Introduction Brody is a very good dog. He is not a dangerous dog. He brings security, and there is safety having him with us. We live in a very dark area, that is poorly lit, and we do feel reassured with his presence. We love him very much, and he is part of our family. We are going to do what ever is necessary to keep him. Continue training for Brody and also training for family members. 2. Brody is a very smart dog Brody is a very understanding dog, and is very smart. May examples of his smartness is demonstrated. ➢ Pulling me by my leg from under the car when working on my car. I reassured him I am okay. Then he sat by me, nonchalantly sitting there, but watching me from the side of his eye. ➢ As I was trimming a shrub, he sat by me and barked continuously at the shrub. Then I realize that they were bees in the shrub and he must have gotten stung before, so he sat right next to me and was trying to warn me. ➢ When he needs treat, he grabs my hand and led me to the freezer in the basement. ➢ Brody sat for about 2 hours as Carol Propotnik, animal behavior consultant, assessed his behavior and talked to me last Friday. Staff at the animal care center came by, and not once did Brody growled or barked at them. ➢ Brody interacted with construction workers in 2009 who replaced my roof, siding, and other repairs that we had done. 2 3. Other Information > As head election judge for City of Blaine, I have met some folks and cops there. I spoke to Mr. Aaron Herzog, CSO coordinator. He thought this was a bit harsh on Brody. He said he understand the city is looking at their liability. He said regarding the Oct 15, 2010 incident, he might not have made that judgement call. He said he reviews these cases with 2 other officers for the City of Blaine. > I spoke to the supervisor for the furniture deliver person, name Derek, who said that it was small bite, and his exact words "it does not make sense that the dog biting someone in your basement and he get into trouble for it ". > Brody is very uncomfortable at his current location. For the first few days he was not eating well. On Thursday Nov 11, Brody was crying, agitated, and was not going to bathroom. I put him out that day. > On Sat Nov 13, visited Brody, he peed for a very long time, over a minute when I first got there, then a long time again about an hour after. He had diarrhea this morning. > Fri Nov 19, Carol visited Brody and interacted with him for about 2 hours. He just sat or lay down. Other staff at the care center witnessed this. Staff at care center was prohibited from writing note as to what they observed with Brody, nor their interactions with Brody. 3 4. What I agree to do to keep him 1. Brody is confined to my basement, free to roam there. 2. Muzzle when outside for bathroom break or playing with him. 3. Always have Brody on a leash when he is outside. 4. Place warning signs, beware of dog 5. Have tag on Brody saying dangerous animal 6. insert microchip 7. Notice to neighbors 8. Provide liability insurance for $300,000 9. Keep dog license and rabies vaccination up to date. 10. Work with dog therapist to train Brody and family members 11. Will have dog therapist submit regular progress reports, perhaps quarterly or whatever you desire. 12. Willing to wait a year before I approach council again to have the dangerous animal tag removed. Some of these items are beyond the law. There is going to be cost to me, but am willing to put my money to this cause. 4 Testimonials Appendix A 5 To whom it may concern: On Tuesday 11/9/2010 I was bitten by a dog in the home located at 1366 Wolf Circle, Lino Lakes, MN 55038 around noon. While I feel the situation was completely preventable, I don't blame the dog or wish that the dog suffer the consequences of termination. I hope that alternative methods can be taken to remedy the situation and that the dog's life be spared. I hope you will seriously consider my request as the victim of the situation. I have had the opportunity to interact with Brody on a number of different occasions over the last two summers. Mr. Sawh's son, Raun, is on my softball team, and he has brought Brody to the ballpark for a number of the games. At all times, Brody was kept on a leash. From time to time, I would walk over to Brody to pet him or sit down to play with him. My three boys loved to be able to play with Brody, and I never had any concern about them playing with Brody. In fact, the park was usually crowded with a number of children, and I cannot recall a single incident that caused concern in any of the parents or adults that were there. It is my understanding that both incidents being considered by the Lino Lakes Police Department occurred while. Brody was contained on his own property and that there were extenuating circumstances surrounding them. A dog that is on his property . and acts upon provocation cannot be considered dangerous. I do not believe that Brody is a danger to the community, and that belief is based on personal interaction with him by both my three young children and me. I have known Brody since he was a puppy and he has spent numerous occasions at my house. Brody has not once shown any signs of a demeanor in which 1 was uncomfortable or feared. He is a playful puppy with an almost human like demeanor. Brody is an extremely smart dog that has a lot of potential as he grows out of his puppy years to a mature well trained dog. The situations involving Brody I believe are due to the fact that he is territorial, in which most canines are when a strange person enters what is his space without first acquainting themselves with him or any other canine at that matter. It is the same with humans as we would not just let an unknown individual enter our homes with our family without confrontation. With this respect 1 believe this situation needs to be approached ethically, and really look at if this was Brody's fault, or was it ignorance on the individual's part for entering the territory of an unknown canine. From the time I have spent with Brody I can tell you that this was not his fault, rather he was just reacting to somebody invading his territory without proper introduction. I would hope that the counsel would approach their decision with caution and really approach this from an ethical standpoint as this is a puppy still in training with a lot of potential and an integral part of a family. It has been brought to my attention that there was an isolated incident, and ultimately, He is to lose his life because of said incident. I can attest to Brody's personality being one of great character. He is a sweet, loving dog. Brody was in attendance nearly every Tuesday this summer for softball games, where there were literally hundreds of people, and several other dogs. Dogs ranging from, rat terriers to pit bulls, to great danes. With all the people, dogs and general commotion of a softball setting, Brody never showed any sign of aggression. I personally am a dog owner and generally an animal lover. I understand that there was an isolated incident that happened, but I do believe it to be just that, isolated. I find it upsetting that the Sawh family could ultimately lose a family member because of this. I just ask that you take a good look at the facts of the incident and realize Brody acted on instinct, and was merely attempting to protect and defend his domain. As an owner of two dogs myself, I have known Brody to be nothing but a family- oriented and well behaved K -9. I cannot help but seriously doubt Brody would ever do anything destructive unless he fully believed it was in direct defense of his family. There was a specific instance where I entered the Sawh's house without being let in by a family member that truly stands out to me. Brody came running down the stairs and rushed me in the entryway. He came up to me and put his front legs on my waist to do nothing more than lick my face. He was so welcoming to human entrance that he reminded me exactly of my two pups as I entered my own home. I have no reason to believe that Brody would be anything but friendly to any human encounter he faces. If there are any further questions regarding the character of this dog I would be more than satisfied to take time to discuss further. Thank You, Jon Halloran 13 Attn: City Council Members Raun Sawh 1366 Wolf Circle Lino Lakes, MN 55038 Dear Lino Lakes City Council, The plight of Raun Sawh and his beloved dog, Brody, has inspired me to write to you to urge you to spare this poor animal's life. I have met Brody and he is a sweet, loving, playful dog. I do not find him threatening in the least. When dogs are confined by a tie -down or kenneled and they are approached by a stranger on their own property, they can often feel anxious, scared, or threatened, resulting in defensive behavior. This is why most of us learn as children not to approach strange dogs. Although his behavior was clearly not ideal, this woman was on their property without permission where Brody was confined. Her intrusion on their property should not result in a death sentence for this poor animal who instinctively acted in what he likely felt was his own defense. The fact that Brody bit an intruder on the Sawh's property does not justify his murder. The punishment simply does not fit the crime. Brody may be just another dog in your eyes, but he is Raun's best friend. Sentencing him to death would cause him Thuch more pain,than that of a dog bite. I, urge you to act reasonably and listen to both sides of this story before jumping to conclusions. He has always been very loving, caring and playful during my interactions. I do not see him as a threat to society. I believe it would be a poor and unnecessary decision to euthanize Brody. From my understanding, the first incident occurred with a neighbor with whom there was somewhat of an unpleasant relationship with the Sawh family. The second incident, which was the subject of testimony earlier this month, involved a woman who was walking across the lawn and trespassing. She admits that she aggravated, or agitated the dog by a provocative gesture. The third incident, which, occurred after the dog was deemed "dangerous," was .a minor bite to a delivery man who mistakenly went down to the family's basement where Brody was confined at the time, even though he was not supposed to do so. This apparently was due to some type of miscommunication between he and Mrs. Sawh. I recognize, as does Mr. Sawh, that the dog has been deemed "dangerous." I also recognize that under the Lino Lakes ordinances, the animal control authorities are authorized to destroy a dog if a bite occurs after it has been deemed dangerous. The purpose of this letter is to provide my personal experiences and interactions with Brody, both in public places and at my home; all of which took place in a setting in which there were multiple people around, high traffic and energy, and other dogs present. Over the past year I have had the opportunity to observe Brody's behavior and interaction both with people and animals, and not once saw him exhibit aggressive or hostile behavior. Brody has always been mild mannered and a very affectionate dog. He has done very well at our softball games, not once showing aggressive behavior toward any of the people running around or other dogs that frequent our softball complex. On multiple occasions, Raun would bring Brody over to my house after our team's softball games and all of our team mates would gather and in turn bring their dogs as well. Brody, who had never met many of these people or other dogs seemed very comfortable and curious. He played well with the other dogs and was never aggressive toward any of my friends. Brody is a kind, affectionate, loyal dog. He is greatly loved and well taken care of by the Sawh family. The allegations that have been brought against him are not at all representative of his mild mannered behavior. Please take this letter into consideration when determining the outcome of Brody's life and the impact that "destroying" him will have on the family and friends that love him so deeply. Regards, Jeff Spinner • • • WS – Item 1 WORK SESSION STAFF REPORT Work Session Item 1 Date: November 22, 2010 To: City Council From: Mary Divine Re: Motorsports Facility Noise Study Background At the last City Council work session staff was asked to report back on the potential for completing a noise analysis report prior to the motorsports facility developers beginning a full Environmental Impact Statement (EIS). Council received a Preliminary Noise Evaluation and a Noise Control Concepts report from IMEDC's noise consultant in their weekly update on November 5. Staff has consulted with a firm specializing in indoor and outdoor noise and vibration monitoring, modeling, mitigation and design. An environmental and acoustical noise analysis begins by monitoring existing sound levels through the placement of receptors at various locations around the proposed site. The anticipated activity level of the track, including the track itself, sound systems, parking and tailgating activities, and estimated traffic increases to and from the facility would be estimated at "worst case" scenario. The level of accuracy depends on the level of specificity of the base information. At this point, the developers have provided only general information about the location, size and design of the facility and the additional infrastructure that would be required to support it. An EIS would be necessary to begin to reach that level of specificity. A base analysis of a noise study would cost in the range of $20- $30,000. Additional analysis, at additional cost, could provide more information such as: 1. Audioscape planning— simulates the sound that could be heard at different locations and types of events. 2. Low frequency noise analysis— studies the octave bands in a lower range, which is a more difficult frequency to measure. Low frequency noise can seem more like a vibration than noise. This is not currently regulated by Minnesota Noise Standards. 3. Predictions of noise over an extended time frame (20 -30 years) to estimate the impact of long -term traffic and development. Base monitoring data from the receptors could most likely be used as part of the EIS analysis if the EIS is done within a reasonable timeframe after the monitoring was complete. These studies outline mitigation measures that could occur, but do not provide real -life "after the fact" data about how people perceive the noise, how many complaints are received, and the impact of the facility on residents' quality of life. One could conclude from reviewing noise studies that race tracks make noise, noise impacts can be mitigated but not removed, each facility has unique issues, and conditions ranging from wind direction to temperature inversions can affect the decibel levels of all varieties of events at varying distances at varying times. Staff has met with IMEDC, who have indicated that they and their board of directors need reasonable expectation of support before initiating any additional studies. IMEDC is looking for a partnership with a city that wants a race track in its community, and will move on if Lino Lakes is not interested. Requested Council Direction Council's options include: 1. Request that IMEDC initiate a noise study specific to the Lino Lakes site. 2. Determine the level of study that would provide Council with sufficient information to determine if IMEDC should move forward. Staff will then request a proposal and cost estimate based on Council's direction. 3. Determine that Council supports the concept of a motorsports facility in Lino Lakes provided that proposed mitigation actions as outlined in the EIS are followed. 4. Conclude that the draft 2030 Comprehensive Plan does not support this type of use in Lino Lakes and inform the developers it would not support an amendment to the Comp Plan. 5. The Council shall annually designate a legal newspaper of general circulation in the City as its' official newspaper in which shall be published ordinances and other matters required by law and this Charter to be so published, as well as such other matters as the Council may deem it in the public interest to have published in this manner. Section 12.02. Oath of Office. Such code shall be based on concepts of professionalism, ethics, and will of the people. Further, such code shall include the appropriate responses to violations of its provisions. Section 12.04. Official Bonds. The City Administrator, the Clerk - Treasurer, and such other officers or employees of the City as may be provided for by ordinance shall each, before entering upon the duties of his /her respective office or employment, give a corporate surety bond to the City in such form and in such amount as may be fixed by Council as security for the faithful performance of his /her official duties. This corporate surety bond may be in the form of either individual or blanket bonds at the discretion of the Council. They shall be approved by the Council, and approved as to form by the City Attorney, and filed with the Clerk- Treasurer. The premiums on the bonds shall be paid by the City. Section 12.05. Sales of Real Property. No real property of the City shall be disposed of except by ordinance. The proceeds of any sale of such property shall be used as far as possible to retire any outstanding indebtedness incurred by the City in the purchase, construction or improvement of this or other property used for the same public purpose. If there is no such outstanding indebtedness, the Council may by resolution designate some other public use for the proceeds. Section 12.06. Vacation of Streets. The Council may by ordinance, pass on a four - fifths (4/5) vote, vacate any street or alley or 27 CODE OF CONDUCT Purpose To establish a code of conduct and associated remedies that council members agree to abide by in carrying out their duties as elected officials. This code of conduct does not supersede any existing or future statutory or constitutional rights, but simply outlines appropriate council expectations, behavior and interactions with each other, city staff, citizens and all other groups encountered as a result of city business, so as to efficiently and effectively develop and carry out the mission, vision, goals and established policies of the city. Roles/Responsibilities Meetings — By Charter, the mayor presides over meetings of the city council. Speakers, including council members, do not speak until recognized by the mayor. Act in the Public Interest — Recognizing that service to our citizens must be our primary concern, council members shall work for the common good of the people of Lino Lakes and not for any private or personal interest. Council members will treat all persons, claims and transactions in a fair and equitable manner. Preparation — Council members are expected to be prepared for city council meetings and work sessions. Agenda Preparation — The city administrator directs preparation of draft meeting agendas. The final agenda is determined by the city council prior to the meeting. At the council meeting, agenda items may be added or deleted by council members per procedures established in the city code. Conduct of Members Staff Direction — The mayor and city council members direct city staff, contract employees and consultants only through the city administrator, as determined by majority vote. At work sessions, the mayor will state the concerns of the council or specific directions provided by the council to the staff. The city administrator will request further clarification if he feels it is required so that there is a clear understanding of what the council's expectations are in terms of the actions to be taken by staff. Respect for Staff Time — If a council member is utilizing an inordinate amount of staff time, the city administrator is required to bring this to the attention of the city council for resolution. The city council of the city of Lino Lakes confirms its determination that standards of professionalism, ethics, and will of the people be adhered to among its members, as well as appointed and hired officials and employees of the City. Use of Public Resources A council member or member of any board or commission must not use public money, time, personnel, facilities, or equipment for private gain or political campaign activities except when a. the use is required or authorized by law; or b. the use is no greater than that allowed for members of the general public. This paragraph does not prohibit correspondence at any time to individual residents in response to the resident's specific inquiries, or general surveys of residents that are conducted before the time of filing for candidacy for elective office. 12a. Representation of Private Interests In keeping with their role as stewards of the public trust, council members or member of a board or commission shall not appear on behalf of the private interests of a third-party before the City council or any board, commission or committee or proceeding of the City. 12b. Within 30 days after taking the oath of office or being appointed to a position, each council member and member of a city board or commission must file a report with the city clerk, on a form prepared by the clerk, which contains the information specified below for the preceding year. Subsequently, each person must file a supplemental report on the first day of February of each year in office and within 30 days after any change in information provided under paragraph 5. The information must be for the individual, the individual's spouse, and all minor children (collectively referred to below as "person "): a. a business entity in which the person is an officer, director, member, or employee, and the position held; b. a business entity in which the person has an ownership interest, either legal or equitable, greater than 5 percent c. sources of income, compensation, fees, or commissions that are received from employment, for services rendered, or from pensions, except the employment of minor children; d. non -profit organizations in which the person serves on the governing body, and the position held, except if serving in that capacity as the city's representative; and e. real property within the city owned by the person or in which the person has a beneficial interest and that has an assessed valuation in excess of $10,000. The council may hold a hearing after receiving a written complaint questioning adherence to these principles or alleging a conflict of interest or failure to file a required disclosure statement, or on the council's own volition. At the hearing, the person accused must have the opportunity to be heard. A hearing will be held only if the city council determines (1) upon advice of the city attorney, designee or other attorney appointed by the council, that the allegations rise to the level of a violation of these principles or to the level of a legally- recognized conflict of interest, and (2) that the complaint has been lodged in good faith and not for impermissible purposes such as delay. Currently, the ordinance specifies in Section 503.16(7) that once the police have determined an animal to be dangerous, the following procedure will be followed: (a) The animal control officer shall cause one owner of the animal to be notified in writing or in person that the animal is dangerous and may order the animal seized or make orders deemed proper. This owner shall be notified as to dates, times, places, and parties bitten and shall be given 14 days to appeal this order by requesting a hearing before the City Council for a review of this determination. Mr. Roeser is proposing that once the police have deemed an animal to be dangerous, the animal be seized and quarantined at the owners expense until: (1) the animal has been destroyed; (2) moved out of the City, or (3) a hearing has been held and the Council orders conditions for keeping the animal and all the required conditions have been met within 14 days. Requested Council Direction The Council is being asked to consider this amendment. Page 2 of 5 3. A cover over the entire pen or kennel shall be provided. The cover shall be constructed of the same gauge wire or heavier as the sidewalls and shall have no openings in the wire greater than two inches; and 4. An entrance /exit gate shall be provided and be constructed of the same material as the sidewalls and 41110 also have no openings in the wire greater than two inches. The gate shall be equipped with a device capable of being locked and shall be locked at all times when the animal is in the pen or kennel. (d) UNPROVOKED. Unprovoked shall mean the condition in which the animal is not purposely excited, stimulated, agitated or disturbed. (4) Designation as potentially dangerous animal. The animal control officer shall designate any animal as a potentially dangerous animal upon receiving evidence that a potentially dangerous animal has, when unprovoked, then bitten, attacked or threatened the safety of a person or a domestic animal as stated in division (3)(b) above. When an animal is declared potentially dangerous, the animal control officer shall cause one owner of the potentially dangerous animal to be notified in writing that the animal is potentially dangerous. (5) Evidence justifying designation. The animal control officer shall have the authority to designate any animal as a dangerous animal upon receiving evidence of the following: (a) The animal has, when unprovoked, bitten, attacked or threatened the safety of a person or domestic animal as stated in division (3)(a) above; or (b) The animal has been declared potentially dangerous and the animal has then bitten, attached or threatened the safety of a person or domestic animal as stated in division (3)(a) above. (6) Authority to order destruction. The animal control officer, upon finding that an animal is dangerous hereunder, is authorized to order, as part of the disposition of the case, that the animal be destroyed based on a written order containing one or more of the following findings of fact: (a) The animal is dangerous as demonstrated by a vicious attack, an unprovoked attack, an attack without warning or multiple attacks; or (b) The owner of the animal has demonstrated an inability or unwillingness to control the animal in order to prevent injury to persons or other animals. 7 Procedure. The City's current fee schedule has been circulated to department directors with a request to update or amend the schedule as appropriate for 2011. Ordinance No. 11 -10 (the proposed 2011 Fee Schedule) is attached. Recommended amendments to the ordinance are printed in red. There are two corrections to the ordinance regarding building fees. In addition to those corrections, changes are outlined below for your review: Achieving Compliance through Education (ACE) Program - In 2010 the council authorized the Lino Lakes Police Department to implement the ACE program (allowing individuals who have been ticketed for certain minor offenses to chose education through the police department as an alternative to going through the court system). Certain fees are attached to the ACE program and it is appropriate to include them in the city schedule; Dangerous Dog Registration — Minnesota Statutes requires proper registration of any dog classified as dangerous and allows for an annual fee to be charged to the dog owner. The city fee schedule did not include this fee so it is being added. Appeal Fee — Zoning Ordinance Section 2, Subd. 4 Administration: Variances and Appeals allows for an Administrative Appeal. The procedures section states that an application shall be accompanied by a fee as established by City Council ordinance. The city fee schedule did not include this fee so it is being added City Staff Services — Department directors are recommending that the fee schedule include language that clarifies how the city charges for certain staff assistance (i.e. data practice requests, research, development project assistance). The finance director has recommended language that allows the city to charge for the specific employee's time based on their hourly rate plus benefits and overhead. The council holds a public hearing on the establishment of fees. The 2011 Fee Schedule Ordinance is presented for council review, a public hearing and first reading. The depreciation applies to the original surface of the right -of -way and to the overlays and seal -coats applied to the surface. The formula includes life expectancy schedules for each and has an estimated cost per square yard based on the quality of the right -of -way surface required for different levels of traffic. This formula creates a degradation fee which is determined by the cost per square yard for street, overlay, and seal -coat, multiplied by the depreciation schedule, multiplied by the area of the street patch. ATTEST: 40 Julie Bartell, City Clerk 9 Jeff Reinert, Mayor • DANGEROUS ANIMAL HEARING • • STAFF ORIGINATOR: Chief Kent Strege HEARING DATE: November 22, 2010 TOPIC: Dangerous Animal Disposition Background - November 8th a hearing was held where the city council upheld the declaration of the Sawh's dog as a "Dangerous Animal ". - The Sawh's were allowed to keep the dog if they followed stipulations determined by the City Council. - On November 9th officers of the Lino Lakes Police Department took a report of the same dog biting another person at 1366 Wolf Circle at approximately noon that day. o Chris Hanson contacted the LLPD (Incident #10- 258649) and reported that he went to 1366 Wolf Circle to deliver furniture. o He went downstairs to see where the furniture was to be moved to. o The dog came out of the unlocked kennel and bit him. o The dog left puncture wounds on his left hand (photographs taken) o He reported the incident after he spoke with his employer. o Officers later responded to 1366 Wolf Circle and after confirming the incident happened the dog was seized per ordinance and impounded at the Otter Lake Animal Care Clinic (OLACC) where it has remained since. On November 10th I spoke with the OLACC staff who advised me that since the dog was already about 2.5 years old the behavior was not likely to change with training. I drafted and had delivered a letter that informed the Sawh's that their dog had been declared dangerous on November 8th and had subsequently inflicted an unprovoked bite and per city ordinance it shall be destroyed in a humane manner. - The letter further stated that they have 14 days to appeal the order. Staff recommendation is the ordinance be followed and the dog destroyed. § 503.15 DANGEROUS AND POTENTIALLY DANGEROUS ANIMALS. (1) Attack by an animal. It shall be unlawful for any person's animal to inflict or attempt to inflict bodily injury to any person or other animal whether or not the owner is present. This section shall not apply to an attack by a dog under the control of an on -duty law enforcement officer or to an attack upon an uninvited intruder who has entered the owner's home with criminal intent. (2) Destruction of a dangerous animal. The animal control officer shall have the authority to order the destruction of dangerous animals in accordance with the terms established by this chapter. (3) Definitions. (a) A DANGEROUSANIMAL is an animal which has: 1. Caused bodily injury or disfigurement to any person on public or private property; 2. Engaged in any attack on any person under circumstances which would indicate danger to personal safety; animal; 3. Exhibited unusually aggressive behavior, such as an attack on another 4. Bitten one or more persons on two or more occasions; or 5. Been found to be potentially dangerous and/or the owner has personal knowledge of the same, the animal aggressively bites, attacks or endangers the safety of humans or domestic animals. (b) A POTENTIALLY DANGEROUS ANIMAL is an animal which has: 1. Bitten a human or a domestic animal on public or private property; 2. When unprovoked, chased or approached a person upon the streets, sidewalks, or any public property in an apparent attitude of attack; or 3. Has engaged in unprovoked attacks causing injury or otherwise threatening the safety of humans or domestic animals. (c) PROPER ENCLOSURE. Proper enclosure means securely confined indoors or in a securely locked pen or structure suitable to prevent the animal from escaping and to provide protection for the animal from the elements. A proper enclosure does not include a porch, patio or any part of a house, garage or other structure that would allow • • • • • • the animal to exit of its own volition, or any house or structure in which windows are open or in which door or window screens are the only barriers which prevent the animal from exiting. The enclosure shall not allow the egress of the animal in any manner without human assistance. A pen or kennel shall meet the following minimum specifications: 1. Have a minimum overall floor size of 32 square feet; 2. Sidewalls shall have a minimum height of five feet and be constructed of 11 -gauge or heavier wire. Openings in the wire shall not exceed two inches, support posts shall be one and one - quarter inch or larger steel pipe buried in the ground 18 inches or more. When a concrete floor is not provided, the sidewalls shall be buried a minimum of 18 inches in the ground; 3. A cover over the entire pen or kennel shall be provided. The cover shall be constructed of the same gauge wire or heavier as the sidewalls and shall have no openings in the wire greater than two inches; and 4. An entrance /exit gate shall be provided and be constructed of the same material as the sidewalls and shall also have no openings in the wire greater than two inches. The gate shall be equipped with a device capable of being locked and shall be locked at all times when the animal is in the pen or kennel. (d) UNPROVOKED. Unprovoked shall mean the condition in which the animal is not purposely excited, stimulated, agitated or disturbed. (4) Designation as potentially dangerous animal. The animal control officer shall designate any animal as a potentially dangerous animal upon receiving evidence that a potentially dangerous animal has, when unprovoked, then bitten, attacked or threatened the safety of a person or a domestic animal as stated in division (3)(b) above. When an animal is declared potentially dangerous, the animal control officer shall cause one owner of the potentially dangerous animal to be notified in writing that the animal is potentially dangerous. (5) Evidence justifying designation. The animal control officer shall have the authority to designate any animal as a dangerous animal upon receiving evidence of the following: (a) The animal has, when unprovoked, bitten, attacked or threatened the safety of a person or domestic animal as stated in division (3)(a) above; or (b) The animal has been declared potentially dangerous and the animal has then bitten, attached or threatened the safety of a person or domestic animal as stated in division (3)(a) above. (6) Authority to order destruction. The animal control officer, upon finding that an animal is dangerous hereunder, is authorized to order, as part of the disposition of the case, that the animal be destroyed based on a written order containing one or more of the following findings of fact: (a) The animal is dangerous as demonstrated by a vicious attack, an unprovoked attack, an attack without warning or multiple attacks; or (b) The owner of the animal has demonstrated an inability or unwillingness to control the animal in order to prevent injury to persons or other animals. (7) Procedure. The animal control officer, after having determined that an animal is dangerous, may proceed in the following manner. (a) The animal control officer shall cause one owner of the animal to be notified in writing or in person that the animal is dangerous and may order the animal seized or make orders as deemed proper. This owner shall be notified as to dates, times, places and parties bitten and shall be given 14 days to appeal this order by requesting a hearing before the City Council for a review of this determination. 1. If no appeal is filed, the orders issued will stand or the animal control officer may order the animal destroyed. 2. If an owner requests a hearing for determination as to the dangerous nature of the animal, the hearing shall be held before the City Council, which shall set a date for hearing not more than three weeks after demand for the hearing. The records of the animal control or City Clerk's office shall be admissible for consideration by the animal control officer without further foundation. After considering all evidence pertaining to the temperament of the animal, the City Council shall make an order as it deems proper. The City Council may order that the animal control officer take the animal into custody for destruction, if the animal is not currently in custody. If the animal is ordered into custody for destruction, the owner shall immediately make the animal available to the animal control officer. 3. No person shall harbor an animal after it has been found to be dangerous and ordered into custody for destruction. (8) Stopping an attack. If any police officer or animal control officer is witness to an attack by an animal upon a person or another animal, the officer may take whatever means the officer deems appropriate to bring the attack to an end and prevent further injury to the victim. (9) Notification of new address. The owner of an animal which has been identified as dangerous or potentially dangerous must notify the animal control officer in writing if the animal is to be relocated from its current address or given or sold to another person. The notification must be given in writing at least 14 days prior to the relocation or • • • • transfer of ownership. The notification must include the current owner's name and address, the relocation address and the name of the new owner, if any. • (Ord. 03 -08, passed 5 -27 -2008) § 503.16 DANGEROUS ANIMAL REQUIREMENTS. (1) Requirements. If the City Council does not order the destruction of an animal that has been declared dangerous, the City Council may, as an alternative, order any or all of the following: (a) The owner provide and maintain a proper enclosure for the dangerous animal as specified in § 503.15(3)(c); (b) Post the front and the rear of the premises with clearly visible warning signs, including a warning symbol to inform children, that there is a dangerous animal on the property, as specified in M.S. § 347.51, as it may be amended from time to time; (c) Provide and show proof annually of public liability insurance in the minimum amount of $300,000; (d) If the animal is a dog and is outside the proper enclosure, the dog must be muzzled and restrained by a substantial chain or leash (not to exceed six feet in length) and under the physical restraint of a person 16 years of age or older. The muzzle must be of the design as to prevent the dog from biting any person or animal, but will not cause injury to the dog or interfere with its vision or respiration; (e) If the animal is a dog, it must have an easily identifiable, standardized tag identifying the dog as dangerous affixed to its collar at all times as specified in M.S. § 347.51, as it may be amended from time to time; (f) All animals deemed dangerous by the animal control officer shall be registered with Anoka County within 14 days after the date the animal was so deemed and provide satisfactory proof thereof to the animal control officer; and (g) If the animal is a dog, the dog must be licensed and up to date on rabies vaccination. If the animal is a cat or ferret, it must be up to date with rabies vaccination. (2) Seizure. Animal control shall immediately seize any dangerous animal if the owner does not meet each of the above requirements within 14 days after the date notice is sent to the owner that the animal is dangerous. Seizure may be appealed to the district court by serving a summons and petition upon the city and filing it with the district court. (3) Reclaiming animals. A dangerous animal seized under division (2) above may be reclaimed by the owner of the animal upon payment of impounding and boarding fees, and presenting proof to animal control that each of the requirements under division (1) above is fulfilled. An animal not reclaimed under this section within 14 days may be disposed of as provided under § 503.15(6), and the owner is liable to animal control for costs incurred in confining, impounding and disposing of the animal. (4) Subsequent offenses. If an owner of an animal has subsequently violated the provisions under § 503.15 with the same animal, the animal must be seized by animal control. The owner may request a hearing as defined in § 503.15(7). If the owner is found to have violated the provisions for which the animal was seized, the animal control officer shall order the animal destroyed in a proper and humane manner and the owner shall pay the costs of confining the animal. If the person is found not to have violated the provisions for which the animal was seized, the owner may reclaim the animal under the provisions of division (3) above. If the animal is not yet reclaimed by the owner within 14 days after the date the owner is notified that the animal may be reclaimed, the animal may be disposed of as provided under § 503.15(6) and the owner is liable to the animal control for the costs incurred in confining, impounding and disposing of the animal. Studenski, City Engineer November 22, 2010 Resolution No. 10 — 104, Adopting an Expense Report for Costs Incurred in Carrying Out and Enforcing the Hazardous Buildings Proceedings Against the Property at 745 Oak Lane Simple Majority Resolution No. 08 -71 ordered the Removal of Hazardous Structures at 745 Oak Lane. That resolution further ordered that unless action is taken by the property owner to remove the hazardous structure the City would seek a Judgment for Enforcement of the resolution. The property owner did not take action after notification of the requirements of Resolution No. 08 -71. On October 22, 2008 the District Court heard the petition from the City of Lino Lakes for a Judgment of Enforcement; the District Court authorized the City of Lino Lakes to immediately cause the hazardous structures to be removed and to levy the costs for removal as a special assessment against the property at 745 Oak Lane. A copy of Judgment for Enforcement of Resolution No. 08 -71, ordering the Removal of Hazardous Structures, is attached. The City had the building inspected by a licensed inspector for regulated waste as required by the Minnesota Pollution Control Agency. An amount of regulated waste requiring abatement was found during the inspection. Bids were solicited for the work and the City Council awarded the contract to the low bidder, Arnt Construction Company, Inc , who performed the work. Staff and the City Attorney have kept an accurate account of the expenses incurred in carrying out and enforcing the hazardous building proceeding against the property, which are attached. Upon adoption of the expense report, the documentation will be submitted to the District Court at the Anoka County Courthouse for approval and allowance. The property owner shall pay the certified amount which shall be levied and collected as special assessment payable in a single installment. The above captioned matter came on for hearing before the undersigned Judge of District Court, at the Anoka County Courthouse, Anoka County, Minnesota, on the 22' day of October, 2008, upon Petitioner's Motion for Default Judgment. Petitioner was represented by Scott C. Baumgartner. There was no appearance by or on behalf of any of the owners of record of the subject property. The matter proceeded as if on default and the Court received evidence from the City of Lino Lakes regarding enforcement of a resolution ordering the removal of hazardous structures pursuant to Minn. Stat. §463.15, et seq. Based upon the foregoing, and upon all the files, records and proceedings herein, the Court now makes the following: 1 -68- FINDINGS OF FACT 1. That the City of Lino Lakes is a statutory city established pursuant to the laws of the State of Minnesota under Chapter 412 and located in Anoka County, Minnesota. 2. That on July 14, 2008, the City Council for the City of Lino Lakes adopted Resolution No. 08 -71 "Resolution Ordering Removal of Hazardous Structure In the Matter of the Hazardous Building Located at 745 Oak Lane, Lino Lakes, Minnesota 55014 and legally described as: That part of the Southeast 1 Quarter of the Northeast Quarter of sec 8, Township 31, Range 22, Anoka County, Minnesota, described as follows: commencing at the Southeast corner of said Southeast Quarter of Northeast Quarter; thence West along the South line thereof a distance of 466.4 feet to the point of beginning; thence continuing West along said South line 165 feet; thence North 3 degrees 22 minutes East, 315.1 feet; thence Easterly, 150 feet on line parallel to and 315 feet North of the South line of said Southeast Quarter of Northeast Quarter to an existing iron monument; thence Southerly, 315 feet to the point of beginning. The above described tract of land now being a part of lot 14, AUDITORS SUBDIVISION NO. 100. 3. That Resolution No. 08 -71 constitutes an "order" within the meaning of Minn. Stat. §463.17 (2004). 4. That pursuant to Resolution No. 08 -71, the City Council of the City of Lino Lakes found the building on the subject property to be a "hazardous building" for the following reasons: 1) The roof has collapsed and is rotten, exposing the interior of the home to the elements and rodents; 2) Portions of the home's walls have been crushed by trees; 3) The floor and interior wall sheathing is rotten and moldy; 4) The foundation is cracked; 5) The home and detached garage have broken windows, which may be an attractive nuisance to young children; 2 -69- • • • • 6) The structure is unstable and is in danger of collapse, which could cause injury and damage to persons and property adjacent thereto; and 7) The home condition is beyond repair and is not habitable 5. That in Resolution No. 08 -71, the Lino Lakes City Council ordered the record owners of the premises to remove the building in accordance with a previously submitted plan. 6. That in Resolution No. 08 -71, the Lino Lakes City Council further ordered that unless corrective action to remove the hazardous structures is taken or an answer served upon the City within twenty (20) days after the date of order to remove such building describes a failure and would prompt the City to seek a motion for summary enforcement pursuant to Minn. Stat. §463.15, et seq. 7. That pursuant to the affidavits of personal service on file herein, the City caused Resolution No. 08 -71 to be served personally upon the following persons or entities and at the following times: James Ash July 24, 2008 9. That the record owner of the property is James K Ash. 10 That the City of Lino Lakes has not been served with any answer to Resolution No. 08 -71 and the time for serving such answer has expired. 11. That not less than five days prior to the filing of a motion for default judgment herein, the City of Lino Lakes filed a true and correct copy of Resolution No. 08 -71, along with proof of service as required by §463.17, Subd. 3. A Notice of Lis Pendens as required by that section was also filed with the Anoka County Recorder. 3 -70- 12. That the record owner has failed to carry out the removal required by ID Resolution No. 08 -71. 13. That the hazardous condition of the property as described in Resolution No. 08 -71 remains. 14. That the City of Lino Lakes is entitled to the entry of judgment affirming Resolution No. 08 -71' Resolution Ordering Removal of Hazardous Structure" for the subject property. 15. That pursuant to Minn. Stat. §463.15, et seq., the Court is to fix a time which the City of Lino Lakes may proceed with enforcement of Resolution No. 08 -71 and delineate financial responsibilities and consequences. BASED UPON THE FOREGOING, the Court now makes the following: CONCLUSIONS OF LAW 1. The City of Lino Lakes is authorized to immediately cause the hazardous structures to be removed. 2. The costs of the removal shall be a lien against the real estate upon which the building is located and shall be levied and collected as special assessment in the manner provided by Minn. Stat. § 429.061 to 429.081, though payable in a single installment. 3. The City of Lino Lakes shall keep an accurate account of expenses incurred in carrying out the order and of all other expenses theretofore incurred in connection with its enforcement, including specifically, but not exclusively, filing fees, services fees, publication fees, attorney's fees, appraiser fees, witness fees, including expert witness fees, and travel expenses incurred by the City from the time 4 —71— • • • • the order was originally made, and shall credit thereon the amount, if any, received from the sale of the salvage or building or structure, and shall report its action under the Order with a statement of monies received and expenses incurred to the Court for approval and allowance. Thereupon the Court shall examine, correct, if necessary, and allow the expense account, and, if the amount received from the sale of the salvage or the building or structure, does not equal or exceed the amount of expenses as allowed, the Court shall certify the deficiency to the City Clerk for collection. The owner shall pay the same without penalty added thereon by October 1 of the year following certification and if not paid, the City Clerk shall certify the amount of expense to the County Auditor for entry on the tax list of the county as a special charge against the real estate for the subject property and such funds shall be collected in the same manner as other taxes. The amount so collected shall be paid under the municipal treasury. Using earth moving equipment, the property owner has created a racing /riding track for dirt bikes and other off -road vehicles. The use of the site for this purpose generates noise that is generating complaints from neighbors. Staff consulted the Zoning Ordinance and discussed the activity with the City Attorney. The conclusion was that an off -road racing /riding course is not an allowable use under the Zoning Ordinance. Staff then sent a letter to the property owner. The letter recognizes that riding recreational vehicles can be fun, but notes that the activity creates serious impacts on neighbors. The letter informed the property owner that the activity must cease. The property owner visited City Hall and maintained that he does not have a racing /riding facility, and that his vehicles comply with state law regarding the noise they create. (It was not clear to staff the specific law to which he was referring.) He maintains that riding motorcycles and ATVs on his property is not violating any law and is not prohibited. The Zoning Ordinance contains a means to resolve this through a City Council determination. In consultation with the City Attorney, staff is bringing this question to the City Council for a determination. It is important to remember that the determination applies not only to this site. ANALYSIS Uses Allowed by the Zoning Ordinance The position stated in the letter to the property owner is based on the following reasoning: • The Zoning Ordinance lists uses that are allowable in the individual zoning districts. Every zoning district states that, "no building or land shall be used and no building shall be erected, converted or structurally altered unless otherwise provided herein, except for one or more of the following uses" that then are specifically listed for that zoning district. • The property is zoned R -1 Single Family Residential. • Accessory uses allowed in the R -1 zone include "Swimming pools, sport courts, and other recreational facilities which are operated for the enjoyment and convenience of the residents of the principal use and their guests." • Swimming pools and sport courts are common accessory uses customarily found in residential neighborhoods. However, a racing /riding course for off -road vehicles is a very different type of facility, one that has the potential for significant negative impacts on nearby residents — impacts that are not created by permitted facilities such as pools and sport courts. Off -road courses are not customarily found in residential neighborhoods. • The racing /riding track is a "facility" in that there is an established track or route. There also are man-made topographic features that were intentionally created to enhance the experience of riding on the track. This differs from someone who occasionally rides a vehicle across or on the property, such as when moving it into a garage or onto a trailer. • The "other recreational facilities" phrase was not intended to include any and all conceivable types of recreational activities or facilities without regard to their impacts. • For these reasons, the conclusion was that a racing /riding track for off -road vehicles is not allowable as an accessory use on an R -1 property. The property owner disagrees with this conclusion. He believes that if he is not violating sound requirements established for his vehicles, he is not violating any law. Staff's conclusion is based on the uses listed in the Zoning Ordinance, not on statutory noise limits for vehicles. Nonetheless, a resident has the right to disagree with an interpretation of the Zoning Ordinance. The Ordinance provides an appeal process, which requires an application and fee. However, there is another approach to the current situation which is more efficient. As stated in Section 1, Subd. 1.E. of the Zoning Ordinance: In any zoning district, whenever a proposed use is neither specifically allowed nor denied, the City Council shall determine if the proposed use is comparable in potential activities and impacts to a use listed within the zoning district and is acceptable related to land use compatibility, traffic, and/or nuisance issues and established conditions and standards relating to development of the use. In summary, the City Council is the authority to determine if "other recreational facilities" in accessory use 10 in the R -1 zone allows for a dirt track for racing /riding off -road vehicles. That is: is such a track "comparable in potential activities and impacts" to a use that is specifically listed? • • • • • Staffs view is that a racing /riding track is a facility and use that is not specifically allowed by the Zoning Ordinance and therefore is prohibited: unless the City Council determines that the use is acceptable because it is comparable in potential activities and impacts to a use listed in the ordinance. Nuisance Violation Not Determined Chapter 901 of the City Code addresses nuisances. Racing /riding of off -road vehicles in a residential neighborhood may be violating the City Code because of the noise created by the riding activity. However, just when or if this is the case has not been determined and staff is not proposing to pursue this question at this time. The Planning & Zoning Board discussed this issue informally. The P & Z consensus is that the issue is a noise nuisance issue rather than a land use /zoning issue. If the City Council determines that the use of the site is not allowable under the Zoning Ordinance, there would be no need to pursue the nuisance issue. RECOMMENDATION 1. Approve Resolution No. 10 -106, determining that an off -road vehicle riding course is not allowed in an R -1 zone. 2. Return to staff with direction. In such cases where, in the judgment of the City Council, there is no comparable use listed, the City Council or Planning and Zoning Board, on their own initiative or upon request from the property owner, may conduct a study to determine if the proposed use is acceptable and, if so, what zoning district would be most appropriate and what conditions and standards should apply to the proposed use. The City Council, Planning and Zoning Board, or property owner, on receipt of the staff study, may initiate an amendment to the Zoning Ordinance consistent with Section 2, Subd. 1. of this Ordinance to provide for the particular use under consideration or shall find that the proposed use is not compatible for development within the City. This district is intended to provide a residential atmosphere for those persons desiring a single family neighborhood with a suburban density. This district is intended for development of single family detached homes on lots served with public sewer and water. G. Permitted Uses. In the R -1 District, no building or land shall be used and no building shall be erected, converted or structurally altered unless otherwise provided herein, except for one or more of the following uses: 1. Day care facilities (fourteen (14) or fewer persons). Governmental and public regulated utility buildings and structures necessary for the health, safety and general welfare of the City. 3. Subject to applicable provisions of this Ordinance, the following are permitted accessory uses in the R -1 District: 1. Accessory apartments as regulated by Section 3, Subd. 10. of this Ordinance. 2. Accessory buildings including garages, tool houses, sheds and similar buildings for storage of domestic supplies and equipment, as regulated by Section 3, Subd. 4.D of this Ordinance. 3. Fences, as regulated by Section 3, Subd. 4.R of this Ordinance. 4. Home occupation Level A as regulated by Section 3, Subd. 8 of this Ordinance. 5. Non - commercial greenhouses provided they do not exceed two hundred (200) square feet in area. 6. Parking spaces and car ports for licensed and operable passenger cars and trucks. 7. Radio and television receiving antennas, satellite dishes, TVROs three (3) meters or less in diameter, short-wave radio dispatching antennas, or those necessary for the operation of electronic equipment including radio receivers, ham radio transmitters and television receivers as regulated by Section 3, Subd. 15 of this Ordinance. 8. Recreational vehicles and equipment per Section 3, Subd. 4.P of this Ordinance. (This regulates the parking of vehicles on the property.) 9. Signs, as regulated by Appendix C of the City Code. 10. Swimming pools, sport courts, and other recreational facilities which are operated for the enjoyment and convenience of the residents of the principal use and their guests. The Lino Lakes Zoning Ordinance lists uses that are allowable in the individual zoning districts. Every zoning district states that, "no building or land shall be used and no building shall be erected, converted or structurally altered unless otherwise provided herein, except for one or more of the following uses "; which uses then are specifically listed. 2. Accessory uses allowed in the R -1 zone include "Swimming pools, sport courts, and other recreational facilities which are operated for the enjoyment and convenience of the residents of the principal use and their guests." (Sec. 6, Subd. 1.H.10). 3. An accessory use is defined as "a use of land or of a building or portion thereof customarily incidental and subordinate to the principal use of the land or building and located on the same lot with such principal use." 4. Swimming pools and sport courts are common accessory uses customarily found in residential neighborhoods. However, a racing /riding course for off -road vehicles is a very different type of facility, one that has the potential for significant negative impacts on nearby residents — impacts that are not created by permitted facilities such as pools and sport courts. Off -road courses are not customarily found in residential neighborhoods. 5. A racing /riding course or track is a "facility" in that there is an established track or route that often can include man-made topographic features, such as jumps, created to enhance the enjoyment of riding on the track. This differs from occasionally riding a vehicle across or on a property, such as when moving it into a garage or onto a trailer. 6. The "other recreational facilities" phrase in Sec. 6, Subd. 1.H.10. was not intended to include any and all conceivable types of recreational activities or facilities as accessory uses, without regard to the impacts of those uses. —95— • • • • 7. Section 1, Subd. 1.E. of the Zoning Ordinance states: • • In any zoning district, whenever a proposed use is neither specifically allowed nor denied, the City Council shall determine if the proposed use is comparable in potential activities and impacts to a use listed within the zoning district and is acceptable related to land use compatibility, traffic, and /or nuisance issues and established conditions and standards relating to development of the use. 8. The City Council is the authority to determine if "other recreational facilities" in accessory use 10 in the R -1 zone allows for a track for racing /riding off -road vehicles: whether such a track is "comparable in potential activities and impacts" to a use that is specifically listed. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes that: 1. A racing /riding course for off -road vehicles is not comparable in potential activities and impacts to a permitted accessory use listed within the R -1 zoning district The noise generated by off -road vehicles is not compatible with the residential atmosphere that defines the R -1 Zoning District. 2. A racing /riding course for off -road vehicles is not an allowable accessory use in the R -1 Zoning District. Simple Majority On May 14, 2007 the City Council awarded the Lake Drive/I -35W Improvement Project to Lunda Construction Company. Under a separate Joint Powers Agreement with the City, the Minnesota Department of Transportation (Mn/DOT) provided the project oversight and contract administration. Mn/DOT has completed all necessary project related work and provided the City with the final payment voucher to complete the project. The total amount of Payment Voucher No. 30 is $0.00. The final payment amount is a result of liquidated damages ($123,500) charged due to delays in the project completion. A copy of the Certificate of Final Contract Acceptance and Final Payment Voucher No. 30 is attached. The contractor has satisfactorily completed all work and has provided all necessary documentation. With this final payment the total construction cost comes to $7,851,028, which is approximately 3% below the construction budget of $8,073,000.
