Mr.Raffertyaskediftheapplican tistryingtomaintainthemajorityof the trees.Mr. Anderson explainedthatanumberoftreeswillhavetogoduetohousepads,but he wouldliketo arrangedriveway locationst ominimizelossoftreesonthesite . Mr.Tralleaskedifthis request wa ssimilarto anapplicationthatcamebeforetheboard inthepast.Mr.Bengtson repliedthat twoapp licationsofasimilarnaturewerepresented inthepastforAnokaCountyParklandwhichinvolvedablanketvariancesuchasthis one. Mr.Ladenaskedifstaffhadconsidered placing aconservationeasementoverthese properties sincesomeare asare zone dPublicSemi -Public.Mr.Bengtsonstatedthat there wouldbe easementsover the lakeshoreside oftheproperties whichwouldprevent developmentfrom occurring beyond theO rdinary H igh W ater L evelaswellaslakeshore setbacks ,therefore aconservatione asement wasnotnecessary .Staffstatedthat i ndividualpropertyownerswouldmaintain theseareas .Mr.Laden hadconcernsabout potential clearingandcuttingofvegetationinthefuture.Mr.Bengtson saidthat staff could discuss option swiththe city ’s Environmental Specialist inregardtosignageora programtomakelandownersawareoftherestrictions . Mr.LadenaskediftheEnv ironmentalBoardwouldreviewtheComprehensivePlan Amendment.Mr.Smyser repliedthatthis typeof application would not typicall ygoto theEnv ironmentalBoard .Mr.Smyserstressed thattheproperties involved arevery narrowstripsofland.Headdedthatthecitywill maintainaflowageeasementoverthe properties andthatthecity’ss horelandoverlayordinancereg ulatestosomedegree.Most propertyownershavehad previous accessthroughtheseproperties andthis process w ould formalizetheirownership. Applicant,BillTschida,St.P aulRegionalWaterServices ,statedthat 22propertyowners cametoaboardmeet ingrequestingownershipoftheseproperties.(Hydenarrivedat 7:08p.m.)Hesaidthatcurrentlythe boardgrantsuse ofthepropertiesto theproperty owners,andthatthisrequestiscompletelydrivenand strictly voluntarybyproperty owners.Heexp lainedthatpropertyownerwillconveythelandb yquickclaimdeed s , and theboardwillretainflowageanddrainageeasementsoverthepropertieswitha restrictionthatnostructurescanbebuiltonthem.Hedoesnotthinktherewillbeany furtherlake shoretobeaddressed afterthisrequest . Mr.Pogalzaskedifpropertyownershave haduseof thislakeshorepropertywithout payingtaxes.Mr.Tschida saidthatpropertyownershavebeenpayingan annualfee to havedocks andaccesstothelake.Mr.Ts chida statedthathe isunsureifthi swillcause propertytaxes to goup.He reiterated thatthis request ist otallydrivenby the property owners. Mr.Nelson madea MOTION to recommend approv alof theVariancesforRoad Frontage,LotArea,LotWidth,andLotDepth ,forpropertiesa long Peltierand CentervilleLakes asdescribedinthestaffreport .Motionwassupportedby Mr.Rafferty . Motioncarried 6 -0. E.PreliminaryPlatandVariancesforFrontSetbackandUplandAreaforFran’s Estate,BirchStreet –discussiononly Mr.Bengtsonpresentedthestaffrepor t andnotedthatthisitemwasbeingpresented tonightfordiscussiononly asstaffwas stillintheprocessofreviewingrecently submittedmaterialandwere notpreparedtomakearecommendationatthistime. Staffnotedthat since preparingthestaffr eport,thesurveyor h asagreedtoworkwith staff’sconcerns.Hesaidthatthes urveyorha dsubmitteda revisedPreliminaryPlat that showed ashareddriveway,an easementbufferandrevisedbuildingpads. Atthistime,staffisaskingtheboardforco mmentsontheissues presented . Mr.Rafferty wasconcernedthatifthis variancerequestwasgranted,itcould potentially setprecedence forfutureapplications.Headdedthatthisparcelis reallyonelotnottwo. Mr.L adenaskedforclarificationof whattheintent is for the amountofuplandsquare footageintheordinance .Mr.Bengtsonrepliedthat theintentisto provideenoughroom forabuildablelot whileallowing forsetbackrequirementsfrom the buildingpad. Mr.Nelsonasked if therevised plan includeda decreasedsetback .Mr.Bengtson replied thatthenew plansshowasmallerbuildingpadtoallowforagreatersetbackarea. Upondiscussion,boardmemberscommentedthatthepropertyisnotlargeenoughto allowfortwohouseswiththe limitedamountofupland. Mr.L aden wonderedifaduplexwouldfitwithinthedensity.Mr.Smyserstatedthatthe ComprehensivePlanrestrictsR -2tomediumdens ity. Boardmemberscommentedthatthe largepercentagevariancerequest wasexcessive. Chu ckPlowe,PloweEngineering,6776LakeDr.,representingtheapplicant ,statedthata lotofworkandresearch wasdone onthisproject ,includingworkingwiththe R iceCreek WatershedDistrict.Mr.Ploweagreedthattherequestisforalargevarianceam ount,but thatthe backlotline was notanissue.Henotedthata tonetimethecitydidanticipate twolots,astherearetwosanitarysewerservicesinplace.Heexplainedthata tonetime theselotshadsuitableuplandarea,but a highwayplatremove d10feetfromeachlot.He Planning&ZoningBoard October11,2006 Page 6 APPROVED MINUTES stated,therefore,thatheisnowleftwithahugewetlandinbackandthatthe highway tookawaylotfrontagearea. M r.Plowe pointedoutthatthere isahometotheeast whichis 35ft.from the edgeof the roadway,while they areproposinga30footsetback. Mr.Rootasked fordetailson thehighwaytaking the land ,wonderingiftheotherhomes existedatthistime.Itwasconfirmedthattheotherhomeswereexisting. Mr.RootstatedthattheBoardhastojudgeanap plicationbasedonthecurrent regulations,andnotwhathasoccurredpreviously. Mr.Nelsoncommentedthatitisanextenuatingcircumstancetolookatsurrounding homesandtheirsetbacks ,andthatitw arrantsconsiderationtolookatneighboring homes. Mr.Ladenstatedthatthisapplicationhasconsiderations,but he struggl es with the front yardsetback reduction . FranTourville,6948LakeDrive ,informedtheboardthat whenthecityputinsewer,they agreedtohookups ewerfortwolots.Mr.Tourv illestatedthatheh adnoideaatthattime theywouldremove ten feetfromtheproperties.He statedthey wouldhavefoughtthe hookupifhehadfor e seenwhatwasgoingtohappen.He notedthathe usedtohelpout thecitywithoutchargesbecauseheli vedhere ,andheis unhappyaboutthesituationheis innow. Mr.Trallestatedthat thisisau niquesituationthatneedstobedealtwithbut with concernfor settingprecedenceforothers. Mr.Tourville statedthatdueto thedepthofthelots,eachl otwouldbealmostoneacre . Mr.Bengtsonexplainedthatthen eighboringhomemayhavetobepurchasedbythe Countyiftheroadwidensinthefuture ,andthatallowingthesevariancesnowcould createaprobleminthefuture. Mr.Ladenaddressedthe bui lding padsandaskedwhatthedimensionswere.Mr. Bengtson notedtheproposeddimensionsforeach pad . Mr.Ladenaskediftheapplicantwouldallowforasmallerbuildingpadinorderto increasethesetback.Mr.Plowestateditispossible. Mr.Raf ferty commented thatauniquebuildingsituationcouldmakethedifference betweenoneandtwolots. Mr.Bengtson statedthatstaff wouldconsiderthecommentsoftheboardandwouldbring theapplicationbeforetheboardattheNovembermeeting asaPubl icHearing . F.AmendmenttothePlannedUnitDevelopmentFinalPlanforLakewood ApartmentstoAltertheApprovedElevations,LegacyatWoodsEdge Mr.Bengtsonpresentedthestaffreport.Mr.Bengtsonstatedthattheapplicantmaybe preparedtostatesomerevisionsthiseveningtotheconcernslistedinthestaffreport. Mr.Raffer ty statedthathe wouldliketoseeavisualofwhatwaspreviouslyapprovedto compareto the changes that arebringpresentedtoday. Theboardtooka 10minuterecessat7:59inorderforstafftomakecopiesofprevious submittedrenditionsforthe board’sreview.TheBoardreconvenedat8:09p.m. Mr.BengtsondistributedthepreviouslyapprovedplanstotheBoardmembers.Mr. Bengtsondescribedthechangesbeingproposedwithtonight’samendmentrequest. Mr.Ladenaskedifthedesignstandar dsrequirebalco n ies.Mr.Bengtsonst atedthatthese arerequirementsintheresidentialareas,butare not requiredinthe commercialormixed use areas. Shawn Knoth ,HartfordGroup,applicant waspresentforquestions . Mr.Tralleaskedif a proposed windowtreatmentwasadded.Mr.Knothrepliedthey werethesameasin previousplans. Mr.Ladenaskedwhatthereason is forremovingthebalconies.FrankJanes,Hartford Group ,explainedthattheb alconetteswere1.6inchunusablebalconies .Headde dthat theyw eretoldthattheywerebetteroffnothavingthemastheywerenotafullbalcony. MHFA(MinnesotaHousingFinanceAgency)advisedremovingthem.Mr.Ladenasked whattheissueswere.Mr.Janes respondedthattherewereconcernsaboutwhat people wouldusethebalconiesfor,and thatthey couldpotentiallybeusedforstorage. Mr.Knoth statedthathehas workedhardtomaintaintheintegrityofthebuilding. Mr.Pogalzaskedif somethingcouldbeadded,suchasadditionalbrick,tocom pensate forthe moneythatw ould besavedfrom removingthebalconies.Mr.Knoth statedthat theydidenhancethe cornerelement.He expressedthattheyare tryingtocreatethebest lookingbuildingtheycanprovide whilet ryingtoworkwiththeobstacl estheyhavecome upagainst. Mr.Knothexplained thattheperceivedvalueofthebalconieshaschangedfromwhat wasconsideredavaluetowhatisnowconsideredadetriment . Uponfurtherdiscussion,Mr.Janesexp lain edthattheyfoundawindowth atday that wouldworkandtheyareeli m ina t ingthisrequestforconsideration. Mr.Janes statedthatthey didfindsomeonethatwould offerawarrantyforthistypeof installationandthatwiththeoutsidetrim,theywouldmeettherequirementsofthe guidelines. Mr.Raffertyaske d what are asareH ardi e -board.Mr.Knothrespondedthat theentire buildingis Ha rdi e -boardpanel ,s moothwithatexturizedpainttogiveastucco appearance. Mr.Laden askedifthisis moreeconomicalthanEIFS.Mr.Knothrepliedyes,butthat thebiggerissue i smold. Mr.Nelsonwonderediftherewereanyreservationsbecausethere wa sonlyoneoption forthenewlyfoundwindow.Mr.Knoth reiterated thatthisinstallationis an unconventionalwaytoapproachthis ,butthatthecontractorwouldwarrantythewor k . Mr.Nelsonasked how thenewrenderinghasimprovedfromtheold.Mr.Knothreplied thatthereisa morepronouncedpresencetothecorner ,whichnowwrapsaround,and additionalcolorhasenhancedthebuilding . Mr.Nelson askedifMr.Knoth consider s removingthe balconettes animprovement.Mr. Knothreplied thatheisindifferenttothebalconettes,anddoes notconsider theirremoval tobe adetriment. Mr.Rafferty commented abouttheparapetheightsandaskedifthe wingedappearance w ouldbe improvedbyraisingthelowerparapetelements.Mr.Knothstated thatthe direction fromstaff wastomakethi scornerakeyvisualelement. Mr.Trallewashappytoseethebalconieswereremoved.Helikedthewindowswhere thebalconieswere.Hecons ideredthechangestobeabigimprovement.Helikedthe corner,thestrongfrontandthecolors.Hel ike d whattheycameupwith. VI.DISCUSSIONITEMS A.Spotlighton2030Update Mr.Smyser gavetheboardanupdateonthestatusofthecity’svisioningprocess.He statedthat approx imately 200invitations weresentto randomlyselected residents invitingthemto jointhevisioning committee.Henotedthattheresidentsweres elected atrandom via computerby the samefirm thatconductedthe citysurvey.Hestatedthat therewassomeresponse andaninitial meeting tookplace on Sept ember 30 ,anddue to smallattendanceatthatme eting,a makeupmeeting washeld .Hestatedthata communitybusinessforum tookplaceyesterday,andthatl astnight and tomorrownight were communityforums .Heexplainedthatresidentswereinvited a t the community forums tovolunteertoserveon subc ommittees.Cityboardmemberswillnotbeallowed toserveonvisioningsubcommittees.Henotedthatthegroups willmeet inNovember andDecember,andthatthey h opetohaveadraftofthecommunityvisioningplanby Dec ember 10to bringtotheCityCou ncilf orreview.Mr.Smysersaidthattheyhopeto havetheCityCouncilofficiallyreceiveaplanine arlyJanuary.HestatedthattheP&Z Board willbetheleadgroupforthe subsequent comprehensiveplan update process.He notedthati nformationand updatesarepostedonthe city website.Hestatedthat a commentlinehasbeensetup at 651 -982 -2485 ,andthatthef orumtomorrownightis opentoanyoneinthecommunity. Mr.Hyden questionedhowmanyresponseswerereceivedoutofthe 200 sent.Mr. Smyser repliedthattheyreceivedabout 20or30 responses .Mr.Hydenwonderedifthe majorityoftherespondents we refromaparticulararea.Board membersagreedthatthey hope response sarecoming fromavariedarea. B.RobinsonSodFarms Mr.Smys er statedthatstaffhashadsomediscussiontodevelopapprox imately 600acres oflando n the northwest sideofcity.Hesaidthatthepro spectivedeveloperdiscuss ed theproposeddevelopmentata recent worksession.Heexplainedthatn ospecificpl a n s wereproposed,but ageneraldiscussion washeld .He stated thattheCity Councilwas generallyfavorabletoalargescaleapproachtodevelopment inthisarea .He added that theapproach is to incorporateplanningofthatar eaintotheComprehensivePl anu pdate. Mr.Smysersaiditwouldbep ossibletodoanAUARforthispartofthecity,which couldbethebestapproachtoplanningthe northwest partofthecity.Henotedthatan AUARc ouldbeveryusefulfor theComp rehensive Planupdate.Hereiter atedthatno applicationhadbeen submitted.
