Simple Majority (3/5)
In October, 2003, the City Council adopted Resolution No. 03 -174 levying special assessments
for improvements to 21st Avenue. The assessment roll included parcel numbers 24- 31- 22 -24-
0006, 24- 31 -22 -24 -0008, 24- 31 -22 -24 -0009, owned by Rehbein Properties.
Rehbein Properties prepaid their special assessments prior to their certification to Anoka County;
however, the assessments for these parcels were erroneously certified to Anoka County along
with the rest of the assessment roll.
In order to correct the County records and remove the assessments from these properties, the
County requires a resolution be adopted abating the assessments. Staff has prepared Resolution
No. 04 -45 which abates the assessments and corrects the County records.
Staff recommends approval of Resolution No. 04 -45.

RESOLUTION AUTHORIZING THE ABATEMENT OF SPECIAL ASSESSMENTS ON PARCEL
NUMBERS 24- 31 -22 -24 -0006, 24- 31 -22 -24 -0008, 24- 31 -22 -24 -0009
WHEREAS, the City Council of Lino Lakes adopted Resolution No. 03 -174 on October 27, 2003
levying special assessments on parcel numbers 24- 31 -22 -24 -0006, 24- 31 -22 -24 -0008, 24 -31-
22 -24 -0009, owned by Rehbein Properties, for improvements to 21St Avenue; and,
WHEREAS, Rehbein Properties did prepay the amount of said special assessments prior to their
certification to Anoka County; and,
WHEREAS, the special assessments on such properties were erroneously certified to Anoka
County for collection with future real estate taxes; and,
WHEREAS, the City of Lino Lakes wishes to correct the Anoka County records for these
properties relative to the special assessments; and,
WHEREAS, the Anoka County requires that the City Council approve a resolution abating said
special assessments in order to correct the County records.

Section 700 of the City Code relating to Liquor and Beer Licensing was last updated in
2002. I am reviewing legislative changes and anticipate bringing forward a
recommendation for a few updates in this area. At present, however, I have only one
change which I recommend the Council consider.
At your regular meeting of February 9, 2004, you approved a wine and 3.2 % beer license
for Mansetti's Pizza. Minn. Stat. 340A.404, subd. 5 provides that a City may allow the
sale of strong beer at an on -sale establishment that already has a wine and a 3.2% beer
license as follows: (relevant excerpt)
Subd. 5. Wine licenses.
(b) The governing body of a municipality may by ordinance
authorize a holder of an on -sale wine license issued pursuant to
paragraph (a) who is also licensed to sell 3.2 percent malt
liquors at on -sale pursuant to section 340A.411, and whose gross
receipts are at least 60 percent attributable to the sale of
food, to sell intoxicating malt liquors at on -sale without an
additional license.
The wine/beer license at Mansetti's is the only one of its type in the city at this time.
However, I anticipate that in the future, there may be similar establishments that wish to
sell only wine and both types of beer. The only way for an establishment to do so at
present is to have an on -sale license, which allows sales of all types of liquor.
You will notice that the wording of the Statute states that a city "may by ordinance"
(emphasis mine) allow this. Bill Hawkins and I discussed this and he gave the opinion
that our ordinance, as written, does not allow for this. He also stated that the language
• provided here would be sufficient to make this change, should the Council wish to do so.

The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain:
The City Code of the City of Lino Lakes, Section 701, Liquor Licensing (under Section 700, Liquor
and Beer), is amended as follows:

701. Liquor Licensing
701.01 Subdivision 1. Provisions of State Law Adopted. The provisions of
Minnesota Statutes, Chapter 340, with reference to definitions of terms, applications for
license, granting of license, conditions of license, restriction on consumption, provision of
sales, conditions of bonds of license, hours of sales, and all other matters pertaining to the
retail sale, distribution and consumption of intoxicating liquor, are hereby adopted and made
a part of this chapter as if fully set out herein.
Subdivision 2. City May be More Restrictive Than State Law. The Council
is authorized by the provisions of M.S.A. § 340A.509, as it may be amended from time to
time, to impose, and has imposed in this Chapter, additional restrictions on the sale and
possession of alcoholic beverages within its limits beyond those contained in M.S.A.
Chapter 340A, as it may be amended from time to time.

701.02 License Required.
Subdivision 1. General Requirements. No person, except a wholesaler or
manufacturer, to the extent authorized under state license, shall directly or indirectly deal in,
sell or keep for sale in the city any intoxicating liquor without first obtaining a license to do
so as provided in this chapter. Liquor licenses shall be of six kinds:
(1) On -Sale;
(2) On -Sale Wine;

Subd. 2. On -Sale License. On -Sale licenses shall be issued only to hotels,
clubs, restaurants and exclusive liquor stores and shall permit on -sale of liquor only.
Subd. 3. On -Sale Wine License. On -Sale Wine License shall be issued only
to restaurants meeting the qualifications of Minnesota Statutes, Section 340.11, Subd. 20,
and shall permit only the sale of wine not exceeding 14% alcohol by volume for
consumption on the licensed premises only in conjunction with the sale of food.
Subd. 3a. Strong Beer Sales in Conjunction with Wine and 3.2% Beer
Licenses. Licensees who hold both an on -sale wine license and an on -sale 3.2% malt
liquor license and whose gross receipts are at least 60% attributable to the sale of food
may sell intoxicating malt liquor (strong beer) at on -sale without an additional license, as
allowed by Minnesota Statutes, Section 340A.404, subd. 5.

Subd. 4. Off -Sale License. Off -Sale licenses shall be issued only to
exclusive liquor stores and shall permit of sale of liquor only.
Subd. 5. Club License. Club licenses shall be issued only to incorporated
clubs which have been in existence for fifteen years or more, or to congressionally chartered
veterans' organizations which have been in existence for ten years, and shall permit on -sale
of liquor to members and bona fide guests only.
Subd. 6. Sunday On -Sale License. Sunday On -Sale licenses may be issued
to any hotel, restaurant, or club which has facilities for serving at least thirty guests at one
time and which has an on -sale license and shall permit on -sale of liquor on Sunday in
conjunction with the serving of meals.
Subd. 7. Combination License. A combination On -Sale and Off -Sale
License shall be issued only to an exclusive liquor store.
Subd. 8. Temporary Set Up License. A one -day intoxicating liquor
consumption and display permit may be issued to any non -profit organization in connection
with a social activity occurring within the city and sponsored by the organization. No more
than ten such licenses shall be issued in the city in any year. The fee for such license shall
• be $25.00. A permit shall allow consumption or display of intoxicating liquor and the
serving of liquids for the purpose of mixing with intoxicating liquor, but shall not allow the
sale of intoxicating liquor. This permit shall be valid only for the day indicated on it. No
permit issued pursuant to this subdivision shall be valid unless first approved by the
Commissioner of Public Safety.

Subdivision 9. Licenses Reserved. Of the number of on -sale liquor licenses
that the City is allowed to issue under Minnesota Statute 340A.413, three licenses shall be
reserved for the following uses in the specified locations only: two shall be issued only to
restaurants or hotels with restaurants in the Town Center area at Lake Drive and I -35W; one
shall be issued only to a restaurant or a hotel with a restaurant in the I -35E and Main Street
business area. These areas are shown on the map in Section 701.11. These restaurants shall
have facilities to serve meals at tables to the general public and have seating capacity to
serve a minimum of 50 guests at one time, and at least 50% of gross revenue shall be from
the serving of food and non - alcoholic beverages. The City may require a statement signed
by an independent certified public accountant attesting that the establishment meets this
revenue requirement.

Staff has received an application from Miller's on Main to conduct a second annual Street
Dance to be held on August 20 & 21, 2004. This application includes requests for a
Special Event Permit and a Cabaret License.
The Council has previously received background information on this item and discussed
this matter during the March 3, 2004 Council work session, as this is considered a special
event in the City, and the only one of its type. Staff presented a list of recommended
conditions the Council may wish to impose if approval of this event is granted. Since
that time, a few additional conditions recommended by Staff have been added. The
applicant has expressed a willingness to be bound by the conditions recommended by
Staff, and to include plan information pertaining to a checklist of items, and to work with
Staff to resolve an additional issues which may arise.
Fire Chief Milo Bennett provided recommendations as to the 2004 event. Based upon
these points, Staff recommends including the following additional conditions of approval:
-- Minimum of three 2A10BC fire extinguishers need to be on location in the tent area.
- - "No Smoking" signs need to be displayed throughout the area.
- -No pryotechnics are allowed.
- -No parking within 20 feet of the tent. Measured from stakes.
- -No open flames within 20 feet of tent. Measured from stakes.
- - Generator to be located at least 20 feet from tent. Measured from stakes.
- - Clearance to property line needed to 20 feet. Measured from stakes.
-- Certificate of flame retardant for all panels of tent.
Police Sergeant Mortensen requested the several items be addressed as well. Based upon
these considerations, Staff recommends the following conditions of approval:
- -any music shall cease at 12 midnight, and patrons shall clear the premises at 1 a.m.
- -first aid shall be available with sufficient access by the public
- -an entrance fee shall be charged and entrance shall be by wrist bands only

be assembled at the rate of at least one parking space for every
four persons or a parking plan which clearly shows adequate

(11) Fire protection shall be provided by the sponsor which may

effect, or may be set forth by the political subdivision
concerned; and sufficient emergency personnel to efficiently
operate the required equipment will be provided by the
sponsor, also;
(12) All reasonably necessary precautions to insure that the sound
of the assembly will not carry unreasonably beyond the
enclosed boundaries of the location of the assembly;
(13) Administrative control center with telephones where local
authority can contact the sponsors and law enforcement
personnel inside the assembly area;
(14) A bond, filed with the City Clerk, either in cash or
underwritten by a surety company licensed to do business in
Minnesota in the minimum amount of $100,000.00 which shall
indemnify and hold harmless this political subdivision or any of its
agents, officers, servants, and employees from any liability or causes
of action which might arise by reason of granting this license,
payment of employees, or services rendered by the granting
authority, and from any cost incurred in cleaning up any waste
material produced or left by the special event.

Insurance Portability and Accountability Act ( HIPAA). The purpose of this act is to insure the
privacy and portability of individual employee's health insurance. In order to comply with this
act, the city must appoint an individual to serve as Privacy and Complaint Official. It is our
recommendation that the Director of Administration be appointed'as the Act relates to a Human
Resource function.

A RESOLUTION ACKNOWLEDGING THE CITY OF LINO LAKES'S
COMPLIANCE WITH THE HEALTH INSURANCE PORTABILITY AND
ACCOUNTABILITY ACT
WHEREAS, the City Council of the City of Lino Lakes is the official governing body of
the City of Lino Lakes; and,
WHEREAS, the Federal Health Insurance Portability and Accountability Act of 1996 (HIPAA)
requires that all health plans, health care providers and health care clearinghouses implement
regulations for the purposes of ensuring the portability of health care coverage when moving to a new
job, reducing paperwork by conducting electronic payment transactions, and securing the privacy of
individual protected health information; and,
• WHEREAS, the City of Lino Lakes, in limited functions, acts as a health plan and a health care
provider and is therefore subject to HIPAA regulation; and
WHEREAS, HIPAA regulations require that the City designate itself as a covered entity; and
WHEREAS, the City is required to develop internal policies and procedures to carry-out all
HIPAA regulations; and
WHEREAS, the City must name a Privacy and Complaint Official to respond to HIPAA- related
questions or grievances; and
WHEREAS, HIPAA regulations require that the City provide affected clients with a
Notice of Privacy Practices, informing clients of their privacy rights.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

SECOND READING, Ordinance No. 06 - 04, Vacating a Drainage and Utility
Easement Across Lot 18, Block 4, D. Erickson 2 "d Addition

BACKGROUND:
The resident of Lot 18, Block 4, D. Erickson 2"d Addition has petitioned the City to vacate 10-
feet of the existing 20 -foot easement located in their backyard to allow for pool construction.
The dimensions of the existing easement and the proposed vacation are shown on the
attached drawings. The existing easement was dedicated for drainage and utility purposes.
The grading plan, as proposed by the developer's engineer, shows an existing drainage and
utility easement of 20 -feet along each of the backyards of block 4. This drainage and utility
easement has been encroached upon by many of the neighbors over the past years without
disrupting the drainage in the area. The easement is not used for a large drainage area
along the back property lines and City Staff feel a 10 -foot easement is adequate to address
the drainage in this area.
Section 12.05 of the City Charter requires that real property of the City cannot be disposed
of except by Ordinance. The Ordinance will require two readings, publication, and a waiting
period before it is in effect. The proposed schedule for this vacation is as follows:

AN ORDINANCE VACATING A PORTION OF A DRAINAG AND UTILITY EASEMENT
ACROSS LOT 18, BLOCK 4, D. ERICKSON 2 "D ADDITION
THE CITY COUNCIL OF THE CITY OF LINO LAKES DOES HEREBY ORDAIN:
Section 1. That it is in the best interest of the City to vacate 10 -feet of the existing 20 -foot
easement located in the backyard of lot 18, block 4, D. Erickson 2"d Addition, as shown on
the attached drawing.
Section 2. That the City of Lino Lakes held the 1st Reading before the City Council on
March 22, 2004 and held the 2nd Reading and Public Hearing on April 12, 2004.
Section 3. This Ordinance shall be in full force and effect from and after 30 days following its
passage and publication, in accordance with the City Charter.

The Rice Creek Covenant Church has submitted an application to further develop its current site
at 125 Ash Street. The application includes several elements. The project was continued at the
March P & Z meeting and will be considered further at the April 14 P & Z meeting.
If the project proceeds, the vacation of a drainage and utility easement must occur. The City
Council holds public hearings for vacations. Because of advance publication requirements, the
easement vacation notice was published for tonight. However, since the entire project will not
be considered by the City Council tonight, staff recommends opening the public hearing and
continuing it to the May 10 meeting. The entire development project is scheduled to be
considered that night, and the easement vacation can be considered then.

TSM Development has requested approval of a preliminary plat for Highland Meadows East 2nd
Addition. The project involves developing Outlot A of the Highland Meadows East
development, approved in 1999. The application includes several elements. The project was
continued at the March P & Z meeting and will be considered further at the April 14 P & Z
meeting.

Final Plat, Century Farm North 2nd Addition
and
Amending Height Restriction Condition of
Approval of Resolution 03 -60
The preliminary plat for Century Farm North was approved by the City Council on April
28, 2003 with Resolution 03 -60. The approval includes a phasing plan as required by the
growth management ordinance. The final plat for phase 1 (56 units) was approved in
July. The developer has submitted the final plat for phase 2.
The submitted final plat includes individual lots for units in phase two of the approved
phasing plan. This includes 65 units: 22 single family detached townhomes, 42 single
family lots, and one single family lot for an existing house. This existing home was not
expected to remain when the phasing plan was approved. In order to comply with the
approved phasing plan, this lot must be counted as a new unit.
ANALYSIS
Because of the complexity of this project, each phase includes elements not necessarily
included in previous phases. The final plat for each phase must be compared against the
conditions of approval.
The final plat substantially conforms to the approved preliminary plat and phasing plan.
A title commitment has been approved by the City Attorney, along with the association
declarations and the partial release of the powerline easement.
A development contract is being prepared, and will include financial securities. The
agreement was not completed in time to be included in the packet one week prior to the
April 12 meeting.
Conditions attached to approval of the preliminary plat (Resolution 03 -60):
Condition #4: "The submitted townhome housing types and building elevations be
• modified to specify finish materials and be subject to City approval. Side walls facing

public streets shall include windows or other architectural features to avoid the
appearance of a blank wall."
The P & Z was concerned about a monotonous appearance to the development. We
received new elevations submitted after the P & Z discussion. They include four optional
color combinations (A, B, C, D). The new options included different colors for the vinyl
siding, shakes, stone, and shingles. The buildings also include windows and several
materials on the ends of the structures.
The City's townhome building material standards in the zoning ordinance state:
Exterior Building Finish: The exterior of townhome dwelling units shall include a
variation in building materials which are to be distributed throughout the building
facades and coordinated into the architectural design of the structure to create an
architecturally balanced appearance. In addition, townhome dwelling structures shall
comply with the following requirements:
a) A minimum of twenty -five (25) percent of the combined area of all building
facades of a structure shall have an exterior finish of brick, stucco and/or natural
or artificial stone.
b) Except for brick, stucco, and/or natural or artificial stone, no single building
facade shall have more than seventy -five (75) percent of one type of exterior
finish.
c) For the purpose of this section, the area of the building facade shall not include
area devoted to windows, entrance doors, garage doors, or roof areas.
All four options meet these requirements. However, the options tend to look a bit too
busy with all the varied colors. The applicant has made and effort to break up the facades
and staff can work out a final color design.
It would be better to use one of two approaches. One, keep the same color across each
horizontal band of the buildings: the base stone is one band, the walls another, and the
upper gable ends the third band. In other words, a base, middle, and top. Another
approach is to have a similar color form a vertical visual element all the way up the
facade• similar to the Option A front elevation (though the far left and right elements
would need to be one color). The point is to avoid monotony, though a chopped up,
calico result is not desirable either.
Condition #6: The original approval included specific height restrictions to
protect air space for the private air park. The applicant is requesting revisions to these.
The revised building height plan includes a 7:1 "transitional surface" on the sides of the
runway and a 20:1 "approach surface" off the end of the runway. We have discussed the
proposed new restrictions with MnDOT Aeronautics. The new restrictions are more
complete and more in line with MnDOT recommendations.

Under MnDOT rules, the approach surface (off the end of runway) must be maintained
for the air park to continue having a license to operate. The transitional surface off the
sides of the runway is recommended, but not mandatory.
The City is not obligated to adopt these restrictions. It is in the air park's interest to do
so. Public entities have to purchase land or development rights around public airports to
maintain several safety zones. Placing restriction on the use of land to protect a private
airport is a different situation. The City's comprehensive plan does includes an objective
to adopt some airport zoning restrictions. This plat, with its new airpark lots that are part
of the airpark itself, offers the opportunity to do so without imposing restrictions on land
outside of the plat. These restrictions apply only to property within the Century Farm
North development.
Condition #10: This condition addresses park dedication for the plat, which was
unresolved at the time of preliminary plat approval. Since then, it has been resolved.
However, the park trails are to run within a powerline easement. Since the trail will be a
City park trail, we wanted to make sure that the trail is allowable.
The developer has negotiated with the powerline easement holder, Great River Energy, to
ensure that the trail is acceptable. This was part of the negotiations over reducing the size
of the easement. The easement actually covered a much larger area and the developer
negotiated to confine the easement.
OPTIONS.
1. Approve the final plat for Century Farm North, including the revision of Condition #6
of Resolution 03 -60, the height restrictions.
2. Table and return to staff with direction.

WHEREAS, review and approvals of plats are governed by state statutes and City

WHEREAS, the site is included in the Century Farm North preliminary plat approved by
the City Council on April 28, 2003, by Resolution 03 -60, and
WHEREAS, the preliminary plat approval included phasing of the development over
several years, and
• WHEREAS, the final plat for Century Farm North 2nd Addition, received by the City
March 4, 2004 is consistent with that phasing plan and other City requirements, and
WHEREAS, it has been determined that height restrictions for structures within the
Century Farm North preliminary plat area included in condition #6 of Resolution 03 -60
should be revised to be consistent with MN Rules Ch. 8800;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino
Lakes hereby approves the final plat for Century Farm North.
BE IT FURTHER RESOLVED, that no structure shall be constructed higher than the
imaginary surfaces depicted on the "Air Park Building Height Exhibit ", received by the
City on March 4, 2004, which replaces Condition #6 of Resolution 03 -60.

Contract, 62nd Street Reconstruction

BACKGROUND:
Sealed bids were received and publicly opened at 10:00 a.m. on April 2, 2004. The
results of the bid opening are presented below. City Council action is required to award
a construction contract to the lowest responsible bidder.

Three Rivers Construction $1,133,377.19
Engineer's Estimate $1,133,076.20
The low bid is approximately 18% under the Engineer's Estimate for this project. A copy
of the complete bid tabulation is attached. There was an error in the total amount of bid
by F.M. Frattalone. Their total bid amount increased and eliminated them as the low
bidder. F.M. Frattalone has been notified of the error and is in agreement with the
change in results.
The substantial completion date for this project is September 15, 2004, with a final
completion date of October 30, 2004.
OPTIONS:
1. Return to staff for further review.
2. Adopt Resolution Number 04 -44, Accepting Bids and Awarding a Construction
Contract to Arnt Construction Co., Inc. for the 62nd Street Reconstruction project.
3. Not adopt Resolution No 04 -44.
RECOMMENDATION:
Option No 2 - Staff recommends adoption of Resolution Number 04 -44.

RESOLUTION ACCEPTING BIDS AND AWARDING A CONSTRUCTION CONTRACT — 62'
STREET RECONSTRUCTION PROJECT.
WHEREAS, pursuant to an advertisement for bids for the construction of the Elm Street
Reconstruction project, bids were received, opened and tabulated according to law, and the
following bids were received complying with the advertisement:

LAKES, MINNESOTA:
1. The Mayor and Clerk are hereby authorized and directed to enter into a contract with Arnt
Construction Co., Inc., in the name of the City of Lino Lakes for the construction of the 62nd
Street Reconstruction project according to the plans and specifications approved by the City
Council and on file in the office of the City Clerk.
2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the
deposits made with their bids, except that the deposits of the successful bidder and the next
lowest bidder shall be retained until a contract has been signed.
Adopted by the Lino Lakes City Council this 12th day of April 2004.
