CALL TO ORDER AND ROLL CALL : Acting Chair Michael Hyden called the Lino Lakes Planning and Zoning Board meeting to order at 6 :30 p.m . on February 12, 2014 . 2 . A PROVAL OF AGENDA T he Agenda was a pproved as presented . 3 . A PPROVAL OF MINUTES: January 8, 2014 M r. Root made a MOTION to approve the January 8, 2014 Meeting Minutes. Motion was supported by Mr. Laden . Motion carried 4 - 0 . 4 . OPEN MIK E Acting Chair Hyden declared O pen M ike at 6:31 p.m . There w as no one present for Open Mike. ACTION ITEMS A. CONTINUED PUBLIC HEARING to consider a Rezone to Planned Unit Development and PUD Development Stage Plan/Preliminary Plat for a mixed density residential development (222 single family lots and 85 unit multi -family building) to be called NorthPointe, located at the southeast quadr ant of 20 th Ave. S (CSAH 54) and Cedar Street K atie Larsen, City Planner, presented the staff report . Staff recommended approval of the PUD Development Stage Plan/Preliminary Plat and Rezone . Mr. Laden excused himself from this issue based on a conflict of interest. Board members discussed the proposal with staff. Discussion included: - Traffic and safety issues – t urn lanes are needed. - Traffic study was reviewed by the city engineer. - Existing trees and shrubs in the right of way should be removed for s ight safety. - Drainage issues were addressed and need to be improved. - The City is working through specific grading issues. - The City will want to review a n oise analysis prior to final plat approval. Developer, Larry Olso n, AJE Companies , was present. Mr . Olso n stated that they are working with the city to address all concerns and he has no issues with the list of conditions of approval. Acting Chair Hyden declared the Public Hearing open at 6 :58 p.m. Sharon Pignato, 6709 20 th Ave S ., asked about the ti meline of this development. Staff explained the proposed phasing plan. Ms. Pignato stated that they moved to Lino Lakes for its commitment to being rural. She said their road is not designed for extra traffic and expressed concern for safety of children . She stated concern that t urn lanes would be in her front yard. She asked about zoning laws. Staff noted that the area is guided for medium density and this development would be consistent with the city’s comprehensive plan Ms. Pignato was c oncerned a bout traffic, noise and safety on the road. She was additionally concerned about traffic on County Road J and Birch St. Julie McNeel y , 6687 20 th Ave., was concerned that proposed driveways will direct headlights right into her windows. She was concerned for her quality of living. She wondered if landscaping could help to mitigate the lights. Mr. Evenson made a MOTION to close the Public Hearing at 7 :10 p.m. Motion was supported by Mr. Root . Motion carried 4 - 0. B oard member s discussed traffic issue s and asked if the developer could include some landscaping that could mitigate the effect of headlights s hining into existing homes . Planning & Zoning Board February 12 , 2014 Page 3 APPROVED MINUTES Staff responded that the C ity cannot require the developer to take action on another person’s property. The board strong ly suggest ed that the developer work with the neighboring property owner s to discuss landscaping o n the existing lots to reduce headlights into the homes Mr. Root made a MOTION to recommend approval of the Rezone and Preliminary Plat based on the followin g conditions: 1. All comments from City Engineer letter dated February 7, 2014 shall be addressed. 2. All comments from Anoka County Highway Department dated January 24, 2014 shall be addressed. 3. All comments from MNDOT letter dated December 5, 2013 shall be add ressed. 4. All comments from Environmental Coordinator letter dated February 3, 2014 shall be addressed. 5. The Phasing Plan for development shall be incorporated into the plan set and listed on the Sheet Index. 6. The Phasing Plan identifies 215 lots, however; the preliminary plat indicates 216 lots. The Phasing Plan shall be revised. 7. The Floodplain Exhibit shall be incorporated into the plan set and listed on the Sheet Index. 8. A Letter of Map Revision (LOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any building permits for parcels located within the floodplain. 9. Temporary cul de sacs shall be required where a street is terminated pending future extension. 10. Drainage and utility easements shall be dedicated over stormwa ter drainage areas. 11. Drainage and utility easements or conservation easements shall be dedicated over wetland buffer areas. 12. Sheet 6, Preliminary Plat: a. Lot 1, Block 8 and Lot 9, Block 10 shall be revised to omit the portion of Outlot G that extends to Street I and a 20 feet easement shall be provided over the storm sewer utility. b. Lot 1, Block 1 and Lot 1, Block 11 shall have a 15 foot wide easement abutting CSAH 54 for landscape buffer. 13. Sheet 9, Ghost Plat: a. The City suggests future access through Outlot E if feasible. The current proposal creates a disconnect within the development. 14. Sheets 10 & 11, Preliminary Site & Utility Plan: a. Front and rear setback line for 65’-70’ wide lots shall be shown as 25 feet. Building pads may remain designed at 30 feet. b. Rear se tback line for 50’ wide lot shall be shown as 25 feet. Building pads may remain designed at 30 feet. 15. Sheet 14, Preliminary Grading & Erosion Control Plan: a. The garage location shall be reversed to meet the 5 foot side setback on Lot 7, Block 8 and Lot 22, B lock 7. Planning & Zoning Board February 12 , 2014 Page 4 APPROVED MINUTES 16. Sheet L1, Planting Plan: a. Remove comment that “Blvd Trees to be installed by Builder @ Time of Home Construction”. b. City will require tree escrow and will install boulevard trees. 17. Sheet L2, Planting Plan: a. Remove comment that “Blvd Trees to be insta lled by Builder @ Time of Home Construction”. b. City will require tree escrow and will install boulevard trees. 18. Sheet L3, Planting Plan Buffer Enlargement: a. Please verify landscape buffer plantings are allowed in NSP easement. 19. Sheet L4, Planting Plan: a. Outlo t G shall be added to the Open Area Landscape calculations. b. 245 Boulevard Trees are required but the Plant Schedule adds up to 244. Please revise. c. The Schedule for Buffer s and Open Areas should be separated. d. The Schedule for Open Space and Replacement Tre es could be combined. 20. The trail needs to meet the RCWD Rule F.6.(7)(iii), requiring that the linear surface must be 25' from the wetland edge. Motion was supported by Mr. Evenson . Motion carried 4 - 0 . B. PUBLIC HEARING to consider a Rezone , Preliminary P lat and Final Plat for a three -lot residential subdivision to be called Talan Ridge located at 260 Linda Avenue K atie Larsen, City Planner, presented the staff report including a history of the parcel . Staff recommended continuing the public hearing to a llow the developer to further address drainage, landscaping, and stormwater management. Staff explained that the proposal includes one P reliminary P lat with three lots , but two future Final Plats. Patrick Judge, Avenger Home Solutions, Inc., 3128 Pries t Lane, Mound, MN 55364 , is proposing to subdivide the parcel into three lots. He is v ery sensitive to redevelopment and sensitive to development what matches the community. The house th at is there now will be renovated . The s econd and third homes will be built consisten t with the neighboring homes. Mr. Judge u nderstands that they will need to delineate th e wetland in the spring. Acting Chair Hyden opened the Public Hearing at 7 :35 . John G rundhofer, 235 L inda A ve ., discussed the history of the sewe r installation in the area. Mr. Grundhofer stated that this development would disrupt the look of the entire street by adding additional houses there , noting that the residents are not in favor of it. Planning & Zoning Board February 12 , 2014 Page 5 APPROVED MINUTES Judy Brunner, 270 Linda Ave., stated that the City ha d no intention of developing this area. She stated that these additional properties would change the c haracter of the neighborhood immensely. She stated concern for the existing high water table and flooding issues. She stated that the w etland has been abused by previous property owners. She was concerned that the proposed development would increase the already existing drainage issues. She stated that the proposal is out of character with the area. Paul W h aley, 6200 Laurene Ave., distributed a commen t and photo from the neighbor at 250 Linda Ave. He stated that his concerns were similar. He stated that the proposal would not look right with the existing b eautiful rural properties currently on this road. He stated that this development would affect his property, stating that three new houses is too many for the wetland. He was concerned about dr ainage and additional flooding issues. He stated that he has lived there for 13 years and his sump pump runs every spring. He was concerned about water run off. He noted that the existing house would not fit in with b rand new homes on either side. Tom Brunner, 270 L inda Ave ., discussed history of the wetland. He was concerned about drainage and flooding issues. He stated that the pond is misrepresented on the submittal . He stated that he has contacted the city many times regarding flooding with no results. He said that a storm sewer is necessary. He is concerned about neighboring property values. He urged that the board look at this area very carefully . He considers three houses to be too many for drainage and aesthetic reasons. Brady Mullins, 6227 L aurene Ave., stated concern for existing flooding issues, noting that his driveway is flooded every year and his basement gets wet in the spring. He was concerned about s tanding water in this area with no drainage. He pointed out that the proposed lot sizes are not co nsistent with this area. He asked that the city not take a rural development in the middle of a road and make it residential. He would pre fer to see only two houses on the property, but not three . He stated that the proposal d oes not match the neighborhood and will look out of place. He was also concerned about headlights directed into his house. John Grundhofer, 235 Linda Ave., stated th at when this property went up for sale recently , the realtor advertised it as three lots, therefore the developer thought it would be three lots and could be three homes. Jason Wedel, City Engineer, stated that this proposal does not include curb and gutt er or street impr ovements. He noted that drainage concern s are the reason why staff is recommending continuation of this item , stating that there are issues for the engineering department to address. Mr. Wedel pointed out that record drawings from the co nstruction of Linda Ave. show that the street was designed to include sewer and water service to all lots on the road. Mr. Root made a MOTION to continue the Public Hearing to the March 12, 2014 P&Z Meeting. Planning & Zoning Board February 12 , 2014 Page 6 APPROVED MINUTES Motion was supported by Mr. Laden . Motion c arried 4 - 0 . Mr. Bru n ner asked why the item would be continue d to March if the pond can’t be delineated until May. Mr. Grundhofer added that they have complained to the city about the water problems for years. 6 . DISCUSSION ITEMS A. Project Updates Katie Larsen, City Planner , provided an update of current city projects . 7 . ADJOURNMENT M r. Laden made a MOTION to a djourn the meeting at 8 :08 p .m. Motion was supported by M r.
