The application is complete, the related fees have been paid, including investigation fees, and insurance information has been provided to the City as required. The Lino Lakes Police Depaitiuent has conducted a background investigation relative to this application as required and found no information on the principal applicants which would give a specific reason for denial of the application. As you may know, on -sale licenses granted by municipalities are regulated under Minnesota State Statute 340A. For many years, M.S.A. 340A.413 provided restrictions on the number of on -sale licenses which cities may issue. While this provision is still in place, the omnibus liquor bill of the 2003 legislative session added section M.S.A. 340A.404, which exempted certain establishments from the limitations. These exempted establishments include hotels, restaurants, and a few other limited groups. A copy of these portions of the two statutes is attached, as well as a short House Research memo on this topic. The effect of the new provision which exempts certain establishments all but does away with on -sale liquor icense limitations for municipalities. Mansetti's Pizza qualifies as a "restaurant" under the statutory definition. The owners hope to complete inspections and be open for business in approximately three weeks. The applicant will be in attendance at the Council meeting Monday evening to answer any questions the Council may have. In accordance with the City Code Section 701, Liquor Licensing, this business requires City approval to grant wine and beer licenses, and this business qualifies for issuance of these licenses. The applicant is fully aware license approval is subject to all the provisions and conditions of the laws of the city, state and of the federal government. OPTIONS: 1. "Theater" means a building containing an auditorium in which live dramatic, musical, dance, or literary performances are regularly presented to holders of tickets for those performances. • Wednesday, Feb 04, 2004 02:51 PM HOUSE RESEARCH • • • Short Subjects John Williams June 2003 The 2:00 a.m. On -Sale Closing Hour and Other Liquor Law Changes The legislature in 2003 made some of the most far - reaching changes in liquor kw since Sunday liquor was legalized more than 30 years ago, including allowing on -sale of alcoholic beverages until 2:00 a.m. On -sale closing The 2003 omnibus liquor bill moves back from 1:00 a.m. to 2:00 a.m. the hour hours at which on -sale of intoxicating liquor and 3.2 beer must cease. ( "On- sale" is sale for consumption on the premises only.) The same change is made for the hour at which establishments with "consumption and display" permits (bottle clubs or set -ups) must stop consumption on the premises. The effective date of the change is July 1, 2003. Local authority to set other hours The 1:00 a.m. hour had been in effect since the 1940s. Although the hour set in law is often referred to as the "closing hour," state law does not require establishments to close their doors at that hour but only to stop selling alcohol. A requirement to actually close may be included in local ordinances. The bill made no changes in the hours for off -sale establishments (package stores). Under present law, cities and counties may set more restrictive hours for alcoholic beverages than state law allows. So local governments have the right to retain the 1:00 a.m. closing hour for establishments within their jurisdiction. Cities cannot allow any on -sale of alcohol later than 2:00 a.m. A city that has already adopted an ordinance that sets a 1:00 a.m. closing time will retain that closing time unless it decides to repeal or amend its ordinance. A city that enacts a 1:00 a.m. ordinance before July 1 will prevent the new closing time from taking effect within its jurisdiction. A city could still adopt such an ordinance after July 1, but it would mean rolling back the closing hour from 2:00 a.m. to 1:00 a.m. Any local action to set on -sale hours that differ from state law must apply equally to intoxicating liquor and 3.2 beer. Permits Local license limits Brewpubs selling at off -sale In order to continue on -sales until 2:00 a.m., a licensed establishment must obtain a permit from the state Department of Public Safety. The permit is in addition to the establishment's on -sale license issued by the city or county. The permit is valid for a year. The fee for on -sale retailers of intoxicating liquor is based on the establishment's gross receipts from alcohol sales in the previous year: ■ Up to $100,000 in gross receipts, $200 ■ Over $100,000 but not over $500,000 in gross receipts, $500 ■ Over $500,000 in gross receipts, $600 For intoxicating liquor establishments that have been in business less than a year, 3.2 beer licensees, and consumption and display permit holders, the fee is $200. The legislature enacted the permit requirement in order to raise money to partly offset the cost of additional troopers for the State Patrol. A study by the Revenue Department will determine if the new hours generate at least $3.85 million annually in new state tax revenue. If the study shows that they do, the permit requirement will be repealed beginning July 1, 2005. For many years state law has limited the number of on -sale intoxicating liquor licenses that cities could issue. First -class cities (Minneapolis, St. Paul, and Duluth), for instance, were allowed to issue one license for every 1,500 persons up to a maximum of 200. Cities wanting to issue more licenses than state law allowed had to come to the legislature for authorization. The 2003 omnibus liquor bill exempted on -sale licenses to restaurants and hotels from these limits. Since almost all licenses for which legislative approval had been sought in past years fall into one of these categories, the result is to all but end the practice of seeking additional licenses from the legislature. Special liquor laws to allow licenses to establishments that couldn't be licensed under general law for other reasons are likely to continue. The omnibus liquor bill also allowed "bewpubs" (restaurants that brew beer on the premises) to sell their products in bottles for consumption off the premises. Sales can only be made in 64 -ounce bottles known as "growlers" that must be sealed on the premises. Brewpubs can sell no more than half their annual maximum output of 3,500 barrels at off-sale, up to a maximum of 500 barrels. Their off -sale hours would be the same as for package stores. The majority of this group is made up of the city's senior management team, and no employees in this group are compensated for overtime. Staff is recommending that these employees receive the same 2004 annual adjustment currently being negotiated by the city's four unions: 2 %. In addition, staff is recommending market adjustments to salaries for positions that are below the average for similar size metro area cities (population 10,000 — 25,000): Public Safety Director, 2.65 %; and Public Works Superintendent, 2.9% Community Development Director, 1.17 %, Director of Administration 0.53 %, Office Manager in Public Safety 3.66% and City Clerk 0.94 %. None of these positions received a market adjustment in 2003. This amount keeps us within budget. This approach to salary implementation is the approach we have taken for several years, and is the approach are taking as we continue to negotiate our four union contracts. Non -union employees traditionally receive the same health care benefits as unionized employees. The "Legacy at Woods Edge" project is a mixed use development, located in the southeast quadrant of I -35W and Lake Drive (County State Aid Highway 23). The project includes upto approximately 350,000 square feet of retail, service and office uses and 450 multi - family residential units. Also incorporated into the site development is the YMCA. The project, as proposed, required the preparation of an Environmental Assessment Worksheet (EAW). The City retained the services of Short, Elliott, Hendrickson, Inc., (SEH) to prepare the EAW. The City Council authorized distribution of the EAW on November 10, 2003. The required 30 day public comment period ended on the December 24, 2003. Comments were received from the Minnesota Department of Transportation (Mn /DOT), Anoka County Department of Parks and Recreation, Metropolitan Council, Anoka County Highway Department, Army Corps of Engineers, the Minnesota Pollution Control Agency (MPCA) and the Minnesota Department of Natural Resources (Mn /DNR). Agency comments and the City's responses are included in the attached Record of Decision prepared by the City's Consultant Short, Elliott, Hendrickson, Inc. After the public comment period, it is the City's responsibility to decide if it has enough information to determine if the project will cause significant environmental effects. If it will not cause such effects, the City makes a "negative declaration" meaning that an Environmental Impact Statement (EIS) is not necessary. If the review process reveals, in the judgement of the City, that the project will cause significant environmental effects, the City makes a "positive declaration" meaning an EIS is necessary. As setforth in the Record of Decision, adequate information has been presented to determine that the proposed project will not cause significant environmental effects and therefore an Environmental Impact Statement (EIS) is not necessary. The City's Environmental Board reviewed the draft Record of Decision on January 21, 2004 and recommended approval with the addition of a sentence to the Construction • Impacts section related to minimizing impacts to residences along Marshan Lane. Their comments have been incorporated into the final document. Representatives from Short, Elliott, Hendrickson, Inc. will be available at the council meeting to address comments. February 9, 2004 • • Legacy at Wood's Edge Record of Decision City of Lino Lakes February 2004 FINDINGS OF FACT ADMINISTRATIVE BACKGROUND The City of Lino Lakes is the responsible governmental unit (RGU) for this project. An Environmental Assessment Worksheet (EAW) has been prepared for this project as prescribed by environmental review requirements. Lino Lakes prepared the EAW. The EAW was filed with the Minnesota Environmental Quality Board (MEQB) and circulated for review and comments to the required EAW distribution list. A Notice of Availability was published in the EQB Monitor on November 24, 2003. The thirty -day comment period closed on December 24, 2003. Written comments received from agencies and citizens are summarized and responded to in this report in the section "EAW Comments and Responses ". PROJECT DESCRIPTION The proposed project consists of mixed -use development on approximately 65 -acres of land in Lino Lakes, Minnesota. The development will include 348,292 square feet of commercial /office, 450 multi - family residential units, and 38,000 square feet of civic uses (YMCA facility). The proposed site plan incorporates the above square footages and number of residential units into a series of buildings that have been located to minimize disruption to existing natural features such as wetlands and mature trees, as well as to maximize visibility and create a quality mixed -use development. The mixed -use development will inspire an energetic neighborhood and will provide a number of living, working, and service opportunities within the project area. The project includes an internal street network that provides access to the retail /office, residential, and civic buildings. Town Center Parkway, which currently provides access to the Lino Lakes City Hall, will serve as a collector street and will provide access to Lake Drive (Anoka County State Aid Highway (CSAH) 23) at the southwest corner of the site. The proposed local roadways will also provide corridors for public water, sanitary sewer, and other utilities necessary to serve the development. The clustering of structures has been employed in the proposed development for the purpose of preserving and enhancing sensitive land features on the site and for providing parkland and open space. The proposed plan has the added benefit of avoiding wetland impacts on the site and of minimizing impacts to a grove of mature • Legacy at Wood's Edge Record of Decision City of Lino Lakes February 2004 trees located along the eastern edge of the site. A proposed storm water treatment system will provide an efficient infiltration and retention system for storm water runoff from the site. Storm water ponds, vegetative grass filter strips, and infiltration cells will be utilized to retain and treat runoff from the site. These features will also provide aesthetic value and green space to the visually attractive integrated neighborhood. Initial site grading and construction of the Legacy at Wood's Edge Development is anticipated to begin in 2004. Full development of the site is expected to be complete in 2 to 3 years. Criteria for Determining the Significance of Environmental Effect Minnesota Rule 4410.170, subp.7 specifies the following criteria to be used in deciding whether a project has the potential for significant environmental effects. An Environmental Impact Statement (EIS) is not considered necessary for this project based on the criteria listed below. 1. Type, Extent, and Reversibility of Environmental Effects The EAW and this Findings of Fact summarize the type and extent of impacts to the surrounding environment. Alternatives to avoid potential impacts on the environment were considered and evaluated during the development of the site plan and prior to the preparation of the EAW. The proposed site plan also includes design features to mitigate potential social, economic, and environmental impacts. The following is a summary of the major findings of the EAW regarding potential social, economic, and environmental impacts as a result of the proposed mixed -use development project. Compatibility with Local Plans The project is consistent with local and regional plans, which includes the following: • City of Lino Lakes Comprehensive Plan o Land Use Plan o Sanitary Sewer Plan o Transportation Plan o Surface Water Management Plan • City of Lino Lakes Subdivision and Platting Ordinance • City of Lino Lakes Shoreland and Floodplain Ordinances • Village Development Master Plan, 1997 • Lino Lakes Town Center Design & Development Guide • City of Lino Lakes Handbook for Environmental Planning and Conservation Development • Rice Creek Watershed District Watershed Management Program Legacy at Wood's Edge Record of Decision City of Lino Lakes February 2004 The City's Comprehensive Plan guides the project area for mixed use development and includes the Master Plan for this site, developed in 1997. The City's Comprehensive Plan specifically states the following: "The southeast quadrant of the I -35W /Lake Drive interchange represents the Lino Lakes Village area. The Village is intended to integrate a mixture of commercial, medium and high density residential and public land uses in an attractive and cohesive design." The City's Zoning Ordinance provides for mixed -use development through the use of the Planned Unit Development process. Additionally, the Village Master Plan included design guidelines that are being implemented as part of the proposed development. Wildlife and Vegetation Impacts A search of the Minnesota Department of Natural Resources (DNR) Natural Heritage Database for rare plant and animal species or other significant natural features known to occur within an approximate one -mile radius of the proposed project was conducted. The results of the database search show four known occurrences of rare species or animal aggregation sites in the search area. A Bald Eagle nesting site has been documented east of the project site within the Wargo Nature Center, which is approximately 34-mile east of the proposed development. No Construction is proposed within close proximity of the nest. The Lino Lakes Town Center Natural Resource Inventory Report was completed in 1999. Additional biological field investigations were conducted on July 9, 2003, to determine if any occurrences of rare plant species are present on the site. The results of the biological field survey conclude that there were no rare plant populations encountered and that the proposed development will not directly impact any rare plant species. Erosion and Sedimentation The preliminary grading estimates have been refined since the publication of the EAW. Current estimates indicate that approximately 69,000 cubic yards of material will be cut and approximately 150,000 cubic yards of fill material will be required resulting in a net difference of approximately 81,000 cubic yards of fill being required for the proposed project. All erosion /sediment control measures and BMP's described in the EAW remain the same and will be further documented in the NPDES Phase II permit for the project. Wetland Impacts The proposed site plan has incorporated avoidance measures to ensure no wetland impacts or alterations of any wetlands will occur as a result of the Legacy at Wood's Edge Development. Legacy at Wood's Edge Record of Decision City of Lino Lakes February 2004 Water Related Land Use (Shoreland and Floodplain Impacts) The southern and eastern portions of the site are located within the designated shoreland zoning districts for Marshan Lake and George Watch Lake. The City has adopted a shoreland and a floodplain ordinance that regulates development within these designated areas. Furthermore, the DNR has approved these ordinances. The proposed Legacy at Wood's Edge Development will fully comply with the standards of these ordinances. The proposed project does not lie within a delineated 100 -year floodplain. Water Quality Impacts A surface water management plan for the development is being proposed that will retain storm water runoff on -site for the purpose of improving water quality and incorporate infiltration to reduce surface discharge and promote recharge of the groundwater. To comply with City and Rice Creek Watershed District requirements, the surface water management plan has addressed rate control by utilizing proposed ponds and existing wetlands for live storage. The development proposes to construct a drainage system within all the street improvements and parking areas to convey runoff to proposed ponding areas and infiltration cells (green space or ' underground storage chambers). Subsurface chamber technology takes advantage of the soil's inherent filtration and renovation capabilities to store and treat storm water runoff while providing the flexibility to plan for additional buildings and green space. To maximize pollutant removal efficiencies, the water quality control structures will be designed and constructed according to NURP, the National Pollutant Discharge Elimination Systems (NPDES) Phase II permit, the City of Lino Lakes, and Rice Creek Watershed District standards. Based on a water quality analysis, the proposed development will maintain adequate area for the retention (ponds) and infiltration (natural and underground chambers) of surface water runoff. Before construction can proceed, both the City of Lino Lakes and Rice Creek Watershed District must issue permits to satisfy surface water management regulations. The project will eliminate two existing infiltration basins along the north side of Town Center Parkway. These basins will be replaced elsewhere on the site. A National Pollutant Discharge Elimination System (NPDES) Phase II permit will be required for this project. Erosion prevention and sediment control best management practices (BMP's) will be used in accordance with the NPDES Phase II permit. An erosion control plan will be developed for the site and will likely include temporary and permanent erosion control measures such as timely revegetation of disturbed areas, hay bales, silt fencing, flotation silt curtains, and sedimentation ponds. • • Legacy at Wood's Edge Record of Decision City of Lino Lakes February 2004 Hazardous Waste A Phase I Environmental Site Assessment was completed for the site in May 2003. The assessment revealed the following environmental conditions in connection with the site: • Two above - ground storage tanks, likely holding petroleum products, are currently located and in use along the north end of the site; • An area of cars and miscellaneous vehicles are located on the northeastern portion of the site; and • The northern portion of the site has been used as a sandblasting facility for approximately 25 years. The aboveground storage tanks will be removed as part of the development and remedial action will be taken if necessary. Further evaluation of the soils in the vicinity of the aboveground storage tanks and the vehicle storage area will be conducted to determine if any petroleum releases have occurred or whether past land uses may have adversely impacted the soils on the site. The proposed commercial and residential developments are not expected to have petroleum or oil storage tanks. The land uses associated with the commercial development are expected to be retail and /or restaurant types of uses. Traffic AM and PM Peak Hour trip generation rates were developed for the proposed development as well as the existing facilities (City Hall complex, Fairview Clinic, and Lino Lakes State Bank). Trips to /from each building were assigned to the street system within the development. This provided a tabulation of traffic volumes at various locations within the development, as well as at the intersection of Town Center Parkway and Lake Drive. According to this analysis, the Peak Hour traffic volume is 1,155 trips, which occurs from 4:30 -5:30 pm. Based on the traffic analysis, a concept transportation improvement plan was developed for the Town Center Parkway and Lake Drive intersection. On Town Center Parkway, the plan includes three outbound lanes to separate left turn, through, and right turning traffic and also includes two inbound travel lanes. Signalization of this intersection would also be necessary to maintain acceptable levels of service and provided a controlled pedestrian crossing. According to the 2020 Traffic Volume Forecast in the Lino Lakes Transportation Plan, traffic volumes on Lake Drive are anticipated to increase to over 17,000 trips per day. Regardless of the proposed development, improvements to Lake Drive are expected in the future. However, to accommodate the full development of the Legacy at Wood's Edge Development, several additional improvements to Lake Drive are being proposed. The concept transportation plan has proposed Legacy at Wood's Edge Record of Decision City of Lino Lakes February 2004 the construction of two southbound left turn lanes between the intersection of Town Center Parkway and the I -35W bridge. Furthermore, traffic signals at Town Center Parkway and both ramps to I -35W are anticipated. To signalize the south ramp intersection, the existing off ramp and on ramp intersections, which are now separated, need to be aligned to a single intersection, which would require the reconstruction of approximately 400 -feet of the northbound on ramp. Ultimately, the capacity on Lake Drive past the Town Center Parkway intersection will need to be expanded. This will require additional lanes on Lake Drive and the reconstruction of the I -35W bridge. Turn lanes will be necessary at the interchange ramps to accommodate future traffic as well as full build -out traffic from the Legacy at Wood's Edge Development. In the interim, between the reconstruction of the bridge over I -35W and the development of portions or all of the proposed development, an intermediate intersection needs to be developed that has been described above. The traffic volumes for the year 2020 along with full build -out of the proposed development, have been used in a traffic simulation model. Results of the traffic simulation as it relates to the regional transportation system have been shared and discussed with Mn /DOT and the Anoka County Highway Department. This information will also be shared with the Met Council. • Construction Impacts • Temporary construction related impacts such as dust, odors, and noise have been considered. There are a relatively small number of residences located immediately south of the site that could experience temporary impacts resulting from construction activities. However, considerable effort will be made to minimize impacts on these residences. Dust is likely to be generated by equipment during times of construction. Dust generation will be minimized by enforcing best management practices, which may include: 1) minimizing the periods and extent of areas being exposed or graded; 2) watering construction areas and haul roads during periods of high winds or high levels of construction activity; 3) minimizing the use of vehicles on unpaved surfaces; and 4) covering and /or spraying material piles and truck loads. Temporary odors may be generated by exhaust from engines engaged in construction activities. All equipment will be properly equipped to control odor emissions. Noise will be generated during the construction of the public improvements (e.g. roads, sewer, water) and residential and commercial /office buildings in the development. City ordinance regulates the daytime hours of construction to minimize noise impacts to sensitive receptors on adjacent properties. Noise mitigation is not proposed at this time because construction noise will be • Legacy at Wood's Edge Record of Decision City of Lino Lakes February 2004 temporary and all City and County roads in the area are exempt from state noise standards. Noise levels along the local roadways are not anticipated to exceed State noise standards, nor are they anticipated to be greater than noise levels that are commonly experienced within a residential and commercial area. Furthermore, adequate building setbacks and acoustical site planning techniques have been incorporated into the site plan to shield more sensitive land uses from noise impacts. Visual Impacts Only routine visual impacts associated with construction activities and typical urban development are anticipated by the proposed development. This area has already been developed with the City offices, police station, and early childhood development center. The proposed development will change the nature of a portion of the site from open space to one that is urban in nature. The Lino Lakes Town Center Design & Development Guide, May 2000, will be utilized to guide the orderly and integrated development of the site, which includes a mix of land use (retail shops, office spaces, housing, recreation, community facilities, and open space). The Guide emphasizes the importance of creating attractive gathering spots, commons areas, and comfortable walking environments for visitors and residents. Furthermore, the Guide identifies the importance of maintaining a sense of place by incorporating tree -lined boulevards, natural drainage swales, open spaces, appropriate building materials (wood, masonry, and stone), landscaping, and architectural standards. Historic and Archaeological Resources The Minnesota State Historic Preservation Office (SHPO) was contacted regarding archaeology and historic resources in the area. The SHPO completed their review, acknowledged that the overall area contains a large number of recorded sites, but recommended that no further study is necessary at the site of the proposed Legacy at Wood's Edge Development. 2. Cumulative Potential Effects of Related or Anticipated Future Projects The EAW and this Findings of Fact address the impacts related to the proposed development, based on existing conditions and post - development conditions. The City of Lino Lakes is not aware or any other large -scale development plans that are contingent upon the completion of the Legacy Development. 3. Extent to Which Environmental Effects Are Subject to Mitigation by Ongoing Public Regulatory Authority The mitigation of environmental impacts will be designed and implemented in coordination with regulatory agencies and would be subject to plan approval and the permitting process. Currently Mn/DOT does not have any improvements planned for this interchange in the 20 -year Transportation System Plan. Mn/DOT is currently initiating an 1 -35 Study, from I-694 to Hinkely Minnesota to determine the 20 -year needs of the study corridor. However, we would recommend that the city by and secure funding as soon as possible for any future interchange improvements. Mn/DOTs policy is to assist local governments in promoting compatibility between land use and highways. Residential uses located adjacent to highways often result in complaints about traffic. noise. Traffic noise from this highway could exceed noise standards established by the Minnesota Pollution Control Agency (MPCA), the U.S. Department of Housing and Urban Development, and the U.S. Department of Transportation. Minnesota Rule 7030.0030 states that municipalities are responsible for taking all reasonable measures to prevent land use activities listed in the MPCA's Noise Area Classification (NAC) where the establishment of the land use would result in violations of established noise standards. Mn/DOT policy regarding development adjacent to existing highways prohibits the expenditure of highway funds for noise mitigation measures in such areas. The project proposer should assess the noise situation and take the action deemed necessary to minimize the impact of any highway noise. The proposal includes almost 350,000 square feet of office/retail commercial use, 450 multi - family residential units, and 38,000 square feet of civic uses. Council staff has reviewed this EAW to determine both its adequacy and accuracy in addressing regional concerns and its potential for significant environmental impact. Staff finds that the Draft EAW is complete and accurate with respect to regional concerns and raises no major issues of consistency with Council policies. An Environmental Impact Statement is not necessary for regional purposes. However, Metropolitan Council staff provides the advisory comments itemized below for your consideration when making subsequent project decisions. Item II – Fish, Wildlife and Ecologically Sensitive Resources Since virtually all of the stormwater is directed to the regional park there could be a regional system impact to the Regional Recreation Open Space System if the storinwater quality and or volume are such that they negatively impact the natural resources of the park. A number of stonnwater management techniques are listed in the EAW as potential ways to manage stormwater runoff. There are more ideas available in the Metropolitan Council's Urban Small Sites BMP Manual. However, the City recognizes the extensive wildlife habitat east of the site and proposes to install surmountable curbing along the easterly side of the roadway located in the northeastern portion of the site. This would allow any wildlife that enters the urban area from the wetland complex to the east the ability to traverse the curb and retreat back to the east to undeveloped portions of the site and the Rice Creek Chain of Lakes Regional Park. areas into the design of the many parking lot vegetated islands on the site. It is unclear from the document if this low impact development practice is currently part of the proposal. By constructing depressed rather than raised islands and surrounding the islands with curb cuts or concrete edges that slope to the interior of the islands, runoff from the parking areas can be muted into these vegetated areas, then through a piped overflow into the underground chambers. In this fashion the first flush of runoff events can be retained in the bio- infiltration areas, maximizing the efficiency of the rest of the runoff treatment train. Item 10 — Land Cover and Item 25 — Nearby Resources. The proposal includes a high percentage of impervious surfaces that will cover 30 acres if the project is implemented as proposed. To preserve water quality in the adjacent regional park stormwater runoff from the development will need to be managed in an ecologically sensitive manner. Portions of the site are identified as regionally important in the joint Metropolitan Council and Minnesota Department of Natural Resources Regional Natural Resources Inventory and Assessment (NRI/A). The EAW should acknowledge this designation. Areas of particular concern include: • proposed reductions in wooded/forested land cover abutting the regional park; • potential loss of the island of oak woods in the southwest/central part of the site; • use of native vegetation in the proposed urban/suburban landscaping where there are development transitions to the regional park's natural areas. Item 19 Geologic Hazards and Soil Conditions This item states that "excessively drained soils and relatively high ground water table creates a potential for ground water contamination." The sanitary waste issue is addressed through the municipal sanitary treatment off site. It is recommend that this information also be considered when managing stormwater runoff. Deep stormwater ponds would have the potential to directly contaminate ground water with oils, road salt, and other contaminates associated with roads and parking lots. Item 21— Traffic The EAW states that year 2020 traffic volumes for full build -out of the site will be part of a simulation program that is being developed. It further states that results of the traffic simulation as it relates to the regional transportation system will be shared and discussed with Minnesota Department of Transportation (MnDOT) and the Anoka County Highway department. The results of the traffic simulation model should also be shared and discussed with the Metropolitan Council. There is currently no transit service to the proposed development. However, Routes 250 and 262 do operate local service in the area, and Route 250 travels past the site on Lake Drive on its "deadhead" routing to and from St. Joseph's Church Park & Ride lot. Metro Transit and Metro Transit Services can consider rerouting one or both of these routes to offer residents service to both downtown Minneapolis and downtown St. Paul. In 2 2 3 4 5 6 RESPONSE 2 The majority of the interior parking lot islands do not have sufficient area to treat and store the amount of runoff that will be generated from the proposed development, but these islands will consist of a pervious surface that will provide some infiltration. Detention ponds and underground infiltration chambers will be utilized to treat and store runoff from the site. Where applicable, a drop curb design will be used to provide access to infiltration ponds. Currently, the site plan includes four onsite ponds that will receive runoff from impervious areas through a drop curb design. 3 At the time the EAW was written, the City was not aware of the Regional Natural Resources Inventory and Assessment (NRI /A) and that the MNDNR and Metropolitan Council had identified a portion of the site in the assessment. The Metropolitan Council was contacted, and a copy of the NRI /A map was attained. Preservation efforts have been incorporated into the site plan that will reduce impacts on a grove of mature trees located on the eastern side of the site (adjacent to the park). Furthermore, the proposed development includes natural open space areas and vegetative buffers between the development and the park boundary. 4 Suitable separation (3 to 4 feet) will be maintained between the bottom of detention ponds /infiltration chambers and groundwater to minimize the potential for contamination. addition, they could review the possibility of reverse commute service out from the downtowns for the office portion of the development if there is sufficient demand. Metro Transit would prefer for any potential bus stops for the development to be located on Lake Drive to minimize route deviations and extra running time. Therefore, it is important that there are good pedestrian connections throughout the development and to Lake Drive. If the proposed residential development is within 1/4 toile of Lake Drive it would generally be considered -a reasonable walking distance to transit service. Also in the southbound direction riders would need to cross Lake Drive to board the bus, so a traffic signal/crosswalk is suggested. Since any, potential bus stops would probably be on Lake Drive, safety for buses making stops should be kept in mind when designing the proposed improvements on Lake Drive. At the present time one of the region's largest park and ride facilities (I-35W at 95th Ave in Blaine, 800 spaces) is only a couple of miles from the site. Most likely commuters will drive to this park and ride, which offers a high level of express service to downtown Minneapolis and also limited stop service to St. Paul. Also the City of Lino Lakes is within the service area for the Anoka County Traveler. Currently, dial -a -ride service is available in the area. This concludes the Council's review of EAW. The Council will take no formal action. These concerns include: • Currently, the County does not have any improvements planned to CSAH 23 (Lake Drive), nor are any scheduled through 2015. • While the 2020 Traffic Volume Forecast in the Lino Lakes Transportation Plan anticipates volumes on CSAH 23 "to increase to over 17,000 trips per day" (EAW pg. 23), the County's 2015 Transportation Plan anticipates volumes of 9,000 on the southwest side of 1-35W interchange in front of the development. • Access management in the area between 1 -35 W and the south project limits should meet the County's Access Management Guidelines. Mn/DOT's guidelines may also apply. • The development- initiated improvements to the County Road system should be designed in accordance with the guidelines for plat and site plan review in the County's Development Review Process manual dated December, 2003. • The City, County, and Mn/DOT, may wish to consider a short-, mid -, and long -range programming and funding plan for the road improvements recommended in the Affirmative Action t Equal Opportunity Employer 1 2 RESPONSE 1 The City of Lino Lakes Comprehensive Transportation Plan forecast traffic volume for Lake Drive /CSAH 23 was based on 1996 ADT volumes. The 2002 Traffic Flow maps indicate the traffic volumes on Lake Drive /CSAH 23 near Elm Street were 10,000 trips per day. The 2002 map may include traffic counts from year 2000 and probably does not reflect the growth in the Target/Kohls development area north of I -35W. It would be prudent to plan the improvements in such a way as to avoid reconstruction of any interim improvements made—in other words, maximize the potential of our investments. • The EAW mentions a future "traffic simulation as it relates to the regional transportation system" (EAW pg. 25). The County is very interested in seeing the results of this simulation and we look forward to discussing these with you and Mn/DOT, hopefully prior to Preliminary Plat review. • There is some concern about the impact of this project on traffic farther south on CSAH 23. While it is understood that this is outside of the scope of the EAW, development of this portion of the City will anchor, or set in stone, the potential for alternatives. Before alternatives are eliminated, it would be helpful to discuss the cumulative impact of this, and other, development projects in greater detail with the City. • We encourage early, possibly draft, submittal of any Preliminary Plat and/or site plan of the Legacy at Woods Edge to the County Staff for review. Cover Types (Item No. 10) Table 1 shows the conversion of 4,6 acres of wooded/forest cover. This may result in the removal of a significant amount of wood from the Site Depending on its condition, this wood may be used as landscaping material, firewood, or as a replacement for coal in the production of energy. The developer should contact Jean Moodie, Regional Forest Utilization and Marketing Specialist (651772- 7567), for advice on this subject. Water Ouality: Surface Water Runoff (Item No 17) The project proposer has done a good job of incorporating stormwater infiltration technologies into the plans for this site The EAW states that the project will result in a zero percent post - development increase in runoff rates. We recommend that this control be coupled with a zero percent increase in runoff volumes. Improvement in volume control would be desirable, especially considering that the project will result in a 43 percent increase in impervious cover in the shoreland district of Marshan Lake. Item No. 17b states that treated stormwater either will be infiltrated or discharged to wetlands. The EAW does not state the change in stormwater runoff volume from the site. This increase in runoff volume is likely to only occur in the George Watch Lake Watershed because the storm water management plan establishes a drainage system that routes nearly all runoff from the site to the east and into the George Watch Lake Watershed. Runoff from impervious surfaces that are within the Marshan Lake Shoreland District is directed to a series of infiltration basins /ponds that eventually outlets to a wetland, which is tributary to another extensive wetland complex located in the George Watch Lake watershed. The site is not in the current MUSA, but the City has ample MUSA reserve for commercial projects. The site has a conditional use permit (CUP) which will need to be amended to allow the construction of the new building. The required site and building plan review is an administrative review, but the review elements are relevant to the CUP. Because of the VFW's willingness to dedicate additional right of way, building and parking drive setback variances are needed along Lake Drive. The City approved a CUP amendment in April 1999 for an addition to the existing building, which was never constructed. The new application would replace that plan. The existing garage, not shown on the survey, must be removed. The building is set back from Lois Lane 70'. The parking is set back 15'. Since the Lois Lane side is the shorter fronting on a road, it is considered the front for measuring setbacks. This makes the east the side lot line, where the setback of 20' complies with the requirement. The following discussion addresses setbacks from Lake Drive. Variance: The existing Lake Drive right of way is not of consistent width along the entire property. It is 40' from the centerline along the southern portion, then 50' along the northern portion. The VFW is proposing to dedicate additional right of way to provide for future needs and make the right of way consistent. An additional 20' will be dedicated on the south, and an additional 10' along the north. This will result in a consistent 60' from centerline. Future right of way width recommended for this arterial is 120' total. Additional width will be obtained when/if land on the west side of the road subdivides. (In fact, the Crystal Cove plat will dedicate an additional 10'.) This squeezes the site a little. In order to fit the proposed building and parking drive, the VFW is requesting a setback variance. The required setback from an arterial roadway (Lake Drive, CSAH 23) is 40'. The building will be approximately 34' from the new property line. The parking drive will be about 5' from the line instead of the required 15' . The full right of way will be in place. This eliminates concern about additional roadway needs and public costs of condemning land and, possibly, demolishing buildings or other facilities. The building will be six feet closer than normally required. The parking drive will be 9.5' closer than normally required. The main issue here is the 5 +' of land for landscaping. It is difficult to provide extensive landscaping and screening. However, there is little screening along Lake Drive in this commercial area. The project will significantly improve the appearance of the site, including landscaping. Lighting: Light fixtures in the parking lot will be on six poles. Three, in the northern parking area, will have two fixtures each. One single fixture will be near the Lois Lane driveway, and two others in the southern parking area. The submitted photometric plan indicates that lighting meets city standards: no more than 0.4 foot candles at the residential property line to the east, and no more than 1.0 at street right of way lines. The exterior building lighting is included. The submitted fixture cut sheets show 90 degree cut off fixtures in compliance with city requirements. The lighting under the north and south entry canopies is completely recessed, similar to what the current ordinance requires for motor fuel station canopies. Signage: No additional ground signs are indicated on the plan. An area of the south wall indicates an area for wall signage. The VFW will remove the existing pylon sign. Signage is governed by the City's sign ordinance and permits are required for all signs. All signs will be reviewed with the sign permit applications. • • • Circle -Lex VFW page 4 Landscaping, Screening: As shown on the landscape plan, a variety of trees, shrubs and ornamental plantings are proposed on site. A new six -foot, cedar privacy fence is proposed, to continue the segment of existing fence, which will extend along the residential property lines on the east. This provides screening for those lots. The fence also will be built along other property lines. Only the street sides will not be fenced. Plantings labeled "vide" that were not listed in the plant list have been identified. The City native seed schedule should be used in infiltration and ponding areas. Utilities: The VFW site currently is not within the MUSA, but the City has plenty of commercial MUSA reserve to accommodate the needed 2.24 acres needed. Water and sanitary sewer service are available to serve the site in Lake Drive. The existing VFW building has a well and onsite septic system. Both are in locations that will be completely or partially covered by the new building. If the existing building is to continue operating during construction of the new building, there must be a way to supply water and dispose of wastewater. The new plans show temporary connections to city utilities as well as the permanent connections. As a condition of plan approval, utility related modifications and comments as set forth in the City Engineer's memo 'should to be incorporated into the final plans. Stormwater management: The new plan proposes ponding along the northern and eastern borders of the site. (Ponds proposed within the Lake Drive right of way on earlier plans have been eliminated.) The City Engineer review is attached. Drainage and utility easements must be created over all ponds. The applicant will be required to enter into a ponding maintenance agreement with the city. As a condition of plan approval, the grading and drainage related modifications and comments as set forth in the City Engineer's memo should be incorporated into the plans. The residential properties on the east have wells. State law requires that there must be at least 50' separation between a well and a stormwater pond. The applicant has submitted information stating that the wells are in front of the two houses to the southeast (785 and 793 Lois Lane). Further east, the next house is several hundred feet away and the well is in front of the house. Access, Circulation, Parking: Right Of Way Lake Drive is CSAH 23, a principal arterial roadway. Ultimately, Anoka County will need 60 feet of right of way on each side of the centerline for Lake Drive, for a total width of 120 feet. There is some discrepancy over the current width of the Lake Drive right of way. The half - section shows the right of way as 100' along the entire frontage of the site. The submitted survey, however, shows a jog in the property /right of way line: the total ROW is 100 feet along the northern part of the property, but only 90' along the southern part. Circle -Lex VFW page 5 As explained above under "variance ", the VFW is proposing to dedicate additional ROW to create an even line, a consistent 60' from the centerline. Access, Circulation Current access to the site is not well defined. Neither Lake Drive nor Lois Lane have curbs. Access occurs along the property line, not necessarily by defined driveways. Anoka County is planning to construct a median in the future as part of Lake Drive improvements. This will restrict access to many properties, as it will eliminate left turns in and out of many driveways. The improved site will be accessed from two driveways, one each on Lake Drive and Lois Lane. A full access through a future Lake Drive median may have better probability if the driveway aligns with a public road (79`h St.), though this is not assured. Whether or not the median is constructed, the Lake Drive driveway should align with 79th St. for a safe "intersection ", even if it's only for the interim. The January 21 plans show this alignment. The Lois Lane driveway is as far back from the Lake Drive intersection as possible while still providing the minimum 10' setback from the side property line. The plan proposes two distinct parking areas. The smaller area on the south side is intended to accommodate the bar and restaurant. The northern area will serve the assembly hall. The parking lots and driveways will be asphalt with curbs. In the northern area, the drive lane that parallels Lake Drive has the potential to connect with a parking area on property to the north when it develops. This serves as a de facto frontage road. With the likelihood of a median in Lake Drive, access for both sites will be better if they can use one another's driveway. It increases the number of Lake Drive driveways available for each site from one to two, while only building one on each site. This will require a cross access easement for both sites. Because Lake Drive is an arterial, it will be a good idea to require a stop sign for vehicles exiting the parking lot onto Lake Drive. Parking For bars and restaurants, our code requires 10 spaces per 1000 sf, plus one space per employee on the maximum shift. This criterion was applied to the whole building when the American Legion was reviewed. Zoning Ord. Req. The VFW has submitted a sketch demonstrating that about20 cars can park on the site during the construction period. Some additional parking could occur on 79th St. Conditional Use Permit There are general criteria for all CUPs and specific conditions that apply to private clubs. General Criteria: The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds the following criteria have been met: a. The proposed development application has been found to be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: Land Use Plan, Transportation Plan, Utility (Sewer and Water) Plans, Local Water Management Plan, Capital Improvement Plan, Policy Plan, Natural Environment Plan. • The proposed project creates no conflicts with the plans. b. The proposed development application is compatible with present and future land uses of the area. • The site has been used for the same use for many years. The increase in size of the building will not create incompatibilities as long as the use complies with the performance standards and conditions. c. The proposed development application conforms to performance standards herein and other applicable City Codes. • The proposal complies with the zoning ordinance requirements if the variances are approved. d. Traffic generated by a proposed development application is within the capabilities of the City when: 1) If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. 2) If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. 3) If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. 4) The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 5) Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. 6) The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement • • • Circle -Lex VFW page 7 Plan. However, the City may, at its discretion, consider developer - financed improvements to correct any street deficiencies. 7) The LOS requirements in paragraphs a. to d. above do not apply to the I- 35W/Lake Drive or I -35E /Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties, that contribute to traffic at the interchange. 8) The City does not relinquish any rights of local determination. • Traffic generated by the new building will increase somewhat over the existing use, but is not expected to create ongoing traffic problems. Large events will bring additional vehicles periodically. However, the number of vehicles likely will not create a safety hazard or significant impacts. The Apollo Drive and Main St. intersections with Lake Drive both are controlled intersections. If, in the future, traffic becomes an issue, the City can revisit the CUP and consider adding additional conditions such as traffic control personnel for large events. e. The proposed development shall be served with adequate and safe water supply. f The proposed development shall be served with an adequate and safe sanitary sewer system. • The new building will be connected to city water and sanitary sewer. g. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. • There will be no city capital expenditures for this project. h. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. • The project will create no such undesirable effects. i. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. • No such features exist on the site. Specific CUP Conditions: Private lodges and clubs are allowed as conditional uses in the GB zone provided that: a. Adequate screening from abutting and adjoining residential uses and landscaping is provided. b. Adequate off - street parking and access is provided and that such parking is adequately screened and landscaped from adjoining and residential uses. c. Adequate off - street loading and service entrances are provided and regulated where applicable by Section 3, Subd. 6. of this Ordinance. • • • Circle -Lex VFW page 8 • The review has discussed these issues, and they are addressed in the plans and conditions of approval. ENVIRONMENTAL BOARD ACTION The Environmental Board reviewed the project on October 29, 2003. The Board's recommendations are attached. PLANNING & ZONING BOARD The P & Z conducted a public hearing over several meetings and on January 14 recommended approval of the project with conditions. CONDITIONS OF APPROVAL The project approval should be subject to the following conditions: 1. The separate parcels shall be combined into one tax parcel. The applicant must submit documentation that a lot combination has been filed with Anoka County prior to issuance of a building permit. 2. Additional right of way shall be dedicated to Anoka County for Lake Drive, as indicated on the plans. A deed for this right of way shall be filed prior to building permit issuance. 3. The 50' separation between existing wells on all adjacent residential properties and the proposed stormwater ponds must be noted on construction plans. 4. Drainage and utility easements must be created over all ponds. Deeds for these easements shall be provided to the City prior to building permit issuance. 5. Drainage and utility easements shall be dedicated, 10 feet in width, along all lot lines. Deeds for these easements shall be provided to the City prior to building permit issuance. 6. The new building must connect to city water and sanitary sewer and pay appropriate connection charges. 7. Any existing septic systems or wells must be properly abandoned according to law. 8. The height of plantings near the driveway must not interfere with sight lines. 9. The City native seed schedule shall be used in infiltration and ponding areas. Circle -Lex VFW page 9 • 10. Issues listed in the February 3, 2004 memo by the City Engineer must be resolved to his satisfaction. • • 11. A stop sign shall be installed for the Lake Drive driveway. 12. All necessary permits shall be obtained by the applicant from Anoka County for work in the Lake Drive (CSAH 23) right of way. 13. Lighting must be as shown on submitted plan and fixture cut sheets. 14. Signage is governed by the City's sign ordinance and permits are required for all signs. 15. The VFW shall enter into a site performance agreement prior to issuance of a building permit. 16. The VFW must agree to a mutual cross - access easement with the property to the north when that property develops. 17. If parking or traffic generation create problems in the future, the City may impose additional requirements to resolve such issues. 18. Project approval includes approval of setback variances to allow the building to be 34 feet from the new Lake Drive right of way, and the parking drive to be 5 feet from the new Lake Drive right of way. Building Section, DSGW, 10/9/03, rec'd 10/10/03 • • CITY OF LINO LAKES RESOLUTION NO. 04-18 RESOLUTION APPROVING THE ALLOCATION OF 2.24 ACRES OF COMMERCIAL MUSA, APPROVING THE AMENDMENT OF A CONDITIONAL USE PERMIT, AND APPROVING VARIANCES FOR SETBACKS, FOR THE CIRCLE -LEX VFW SITE, 7868 LAKE DRIVE WHEREAS, the City has received an application for an amendment of a conditional use permit to allow a the construction of a new building for the Circle -Lex VFW, a private club; and WHEREAS, the subject property currently is zoned GB General Business; and WHEREAS, private clubs is a conditional use in the GB zone and the VFW has an existing conditional use permit; and WHEREAS, the legal description of the property is: (see ATTACHMENT A) and WHEREAS, the site currently is not within the existing boundaries of the Metropolitan Urban Service Area (MUSA) but the requested MUSA allocation is consistent with the comprehensive plan and growth management policy because: • the site is guided for commercial use in the comprehensive plan, • the site is in a Stage 1 growth area • the City has MUSA reserve available for commercial development • the proposed development is not premature and WHEREAS, at their meeting on January 14, 2003, the Planning & Zoning Board held a public hearing and recommended approval subject to conditions; NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City Council hereby approves the allocation of 2.24 acres of commercial MUSA for the site, and; BE IT FURTHER RESOLVED that the Lino Lakes City Council hereby approves the • amendment to the conditional use permit, with the following conditions: 1. The separate parcels shall be combined into one tax parcel. The applicant must submit documentation that a lot combination has been filed with Anoka County prior to issuance of a building permit. 2. Additional right of way shall be dedicated to Anoka County for Lake Drive, as indicated on the plans. A deed for this right of way shall be filed prior to building permit issuance. 3. The 50' separation between existing wells on all adjacent residential properties and the proposed stormwater ponds must be noted on construction plans. 4. Drainage and utility easements must be created over all ponds. Deeds for these easements shall be provided to the City prior to building permit issuance. 5. Drainage and utility easements shall be dedicated, 10 feet in width, along all lot lines. Deeds for these easements shall be provided to the City prior to building permit issuance. 6. The new building must connect to city water and sanitary sewer and pay appropriate connection charges. 7. Any existing septic systems or wells must be properly abandoned according to law. 8. The height of plantings near the driveway must not interfere with sight lines. 9. The City native seed schedule shall be used in infiltration and ponding areas. 10. Issues listed in the February 3, 2004 memo by the City Engineer must be resolved to his satisfaction. 11. A stop sign shall be installed for the Lake Drive driveway. 12. All necessary permits shall be obtained by the applicant from Anoka County for work in the Lake Drive (CSAH 23) right of way. 13. Lighting must be as shown on submitted plan and fixture cut sheets. 14. Signage is governed by the City's sign ordinance and permits are required for all signs. 15. The VFW shall enter into a site performance agreement prior to issuance of a building permit. 16. The VFW must agree to a mutual cross - access easement with the property to the north when that property develops. 17. If parking or traffic generation create problems in the future, the City may impose additional requirements to resolve such issues. Resolution 04 -18, page 2 18. No. 12976 -002 Routing: The City of Lino Lakes has received revised documents providing for reconstruction of the existing VFW facility site located at the northeast corner of the intersection of Lois Lane and Lake Drive. This proposed site reconstruction was previously addressed in memorandums dated November 11, 2003, January 8, 2004, and January 15, 2004. The following review is based on the previous memorandums, and the following: 1. Revised full -size and 11" x 17" size Preliminary Plan sets (Sheets A1.1, U1, G1, D1), dated January 20, 2004, and received by the City of Lino Lakes on January 21, 2004. S2. Copy of a memo from Michael J. Thomas of DSGW Twin Cities dated December 4, 2003 regarding Conditions of Approval. The proposed Plan provides for demolition of the existing building and construction of a new building with improved driveways and parking facilities. The area of the site is approximately 2.25 acres. Comments provided in the previous memorandums remain effective as applicable, and are therefore included as needed within this Memorandum. • General Comments: General comments are as follows: 1. The proposed 2.25 acre site development shall be subject to the requirements of NPDES (National Pollution Discharge Elimination System) as most recently adopted by the Minnesota Pollution Control Agency (MPCA) and the City of Lino Lakes. Because the site is less than 2.5 acres, a review and approval of the Rice Creek Watershed District (RCWD) will not be required. A Stormwater Pollution Prevention Plan (SWPPP) must also be provided in accordance with MPCA requirements. The applicant has indicated that he is aware of this requirement and is in the process of preparing a submittal. 2. Because the property is adjacent to Lake Drive (County Road 23), the Plan will require the review and approval of Anoka County. The County provided review comments in a letter to the City dated September 22, 2003. Because the Site Plan has been revised since then, it is recommended that the County again review the proposed plans and provide comment. A summary of the County's comments from the September 22, 2003, letter are as follows: An Employee Owned Company Promoting Affirmative Action and Equal Opportunity Circle -Lex VFW Post 6583 Page 2 February 3, 2004 City of Lino Lakes, Minnesota • • • The dedication of an additional 10 feet of right -of -way will be required for future reconstruction purposes. At this time, it is not proposed to construct a right turn lane into the property. However, increases in future traffic volumes and safety concerns may warrant such a requirement from the County in the future, and will be the responsibility of the property owner to construct if required by the County. An additional 10 feet of dedication is provided on the plan by the applicant. • Currently, there are three driveways to CSAH 23 from the property. A single access to CSAH 23 opposite 79th Street is proposed, and is acceptable to the County. The Applicant shall be aware, that pending any future improvements to CSAH 23, a raised median or limiting of full access to the driveway may eventually become a possibility. • Sight corner visibilities shall be maintained per City and County requirements. No plantings, berms, business signs, or other features may be installed within the right -of -way, and that any such features installed outside of the right -of -way must not compromise safe visibility. The site Landscape Plan shall consider this issue accordingly. • At the time of the County's review (September 22, 2003), a Grading and Erosion Control Plan had not yet been submitted. The County will require a Grading and Erosion Control Plan for review along with drainage calculations. • A permit from Anoka County will be required for any and all work within the County right -of- way, and a note stating this has been added to the plans. Provisions for restoration, traffic control, and safety as required by the County shall be incorporated into the Plans. 3. The proposed reconstruction is intended to occur simultaneously with the maintaining of operation of the existing facility. The Applicant must provide a work plan that provides for the construction and existing operation, including provisions for access, parking, construction limits, and keeping the existing building in service while the new building is constructed. 4. Existing well and septic locations on adjoining properties have been confirmed according to the applicant. The applicant states that minimum separation distances for the wells and septic systems from the proposed storm water ponds is attained for the plans as proposed. The separation distance shall be provided in accordance with the requirements of the Minnesota Department of Health. Site Plan (Sheet A1.1): The following comments regarding the Site Plan are offered as follows: 1. The single access point from Lake Drive has been lined up directly across from 79th Street as required in previous comments, and is now acceptable. Right of way lines on the plans (for both Lake Drive and Lois Lane) have been identified on the plans per previous comments. The applicant must dedicate all additional right of way as required, and has indicated that a deed will be filed prior to applying for a building permit (Condition No. 2 of DSGW memo). 3. Proposed improvement features should be labeled accordingly, including concrete curb and gutter. The type of concrete curb and gutter and pavement section design is not specified on any of the Plan sheets, but is identified on Sheet D1 (B612). The pavement section is also shown on D1, and should be labeled as the parking lot pavement section. Radius dimensions for the driveway entrances are provided. However, it is recommended that a 20 -ft. radius be provided at all driveway entrances, including at Lois Lane, consistent with City standards. 4. In addition to additional right of way dedication required by the County along Lake Drive, a 10 -foot drainage and utility easement shall be dedicated by the applicant around the perimeter of the property. An exception shall be the northeast portion of the property where the easement must expand to include the pond and detention area. The applicant has agreed to provide said easements per Condition No. 6 of the DSGW memo. A variance will be required to meet set -back distance requirements for the parking area and building from the newly dedicated right -of -way limits. 5. The proposed ponding area is essentially squeezed or "shoe- horned" into a narrow space between the parking lot and the adjacent property. This does cause some concerns with regards to possible encroachment into neighboring properties, and an immediate drop behind the curbing of the parking lot. Typically, a bench of sufficient width around a pond is needed to provide for adequate maintenance and access. As mentioned in the previous memorandum, there are concerns regarding maintenance and snow removal. 6 -foot privacy (wood fence) has been provided on the plan to protect and prevent encroachment and/or grading into the neighboring properties. The fence must be placed on the Applicant's side of the property line in accordance with the requirements of the City of Lino Lakes. 6. An existing building and other structures must be removed to provide for the new construction. All existing fixtures shall be removed in accordance with the requirements of the City of Lino Lakes and the State of Minnesota, including foundations and any other underground fixtures that may exist such as storage tanks or other. In the event there are environmental issues such as contaminated soil and/or materials or other removal issues, the Applicant shall be responsible for complying with all environmental requirements of the City, County, and State as applicable. This also includes the abandoning and capping of wells and removal of septic systems as may be applicable. Grading Plan (Sheet GI): Comments with regards to the Grading Plan are as follows: 1. The building's main finished floor elevation has been provided as 909.8. The lowest building opening must be a minimum of 1 -foot higher than the emergency overflow elevation. Any basement floor elevations must be at least 4 -feet above the normal water elevation and 2 -feet above the design flood level. However, the applicant has indicated that there is no basement proposed for the building. Circle -Lex VFW Post 6583 Page 4 February 3, 2004 City of Lino Lakes, Minnesota 2. Comments regarding the drainage calculations were provided in the January 15, 2003 memo. Revised calculations must be submitted and address the following specific items as previously identified: • Per the drainage diagram and calculations submitted, Subcatchments 2 and 3 (S2 and S3) were shown routing to Pond 1 (P1). However, per the utility plan, S2 discharges directly to the storm sewer rather than to the pond. In addition, Subcatchment 1 (S1) was shown discharging to a Pond 2 (P2), although no Pond 2 exists on the grading plan. In addition, the HydroCad model utilized a 6 -inch outlet whereas no outlet of such is shown on the utility plan. It should also be noted that no ponding is allowed within the County right -of -way. The calculations must be corrected and re- submitted. • The 2, 10, and 100 year proposed discharge rates may not exceed the 2, 10, and 100 -year existing discharge rates. If the orifice on the outlet is at the minimum 6 -inch size, the City shall review and determine if the proposed discharge rate is acceptable. Further review shall be conducted upon the receiving of revised calculations showing the corrected discharge rates. • A 10 -foot wide 10:1 bench is typically required at the normal water level for stormwater ponds. 3. Notes regarding seeding, mulching and turf establishment shall be provided and refer to the appropriate Mn/DOT Specification for turf establishment (2575) and for the seed mixture. The City of Lino Lakes has a specific seed specification for ponding areas and a note referring to City of Lino Lakes seeding specifications is provided on the plan. However, it is recommended that the actual specification and mix be included on the plans or detail sheet. 4. All grading shall be confined to the property, and a note has been added to the plans stating this. In addition, an existing retaining wall is located at the east property line. The applicant has stated that the retaining wall will be left in place and left undisturbed. If not, the Grading Plan must address this accordingly. 5. The Grading Plan suggests that at least some portions of the parking lot and driveways will drain directly to the neighboring streets (Lake Drive and Lois Lane). Additional spot elevations at the driveway entrances should be shown to verify the intended drainage patterns. 6. As previously stated, provisions for existing wells and septic systems shall be addressed on the Grading Plan in accordance with City and State of Minnesota requirements. Utility Plan (Sheet U1): The following comments can be made with regards to the Utility Plan: 1. Sanitary sewer and water currently exist in Lake Drive (12 -inch diameter water and 21 -inch diameter sanitary sewer). The Plans propose utilizing existing services to these mains. The size and condition of Circle -Lex VFW Post 6583 Page 5 February 3, 2004 City of Lino Lakes, Minnesota these services should be verified to assure their adequacy. The amount of filllcover over all sewer and water service pipes shall be a minimum bury depth of 8 feet, and shall be insulated per City of Lino Lakes standards if the minimum cover cannot be attained. 2. Per the plan, one fire hydrant exists adjacent to the site along Lake Drive and another on the south side of Lois Lane at Lake Drive. The Plan shall be subject to the review of the City Fire Chief, and the installation of additional hydrants may be required if required by the Fire Chief. 3. The Utility and Grading Plans propose connecting to the existing 21 -inch storm sewer pipe that runs beneath the edge of Lake Drive. Connection to the pipe will require a permit from Anoka County. The traffic control and restoration provisions in Note 8 on the utility plan shall also refer to the requirements of Anoka County, including permitting and restoration requirements. 4. All trenches (including services) shall be backfilled and compacted and meet 100% maximum Standard Proctor Density in the upper 3 -feet from finished road elevation, and 95% maximum Standard Proctor Density below the upper 3 -feet. 5. A minimum of two feet of cover over storm sewer pipe is desired. 6. A proposed driveway apron is shown at the same location as the 6 -foot high wood privacy fence, per the request of the adjacent property owner according to the applicant. A gate, private access agreement, or other as agreed upon between the applicant and the adjacent property owner shall be provided as needed. Other: 1. A Geotechnical Report has not yet been provided. As previously mentioned, re- development of the site will require demolition of the existing building and removal of smaller buildings and surface features. There may also be underground items required for removal as well, including foundations, storage tanks, old septic systems, etc. as previously stated. The Applicant shall verify the existence of all surface and underground items and shall remove and dispose of those required in accordance with State and Local regulations. 2. The type of light fixtures proposed shall be subject to the approval of the City of Lino Lakes. 3. The previous review memorandum included comments regarding the Landscape Plan submitted (Sheet L1.0). Comments included that special consideration be given to assure that no plantings are installed over any existing or proposed utilities. MEETING DATE: February 9, 2004 TOPIC: Second Reading: Ordinance 02 -04 Rezoning Site from R -4, High Density Residential to R -3, Medium Density Residential Northeast Corner Lake Drive and Aqua Lane. VOTE: 3/5 BACKGROUND The City Council approved the first reading of Ordinance 02 -04 on January 26. The subject site is four acres of property at the northeast corner of Lake Drive and Aqua Lane, adjacent to the existing Marshan Lake Condominiums. The entire Marshan Lake Condominiums site and the remaining four -acres along Lake Drive is guided Medium Density Residential. The site is zoned R -4, a high - density zone. This is not consistent with the comprehensive plan's Medium Density classification. To address this inconsistency, Ordinance 02 -04 amends the zoning ordinance to rezone the site to R -3 to bring it into conformance with the comprehensive plan. Upon approval of the second reading, the ordinance will be published on February 17th and become effective 30 days after publication. OPTIONS 1. Approve the second reading of Ordinance 02 -04, rezoning the site from R -4 High Density to R -3 Medium Density. 2. Return to staff with direction. RECOMMENDATION Option 1 • • CITY OF LINO LAKES ORDINANCE NO. 02-04 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF LINO LAKES BY REZONING CERTAIN REAL ESTATE AT THE NORTHEAST CORNER OF LAKE DRIVE AND AQUA LANE FROM R -4, HIGH DENSITY RESIDENTIAL TO R -3, MEDIUM DENSITY RESIDENTIAL The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: Section 1 Findings The Lino Lakes City Council hereby makes the following findings: 1. The City of Lino Lakes approved its current comprehensive plan in August 2002 with Resolution No. 02 -103. The comprehensive plan was prepared and approved as required and enabled by Minnesota Statutes 462.351- 462.356 and Minnesota Statutes 473.851- 473.869. 2. The City of Lino Lakes approved its current zoning ordinance in March 2003 with Ordinance No. 08 -03. The zoning ordinance was prepared and approved as required and enabled by Minnesota Statutes 462.357. 3. The comprehensive plan includes a Proposed Land Use plan guiding land within the City of Lino Lakes for specified land uses. 4. The comprehensive plan guides a four -acre site at the northeast corner of Lake Drive and Aqua Lane for land use category Medium Density Residential: 3 -6 units per acre. 5. The site is zoned R -4, High Density Residential. Under the current zoning ordinance, R -4 is intended for the High Density land use category: 6 -12 units per acre. 6. Under the current zoning ordinance, the R -3, Medium Density Residential zoning district is intended for the Medium Density land use category: 3 -6 units per acre. 7. Therefore, the current R -4 zoning is not consistent with the current Medium Density land use category in the comprehensive plan. Such inconsistencies should be corrected by amending either the zoning or the comprehensive plan. 8. Minnesota Statutes 473.858 and 473.865 require that official controls are to be amended so as not to conflict with the comprehensive plan. 9. The High Density land use category, which would allow for development of up to 12 units /acre, is not consistent with the existing townhome neighborhood, which is 6.4 Ordinance 02 -04, page 2 • • • units /acre. Medium Density, which allows 3 -6 units /acre, will allow development that will be very close to and thus consistent with the existing neighborhood. 10. The City Council considered an application to amend the comprehensive plan to change the land use category for the site from Medium to High Density. The City Council decided, with Resolution 04 -01, to deny the amendment to the land use. 11. The site should be rezoned to R -3, Medium Density Residential, to be consistent with the comprehensive plan land use classification of Medium Density. 12. The Planning & Zoning Board held a public hearing on the rezoning on January 14, 2004, and recommended approval of the rezoning. 13. The rezoning action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The current R -4 High Density Zoning conflicts with the Medium Density land use category of the comprehensive plan. The purpose of the rezoning is to correct this inconsistency between the comprehensive plan and the zoning. State statute requires that official controls found to be in conflict with the comprehensive plan must be amended so as not to conflict. 14. The R -3 zoning is or will be compatible with present and future land uses of the area. The surrounding neighborhood was developed at approximately 6.4 units per acre. The Wenzel Farms townhomes across Lake Drive were built at approximately 5 units per acre. A High Density land use category would provide for 6 to 12 units per acre. A Medium Density category allows up to 6 units per acre. Six units per acre is compatible with the surrounding neighborhood. 15. This rezoning action is not based on a specific proposed use. It is intended to correct a conflict between the zoning ordinance and the comprehensive plan. 16. Development according to R -3 zoning can be accommodated with existing public services and will not overburden the City's service capacity, and traffic generation by the R -3 zoning is within capabilities of streets serving the property. Projects built according to R -3 Medium Density Residential standards will pose less burden on existing services and infrastructure than R -4 High Density Residential projects. Section 2 The Zoning Ordinance of the City of Lino Lakes, Anoka County, Minnesota, passed by the City Council on March 10, 2003 is hereby amended by rezoning from R -4, High Density Residential to R -3, Medium Density Residential, pursuant to the provisions of the Zoning Ordinance of the City of Lino Lakes, for the subject real estate described in Attachment A. The funding for this work is provided by assessments to the respective subdivisions. The estimated total project cost is $78,000.00. The subdivisions receiving wearing course this year include the final portion of Clearwater Creek 3rd Addition and Clearwater Creek 5th Addition. Sealcoating places a thin layer of oil and rock on the street to enhance the surface. Candidate streets include new streets that received the wear course 2 - 3 years ago and all other streets are done on a 5 - 7 year cycle. This year, approximately 5 miles of streets will be sealcoated at an estimated total project cost of $77,000. The 2004 budget includes $61,000 for sealcoating. The difference between the annual City budget amount and the total bid amount would be funded from the City's Sealcoat fund as this reflects the cost of the first time sealing of new roadways.
