8 and 3). It includes a straightforward dedication of 10% of the uplands and allows the City to list the park dedication in the City's fee schedule (see Subdivision 8). It also states that the City will use the land value at final plat to determine cash dedication (see Subdivision 13). Ordinance 01 -06, Park Dedication page 2 The study determined that when the City chooses a cash dedication rather than land, $1960 per lot is reasonable. This amount will be included in the City fee schedule rather than in the City Code in order to make it easier to change in the future. The fee schedule will list residential park dedication as 10% of non - wetland area or $1960 per lot or a combination, as determined by the City. When it will be a combination, we will start with the land, since land should be acquired when possible. But if we don't want the full 10% in land, we can apply the project's net density to the remaining dedication need to get the cash value. For example, a 40 -acre subdivision with two acres of wetland gives us 38 acres of upland. Ten percent is 3.8 acres. If the City only needs two acres to add onto an adjacent park, that leaves 1.8 acres of unmet dedication. If the proposed project's net density is 2.1 units per acre, that would calculate out to 2.1 x 1.8 acres = 3.78 "lots ". We would multiply the 3.78 x $1960 = $7408.80. Therefore, the City would get two acres of land and $7409 in cash. Commercial /industrial park dedication listed in the fee schedule will remain what it is in the current ordinance. An ordinance requires two readings, publication, and a 30 -day waiting period before it becomes effective. Staff will prepare the appropriate change to the fee schedule to have it ready for adoption when the new ordinance becomes effective. As stated in an earlier memo, the anticipated schedule is: May 14 City Council Mtg. public hearing and first reading of the ordinance May 29 City Council Mtg. second reading of ordinance June 5 ordinance published in newspaper July 5 ordinance becomes effective (30 days after publication) OPTIONS 1. RECOMMENDATION Option 1 01 -06 Council Member Ordinance 01 -06, Park Dedication page 3 introduced the following ordinance and moved its adoption. CITY OF LINO LAKES ORDINANCE NO. 01-06 AN ORDINANCE AMENDING SECTION 1001 OF THE CITY CODE REGARDING SUBDIVISION AND PLATTING TO MODIFY PARK DEDICATION REQUIREMENTS. The City Council of the City of Lino Lakes, Anoka County, Minnesota, does ordain as follows: I. Section 1001.14 of the City Code is hereby amended to delete the existing provisions and add the following requirements: 1001.14 Property Dedication. Subdivision 1. A portion of any subdivision shall dedicate to the City a reasonable portion of the proposed subdivision for public streets, roads, utility easements, water facilities, storm water drainage and holding areas or ponds and other similar utilities and improvements. Subdivison 2. As a prerequisite to any subdivision approval, and at the sole determination by the City, applicants and/or developers shall dedicate land for parks, playgrounds, public open spaces or trails and/or shall make a cash contribution to the City's park dedication fund roughly related to the anticipated effect of the subdivision on the park and trail system. The amounts listed in this Section are the City's best estimate of the dedication or cash contribution needed to offset the effect of the subdivision on the park and trail system. The requirement may also be met with a combination of land and cash if approved by the City Council. Subdivision 3. Land shall be reasonably suitable for its intended use and shall be at a location convenient to the people to be served. Factors used in evaluating the adequacy of proposed park and recreation areas shall include size, shape, topography, geology, hydrology, tree cover, access and location, and future park needs pursuant to the Comprehensive Plan. Wetlands, ponding areas, and drainage ways shall not be eligible for park dedication credit. Park land to be dedicated shall be above the ordinary high water level. Grades exceeding twelve (12) Ordinance 01 -06, Park Dedication page 4 percent or areas unsuitable for park development shall not be considered for dedication. Land with trash, junk, pollutants and /or unwanted structures is not acceptable. Subdivison 4. The applicant shall confer with City Staff and the Park Board at the time the preliminary plat is under consideration, to secure a recommendation as to the location of any property that should be dedicated to the public, such as parks, playgrounds or other public property. The preliminary plat shall show the location and dimensions of all areas to be dedicated in this manner. Such contribution requirement recommendation(s) will be sent to the Planning Commission for review and comment and subsequently to the City Council for their approval. Subdivision 5. When a proposed park, playground, recreation area or other public ground has been indicated in the City's official map or Comprehensive Plan and is located in whole or in part within a proposed plat, it shall be dedicated to the appropriate governmental unit. If the applicant elects not to dedicate an area in excess of the land required hereunder for such proposed public site, the City may consider acquiring the excess land through purchase or condemnation. Subdivision 6. Where private open space for park and recreation purposes is provided in a proposed subdivision, such areas may be used for credit, at the discretion of the City Council, against the land or cash dedication requirement for park and recreation purposes, provided the City Council finds it is in the public interest to do so. Subdivision 7. The City, upon consideration of the particular type of development, may require that a lesser parcel of land should be dedicated due to particular features of the development. In such cases, a cash contribution shall be required above the land dedication to ensure that compensation is received for the full amount of the impact on the City's park and trail system. Subdivision 8. In all new residential subdivisions, ten (10) percent of the area subdivided shall be dedicated for public recreation space or other public use as established by City Council resolution. A different percentage may be applied as the City Council shall determine to be reasonably necessary as a result of the subdivision approval. This ten percent shall be calculated on the net area, which is the gross area of the subdivided property minus the area in wetlands. The land dedicated for public recreation shall be in addition to property dedicated for streets, alleys, easements, or other public ways. No areas may be dedicated for public use until such areas have been approved by the City Council as suitable and necessary for the health, safety, convenience and general welfare of the City. Subdivision 9. When a subdivision is proposed, the developer shall make a dedication of land for public park and trail use, as provided for in Subdivision 8, of this Section, Ordinance 01 -06, Park Dedication page 5 or shall pay a fee in lieu of such land dedication as established by City Council resolution. Said amount is the City's best estimate of the effect of the subdivision on the City's park system. Subdivision 10. All land proposed for trail and /or bikeway dedication shall be subject to the recommendations of the Park Board and approval of the City Council. Subdivision 11. The City may elect at its sole discretion to receive a combination of cash, land, and development of the land for park and/or trail use. The potential cash donation generated by the dedicated land and/or the value of the development of land shall be calculated. That amount shall be subtracted from the cash contribution required by Subdivision 9 of this Section. Subdivision 12. Planned unit developments with mixed land uses shall make cash and/or land contributions in accordance with this Section based upon the percentage of land devoted to the various uses. Subdivision 13. Park cash contributions are to be calculated and established based on land value at time of final plat. Cash dedications shall be included in the development agreement and paid prior to the City's signature of and release of the final plat. For subdivisions that do not require a development agreement, the cash dedication shall be paid before the City releases the signed approval of the subdivision for recording. Subdivision 14. Cash contributions for parks and trails shall be deposited in either the City's Park Fund or multi - purpose trail fund and shall only be used for park acquisition or development, and trail acquisition or development as determined by the City. Subdivision 15. Property being replatted with the same number of lots and same number of dwelling units shall be exempt from all park land dedication requirements. If the number of lots or the number of dwelling units is increased, or if land outside of the previously recorded plat is added, then the park land dedication and /or park cash contributions shall be based on the additional lots and on the additional land being added to the plat. Subdivision 16. If the applicant or developer does not believe that the estimates contained in this Section fairly and accurately represent the effect of the subdivision on the park or trail system of the City, the applicant or developer may request that the City prepare an in- depth study of the effect of the subdivision on the park and trail system an estimate of that effect in money and /or land. All costs of such study shall be paid by the developer or applicant. If the developer requests the preparation of such a study, no application for the development shall be deemed complete until the study has been completed and a determination is made as to the appropriate amount of land or money necessary to offset the effects of the subdivision. The site is within the existing Behm's Park on the southwest corner of Mustang Lane and Palomino Lane. Behm's Park currently includes approximately 8.6 acres. The park area includes Lots 13, 14, 15, and 16, Block 2, Sunset Oaks. The City acquired these four lots for park purposes via warranty deed in December 1985 to fulfill park dedication for Sunset Oaks. The City rezoned Lots 14, 15, and 16 to R -1 in 1994 (Ordinance 15 -94). Lot 13, the southern portion of the park, was not included in the rezoning action. This likely was an oversight. In 1997, the City received approval from the Metropolitan Council to allow the City to use part of its MUSA reserve for the Behm's Century Farms development. The approved submittal map included Lots 14, 15, and 16, but did not include Lot 13. That is, the southern part of Behm's Park was not included in the area where MUSA can be applied. Again, probably an oversight. In 1999, the City Council authorized selling 2.55 acres of the park to G. M. Development for $75,000, which was to include grading improvements to the park (Ordinance 16 -99 and Resolution 99 -50). The intent was to allow for the creation of nine house lots. Proceeds of the sale of this land would be used to develop the park. However, there was no guarantee in the purchase agreement that the City would approve rezoning or development of the 2.55 acres. • • • Behm's Farm Park Addition May 14th, 2001 page 2 Gary Uhde of G. M. Development has requested that the City allow him to follow through on his plan for developing the new lots. Staff discussed this with the City Council at a work session on 11/8/00 and Council directed staff to proceed. In order to proceed, three actions are needed: 1. Rezone Lot 13 Sunset Oaks to R -1 2. Allocate 2.55 acres of MUSA reserve to the area to be sold to the developer 3. The proposed use is or will be compatible with present and future land uses of the area. The land use and zoning table shows that the proposed rezoning complies with these first two factors. The site and surroundings is guided for single family and park uses. Land immediately surrounding the new lots is already developed with single family homes. Most of the current park will remain park. The park acts as a buffer for the larger lot, unsewered homes to the west and south. 3. The proposed use conforms with all performance standards contained herein. The proposal meets the zoning and platting requirements contained in City ordinances. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Existing utilities can handle the nine new lots. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. The existing roads can easily handle traffic from the nine new homes. Staff recommends finding that the project complies with the above factors. MUSA Policies As noted above, most of the site is within the area approved for the use of some MUSA reserve. The lower portion is not. However, only 0.5± acres is outside the approved area. Because this appears to be an oversight of the past, staff feels comfortable with this. In addition, most of the area approved for MUSA will remain as City parkland. The City's MUSA reserve can be allocated within approved areas at the City's discretion. Currently, the City has 29.2 acres in the reserve. This project would need 2.55 acres of MUSA reserve. • Interim MUSA Reserve Criteria: The City has criteria for the allocation of the MUSA reserve. The request for MUSA is occurring concurrently with preliminary plat application. 2. The property in question shall be zoned R -1 or R -1X or a rezoning application be in process in conjunction with the preliminary plat. The rezoning request is occurring concurrently with the MUSA request. 3. The property in question must be immediately adjacent to existing MUSA. MUSA is directly across both Mustang and Palomino Lanes. 4. MUSA Reserve shall be allocated to net buildable acres. The net acreage for the nine lots is 2.55 acres, and that is the MUSA request. 5. Development of the property must be considered a natural utility extension. 6. Development of the property must be considered a natural extension of existing roadways. Utilities and roadways exist directly adjacent to the site. 7. Development of the property shall not adversely affect the health, welfare, and general safety of the community. 8. Development of the property shall be environmentally compatible with the surrounding area. There is no evidence of negative impacts to the community or environment. The wetland plan was approved by the Rice Creek Watershed District. 9. Development of the property shall be consistent with the City's Comprehensive Park Plan. The revenue from developing the site into nine lots will provide funds to develop the park according to the Park Plan. 10. MUSA Reserve shall be allocated only to properties located within Sewer District 1, 4s, 6 and the Behm's Century Farms Development within Sewer District No.2. Development of the property shall be consistent with the City's comprehensive Sewer and Water Plan. Utilities and roadways exist directly adjacent to the site. 12. The developer shall demonstrate a commitment to the community. This is one phase of the larger Behm's development area. 13. The proposed development shall comply with the City's Infill Policy as outlined by Resolution No. 92 -85. See below. 14. Roadways serving the proposed development shall be determined adequate to handle the additional traffic generated by the proposed development or a financial commitment shall be made by the developer to upgrade said roadways. Existing roads are adequate to handle traffic from nine new lots. Infill Policy: The City adopted Resolution 92 -85, a policy for the location of new development, also referred to as the " infill policy ". This policy includes criteria to be considered, which are listed below: • All new developments must be located within the MUSA as established by the Comprehensive Plan. Allocation of MUSA acres from the MUSA reserve will fulfill this requirement. • All new developments must be analyzed for impact on utility and street system costs. • New development shall only be allowed if: a) The cost of utility and street extensions can be covered by immediate assessment, and b) The cost of operation and maintenance of the system will not exceed the normal costs, and c) An upfront payment or series of payments by the developer would offset any additional costs. • • Behm's Farm Park Addition May 14th, 2001 page 6 Utilities and streets exist to serve the new lots. Payments to support service to these lots will be addressed as with any development. Staff recommends finding that the project meets these criteria. Preliminary Plat Lots, Blocks: All the proposed lots comply with the minimum lot dimensions. The blocks will not be separated by roads. Rather, park trails between the platted blocks will provide access to the park. Natural Features: An existing ditch has been relocated as part of the drainage plan for the larger Behm's project. This ditch is classified as wetland. There is a small wetland on the southern portion of the site that is not being impacted. The impact plan was approved by the Rice Creek Watershed District. Native plantings have been planted inside the southern half of the trail loop. The northern portion is sodded, irrigated play area. Transportation, Roads, Access, Circulation: No new roads are proposed. Parks and Trails: The City agreed to sell the land to the developer in order to obtain funds to develop the park. As part of the land sale agreement, the developer has completed earthmoving work in the park. He also graded the trail and installed aggregate. The City has since paved the trail. Additional park dedication will be $6885 cash. Because of the unusual situation, staff and the developer negotiated for the cash dedication. This is based on a typical cost of land per acre in Lino Lakes, and the 2.55 acres of new lots: $27,000 x 2.55 = $68,850. The typical City park dedication of 10% calculates out to $6885. Some discussion occurred at the public hearing about trail access to the site. Behm's 5th Addition to the east across Mustang Lane originally had a trail leading to Mustang Lane. However, residents protested that trail location, so it was not constructed all the way to Mustang. Stormwater Management: As noted above, the ditch across the northern portion of the park has been realigned somewhat as part of an approved plan. Grading and stormwater management for this area was reviewed with previous Behm's Century Farms development. The grading plan for the new lots will meet City requirements. • Utilities: Sewer and water are available both in Mustang Lane and Palomino Lane. • • Behm's Farm Park Addition May 14`h, 2001 page 7 Conditions of Approval of Preliminary Plat: Resolution 01 -06 approves the preliminary plat. Three conditions of approval are included in the resolution: 1. Ordinance 01 -01 must be in effect (30 days after publication) before the final plat can be recorded. 2. Ordinance 02 -01 must be in effect (30 days after publication) before the final plat can be recorded. 3. The developer must notify purchasers of residential lots of the existence of the nearby Lino Air Park. The developer must provide to the City a copy of the notification format to be used before final plat approval by the City. PARK BOARD RECOMMENDATION The Park Board discussed this project at its January 4 meeting. The Board was glad this project is in progress in order to complete the agreement and develop the park. The Park Board is satisfied with the additional cash park dedication. ENVIRONMENTAL BOARD RECOMMENDATION The Environmental Board discussed this project at its January 3 meeting. That Board recommends additional native plantings behind the Mustang Lane lots and notification of the need for periodic burning of the plantings. Staff believes the existing native plantings are sufficient. PLANNING & ZONING BOARD The P & Z reviewed the applications on January 10, 2001. The P & Z approved the rezoning, MUSA allocation, and preliminary plat. One condition was added to the plat: that the purchasers of the lots are notified of the existence of the air park. SALE OF LAND As explained above, the land currently is zoned Rural, with a 10 -acre minimum. Until the land is rezoned, no lots smaller than that can be created. This means that the nine lots making up 2.55 acres of land cannot be created until the rezoning is effective. Therefore, the City cannot sell the land to Century Farms Development until the rezoning is effective, 30 days after publication of Ordinance 01 -01. A petition of at least 25% in number of the benefitted property owners together with a resolution adopted by an affirmative vote of the majority of all of the Council (3/5 vote), or b. A resolution adopted by a 4/5 affirmative vote of all the Council 2. Receive Feasibility Report and Call Hearing on Improvement June 25, 2001 a. Resolution shall be published twice, at least one week apart, in the official newspaper of the City no less than two weeks prior to the date of hearing, and b. Election November 6, 2001 When less than 100 % of the estimated cost of the proposed improvement is to be paid for by a funding source other than the City general fund, the Council shall within 120 days after the conclusion of the hearing, submit the proposed improvement and its assessment formula to the voters of the City. If a majority of those voting on the improvement are opposed, the Council shall not proceed with the improvement. 6. VOTE REQUIRED: 4/5 Vote Required BACKGROUND: As we have discussed in the past, the reconstruction of Elm Street from Sunset Avenue to Fourth Avenue is a high priority due to the proximity of Centennial Middle School, the level of development in the area, and the amount of pedestrian traffic using the current roadway. The primary funding source for this work will be Municipal State Aid funds but assessments and trunk funds will also be considered in the report. Proceeding with the study of this roadway now also allows the City to take advantage of the neighborhood involvement momentum related to the efforts by St. Joseph's church related to traffic issues along Elm Street and Second Avenue. During preparation of the report, neighborhood meetings will be held to solicit input on the design of the proposed improvements. Staff will consider "traffic calming" concerns along these roadways as part of the study. The study will include not only the reconstruction of the roadway and related drainage concerns but will also consider sanitary sewer and watermain system needs. OPTIONS: 1. Five areas have been identified for maintenance in 2001, they are located as follows: Location Mar Don Acres Twilight Acres 2nd Addition Highland Meadows West Thomas Street Tomahawk Trail Type of Maintenance pond cleaning pond cleaning downstream ditch cleaning outfail repair ditch cleaning The maintenance activity required at these sites is more extensive than what is typically undertaken by Public Works staff. They have been combined into one project in order to minimize mobilization costs. If, after we begin preparation of the construction documents, discover the cost of a specific maintenance activity far outweighs the benefit, we may recommend reductions in the project scope. The funding for this work is provided by the Surface Water Management Fund. This fund was established in 1992 as a revenue source in order to meet the "administrative, planning, ponding, mitigation, and water quality needs" of the City. It is reimbursed through assessments to new subdivisions and is also collected as property owners connect to City utilities. The dimensions of the existing easement, the proposed easement, and the legal description are described on the attached drawings. The existing easement was dedicated for ponding and flowage purposes. The property owner has requested this change because the existing easement configuration will not accommodate his proposed house and hanger. There is also a taxiway easement on the property that will be left unaltered. Rice Creek Watershed District has reviewed and approved of the proposed change as shown on the attached correspondence dated March 5, 2001. City staff has determined that the drainage can be conveyed using the reduced easement area as shown and recommends granting the vacation request. Section 12.05 of the City Charter requires that real property of the City cannot be disposed of except by Ordinance. The Ordinance will require two readings, publication, and a waiting period before it is in effect.
