First Reading to Consider Ordinance NO. 16 -04, an Ordinance Regulating the Surface Use of Motorized Watercraft on Peltier Lake, Amending Ordinance 03 -02 by Repealing the Sunset Clause of Section 8. VOTE REQUIRED: 3/5 Vote BACKGROUND: Ordinance 03 -02 was passed by the Lino Lakes City Council on March 25th, 2002. Ordinance 03 -02 is an ordinance regulating the surface use of motorized watercraft on Peltier Lake. The purpose of this ordinance is to control and regulate the use of water on Peltier Lake, in Anoka County Minnesota, said body of water being located within the boundaries of the City of Lino Lakes and the City of Centerville, and to promote Peltier Lakes fullest use and enjoyment by the public in general; to insure safety for persons and property in the use of said waters, to minimize adverse impact on natural resources, to harmonize and integrate the varying uses of said waters, and to promote the general health, safety and welfare of the citizens of Lino Lakes, Minnesota. Both the Cities of Lino Lakes and Centerville passed by ordinance 03 -02 jointly and cooperatively. The City of Lino Lakes and the City of Centerville passed identical ordinances except for a provision in the Lino Lakes ordinance allowing for Sunset of the Ordinance on September 1, of 2004. The purpose of this Sunset Clause was to allow time for professional evaluation of the ordinance, and for the City of Lino Lakes to review changes to the status of biologic concerns that were presented in the reasons for passing Ordinance 03 -02. Since the passage of Ordinance 03 -02, monitoring of the northern portion of Peltier Lake has seen the return of Great Blue herons to successful nesting in 2003 and 2004. There were over 300 pairs of Great Blue herons and at least 12 pairs of Great Egrets returned to the island to nest in 2003, and an estimated 350 pairs of nesting birds in 2004. Observations and nesting bird counts were done with both DNR aerial surveys and ground surveys in 2002 and 2003. Additionally, desirable aquatic vegetation (especially in the northern shallow section of the lake) has returned, and improved water quality has been documented since the establishment of the slow no -wake zone ordinance. Data collected shows with a high degree of confidence in the hypothesis that nesting Great Blue herons on Peltier Island are able to nest if disturbance within the estimated buffer needs of the birds is adhered to. With that, staff recommends that the language of "It shall be repealed automatically on September 1, 2004 ", from Section 8 of Ordinance 03 -02 be removed. Section 4: ENFORCEMENT: The Primary responsibility for enforcement of this ordinance shall rest with the Anoka County Sheriff s Department and the Lino Lakes Police Department. This, however, shall not preclude enforcement by other licensed peace officers. Section 5: EXCEPTIONS: All authorized Resource Management, Emergency and Enforcement Personnel, while acting in the performance of their assigned duties, are exempt from the foregoing restrictions. Section 6: NOTIFICATION: It shall be the responsibility of the Anoka County Parks and Recreation Department to provide for adequate notification of the public, which shall include placement of a sign at each public watercraft access outlining essential elements of the ordinance, as well as the placement of necessary buoys and signs. Section 7: PENALTIES: Any person who shall violate any of the provisions of this Ordinance shall be guilty of a misdemeanor as defined by state law. Section 8: EFFECTIVE DATE: This ordinance shall be in force and effect from and after its passage and publication as provided in the Lino Lakes City Charter. It shall be repealed automatically on September 1, 2001. Peltier Island Heron Rookery Summary Report Spring /Summer 2003 In summary: • During 2003, the Task Force met four times to plan activities and update members as the season progressed • Eagle Brook Church, with the assistance of the Rice Creek Watershed District is considering the establishment of a conservation easement for 16.7 acres of the property on the east shore of Peltier Lake. The easement area would include the "stick field " where the herons collect nesting material. • We conclude from all observations that at least some of the 300 + pairs of Great Blue Herons and a few of the 12 .Great Egret pairs successfully nested at the Peltier Island colony this year. • Preliminary information from the 2003 season indicates noticeable improvements in water quality and nest success with the no -wake zone in place. Task Force Activities During 2003, the Task Force met four times to plan activities and update members as the season progressed. In August, Barbara Bauman joined the Task Force as a representative from Eagle Brook Church. Eagle Brook Church, with the assistance of the Rice Creek Watershed District is considering the establishment of a conservation easement for 16.7 acres of the property on the east shore of Peltier Lake. The easement area would include the "stick field" where the herons collect nesting material. The church will also work with the Task Force to develop a natural resource management for the easement area. The city of Lino Lakes hosted a meeting on March 29th for citizen volunteers who were advised how to monitor heron activity and where to report violations of the no -wake zone or disturbance to the heronry. In addition, the city sponsored a student intern from the University of Minnesota under the Community Assistance Program. Keely Dinse assisted us through the summer in the field with monitoring and spent considerable time compiling a compendium of information on the history of the colony, management actions, Task Force minutes, and related scientific literature. This compendium is available for review at Lino Lakes city hall — contact Marty Asleson. Recently, personnel from the DNR's Nongame Wildlife Program submitted a research grant proposal to the DNR in partnership with Anoka County Parks and the City of Lino Lakes. The proposal, entitled " Monitoring, Research and Management to Assess the Status of an Urban Population of Select Colonial Waterbirds and to Restorele a Multi- Species Breeding Colony" would cost $74,620.00 with a request for $44,080.00 in grant monies. Should the grant be funded, Peltier heronry is one of five sites on which work would be focused. Final decision on this request in pending and competition for the funds is great. Fieldwork in 2003 included a mid- winter nest survey conducted with 8 observers on Feb 27, 2003. This survey, conducted after the breeding season, reflects the nesting activity of the summer 2002. The survey team counted 284 intact nests and 23 partial nests. This count was in line with estimates from aerial surveys of a maximum number of 300 -400 adult Great Blue Herons in the colony during the 2002 breeding season. While an estimated 50 Great Egrets were noted in the colony on the 4/9/02 aerial survey, only 4 or 5 pairs remained to nest at this site in 2002, as noted in last year's report. This past spring and summer 2003, was an active period with many individuals keeping watch over this colony. The first reports of Great Blue Herons returning to Peltier Lake were submitted by Wayne LeBlanc on 3/15/03, Glenn Fuchs from Anoka Co. Parks reported to Art Hawkins that he had seen about 30 birds at nests on Sunday 3/23. Keely Dinse saw at least 20 Great Blue Herons on the island on March 24th and Rebecca Pecchia reported an estimated 60 to 70 Great Blue Herons over the island on March 30th. Clearly, the herons had returned to the nest site during the last weeks of March. The first reported Great Egret was noted in the Twin Cities area at Diamond Lake in Minneapolis on March 20, 2003. Ron Marier reported seeing his first Great Egret over Peltier Lake the morning of April 6th. On April 13th, Wayne LeBlanc noted two Great Egrets landing on the island. A crew from Anoka County Parks again provided nest material for the herons at the stick field. Art Hawkins began monitoring the "stick field " on April 15t`. A large number of Great Blue Herons were observed gathering nesting material through the remainder of the month. Mr. Hawkins monitored this site through June 19th. He noted that the birds' behavior changed about May 7th when he observed as many birds leaving the colony (presumably to gather food) and not going to the stick field as were visiting the stick field. Glenn Fuchs also monitored the birds coming and going when they traveled west from the island into the Park for nesting material or other activities. Mr. Hawkins also noted, for the second year, an absence of the plunge diving feeding behavior that he had first observed as a prevalent foraging strategy in the late 1990s. DNR biologist Steve Kittelson conducted the first aerial survey of the Peltier Island colony on April 29th. He estimated 300 -350 active Great Blue Heron nests and also observed 3 active Great. Egret nests. Subsequent aerial assessments occurred on May 13, June 3, and July 1st. In all cases, things appeared to be proceeding normally. Mr. Kittelson reported 12 active Great Egret nests observed on the June 3rd aerial survey for the maximum number of pairs of this species believed to have occurred in the colony this year. We added a new aspect to the colony monitoring this season by employing a tree climber to assess nesting activity from tree top level. The climber and field team first visited the colony on May 29, 2003. The climber went to the top of five trees and was able to directly observe a total of 55 nests, including three Great Egret nests. He noted birds active in 32 of the 55 nests he observed, for an occupancy rate of 58 %. Two of the three egret nests contained eggs, the third had an adult in incubating posture. Many of the heron nests had chicks that were noticeably different in size from nest to nest indicating a range of ages. Colony monitoring indicated much activity by the birds during the month of June. This is in stark contrast to 2002 when then site had been abandoned by June 4, 2002. Glenn Fuchs reported, " On Sunday 29 June and again on Wednesday 2 July, Art H. and I conducted simultaneous observations of the activity on the island concentrating on flights to and from the island. On both days were observed flights averaging about one flight per minute over the course of a one hour time period." On June 20th, 2003, Steve Kittelson conducted a field visit to 15 trees and made observations of bird activity from below the trees. In these trees he observed 40 nests, 20 of which were occupied by Great Blue Herons with 33 live young and 4 dead young. He also observed three active Great Egret nests with 5 young. The remaining 16 nests were seemingly empty, although some occurred in trees below which there were eggshells or whitewash indicating hatching or the presence of young earlier in the season. The question then becomes, were young hiding in the nests and unobservable or had they already fledged (grown sufficiently to have flow away) or walked away from these nests as he approached? We do not know the answers, but June 20th seems just too early for successful fledging. Also, on June 20th, the resident pair of eagles was present over the colony and Steve noted one eagle young in the nest during his visit. None of the observers who watched the colony during the season ever reported any negative interactions between the eagles and herons or egrets. An aerial survey on July 1st indicated 100 —150 active heron nests and 3 -5 broods of Great Egrets present on the island. Empty nests were also noticeable from the air. The field team, including the climber, also visited portions the colony on July 3rd and the 10th. The field visit on the 3rd revealed that some portions of the colony were no longer active and nests were empty of young or adults. However, 20 young herons at the stage of short flights or "branching " were observed in one area east of the eagle nest. On July 10th, the climber and crew returned to the colony and checked nests that could be seen by the climber from the top of 4 trees. All 37 nests that the climber could see into from his tree top position were empty of live birds except one with one young Great Blue Heron. Eleven of the nests had at least one visible carcass. The field crew noted the presence of 18 herons flying, both adults and young of the year. It appeared as if most adults and young had left the colony. There would have been sufficient time for young herons to have successfully fledged by this date. We conclude from all these observations that at least some of the 300 + pairs of Great Blue Herons and a few of the 12 Great Egret pairs successfully nested at the Peltier Island colony this year. Please recall that at its maximum size in 1996, however, that this colony was home to an estimated 1100 pairs of three nesting species including an estimated 250 pairs of Great Egrets and at least 12 pairs of Black- crowned Night Herons. The No -Wake Zone Human disturbance — boats and aircraft Wayne LeBlanc reported all ice was off the lake by April 12th and that the buoys were in the water demarcating the no -wake zone. This year, the no -wake line was set in place well before the Memorial Day influx of boaters to the lake. The information sign at the boat launch and the no trespass signs on the island were in place in a timely manner as well. A lakeshore resident reported people on the island on May 17`x'. For the most part, however, boaters seemed to respect the no -wake speed limits and the no trespassing restrictions on the island. Compliance with the no -wake zone was apparently good and no observations of speeding boats scaring herons were reported. Helicopters were twice noted over the lake by observers. Seaplanes seemed to be complying with the request not to use Peltier Lake and apparently have relocated their training activities to Big Marine Lake in Washington Co. The DNR received a report in early July of increased seaplane use of Big Marine Lake with the consequent death of loons which were reportedly being "runover" by the planes. This report of loon mortality is unconfirmed. In September, we had a request from DNR Forestry to use the lake for firefighting planes to scoop water if needed. Because the birds had finished nesting by this date, we concluded that such plane activity would not be a problem in late summer or fall. Water Quality and Aquatic Vegetation The water depth north, west and east of the island is shallow, being roughly 1 meter. (3 feet) deep. Consequently, the submergant aquatic plants in this area are extremely vulnerable to disturbance from high speed boat traffic. This disturbance has been documented on aerial and other photos from previous years showing a roughly 2,000 foot by 200 foot area of reduced native aquatic vegetation north of the island where the slalom water -ski course was previously located. Observations in the summer of 2003 show native plants beginning to return to that area. We believe that the no -wake zone restricting boat speeds has been crucial to the recovery of these aquatic plants. The sediments in this shallow area of the lake are very fine mud. Pulling a water quality device called a secchi disk from the bottom in this area of the lake results in a large cloud of black sediment rising to the surface. High -speed boats in this shallow water suspends those sediments causing nutrients to enter the water column (These nutrients would normally stay in the sediments). Water quality is diminished when nutrients and sediments spread throughout the water column. Water clarity (visibility) in Peltier Lake in 2000 through 2002 was noticeable poor. Task Force members noted that visibility in the lake was better in 2003 then in the three previous seasons. It was noted in the November Task Force meeting that a preliminary review of the water quality data on file for this lake indicated a marked increase in phosphorus levels in Peltier Lake first recorded in July 1998. The effect of the no -wake zone in reducing boat speed and the consequent impacts to water quality and aquatic vegetation seem positive as evidenced by the improving ecology of the lake and the behavior of the herons and egrets. Preliminary information from the 2003 season indicates noticeable improvements in water quality with the no- wake zone in place. Further monitoring and assessment will continue in 2004 and beyond. This ordinance has been very effective in helping to protect and improve the unique natural resources on the north half of Peltier Lake, particularly the Peltier Island Heron Rookery. Unfortunately, this ordinance is scheduled to expire on September 1, 2004, unless further action is taken by the City Council to make the ordinance permanent. On behalf of the Peltier Lake Heron Task Force and based on the proven efficacy of the "Slow /No Wake Zone" ordinance, we are respectfully requesting that the Lino Lakes City Council amend the ordinance and remove the last sentence in Section 8 of Ordinance No. 03 -02 which currently states "It shall be repealed automatically on September 1, 2004 ". The removal of this sentence should result in changing ordinance 03 -02 to a permanent status and will help sustain and conserve the unique natural resources on and surrounding Peltier Lake in perpetuity. In 2003, several noticeable improvements were documented as a direct result of the "Slow /No Wake Zone ". First, over 300 pairs of Great Blue Herons and at least 12 pairs of Great Egrets returned to Peltier Island for nesting. Many of the birds were successful in raising their young. Secondly, water quality has improved in 2002 and 2003 since Centerville Lake's worst year on record in 2001. Thirdly, observations in the summer of 2003 indicated an increase in beneficial native aquatic plants around Peltier Island, especially in the area north of the island. Please refer to the attached 2003 Peltier Island Heron Rookery Summary Report for more specific details. Clearly, implementing the "Slow /No Wake Zone" ordinance as a best management practice has been an effective tool in our combined efforts to sustain the unique biological systems on Peltier Lake and the surrounding area. Therefore, we believe that if Ordinance No. 03 -02 is allowed to expire, there will likely be multiple negative implications that will result in an overall decline of the natural resources in and surrounding Peltier Lake. Thank you for your commendable leadership in establishing Ordinance 03 -02 two years ago. The Peltier Lake Heron Task Force appreciates your consideration and vision in making Ordinance No. 03 -02 a permanent measure. MLA is a statewide non - profit dedicated to citizen stewardship of Minnesota waters and development of public policy for lake protection. MLA represents over 60,000 lake user interests in Minnesota, including over 250 lake associations. Our concern stems from the following facts. High speed boat use in shallow areas of the lake will destroy the aquatic vegetation, which is already happening as is evidenced by photos. Healthy aquatic plant communities support fish and other aquatic life that are important to the healthy functioning of the lake. It also stirs up lake sediments releasing nutrients into the water column which will adversely impact the lake ecology and water quality and adversely impacts the nesting ability of the high quality wildlife resources in the adjacent shore areas. We recommend, as a matter of policy for both the city and the county, that high speed boat traffic be prohibited in lake areas less than five feet in depth and where healthy aquatic plant communities are established. Having such a policy will help protect Peltier Lake as well as help to address the inevitable future water surface conflicts that will arise on other waterbodies within your jurisdictions. In summary, the Minnesota Lakes Association hopes that Anoka County and the City of Lino Lakes will keep the present no -wake zone on Peltier Lake and at the same time put this decision into the context of a county -wide surface water management policy that is fair and balanced to sustain your valuable lake resources. The property owner is proposing to build a new house and wants to make use of the east portion of his property which has the 30' road easement and the required 30' setback on it. The property to the east also has a 30' road easement for a total of 60'. These easements were on the original plat o f Equity Estates. Road easements also exist on the properties to the south. The City's Transportation Plan shows Holly Drive in this area as a recommended connection from 12th Avenue to Centerville Road and also south to County Road J. The 30' easement would connect Karth Road with the existing paved portion of Holly Drive that currently ties into Centerville Road. The original owners of the property received a variance in 1981 from the City to install the driveway on the 30' road easement. In a letter dated June 18, 1981 from the project engineer, it states the property owner "should realize that a City Street could be constructed in this road easement at a future date ". Staff has reviewed the road easement and concurs with the original design that a future road could be constructed and would connect to the City's Transportation Plan. Staff is recommending that the request for vacation of the road easement be denied. OPTIONS: 1. Deny vacation of 30' Road Easement at 1390 Karth Road. 2. Retum to staff for further consideration. As part of the project, the lift station was relocated from the west side of Black Duck Drive to City owned property on the east side of the street. The old location was a 30' x 30' parcel obtained in 1972 when the station was constructed. As shown in the attached diagram the parcel extends into the adjacent single family residential lot. With the removal of the lift station the parcel is no longer needed for public purposes. The parcel is not of sufficient size to accommodate any future development. To relieve the City of any future maintenance responsibilities staff is requesting that ownership of the parcel be transferred to the abutting residential property. However, staff is recommending that the City retain a 10 foot drainage and utility easement over the easterly 10 feet of the parcel consistent with the existing easements Tying north and south of the property. City staff has discussed the transfer with the adjacent property owner. They have expressed their interest in the parcel to remove the "notch" in the property. Preparation of the plans is substantially complete, including reviews by the Rice Creek Watershed District, and Anoka County. City staff has prepared the plans and specifications for this work and is requesting Council approval to advertise for bids. The project schedule is as follows: May 10, 2004 June 3, 2004 June 14, 2004 October, 2004 Approve Plans and Authorize Advertisement for Bids Open Bids Consider Award of Contract Substantial Completion of Construction The project cost for the Hodgson /Birch Improvement project is $650,000.00. An additional $50,000.00 is included for constructing trails at the Birch Street/Hodgson Road intersection as per the 2004 Park Board Goals approved by the City Council on March 22, 2004.
