B.PUB LICHEARINGfor aZoningOrdinanceAmendmenttomodifythe allowableuseswithintheNB,NeighborhoodBusiness,andtheLB,Limited Business,zoningdistrictsandforaRezonefromLB,LimitedBusiness,toNB, NeighborhoodBusiness,atLot1,Block16,Mil lersCrossroads,locateda t the southeastcornerofBirchSt.andHodgsonRd Mr.Smyser clarifiedthataPublicHearing noticewaspublished forthisitem forthe next CityCouncilmeeting which willincludeamendmentstotheGB,GeneralBusiness District inadditiontotheNBandLBDistricts . Mr.Smyserpresentedthestaffreport and explain ed thattheCityCouncil directedstaffto rezonetheproperty .Examiningthedifferencesbetweenzoningdistrictsledtostaff recommendationtochangesomeofthe usesallowedinthebusinesszones .Staff requestedthattheboardtakeactionthisevening inorderfortheitemtogototheCity Councilmeeting aspublished . Mr.Tralle opened thePublicHearinga t6:59 p.m. Mr.GregSchlink,BruggemanProperties,ownerof Lot1,Block16,MillersCrossroads , gav eabriefhistoryofthesite .Mr.Schlink state d that thePlanning&Zoningboard recommendedapprovalof ac offeehousewithadrive -through ,butt he CityCouncil was preparedto denytherequest.Mr.Sc hlinkexplainedthattheywithdrewtheirapplication insteadofreceivingadenial.Mr.Schlink distributedaletter,datedSeptember13,2006, referredtoas MillersCrossroads ShoppingCenter(AgendaItemV.B.),to board membersandcitystafftobeinc ludedas partofthepublicrecord.Mr.Schlink toldboard membersthathe wasinformedt heissue wasa “donedeal,”thereforehehad no further comments butwould answer any questions. BoardMembersquestionedtheapplicantaboutthechangestothezoni ngordinanceas presentedand asked ifthedrive -through wa stheapplicant’smainconcern.Mr.Schlink statedthathethinksadrive -through useonalimitedbasisisreasonable forthissite, addingthattheintentisforasmallc offeeshop.Hebelieve sthiswould notcausea traf f icissueorbedetrimentalto theneig hborhood.Mr.Schlinkstatedthathismain concernisthedrive -through.Headdedthattheydo wanttheabilitytoservebeerand wine,provide outdoorseating,andhavethepotentialfo ra smallhospicefacility. Mr.Raffertyaddressedthatstaffhasaddedoptionstothe N eighborhood B usiness district asproposed ,andthattheCityCouncilwoulddenyadrive -throughatthislocation .Mr. Schlink statedhe wouldliketheopportunityt opropose a drive -through againinthe future,butarezonetothepropertywouldeliminatethatoption. Mr.Laden statedthathe is infavorofaneighborhoodbusinesszonetotheproperty.Mr. Ladenquestion ed whya cateringbusinesswouldfitin to aneighborhood zone ,asmost cateringbusinessistakenoffsite,andopposedachangetocatering butagreed with the other proposed c hanges. Mr.Pogalzasked whatthepropertywaszonedwhenthisprojectwasoriginallyproposed. Mr.Smyser repliedthatthesitewasoriginallydividedintoR -1and R -3 districts ,butthe sitewasguidedforcommercial.The C ouncil later approved arezo neto LB for th e corner.Mr.SmyserstatedthatwhenpropertywasrezonedtoLB,therewasagreat amountofdiscussionbetweentheLBandNBzonesatthattime.Themostr ecent applicationincluded the drive -thru,andC ity C ouncilstatedtheywouldden y the proposal. Mr.Pogalzquestioned Council’s intentfordenial.Mr.SmyserstatedthattheCity Councilre -examinedzoningofthesite,andnolongeragreedwiththeoriginaldecision. Mr.Smyserexplainedthatstaffgeneratedtheadditionalrevisi onstotheordinance accordingly.Mr.Pogalzquestionedthefairnessofthedecision. Mr.Smyserpointedoutthat the applicantwithdrewtheapplication,thereforeanintent wasamootpoint. Mr.Ladenaskedifabuildingwasproposedw iththe origina l approval .Mr.Laden believestheproposeduseseemedappropriateforthesite.Mr.Ladenaddressedthatthe originalproposaldidnotincludeadrive -through.Mr.Smyser repliedthat aproposed buildingwas reviewed andconsidered with theoriginalap proval. Mr.Ladenasked staff if a C onditionalUsePermit isgrantedforacoffeeshop,atalater time couldthatuseturnintoafastfoodrestaurantorwouldtheapplicanthavetoreapply. M r .Smyser responded thatconditionswereproposedforth is site torestrictthattheuse w ouldbe limitedto acoffeeshopaspartof C ity C ouncildiscussion. M r.Smyser explainedthatap e rmitteduseisausebyright,however acity canlegally addstipulationstoa ConditionalUsePermit.Hes tated thata C on ditionalUsePermit givesthecityexcessregulatoryability ,add ingthatthisisani mportantdifference betweenthetwo. Uponfurtherdiscussion,boardmembersandstaffagreedthatthefactistheapplicant withdrewtheapplication,thereforetheyneed edtoaddresstheproposalspresentedbefore themtonight. Mr.Smyser reiteratedthatthec ityhastherighttorezoneproperty.Headdedthat often decisionsaremadeandlaterdeterminedthatadifferentdecisionmayhavebeenbetter. Mr.Hydencommen tedthathe understandsthatth ecityhastheabilitytomakechanges andcan,but statedthat thedeveloperthoughttheyknewwhattheruleswere,andnowthe Planning&ZoningBoard September13,2006 Page 4 APP ROVED MINUTES rulesare being changed.Hestatedthathef eelsbadabouttheprocess.Mr.Hydenagreed with theproposedtextchangese xcept forthe catering issue .Hefeltthat all proposed amendmentssee mtofit theNeighborhoodBusiness district. Mr.Trallecommentedthathe alsodeterminedthata drive -throughwas notappropriate forthissiteaftertheP&ZBoard’srecommendation.Mr.Trallepointedoutthatmany proposalshavebeenmadeforthispropertyandth atthe proposedchangeswillopenup opportuni tiesforbusiness . Mr.Ladenpointedoutthat oftentimes thecityrezones property withouttheprop erty owner’sapproval ,andadded thatt herearenoguaranteestothezoningofaproperty. Mr.Raffertymadeamotiontorecommendapproval oftheproposed ZoningOrdinance AmendmenttomodifytheallowableuseswithintheBusinesszoningdistricts as pro posed withtheexceptionofthechangetocateringbusinesses.Motionwasseconded byMr.Hyden. Mr.Pogalzcommentedthatthe proposed siteiscurrentlybeingdeveloped and the propertyownerhassomethinginmind.Heb elievesthat theCityCouncil sh ouldwork withdevelopersthathavealreadybeenapproved. Arollcallvotew astaken onthemotion.Motionwasapproved3 -2 withthefollowing votes:Ayes:Rafferty,HydenandLaden.Nays:NelsonandPogalz. Mr.Ladenstatedthat the suggest ionofpro posing restrictions regarding thisissuehad be en madetoavoidlengthydiscussionso f thisissueinthefuture.Mr.Rafferty commentedthathefelttheboardcouldcontinuetoencouragecompliancewithout adopt ingstrictr equirements.
