Adjourn Revised 10/18/04 ajb 9:35 a.m. PAGE 1 WS -1 WORK SESSION MEMORANDUM To: City Council From: Michael Grochala Date: October 20, 2004 Re: Work Session Item No. 1 cc: Residential Airplane Hangars As you are aware City staff has been working with Milo Bennett, Centennial Fire Chief, to identify options to resolve the airplane hangar sprinkling issues associated with the Lino Air Park and Century Farms North developments. The City received an interpretation from the State Building Codes office regarding this issue (attached). The City operates under the Minnesota State Building Code which includes the International Building Code (IBC) and as a subset the International Residential Code (IRC) which deals with one and two family residential structures. As stated in the interpretation provide by the state, if the hangars are constructed under the IBC, which defines residential hangars as having a maximum size of 2,000 square feet, then the limitations set forth in that code would apply. However, the definition of accessory structures within the IRC does not differentiate between residential accessory buildings and aircraft hangars. Under such interpretation residential hangars would be treated the same as other residential accessory structures (i.e., garage, pole barn etc.). Based on the state's comments and concerns raised by the Lino Air Park staff will move forward with permit reviews based on the IRC. This will allow for hangar construction without the installation of sprinklers. However, it should also be noted that this interpretation also eliminates more stringent requirements for fire separation setbacks and fire wall construction. Staff will also continue to work with the Centennial Fire Department to seek an amendment to the next building code that clarifies this issue. No further action by the council is required. The codes as we read them defined a residential hanger as having a maximum of 2,000 square feet. We had checked with several people in both the state building department and the state fire marshals office and got the same answer. A letter and e -mail was sent to the State Building Official asking for a variance and an amendment to the next code adopted. An e -mail was received back that said if the hangers are built under the residential code they would not be considered a commercial building and therefore would not be required to be sprinkled. This interpretation, I believe, solves the issue with the residential hangers. It removes the requirement for sprinkling the hangers and still keeps the sprinkler requirements in place for commercial buildings. This will not require the City Council to take any action on matter. We should still seek an amendment to the next building code adopted by the state that defines a residential hanger to have a maximum size of least 3,200 square feet.
