B.PUBLICHEARINGforaConditionalUsePermittoallowacommercialdog kennelat7933 -24 th Avenue Mr.Bengtsonpresentedthestaffreport. ChairRaffertyopenedthePublicHearingat6:43p.m. Staffrecommendedapprovalsubjecttothe conditionsofthestaffreport. Mr.BengtsonnotedthathehaddistributedcityOrdinanceNo.03 -96toboardmembers priortothestartofthemeeting. Mr.RaffertyaskedtheBoardtoconsidertablingthisiteminordertoreviewthe distributedinformatio n. Mr.Pogalzaskedhowthecitycameuponthisrequest.Mr.Bengtsonrepliedthatthe PoliceDepartmenthadreceivedcallsregardingstraydogsfromthisproperty. Mr.Bengtsonstatedthatallordinancesandcodesectionsneedtobemetinorderfor appro val.Hepointedoutthatbasicsanitationstandardsareinplace,butstaffiscurrently workingtoamendtheanimalordinancetobetterdefinetheserequirements. Mr.Nelsonpointedoutadiscrepancyofthenumberofallowabledogswithinthereport. Mr.Bengtsonstatedthatwewouldclarifyfromtheapplicanttheexactnumberofdogs theyarerequestingtobeallowed. Mr.Raffertyaskedforpubliccomment. Theapplicantwasnotinattendance.Staffstatedthattheapplicanthadnotifiedstaffthat sh emaynotbeabletoattendthemeetingduetoillness. Noonewaspresenttospeakonthisissue. Theboardagreedtotabletheitem,butwereconcernedaboutcitationsbeingissuedprior to theitembeingresolved.Staffstatedthattheywouldremainin communicationwiththe policedepartmentregardingthisissue. Planning&ZoningBoard March8,2006 Page 3 APPROVEDMINUTES C.PUBLICHEARINGforaRezone,PerliminaryPlatandMUSAAllocationfor PheasantStrollEstates Mr.Smyserpresentedthestaffreport. Mr.RaffertyopenedthePublicHearingat7:04p.m. Mr.SmyserstatedthattheyhavebeenworkingwiththeAnokaCountyHighway Departmentandneighboringcitiesonroadalignmentissuesandinfrastructure. Mr.Smyserstatedthataletterreceivedbyares identwillbeincludedaspartofthepublic recordforthismeeting,andwasdistributedtotheboard. Staffstatedthattherewereanumberofoutstandingissueswiththisproject,therefore theywererecommendingcontinuingthepublichearing. Mr.Smy serstatedthatsuccessfuldevelopmentwillrequiresufficientaccessandutilities.He addedthatthesediscussionsareongoingandprogressing,butwillneedtoberesolved prior toplatapproval. Staffdiscussedroadwayandutilityoptionsthatarebein gconsideredforthesite. Mr.Raffertyaskedforpubliccommentontheissue. MikeBlack,RoyalOaksRealty,representingthedeveloperonbehalfofBrunn Construction,statedthattheyarealocalcompanythathasbeenbuildingintheareafora longtim e.HestatedthatBrunnpurchasedthispropertyinthesummerof2004,andhave beenworkingwithstaffandneighboringpropertyownerssincethentoplanthis development.HenotedthatBob’sAutoRanchisnotinterestedinsellingtheirpropertyat this time.Headdedthattheyareretaininganexistingloghomeonthesite.Theyfeelthat whattheyareproposingisthebestoptionforthissite.Theywouldliketwopermanent turnarounds,andaretryingtohelpfacilitatedevelopmenttothewest.Theyare tryingto avoidaliftstationandhavetriedtoaddressstaff’sconcerns.Theyareeliminatingan offsettingintersectionandallowingforfuturedevelopment.Theyplantoavoidadditional offsetintersections.RoyalOaksRealtydiditsownstudyofthis areaastowhatwould makethemostsensetakingtheareaintoaccount.Theybelievetheroad shouldlineup withKentSt.Theirproposalprovidesforapossibilityoffuturelotsonthe westernborderof thesiteandallowsforresidentialdevelopmentwh ilealigningtheintersectiontothesouth. TheybelievethatthisproposalmakesasmuchsenseandisassafeasanyplansLandForm hasproposed.Mr.Blackwouldprefernottomixuseswiththecommercialarea. Mr.Trallepointedoutthatminimizingacces spointshasnotbeensuccessfulinthepast. Heisconcernedforthecity. Mr.Blackstatedthatthisplanwouldallowforeitheraroadextensionornoextension. D.PUBLICHEARINGforaConditionalUsePermittoallowforaccessorydrive - throughandoutdoordiningfacilitiesforMiller’sCrossroadsShoppingCenter Mr.Smyserpresentedthestaffreport. ChairRaffertyopenedthePublicHearingat8:08p.m. Mr.SmyserclarifiedthatthePublicHearingisforthedrive -throughandoutdoordin ing only,notforbuildingdesignapprovals. Mr.Smyserconfirmedthattheproposedtrashareaisenclosedandthatthepeakparking issuehasbeenresolvedsincethestaffreportwaswritten.Staffwillrequiremore informationaboutth eretainingwall.Mr.Smyserclarifiedthattheoutdoorseatingwill onlybeaccessiblefrominsidethecoffeeshop,asperCUPrequirements. Staffstatedthattheyreceivedtwoemailedcommentsthatwillbepartofthepublic record,asweredistributedt otheboardpriortothemtg. Staffisrecommendingapproval. RobertBayer,6490HokahDrive,ownerofCuppaJo’scoffeeshopat6505WareRoad, statedthathebelievesthecityshouldhelplocalbusinessessucceed.Hestatedthat allowingthiscoffeeshop wouldhaveanegativeimpactonhisshopaswellastheentire SpiritHillsCenter.HebelievesatrafficstudyiswarrantedtoallowforaConditionalUse Permit.Mr.Bayerpointedouttherearecurrentproblemswithexistingtrafficbackupon BirchSt.,aswellastryingtoexitoffofWareRoadontoBirchStreet.He addedthatmany accidentshaveoccurredattheintersectionsofHokahDr.,BirchSt.,and WareRd. KatieAllen,389088 th CourtNEexpressedconcernabouttraffic.Shestatedthatan addition alcoffeeshopwithadrive -throughwillincreasetrafficontoBirchSt.She requestedanimprovementtotheintersectionatSpiritHills,possiblysignals,todecrease trafficproblems.Sheaskedthatthisitembetabledinordertoaddressincreasingtra ffic issuesonBirchSt. MichaelLawrence,339ArrowheadDrive,pointedoutthataccesstoMiller’sCrossroads fromBirchSt.isarightturnonlywithnoleftturnentrance.TrafficgoingwestonBirch St.wouldhavetoturnontoWareRd.toaccessthesi te.Hestatedthattrafficiscutting Planning&ZoningBoard March8,2006 Page 5 APPROVEDMINUTES acrosshisdevelopment.Hepointedoutthatthiswassupposedtobeaquiettownhome development.HecontinuedthatlimitingaccessfromBirchSt.willincreasetraffic throughtheresidentialarea.Hedoesnotseetheneedforanadditionalcoffeeshop.Heis alsoconcernedaboutthelocationofsignageforthisdevelopment.Heseesnocorrect accesspointsforadrive -thrufacility.Mr.Lawrenceconfirmedthathecurrentlylivesin the Miller’sCrossroadsTownhomes. Mr.GregSchlink,3564RollingviewDri ve,representingthedeveloper,statedthatthey havebeenworkingwithstaffformonths.Henotedthathehasclarificationonlighting issuespresentedinstaffreport.Hepointedoutthatthezoningofthepropertyisconsistent withthisproject.Hest atedthatsignificanttrafficissuesweredealtwithduringpreliminary platdiscussions.Hestatedthattheproposalisaresultofconsiderablediscussionswithcity staffandtheAnokaCountyHighwayDepartment.Headdedthattrailsandsidewalks remain asoriginallyproposed. PeterHilger,PortfolioDesignServices,explainedtheproposedlightingfortheproject andaskedforcomment.Headdedthatthetrail/sidewalkwillconnecttoHodgsonRoad.It wasclarifiedthatthemonumentsignwillbeinternal lylit. Mr.Ladenrequestedthatstripingbeaddedacrossthedrive -througharea.Herequested downcastlightingonly.Hewonderedwhytherewasnooutdoorseatingproposedforthe sandwichshop.Mr.Hilgerrespondedthattherehasbeennorequestbythes andwichshop tenantforoutdoorseatingatthistime.Heexplainedthattheissueistenantdriven,and usershavenotbeenconfirmed.Headdedthattheycouldcomebackinfutureforoutdoor seating. Mr.Ladenaskedhowtheoutdoorseatingareawillbesc reenedfromthedrivethrough andthetrasharea.Mr.Hilgerrepliedthatthetrashenclosureisfullyenclosed,witha roofandadoor.Mr.Hilgerdescribeddetailsoftheproposedlandscapingforthisarea. Mr.Hilgercommentedthatthiswillbeanattra ctiveoutdoorseatingarea. Mr.Hilgerpointedoutthatinteriorplanshavenotbeenfullydevelopedandthelayout maychange,butthebuildingplanshavebeenapproved. Mr.Raffertyaskedforimprovementstobreakthemonotonyofthebuilding,ifpossible. Mr.Trallepointedoutthat,althoughthebuildingwasapproved,thetenantuseisnow changing.Hestatedhedoesnotlikethedrive -throughandfeelsthatitwilladd trafficto thearea.Heexpressedconcernthattheexitroadconsistsofanangleinexcessof90 degrees.Hedoesnotlikethelocationofthegarbageandisalsoconcernedaboutthe businessesinSpiritHills. Mr.Raffertyexpressedconcernovertheuna ttachedtrasharea.Mr.Hilgerrespondedthat the originaltrashlocationwasnotenclosedandwaslocatednearthefrontofthebuilding, whereasatrashenclosureismuchpreferredtobelocatedinthebackofthebuilding. M r.Rootreiteratedthatthisisanallowableuse,andtheboardisnotabletochooseusers. Headdedthatthebuildingwasapprovedandisestablished,andreiteratedthatthetwo itemsfortheCUParetheoutdoorseatinganddrive -through.Henotedthat helikesthe outdoorseatingandfeelsitisagoodfeature.Hehasconcernswiththedrive -through includingstriping,thedegreeoftheangletoexit,andgeneratingcartraffic Mr.Rootaskedaboutthefutureparkingareaonthesouthsideofthebuildi ng.Mr. Smyserstatedthatthisparkingareawouldbeforemployeesonly. Mr.Rootwasconcernedaboutthelightingandsoundfromthemenuboard.Mr.Smyser pointedoutthatthenearesttownhomeisalmostthreefeetaway,andthatthespeakeris notlarg ethereforeshouldnotbeaudibletotheresidentialarea. Mr.Rootaskediftheboardcouldseparatetheapprovalsfortheoutdoorseatingandthe drive -through.Mr.Smyserrepliedthattheboardcouldseparatetheitems. Mr.Smysernotedthattrafficwas studiedaspartoftheentireMiller’sCrossroadsproject. Mr.Tralleexpressedconcernthatthedrive -throughwouldaddtraffictothetownhomes. Mr.Hilgerpointedoutthattheoriginalproposalforplattingthesiteincludedfour buildings,whichhave beenreducedtoonebuilding.HeaddedthattheCountyrequireda rightturnonlyontoBirchSt.,regardlessoftheuser.Hecontinuedthatadrive -through has thesameissuesofaccessasotherusers,andthattheyarenowproposingafractionof what th eystartedwith. Mr.Hydenwonderedifstudiesshowthatadrive -throughincreasesbusiness.Mr.Hilger repliedthatstudiesdonebyITE,InternationalTrafficInstitute,shownodataoncoffee shops,onlyfastfoodfacilities.Headdedthatthestudiessh owthatthebiggest contributionadrive -throughprovidesisareductiononparking. Mr.Hydenreiteratedthattheboardwillnotdeterminewhatuserscangointoaspace, andtheyshouldfocusonthetwoissuesathand. LindaFagerland,181EgretLane,askedhowtheboardcouldapproveacoffeeshopwith oneacrossthestreetifthegasstationwasnotapprovedbecausetherewasoneacrossthe street. Mr.SmyserrepliedthatwhenMiller’sCrossroadswasoriginallyconside red,thezoning wasnotyetdetermined.Heexplainedthatsincezoninghasnowbeendeterminedforthe site,thecitycannotrefuseauseifitisallowedinthatzoneandmeetsrequirements.He continuedthatthecityhasnolegalrighttorefuseacoffee shop.Headdedthattheyhave nodatatoindicatethatadrive -throughwillincreasetraffic. Mr.Lawrencestatedthathei sgenerallyconcernedwiththedrive -through.Headdedthat ifa drive -throughbusinessgoesoutofbusiness,afutureusermaynotneedadrive -through, buttheroadwouldremain.HestatedthatpeopledoturnleftontoBirchSt.fromLakota Trail.Hebel ievesthatadrive -throughwillincreasetraffic.Heagreedthatthedrive - throughandtheoutdoorseatingshouldbeseparateapprovals. Mr.Raffertypointedoutthatalotofstudieswereinvolvedinthedecisionsforthis development. Mr.Ladenexpressed concernforfutureuses,andaskedwhatelsewouldbeallowedina LimitedBusinessDistrictwithaCUPforadrive -through. Mr.SmyserrepliedtoMs.Allen’sandtheboard’squestions,explainingthatthree businesszonesincluderetailandnon -retailusers.Mr.Smyserreadthelistofallowable usesintheLBzoningdistrictfromthecity’sZoningOrdinance. Ms.Allenaskedspecificallyifalawfirmcanopennexttoagasstation.Mr.Smyser repliedprobabl y. JerryFagerland,181EgretLane,questionedthatifadrive -throughwouldnotgenerate moretraffic,whywouldabusinessputonein.Mr.Nelsonrepliedthatstudyshowsthata drive -throughreducesparking,minimizingthenumberofparkingstalls. Mr.Fagerlandcommentedthatcitizensareconcernedabouttrafficandsafety.Hestated thatheismorelikelytogothroughadrive -throughthanifhehastogetoutofhiscar.He notedthatnosafetyissueshadbeenspecificallyaddressed. Mr.Rafferty remarkedthatthisdevelopmenthasimprovedtrafficflowintheareaby addingasignalizedintersection.Headdedthatconsiderabletime,dollarsandeffortshad beenputintothisdevelopment. Mr.Fagerlandexpressedthatexistingownershavepracticalo pinions. Mr.Bayersuggestedthattheboardrevisitthetrafficpatternwiththisnewuse.Hestated thatheisaresidentwhohasdifficultyturningleftontoBirchSt.atanytime.He continuedthatgettingtoandfromhisbusinessacrossthestreetisd ifficult,andheis unabletowalkacrossthestreet. Mr.Raffertynotedthatroadissueswillnotgetfixeduntilthereisaneedforthemtoget fixed.Headdedthattheboardcannotfightdevelopmentofareasthathavearighttobe developed. Mr.Raffertyexpre ssedthathedoesnotthinkthisissuemeritsanadditionaltrafficstudy. Hepointedoutthatthemajorityoftrafficwillbeinthemorning,whichisnotmuch differentfromthatofadaycare,inregardstoatrafficstudy.Hestatedthatallofthe poin tsmadetonightwereveryclearandgoodcomments.HeconcludedthattheBoard needstofocusonarecommendationbasedoninformationbeforethemtonight. Mr.Hilgerrequestedaconditiontodecreasetheradiusoftheturnexitingthedrive - through.Head dedthattheboardcouldincludeaconditiontoincreasearchitectural review.Mr.Hilgerrequestedthattheproposalremainasonevote,astheissuesare linkedbydesign. Mr.PogalzmadeaMotiontoclosethePublicHearingat9:48p.m.,andwassupport ed by Mr.Hyden.Motioncarried6 -0. Therewerenofurtherquestionsforstaff. Mr.RootmadeaMotiontoRecommendApprovalofaConditionalUsePermitfor outdoorseatingwithConditions1 -4,6,8&9,removingConditions5&7,andadding Condition10,designatingacrosswalkconnectingthesidewalkthatgoesEast -Westfrom LakotaTrailtothefrontofthebuilding,andaddingCondition11,addingarchitectural pylasters.MotionwassupportedbyMr.Laden. Mr.Nelsoncommentedthathewould prefertovoteforbothissuesatonceastheywere presentedasawhole. Mr.Pogalzagreedandquestionedwhytheissueshadbeenseparated.Mr.Root respondedthathelikestheoutdoorseatingbutdoesnotlikethedrive -through. TheBoardrequestedcon firmationthatiftheexistingmotionweretofail,wouldtheybe abletothenvoteonbothcomponentstogether.Staffrepliedyes. Motionfailed3 -4.(Hyden,Nelson,PogalzandRaffertyvotingnay.) VI.DISCUSSIONITEMS Planning&ZoningBoard March8,2006 Page 9 APPROVEDMINUTES A.GTSTraining StaffstatedthatthecityannuallybudgetsforPlanning&ZoningBoardmembersto attendworkshopsofferedbyGovernm entTrainingServices.Staffencouragedboard memberstotakeadvantageoftheopportunity.Staffrequestedthatboardmembers reviewthecoursedescriptionsthatwereincludedintheirpacketsandtoadvisestaffif theyareinterestedinattending.Mr.L adenstatedthatheattendedclasseslastyearand foundthembeneficial.
