CALL TO ORDER AND ROLL CALL Chair Tralle called the Lino Lakes Planning and Zoning Board meeting to order at 6 :30 p.m . on March 12, 2014 . 2 . E LECTION OF CHAIR AND VICE CHAIR Mr. Root nominated the current chair and vice chair for 201 4 . The board re -elected Paul Tralle as Chair and Michael Hyden as Vice Chair for 201 4 by unanimous vote. 3. A PROVAL OF AGENDA T he Agenda was a pproved as presented . 4 . A PPROVAL OF MINUTES Febr uary 12 , 2014 M r. Hyden made a MOTION to approve the February 12 , 2014 Meeting Minutes. Motion was supported by Mr. Evenson . Motion carried 6 - 0 . Mr. Hyden made a MOTION to close Open Mike at 6 :32 p.m. M otion was supported by M r . Laden . Motion carried 6 - 0 . (Tralle abstained.) 6 . ACTION ITEMS A. CONTINUED P UBLIC HEARING to consider a Rezone and Preliminary Plat f or a three -lot residential subdivision to be called Talan Ridge located at 260 Linda Avenue K atie Larsen, City Planner, presented the staff report . Ms. Larsen reviewed the items discussed at the last meeting. Staff pointed out the difficulty of balanc ing the desires of the neighborhood with the r ights of the pr operty owner. Jaso n Wedel, City Engineer, addressed some of the concerns of the neighborhood regarding stormwater management and drainage issues. Mr. Wedel stated that soil borings done by the developer show that groundwater levels meet requirements. Staff has discussed the drainage issues on Linda Ave nue and Laurene Ave nue and the city plans to make improvements to that area in 2014 . G rading work will be done in the right of way along the ditc h line of Laurene Ave nue and t he c ity will work with property owners. Staff will study the area to determine what the final improvements will be. Staff noted that the proposed ponding exceeds the city’s standards. Mr. Wedel expla ined the infiltration pr ocess. Ms. Larsen noted that the developer will need to delineate the existing wetland in order to develop the third lot, which w ould not occur until the spring. Staff specified that the board will take action on the Rezone and Prel iminary Plat only. Th e Final Plat s will be reviewed at future meeting s . Staff recommended approval of the Rezone and Preliminary Plat . Staff noted that the developer plans to make improvements to the existing house on Lot 2. Applicant Pat J udge, 3128 Priest Lane, Mound, M N, was present for questions . Mr. Mattke, surveyor, was also pres ent for questions. The applicant and surveyor understand the recommendations of staff and that the re is a chance that this project may result in only two lots. Chair Tralle declared the Pu blic Hearing open at 6 :54 p.m. Lara Verrecchio, 250 Linda Ave nue , distributed a photo from March 10 , 2014 showing standing water at the corner of Linda Ave nue and Laurene Ave nue. Ms. Verrecchio asked if the city’s water management project for this area w ould include the culvert issue at 260 L aurene Ave nue . She also wondered if the newly proposed houses would be Planning & Zoning Board March 12, 201 4 Page 3 APPROVED MINUTE S approximately the same size in comparison to the existing house on the property, commenting that it would be less of an issue if the new houses w ere as small as the existing house. Tom Brunner , 270 Linda Ave nue , asked that the board members take a look at the lots in this area. He stat ed that th is area has been a problem for many years. He said that the ponding area has changed and since one p ond was filled in, he now gets flooding on his property. He is concerned about overflow to the south going onto his property. His septic tank previously flooded. He d oes not agree with the lot width of the newly proposed lots. He is c oncerned about whe re water is going to go if two more lots are developed. He stated that this area is very low and flooding occurs frequently. He asked that this area be looked at in May or June. Connie Grundhofer, 235 Linda Ave nue , commented that the lots to the north o n Laurene Ave nue a re large lots and the lots to the south are rural. She said this gives the area a relaxing, country feel. She pointed out that if this project is approved there would be six homes on the south side of the street and three homes on the n orth. She stated that the neighbor directly across from the property was unable to attend the meeting, but was concerned about drainage. Ms. Grundhofer stated that the neighbors were not in favor when the sewer installation occurred. They understood tha t the sewer installation was for Fox Trace. She said the neighbors like the big lots and country feel. She distributed a document showing a delineation of a pond in 2 001 . She stated that the previous owner of the property was filling in the pond area. She asked for the board to consider consistency as the residents on Linda Avenue want to keep their large lots. Chair Tralle not ed that two of the neighboring propert ies are approximately ½ acre in size. Paul Whaley, 6200 Laurene Ave nue , agreed with Ms. Grundhofer and Mr. Bru nn er t hat the proposal is inconsist e nt with the neighborhood and will lower property values. Mr. Whaley was concerned about increased drainage if two new homes are built. He e xplained some of the drainage issues in the area and expr essed concern about narrow lot lines. He suggested that this project be delayed unti l the snow has melted. Mr. Whaley asked what the process is for the neighbors to continue to try and get this project stopped. Judy Brunner, 270 Linda Ave nue , agree d wit h the previous comments. She stated concern that no curb or gutter is proposed. She is worried about future drainage issues. She noted that the property to the s outh is not just wetland, but is used and enjoyed by her children and grandchildren. She do es not think this should even be considered until curb and gutter are in place. Sh e asked that the board consider not just the sizes of the lots, but the layout of the houses and how close together the proposed houses will be. She u nderstands that this a rea ha s a high water table , but w ants to be able to use their property without dealing with increased water issues. She is concerned about water runoff onto her property . Planning & Zoning Board March 12, 201 4 Page 4 APPROVED MINUTE S David Berg, 283 Linda Ave nue , s poke on behalf of property owner Anthony Czeck . M r. Berg agreed with all of the previous comments a nd does not understand how this will work. He said that flooding is terrible and needs to be addressed. He feels t hat this area must be left alone. The board addressed the resident concerns: Mr. Wedel stated that the city project proposed for this year would include revisit ing the ditch system that runs along Linda Ave nue and Laurene Ave nue . He explained that the area would be surveyed to determine issues with the culvert and address what improvements need to be made. Chair Tralle addressed that this are a includes a variety of lot sizes , noting that all three of the proposed lots will be larger than existing lots across the street. He suggested that the residents look at the map of the area on the A noka County website to view the incons istency of lot sizes. Chair Tralle pointed out that the existing houses vary in design and age, and that people have a right to choose what they build on their property. If a house meets code requirements, th e n it ca n be built. Mr. Wedel address ed how the water will flow from the proposed pond. The pond is designed to h andle a 100 year flood. Developers have to meet requirements for runoff and what is proposed will not exceed the existing runoff . The site will be inspected by the city for conformance with design. Chair Tralle explained that residents can attend the City Council Meeting for this item to state their case. He reminded the audience that the P&Z board is an advisory board to the council, and that th e board members a re also city residents whose role i s to look out for the best interest of the city. Mr. Tralle stated that the city must allow a property owner to utilize their land as allowed by regulations. Judy Brunner reiterated her concern for the distance between the proposed houses. She pointed out that the property owner purchased a rural lot and she does not think that rezoning the property to residential is in the best interest of the neighborhood for many reasons. Staff displayed a proposed footprint f or the houses . Staff pointed out that the adjacent parcel to the west was rezoned to single family residential in order for the property to be subdivided. Staff reminded the board that the proposed zoning is cons istent with the c ity’s compre hensive plan and meets performance standards, giving the property owner the right to rezone. Staff noted the location of existing utilities and stated that the proposed lots will be required to hook up to city sewer and water . Would it be beneficial for the city to postpone this project until spring? • The project has been reviewed by city staff and they need to trust staff’s review . Staff described that the preliminary plat would likely go before the City Council in April, the final plat for the 1st Addition around June and the 2 nd Addition around July or August. Staff explained that the only unresolved item is the wetland delineation boundary from the Rice Creek Watershed District, whi ch does not affect Lot 1. Staff reiterated that the property has been surveyed and elevations have been determined. The RCWD has no opposition to the first proposed lot. Mr. Wedel stated that delaying the project would not change staff’s review . The de veloper has provided all necessary information to make a de cision on the first proposed property . The developer has submitted a survey, existing and proposed contours , and plans for e arthwork to raise the house pads. Ms. Larsen stated that staff has r evi ew ed all of the required information and there is no basis for the city to delay taking action on the Preliminary Plat. She reminded the board that since the last meeting, staff has received design information for the creation of swales and ponding areas and the developer has fine tuned the drainage plan and provided soil borings. Ted Mattke, Mattke Surveying, d eveloper and surveyor, stated that he is a resident of Lino Lakes and has been doing plats in the city for many years. He is a l icensed surveyor and professional engineer. He desc ribed how the proposed improvements to the lots will improve drainage in the area. He e xplained how the ponding area will be excavated and improved. He anticipates that wetland delineation will be completed by the end o f April and they will survey the area right away to present to the city. Mr. Mattke explained how the proposed improvements for drainage will take place. Mr. Judge , applicant, does not see a reason for the city to delay this project. He has submitted al l required information necessary for the preliminary plat to be acted upon. He stated that there are no wetland or drainage issue s with the preliminary plat. He explained that they submitted s oil borings and went out of their way to show that drainage is acceptable with the first proposed lot. He understands the concerns of the residents . He stated that he would not do this project if he t hought he would be doing hardship to the neighbors. Paul Whaley said that a previous proposal for six lots was de nied about 14 years ago . He reiterated his concern for drainage and flooding as well as the value of his property. He is in favor of tabling the project. Tom Bru n ner added that he has lived at 270 Linda Ave nue for 3 5 years. He restated his concern of the wetlands and increased drainage issues. He is opposed to the project. He does not want to see the property drowned. Connie Grundhofer stated that she was told by an employee of the RCWD that wetland delineations are done between May 1 and Oct ober 1 . She explained that the delineation handout that she distributed was from 2001 and was told by an employee of the RCWD that d elineations are only good for 5 years. She distributed t he document to show what was delineated in the past. She expressed concern that the proposed lot frontages are inconsistent with the area. Judy Brun n er reiterated that the neighborhood has issues with the proposed building on the lots, not that they wo uld be unkind or unwelcoming to new residents. Mr. Masonick made a MOTION to close the Public Hearing at 8 :03 p.m. Motion was supported by Mr. Hyden . Motion carried 6 - 0. (Tralle abstained.) Mr. Evenson made a MOTION to recommend approval of rezoning the property at 260 Linda Avenue from Rural to R -1, Single Family Residential , based on the following conditions of approval to be met prior to final plat : 1. All comments from the City Engineer letter dated March 5, 2014 shall be addressed. 2. All comments fr om Environmental Coordinator letter dated February 3, 2014 shall be addressed. 3. A Land Use Application for final plat shall be submitted by the developer. 4. A Development Contract shall be drafted by the City, executed by the City and the developer and record ed with Anoka County in conjunction with the final plat. 5. The final plat shall be resubmitted to Anoka County Surveyors Office for review after City Council approval. 6. A wetland delineation shall be completed and approved by RCWD prior to any final platting of the proposed Lot 2, Block 1 Talan Ridge. 7. The Developer shall provide the City and RCWD with an as -built grading plan prior to issuance of any building permits. 8. Sheet 1 -Certificate of Survey: a. Revision number and date shall be included. 9. Sheet 2 -Resources Inventory: a. Revision number and date shall be included. 10. Sheet 3 -Preliminary Plat: a. Revision number and date shall be included. b. The Total Upland calculation 57,828 s.f. does not equal the upland areas shown on the individual lots. Please revise. Planning & Zoning Board March 12, 201 4 Page 7 APPROVED MINUTE S c. The House P ads for proposed Lot 1 and Lot 3 shall be revised to reflect a typical house floor plan (e.g., 60’ x 40’). d. The proposed impervious surface calculations for each lot shall be provided. 11. Sheet 4 -Preliminary Grading, Drainage & Erosion Control Plan: a. See City E ngineer letter dated March 5, 2014. b. Revision number and date shall be included. c. The House Pads for proposed Lot 1 and Lot 3 shall be revised to reflect a typical house floor plan (e.g., 60’ x 40’). d. Construction details for the storm water ponding area shal l be submitted. e. Soil erosion and sediment control measures shall be shown. f. “No Encroachments” text shall be removed. g. Location of soil borings shall be identified. h. Existing Water Table shall be revised to 896 +/-. 12. Sheet 5 -Preliminary Utility Plan: a. Revision number and date shall be included. b. The existing house shall hook up to the municipal water system prior to issuance of any building permit. c. The existing well shall be properly capped and abandoned or disconnected from the house if used for irrigation purpo ses prior to the issuance of any building permit. 13. Sheet 6 -Landscaping Plan: a. Revision number and date shall be included. b. Storm water ponding area shall be shown. c. Landscaping plan for ponding area shall be provided. 14. Tree Preservation and Mitigation Plan a. Revi sion number and date shall be included. b. Storm water ponding area shall be shown. c. Are the 12’ and 36’ Willow trees going to be removed? d. The developer shall submit a complete Tree Preservation and Mitigation Plan in full compliance with the tree preservation and mitigation ordinance prior to approval of the final plat. e. Fencing, tree preservation measures and erosion control shall be installed by the developer and inspected by the City prior to any soil disturbance. Motion was supported by Mr. Laden. Motion carried 5 -1 (Masonick vo t ing nay. Tralle abstained.) The Board asked the developer to respond to Condition N o. 14C. Mr. Mattke stated that they do not anticipate removing the large Willow trees, but they do anticipate removing a broken River Birch tree on the SE corner of the property that is in poor condition . Mr. Evenson made a MOTION to recommend approv al of the Preliminary Plat for a three -lot residential subdivision to be called Talan Ridge located at 260 Linda Ave nue , Planning & Zoning Board March 12, 201 4 Page 8 APPROVED MINUTE S based on the condition of ap provals as previously listed. Motion was supported by Mr. Root. Mo tion carried 5 -1. (Masonick vot ing nay. Tralle abstained.) Mr. Laden not ed that it c ould be helpful for neighbors to organize as a group and consolidate speakers , or even sign a petition , before going to the City Council Meeting on April 14th. 6 . DISCUSSION ITEMS A. Project Updates Katie Larsen, City Planner , provided an update of current city projects . Staff agreed to speak again with the police department about posti ng spee d limit sign s on Old Birch Street . Chair Tralle asked about Lennar Next Gen housing. Ms. Larsen stated that the city currently allows for accessory apartments in all residential zones of the city. 7 . ADJOURNMENT M r. Laden made a MOTION to a djourn the meeting at 8 :17 p .m.
