BACKGROUND:
On May 16, 2001, the city administrator reported to the City Council the availability of
public administration interns from St. Cloud State University for the ten -week summer
session. At that time council members gave their verbal approval to engage an intern and
pay the intern a stipend.
Mr. Neal Haglin, a senior in the public administration program, has started his internship
and will assist with administrative tasks agreed upon by the city and the program advisor.
Staff is requesting formal authorization for a $2,000 stipend to be paid in five equal
installments during the course of the internship. In the event the internship is shortened
for any reason, the stipend amount will be prorated.
OPTIONS:

TOPIC: Consideration of an Application for a Block Party,
Hunters Ridge
BACKGROUND:
The third annual block party is being planned for Hunters Ridge in Pheasant Hills
Preserve 7th Addition. The block party is scheduled to start at noon and end at 10:00
p.m., July 14, 2001. Attached is a map showing the location of the proposed party and
the signed petition from property owners acknowledging they have been notified of the
party. These property owners are indicated by the slant marks on the map. Please note
that the street is not a cul -de -sac and the street will be blocked at both ends. There is
nothing in the City Ordinances that prohibits a block party on a through street.
Both the Police Department and the Streets Division of the Public Services Department
have been given information on the party. Public Works will provide barricades for
• blocking the street and the Police Officer assigned to this precinct may stop by to visit the
party.
In the past, the City Council has encouraged these parties as it presents an opportunity for
neighbors to get acquainted with one another. These parties also create the opportunity to
form a neighborhood crime watch unit.

BACKGROUND:
The City Clerk's office has received applications for renewal of all 2001 liquor licenses,
3.2 beer licenses and dance licenses. All applications are complete, all fees paid, and
certificates of insurance have been received, with the exception of Shirley Kay's (see
attached memo), the American Legion and Miller's on Main. The American Legion and
Miller's on Main are in the process of changing the coverage dates on their certificates of
insurance to comply with city ordinance. I expect the revised certificates in my office by
June 30, 2001.
The Police Department completed its annual investigation of all establishment owners
and their managers. No problems were noted in this investigation. The Centennial Fire
Department also completed its inspection and found no violations, according to Chief
Milo Bennett.
I have researched payment of property taxes and assessments and find that all financial
obligations to the city are current.
These licenses must be renewed by July 1, 2001 or the liquor and beer licenses lapse and
the sale of liquor beverages must cease.
OPTIONS:
1. Approve all applications for renewal of liquor, 3.2 beer and dance licenses
contingent upon receipt of remaining certificates of insurance by June 30, 2001.
2. Return the matter to staff for further information.

The City Council approved the second reading of the ordinance that changed the park dedication
formula listed in the City's subdivision regulations.
Resolution 01 -72 lists the base land value to be used in the formulas and lists the resulting fees
for both residential and commercial/industrial development.
The following agenda item (4C) will actually change the fee schedule to incorporate the new
park dedication fees.

RESOLUTION APPROVING PARK DEDICATION LAND VALUE AND FEES FOR
RESIDENTIAL, COMMERCIAL AND INDUSTRIAL DEVELOPMENTS.
WHEREAS, NAC, Inc., conducted a detailed Park and Trail Dedication Study for the City of
Lino Lakes dated April 3, 2001 to review park and trail dedication standards based upon
development of the system identified in the Comprehensive Park and Trail Plan; and
WHEREAS, the study recommended that the City Subdivision Ordinance be amended to reflect
dedication language provided by Minnesota Statutes and to establish park dedication fees that are
proportional to the impact that projects will generate on the park and trail system; and
WHEREAS, the Park and Trail Dedication Study determined that the 2001 land value for the
purpose of calculating park dedication fees is $28,000 per acre; and
• WHEREAS, the Park and Trail Dedication Study determined that the park and trail impact per
residential unit is $1,665; and
WHEREAS, the Park and Trail Dedication Study determined that the commercial /industrial park
and trail impact per acre is $2,175; and
WHEREAS, the City Subdivision Ordinance has been amended to allow for individual
determinations of park impact per development if requested by the applicant; and
WHEREAS, the City of Lino Lakes will periodically review land values and park and trail
infrastructure costs and amend the dedication fees /standards accordingly.
NOW, THEREFORE BE IT RESOLVED, that the Lino Lakes City Council hereby establishes
the following park dedication fees for residential, commercial and industrial development:

The City Council recently approved an ordinance that determines the calculation of park
and trail dedication. Because the fees are subject to change, they are not included in the
ordinance but in a separate resolution, No. 01 -72. Fees for 2001 are $1,665.00 per
residential unit and $2,175.00 per acre for commercial/industrial property. They become
effective on July 5, 2001, which is 30 days after publication of the ordinance.

RESOLUTION UPDATING 2001 FEE SCHEDULE
TO INCLUDE NEW PARK DEDICATION FEES
WHEREAS, the Lino Lakes City Council adopted Ordinance 06 -01 to establish park
dedication requirements, and
WHEREAS, the ordinance establishes the method for calculating cash fees in lieu of land
dedication, and
WHEREAS, the fee amounts are subject to periodic change and therefore not included in
the ordinance, and
WHEREAS, the Lino Lakes City Council has approved Resolution No. 01 -72
establishing park dedication fee amounts of $1,665 per residential unit or $2,175
per acre for commercial/industrial property.
NOW, THEREFORE BE IT RESOLVED, that the City of Lino Lakes City Council
authorizes staff to incorporate park dedication fees contained in Resolution No. 01 -72 into
the 2001 Fee Schedule previously adopted by Resolution No. 01 -28.

Anthony Scott Lawler, president of Infinity Advertising has requested authorization for
his company to sell promotions (see attached) door to door for Kelly's Corner Restaurant
in Centerville and Falcon Ridge Golf Course in Stacy, Minnesota.
Attached please find the completed application, a list of names, addresses and date of
birth of each individual that will be operating in the city. Also attached is a photo ID of
each agent. Because of the poor quality of the pictures I have requested Mr. Lawler to
send a photo of each agent at least 2 "X2" as required by city ordinance 612.05.

Simple Majority
The Lino Lakes Police Department is requesting approval from the
City Council to apply for a "COPS in Schools Grant" to enter into
a partnership with the Centennial School District, specifically
in Rice Lake Elementary School. The school is located in the
City of Lino Lakes. The purpose of the grant is to work toward
making Rice Lake Elementary one of the safest schools in the
nation. Both parties agree to foster positive interaction
between school staff, police department employees and the
children we serve. The Community Policing Philosophy strategies
we hope to employ are: Training School Safety Patrol Crossing
Guards; School Security Program; Present lessons on respect,
responsibility, good decisions, and problem solving; Child
Protection Program; Implementation of the Forest Lake Area Youth
Service Bureau into Rice Lake Elementary; Attend various school
functions; Safety Camp; Traffic Safety Issues; Taking police
reports of crimes on school property; Public Relations with
students (eat lunch and attend recess with students); Promote
Responsible Behavior; Be a Positive Role Model; and Member of the
Lino Lakes Police Department Active Shooter Response Team.
The amount of the grant request is $125,000 over a three year
period. The grant would be funded by the formula as outlined in
the grant application.

BACKGROUND
On May 29, 2001, the City Council approved the first readings of both these ordinances.
This will be the second readings of the ordinances.
To review, the rezoning ordinance rezones the southernmost portion of Behm's Park to
R -1, which will make it consistent with the rest of the park.
The MUSA ordinance allocates 2.55 acres of the City's MUSA reserve. This will be
allocated to the single - family lots approved on May 29 as the preliminary plat of Behm's
Farm Park Addition.
Both ordinances are attached.

ORDINANCE NO. 01 -01
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
LINO LAKES BY REZONING CERTAIN REAL ESTATE FROM R RURAL TO
R -1 SINGLE FAMILY RESIDENTIAL
The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain:
Section 1. The City Council makes the following findings regarding the application
for rezoning the property described below, based on the factors listed in Section 2, Subd.
1.E. of the Lino Lakes zoning ordinance:
1. The proposed rezoning action has been considered in relation to the specific policies
and provisions of and has been found to be consistent with the official City
Comprehensive Plan, as the site is guided for single family and park uses.
2. The proposed use is or will be compatible with present and future land uses of the
area. The site is guided for single family and park uses. Land surrounding the site is
already developed with single family homes. Parkland will remain on most of the
site. The park acts as a buffer for the larger lot, unsewered homes to the west and
south.
3. The proposed use conforms with all performance standards contained herein. The
accompanying plat proposal meets the zoning and platting requirements contained in
City ordinances. Single family homes and public parks are permitted R -1 uses.
4. The proposed use can be accommodated with existing public services and will not
overburden the City's service capacity. Existing utilities can accommodate the nine
new lots.
5. Traffic generation by the proposed use is within capabilities of streets serving the
property. The nine new homes will not cause negative impacts on the existing roads.
Section 2. A public hearing was held before the Planning & Zoning Board on
January 10, 2001.

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN BY
ALLOCATING 2.55 ACRES OF MUSA RESERVE TO NINE LOTS IN THE
BEHM'S FARM PARK ADDITION
The City Council of the City of Lino Lakes, Anoka County, Minnesota does hereby
ordain:
Section 1. The City Council finds that the proposed project meets the City's Interim
MUSA Reserve Criteria as follows:
1. The request for MUSA is occurring concurrently with preliminary plat application.
2. The rezoning request is occurring concurrently with the MUSA request.
3. MUSA is adjacent to the site, across both Mustang and Palomino Lanes.
4. The net acreage for the nine lots is 2.55 acres, and that is the MUSA request.
5. Utilities exist directly adjacent to the site.
6. Roadways exist directly adjacent to the site.
7. The City has reviewed the proposal and there is no evidence of negative impacts to
the community health, welfare, or general safety.
8. The City has reviewed the proposal and there is no evidence of negative impacts to
the environment. The wetland plan was approved by the Rice Creek Watershed
District.
9. The revenue from developing the site into nine lots will provide funds to develop the
park consistent with the City's Comprehensive Park Plan.
10. The site is within the intended Behm's Century Farms Development within Sewer
District No.2 as reviewed by the Met Council.
11. Utilities exist directly adjacent to the site.
12. This is one phase of the larger Behm's development area, which is a significant
commitment to the community.
13. The proposed development complies with the City's Infill Policy outlined by
Resolution No. 92 -85, because: allocation of MUSA reserve will put the site within
the MUSA; the development of the site has been analyzed for impacts on utility and
street system costs; the analysis deteiniined that costs will be covered by assessments,
that operation and maintenance will not exceed normal costs, and there will be no
additional costs.
14. Existing roads are adequate to handle traffic from the nine new proposed lots.
Section 2. A public hearing was held before the Planning & Zoning Board on
January 10, 2001.
Section 3. Since the findings support the proposal, 2.55 acres of MUSA reserve shall
be allocated to the area included in the nine lots of the Behm's Farm Park Addition.
Section 4. This ordinance shall be in force and effect from and after its passage and
publication according to the Lino Lakes City Charter.

Permit Amendment

BACKGROUND
The applicants, Craig Hubbard and Steve Lawrence of Stat Transportation, are
requesting a conditional use permit to allow the operation of a truck freight transfer
service station on the property located at 416 Lilac Drive. The subject property is zoned
GI, General Industrial District. Truck freight transfer services stations are a conditionally
permitted use in the GI District.
The subject property has two existing conditional use permits, granted in September of
2000. The first allowed expansion of an existing pole barn, while the second allowed
outdoor storage. Together, these permits allowed Central Suburban, Inc. to operate a
land development and construction company on this site. This use involved the storage
of trucks, equipment, and construction materials.
The new use will be a trucking company. The company operates six straight trucks and
five semis. These trucks depart the site daily between 7:00 and 8:30 AM, Monday
through Friday, and return between 3:00 and 5:00 PM for parking overnight.
Occasionally, trucks will return to the site with freight that is stored overnight and
delivered the next day. The site contains an existing building which the applicant will
use for a small office for administrative purposes and a shop area for maintenance of
the trucks and trailers.
This review is based on the following plan submittals:
Site Survey Received by the City on 4 -5 -2001
Existing Conditional Use Permit 9 -2000.
ANALYSIS
• The applicant has indicated that they plan to add a loading dock. The applicant must
submit a site plan showing the location of this loading dock and demonstrate that it
conforms with Section 3, Subdivision 6 of the City Code.

According to Section 8, Subdivision 2.1.8 there are eight conditions for the Planning
Commission to weigh when considering a conditional use permit to allow the operation
of a truck freight transfer service in the GI District. These conditions and staff findings
related to each are listed below.
1. Vehicle access points shall be located along roadways having sufficient capacity to
accommodate the traffic generated by the use and subject to the approval of the City
Engineer.
Finding: Access to the site comes from Lilac Drive. The 1997 Transportation Plan
designates Lilac Drive as a minor collector. This road should be capable of
accommodating the traffic from this site. However, the City Engineer should confirm
this finding.
2. A drainage system subject to the approval of the City Engineer shall be installed.
Finding: The applicant's survey shows a drainage and utility easement along the
site's south property line. The survey also indicates that only a small portion of the
parking and storage area will be surfaced with black top, while the balance will be
gravel. The City Engineer should review this survey and determine if this design is
capable of accommodating the site's drainage needs.
3. Storage areas are landscaped, screened from view of neighboring uses, abutting
residential zoning districts, and public rights -of -way in compliance with Section 3,
Subdivision 4.S.
Finding: According to the applicant's survey, there is an existing fence surrounding
the area designated for truck parking, loading and storage. However, it does not
indicate the type or height of this fence. According to Section 3, Subdivision 4.S,
this fence must be six feet high and provide a solid screen. Staff assumes that this
existing fence meets these standards
4. Each light standard base shall be landscaped.
Finding: According to the applicant's survey, the site contains no light standards.
5. Vehicle access points shall create a minimum of conflict with through traffic
movement and shall be subject to approval of the City Engineer.
Finding: This site has one access to Lilac Drive along its northern property line.
This access should provide adequate vehicle movement through the site.
6. All signing and informational or visual communication devices shall be in compliance
with the applicable provisions of Appendix C of the City Code.

Finding: Staff assumes that Stat Transportation will install new signage. All new
signs must comply with the City's Sign Ordinance and a separate permit is required.
7. Provisions shall be made to control and minimize noise, air and water pollution.
Finding: As with all commercial and industrial properties, this site will be required to
meet the performance standards for noise, air and water pollution.
8. All conditions pertaining to a specific site are subject to change when the Council,
upon investigation in relation to a formal request, finds that the general welfare or
public betterment can be served as well or better by modifying the conditions.
Finding: The City may review the conditions of this permit and require the applicant
to comply with any changes necessary to ensure the original intent of the permit as
well as the health, safety and general welfare of the community.
OPTIONS
1. Approval a conditional use permit to allow the operation of a truck freight transfer
service station on the property located at 416 Lilac Drive based on the findings
outlined in the May 3, 2001 planning report and subject to the conditions outlined by
staff.
2. Deny a conditional use permit to allow the operation of a truck freight transfer
service station on the property located at 416 Lilac Drive based on findings of fact
from the Planning Commission.
3. Table the application and request more information.
RECOMMENDATION
Staff recommends approval of a conditional use permit to allow the operation of a Truck
Freight Transfer Service Station on the property located at 416 Lilac Drive. This
recommendation is based on the findings contained in this report and subject to the
conditions listed below.
1. All drainage plans are subject to the review and approval of the City Engineer.
2. The site's perimeter fence must comply with the performance standards outlined
in Section 3, Subdivision 4.S.
3. All signage must comply with the City Sign Ordinance.
4. The applicant shall store all refuse materials inside the principal building or
provide a trash enclosure in conformance with the standards outline in Section 3,
Subdivision 4.G.c of the City Code.

5. Trucks will not be allowed to idle when not in use or between the hours of 6:00
p.m. and 6:00 a.m.

WHEREAS, the Planning Commission held a public hearing on this application on May
9, 2001 and recommended approval.
• WHEREAS, the City Council of the City of Lino Lakes makes following findings of fact,
as required by Section 2 Subd. 2.B.7 and by Section 8 Subd.2.I.8 of the zoning
ordinance:

a. This application will not be detrimental to or endanger the public health, safety,
comfort, convenience or general welfare of the neighborhood or the City.
b. This application will be harmonious with the general and applicable specific plans
and policies of the comprehensive plan of the City and this ordinance.
c. This application will be designed, constructed, operated, and maintained so as to
be harmonious and appropriate in appearance with the existing and /or intended
character of the general vicinity and will not change the essential character of
that area.
d. This application will be served adequately by essential public facilities and
services, including streets, police and fire protection, drainage structures, refuse
disposal, water and sewer systems, and schools; or will be served adequately by
such facilities and services provided by the persons or agencies responsible for
the establishment of the proposed use.
e. This application will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic
welfare of the community.
f. This application will not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any persons, property, or
the general welfare because of excessive production of traffic, noise, smoke,
fumes, glare, or odors.
g.
This application will have vehicular approaches to the property which are so
designed as not to create traffic congestion or an interference with traffic on
surrounding public thoroughfares.
h. This application will not result in the destruction, loss, or damage of a natural,
scenic or historic feature of major importance.
i. This application will conform to specific standards of this ordinance applicable to
the particular use.
Truck freight transfer stations are a conditionally permitted use provided that:
a. Vehicular access to this property will come from Lilac Drive. The 1997
Transportation Plan designates Lilac Drive as a minor collector; therefore, this
site will have sufficient capacity to accommodate the traffic generated by the use
b. The applicant's survey shows a drainage and utility easement along the site's
south property line. The survey also indicates that only a small portion of the
parking and storage area will be surfaced with black top, while the balance will be
gravel.
c. According to the applicant's survey, there is an existing fence surrounding the
area designated for truck parking, loading and storage to screen it from view of
neighboring uses, abutting residential zoning districts and public rights -of -way.
This fence must be maintained in conformance with the standards outlined in
Section 3, Subdivision 4.S.
d. According to the applicant's survey, the site contains no light standards, therefore
they do not need to be landscaped.
e. This site has one access to Lilac Drive along its northern property line. This
access will provide adequate vehicle movement through the site.
f. All signing and informational or visual communication devices shall be in
compliance with the applicable provisions of Appendix C of the City Code.
g. As with all commercial and industrial properties, this site will be required to meet
the performance standards for noise, air and water pollution.

h. The City may review the conditions of this permit and require the applicant to
comply with any changes necessary to ensure the original intent of the permit as
well as the health, safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED, that the Lino Lakes City Council hereby
approves a conditional use permit for a truck freight transfer station at 416 Lilac Drive,
as indicated on the attached site survey, dated received by the City on April 5, 2001.
BE IT ALSO RESOLVED that the following conditions apply:
1. All drainage plans are subject to the review and approval of the City Engineer.
2. The site's perimeter fence must comply with the performance standards outlined
in Section 3, Subdivision 4.S.
3. All signage must comply with the City Sign Ordinance.
The applicant shall store all refuse materials inside the principal building or
provide a trash enclosure in conformance with the standards outlined in Section
3, Subdivision 4.G.c.
5. Trucks will not be allowed to idle when not in use or between the hours of 6:00
• p.m. and 6:00 a.m.

6. All other conditions outlined by staff.

BACKGROUND
The applicant, Community National Bank, is requesting rezoning of the property located

District. The subject property is located directly north of the existing bank and the
rezoning will allow the bank to expand its existing parking lot. This report will address
only the rezoning. The applicant will also need to receive site plan approval prior to
construction of the parking lot.

ANALYSIS
According to Section 2, Subdivision 1 of the City Code, the Planning Commission and
City Council shall weigh five factors when considering a rezoning request. These
factors and staffs findings for each are outlined below.
1. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the City's official
Comprehensive Plan.
Finding: Rezoning this site from NB, Neighborhood Business District to GB,
General Business District is consistent with policies and provisions of the City's
Comprehensive Plan. However, these policies and provisions should also be
examined during the site plan review process. Examples of these policies
include:
a. The Proposed Land Use Map guides this area for commercial use.
b. Develop service and commercial centers as cohesive, highly interrelated
units with adequate off - street parking.

c. Blend commercial redevelopment which is of a similar size and scale with
existing businesses and which is supportable by available markets.
The proposed use is or will be compatible with present and future land uses of
the area.
Finding: The Existing Land Use Map indicates that the subject property is
bordered by a commercial use to the south, vacant and to the east (across Lake
Drive), and residential uses to the north and west. The Proposed Land Use Map
guides the surrounding properties for commercial use. Therefore, expansion of
the bank use on this site is consistent with the future land use plan for this area.
3. The proposed use conforms with all performance standards contained herein.
Finding: At this time, the applicant is only requesting a rezoning. That application
appears to meet the standards for rezoning outlined in the City Code. However,
prior to actual construction of the proposed parking lot, the applicant must
receive approval of a site plan in compliance with all applicable performance
standards and combine this lot with that of the existing bank.
4. The proposed use can be accommodated with existing public services and will
not overburden the City's service capacity.
Finding: Rezoning this site from NB, Neighborhood Business District to GB,
General Business District will not overburden the City's service capacity.
However, this finding is contingent on the applicant combining this property with
the bank site. Creating an independent General Business lot in this location
could have other issues.
Nevertheless, the planned development of an additional parking area on this site
may affect the capacity of City service. Prior to issuance of a building permit, the
applicant will be required to receive approval of a site plan. During this review,
staff will more closely examine this development's effect on City services.
5. Traffic generation by the proposed use is within capabilities of streets serving the
property.
Finding: Rezoning this site from NB, Neighborhood Business District to GB,
General Business District will not have an adverse effect on traffic at the site.
However, the actual design of the parking lot may have an effect on future traffic
flow. Staff will more thoroughly examine traffic issues during the site plan review
process.

BACKGROUND
Mr. Rocky Goertz has submitted an application for a preliminary plat for a single- family
development to be known as Spirit Hills. The site is located on the northeast corner of Highway
49 and Birch Street, between Rice Lake and Shenandoah Addition. The Planning and Zoning
Board reviewed an application that included single- family lots and townhouses at their April
meeting and tabled action based on the mixed use and other issues related to the design. The
applicant revised the preliminary plat to include all single - family homes for review by the
Planning and Zoning Board. The plat was modified again to address conditions regarding the
plat. This review is based on plans dated received May 24, 2001.
ANALYSIS

Land Use and Zoning: The current Land Use Plan designates the property as single family
residential. The City Council discussed the preliminary plat that included townhomes and
indicated that single- family homes would be more appropriate in this location. Outlot A is
intended to be neighborhood commercial at some time in the future. Rezoning of the outlot will
be considered at the time an appropriate site plan for commercial use is submitted.

Surrounding Land Uses:
The residents of 6509 Hokah Drive have submitted a request to require that a fence be installed
on the rear of their lot to provide screening. There is some existing vegetation that will remain
based on the proposed grading plan. Single- family homes will abut single- family homes along
most of the easterly boundary of the plat. There is short distance of road that runs adjacent to the
property line. Should Outlot A be rezoned and developed as commercial use they would be
required to provide appropriate landscaping and screening to buffer affected residents. The City
typically does not require buffering between single- family homes or residential streets.
Shoreland Management Overlay District: All areas within 1,000 feet of the ordinary high
water level (OHWL) are subject to the Shoreland Management Regulations. Nearly all of this
development falls within the Shoreland Overlay, as determined by the OHW of Rice Lake, a
Natural Environment Lake. Because there is public land between the proposed lots and the
OHW, none of the lots are considered abutting and thus, the regulations aren't as restrictive.
However, there is a 150 -foot setback requirement from the OHW for all structures. There is
adequate space to meet the setbacks and accommodate a reasonable house pad on the lots
adjacent to the OHW.
Greenway: The draft Comprehensive Plan identifies areas for greenways. The greenway areas
adjacent to this property are currently public land and thus are already protected. In addition, the
wetland areas will be encumbered by a drainage and utility easement.
Environmental Board Review: The Environmental Board reviewed the application and their
comments are attached.
Lot Size and Layout: All of the lot areas meet or exceed the standard of 10,800 square feet of
buildable area, the minimum lot depth and width requirements.
Outlot B is intended as a site for a sanitary sewer lift station. The area is not adequate. The City
Engineer has requested an area that is a minimum of 80' x 80'.

Transportation: There are two accesses proposed, both onto County roads. The location and
design of the intersections are under County jurisdiction. No written comments have been
received to date. County permits will be required.
Parks and Trails: This site is adjacent to the County Park. The Park Board recommended all
cash dedication for the development. The Planning and Zoning Board recommended that a small
tot — lot site be provided to serve the new plat and development to the east and that upland area
be dedicated for a trail. An area 0.26 acre in size has been set aside for park use. If the Council
determines that the dedication should be consistent with the Park Board recommendation then
staff recommends that the land area identified as park be absorbed into the adjacent lots. The
park area alone does not meet the dimensional standards for an R -1 lot.
There was historically a trail proposed by the County in the vicinity of this plan. However, that
trail has been eliminated from the County's plan and therefore, it was determined that no
connection is necessary through this area.
Wetlands: There are 8.84 acres of wetlands on the property. Some wetland fill is proposed to
accommodate road crossings. The wetland delineation and related plans are subject to the
review and permitting of Rice Creek Watershed District (RCWD), which oversees the Wetland
Conservation Act (WCA). They have reviewed the application and have issued a permit for the
development.
Recommendation:
The Planning and Zoning Board reviewed the application and they recommend approval subject
to the following conditions:
1. Lot 22, Block 1 shall be eliminated or revised to meet the 135' lot depth as measured in
the center of the lot. (Lot was revised)
2. An 80'x 80" area shall be provided for the lift station necessary to serve this site. (not
done)
3. All comments as listed in the May 1, 2001 memorandum from TKDA shall be addressed
to the satisfaction of the City Engineer prior to proceeding to final plat.
4. Park dedication in the area of Lot 30, value to be determined, and dedication of an upland
trail corridor around the lake that borders this property subject to approval by the City
Staff. (Lot 30 converted, no trail corridor)
5. Appropriate permits shall be acquired from Anoka County for access to the adjacent
roadways.
6. The developer shall address all provisions/conditions outlined by Rice Creek Watershed.
The Park Board reviewed the application and they recommend that the park dedication be cash
fees in lieu of land.
The Environmental Board reviewed this request and they recommend approval subject to several
comments and conditions as outlined in the attached tracking sheet.

We are writing this letter regarding the consequences the proposed Spirit Hills Development will have
on our property. The new Ware Road will be along the backside of our property. This will box our
property in between Hokah Drive and Ware Road. This is an unusual layout for a property to have a
road bordering the front and back yard. Also, because our house is the second one off Birch Street, it is
as though we will have streets on three sides.
We have a simple request to ask. We would like a fence built along the back of our property that would
provide screening from the additional traffic, noise, and possible businesses. We would like the fence
built soon after Ware Road is constructed. Our reason for requesting this now, is the P & Z Board made
it sound like the screening and buffering could wait for the business development. We don't think it
should wait that long.
The new Ware Road and potential businesses will have a negative impact on our quality of life. We can
foresee Ware Road becoming a bypass around the Hwy 49/Birch Street intersection. If the access to the
business center is from Ware Rd, the traffic problem will be compounded. Therefore we are requesting
a fence to help compensate for our loss of privacy, increase in traffic and noise, shining headlights, litter,
lower resale value, etc.

staff recommends that the land area identified as park be absorbed into the adjacent lots. The
park area alone does not meet the dimensional standards for an R -1 lot.
There was historically a trail proposed by the County in the vicinity of this plan. However, that
trail has been eliminated from the County's plan and therefore, it was determined that no
connection is necessary through this area.
Wetlands: There are 8.84 acres of wetlands on the property. Some wetland fill is proposed to
accommodate road crossings. The wetland delineation and related plans are subject to the
review and permitting of Rice Creek Watershed District (RCWD), which oversees the Wetland
Conservation Act (WCA). They have reviewed the application and have issued a permit for the
development.
Recommendation:
The Planning and Zoning Board reviewed the application and they recommend approval subject
to the following conditions:
1. Lot 22, Block 1 shall be eliminated or revised to meet the 135' lot depth as measured in
the center of the lot. (Lot was revised)
2. An 80'x 80" area shall be provided for the lift station necessary to serve this site. (not
done)
3. All comments as listed in the May 1, 2001 memorandum from TKDA shall be addressed
to the satisfaction of the City Engineer prior to proceeding to fmal plat.
4. Park dedication in the area of Lot 30, value to be determined, and dedication of an upland
trail corridor around the lake that borders this property subject to approval by the City

5. Appropriate permits shall be acquired from Anoka County for access to the adjacent

I have reviewed the revised preliminary plat and plans for Spirit Hills received on April 30,
2001. I have the following comments:
Plat
1. The plat provides an area of approximately 40 feet by 34 feet for the proposed lift station
site. The minimum area the City requires for a lift station is 80 feet by 80 feet.
2. The plat lists lot numbers only. The block numbers need to be added to the plat.
Grading Plan
1. The low opening elevations for Lots 12 and 13 on the east side of Sioux Lane
foot above the emergency overflow elevation.
2. The 902 contour on Lot 23 does not tie into the proper existing contour.
3. The 896 contour on Lot 16 intersects the 894 contour.
4. The 890 contour on both of the NURP basins intersects themselves.
5. There are several points along the east side of the property where the 894 and
contours overlap one another.
6. The southern NURP basin states the outlet is at an 891 elevation, but the note
states the outlet elevation is 890. Which one is correct?
7. Soil borings still need to be provided for the site.

1. In the HydroCAD model, all Times of Concentration were "Direct Entry ". Time of
Concentration computations still need to be submitted.
2. The 2- and 100 -year storm events were submitted. The City requires rate control for the
1 -, 10 -, and 100 -year storm events. Please submit the 1- and 10 -year events.
3. The City Surface Water Plan does not allow for dry basins. All basins must be designed
to wet NURP basin standards:
2.5" dead storage volume
4:1 side slopes max.
15 feet of 10:1 bench at normal water level
4 feet minimum depth on dead storage
3:1 length to width ratio
4. Storm sewer pipe sizes and slopes are needed on the plan sheets.
5. The storm sewer computations do not always match the plans. Please review and correct
• any discrepancies.
6. The minimum cover for catch basins and catch basin manholes is 4.0 feet from the rim to
the top of pipe, or 2.5 feet if draintile is installed. The location of the draintile as well as
the draintile detail must be included in the plans.
Miscellaneous
1. Copies of the final approvals from the Rice Creek Watershed District and the Anoka
County Highway Department will be needed for this project.

STAFF COMMENTS/ISSUES FOR CONSIDERATION:
• Good idea to ask for a conservation easement with signage in the area
directly east and west of the lake. Signage should be posted along
edge reminding "no mow /disturb" For this to work, there needs to be
covenants restricting use and providing for a management agency. A
minimum association fee should be set aside for management of this
area. A management plan should be developed. The management agency
should be the local environmental review board.
A Tree preservation plan has been submitted. A site visit and a bit
more detail may be needed.
• ..Shoreland Overlay district means that on a sewered lot, building
setback must be 150 feet from the ordinary high water level. This
needs to be verified.
• City Engineering has shown concern for the house pad elevations. Soil
may need to be imported to raise the pad elevations. Mr. Goerts has
indicated to me that they will need to fill only on two lots if a lift
pump can be installed near NE cul de sac
• .... The trail proposal through the planned greenway area (conservation
easement area) may have physical barriers at the area circled in red
on the enclosed GIS map. The county has indicated that they have
abandoned this idea.
• ...Infiltration areas are indicated on the North end, and a "Treed"
swale overflow on the south central side will be preserved.
COMPREHENSIVE PLAN REFERENCES:
ENVIRONMENTAL BOARD COMMENTS: The following is a summary of the comments
made by the March 28, 2001 Environmental Board:
Recommendations include all of the staff recommendations listed above in
project trac report to The Environmental Board on March 28th, and in
addition the Environmental Board made the following recommendations:
• Those cul de sacs proposed by the developer to be devoid of curbing
are allowed with surface water trained into retention swails along
side of the road.
• That the angle of the townhomes as positioned on the plan be opened up
if possible in the area between the water /tree swaile area on the
south side of the townhome area.
• That the Environmental Board advises that this is a High Ecological
Value Zone based on the City Environmental Inventory, and that wetland
should be buffered as much as possible.

Re: Spirit Hills Development
I want to respond to the Planning and Zoning's recommendations that were approved at
their May 9, 2001 meeting pertaining to parks and trails for the Spirit Hills Development.
"Dedicate Lot 30 as Park Land"
The Comprehensive Park Plan and Development Guide provides a framework for city staff
and the Park Board for the purpose of guiding future park development within Lino Lakes.
All aspects of future park development should be considered in a manner which is
consistent with the park system framework, development criteria, and general principles
defined in the Comprehensive Park Plan and Development Guide.
When reviewing a development such as Spirit Hills, potential park system components
must be justifiable within the context of the overall parks system. Neighborhood parks are
the basic unit of our park system and are typically 5 to 17 acres in size and serve residents
within a 1/4 to a 1/2 mile radius. In an ideal world, it would be great to have a neighborhood
park within a 1/4 mile of each and every home. However, reality dictates that when
planning the park system, numerous factors must be taken into account when determining
the number, size, and location of parks. This is exactly what the Comprehensive Park Plan
and Development Guide was created for. Additionally, the realities of limited resources for
the development and maintenance of our parks system also affects decisions related to
future park areas. Specifically with the Spirit Hills Development, acquiring a .28 acre parcel
of land will not provide a functional area for neighborhood residents to enjoy. It would not
be cost effective to maintain, especially when a large park area (Rice Lake Elementary) is
only a 1/2 mile away, connected by an off -road paved trail along the north side of Birch
Street.
The development of the parks system should be based on the principle of providing and
maintaining quality park areas. Scattering mini -parks in every residential development will
not result in a quality parks system.
June 5, 2001
The Comprehensive Park Plan and Development Guide proposes a 36 acre community
• park at the intersection of Birch Street and Hodgson Road. With the acquisition, in 1999, of
67 acres at Centerville Road and Birch Street for an athletic complex, this is no longer
practical. Since the
Spirit Hills Development is approximately 1/2 mile from Rice Lake Elementary School, it was
determined that an additional park area was not needed for this 50 home development.
The existing travel route is 8' wide paved trail separated from Birch Street. This should
alleviate safety concerns for children to walk or bike to Rice Lake Elementary. Rice Lake
Elementary has the typical amenities normally found in neighborhood parks including a
playground, basketball, baseball /softball fields, and open play area. The acquisition of a 1/4
acre lot in the Spirit Hills development to serve as a mini -park is not practical or efficient.
Mini -parks are primarily designed to address limited, isolated, or high- density areas such as
apartment complexes or housing for the elderly. The Comprehensive Park Plan and
Development Guide does not indicate any future mini - parks. However, should a
development such as an apartment complex or senior housing come before staff and the
Park Board, we would certainly consider a mini -park scenario.
"Securing Trail Easement Along Northwestern Edge of Development"
The Anoka County Regional Trail System Plan originally proposed a trail along the eastern
and southern areas of Rice Lake and continuing to Hodgson Road. I have included a map
• showing the original trail location. When the Spirit Hills Development came to my attention,
I contacted Anoka County regarding the status of the proposed trail. Anoka County
indicated that this trail was no longer in the Regional Trail Plan for two reasons. The most
significant reason was construction costs due to the extensive amount of wetlands that
needed to be traversed. It was determined that this particular trail segment was cost
prohibitive. Secondly, there was a safety concern related to the trail terminating at a non-
controlled intersection. This would require trail users to cross the middle of Highway 49,
travel north over the bridge, and continue westward on the regional trail. Expecting trail
users to cross Highway 49 isn't responsible, especially given the existing 50 mph speed
limit and the possible raised median when Highway 49 is reconstructed. Therefore, Anoka
County has relocated the regional trail to terminate at the existing trail system at Rice Lake
Elementary School. The regional trail would continue westward along Birch Street, and
proceed northward along Highway 49. This coincides with Anoka County's plan to place a
paved trail along the western side of Highway 49. It does not make economic or practical
sense to commit substantial resources to construct a trail that terminates at an unsafe
location, especially when a feasible alternate has been identified. For this reason, staff and
the Park Board felt it would not be practical for the city to construct the aforementioned trail
segment and subsequently contacted Mr. Goertz that a trail easement along the
northwestern edge of the development wasn't necessary.
"Securing Property for Trail Adjacent to Birch Street"
The Comprehensive Park Plan and Development Guide indicates a Class 11 level of trail
• along the north side of Birch Street. A Class 11 level trail is defined as a 8 - 10 feet wide
paved trail, separated from the roadway, and located within the existing road right -of -way.
Since an existing trail is located on the north side of Birch Street from Hokah Drive to Rice
Lake Elementary, the only issue relates to construction of a trail segment from Hokah Drive

to Highway 49. Since the area in the Spirit Hills Development adjacent to Birch Street
(Outlot A) is not being platted, it makes sense to wait for such time that Outlot A is
developed. The extension of the trail in front of Apitz Garage could also be addressed at
that time. Perhaps a portion of the cash dedication from this development could be used to
construct a trail along Birch Street from the proposed Sioux Lane to Hokah Drive.
An issue was raised at the Planning and Zoning meeting relating to the acquisition of land
for park purposes that exceeds the developer's obligation for Park Dedication. Per state
statutes, it is my understanding that the city cannot require the developer to dedicate land
in excess of the park dedication requirements without compensation. Mr. Goertz inquired
about the scenario that the .28 acres of land the Planning and Zoning Board wanted
dedicated to the City as "Park" was valued at $80,000 - $90,000, and his required Park
Dedication was approximately $50,000. It is my understanding that state statutes require
the City to reimburse developers for acquisition of park land in excess of the required Park
Dedication. We have not planned for and do not have $30,000 - $40,000 to reimburse Mr.
Goertz for the difference.
For the reasons stated, I concur with the Park Board's recommendation to the City Council
that the City receive 100% cash for the required Park Dedication for the Spirit Hills
Development.

Heritage Development has submitted an application for comprehensive plan amendment and
rezoning, and preliminary plat for a portion of an area included in their application for
preliminary plat. The property commonly known as the Saddle Club is located south and east of
Old Birch Street. The review is based on plans received by the City on April 6, 2001.

Land Use and Zoning: The northern 20 acres (approximately) is zoned R -1. The south 20
acres (approximately) is zoned rural. The application is to rezone the entire parcel to R -1.
Additionally, the applicant includes a comprehensive plan amendment to bring the entire
property into the MUSA. The existing comprehensive plan designates the northern portion of
the parcel for single - family residential development. The draft comprehensive plan designates
the entire site for low - density sewered residential development.
While the entire parcel is proposed to be platted, the wetland portion of the property is 15.34
acres so the area to be added to the MUSA does not have a net impact on the amount of land to
be serviced. Nonetheless, the MUSA line will have to be moved to include the southern portion

of the site in the MUSA. The amount of upland in the southern portion is about eight acres,
which would be the amount of MUSA reserve to be allocated to the site.
Surrounding Land Use:
Greenway: The draft Comprehensive Plan identifies areas for greenways. The intent of the
greenway designation is to protect environmentally sensitive areas. This will be accomplished
by platting the wetland areas as park. Additionally, staff recommends that wetland markers be
placed along the perimeter of the delineated wetlands to identify and protect the space.
Lot Sizes and Layout: The R -1 District minimum lot size is 10,800 square feet of upland. All
lots meet or exceed this provision with an average lot size of 18,005 upland.
The minimum lot width is 80 feet at the 30 -foot front yard setback. All lots except lot 6, Block 2
meets this requirement. The lot width should be met by moving the northerly lot line. Lot 5 is
required to be 100' and it is currently shown at 104'.
The minimum lot depth is 135 feet. All of the lots meet or exceed this provision.
Grading: Fill is proposed on the site to create the house pad areas and roadways. Much of the
site is proposed to remain undisturbed and will be encumbered by drainage and utility easement.
The grading plan is subject to the review and approval of the City Engineer.
Existing Structures: All existing structures shall be removed from the site.
Transportation: Access to the property is proposed from Old Birch Street. This requires right -
of -way acquisition from an adjacent parcel, which is in process and it is not anticipated to be an
issue. A roadway connection is also proposed to Killdeer Drive. This right -of -way acquisition
has been completed. There will be modifications to adjacent roadways based upon a feasibility
report completed in March.
Utilities: Water and sanitary sewer are both proposed to be looped through the property along
the proposed roadway alignments. A feasibility study has been completed and the results of the
study will be incorporated into the construction plans for the development.
Parks and Trails: There is a trail corridor proposed between Lots 18 Block 2 and Lot 1, Block
3 and the right -of -way on the northeast corner of the site provides access to the trail corridor
platted in the Oaks of Lino. While all of the wetland area is identified as park, only upland areas

The amount to be paid will be based upon the rates in effect at the time of fmal plat.
Wetlands: There are 15.34 acres of wetland on the property. Some fill is proposed to
accommodate roadway construction. The proposal is to mitigate the fill adjacent to other
wetland areas. The wetland delineation and proposed fill are subject to the review and
permitting of Rice Creek Watershed District, which oversees the Wetland Conservation Act
(WCA). It is the City staff's policy to require preliminary approval (tabled with approval for
administration action or TWAFAA) from Rice Creek before the City staff recommends approval
by the Planning and Zoning Board. This has been completed as of April 25, 2001.
Environmental Board: The Environmental Board reviewed the application and they
recommended that the tree preservation be better well defined, raised concern regarding 70
houses being platted and relationship to the total lots platted in the community, request to reduce
the lot areas in Block 2 so the area could be included in the greenway.
Tree Preservation: There are woods identified on the site and much of the tree area is being
preserved outside of the grading area.
Recommendation: The Planning and Zoning Board reviewed the application and they
recommend denial of the application in its entirety. The Board did not provide specific reasons
for their action although their discussion included concerns regarding availability of MUSA and
provisions for utility service in the area.

1. Lot 6, Block 2 shall be 80' in width
2. All Engineering issues as outlined in the memo dated May 1, 2001 shall be
addressed.
3. Park dedication shall be paid prior to recording the fmal plat.
4. Right -of -way acquisition shall be completed prior to recording the final plat.
5. Wetland Markers shall be installed along the perimeter of the delineated
wetlands.
By adoption of the attached resolutions and ordinance

LINO LAKES BY REZONING CERTAIN REAL ESTATE FROM R, RURAL TO
R -1, SINGLE FAMILY RESIDENTIAL
The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain:
Section 1. The City Council makes the following findings regarding the application
for rezoning the property described below, based on the factors listed in Section 2, Subd.
1.E. of the Lino Lakes zoning ordinance:
1. The proposed rezoning action has been considered in relation to the specific
policies and provisions of and has been found to be consistent with the official
City Comprehensive Plan, as the site is guided for residential uses.
2. The proposed use is or will be compatible with present and future land uses of the
area. The site is guided for single - family residential uses. Land in the area of
the site is already developed with single- family homes or designated for such use.
3. The proposed use conforms with all performance standards contained herein. The
accompanying plat proposal meets the zoning and platting requirements contained
in City ordinances. Single- family homes and public parks are permitted R -1 uses.
4. The proposed use can be accommodated with existing public services and will not
overburden the City's service capacity. Utilities can be extended to serve the
development and a feasibility study has been completed.
5. Traffic generation by the proposed use is within capabilities of streets serving the
property. The 46 new homes will not cause negative impacts on the existing
roads.
Section 2. A public hearing was held before the Planning & Zoning Board on March
14, 2001 and continued to May 8, 2001.
Section 3. The Zoning Ordinance of the City of Lino Lakes, Anoka County,
Minnesota, passed by the City Council on July 14, 1997 is hereby amended by rezoning
from R, Rural, to R -1, Single Family Residential, the following described real estate:

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN BY
ALLOCATING 8 ACRES OF MUSA RESERVE TO A PORTION OF THE
SADDLE CLUB PLAT
The City Council of the City of Lino Lakes, Anoka County, Minnesota does hereby
ordain:
Section 1. The City Council finds that the proposed project meets the City's Interim
MUSA Reserve Criteria as follows:
1. The request for MUSA is occurring concurrently with preliminary plat application.
2. The rezoning request is occurring concurrently with the MUSA request.
3. MUSA is adjacent to the site to the north and northeast.
4. The net acreage for the area to be included is 8 acres, and that is the MUSA request.
5. Roadways exist directly adjacent to the site.
6. The City has reviewed the proposal and there is no evidence of negative impacts to
the community health, welfare, or general safety.
7. The City has reviewed the proposal and there is no evidence of negative impacts to
the environment. The wetland plan was approved by the Rice Creek Watershed
District.
8. Utilities exist adjacent to the site.
9. The proposed development complies with the City's Infill Policy outlined by
Resolution No. 92 -85, because: allocation of MUSA reserve will put the site within
the MUSA; the development of the site has been analyzed for impacts on utility and
street system costs; the analysis determined that costs will be covered by assessments,
that operation and maintenance will not exceed normal costs, and there will be no
additional costs.
10. Existing roads are adequate to handle traffic from the 46 new proposed lots.
• Section 2. A public hearing was held before the Planning & Zoning Board on March
14, 2001 and May 8, 2001.

Section 3. Since the findings support the proposal, 8 acres of MUSA reserve shall be
allocated to the area included in the southern one half of the Saddle Club plat.

Club, and
WHEREAS, A public hearing was held before the Planning & Zoning Board on March
14, 2001 and continued to May 8, 2001 and
WHEREAS, Ordinance 10 -01 rezones the southern 20 acres of the property to R -1 Single
Family Residential, and
WHEREAS, Ordinance 09 -01 allocates 8 acres of MUSA reserve to the southern portion
of the proposed plat, and
• WHEREAS, the proposed preliminary plat meets the requirements of the City's zoning

BACKGROUND:
In 1995 the city purchased from Anoka County a .7 -acre property known as the
"Kaiser' property on the northeast corner of Birch Street and Hodgson Road. The
property has a small abandoned home and several outbuildings, and is zoned
General Business. The purchase price was $61,400.
The intent for the use of the property was to make it available for commercial
development. However, the county later concluded that it needed a significant
amount of the parcel for right of way for future widening of Hodgson Road.
The county board has approved purchasing the entire parcel back from the city at
the current market value of $88,400. The owner of Apitz Garage and the county will
subsequently negotiate an agreement for the remainder of the land for the
expansion of the Apitz facilities.
OPTIONS:
1. Approve the first reading of Ordinance No. 08 -01 offering the sale of property
to Anoka County
2. Return to staff for further consideration

AN ORDINANCE AUTHORIZING THE CONVEYANCE OF PROPERTY
TO ANOKA COUNTY
The City Council of Lino Lakes, Anoka County, Minnesota does ordain:
I.
The real property described as:
That part of the Northeast Quarter of the Southeast Quarter of Section 30, Township 31,
Range 22, Anoka County, Minnesota, described as follows:
Beginning at the intersection of the south line of said Northeast Quarter with the
centerline of State Highway No. 49 as now established; thence east along said south line
208 feet to a point 858.5 feet west from the southeast corner thereof; thence north at right
angles a distance of 220 feet; thence west and parallel with said south line of the Northeast
Quarter of the Southeast Quarter to said centerline of State Highway No. 49; thence
southeasterly along said centerline to the point of beginning. Except that part platted as
Anoka County Highway Right of Way Plat No. 11.
(the 'Property") is owned by the City of Lino Lakes (the "City "). The city council of the
City has determined that the Property is no longer needed by the City for any public
purpose.

The city council of the City authorizes conveyance of the Property directly to Anoka

Reconstruction.

BACKGROUND:
After discussions with the City of Centerville, a Joint Powers Agreement (JPA) for
21st Avenue was approved by the Lino Lakes City Council on August 10, 1998.
Minor changes to the JPA are proposed, as shown in italics on the attached
version. The changes effect item "a" on page 1; "1.b." on page 2; and "10" on
page 4. Exhibit A has also been revised to reflect the most recent Feasibility
Study. The City of Centerville will consider these changes at their June 13,
2001, meeting.
Staff has reviewed the changes and recommends approval.
OPTIONS:
1. Return to staff for further review.
2. Adopt Resolution No. 01 -80, Approve the revised Joint Powers Agreement for
the Reconstruction of 21st Avenue contingent upon the City of Centerville
approving the same agreement.

RESOLUTION APPROVING THE REVISED JOINT POWERS AGREEMENT WITH
THE CITY OF CENTERVILLE FOR THE RECONSTRUCTION OF 21ST AVENUE AND
TO AUTHORIZE THE MAYOR AND DEPUTY CITY CLERK TO SIGN THE
AGREEMENT.
WHEREAS, Minnesota Statutes, Section 471.59, authorizes political subdivisions to
enter into Joint Powers Agreements, and
WHEREAS, the City of Lino Lakes approved a Joint Powers Agreement with the City of
Centerville for the reconstruction of 21st Avenue on August 10, 1998, and,
WHEREAS, minor revisions are proposed to the agreement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. Hereby approves the Revised Joint Powers Agreement with the City of
Centerville for the 21st Avenue reconstruction and authorizes the Mayor and
Deputy City Clerk to sign the Agreement.

JOINT POWERS AGREEMENT
BETWEEN THE CITY OF LINO LAKES
AND THE CITY OF CENTERVILLE
REGARDING 21ST AVENUE ROADWAY,
PHASE I, IMPROVEMENTS AND
MAINTENANCE
THIS AGREEMENT, made and entered into on the day and year hereinafter set
forth by and between the City of Lino Lakes and the City of Centerville; both of which
are governmental subdivisions of the State of Minnesota located in the County of Anoka.
RECITALS
a. The City of Lino Lakes and the City of Centerville desire to improve 21st
Avenue by constructing street, curb and gutter and storm sewer from Main Street to the
south.
b. The City of Lino Lakes has prepared a feasibility study of the Project as
defined by this agreement.
c. A portion of the Project is to be constructed within the corporate limits of
the City of Lino Lakes and a portion is to be constructed within the corporate limits of the
City of Centerville. (Exhibit A).
d. Subject to the terms hereof, Lino Lakes is assuming full responsibility for
the design and construction of the Project to be built both within the corporate limits of
Lino Lakes and Centerville.
e. Lino Lakes and Centerville recognize and acknowledge that the Project
will benefit both Lino Lakes and Centerville.

f. Lino Lakes and Centerville will both assess the benefited properties within
their jurisdictions for all, or a portion of the relevant costs of the Project, all as is more
fully set forth below.
PURPOSE
The purpose of this Agreement is to set forth the terms of the agreement Lino
Lakes and Centerville have reached regarding the design and construction, maintenance
and financing of the Project both within the corporate limits of Lino Lakes and
Centerville, in accordance with Minnesota Statutes, Section 471.59.
AGREEMENT
NOW, THEREFORE, in consideration of the mutual undertakings herein
• expressed, Lino Lakes and Centerville agree as follows:

1. Lino Lakes is responsible for the design and construction of both the
portion of the Project located within Lino Lakes and the portion of the Project located
within Centerville. Therefore, the parties agree that:
a. Lino Lakes shall design the Project, administer the construction and
conduct inspections of the construction process. Centerville shall have the right to
inspect, review and comment upon construction of the Project. Centerville shall have the
right to review and approve the final plans and specifications prior to advertisement for
bids.
b. For purposes of performing its obligations under this Agreement,
Centerville hereby grants to Lino Lakes the rights to use the streets, public ways, and
easements of Centerville for purposes of constructing the Project, including any
excavations necessary to perform work incidental to the performance of this agreement;

and Centerville hereby agrees, through its departmental agencies, to cooperate to the
fullest extent in the protection of any excavations or barricades that may be necessary for
the work performed by Lino Lakes.
c. Lino Lakes agrees to notify and coordinate with businesses in Lots 7, 8
and 9 of the Centerville Industrial Park (along the existing gravel segment of 21st
Avenue) as early as practical the construction schedule of the Project.
2. Construction costs and design engineering shall be divided proportionally,
50% to Lino Lakes and 50% to Centerville, for the Project. Legal, administrative and
construction engineering costs shall be paid separately by each City.
3. Each city has the right to terminate Agreement prior to award of
construction contract.
4. Each municipality shall be solely responsibly for their share of the costs of
the Project. Each municipality shall be responsible for the sale of bonds, if any, and levy
of special assessments against properties within their cities boundaries.
5. City of Lino Lakes shall receive, from the City of Centerville, monthly
payments, as certain portions of the construction are completed. The Project amounts are
then due and payable for work completed. Upon completion of the entire Project, the
City of Lino Lakes shall prepare a final cost statement and submit it to the City of
Centerville. Payment of the statement shall be completed within 45 days upon receipt of
the statement.
6. Before this Agreement shall become binding and effective it shall be
approved by an appropriate resolution of the City Council of Lino Lakes and of the City
Council of Centerville, which shall be attached hereto as Exhibits B and C, respectively.

7. The City of Lino Lakes shall maintain 215` Avenue by performing annual
street sweeping, crack sealing and pothole filling. The City of Centerville shall maintain
21st Avenue by plowing snow and winter sanding /de- icing.
8. The City of Lino Lakes and the City of Centerville will sealcoat the
roadway on a 5 -7 year interval by separate cost share agreement.
9. Other projects, such as reconstruction and overlays, shall be completed by
separate agreement between the City of Lino Lakes and the City of
Centerville.
10. The City of Lino Lakes shall maintain the storm sewer consisting of
performing periodic inspections of the conveyance system/pond and by
taking any necessary corrective action, all by a separate cost share
agreement.

Resolution No. 01 -81, Order the Improvement and Preparation of
Plans and Specifications — 2001 21st Avenue Street and Storm
Sewer.

BACKGROUND:
At the May 28, 2001, City Council meeting, a hearing was held on the proposed
installation of roadway and storm sewer improvements on 21st Avenue and a
portion of Northern Lights Boulevard.
In accordance with Minnesota State Statutes 429, the next step is to order the
improvement and preparation of construction documents.
OPTIONS:
1. Return to staff for further review.
2. Adopt Resolution No. 01 -81, Order the Improvement and Preparation of
Plans and Specifications for the 2001 21st Avenue Street and Storm Sewer
Improvement.
RECOMMENDATION:
Option No. 2 - Staff recommends that Resolution No. 01 -81 be adopted.

IMPROVEMENT
WHEREAS, a resolution of the City Council adopted the 23rd day of April, 2001, fixed a
date for a council hearing on the proposed improvement of 21st Avenue and Northern
Lights Boulevard by constructing roadways, storm sewer, and ponding.
WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was
given, and the hearing was held earlier this evening, at which time all persons desiring
to be heard were given an opportunity to be heard thereon,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. The improvement is hereby ordered.
2. The City Engineer, John Powell, is hereby designated as the engineer for this
improvement. The engineer shall prepare plans and specifications for the making of
such improvement.
