Staffrecommendedapprovalsubjectto the fiveconditions listedinthestaffreport . Chair Rafferty declaredthe continued PublicHearingopenat6:38p.m. Boardmembersexpressedconcernforcurrentunsanitaryconditionsofthesitealongwith runsthatdonotmeetstandards.Boardmembersagreedthatatthistime,thesiteisnot compliantw iththeregulationsforakennellicense.CityStaffremindedtheboardthat theyarevotingona conditionalusepermit fortheproperty,notakennellicense. Mr.Bengtson reportedthatthepolicedepartmentwillinspectthesiteforcompliance withth eordinanceinregardstoakennellicense .Mr.Bengtsonconfirmedthatthecity couldrevokethe conditionalusepermit if aviolationofSection502oftheCityCode occurs . Boardmemberswereconcernedwiththeissuanceofacommercialuseversusapr ivate use,notingthatacommercialuseisintendedforthesaleofdogs.Mr.Bengtsonnoted thatthestandardsforaprivateorcommercialkennelarethesame ,butamaximumof fourdogsareallowedwithaprivatekennel . Boardmembersagreedthatthea nimalordinances houldberevised ,stating thatit lacks standardsthatshouldbeinplacefortheprotectionofdogs. Mr .Bengtson clarifiedthattheapplicanthassubmittedaseparateapplicationfora commercialkennellicense and that th ePoliceDepar tment wouldhaveto inspectthesite for licensing. M r.Raffertyinvitedthepublictospeak.Noonewaspresenttospeakonthesubject. Thea pplicantwasnotpresent. Mr.Tralle madeamotiontoclosethePublicHearingat7:13p.m.andwassupported by Nelson.Motioncarried 6 -0. C.PUBLICHEARING toAmendthePlannedUnitDevelopmentConditionalUse Permittoallowforbuildingheightinexcessofthedistrictstandardsand revisionstothes itelayout,ApolloLanding Mr.Bengtson presentedthestaffreport. Mr.RaffertydeclaredthecontinuedPublicHearingopenat 7:35p.m. Staff recommendedapprovalof the requestwith three conditionslistedin the staffreport. PhilipCarlson,Equino xDevelopment,applicant,stat edth attherequest foraheight increase istoallowforan architecturalfeatureofaHamptonInnSuite ,andthatthe mechanicalarea will bescreenedfromview. Mr.Pogalz agreedthatitwouldbegoodto screenthem echani calarea . Mr .Raffert y askedwhytheparapetwouldnotbeincludedinthebackoftheb uildingas well .Mr.Carlsonrepliedthatit wouldnotbevisibletoanyone from therearofthebldg. Mr.Bengtson clarifiedthatthe intentofthe increased frontb uildingheigh tisforv isual appeal ,andthat itshouldbe high enoughtoscreen the mechanicals. Mr.Bengtson explainedthatthe siteplanhasbeenrevisedtoallow for additionalparking spaces forfutureadditions.Henotedthatthe e ntiresitewill consistof sha redparking. The a pplicant confirmedthat each futur ephase willbebroughtbackfor site approval. Hestatedthattheywouldhavelikedallofthebuildingsonthesitetobebuiltatthesame time.Headdedthatthehotelisnowa HamptonInnSuites,whichisbetterthan previouslyproposed. BradMichel,504 –77 th Street ,expressed concernabout thebuildingh eight .Heclarified thath ispropertyis located tothenorthofthehotel ,andtheh otelwilldirectlyaffectthe viewfromthebackofhis home.Heexplainedthathewasp resent atthemeeting toget moreinformationforhimselfand his neighbors.Hecontinuedthati nitially the developer statedthat the hotelheightwouldbewithincityordinances,and nowthathaschanged. Hepreferredt hatthehotel would remainthreestories. Mr.Michel stated that theheightislessofaconcernnowthathe attended themeeting and receivedclarification ontheproject . Mr.PogalzmadeamotiontoclosethePublicHearing at8:00p.m.andwassuppo rted Mr.T ralle.Motioncarried 6 -0. Mr.Pogalzasked ifthe firedep artment wa sawareofthe increased heightrequest .Staff repliedthattheyreceiveallapplications,andthatstaffhadnotreceiveda nynegative commentsfromthem. FrankJanes ,HartfordGroup,applicant ,statedthattheyhad r e c eived the memofromstaff withcommentsandsuggestions fromthereviewcommittee .Heexpressedthatthey couldaddress some oftheissues ,buthadconcernswithsome .Henotedthattheyh ave beenwork ingwithstaffforalongtimerevisingtheplanstoachieveaplanthatworksfor thedeveloper,staffandthecity.Hestatedthattheyarea ttempting to accomplisha townhomewithappealingarchitecturethatworksonthesite. Mr.Janes addressedeac h commentinorderof staff’sletter . 1 .Theapplicantfelttheyhave met therequired 15f ootset backfrom theRight -of -Way. Headdedthatthey mayadjust these setbacks. 2 .Theapplicantfelttheyhavemetthedesignstandardsfor materials ,adding that additionalbrickorstoneisnothighontheirlist. 3 .Shawn K not h ,Hartford Group,described the detailsof the buildingside s ,notingthat theycan addresstheissueofincreasing the buildingdepth.Mr.Janesnotedthatthey couldrevisethes eplansbeforethenextmeetinginanattempttoenhancethesideview, withoutaffectingcostandmarketability. 4.Theapplicantfeltthatinworkingwithstaff,theyhavemettheguidelinesand didnot feel that baywindowswerenecessary.Theirpropo salincludeddistinctdetailed differentiations,but they addedthattheycouldperhapsaddsome baywindows. 5 .Theapplicantstatedthattheybelievetheproposed variationofroofheights add sto the distinctionof the units andisan enhancement. 6 .Th eapplicantexplainedthatthecolorrenderingsubmittedisa representation ofthe colorscheme .Theywelcomedsuggestionsfromtheboard,andshowed true samplesof colorandmaterials. Mr.P ogalz commentedthatincreasingthebumpoutonthe b uilding doesincrease m aterialcost ,but pushing the endwall s outisnotincreasing it thatmuch.Mr.Knoth respondedthata neightinchbumpoutontheendwallcouldbeatt ainable. Mr.Knoth statedthattheyhave triedtoaccommodatestaff’scomment s andthinksthey areproposingagreatproduct. Boardmembersexpressedconcernforthelackofgutters ,potentiallycausing accumulatedwateronthepatiosand moisture inwindows .Theyfeltthatbaywindows andextrastonewouldbenicefeatures. Mr.Tralle commentedthathelikesthedifferentiationoflinesontheproposedroofs. Mr.Knoth explainedthattherearetwocombinationsofthebuildingdesigns.Theywill beplacedsothatnofaçadewillbeexactlythesameastheoneexactlyoppositeacrosst he street .Hedescribedthattheywillhavethesame architecturalstyles,butinadifferent combinationofunitsandcolors. Mr.Janes notedthattheywill mixupcolorsto the greatestextentpossible.Mr.Knoth addedthatthecolorswillstaywithin afivecolorpalette. Mr.Tralle waspleasedthatthedevelopment willlooklikeaneighborhood.Helikedthe u seofcolorchange.Hea gree d withbumpingoutsidewall s andwindows.Hewas concernedaboutgutters.Hecomplimentedtheapplicantonmak inggreatstrides. Mr.Knoth describedthatthedoorsurroundsandstoopswillbe madeof precaststone. Mr.La den suggestedthatthebuilding differentiationmightbestrongerif the pitchwas the sameb ut the roofheightw asvaried.Heagreedwiththe recommendationforbay windows,pointingoutthatthe guidelinesspecific a llycallfor a porch,baywindowor balcony.Hesuggestedthebaysbeboxedoutaspartofthebuildingfrontonly,sothe frontfaçadehasdepth.Asforthe sidegable ,hewould ratherseeabaythanagable.He suggestedif thereisabayonthefront,maybeone shouldbe on the sideaswell. Mr.Pogalz questionedwhattypeofconcretewouldbeusedonthe patios and sidewalk s. Mr.Janes repliedthattheycan clarify thata tthe next meeting. Mr.Janes assuredtheboardthattheywillconsiderthe comments made andincorporate whattheycanfromtheirperspective,andbringthemtothenextmeeting. Mr.Rafferty askediftheyhavedoneasimilarproject anywhereelse .M r.Janes replied notheyhadnot. Theapplicantaskedtheboardforcommentsonthecolors,notingtheyare willingto workwithstaffonspecificcolors.Theboardagreedthattheylikedtheselectedcolor schemeandappre ciatedseeingthesamples ,con cludingthattheapplicantsdid agood job. Mr.Pogalz askedtheapplicantiftherehasbeenmuch publicinterest i ntheproject sofar . Mr.Janes remarkedthattheyhavereceived someinterest.Mr.Pogalz askedforan approximatepricepointfortheto wnhomes.Mr.Janesrepliedthesewillnotbeentry levelfirst -timehomebuyerunits. Mr.Pogalz askedif Hartfordwill be do ingthe construction .Mr.Janesr e pliedthatthey received bidsfromanumberofcontractors and willbemakingadecision inthe next30 - Planning&ZoningBoard April12,2006 Page 7 APPROVED MINUTES 60days ,notingthatthesame contractorshouldconstructall ofthe units.Mr.Janes addedthatHartford willprovidequalitycontrolfromarchitecturalstandpoint. Mr.Janes wentontosaythatHartfordGroupwill stillownthepropertyandse lltheunits forbuild.Hartford willbeinspectingtheproductanditwillbeintheirbestinterestto makesurewhatisbuiltiswhatisonpaper ,hoping forbestprojectLinoLakeshasever seen.HartfordGroup willmonitortheproject. VI.DISCUSSIONITEMS A.GTSTraining S taff reminded the board tocontactDawnBuggeiftheyareinterestedinregisteringfora trainingsession.Staffconfirmedthattheregistrationcostwouldbepaidforbythecity priortotheevent. B.HardwoodCreek Mr.Smyser summarizedthattherewas ajointmeetingofthecitycouncilandallofthe advisoryboardstodiscusstheHardwoodCreekproject.Mr.Smyserasked if the board membershadfurthercommentsor if thosewho hadnotattendedthemeeting hadany questions. Mr.Raffertycommended th e masterplan ningoftheproject .Hec ommentedonthe importanceof p ark land .Heexpressedappreciationforthe op portunitytohavethejoint meeting. Mr.Tralle statedthathehad attended the openhouse ,andwasimpressedwiththe proposed underg r oun dwatering system. Mr.Rootagreedthatlargescaleplanning is best for allsituations.Hisonlyconcernwas the positioningofbigboxstores andthetransitionbetween commercialand r esidential uses. Mr.Ladenagreed withMr.R oot’scomments.Hee xpressedthe projectbringsinnovative ideas,exceptinthecommercialarea.Hew ouldliketoseesomethingdifferentinthe commercialarea. Staff commentedthatthe amountofparklandisanimportantpartof the design.Mr. Smysernotedthatthe ECSs ystemisbeingdeterminedtoseeifitwouldworkonthis site ,and probably only incommercialareas.Thecityisloo kingformoreecologically friendlywaterm anagement .Mr.Smyserstatedthatthec ommercialareas are stillbeing determined andwillre main onholduntil the roadaccessissueisset. Mr.Laden wonderedhowvaluabletheAUARwaswiththisproject.Mr.Smyserreplied thatthe AUARresultswerewonderful.Headdedthata nythingbuiltmustbeconsistent with the mitigationplan ,andthats omestrongrecommendationswillbemade,alongwith somesuggestions. C.R ehbein BusBarn Mr.TrallewasconcernedthattheRehbeinbussite wasinviolationof their Conditional UsePermit.Herecently droveby thesiteandthereappearedtobe no activity .He requestedthatthe CityCouncil beinformed thattheyarenotincomplianceastheir p artialaddition has not been completed andthe lightingconcernshavenotbeen addressed,as lights currently shineintoneighborhoods. Mr.Nelson statedthattheyhave fixedthelights. Mr.Bengtson statedthat therewasamajordelayintheprojectoverthewinter. However,hehadrecently r e c eiv eda phonem essagefrom R ehbein thatthey intendto followthr o u gh withtheproject .Theyhaverevisedtheirlightingwithoutapproval,so staffwill bebringingas -built plans tothe city council.Headdedthatt heyneedto connect tocitywater .Here portedthatprogress isbeingmade.Staffhasmadeavisitto thesite andnotedthat lightingwasimproved.
