Mr.Bengtsonnotedthatr evisionsincludedincreasedbumpoutonendsofb uildingsas wellastheadditionof baywindowsandguttersalongfrontelevations.Mr.Bengtson statedthat citystaffhad requestedareductioninparkingspaces inorder t oincrease the landscapearea.Mr.Bengtsonnotedthatthef inalplatincludes three buildingsinthefirst phase. Staff recommended approvalwith22conditionsaslistedinthestaffreport. Staffnotedthatbuildingsmeetbuild -toline requirements. Fr ankJanes,HartfordGroup,applicant,waspresentfor questions. Boardmemberscomplementedthedeveloperontherevisions of theproject. Planning&ZoningBoard May10,2006 Page 3 APPROVED MINUTES Mr.LadenmadeaMOTIONtorecommendapproval ofthePlannedUnitDevelopment FinalPlanforLegacyTownhomes,subjecttothefollo wingconditions: 1.Thedeveloperwillenterintoadevelopmentagreementwiththecitypriortothe issuanceofanybuildingpermitsforthesite. 2.Aminimum2inchdeepwindowtrimortwoinchrecessmustbeprovidedin accordancewiththedevelopmentst andardsforthesite. 3.Alllightingfixturesmustbesubmittedandprovetobeinconformancewiththe requirementsoftheLLTCDDG. 4.IssuesdiscussedintheS.E.H.engineeringreviewlettermustbeaddressedtothe satisfactionofcitystaff. 5.Operationan dmaintenanceagreementsforthesite,includingprovisionsfor stormwaterfacilities,mustbesubmittedforreviewbycitystaffpriortotheissuance ofbuildingpermits. 6.Homeowner’sassociationdocumentsmustbesubmittedpriortothecity rele asingth e platforrecordation. 7.Theapplicantshallprovideabicycleparkingareasufficientinsizetoaccommodate anappropriatenumberofbicycles.Thetypeoffixtureprovidedandthelocationof thisparkingareamustbereviewedandapprovedbystaffprio rtotheissuanceof buildingpermitsforthesite. 8.Alllandscapedandsoddedareasmustbeirrigated. 9.Allgroundmountedutilityequipmentshallbecompletelyscreenedfromviewwith appropriatelandscapingmaterials. 10.Allroofmountedequipmentshallb ecompletelyscreenedfromview.Thisscreening shallbeconstructedofmaterialsconsistentwiththoseusedforthemainbuilding. 11.Themailboxesproposedforthedevelopmentmustbereviewedandapprovedbystaff priortotheissuanceofbuildingpermit sforthesite.Suchmailboxesshallbe screenedwithcomplementarymaterialstothoseofthemainstructures. 12.Thedeveloperisencouragedtowrapthecornersofbuildingswiththepatioareasof theendunits. 13.Thefinalplatforthebuildingsontheea stsideofthesite,whichhavedrivesleading tothegaragesshallincludealimitedcommonelementforthosedrivestoprohibit othertownhomeownersfromparkingwithinthedriveofanothertownhome. 14.Thesixparkingspacesshownonthesiteplanclose sttoTownCenterParkwayand VillageDriveshallbeeliminatedandreplacedwithadditionallandscapingmaterials. 15.Theappropriateaccesseasementsforthepondswillbegrantedtothecityfor maintenancepurposes. D.PUBLICHEARINGforRezoneto PlannedUnitDevelopment andDevelopment StagePlan/PreliminaryPlatforTheP reserve Mr.Smyser presentedthestaffreport.Mr.Smyserremindedtheboardoftheadvantages ofaconservationdevelopment. Staffrecommend ed continu ing thePublicHearingtotheJuneP&ZMeeting ,inorderto addressoutstandingissues . Mr.Studenski explained thatthis developmentwouldenhanc e existingwetlandareas. Boardmembershadconcernswithincreasedtraffic,trafficflow,andtheproposedtrail. Mr.Smyser explaine dthatthe developerwillputinthetrailaspartoftheproject.Mr. S mysernoted that anareaofrareorchidsonthesite wouldbe preservedaspartofthe development.Mr.Smyser stated thatth isareawouldbevisiblefromthetrail,addingthat animportantpartofthecity’strailplanistoaccessnaturalfeatureareas . Mr .Smyser clarifiedthatadevelopment shown tothewestofthesite ona rendition from theapplicantdidnotrepresentarealproposal . J eanRiley,6575 P heasant R un,expressedconcernabouttheproposedtrailsthatrunon roads.Shewasconcernedabout increasedtraffic,notingt hat the BlackDuckDriveand BirchStreetintersectioniscurrentlya mess.She stated concern s aboutsafetyissueswith pedestrianscrossingthestreetsinthisarea aswellasincreasing trafficthroughthe Planning&ZoningBoard May10,2006 Page 5 APPROVED MINUTES neighborhood s .Shewonderedhow pedestrianst othenorth are supposedtocross B irch Streetinorderto accessthe proposed trails . Greg G raves ,6532K ildeer D rive,stated that herecalled whentheS addle C lubarea was developed t h erewouldbe noadditionalaccessesallowedoffofBirchStreet.He stated concernaboutfutureroadextension andincreasedtraffic .He askedwhatwouldh appen withthetemporaryculdesac andwasconcernedaboutpotentialdamagetotheroads duringthedevelopmentprocess . Michael Prieve,1047 A spen L ane ,expressedconc ernaboutroadissuesandwondered howthisdevelopmentwouldconnecttotheFoxboroughdevelopment.Hes uggestedthat theroadeventuallyconnectto62 nd street.He alsosuggestedimprovingtheentirepond insteadofonly ¾ofthepond asproposed. Sha wn McArdle,6508KilldeerDrive,statedthatwhenthep roposeddevelopmenttothe west wasdiscussedbythecity,thePoliceChiefsaidtha tBirchStreetcouldnotsupport anyadditionaltraffic .HerequestedthattheChiefofPolicebeinvolved andask ed if B irch S t reet c ould holdthisamountoftraffic . KevinOvergaard,6511 P heasant R un South,wasconcernedabout dailyeventsand activitiesatBi r chParkthatcause overflowparkingontotheroads .Hewasconcerned about increasedtrafficandspeed,an dthe safetyofresidentsaccessingthepark .He askedifanexpansionoftheparkingl otwouldbepossible. Clydie D ouglas ,1100T rapper ’s C ourt ,wonderedifthedevelopmentwouldimpactthe floodplainfor N orth T rapper ’s Crossing.Sheaskedwhatthe conservationprojectwould entail,andwa sconcernedaboutpedestriansinthewetlandareaaswellaspotential damageoccurringduring the restoration.Shenotedthattherehasbeendamageto existing parkproperty,andaskedwhowouldbemanagingactivit ywithincreasedpark use.Sheaddedthatresidentsdonotalwayscontrolpet waste. DonZ vareck,6331 C ripple Creek C ourt ,statedthatoverthelast1½to2years,therehas beenexcessivewaterretentionintheareatothewestofhishome.Hewond eredifthis wasduetotheFox boroughdevelopment.He wonder ed howth e areaw ould beaffected bythisproject andwantedtopointoutpossibleimpacttothisarea . Tom W eber ,6425 CassiopeiaCourt,sta tedthatthe wetlandareacompletelyfloodswith rai n.Hewasconcernedwithincreasedwaterretention,statingthisistheworstyearhe hasseen.Healso wonderedwhatthesilvertagsonthetreeswerefor .He expressed concern aboutincreasedtraffic,notingthatexiting12 th AvenuewestontoBirchSt reetis almostablindintersectionduetothehillinth e area. Steve Pickhartz,6381 MineralP oint,statedthat whentreeswereremovedinhisareafor a bikepath to c o mein,he wastoldthatthe amountof wetland sfilled neededtobe replaced2:1.He iswonderingwhy thisdevelopmentisnot being requiredtoreplace wetlandfill 2 :1 .HeagreedthatBirchStreettrafficis a concern. Mr.Husvethrespondedto publiccomment s .Heclarifiedthat the required wetland replacementforthis developmentis2:1 .Headdedthat anadditional 39acresof proposed wetlandrestorationisabovea ndbeyondtherequiredamount. Mr.Husve th explainedthattheDepartmentofNaturalResourceshasdeclaredtherare orchidsfoundonthissitetobean endangeredspecies ,therefore preventingthe ability of removal .Th is restricted thelocationof aroadthroughthisarea. Mr.Husvethstate dthatthet reetags wereforinventorypurposes,trackingthe locations, speciesanddiametersoftreeslastspring.Headdedthatthisinformationwasconsidered duringthepl anningprocess inhelpingtoguidethelocationofroadsandtrailsthrough th is development. Mr.Husveth notedthattheamountofuplandareabeingpreservedis fairlylow ,andthat 75percentiswetland.Headdedthatthisleavesav erysmalldevelopmentwindowfor theplacementof housesandroads .Hesaidthataboutfivetot enp ercentofupland is goingtoconservationareas. Mr.Husveth explainedthat waterentering thewetland areawillbeconsistentwith constructionrunoff.Mr.HusvethwastheecologistintheFoxboroughdevelopment ,and addedthattheb lockageofflow inthatdevelopment maybeduetobeaverdams.He addedthatan 80 -pagestewardshipplan forthissite isavailabletoany one interested. Boardmemberssuggestedthatcitystafflookintothepossibilityofimprovingtheentire pondonthenorthendof thesite.Mr.Smyser statedthatcity staffcandiscuss the possibilitieswith M r.Husvethonthepotential toimprovethewholepondatonce .Mr. Husvethaddedthatindividuallandownerswouldneedtobeincludedinthiseffort. Mr.Husvethgaveasu mmaryoftheplans for wetlandrestoration .Hestatedthat th is development willincludeenhancingthequalityofwetlandsthrougha ggressive vegetationmanagement ,enhancingaesthetics ,wildlifev alueandecologicalintegrity. Boardmemberswereconcern edaboutadditionalimpervioussurface,increasedrunoff anddrainageissues.Mr.Husveth respondedthattheyhave assessed the amountofrunoff andtakenadditionalstepsto infiltratewater,slowing the amountofrunoff. Mr.SmysernotedthatM r.Hu svethhasbeenveryhelpful workingwithstaff,andthathis ecologicalexpertise is appreciated. Mr.Smyseraddressedconcernsaboutparkland.Henotedthat cityparksarecurrently overburdened .Hestatedthata nareahasbeenconsideredforadditiona lparking.He statedthatthe roadwid thwouldallowforpedestrians. Mr.Rafferty requestedthatstafflookintot hepossibilityofdecreasingspeedlimitsin residentialneighborhoodswithnewdevelopments. Planning&ZoningBoard May10,2006 Page 7 APPROVED MINUTES Mr.Smyser notedthatany changeinthefloo dplainwouldhavetobemitigated.He pointedoutthatareasof standingwater are within the wetlandarea ,addingthatsome residentiallotsincludewetlandareas.Inregardtothebeaverdams,hestatedthatthe countyditchismanagedbytheRiceCre ekWatershedDistrict. Mr.Smyser explainedthatthecityrequiresrepairofanydamagestoroadsthatmay occurwithdevelopment.He addressedtrafficconcerns,statingthatthe intentis for PheasantR un S outh to connect to OldBirchStreet.Headde dthata lternativeBirch St reet connectionsw ouldhelpalleviate bottleneckissues andhelpdisperse traffic.He pointedoutthato ne goal of the transportationplan is toconnect PheasantRunSouthto 62 nd Street. Mr.Husveth specifiedthattheculdes aconthenortheast cornerof theF oxborough development hasasign designatingthatthestreet isafuturethrough -street. Mr .Smyser statedthatt hereisatrailstubin F oxboroughwiththeintenttoconnecttothe SaddleC lubsitewhenandiftheprope rtydevelops. Mr .Smysersummarizedthatthecity’si nterconnectedtransportationsystemisplannedto diffuse traffic congestion.Hepointedoutthatthisplanhappensinstageswitheach development. Mr.McArdle reiteratedthat inthepastthecity staffstated therewasnowaytoaddan outletonto O ld B irch S t reet andincreasetraffic.Heaskedwhystaffis s tatingthatitc an happen now .Mr .Smyser clarifiedthatinthepast,staffstatedthataproposedroadcould notconnecttoBirchStreetdu ethelocationofawetlandontheproperty. Mr .L aden encouragedcitystaffandthedevelopertoattempttodesignpathsthatare separatedfromtheroad,ashewasconcernedwithsafetyissues.Hec ommended the developerforpursuinghislandforconse rvationdevelopment. Mr .Raffertywondered whatcouldhavebeendevelopedifthisproposalwasnota c onservationdevelopment .Mr.Smyser repliedthata yieldplan fora standard developmentshowed that thenumberoflotswasthesame,buttheconservati on developmentallowsthelotstobelessdeepwithnarrowerstreets. Mr.Smyserstatedthatstaffcouldreexaminethelocationofthetrail. Mr.Trallecommentedthattrafficconcernsareexistentwitheverydevelopmentinthe city ,andthatthePlann ing&Zoning Boarddoestheirbesttoaddresstrafficconcerns. Hesuggestedthattheparkscouldaddfeaturesincludingbiketrailswithjumpssothat kidsdon’ttearupwhat’sthere. Mr .Hydenagreedtoforwardhandoutsfromothermunicipalitiestocitystaffinorderto distributeinafuturemeetingpacketforfurtherdiscussion.
