A.PUB LICHEARINGfora PreliminaryPlatandVariancesforfrontsetbackand
uplandlotareaforFran’sEstate
Mr.Bengtsonpresentedthestaffreport.
Mr.Bengtson stated thatthisitemwasdiscussedattheOctober11,2006 meeting .Mr.
Bengtson notedacorrectiontothestaffreport thatparkdedicationforthisapplication
wouldincludeonelotonly,andtheamountwouldbeadjusted fromthestaffreport .He
clarifiedthat the conditionreferringtoparkdedicationdidnot specify anamount,
t h ereforenocorrectiontotheproposedcondi tionwasnecessaryforthiscorrection .
Mr.Nelson asked staff about limitingthetypeofconstruction inthiscase .Mr.Bengtson
s aid that the applicant couldreducethesizeofthe buildingpadsforeachhouse inorder
to increasethesetbackamounts.Mr.Bengtson pointedoutthat anyhomebuiltwould
needtomeet a 40 -footsetback ,soadjustingthebuildingpad couldbe apossibility.
Mr.Laden notedthatth ehousetothewest had asidey ardsetbackof28 feet ,andasked
staffifthereis adifferencebetween meeting side or front yard setbacks.Staffreplied
thatu ndercurrent city ordinance,thefullsetback amount isrequired forboth .Staff
notedthat t heordinance mayhavebeen differentatthetime thehousenextdoor was
constructed .
Mr.Bengtsonstatedthatthezoningordinanceallowancetoreducefrontsetbackstothe
averagesetbackofadjoiningpropertiesdoesnotapplytothissitebecausethepropertyto
thewestdoesnotfrontontoBirch Street.However,ifitdidapply,theaveragesetbackof
theadjoiningpropertieswouldbe20.5feet.Thisaverageisfromtheexistingrightof
waylines.Iffullrightofwaywasgranted,thehousetotheeastwouldhaveasetbackof
closetozero.
A pplicant,FranTourville,6948LakeDr,LinoLakes ,saidthathispropertywastheonly
landonB irch Street thatha d a10footeasementtakenfromit.Henotedthatthis puts his
setback amount anothertenfeet.Mr.Tourville statedthathe wasn’taware ofthesizeof
the revised buildingpadsuntilhegottheagenda ,ashehadnotbeenoutofcontactwith
hisengineer .Mr.Tourville saidhe feltthatthe buildingpadscouldbereduced even
further than currently proposed .Mr.Tourville statedthatthe wetlandwasdelineatedas
Class3,andthathecouldgetapermit toremove400sq.ft.whichhecouldapplytolot
two .
BoardMembersdiscussedpossibleoptionswiththeapplicant.
M r.Tourville saidthathe wastoldhecouldget a permit tofill 400s q.ft.withoutany
mitigation exchange.
CityEngineer Jim Studenskistatedthatthereisanamount thatcanbeimpactedwithout
mitigation.
Mr.Tourvillestatedthathe could attemptto increase the front setback s for both lots.

BruceSchmidt ,6498 T otem Tra il ,askedwhattheapplicantwasproposingtodowiththe
ditchthatwasbetweentheirproperties.
Mr.Tourvillerepliedthathe hadproposedextendingtheculvert80feettothesouthand
filling itinsothelotswouldbeeven.Headdedthatifthec ity weretohavea
m aintenanceproblemwiththat then itw ouldremainthesame.
Mr.NelsonaskedMr.S c hmidt ifhehadconcernsabout theproposalfortheditch.Mr.
Schmidt repliedthathe somewhat likestheditchandwasjustwonderingaboutit.
Polly G reve ,6469 T omahawk C ourt ,statedthatherpropertyborderstheapplicant’sin
the southeast cornerandwasconcernedaboutwetlandfill.Shecommentedthatshe
alreadyhasproblemswithwaterinh eryard ,andbecauses heisdownhill fromthe
applicantshe isworriedaboutincreased drainage problemstoherproperty.Sheasked
whatoptionsshehadifproblemsweretooccur.Mr.Studenski respondedthat 400feet
offillwouldhave averyminimalim pact andthatthis amountwouldnotaffectdrainage.
Ms.Greveaskedwhatwouldhappenif theproblemd id makeitworse .Mr.Studenski
repliedthatthe citywouldlookintotheditchareatodeterminetheproblem.
Boardmembersdiscussedthepotentiali ncreaseinuplandareabyfillingin400feet.
Staffnotedthattheproposedchangescould alleviatesomeofthesituation ,butthatthey
couldnot makecommentorrecommendationon proposalswithout seeing plans.
Mr.Ladenaskedifthe proposalc ould be approve d byaddingconditions.Mr.Bengtson
statedthatthey could addthechangestothe conditions ofapproval,buttherewouldbe
no confirmationthatthesething s recommendationswereadheredtobythecouncil.
Mr.Laden askedtheapplicantwhenh eplans onstartingconstruction .Mr.Tourvillesaid
thatheis wideopen ,probablynextspring,addingthatheisin nohurry.
Mr.Rafferty notedthattheproposal doesnotmeetord inancerequirementsandapproval
couldset precedence forthefuture .
B oardmembersdeterminedthat because twoboardmemberswereabsentandnotall
memberspresentwereinfavoroftheproposal ,itmaybeintheapplicant’sfavortocome
backwithrevisedplans.

lot s .Hewonderedhow farbackontheproperty the houses would be.Headdedthath is
propertyisasponge andwonderedhowthiswould affecthisproperty.Mr.Tralle replied
that accordingtothecityengineerthisproposalshou ldnotaffect his property.
Boardmembersaskedtheapplicantifhewouldliketheboardtovoteontheitemor ifhe

B.PUBLICHEARINGfor aComprehensivePlanAmendmenttochangethe
proposedlandusefromPublic/Semi -PublictoLowDens itySeweredResidential
forpropertiesownedbytheSt.PaulWaterServices
Mr.Bengtsonpresent edthestaffreport ,notingthataComprehensivePlanAmendment
wasnecessaryasthe Comp rehensive Plandesignatedsome oftheaffected parcelsasPSP
(Public and Semi -Public ).
Staff clarified thattheSt .PaulRegional W aterServices wa snotlookingtoselllandto
getridof holding s .Adjacentp ropertyowners requested topurchasetheseparcelsofland
to combine withtheirproperties.
Staffrecommendeda pprovaloftheproposedrequest.
Mr.Ladenasked ifa full trail connection wouldstillbepossiblewiththis .Mr.Bengtson
respondedthatthechangeofownership wouldnotaffectthecit y’sabilitytoputinatrail.
Mr.Tralleopenedthe P ublic H earin gat 7:43p.m.
Staffnotedthat a representative fromtheSt.PaulRegionalWaterServices wasnotable
toattendthemeeting.
HenryFarmer ie,7425PeltierLakeDrive ,askedifthere we re planstobringcitywater
andsewertotheproperties.Mr.Beng tson repliedthatchangingthelandusetolow
densityseweredresidential doesnotmean the cityhasplansorthecapacitytodoso,but
inthefutureitwouldbeintendedforfullservice when possible .
Mr.Smyser explainedthat theutilityservicefo rthatareawouldcomefromtheeast ,
along 20 th Avenue ,asthereis nosewerpipeto bring up P eltier L ake D r.Hesaidit
w ould dependondevelopmenttotheeast .
Mr.Farmer ie askedif changingthezonewasarequirementbeforethelandowner could
buyt heproperty,andnotedthatthepropertyowners wereofferedthesestripsabouta
yearago.

Mr.Bengtson explainedthatwhilestaffwasreviewingtheprocess,theydiscoveredthat
thesesliversoflandwereguidedPSP.Thecityc annotmerge two pieceso flandifone
pieceisdesignatedPSP ,sothiswas anunanticipatedproblem.
Mr.Farmer ie statedthatcurrentlythestripsoflandbetweenthemandthelakehavebeen
offeredonlytotheadjacentpropertyowners,but askedifs omeoneels e couldpossibly
c omeandbuy aparcel .Mr.Bengtsonrepliedthat staff recommended a condition that the
parcels wouldonlybeavailableforsaletotheadjacentpropertyowner.Theintentofthe
S t .PaulReg ional WaterServicesisto sell theparcels to the adjacent prop erties only .
Mr.Raffertyaskedforclarificationonthelotcombinationprocedureandif St.Paul
RegionalWaterServices willmaintainparcelsnotadjacenttodevelopedland.Staff
clarifiedtheprocess andexplainedthattheSt.PaulRegionalWaterSe rviceswould
continuetoholdparcelsnotsoldtoadjacentpropertyowners .
M i ke M astro ,1553 L amotteDr .,statedthatt hereisa60 -footoutlotnexttohis property
whichhasacity -owned drainageditch that needstobeattendedto.Henotedthatthec i ty
alsohaspropertyadjacentto the RegionalWater Ser v i c e sproperty.Hestatedthathe
c urrentlyhassolerightsof the use oftheadjacentpropertythroughan insurancepolicy
andanannual dockagefee.Hewonderedifhe own ed theproperty,wouldthos e
obligationsgoaway .Mr.Mastrowasinformedthatthep ropertyownerwillown the
parcelsand St.Paul WaterServices willhaveaccessonly.Hewasinformedthatm any
oth ercommunitieshavedonethis.
Mr.Mastro saidthathe heardtherewouldbeafee throughthisprocess.Mr.Bengtson
explainedthatthisis not the laststepin the process.Theproposalwouldgotothe
Met ropolitan Council ,anda minorsubdivision wouldneedtobedoneadministrativelyto
divide the property.St.PaulWaterService sw ould betheapplicantandw ould haveto
establish anescrowaccountforstaffreview.Staff is not aware iftheregionalwater
s erviceswillaskpropertyownersformoney.Ultimately,theproperties will needtobe
combined withadjoiningparcels .
Mr.Mastro statedthathe hasalreadygiventhereg ional waters er v i c e s his application
andfees.
Gerry L ind n er,7413 P eltier L ake D r .,statedthathed oesnotwantatrailtocome
betweenhimandthelake.Mr.Bengtsonstatedthatthisisnotinanyw ayadiscussionof
atraillocation ,andthatthecity’s trailplanindicatesatrailinatheoreticallocation.Mr.
Lind n er wantedit statedfortherecordthathedoesnotwantatrailacrosshisland.Mr.
Lindnersaidthatthe St.PaulRegional Water Services askedhimtopaytosurveyhis
landandhe was wonderingifthecity was goingtohelppaythecostsforsurveying.Mr.
Bengstonrespondedthatthecity doesnot payforpropertyownerstohavetheir
propertiessurveyed.Itwassuggestedthatit maybemore costeffectiveifmultiple
propertieswouldbesurveyedatonce.
Mr.Farmer ieaskedaboutthefeesassociatedwiththenextstepoftheprocess.Mr.
Bengtson explainedthatfeeswouldberequiredanditis upto the applicanttoworkout
who paysfor those fees.

C.CSAH49/CountyRdJ Draft MasterPlanApproval toProceedwith the Public
ReviewProcess
Mr.Smyserpresentedthestaffreport .He announcedthatthedraftmasterplanisready
forreviewandisavailableonthecity ’s website .Ano penhouse is scheduled for
November15 .
Mr.Smyserexplainedsome ofthe pertinentsectionsoftheplan.
Mr.Smyserpointedoutthat it is necessarytolook at the surroundingarea and i mportant
torecognizeneighboringdevelopmentwhenplanning.Hepointedoutthat the
transportationfocusoftheareais the CSAH49 /CountyRdJintersection and
s ignaliz ation willrequireadd itionalright -of -way.Hesaidthata ccessmanagementis
vitallyimportant andthattheyhaveworkedwiththecountytodeterminewhere access
pointswillbelocated.
Mr.Smyserpoint ed outgapsi nwaterandseweravailability.Hesaidthecityof
Shoreviewhasstated that they willnotacceptadditionalcapacitytotheir sewer pipe.
Mr.Smyserexplainedplansforfuturesewerserviceconnections.
Mr.Smysercommented thatthe re a lignmentofWar eRoadisanadditionalobjectivethat
s taffwilladdtothereport.
Mr.Smyserpointedoutthatsignalization at the CSAH 49/CountyRd Jintersectionwill
needtobecompleted,but notnecessarilybeforedevelopmentsareapproved.Staff
anticipatesthat developerswillprovideforpartialcostof necessary infrastructure.
Mr.Smyserstatedthata bigboxuser ,iffeasibleatall,ismoresuitableontheeastside
versusthewestside.
Mr.Tralle inquired abouttheprevioussubmittalforassistedliving /seniorhousing.Staff
statedthattheyhaveaccommodatedforthelocationofanassistedliving/seniorhousing
development.Mr.Smy s erstatedthattheproposalthatwassubmitted generated too

muchtraffic.Mr.Smyser add edthattheformerapplicantha sbeenincontactwithcity
staff,andthatstaffiskeepingtheminformed.
Mr.Smysersaidthei ntentistocreateanurbanformforthearea.The citywouldlike
cornerstonebuildingsattheintersections ,with parkinglotsbehindthebuildingsorwith
increased landscaping.Thecitywouldliketo offerpedestrianorientedfeatures.
Mr.Ladenaskediftherewillbewrittenarchitecturalstandardsforthisarea.Mr.Smyser
referredtothe8 th bulletpoint onpage34,andaddedthat designguidelines should be
incorporatedwith each approval.Heexplainedthatb ecausetherearenumerousprop erty
owners,eachdevelopmentcould submittheirowndesignguidelines.
Boardmembersinquiredaboutpedestrianflow.Mr.Smyserexplainedthatped estrian
opp ortunit ies depend onthestoresinvolvedandthedesignofthewholedevelopment.
Mr.Rootappreciate d staff’s effort s toaddress makingtheplan pedestrianfriendly.He
a skedhowlimitedwearebythecountynotallowingasignalattheintersectionto the
north.Mr.Smyseraddressedthatitwilleliminatesomeusersintheareathatwillwanta
signal,butitisnotgoingtohappenintheforeseeablefuture.Headdedthatm any
lengthydiscussionsoccurredwiththeAnokaCountyH ighwayDepartment.Mr.Smyser
statedthatasignal couldbelikely tenyearsfromnow ,butthe bottomlineisthatitisa
countyroadand theAnokaCtyHwyDept determine s thepolicies.
Mr.Ladencommentedthatlimitingbusinessatthatlocationmaynotbeabadthing.
Mr.Rootstated concern fore conomicdevelopment .Mr.Smysersaidtheythinkthey
havefoundabalance.
Mr.Rootcommentedon the existingbusinessesandwonderedatwhatpointtheyplan
developmentaroundthem.Mr.Smyser repliedth eproposedplandoesal lowforthe
RockGardensandtheAutoSaleslottocontinuetoexist.Hesaidthatitism orelikely
that thevalueoftheproperties willincreasesoit maybecome advantageoustodo
somet hingdifferentwiththeproperties .
Mr.Rootaskedhowbigthep i ctur ed “bigbox ”is .Mr.Smyserrepliedabout55,000sq .
feet ,givingperspectivethattheLinoLakesSuperTarget is180,000sq .ft.
M r.Nelson inquiredifthe 49 C lub willhaveample access to develop.Mr.Smyser
respondedthat thisisthemostimminen tsituation ,andthat onedeveloperpotentially
controlsalargeamountofproperty northofit.They will havetoplan toaccommodate
the proposedaccess.
Mr.NelsonaskedwhatwouldhappentoSadder ’sAutomotive .Mr.Smyser saidthey
havenotyet de termine d theprocessforfutureroadimprovements ,andthat Sadder ’sisan
is suethathastobedealtwith.

extensiveplanninginakeylocationinthecity.

ProcessfortheCSAH49/CountyRoadJMasterPlan .Motionwassupported byMr.
Nelson .Motioncarried 4 -0.
Mr.Ladenaskedifthere we readditionalareasofthecitythatw ould beconsidered
gatewayssuchasthis.Mr.Smyser saidthatnone areinitiated,but they areconsideringa
similarapproachto the LakeDrive/M ain Streetintersection.Headded someofthe
quadrantsin the35E areaarepossibilities,but thereare nospecificplans.
Mr.Tralle mentionedthathe spokewithagentlemanregardingtheSt.PaulRegional
WaterServiceswhospokeveryhighlyofhowstaff conductedthemselvesanddidanin -
depthstudyofwhatoccurredandthatheappreciatedstaff’swork.

Mr.Smyser pointedoutthatthreemembersoftheP&Z B oardareapproachingtheendof
theirterm s ,andrem indedtheboardmembersthattheyarerequiredtoreapplyiftheyare
interested andthat applicationsareonthe city’s website .Mr.Root,Mr.HydenandMr.
Pogalz ’s termswillexpireattheendoftheyear.
