License and Cabaret License for August Festival,
Saint Joseph Catholic Church
VOTE REQUIRED: Simple Majority (3/5 Vote)
BACKGROUND:
Saint Joseph Catholic Church is hosting its annual August Festival on Friday, August 11th
and Saturday, August 12th, 2001. As part of its celebration, beverages, including 3.2
beer, will be served. The State of Minnesota requires that a separate 3.2 license be issued
for such an event.
As in the past, the Parish will hold a dance on Saturday evening, August 11th . Each year
a cabaret license is required for this event . The Church has confirmed security will be
managed as in previous years.
The Parish has made application to the City of Lino Lakes to acquire a cabaret license
and a 3.2 beer permit, has submitted a certificate of insurance for the dates of the event
and paid the proper fees. Please note there have been no reported problems with the
festival in the past.
OPTIONS:
1. Adopt a motion to approve 3.2 beer license and cabaret license.
2. Deny approval of 3.2 beer license and cabaret license.

Consider Request for an Exemption from Lawful
Gambling License, St. Joseph Catholic Church

BACKGROUND:
Non - profit organizations are allowed under the State Gambling Statutes to apply for an
exemption from lawful gambling license if they conduct fewer than five (5) gambling
occasions per year. St. Joseph Catholic Church usually conducts four (4) gambling
occasions each year, this being their second gambling occasion for the year 2001.
OPTIONS:
1. This item is under the Consent Agenda. If the Council feels that this request is
acceptable, the item would be part of the motion to approve the Consent Agenda.
2. If council feels this request needs further information, the item should be taken off

Electrical Inspection Services through
Suburban Inspections

The City of Lino Lakes and Suburban Inspections have completed
the necessary paperwork for a renewal of electrical inspection
services. The contract renews effective July 1, 2001. The new
contract agreement is a two year contract for the period of July
1, 2001 to July 1, 2003. The contract includes a change in
insurance coverage.

ELECTRICAL INSPECTION SERVICES AGREEMENT
BETWEEN THE CITY OF LINO LAKES AND SUBURBAN INSPECTIONS
This Contract is made and entered into between the City of Lino Lakes, 600 Town Center
Parkway, Lino Lakes, Minnesota, 55014, hereinafter "City" and K. L. Peterson, Inc.,
d/b /a Suburban Inspections, 17833 Xylite Street NE, Ham Lake, Minnesota 55304,
hereinafter "Contractor ".
WHEREAS, the City requires services to be provided for electrical inspections;
and
WHEREAS, the Contractor desires to, and is capable of, providing the necessary
services according to the terms and conditions stated herein;
NOW, THEREFORE, in consideration of mutual promises and agreements
contained herein, the parties agree as follows:
111 1. TERM
•
1.1 Term. The term of this Contract shall run from 7 -1 -01 to and
including 7 -1 -03, unless earlier terminated by law or according to
the provisions herein.
2. CONTRACTOR'S OBLIGATIONS
2.1 General Description. The Contractor shall provide the following
services generally described as:
A. Provide qualified personnel to perform electrical
inspections within two work days of notification by the
electrical installer.
B. Enforce the Minnesota Electrical Act and Rules as adopted
and amended by the City.
C. Submit a report of completed inspections, invoice for
completed electrical inspections with the completed permits
on the first and the third Mondays of each month.

D. Cooperate with the City Building Official, to resolve non-
complying or incomplete electrical installations when
installer fails to comply with acceptable standards.
E. Notify the electrical utility for connection or re- connection
of all electrical services installed, replaced or repaired for
which an electrical permit is required.
F. Provide forms and documents needed for normal office use
for 1% of the inspection fees invoiced up to a maximum of
$200.00 per year.
3. CITY'S OBLIGATIONS
3.1 General Description. The City shall:
A. Receive and process electrical permits and fees in
accordance with a fee schedule.
B. Forward the white copy of the permits to Contractor, retain
the pink copy of the permit, and file same in
alpha/numerical order by address until the completed white
copy is returned with the report of the completed
inspections and permits.
C. Receive and process orders for payment and fees collected
for fee shortages and extra or special inspections.
D. Adopt an ordinance to provide for an electrical inspection
of all installations requiring inspection within the City.
E. Keep on file with the State Board of Electricity copies of
the current inspection ordinance.
F. Adopt the most recent revision of the Minnesota Electrical
Act including M.S. 326.01.
G. Adopt the Minnesota Rules Chapter 3800.
H. Notify electrical utilities servicing the City that all services
installed, replaced or repaired for which an electrical permit
is required must be approved by the Contractor.
4. PAYMENT
4.1 Compensation. The City shall pay to Contractor for the purchased
services 80% of the permit fees collected for permits on the report
for completed inspections.
4.2 Invoices. Contractor shall, within fifteen (15) working days
following the last day of each calendar month in which the services
were provided, submit an invoice and request for payment on an
invoice form acceptable to the City.
The invoices shall itemize all of the permit fees collected for
completed inspections, 1.) the name of the contractor receiving the
inspection and 2.) the dates of performance covered by the invoice.
4.3 Time of Payment. The City shall make payment to the Contractor
within thirty -five (35) days from the date on which the invoice was
received. If the invoice in incorrect, or otherwise improper, the
City will notify the Contractor within ten (10) days of receiving the
incorrect invoice. Upon receiving the correct invoice from the
Contractor, the City will make payment within thirty -five (35)
days.
4.4 Payment for Unauthorized Claims. The City may refuse to pay
any claim which is not specifically authorized by the Contract.
Payment of the claim shall not preclude the City from questioning
the propriety of the claim. The City reserves the right to offset any
overpayment or disallowance of claim by reducing future
payments.
5. COMPLIANCE WITH LAWS /STANDARDS
5.1 General. Contractor shall abide by all Federal, State and local
laws, statutes, ordinances, rules and regulations now in effect or
hereinafter adopted pertaining to this Contract.
5.2 Licenses. Contractor shall procure, at its own expense, all licenses,
permits or other rights required for the provision of services
contemplated by this Contract. Contractor shall inform the City of
any changes in the above within five (5) days of occurrence.
5.3 Minnesota Law to Govern. This Contract shall be governed and
construed in accordance with the substantive and procedural laws
of the State of Minnesota, without giving effect to the principles of
conflict of laws. All proceedings related to this Contract shall be
venued in the State of Minnesota.

6. INDEPENDENT CONTRACTOR STATUS
Contractors is an independent contractor and nothing herein contained
shall be construed to create the relationship of employer and employee
between City and Contractor. Contractor shall at all times be free to
exercise initiative, judgment and discretion as to how to best perform or
provide services. Contractor acknowledges and agrees that Contractor is
not entitled to receive any of the benefits received by City employees and
is not eligible for workers' or unemployment compensation benefits.
Contractor also acknowledges and agrees that no withholding or deduction
for State or Federal income taxes, FICA, FUTA, or otherwise, will be
made from the payments due Contractor and that it is Contractor's sole
obligation to comply with the applicable provisions of all Federal and
State tax laws.
7. INDEMNIFICATION
Any and all claims that arise or may arise on behalf of the Contractor, its
agents, servants or employees as a consequence of any act or omission on
the part of Contractor or its agents, servants, employees while engaged in
the performance of the Contract shall in no way be the obligation or
responsibility of the City. Contractor shall indemnify, hold harmless and
defend the City, its officers and employees against any and all liability,
loss, costs, damages, expenses, claims and actions, including attorneys'
fees which the City, its officers or employees may hereafter sustain, incur
or be required to pay, arising out of or by reason of any negligent or
willful act or omission of Contractor, its agents, servants, or employees, in
the execution, performance, or failure to adequately perform Contractor's
obligations pursuant to this Contract.
8. INSURANCE
8.1 General Terms. In order to protect itself and to protect the City
under the indemnity provisions set forth above, Contractor shall, at
Contractor's expense, procure and maintain policies of insurance
covering the term of this Contract, as set forth below. Such
policies of insurance shall apply to the extent of, but not as a
limitation upon or in satisfaction of, the indemnity provisions
herein. All retentions and deductibles under such policies of
insurance shall be paid by Contractor. Each such policy of
insurance shall contain a clause providing that such policy shall not
be canceled by the issuing company without at least ten (10) days
written notice to the City of intent to cancel.
8.2 Coverage. The policies of insurance to be obtained by Contractor
41 pursuant to this section shall be purchased from a licensed carrier

rated at a level of A- VII or better, by Best's Rating, and shall
• include the following:

A) General Liability
A single or combined limit, occurrence -based comprehensive
general liability insurance policy which shall include a broad form
comprehensive liability endorsement and a contractual
endorsement, which shall include the following coverages at a
minimum:
Bodily Injury/Death: 300,000 per person
1,000,000 per occurrence
Property Damage 300,000 per person
1,000,000 per occurrence
City Of Lino Lakes will be endorsed as additional named insured
on the General Liability.
B) Automobile Liability
A single or combined automobile liability insurance policy for all
owned, non -owned and hired vehicles, if any, used in the provision
of services under this contract, which shall include the following
coverages at a minimum:
Bodily Injury/Death: 300,000 per person
1,000,000 per occurrence
Property Damage 300,000 per person
1,000,000 per occurrence
C) Professional Liability
(1) A professional liability insurance policy covering
personnel of Contractor, if any, who provide professional
services under this Contract, which shall include the
following coverages at a minimum:
Personal Injury/Death: 300,000 per person
1,000,000 per occurrence
D) Workers' Compensation
If applicable, Contractor shall procure and maintain a policy that at
• least meets the statutory minimum.

8.3 Certificates. Prior to or concurrent with execution of this
Contract, Contractor shall file copies with the City which shall be
incorporated into this Contract as Exhibit A.
8.4 Failure to Provide Proof of Insurance. The City may withhold
payments or immediately terminate this Contract for failure of
Contractor to furnish proof of insurance coverage or to comply
with the insurance requirements as stated above.
8.5 Nonwaiver. Nothing in this Contract shall constitute a waiver by
the City of any statutory limits or exceptions on liability.
9. SUBCONTRACTING
The Contractor shall not enter into any subcontract for the performance of
the services contemplated under this Contract nor assign any interest in
this Contract without prior written consent of the City and subject to such
conditions and provisions as are deemed necessary.
10. TERMINATION
10.1 With or Without Cause. This Contract may be terminated with or
without cause, by either party upon thirty (30) days written notice.
10.2 Notice of Termination. Notice of Termination shall be made by
certified mail or personal delivery to the authorized agent of the
party. Notice of Termination is deemed effective upon delivery to
the address of the party as stated in paragraph 12.
11. CONTRACT RIGHTS/REMEDIES
11.1 Rights Cumulative. All remedies available to either party under
the terms of this Contract or by law are cumulative and may be
exercised concurrently or separately, and the exercise of any one
remedy shall not be deemed an election of such remedy to the
exclusion of other remedies.
11.2 Waiver. Waiver for any default shall not be deemed to be a waiver
of any subsequent default. Waiver of breach of any provision of
this Contract shall not be construed to be modification for the
terms of this Contract unless stated to be such in writing and
signed by authorized representative of the City and Contractor.

12. AUTHORIZED REPRESENTATIVE
Notification required to be provided pursuant to this Contract shall
be provided to the following named persons and addresses unless
otherwise stated in this Contract, or in a modification of this
Contract.

Any alterations, variations, modifications or waivers of the provisions of
this Contract shall only be valid when they have been reduced to writing,
and signed by authorized representatives of the City and Contractor.
14. SEVERABILITY
The provisions of this Contract shall be deemed severable. If any part of
this Contract is rendered void, invalid, or unenforceable, such rendering
shall not affect the validity and enforceability of the remainder of this
Contract unless the part or parts which are void, invalid or otherwise
unenforceable shall substantially impair the value of the entire Contract
with respect to either party.
15. MERGER
15.1 Final Agreement. This Contract is the final expression of the
agreement of the parties and the complete and exclusive statement
of the terms agreed upon, and shall supersede all prior
negotiations, understandings or agreements. There are not
representations, warranties, or stipulations, either oral or written,
not herein contained.
16. AUDIT OF RECORDS
The books, records, documents and accounting procedures and practices
of the Contractor relevant to the Contract are subject to examination by the
City representatives and either the legislative auditor or the state auditor as
appropriate pursuant to Minn. Stat. § 16B.06, Subd. 4 (1990).

Consideration of Updating Electrical
Permit Fees through Suburban Inspections

Since the inception of a contract between the City of Lino Lakes
and Suburban Inspections on January 1, 1997, electrical permit
fees have remained fixed. Staff is requesting City Council to
approve an increase in electrical permit fees as outlined in the
attachment.

Maximum fee for single family dwelling not over 200 amp is $110.00 plus $.50

inspection only. Minimum fee for work requiring a Rough -in inspection is $50.00
plus $.50 State surcharge.
Re- inspection or Additional Inspections - $25.00

BACKGROUND
Mr. Glenn Valentine of Ventura Homes has applied for a variance from the required
setback from a collector road. The site lies between I -35E and 20th Ave. (Co. Rd. 54).
Most of the site is wetland. Only a small portion of the site is upland: the area along 20th
Ave. Variances from required road setbacks will be needed if a house and driveway are
to be built. Some wetland fill will be required.
This report is based on the certificate of survey by E. G. Rud & Sons, Inc. dated 5/23/01.
ANALYSIS
Structure Setback From Road: In the R -X Rural Executive zoning district, the
City's zoning ordinance requires a 40' building setback from a collector road such as 20th
Ave. This site has only a small area of upland. Some wetland fill will be required if a
house is to be built. The greater the road setback, the more wetland fill will occur. The
request is to allow the structure to be 10 feet from the right of way of 20th Ave.
Driveway Setback From Intersection: The driveway must be at least 30 feet from
the intersection, measured from the corner of the property (Sec. 3 Subd. 5.C.8.f of the
zoning ordinance). However, this would require additional wetland fill for the driveway.
Therefore, a variance is needed for this as well. The driveway as shown on the submitted
survey is 10 feet from the intersection.
Future Right of Way: Anoka County has informed us that it foresees the need for
an additional five feet of right of way on each side of the road. If this occurs, the garage
and driveway will be only five feet from the ROW. While this is an undesirable
situation, it is a trade -off between being closer to the road and filling more wetland. The
City cannot simply prevent the property owner from using the land.

• Wetland: The site is located within the jurisdiction of the Vadnais Lake Area
Watershed Management Organization (VLAWMO). Because of the wetland impact, a
review by VLAWMO is pending. The location of the house will determine the amount of
wetland fill needed. The plan shows just under 1000 sf of fill, as noted on the attached
VLAWMO notice. Increasing the road setbacks will increase the wetland fill.

The VLAWMO board meets June 14 at 7:30 am. (the morning after the P & Z meeting).
The VLAWMO staff recommendation is to approve the plan.
Alternate Site for Septic System: Any new house on well and septic must have an
alternate drainfield site designated. This is to ensure that a new drainfield can be
constructed if the first one fails. The survey shows two drainfield sites.
Findings for Variance
In considering all requests for variance and in taking subsequent action, the City shall
make a finding of fact:
1. That the property in question cannot be put to a reasonable use if used under
conditions allowed by the official controls.
2. That the plight of the landowners is due to physical circumstances unique to his
property not created by the land owner.
3. That the hardship is not due to economic considerations alone and when a reasonable
use for the property exists under the terms of the ordinance.
4. That granting the variance requested will not confer on the applicant any special
privilege that would be denied by this ordinance to other lands, structures, or
buildings in the same district.
5. That the proposed actions will be -in keeping with the spirit and intent of the
ordinance.
This site is severely restricted because of the wetlands. Without variances from setback
requirements, the property cannot be used. The physical circumstance is not created by
the landowner. The hardship is not due to economic considerations. No special privelege
is being granted. This type of hardship is the reason for variances.

BACKGROUND
The application is to remove a portion of land from one parcel and attach it to the
adjacent parcel. That is, the action will move the lot line ten feet. The existing property
line follows the 1/4 t/4 section line. The application is to move that property line ten feet to
the east. The reason is to increase the size of the western parcel to make it a full 20 acres.
The applicant has a buyer for the parcel (Parcel B) who wants a full 20 acres.
In addition, the action would combine into the eastern parcel a narrow strip of land along
I -35E which currently is a separate tax parcel. All of the land involved is under the same
ownership.
Access Driveway: Currently, a private driveway easement runs along the northern
edge of the existing western parcel and part of the eastern parcel. The proposed minor
subdivision would replace the existing driveway easement with a 66' access easement.
This will ensure that Parcel A will continue to have access to 20th Ave.
Both the existing driveway easement and the proposed access easement are private
easements, not City roads. If the applicant intends the new easement to be a future public
roadway, that would have to be analyzed in the future. The City has no plans for a road
in that location and there is no intent to convey a road to the City at this time. The new
easement does not obligate the City in any way.
Though the City's subdivision regulations require all lots to have full frontage on a public
street, the existing eastern parcel does not have frontage now. The proposed minor
subdivision will not alter this situation, it simply increases the size of the driveway access
easement. Any future subdivisions that create new lots will be required to have the full
frontage on a public street.
Long -Term Land Use: The area is guided for long -term rural use on both the
existing and the draft new land use map. The City has no plan to extend utilities to this

area. Any platting would have to be at a maximum density of one lot per 10 acres. (No
plat approval is being requested.)
The application involves a very minor change in parcel sizes and poses no concern for
public health, safety, or welfare. Staff recommends approval.
This report is based on the document "Proposed Minor Subdivision for Brian Iverson ",
by Passe Engineering, Inc., dated 4/30/01 and received by the City May 2, 2001. (We
received the 11" x 17" reduction on May 17.)
PLANNING & ZONING BOARD ACTION
The P & Z considered the application at the June 13 meeting. The potential buyer of the
property, Mr. Bill Walton, addressed the P & Z. Mr. Walton did not want the 66 -foot
easement. The P & Z recommends adding a condition of approval that the 66 -foot
easement not be included.
As explained in this report, Mr. Iverson is the owner of all the property. From the City's
perspective, if a landowner wants to record an access easement over his own property, it
is not a City concern. The City's interests are not affected either way, and there is no
City obligation involved. Staff's recommendation is to approve the subdivision as
submitted.

Revised Building Design and Site Plan Condition of
Approval

BACKGROUND
The City Council approved a minor subdivision and site and building plan for North
American Composites on November 13, 2000. One of the conditions of approval was:
4. The precast concrete panels will be Fabcon Wide Rack 3/8" grooves at 3" O.C.
with smooth concrete cattail design, or similar design. Decorative concrete block
on the office portion of the building shall be either smooth burnished concrete
block or rock -face block.
This originated in a request by the Planning & Zoning Board to revisit the building
elevation along the freeway. Because this is a very visible location, the P & Z asked for
some additional attention to aesthetics. In response, the applicant then submitted a
revised south elevation that includes a custom "cattail" pattern in the concrete panels.
Though the P & Z did not see the new pattern, the revision was included in the project
review by the City Council and was specified in the condition of approval listed above.
North American Composites has asked that this condition be deleted because of the cost
of the custom design. Instead, they have submitted a design that includes a four -foot blue
stripe across the top of the precast concrete panels. The panels have a raked finish, just
like the original submittal.
In addition, the design of the building has been revised somewhat. The office portion
exterior will still be decorative concrete block. However, the standing seam metal roof
on both portions of the building has been changed in the new design. Instead, the new
proposed design has a flat roof for the warehouse portion. The office portion also has a
flat roof, but the east elevation incorporates a peaked facade.
• The footprint of the new design increases the footprint by about 500 sf, about a 2%
change. Staff considers this a relatively minor change.

Because the cattail design was a condition of approval, it will require action by the City
Council to change it.
Staff recommends approving the new building design and revising the condition of
approval to delete the sentence regarding the cattail design. Condition number four
would thus read:

the building shall be decorative concrete rock -face block as indicated on the
exterior elevations by Stiglich Construction, Inc., dated 5/1/01
PLANNING & ZONING BOARD ACTION
Staff discussed the request with the City Council at the June 6 work session. Council
directed staff to bring the request to the P & Z for a recommendation. The P & Z
recommended approval of the request.

BACKGROUND
The City Council approved the first reading of Ordinance 11 -01 on June 11, 2001. As a
reminder, the application is to rezone an existing lot to provide for the expansion of the
parking lot for the Community National Bank. The lot currently is zoned Neighborhood
Business, which does not allow banks. Rezoning the site to General Business will match
the existing bank lot zoning.
If the City Council approves the second reading, the ordinance will be published in the
newspaper the first week of July. The rezoning will be effective 30 days after
publication, as required by the City Charter.

AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
LINO LAKES BY REZONING CERTAIN REAL ESTATE FROM NB,
NEIGHBORHOOD BUSINESS DISTRICT TO GB, GENERAL BUSINESS
DISTRICT.
The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain:
Section 1. The City Council makes the following findings regarding the application
for rezoning the property described below, based on the factors listed in Section 2, Subd.
1.E. of the Lino Lakes zoning ordinance:
1. Rezoning this site from NB, Neighborhood Business District to GB, General
Business District is consistent with policies and provisions of the City's
Comprehensive Plan. However, these policies and provisions should also be
examined during the site plan review process. Examples of these policies include:
a. The Proposed Land Use Map guides this area for commercial use.
b. Develop service and commercial centers as cohesive, highly interrelated
units with adequate off - street parking.
c. Blend commercial redevelopment which is of a similar size and scale with
existing businesses and which is supportable by available markets.
2. The Existing Land Use Map indicates that the subject property is bordered by a
commercial use to the south, vacant land to the east (across Lake Drive), and
residential uses to the north and west. The Proposed Land Use Map guides the
surrounding properties for commercial use. Therefore, expansion of the bank use
on this site is consistent with the future land use plan for this area.
3. This application meets the standards for rezoning outlined in the City Code.
However, prior to actual construction of the proposed parking lot, the applicant
must receive approval of a site plan in compliance with all applicable
performance standards and combine this lot with that of the existing bank.
4. Rezoning this site from NB, Neighborhood Business District to GB, General
Business District will not overburden the City's service capacity. This finding is
contingent on the applicant combining the subject property with the bank site.
5. Rezoning this site from NB, Neighborhood Business District to GB, General
Business District will not have an adverse effect on traffic at the site. However,
the actual design of the parking lot may have an effect on future traffic flow.

Heritage Development has submitted an application for comprehensive plan amendment and
rezoning, and preliminary plat for a portion of an area included in their application for
preliminary plat. The property commonly known as the Saddle Club is located south and east of
Old Birch Street. The review is based on plans received by the City on April 6, 2001.

Land Use and Zoning: The northern 20 acres (approximately) is zoned R -1. The south 20
acres (approximately) is zoned rural. The application is to rezone the entire parcel to R -1.
Additionally, the applicant includes a comprehensive plan amendment to bring the entire
property into the MUSA. The existing comprehensive plan designates the northern portion of
the parcel for single - family residential development. The draft comprehensive plan designates
the entire site for low- density sewered residential development.
While the entire parcel is proposed to be platted, the wetland portion of the property is 15.34
acres so the area to be added to the MUSA does not have a net impact on the amount of land to
be serviced. Nonetheless, the MUSA line will have to be moved to include the southern portion
• of the site in the MUSA. The amount of upland in the southern portion is about eight acres,
which would be the amount of MUSA reserve to be allocated to the site.
Surrounding Land Use:
Greenway: The draft Comprehensive Plan identifies areas for greenways. The intent of the
greenway designation is to protect environmentally sensitive areas. This will be accomplished
by platting the wetland areas as park. Additionally, staff recommends that wetland markers be
placed along the perimeter of the delineated wetlands to identify and protect the space.
Lot Sizes and Layout: The R -1 District minimum lot size is 10,800 square feet of upland. All
lots meet or exceed this provision with an average lot size of 18,005 upland.
The minimum lot width is 80 feet at the 30 -foot front yard setback. All lots except lot 6, Block 2
meets this requirement. The lot width should be met by moving the northerly lot line. Lot 5 is
required to be 100' and it is currently shown at 104'.
The minimum lot depth is 135 feet. All of the lots meet or exceed this provision.
Grading: Fill is proposed on the site to create the house pad areas and roadways. Much of the
site is proposed to remain undisturbed and will be encumbered by drainage and utility easement.
The grading plan is subject to the review and approval of the City Engineer.
Existing Structures: All existing structures shall be removed from the site.
Transportation: Access to the property is proposed from Old Birch Street. This requires right -
of -way acquisition from an adjacent parcel, which is in process and it is not anticipated to be an
issue. A roadway connection is also proposed to Killdeer Drive. This right -of -way acquisition
has been completed. There will be modifications to adjacent roadways based upon a feasibility
report completed in March.
Utilities: Water and sanitary sewer are both proposed to be looped through the property along
the proposed roadway alignments. A feasibility study has been completed and the results of the
study will be incorporated into the construction plans for the development.
Parks and Trails: There is a trail corridor proposed between Lots 18 Block 2 and Lot 1, Block
3 and the right -of -way do the northeast corner of the site provides access to the trail corridor
platted in the Oaks of Lino. While all of the wetland area is identified as park, only upland areas

Lot Sizes and Layout: The R -1 District minimum lot size is 10,800 square feet of upland. All
lots meet or exceed this provision with an average lot size of 18,005 upland.
The minimum lot width is 80 feet at the 30 -foot front yard setback. All lots except lot 6, Block 2
meets this requirement. The lot width should be met by moving the northerly lot line. Lot 5 is
required to be 100' and it is currently shown at 104'.
The minimum lot depth is 135 feet. All of the lots meet or exceed this provision.
Grading: Fill is proposed on the site to create the house pad areas and roadways. Much of the
site is proposed to remain undisturbed and will be encumbered by drainage and utility easement.
The grading plan is subject to the review and approval of the City Engineer.
Existing Structures: All existing structures shall be removed from the site.
Transportation: Access to the property is proposed from Old Birch Street. This requires right -
of -way acquisition from an adjacent parcel, which is in process and it is not anticipated to be an
issue. A roadway connection is also proposed to Killdeer Drive. This right -of -way acquisition
has been completed. There will be modifications to adjacent roadways based upon a feasibility
report completed in March.
Utilities: Water and sanitary sewer are both proposed to be looped through the property along
the proposed roadway alignments. A feasibility study has been completed and the results of the
study will be incorporated into the construction plans for the development.
Parks and Trails: There is a trail corridor proposed between Lots 18 Block 2 and Lot 1, Block
3 and the right -of -way do the northeast corner of the site provides access to the trail corridor
platted in the Oaks of Lino. While all of the wetland area is identified as park, only upland areas

will be accepted for park dedication. The balance of the dedication will be cash in lieu of land.
The amount to be paid will be based upon the rates in effect at the time of final plat.
Wetlands: There are 15.34 acres of wetland on the property. Some fill is proposed to
accommodate roadway construction. The proposal is to mitigate the fill adjacent to other
wetland areas. The wetland delineation and proposed fill are subject to the review and
permitting of Rice Creek Watershed District, which oversees the Wetland Conservation Act
(WCA). It is the City staffs policy to require preliminary approval (tabled with approval for
administration action or TWAFAA) from Rice Creek before the City staff recommends approval
by the Planning and Zoning Board. This has been completed as of April 25, 2001.
Environmental Board: The Environmental Board reviewed the application and they
recommended that the tree preservation be better well defined, raised concern regarding 70
houses being platted and relationship to the total lots platted in the community, request to reduce
the lot areas in Block 2 so the area could be included in the greenway.
Tree Preservation: There are woods identified on the site and much of the tree area is being
preserved outside of the grading area.
Recommendation: The Planning and Zoning Board reviewed the application and they
recommend denial of the application in its entirety. The Board did not provide specific reasons
for their action although their discussion included concerns regarding availability of MUSA and
provisions for utility service in the area.
Staff has outlined two options for Council consideration.
Options:
A. Approve the comprehensive plan amendment, rezoning, and preliminary plat with
the following conditions:
1. Lot 6, Block 2 shall be 80' in width
2. All Engineering issues as outlined in the memo dated May 1, 2001 shall be
addressed.
3. Park dedication shall be paid prior to recording the final plat.
4. Right -of -way acquisition shall be completed prior to recording the fmal plat.
5. Wetland Markers shall be installed along the perimeter of the delineated
wetlands.
By adoption of the attached resolutions and ordinance

B. Deny the application based on findings related to the rezoning criteria outlined below:

property. The 46 new homes will not cause negative impacts on the existing
roads.

4. The net acreage for the area to be included is 8 acres, and that is the MUSA request.
5. Roadways exist directly adjacent to the site.
6. The City has reviewed the proposal and there is no evidence of negative impacts to
the community health, welfare, or general safety.
7. The City has reviewed the proposal and there is no evidence of negative impacts to
the environment. The wetland plan was approved by the Rice Creek Watershed
District.
8. Utilities exist adjacent to the site.
9. The proposed development complies with the City's Infill Policy outlined by
Resolution No. 92 -85, because: allocation of MUSA reserve will put the site within
the MUSA; the development of the site has been analyzed for impacts on utility and
street system costs; the analysis determined that costs will be covered by assessments,
that operation and maintenance will not exceed normal costs, and there will be no
additional costs.
10. Existing roads ar'e adequate to handle traffic from the 46 new proposed lots.

TOPIC: Resolution No. 01 -86, Ordering Preparation of a Study for the Lino
Lakes Marketplace Improvements.
VOTE REQUIRED: Simple Majority
BACKGROUND:
At the May 14, 2001, City Council meeting, a study was ordered to evaluate the
construction of public improvements to serve the proposed Target/Kohl's/ Ryan
site. This retail development site is also known as the Lino Lakes Marketplace.
The petition requested the following improvements:
1. Traffic signal at Lake Drive /Apollo Drive.
2. Construction of roadway, storm sewer, sanitary sewer, and water
from the Lake Drive /Apollo Drive intersection to 745 feet east.
The report will be received by the City Council at the meeting Monday evening.
Staff is requesting that Council receive the report and call a hearing on the
improvement. The hearing is scheduled for July 23, 2001, at which time a
detailed review of the feasibility report will be presented.
In accordance with Minnesota State Statutes 429, the feasibility report is to be
received by council and a public hearing scheduled.
OPTIONS:
1. Return to staff for further review.
2. Adopt Resolution No. 01 -86, Receive the Feasibility Study and CaII Hearing
for the Lino Lakes Marketplace Improvements.
RECOMMENDATION:
Option No. 2 - Staff recommends that Resolution No. 01 -86 be adopted.

RESOLUTION NO. 01 -86
RESOLUTION RECEIVING REPORT AND CALLING PUBLIC HEARING —
LINO LAKES MARKETPLACE IMPROVEMENTS.
WHEREAS, pursuant to a resolution of the Council adopted May 14, 2001, a report has
been prepared by the City Engineer with reference to the improvement of Apollo Drive,
from Lake Drive to the east, by constructing sanitary sewer, watermain, storm sewer,
and streets, and this report was received by the City Council on June 25, 2001, and,
WHEREAS, the report provides information regarding whether the proposed project is
necessary, cost - effective, and feasible,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. The Council will consider the improvement of such sanitary sewer in accordance
with the report and the assessment of abutting property for a portion of the cost of
the improvement pursuant to Minnesota Statutes, Chapter 429.
2. A public hearing shall be held on such improvement on the 23rd day of July, 2001, in
the council chambers of the city hall at 6:30 p.m. and the clerk shall give mailed and
published notice of such hearing and improvement as required by law.

BACKGROUND:
RMF Entities, Ltd and Duffy Development are interested in entering into an
exclusive development contract with the City of Lino Lakes to develop Phase I of
the Village. This phase comprises approximately 7.5 acres of city -owned land in
the Village. The development team is interested in developing a mixed -use area
consisting of retail, office and senior apartments.
Staff has been working through a number of city and developer responsibilities
that would be required to enter into an exclusive development arrangement. This
letter of intent will be the basis for completing a development agreement.
The key elements that would be included in a development agreement include:
• An agreement to work cooperatively with other entities to finalize an
integrated development plan
• Granting exclusive development rights for a period of time subject to
reasonable extensions if delays are out of the developers' control
• Completion by the developer of market research, project budgets, concept
plans and financing.
• Completion by the city of public improvements feasibility, inclusion of the
Village plan into the Comprehensive Plan, resolution of the second access
into the site, finalization of plans with the YMCA
• Cooperative efforts to find a win /win resolution to finalizing site assembly
• Inclusion of design standards for Village development
• Cost sharing of preliminary sketches for Village marketing purposes.
• Responsibilities for public versus private consulting services.
This letter is not a final or binding contract, it is a combined effort of staff and the
developers to narrow down the steps required to move forward with a
development agreement. However, staff is recommending that the council take
action on this letter of intent to demonstrate that the city is willing to pursue this

Re: Lino Lakes Village Phase I retail and senior housing development
Dear Ross, Jeff and John,
On behalf of the City of Lino Lakes, I am pleased to respond to your letter regarding an
exclusive development contract and right to purchase from the city the land for Phase I of
the Lino Lakes Village project.
It is our understanding that RMF Entities, Ltd. and Duffy Development Company will
work in collaboration with the city to create the mixed use commercial/retail and senior
apartment project on ± 7.5 acres of city -owned land in The Village, as depicted in the
concept plan developed by Studioworks.
The purpose of this is to complete a letter of intent that outlines city and developer
responsibilities, with an accompanying timetable, by June 19 to bring to the city council.
Staff will recommend exclusive development rights for Phase I to the development team
for one year. We are aware that unresolved obstacles remain, and exclusive development
rights will be subject to reasonable extensions to allow for completed negotiations and
schedule for construction of the YMCA, approval of a secondary access into the Village,
and costs of improvements for Phase I and II. Both the city and the development team
will agree to reasonable benchmarks (see attached draft schedule) that keep the project
moving forward. This schedule includes entering into a mutually beneficial and exclusive
development agreement by August 2001.
Developer responsibilities within the development agreement will include, but not be
• limited to:

• Cooperation with the city, the Minnesota Department of Transportation (MnDOT)
and the YMCA to finalize an integrated development plan.
• Completion of market research.
• Completion of project budget that will establish the market value of the development
including the land to be acquired from the city.
• Preliminary concept plan and drawings based on your current market research, and
using the design guidelines
• Pre - leasing agreements within an established timeframe
• Evidence of financing capabilities
• Developer establishment of a Town Center Association for ownership and
management of the respective projects.
• Cooperation and assistance in future funding for the project with the Metropolitan
Council and other agencies.
City responsibilities will include:
• Analysis of civil engineering, design, and construction of the Phase I enhancements
including roads, curb and gutter, water mains, storm and sanitary mains, sidewalks,
street lights, public signage and landscaping, etc., outside of the proposed right of
way. Assessable costs will either be reflected in the price of the land or assessed back
to the developers. The developers will have the option to construct the public
improvements (road and utilities) or to have the city construct the improvements and
assess them back to the property.
• Inclusion of the Village plan in the city's Comprehensive Plan.
• Completion of negotiations with MnDOT for the proposed second access to the site.
• Completion of negotiations with the YMCA regarding its site and building plan.
Reasonable parking for the project will be required as part of YMCA site and
building plan approval.
• Providing the developers with all pertinent information it has available regarding the
city -owned site, including marketable title to the land, boundary survey,
environmental assessment, topography and tree inventory.
• Pursuing other potential financial incentive options, including tax abatement, tax
increment financing and Livable Communities funding.
In addition, as part of the development agreement the city and the development team will
work in cooperation for final site assembly on the remaining city owned property and the
Tagg property. This will entail either developer lead in acquisition of the Tagg property
with city assistance, or the city lead in acquisition with a developer take -out.
The development agreement will include design and development guidelines as a means
to ensure that this and future development in the Village is consistent with the concept
plan. The city and the development team will continue to review the revised guidelines
until all parties are satisfied with their inclusion into a development agreement. Staff will
recommend the city council cooperate to any extent that is reasonable within the
guidelines to provide your team the opportunity to develop a mixed -use town center.

The city and the development team will agree to a 50/50 cost sharing, not to exceed
$2,000, for preliminary sketches or computer models of the commercial area and senior
housing in Phase I in order to provide a visual resource for discussions with the city
council, the YMCA and potential users.
We expect there will be a gap between the city's price of the land, plus assessments, and
what is financially feasible for the completion of the Phase I project. The Livable
Communities grant funding of $450,000 in the Phase I project will be incorporated into a
final development agreement for the construction of improvements or land write down.
Any further need for public assistance will be at the discretion of the city council.
This development of public improvements and the sale of public land will require several
independent consulting studies, including an independent appraiser, a feasibility report
regarding the cost of infrastructure and site improvements to the project, etc. It is
expected the city will pay for the public improvements feasibility study and the
developers will pay for their costs for similar consultants for the private development.
All agreements with the development team of RMF Entities and Duffy Development are
subject to the approval of the Lino Lakes City Council.
This letter should not be considered a binding contract, but the guidelines for completion
of a development agreement. We look forward to developing a series of action items and
a timetable that will enable this exciting project to move forward.
