Gordon: I am responding to your request for my opinion on whether or not the city council can enter into a joint powers agreement and make financial contributions thereunder when such JPA gives budgeting control to a board of directors established in the JPA. My legal opinion is that this is permissible. Under the Lino Lake City Charter, Section 7.01 the city council has full authority over the financial affairs of the City. Under Minnesota Statute 471.59, state law allows governmental bodies to enter into joint powers agreements to jointly and cooperatively exercise any power common to each governmental unit. This state law also provides that the parties to the agreement may provide for disbursements from public funds and that such funds may be paid to and disbursed by the JPA organization as may be agreed upon between the joint powers participants. Clearly the state statute contemplates transfer of City funds to the JPA organization. The decision to join the organization and make financial contributions is done by the City Council. I do not read Section 7.01 of the Charter as being so broad as to require City Council approval of a JPA boards budget decision in order to be a member. The act of reviewing and approving the JPA along with knowledge of the financial obligations the JPA will impose upon the City satisfies Section 7.01 of the charter. The CSAH 14 Corridor has become relied on as a primary route between I -35W and I -35E, but was never intended to handle the anticipated traffic for this use. Our joint study on CSAH 14 documented the need for this bypass to avoid the detrimental affects of added traffic on this existing corridor through a very environmentally sensitive area in the Rice Creek Chain of Lakes Regional Park. Thank you for your consideration of this very significant transportation improvement within the 2008 appropriations cycle. Sincerely, John Bergeson Mayor, City of Lino Lakes WS -2 WORK SESSION MEMORANDUM To: City Council From: Michael Grochala Date: March 5, 2006 Re: Work Session Item 2 I -35W /Lake Drive Improvement Project PROJECT STATUS Design Final Design for the project has been completed and submitted for Mn /DOT for final approval. Staff will be requesting council approval of the plans and specifications and authorization to advertise for bids at the March 12 City Council meeting. The project schedule is proposed as follows: City Approval of Plans & Specs/ Advertise for Bids Bid Opening City Awards Contract Start Construction Substantial Completion Final Completion March 12, 2007 April 13, 2007 April 26, 2007 May, 2007 June, 2008 October 2008 We have reached agreement with Mn /DOT on the aesthetic design of the bridge. The bridge exterior will include a "cracked" granite block relief with a three color stain applied. The east side of the bridge, adjacent to the trail, will include a iron railing matching the existing railing within the Woods Edge Development. A graphic of the bridge design will be available at the work session. Streetscaping options on Lake Dr are somewhat limited, but where applicable we are carrying forward design elements from the Legacy at Woods Edge project. Landscaping efforts are being concentrated around the two ponds adjacent to the Marshan Lane residential area in accordance with the council's previous direction. 1 Right of Way Acquisition A total of sixteen (16) parcels are affected by the project. The total appraised value of the right -of -way to be acquired is approximately $1,300,000. Offer letters, accompanied with a copy of the property appraisal, was distributed to property owners as of September 27, 2006. We have reached agreement for direct purchase on 15 of the 16 parcels. Settlement transactions have been completed on 13 of these parcels. Two parcels have closing dates set for the next two weeks. Therefore it appears that only one parcel will be subject to eminent domain proceedings. The District Court has previously approved the public purpose of the acquisition and established a March 15th possession date. Funding The estimated project cost is approximately $10,350,000. This estimate includes all anticipated costs (engineering, legal, construction, land acquisition) as well as approximately $800,000 for contingency purposes. The City's share of the project cost is approximately $5.5 million. The City previously identified approximately $2.5 million as part of the Legacy at Woods Edge project. The remaining funding sources proposed include the Trunk Highway 49 Turnback funds ($955,000) and the use of Municipal State Aid Street funding. City staff is working with Springsted Inc., and Kennedy & Graven to complete the financing package. COUNCIL DIRECTION None Required. Staff will be available to address project related questions in preparation for consideration of plan approval and bidding. 2 WS — Item 3 WORK SESSION STAFF REPORT Work Session Item 3 Date: Council Work Session, March 5, 2007 To: City Council From: Gordon Heitke Re: Updated ATV /Snowmobile Ordinance Background Chief Pecchia is drafting an updated ordinance regulating the use of all- terrain vehicles (ATVs) and snowmobiles within the City of Lino Lakes. Staff will be discussing the impetus for this update as well as some alternative ordinance provisions. It is intended that the draft new ordinance will be ready for Council consideration in the near future. Requested Council Direction Staff is seeking some general direction from the Council on the provisions of the new ordinance. 1 WS — Item 4 WORK SESSION STAFF REPORT Work Session Item 4 Date: Council Work Session, March 5, 2007 To: City Council From: Gordon Heitke Re: Crime -Free Multi- Family Housing Ordinance Background With the approval of a new rental apartment building in Lino Lakes, the Police Department and Community Development Department are being proactive by developing an ordinance directed at rental properties for the purpose of preventing criminal activity. A general overview of the intent and content of the ordinance will be discussed. It is intended that the draft new ordinance will be ready for Council consideration at a future meeting. Requested Council Direction Staff is seeking any direction that the council may wish to provide in the development of this ordinance. 1 WS — Item 5 WORK SESSION STAFF REPORT Work Session Item 5 Date: Council Work Session, March 5, 2007 To: City Council From: Gordon Heitke Re: VLAWMO JPA Issues Background As briefly discussed at the February 26 Council work session, some questions have emerged related to the recently approved VLAWMO JPA. During discussions of the draft JPA, it was indicated that member units would be approving the VLAWMO annual operating budget. The Board of Water and Soil Resources, the overseeing state agency, is taking the position that the VLAWMO Board is to have the authority to approve the budget. Council member Carlson has questioned as to whether that could be allowed under the provisions of the Lino Lakes Charter. Staff is also now concerned as to whether member units will have approval authority on capital improvement projects. Staff will provide an update at the meeting. Requested Council Direction Any Council direction is pending the updated information available at the time of the work session. 1 WS — Item 6 WORK SESSION STAFF REPORT Work Session Item 6 Date: Council Work Session, March 5, 2007 To: City Council From: Gordon Heitke Re: 2007 Goals Setting Session Background The Lino Lakes City Council establishes its annual goals early in the calendar year. In order to save on facilitation costs, staff is suggesting that the Council schedule the goals setting session for March 28 or March 27 as an alternate date. Requested Council Direction Staff is seeking a date for the 2007 goals setting session. 1
