ADMINISTRATION DEPARTMENT REPORT, Dan Tesch A) Miller's on Main Special Event i. Request for variance from state fire code, Gordon Heitke Action Taken: Motion by Stoltz, seconded by Carlson, to endorse the state fire code variance request acting in good faith and based on the following criteria, was adopted by a voice vote (Council Member Reinert absent): - there is substantial compliance with the provisions of the code; - the safety of the public and occupants of such building will not be jeopardized; - undue hardship will result to the applicant unless such variance is granted Pg 34 -35 Pg 36 -59 Pg 59a -i ii. PUBLIC SAFETY DEPARTMENT REPORT, Dave Pecchia None 5. PUBLIC SERVICES DEPARTMENT REPORT, Rick DeGardner None COMMUNITY DEVELOPMENT REPORT, Michael Grochala A) Consider Resolution No. 07 -74 approving a Variance to the Pg 62 -66 local street setback for a porch addition at 8020 Danube Street, Paul Bengtson Action Taken: Motion by Carlson, seconded by Stoltz, to approve Resolution No. 07 -74 as presented, was adopted by a voice vote (Council Member Reinert absent) B) Consider Resolution No. 07 -75 approving an Amendment to a Pg 67 -75 Conditional Use Permit to allow the construction of an office building at 415 Lilac Street (Molin Concrete), Paul Bengtson. Action Taken: Motion by O'Donnell, seconded by Stoltz, to approve Resolution No. 07 -75 as presented, was adopted by a voice vote (Council Member Reinert absent) C) Consideration of Resolution No. 07 -79, Approving Conditional Pg 76 -82 Use Permit to allow earth material storage at 6644 20th Avenue, Royal Oaks Realty — Jim Studenski Action Taken: Motion by Carlson, seconded by O'Donnell, to deny approval of the conditional use permit based on the following findings, was adopted by a voice vote (Council Member Reinert absent): - zoning ordinance: city is not obligated under language for conditional use permit issuance since it says the city "may" grant permits; - comprehensive plan: use is not consistent with nor the use intended for a rural area; doesn't meet agricultural objectives; seen as a "heavy" use in an area planned for future residential development; - traffic /safety — Anoka County has identified safety issues but is committed to requiring they be addressed "to the fullest extent possible" Council Agenda -4- REVISED - six reasons given by Planning & Zoning Bd for denying permit. 5/29/2007 7. Although they are not considered a non -profit organization, they donate more than 70% of profits to other organizations to promote literacy. The Cities of Minneapolis, Plymouth, White Bear Lake, Ramsey and Hennepin County Government Centers are a few of the public buildings that have previously allowed Books Are Fun to come into their building, set up and sell the educational items without a permit. In 2000 the City of Lino Lakes allowed "Books Are Fun" to set up tables in the atrium here at city hall for two days to sell books, CD's DVD's and other learning devices, also without requiring a permit. On Wednesday, May 23, I received a phone call from Linda Peterson, a representative of Books Are Fun, asking if it would be possible to again use city hall as a means to sell the educational tools. The plan would be to set up on Wednesday, June 6th from 11:00 a.m. to 2:00 p.m. and Thursday, June 7th from 9:00 a.m. to 2:00 p.m. The city would receive 5% of sales up to $3000. and 10% of sales over $3000. Books Are Fun carries liability insurance and advised me that the city would not be liable for any loss of product, etc. I spoke with Gordon regarding this request from Books Are Fun and he advised me to send this "heads up" memo. If anyone has a concern regarding this, let him know at Tuesday's work session. As part of the celebration, food and beverages including beer will be served. The Lino Lakes City Code, Section 702.02, Subdivision 3, states "temporary on -sale licenses shall be granted only to bona fide clubs and charitable, religious and non - profit organizations for the sale of beer for consumption on the premises only." In addition, the parish has made application to acquire a cabaret license and approval for an exemption for lawful gambling permit. Bands will be playing live music in the church parking lot on Saturday from 5:00 p.m. to 11:00 p.m. and Sunday from 11:00 a.m. to 5:00 p.m. Non - profit organizations are allowed under State gambling taws to apply for an exemption permit if they conduct fewer than five (5) gambling occasions per year. The project is being funded by a number of sources, including contributions from MN /DOT and Anoka County. To finance the City's cost of the project staff has proposed utilizing TIF proceeds generated from the Legacy and Panatonni TIF districts, MSA funds, state highway tumback funds and various other sources that were presented to Council at prior meetings. As the contract for the project has been awarded, staff is proposing at this time the issuance of G.O. Tax Increment bonds to finance the city's portion of the project. Our financial advisor, Springsted, Inc. has issued their recommendation for the issuance of $4,215,000 G.O. Tax Increment Bonds Series 2007A (see attached). If approved, bids on this issue would be received on June 25, 2007, with consideration for award by the City Council at its meeting the same day. The Series 2007A issue would have a 16 -year term, with final maturity in February, 2024, and would be repaid through the tax increments, as detailed above, and backed by MSA funding and, ultimately, the full faith and credit of the City of Lino Lakes. As outlined in the recommendation, the debt service schedule is structured to utilize TIF proceeds first, with a tax levy schedule for the remaining debt service. The tax levy will be evaluated annually and offset by MSA funds; the City Council would then cancel the tax levy on an annual basis, as needed. Federal Treasury Regulations Conceming Tax - Exempt Obligations (a) Bank Qualification Thereafter, each year's collection of TIF revenues and taxes will be used to make the August 1 interest payment due in the year of collection and the February 1 principal and interest payment due the following year. The City anticipates using Municipal State Aid allotments from the Department of Transportation to reduce its levy requirement. The City may elect on February 1, 2018, and on any date thereafter, to prepay the Bonds due on or after February 1, 2019, at a price of par plus accrued interest. An application will be made to Moody's investors Service for a rating on the Bonds. The City's general obligation debt is currently rated "Aa3 ". We have included a provision that permits the underwriters to combine multiple maturity years into a term bond, subject to mandatory redemption on the same maturity schedule provided in the Terms of Proposal. The advantage to the underwriter is that it provides large blocks of bonds, which are more attractive to bond funds, and certain pension funds, which deal only with large blocks of bonds. This in tum is a benefit to the City since selling larger blocks of bonds reduces the risk to the underwriter, allowing them to lower their costs and the interest coupons. Since the Bonds are being offered on a competitive bid basis and awarded on the lowest true interest cost, the City will award the Bonds to the best bid regardless of whether term bonds are chosen or not. Under Federal Tax Law, financial institutions cannot deduct from income for federal income tax purposes, expense that is allocable to carrying and acquiring tax- exempt bonds. There is an exemption to this for °bank qualified' bonds, which can be so designated if the issuer does not issue more than $10 million of tax- exempt bonds in a calendar year. Issues that are bank qualified generally receive slightly lower interest rates than issues that are not bank qualified. Since the City does not expect to issue more than $10 million of tax - exempt obligations in 2007, the Bonds will be designated as bank qualified. - 4 0 - Page 2 City of Lino Lakes, Minnesota May 23, 2007 (b) Rebate Requirements (c) Bona Fide Debt Service Fund (d) Economic Life (e) Federal Reimbursement Regulations 11. Continuing Disclosure All tax- exempt issues are subject to the federal arbitrage and rebate requirements, which require all excess eamings created by the financing to be rebated to the U.S. Treasury. The requirements generally cover two categories: bond proceeds and debt service funds. There are exemptions from rebate that may apply in both of these categories. There is an exemption from rebate for municipalities that issue $5 million or Tess of tax - exempt obligations in a calendar year. Since the City does not expect to issue more than $5 million in tax - exempt obligations in 2007, the City qualifies as a "small issuer" and will be exempt from rebating excess eamings on Bond proceeds to the federal govemment. Although exempt from rebate, the City must still comply with the arbitrage regulations which require yield restriction of any proceeds remaining after the three year temporary period expires. The City must maintain a bona fide debt service fund for the Bonds or be subject to yield restriction. This requires restricting the investments held in the debt service fund to the yield on the Bonds. A bona fide debt service fund is a fund for which there is an equal matching of revenue to debt service expense, with carry over permitted equal to the greater of the investment earnings in the fund for the prior year or 1/12 the debt service of the prior year. The average life of the Bonds cannot exceed 120% of the economic fife of the projects to be financed. The economic life of the projects to be financed with the Bonds is 20 years. The average life of the Bonds is 9.187 years, therefore within the economic fife requirements. Federal reimbursement regulations require the City to make a declaration, within 60 days of the actual payment, of its intent to reimburse itself from expenses paid prior to the receipt of Bond proceeds. It is our understanding the City has taken whatever actions are necessary to comply with the federal reimbursement regulations in regards to the Bonds. The Bonds are subject to continuing disclosure requirements set forth by the Securities and Exchange Commission. The City will reserve the right to: (i) waive non - substantive informalities of any proposal or of matters relating to the receipt of proposals and award of the Bonds, (ii) reject all proposals without cause, and (iii) reject any proposal that the City determines to have failed to comply with the terms herein. BOND INSURANCE AT PURCHASER'S OPTION If the Bonds qualify for issuance of any policy of municipal bond insurance or commitment therefor at the option of the underwriter, the purchase of any such insurance policy or the issuance of any such commitment shall be at the sole option and expense of the purchaser of the Bonds. Any increased costs of issuance of the Bonds resulting from such purchase of insurance shall be paid by the purchaser, except that, if the City has requested and received a rating on the Bonds from a rating agency, the City will pay that rating fee. If such Deposit is not received by that time, the Financial Surety Bond may be drawn by the City to satisfy the Deposit requirement. The Deposit received from the purchaser, the amount of which will be deducted at settlement, will be deposited by the City and no interest will accrue to the purchaser. In the event the purchaser fails to comply with the accepted proposal, said amount will be retained by the City. No proposal can be withdrawn or amended after the time set for receiving proposals unless the meeting of the City scheduled for award of the Bonds is adjourned, recessed, or continued to another date without award of the Bonds having been made. Rates shall be in integral multiples of 5/100 or 1/8 of 1 %. Rates must be in level or ascending order. Bonds of the same maturity shall bear a single rate from the date of the Bonds to the date of maturity. No conditional proposals will be accepted. 311663v1 SJB LN140 -100 -54- AWARD The Bonds will be awarded on the basis of the lowest interest rate to be determined on a true interest cost (TIC) basis. The City's computation of the interest rate of each proposal, in accordance with customary practice, will be controlling. The City will reserve the right to: (i) waive non - substantive informalities of any proposal or of matters relating to the receipt of proposals and award of the Bonds, (ii) reject all proposals without cause, and (iii) reject any proposal that the City determines to have failed to comply with the terms herein. BOND INSURANCE AT PURCHASER'S OPTION If the Bonds qualify for issuance of any policy of municipal bond insurance or commitment therefor at the option of the underwriter, the purchase of any such insurance policy or the issuance of any such commitment shall be at the sole option and expense of the purchaser of the Bonds. Any increased costs of issuance of the Bonds resulting from such purchase of insurance shall be paid by the purchaser, except that, if the City has requested and received a rating on the Bonds from a rating agency, the City will pay that rating fee. Any other rating agency fees shall be the responsibility of the purchaser. Failure of the municipal bond insurer to issue the policy after Bonds have been awarded to the purchaser shall not constitute cause for failure or refusal by the purchaser to accept delivery on the Bonds. CUSIP NUMBERS If the Bonds qualify for assignment of CUSIP numbers such numbers will be printed on the Bonds, but neither the failure to print such numbers on any Bond nor any error with respect thereto will constitute cause for failure or refusal by the purchaser to accept delivery of the Bonds. The CUSIP Service Bureau charge for the assignment of CUSIP identification numbers shall be paid by the purchaser. SETTLEMENT Within 40 days following the date of their award, the Bonds will be delivered without cost to the purchaser through DTC in New York, New York. Delivery will be subject to receipt by the purchaser of an approving legal opinion of Kennedy & Graven, Chartered of Minneapolis, Minnesota, and of customary closing papers, including a no- litigation certificate. On the date of settlement, payment for the Bonds shall be made in federal, or equivalent, funds that shall be received at the offices of the City or its designee not later than 12:00 Noon, Central Time. Minnesota Laws Chapter 299F.011, Subd. 5 (attached) establishes a procedure for the State Fire Marshal to grant variances from the minimum requirements specified in the state fire code in cases where "there is substantial compliance with the provisions of the code, the safety of the public and occupants of such building will not be jeopardized, and undue hardship will result to the applicant unless such variance is granted ". The law further states that "governing bodies are not liable for damages in connection with granting variances, abatements, denials, or modifications of orders from the fire code that are made in good faith ". The procedure for application to the State Fire Marshal requires that the applicant first make application to the local governing body and that action be taken by that body. The Fire Marshal's Code Advisory Panel will review the application at its monthly meeting (next meeting is June 11) and will make a recommendation to the State Fire Marshal. The State Fire Marshal shall consider any decisions or recommendations of the local governing body. The applicant is requesting to vary from the 20 foot minimum setback requirement from the north property line. The reasons for the variance request are set forth in the applicant's letter and shown on the applicant's site plan (both attached). RECOMMENDATION Staff finds that this request conforms to the requirements for application to the State Fire Marshal for a variance from the State Fire Code. Staff finds that the variance requested is the minimum variance necessary to accommodate the proposed tent structure and the impact of the variance on public safety is minimized due to the area and location for occupancy exiting. The department may not, however, adopt or enforce a rule stricter than paragraph (a), clause (2). I am requesting a variance from the State Fire Code. The variance is for the tent that is used for Blue Heron Days weekend at Nfillers on Main. The tent has been used for the street dance, royalty coronation, taco eating contest, among other things. The same size tent has been used from 2003 -2006, plus for the benefit for officer Silvera. It was brought to our attention that the tent does not meet the state fire code for being 20' from each property line. This code is in place for the safety of the public. I feel that we meet most of the codes requirements and cause no concern for the public's safety. We are 20' from the property line to the East, West, and South. To the north we are not 20' from the property line, however you can see from the enclosed site plan that the side of the tent to the north is completely closed off by a wall. That being the case there is no way for people to exit that direction anyway. I have been told by the fire department that the openings to the west and south are sufficient enough for this size tent. If we are unable to obtain this variance we will be unable to proceed with the above mentioned activities for Blue Heron Days weekend. I feel that that would be a major disappointment for the community. To summarize, I am requesting the city council of Lino Lakes to grant a variance for the state fire code that states all tents need to be at least 20' from each property line. Lastly, the council should know that in the state fire code it is stated " governing bodies are not liable for damages in connection with granting variances, abatements, denials, or modifications of orders from the fire code that are made in good faith." Mr. Wagner has held the same type of event for the past three years during the Lino Lakes Blue Heron Days festival. Mr. Wagner has submitted an application for a special event permit and cabaret license as the event will include live music. Staff has been working with him to ensure that the event plans meet appropriate state and local regulations. A list of conditions has been developed relating to the application and event. As previously directed by the Council, the Police Department will be monitoring sound levels throughout the event. Also, due to the Fire Department's identification of a tent setback insufficient to meet fire code requirements, the permit will not be issued without an approved variance in place. All conditions are set forth as Attachment A to Resolution No. 07 -81 and it is recommended that they be attached if the Council elects to approve these permits. Mr. Wagner has reviewed and accepted the conditions. The applications, site plan and all background information are available for review in the City Clerk's Office. OPTIONS: 1. Bergeson, Mayor • • • • • • ATTACHMENT A (Resolution No. 07 -81) Conditions and Checklist for issuance of Special Event Permit and Cabaret License to Chad Miller d/b /a Miller's on Main, for music event on August 17 and 18, 2007: (1) The applicant has plans for parking vehicles including size and location of Lots, points of access; and proof of permission for use of property upon which the special event is to be held or upon which parking may occur, and in the case of County right -of -way, proper documentation from the County approving the plans; (2) The use of wristbands for limiting the number of persons is indicated in the application. An entrance fee shall be charged and entrance shall be by wrist bands only. The applicant shall also indicate the maximum number of persons which shall be permitted, and the fire marshal shall provide a maximum number of occupants based on the size of the tent; (3) The plans for fencing the location and the gates contained in such fence; (4) The plans for providing toilet and lavatory facilities including the source, number, and location, type and means of disposing of waste deposited; (5) (6) (7) The plans for holding, collection, and disposing of solid waste material; The plans, if any, to illuminate the location of the event including the source and amount of power and the location of lights; based on plans provided, the fire marshal shall determine if a state permit is required; The plans for security including the number of guards and the name of the security company; in addition, the applicant is required to ensure that two uniformed Lino Lakes police officers are present at the event during the hours of 9:00 p.m. and 1:30 a.m. on August 17 and 18, 2007, or as long as the Police Department deems necessary; (8) The plans for sound control and sound amplification, if any, including number, location, and power of amplifiers and speakers; All reasonably necessary precautions shall be taken by the applicant to insure that the sound of the assembly will not carry unreasonably beyond the enclosed boundaries of the location of the assembly; (9) The plans to meet the requirements of the State Fire Code, including but not limited to the following: L Minimum of three 2A10BC fire extinguishers need to be on location in the tent area; ii. (14) The site plan for the placement of a tent does not indicate compliance with setback requirements therefore the applicant is required to obtain a variance from the state fire code; approval of the special event permit and cabaret license is contingent upon the granting of said variance. • • • • AGENDA ITEM 3B STAFF ORIGINATOR: Julie Bartell, City Clerk MEETING DATE: May 29, 2007 TOPIC: Consider 2007 Liquor, Wine, Beer and Dance License Renewals VOTE REQUIRED: Simple Majority (3/5 Vote Required) BACKGROUND: All liquor, wine, beer (3.2) and dance licenses in the City of Lino Lakes expire on June 30, 2007. Staff has been working with the license holders to put in place all renewal information so as to allow for Council consideration at this time. A majority of these licenses require review by the Minnesota Department of Public Safety Alcohol • and Gambling Division and it is appropriate to allow a 30 day period, after Council consideration, for that review. Attached is a list of the establishments that have submitted renewal applications. As indicated, applicants are required to provide certain documentation addressing state and local requirements for the license they request and to pay associated application fees. Approval of the licenses is conditioned upon all information and fees being in place. The Police Department has completed background investigations for the applicants and has indicated no new information that would lead to a recommendation of denial of any of these licenses. The Police Department has done compliance checks on the establishments and the City Council has addressed issues relating to compliance at an earlier hearing. OPTIONS: 1. Adopt Resolution 07 -78 approving renewal of liquor, wine, beer and dance licenses for the period of July 1, 2007 through June 30, 2008. 2. Deny any or all of said licenses. STAFF ORIGINATOR: Paul Bengtson CC MEETING DATE: May 29, 2007 TOPIC: Resolution 07 -74 Variance to the Local Street Setback To allow a Porch Addition BACKGROUND Jim Schally has requested approval of a Variance from the Local Street Setback (30 feet) to allow a covered porch addition that would be 25.5 feet from Danube Street. The proposed porch addition is part of a larger project that involved the removal of the detached garage and remodel of the existing structure. The rest of the project met all setback requirements and was therefore approved by the Building Department. The porch is the only thing that will encroach, a total of 4.5 feet into the Danube Street setback. The site is located north of Main Street and east of Lake Drive within the Pine Haven • subdivision. ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. The encroachment section allows the following: Permitted Yard Encroachments. The following shall not be considered as encroachments on setback requirements subject to other conditions provided herein: a. All Yards. 2) Posts, flues, belt course, bay windows, leaders, sills, pilaster, eaves, gutters, awnings, open terraces, open canopies, chimneys, ornamental features, open fire escapes extending from the principal structure, provided they do not project more than three (3) feet into a required setback. 3) Uncovered porches, decks, balconies, stoops, or similar features provided: a. The decking shall not extend above the height of the floor of the ground floor level of the principal structure though railings may be higher, and b. They shall not extend to a distance less than five (5) feet from any side or rear lot line, and c. They shall not extend to a distance less than twenty (20) feet of any lot line abutting a street, and d. They shall not extend to a distance less than one (1) foot from any existing or proposed access drive, and e. No encroachment shall be permitted in existing or required drainage and utility easements. Because the proposed porch addition includes a roof structure and support posts, requirement 2 above does not allow it to encroach into a setback by more than 3 feet. If uncovered, the porch could encroach up to 10 feet as shown under number 3.c. above. The variance is essentially for the 1.5 feet of additional encroachment that would be required for the proposed improvement. As such, staff considers the encroachment to be a 1.5 foot encroachment of the 27 feet (considering the 3 foot allowance from number 2 above) meaning the encroachment would be roughly 5 percent. Additionally, the existing detached garage that was being removed for the project was encroaching into the front setback and therefore the project is eliminating an existing non- conformity. Findings: State law requires the following finings to be made in order to grant the approval of a variance. Staff has completed the findings in regards to the upland lot area reduction based on the revised submittal: • • • • • FINDINGS In considering all requests for Variance or appeal and in taking subsequent action, the City shall make a finding of fact: a. That the property in question cannot be put to a reasonable use if used under conditions allowed by the official controls. The property is currently developed with a single family home that can easily be put to a reasonable use without the addition of a porch covered with a roof structure. b. That the plight of the landowners is due to physical circumstances unique to his property not created by the landowner. The existing structures lack of a significant entry feature and the placement of the existing home only 15 inches from the front setback are physical circumstances that were not created by the current landowner. c. That the hardship is not due to economic considerations alone if reasonable use for the property exists under the terms of the ordinance. The request made by the property owner has nothing to do with economic considerations; the placement of the home on the lot when it was constructed simply prohibits the addition of the proposed covered porch under the strict enforcement of the zoning ordinance d. That granting the variance requested will not confer on the applicant any special privilege that would be denied by this ordinance to other lands, structures, or buildings in the same district. Allowing a 1.5 foot variance to the 27 foot setback (based on the 3 foot encroachment allowed) is very minor in scope at roughly 5% and would not confer onto the applicant any special privilege. e. That the proposed actions will be in keeping with the spirit and intent of the ordinance. The spirit and intent of the setbacks required by the ordinance is to allow separation between roadways and homes and to increase visibility at intersections. Allowing a 1.5 foot encroachment that is only 10 feet in width would not violate that spirit or intent. STAF'r ORIGINATOR: Paul Bengtson CC MEETING DATE: May 29, 2007 TOPIC: BACKGROUND Resolution No. 07 -75 Conditional Use Permit Amendment Molin Concrete Office Building and Campus Addition Molin Concrete is proposing a 7,785 square foot office building and some minor facade improvements to the existing office building to create a more cohesive appearance to their facilities at 415 Lilac Street. The improvements to the site include two phases. The first phase being that of the office building and the associated site work, and the second phase being the wetland mitigation/enhancement area that was included as part of their application to the Rice Creek Watershed District for the future addition to the manufacturing building. The First Phase is the only part of the application that the city is being asked to review at this time. Phase Two will require a separate application for a Conditional Use Permit Amendment. The Molin property is covered by a conditional use permit for the concrete plant. The northern 20 acres is covered by an interim use permit for outdoor storage. This new application does not involve the storage area. The Conditional Use Permit covers the entire site. Building additions such as those proposed in this application require an amendment to the Conditional Use Permit. Since the original approval, the city has approved amendments to the CUP in 2003 with Resolution 03 -73, in February 2005 with Resolution 05 -13, and again in February 2006 with Resolution 06 -32. Molin Concrete has sent a notice to the surrounding home owners to inform them of the proposed expansion and invited anyone interested to provide comment. These same homeowners were also noticed by the city of the public hearing that was held at the Planning and Zoning Board meeting on May 9th. Molin Amendment Page 2 of 6 ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. The office building will occupy the space between the existing office building and the existing maintenance building. It will be single story with a trellis attaching the new office building to the existing to create a cohesive appearance to the site. The building materials meet all of the city requirements and the design appropriately addresses the base /middle /top approach required by the zoning ordinance. Lighting: The lighting attached to the building will be required to meet all city standards for downcast, shielded lighting. A lighting plan will be required prior to the issuance of building permits that will confirm compliance. Grading/Drainage, Utilities: A grading and utility plan was submitted with this application, and was thoroughly reviewed by the City Engineer. A memorandum is attached to this report that outlines all of the City Engineer's comments. The applicant has also submitted their plans to the Rice Creek Watershed District for review and will be required to obtain any necessary permits. The wetland mitigation and enhancement proposed on the site plan is not meant to be a part of this request. It was shown on the plans by the applicant to depict the ultimate plans for the site. A condition of approval clearly indicates that Phase Two will require a separate conditional use permit amendment most likely to coincide with the expansion of the manufacturing building. Landscaping: With each addition to the site the largest concern has been the exterior landscaping on the site, which continually is inspected by city staff for compliance. The City Forester visited the site on April 5, 2007 and met with the applicant to address any landscaping concerns that existed. This office building proposal will require some changes to the landscaping plan to account for some building plantings, but no major changes to the exterior landscaping plan are being proposed. • • • • Molin Amendment Page 3 of 6 RECOMMENDATION Staff recommends adoption of Resolution No. 07 -75 approving the construction of an office building, subject to the following conditions: 1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. 2. All conditions of the previous amendments shall continue to apply. 3. A Performance Agreement between the applicant and city must be executed prior to the issuance of building permits for the site. 4. A photometric lighting plan in conformance with the standards of the zoning code must be submitted prior to the issuance of building permits. All lighting fixtures will be downcast shielded as required by the zoning code. 5. Trash enclosures must incorporate the same materials used in the construction of the main building. 6. The applicant shall obtain the necessary Rice Creek Watershed District permits. 7. The improvements are limited to those areas depicted as Phase One. On August 3, 2006, City staff witnessed a substantial amount of fill material on this property. A cease and desist order was sent on August 4, 2006 notifying the owner that the activity was in violation of Section 3, Subdivision 12 of the Lino Lakes Zoning Ordinance Specifically, when five thousand (5,000) or more cubic yards of material is to be removed from or deposited on any lot or parcel, a Conditional Use Permit shall be required. The zoning ordinance for Earth Moving and Land Reclamation does provide a list of conditions as a prerequisite for granting a permit. The conditions are as follows: 1. Properly fence any pit or excavation, and barricade entrances to prevent the general public from depositing garbage or refuse. 2. Slope the banks, and otherwise guard and keep any pit or excavation in such condition as not to be dangerous because of sliding or caving banks. 3. Properly drain, fill, or level off any pit or excavation so as to make the same safe and healthful as the permitting authority may determine. 4. Limit the depth of such excavation to an elevation no lower than the minimum floor elevation for building construction as established by the City Engineer, so as not to diminish development potential of the parcel. 5. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. Concrete, asphalt, metal, wood, and other debris shall be prohibited. -76- Royal Oaks Realty CUP — Materials Storage • Page 2 of 7 6. Require that all decomposable material, or other unsuitable foundation material, be removed from an area before deposition of fill begins. 7. Prepare a site plan showing existing and proposed grade elevations and effect of storm water drainage on adjacent areas. 8. Specify a time when the excavation or land reclamation project shall be completed. 9. Place a minimum of four (4) inches of top soil over the completed project and establish appropriate ground cover within sixty (60) days of completion, or in a time period consistent with the City's storm water management and pollution prevention plan. 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. 11. Implement the tree preservation plan. 12. In addition to a conditional use permit, the City Engineer may determine that permits in excess of twenty -five thousand (25,000) cubic yards require the applicant to conduct a neighborhood meeting and to notify affected property owners within one - quarter (1/4) mile. 13. Post a form of security and sum as the permitted authority may require, running to the City, conditioned to pay the City the cost and expense of repairing or cleaning any highways, streets, or other public ways within the City made necessary by the special burden resulting from transporting thereon by the applicant material to or from the site, the amount of such cost to be determined by the Council; and conditioned further to comply with all the requirements of this Ordinance and the particular permit, and to save the City free and harmless from all suits or claims for damages resulting from the negligent excavation, removal, storage, or filling of rock, sand, dirt, gravel, clay, or other like material within the City. 14. Other conditions deemed appropriate to the application by the permitting authority. After receiving the cease and desist order, the property owner contacted the City and stated they had quit hauling and that a Conditional Use Permit would be pursued before any additional material was hauled into the site. The required silt fence was installed within a couple days of the contact with the property owner. • • Royal Oaks Realty CUP — Materials Storage Page 3 of 7 The property is owned by The Sanctuary LLC, Marcel Eibensteiner is the president of that- partnership. Royal Excavating will operate the earth material storage yard with the permission of The Sanctuary LLC. The content of this earth material storage stockpile is intended to be topsoil or "black dirt". The attached site plan (Exhibit B) estimates the current size of the stockpile to be 5,605 cubic yards. The Applicant intends to use the material on an "as needed" basis on various constructions sites in the general vicinity. Dump trucks would be used to deliver earth materials from the site and haul clean fill back into the site. The amount of earth material on the site would not exceed 15,000 cubic yards. The City has sent a notice to the surrounding home owners to inform them of the proposed Conditional Use Permit and invited anyone interested to provide comment. These same homeowners were also notified by the city of the public hearing in regards to this request. Attached Exhibit C shows residences neighboring the earth material storage site. A petition was received on April 9, 2007 from a neighboring resident, as shown on attached Exhibit F. The City has forwarded. this Conditional Use Permit to Anoka County Highway Department. Anoka County has informed the City that they will require a Haul Permit and a Driveway Access permit to be submitted by the property owner, before any further activity can commence on the site. Anoka County is reviewing the proposal and will respond to the City relaxed to their requirements. The deadline for the Conditional Use Permit in which the City must take action remains June 6, 2007. This date requires the City Council to take action at their May 29 meeting. A request to extend the deadline was not acceptable to the applicant. ANALYSIS Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. Also, attached are Exhibits D and E that show the Existing Zoning and Guided Land Use respectively. A gravel driveway provides access to all the structures. Traffic: 20th Avenue is a County Road and Anoka County has jurisdiction over the road. Traffic control will be addressed in the Anoka County haul permit. The road was designed for a 9 -ton load limit. Anoka County had previously posted it at a 7 -ton load limit keeping heavier traffic off the road. Anoka County changed the load limit a couple of years ago to the designed 9 -ton posting to allow heavier traffic to access the surrounding businesses. The attached letter from Anoka County dated May 7, 2007 provided there review of the proposed CUP. To address traffic safety issues, Anoka County stated that the existing access for the residential use of this property will need to be removed and the hauling access relocated within 30 feet of the north property line to maximize the available associated intersection sight distance at Birch Street and 20th Avenue. The hauling access will require a culvert with 6:1 slopes, safety grates and aprons. Anoka County will require a north bound 20th Avenue (CSAH 54) right turn lane and a south bound 20th Avenue (CSAH 54) left turn lane, if traffic volumes are low enon • h the south bound left turn lane can be replaced with a south bound bypass lane. Grading/Drainage: Attached is a site plan for the earth materials storage site, which details the current stockpile. Silt fence has been installed and the stockpile will be subject to regular NPDES inspections conducted by City staff. Rice Creek Watershed District (RCWD) has reviewed the site and confirmed that the property doesn't have any wetlands and is outside of the floodplain. The stockpile is partially vegetated and will require additional stabilization. RCWD does not require a formal permit for this activity. They will monitor the site for erosion and sediment control. Tree Preservation Plan: A tree preservation plan is not required since the materials storage pile has been moved more than 50 feet from the existing trees. • • • Royal Oaks Realty CUP — Materials Storage Page 5 of 7 The Royal Oaks Realty — Material Storage Conditional Use Permit was presented at the April 1 1th and May 9th Planning and Zoning Board meeting and was denied by a vote of 4-3 on May 9, 2007. May 9, 2007 Planning and Zoning Board Comments: Board members gave the following rational for denying a CUP that was recommended for approval by staff: Traffic volume is to intense for surrounding area. Nuisance to residents and the surrounding area. City Ordinance does not apply to an ongoing process. Monitoring traffic on site use will be difficult. An end date is not specified in conformance with the City Ordinance Functions as a business that is not allowed in a rural zone. Recommendations: Conditions met by the applicant since the April 11, 2007 Planning and Zoning Board Meeting 1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance with Minnesota Pollution Control Agency (MPCA) requirements has been prepared by the applicant. 2. The house foundation has been properly removed from the site. 3. The existing septic system has been abandoned according to City requirements. 4. The site has been cleared of debris and other objects to provide a safe situation for the proposed material hauling operation. 5. The site has fence and barricaded entrances to prevent the general public from depositing garbage or refuse. Staff recommends approval of the conditional use permit subject to the following conditions of which some have been adjusted in response to the April 11 and May 9th planning and zoning meetings: 1. Maximum slope on the pile shall be a 1 to 1 and in such condition as not to be dangerous because of sliding or caving banks. 2. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. A maximum amount of 7,000 cubic yards of material will be allowed on the site at any time. A permanent berm located around the stockpiled earth material will be required. 4. The maximum height of the stockpile material shall be 25 feet from grade. 5. The maximum number of trips per day shall be limited to the lowest figure, either 25 trips per day (one trip is into and out of the site) or the allowable number from the Anoka County Highway Department. 6. A rock trench entrance shall be installed and maintained at all times. 7. Dust and wind erosion must be confined to the site and be controlled by watering the driveway as necessary. 8. Materials hauled in must have vegetation applied within 48 hours of its arrival. 9. All construction activity shall be limited to the hours set as follows: Monday throng, Friday 7:00 a.m to 7:00 p.m. Saturday 9:00 al. to 5:00 p.m Sunday and Holidays No working hours allowed 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. 11. Permits from the Anoka County Highway Department must be submitted to the City prior to any activity. All activities on the site must comply with the Anoka County permit requirements. a. It is possible that when this section of CSAH 54 is reconstructed at some future date, additional permanent easements in the form of trail, sidewalk, utility or temporary construction easements may be needed. Typical Anoka County Policy allows one access per parcel provided that access to a local city street cannot reasonably be attained. The existing access for the residential home on this property is deficient for the Case I, Case IIIB and Case IIIC sight distance requirements, which is not acceptable for a hauling site access point. Consequently, the existing access for the residential use of this property will need to be removed and the hauling access relocated within 30 feet of the north property line to maximize the available associated intersection sight distance. The City and the Developer shall ensure that clearing and/or grading is completed to satisfy the Sight Corner requirements to the fullest extent possible at this access point. Please note that no plantings or business signs will be permitted within the county right of way. Care must be exercised when locating signs, plantings, berms, etc. beyond the county right of way, so as not to create any new sight obstructions for road users in this area. The right of access along the remaining portions of this parcel shall be dedicated to Anoka County. The haul road access will require a culvert with 6:1 slopes, safety grates and aprons. Any other existing driveways or field entrances within the boundaries of this property shall be removed and the ditch section restored to match existing depth, slope, and grades. Continuous clean up operations are required. County highways are to be swept (and scrapped if needed) at least once per day. Additional clean up operations may be required if conditions warrant. Bare pavement and visible roadway striping must be maintained at all times. Clean up operations are to continue at the end of each work day until the road is clear of all material. Contractor will be required to keep on site, or have available within one hour, any equipment needed to accomplish clean up operations. Such equipment may include sweeper, scrapper or bobcat, and a water truck. Failure to do so shall be cause for ACHD to order the necessary work to be done and billed to the Permit holder. All loads entering the county highway system must meet legal axle weight. Dust control measures are also required. Hauling operations will be terminated if extreme conditions exist. lo The Permit Holder shall be responsible for obtaining and complying with any permits deemed necessary from the City of Lino Lakes. • • Council Member introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 07 -79 RESOLUTION APPROVING CONDITIONAL USE PERMIT, TO ALLOW EARTH MATERIAL STORAGE AT 6644 20TH AVE SOUTH, ROYAL OAKS REALTY WHEREAS, Royal Oaks Realty has submitted a request to the City to grant a conditional use permit to allow earth material storage at 6644 20th avenue south. WHEREAS, the legal description of the property is: The west 823 feet of the south 795 feet of the southwest quarter of the northwest quarter of Section 25 Township 31 Range 22; excluding the south 265 feet thereof, also excluding the County highway Right -of -Way and any easements of record. WHEREAS, the City's review is based on the site plan received February 9, 2007. WHEREAS, the planning commission held a public hearing on the application on May 9, 2007 and recommended denying approval with a 4 -3 vote and, WHEREAS, the City Council of the City of Lino Lakes finds that, with the conditions of approval included in this resolution, the following findings of fact apply as required by section 3 Subdivision 12 of the Lino Lakes Zoning Ordinance. 1. Properly fence any pit or excavation, and barricade entrances to prevent the general public from depositing garbage or refuse. 2. Slope the banks, and otherwise guard and keep any pit or excavation in such condition as not to be dangerous because of sliding or caving banks. 3. Properly drain, fill, or level off any pit or excavation so as to make the same safe and healthful as the permitting authority may determine. 4. Limit the depth of such excavation to an elevation no lower than the minimum floor elevation for building construction as established by the City Engineer, so as not to diminish development potential of the parcel. Resolution 07 -79 Page 2 5. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. Concrete, asphalt, metal, wood, and other debris shall be prohibited. 6. Require that all decomposable material, or other unsuitable foundation material, be removed from an area before deposition of fill begins. 7 Prepare a site plan showing existing and proposed grade elevations and effect of storm water drainage on adjacent areas. 8. Specify a time when the excavation or land reclamation project shall be completed. 9. Place a minimum of four (4) inches of top soil over the completed project and establish appropriate ground cover within sixty (60) days of completion, or in a time period consistent with the City's storm water management and pollution prevention plan. 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. 11. Implement the tree preservation plan. 12. In addition to a conditional use permit, the City Engineer may determine that permits in excess of twenty -five thousand (25,000) cubic yards require the applicant to conduct a neighborhood meeting and to notify affected property owners within one - quarter (1/4) mile. 13. Post a form of security and sum as the permitted authority may require, running to the City, conditioned to pay the City the cost and expense of repairing or cleaning any highways, streets, or other public ways within the City made necessary by the special burden resulting from transporting thereon by the applicant material to or from the site, the amount of such cost to be determined by the Council; and conditioned further to comply with all the requirements of this Ordinance and the particular permit, and to save the City free and harmless from all suits or claims for damages resulting from the negligent excavation, removal, storage, or filling of rock, sand, dirt, gravel, clay, or other like material within the City. 14. Other conditions deemed appropriate to the application by the permitting authority. • • • • Resolution 07 -79 Page 3 NOW, THEREFORE, BE IT RESOLVED THAT the Lino Lakes City Council approves a conditional use permit to allow earth material storage at 6644 20th avenue south. BE IT FURTHER RESOLVED THAT the following conditions apply: Conditions met by the applicant since the April 11, 2007 Planning and Zoning Board Meeting 1. A Stormwater Pollution Prevention Plan (SWPPP) in accordance with Minnesota Pollution Control Agency (MPCA) requirements has been prepared by the applicant. 2. The house foundation has been properly removed from the site. 3. The existing septic system has been abandoned according to City requirements. 4. The site has been cleared of debris and other objects to provide a safe situation for the proposed material hauling operation. 5. The site has fence and barricaded entrances to prevent the general public from depositing garbage or refuse. Staff recommends approval of the conditional use permit subject to the following conditions of which some have been adjusted in response to the April 11 and May 9th planning and zoning meetings: 1. Maximum slope on the pile shall be a 1 to 1 and in such condition as not to be dangerous because of sliding or caving banks. 2. Limit any fill material to clean fill, defined as rock, sand, gravel, clay, or other like and similar non - decomposable material. Concrete, asphalt, metal, wood, and other debris shall be prohibited. 3. A maximum amount of 7,000 cubic yards of material will be allowed on the site at any time. A permanent berm located around the stockpiled earth material will be required. 4. The maximum height of the stockpile material shall be 25 feet from grade. Resolution 07 -79 Page 4 5. The maximum number of trips per day shall be limited to the lowest figure, either 25 trips per day (one trip is into and out of the site) or the allowable number from the Anoka County Highway Department. 6. A rock trench entrance shall be installed and maintained at all times. 7 Dust and wind erosion must be confined to the site and be controlled by watering the driveway as necessary. 8. Materials hauled in must have vegetation applied within 48 hours of its arrival. 9. All construction activity shall be limited to the hours set as follows: Monday through Friday 7:00 a.m. to 7:00 p.m. Saturday 9:00 a.m. to 5:00 p.m Sunday and Holidays No working hours allowed 10. Reimburse the City for the cost of periodic inspections by the City for the purpose of determining that the terms under which the permit has been issued are being complied with. 11. Post a form of security to the City, conditioned to pay the City the cost and expense of repairing or cleaning any highways, streets, or other public ways within the City made necessary by the special burden resulting from transporting thereon by the applicant material to or from the site, the amount of such cost to be determined by the Council; and conditioned further to comply with all the requirements of this Ordinance and the particular permit, and to save the City free and harmless from all suits or claims for damages resulting from the negligent excavation, removal, storage, or filling of rock, sand, dirt, gravel, clay, or other like material within the City. 12. Permits from the Anoka County Highway Department must be submitted to the City prior to any activity. All activities on the site must comply with the Anoka County permit requirements. a. The existing southerly driveway must be removed and relocated to within 30' of the north property line. b. The haul road access will require a culvert with 6:1 slopes, safety grates and aprons. c. A north bound right turn lane and a south bound bypass lane must be constructed on 20th Avenue (CSAH 54). • • • Resolution 07 -79 Page 5 13. The CUP will be reviewed annually with a three year deadline of June 1, 2010. If the site is not kept in compliance with the conditions set forth, the permit may be revoked by the City Council. We object to this permit issuance due to: - increased heavy industrial vehicular traffic (dump trucks). - further destruction and deterioration of the roadway, which is already in a state of breakdown from past abuse. - increased dust and dirt in the air. - increased diesel exhaust fumes. - increased noise pollution from the exhaust systems of the dump trucks accelerateing through the gears and also "gearing down" or engine breaking. -the literal shaking of our houses that occurs when just one dump truck travels this roadway.
