RESOLUTION NO. 26-152
APPROVING A WATER TOWER LEASE AGREEMENT WITH NEW CINGULAR
WIRELESS PCS, LLC
WHEREAS, the City of Lino Lakes owns and operates the George Watch Lake Water Tower
located at 7470 4th Avenue; and
WHEREAS, New Cingular Wireless PCS, LLC, an AT&T affiliate, has requested to lease interior and
exterior space on the water tower and a 720 square foot ground area for the installation and
operation of wireless communications equipment; and
WHEREAS, the proposed Water Tower Lease Agreement provides an initial five year term
followed by four automatic five year renewal terms, a maximum potential term of 25 years; and
WHEREAS, New Cingular Wireless PCS, LLC will pay the City $2,500 per month, with rent
increasing 7.5 percent at the beginning of each renewal term; and
WHEREAS, New Cingular Wireless PCS, LLC is responsible for its installation and operating costs,
and City operations retain the highest priority under the agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes, Minnesota that the Water
Tower Lease Agreement with New Cingular Wireless PCS, LLC and the related Memorandum of
Lease are approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute the Water
Tower Lease Agreement and Memorandum of Lease in the forms presented to the City Council,
subject to final legal and administrative corrections that do not materially alter the approved
terms.
BE IT FURTHER RESOLVED that City staff are authorized to take all actions necessary to administer
the agreement and carry out the intent of this resolution.
