City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. Motion was supported by Mr. Laden. Motion carried 4 - 0. 4. OPEN MIKE Acting Chair Hyden declared Open Mike at 6:31 p.m. There was no one present for Open Mike. CONTINUED PUBLIC HEARING to consider a Rezone to Planned Unit Development and PUD Development Stage Plan/Preliminary Plat for a mixed density residential development (222 single family lots and 85 unit multi-famil ._ __I _ __ _ _ _ _ _ _ _ _ _ _4h Ave. S (CSAH 54) and Cedar Street Katie Larsen, City Planner, presented the staff report. Staff recommended approval of the PUD Development Stage Plan/Preliminary Plat and Rezone. Mr. Laden excused himself from this issue based on a conflict of interest. Board members discussed the proposal with staff. Discussion included: - Traffic and safety issues — turn lanes are needed. - Traffic study was reviewed by the city engineer. - Existing trees and shrubs in the right of way should be removed for sight safety. - Drainage issues were addressed and need to be improved. - The City is working through specific grading issues. - The City will want to review a noise analysis prior to final plat approval. Developer, Larry Olson, AJE Companies, was present. Mr. Olson stated that they are working with the city to address all concerns and he has no issues with the list of conditions of approval. Acting Chair Hyden declared the Public Hearing open at 6:58 p.m. Sharon Pignato, 6709 20th Ave S., asked about the timeline of this development. Staff explained the proposed phasing plan. Ms. Pignato stated that they moved to Lino Lakes for its commitment to being rural. She said their road is not designed for extra traffic and expressed concern for safety of children. She stated concern that turn lanes would be in her front yard. She asked about zoning laws. Staff noted that the area is guided for medium density and this development would be consistent with the city's comprehensive plan Ms. Pignato was concerned about traffic, noise and safety on the road. She was additionally concerned about traffic on County Road J and Birch St. Julie McNeely, 6687 20th Ave., was concerned that proposed driveways will direct headlights right into her windows. She was concerned for her quality of living. She wondered if landscaping could help to mitigate the lights. Mr. Evenson made a MOTION to close the Public Hearing at 7:10 p.m. Motion was supported by Mr. Root. Motion carried 4 - 0. Board members discussed traffic issues and asked if the developer could include some landscaping that could mitigate the effect of headlights shining into existing homes. DRAFT MINUTES Planning & Zoning Board February 12, 2014 Page 3 Staff responded that the City cannot require the developer to take action on another person's property. The board strongly suggested that the developer work with the neighboring property owners to discuss landscaping on the existing lots to reduce headlights into the homes Mr. Root made a MOTION to recommend approval of the Rezone and Preliminary Plat based on the following conditions: 1. All comments from City Engineer letter dated February 7, 2014 shall be addressed. 2. All comments from Anoka County Highway Department dated January 24, 2014 shall be addressed. 3. All comments from MNDOT letter dated December 5, 2013 shall be addressed. 4. All comments from Environmental Coordinator letter dated February 3, 2014 shall be addressed. 5. The Phasing Plan for development shall be incorporated into the plan set and listed on the Sheet Index. 6. The Phasing Plan identifies 215 lots, however; the preliminary plat indicates 216 lots. The Phasing Plan shall be revised. 7. The Floodplain Exhibit shall be incorporated into the plan set and listed on the Sheet Index. 8. A Letter of Map Revision (LOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any building permits for parcels located within the floodplain. 9. Temporary cul de sacs shall be required where a street is terminated pending future extension. 10. Drainage and utility easements shall be dedicated over stormwater drainage areas. 11. Drainage and utility easements or conservation easements shall be dedicated over wetland buffer areas. 12. Sheet 6, Preliminary Plat: a. Lot 1, Block 8 and Lot 9, Block 10 shall be revised to omit the portion of Outlot G that extends to Street I and a 20 feet easement shall be provided over the storm sewer utility. b. Lot 1, Block I and Lot 1, Block I I shall have a 15 foot wide easement abutting CSAH 54 for landscape buffer. 13. Sheet 9, Ghost Plat: a. The City suggests future access through Outlot E if feasible. The current proposal creates a disconnect within the development. 14. Sheets 10 & 11, Preliminary Site & Utility Plan: a. Front and rear setback line for 65'-70' wide lots shall be shown as 25 feet. Building pads may remain designed at 30 feet. b. Rear setback line for 50' wide lot shall be shown as 25 feet. Building pads may remain designed at 30 feet. 15. Sheet 14, Preliminary Grading & Erosion Control Plan: a. The garage location shall be reversed to meet the 5 foot side setback on Lot 7, Block 8 and Lot 22, Block 7. City will require tree escrow and will install boulevard trees. 18. Sheet L3, Planting Plan Buffer Enlargement: a. Please verify landscape buffer plantings are allowed in NSP easement. 19. Sheet L4, Planting Plan: a. Outlot G shall be added to the Open Area Landscape calculations. b. 245 Boulevard Trees are required but the Plant Schedule adds up to 244. Please revise. c. The Schedule for Buffers and Open Areas should be separated. d. The Schedule for Open Space and Replacement Trees could be combined. 20. PUBLIC HEARING to consider a Rezone, Preliminary Plat and Final Plat for a three -lot residential subdivision to be called Talan Ridge located at 260 Linda Avenue ILI& Katie Larsen, City Planner, presented the staff report including a history of the parcel. Staff recommended continuing the public hearing to allow the developer to further address drainage, landscaping, and stormwater management. Staff explained that the proposal includes one Preliminary Plat with three lots, but two future Final Plats. Patrick Judge, Avenger Home Solutions, Inc., 3128 Priest Lane, Mound, MN 55364, is proposing to subdivide the parcel into three lots. He is very sensitive to redevelopment and sensitive to development what matches the community. The house that is there now will be renovated. The second and third homes will be built consistent with the neighboring homes. Mr. Judge understands that they will need to delineate the wetland in the spring. Acting Chair Hyden opened the Public Hearing at 7:35. John Grundhofer, 235 Linda Ave., discussed the history of the sewer installation in the area. Mr. Grundhofer stated that this development would disrupt the look of the entire street by adding additional houses there, noting that the residents are not in favor of it. DRAFT MINUTES Planning & Zoning Board February 12, 2014 Page 5 Judy Brunner, 270 Linda Ave., stated that the City had no intention of developing this area. She stated that these additional properties would change the character of the neighborhood immensely. She stated concern for the existing high water table and flooding issues. She stated that the wetland has been abused by previous property owners. She was concerned that the proposed development would increase the already existing drainage issues. She stated that the proposal is out of character with the area. Paul Whaley, 6200 Laurene Ave., distributed a comment and photo from the neighbor at 250 Linda Ave. He stated that his concerns were similar. He stated that the proposal would not look right with the existing beautiful rural properties currently on this road. He stated that this development would affect his property, stating that three new houses is too many for the wetland. He was concerned about drainage and additional flooding issues. He stated that he has lived there for 13 years and his sump pump runs every spring. He was concerned about water runoff. He noted that the existing house would not fit in with brand new homes on either side. Tom Brunner, 270 Linda Ave., discussed history of the wetland. He was concerned about drainage and flooding issues. He stated that the pond is misrepresented on the submittal. He stated that he has contacted the city many times regarding flooding with no results. He said that a storm sewer is necessary. He is concerned about neighboring property values. He urged that the board look at this area very carefully. He considers three houses to be too many for drainage and aesthetic reasons. Brady Mullins, 6227 Laurene Ave., stated concern for existing flooding issues, noting that his driveway is flooded every year and his basement gets wet in the spring. He was concerned about standing water in this area with no drainage. He pointed out that the proposed lot sizes are not consistent with this area. He asked that the city not take a rural development in the middle of a road and make it residential. He would prefer to see only two houses on the property, but not three. He stated that the proposal does not match the neighborhood and will look out of place. He was also concerned about headlights directed into his house. John Grundhofer, 235 Linda Ave., stated that when this property went up for sale recently, the realtor advertised it as three lots, therefore the developer thought it would be three lots and could be three homes. Jason Wedel, City Engineer, stated that this proposal does not include curb and gutter or street improvements. He noted that drainage concerns are the reason why staff is recommending continuation of this item, stating that there are issues for the engineering department to address. Mr. Wedel pointed out that record drawings from the construction of Linda Ave. show that the street was designed to include sewer and water service to all lots on the road. This is a three (3) lot residential subdivision located at 260 Linda Avenue and is legally described as the east 290.00 feet of Lots 3 and 4, Block 2 Arthur E. Thom Acres. 1 History Arthur E. Thom Acres was originally platted in 1949. A minor subdivision to subdivide 250 Linda Avenue (Lots 3 and 4, Block 2, Arthur E. Thom Acres) into two (2) residential lots was approved in 1997. A preliminary and final plat for Collova Addition proposing to further subdivide Lots 3 and 4, Block 2, Arthur E. Thom Acres into a total 6 residential lots was submitted in 1998 by PC Collova Builders, Inc. The application was withdrawn by the developer. New homes were constructed on 250 Linda Avenue and 6200 Laurene Avenue in 2000. A residential home currently exists at 260 Linda Avenue. The preliminary plat creates one (1) new lot to the west and one (1) new lot to the east of the existing home. A public hearing was held by the Planning & Zoning Board on February 12, 2014 and continued to March 12, 2014. The final plat will not be approved with the preliminary plat and a Land Use Application for the final plat will be required. The Planning & Zoning Staff Report dated February 12, 2014 precedes this report. The following staff report is based on the revised Plan Set dated February 4, 2014 prepared by Mattke Surveying & Engineering, Inc. and received by the City on February 5, 2014. The neighborhood also varies in lot size, dimension and building footprint square footage. 3. The proposed use conforms with all performance standards contained herein. The subdivision meets all zoning and subdivision ordinance requirements and performance standards in regards to lot size, width and length. A wetland delineation is required to verify the area of Lot 3 meets the minimum lot size of 10, 800 square feet. It is proposed the first final plat, Talan Ridge, will create Lot I and Lot 2. After delineation and RCWD approval, Lot 2 will then be final platted again (Talan Ridge Second Addition) into 2 more lots. This will create a total of 3 lots. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. The current residence at 260 Linda Avenue is on private well and public sanitary sewer. All three (3) lots will be required to connect to public water and sanitary which is capable of handling three (3) single family homes. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. No new boulevard trees are required. Tree Preservation and Mitigation Standards The Tree Preservation and Mitigation Plan identifies the general boundary of tree stands, species and Basic Use Area. There are no Environmental Sensitive Areas on site. The developer shall submit a complete Tree Preservation and Mitigation Plan in full compliance with the tree preservation and mitigation ordinance prior to approval of the final plat. Fencing, tree preservation measures and erosion control shall be installed by the developer and inspected by the City prior to any soil disturbance. Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The preliminary plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The subdivision is not considered premature, is consistent with the comprehensive plan for residential development and meets the performance standards of the subdivision and zoning ordinance. The parcel is guided low density residential per the City's Comprehensive Plan which allows for 1.6 to 3.9 dwelling units per acre. The proposed residential development at 2.27 units per acre is consistent with the Comprehensive Plan's guided land use and density. Blocks and Lots The proposed preliminary plat creates 1 block with 3 lots. Lot 2, Block 1 has an existing home. Lot 1 and 3 are intended to be developed with single family homes. Since the delineation of the wetland is critical in verifying that the area of Lot 3 meets the minimum lot size of 10,800 square feet, it is proposed the first final plat, Talan Ridge, will create Lot 1 and Lot 2. After delineation and RCWD approval, Lot 2 will then be final platted again (Talan Ridge Second Addition) into 2 more lots. This will create a total of 3 lots. Streets and Alleys Linda Avenue is an existing local road and can accommodate two (2) additional single family homes. Co Easements Standard drainage and utility easements will be required around the interior perimeter of the lots. A drainage and utility easement a minimum of 10 feet beyond the storm water management basin's 100-year storm high water level elevation and 10 feet around the wetland boundary will also be required. Storm Water Management and Erosion and Sediment Control Soil borings were completed by Mattke Surveying & Engineering, Inc. to determine the depth of the water table. The proposed lowest floor elevation is 902.0 which provides a minimum 6 feet of separation. A ponding area will be constructed in the rear yard on Lot 1 and Lot 2 to manage storm water drainage from the site. A drainage and utility easement a minimum of 10 feet beyond the basin's 100-year storm high water level elevation will be required. The bottom of the proposed pond is shown to be at 898 and therefore does not meet the 3 foot separation required for an infiltration pond. The developer will need to either line the pond with clay so that it doesn't infiltrate or adjust the pond design so that the pond bottom is at an elevation of 899 and still accommodates the required volume requirements. The grading plans have been revised so drainage is not being directed onto the adjacent properties to the east or west. Storm water is being directed to Linda Avenue, the ponding area or to the wetland via swales graded along the lot lines. Appropriate soil erosion and sediment controls shall be employed during construction of the single family homes. Utilities The current residence at 260 Linda Avenue is on private well and public municipal sanitary sewer. All three (3) lots will be required to connect to public water and sanitary which is capable of handling 3 single family homes. The existing well shall be properly capped and abandoned or disconnected from the house if used for irrigation purposes prior to the issuance of any building permit. 7 Public Land Dedication The City will require payment in lieu of land dedication for purposes of public land dedication. Since this is an existing lot with 1 home, fees will be required for the two (2) newly created lots. 2 lots x $2,500 payment in lieu = TOTAL $5,000 Preliminary and Final Plat Originally, staff was recommending the preliminary and final plat be reviewed and approved together but we are now only recommending approval of the preliminary plat. A Land Use Application for final plat shall be required. The developer will then enter into a Development Contract and other documents as the City deems necessary. Since the delineation of the wetland is critical in verifying that the area of Lot 3 meets the minimum lot size of 10,800 square feet, it is proposed the first final plat, Talan Ridge, will create Lot 1 and Lot 2. After delineation and RCWD approval, Lot 2 will then be final platted again (Talan Ridge Second Addition) into 2 more lots. This will create a total of 3 lots. Comprehensive Plan The proposed three (3) lot residential subdivision for the construction of two (2) single family homes for Talan Ridge is in compliance with the Comprehensive Plan in terms of Resource Management System, Land Use Plan, Housing Plan, and Transportation Plan. The parcel is guided low density residential per the City's Comprehensive Plan which allows for 1.6 to 3.9 dwelling units per acre.
