I -35W /Lake Drive Improvement Project
PROJECT STATUS
Design
The design for the improvements is nearing completion. Plans have been
distributed to the Minnesota Department of Transportation and Anoka County for
final review. Once their comments are received SEH, Inc. will make all
necessary modifications and submit the final plan set for agency approval. This
is expected to be completed by mid to late December.
One outstanding issue is the Streetscaping and aesthetic design of the bridge.
Early in the design process Mn /DOT indicated the need to establish general
parameters for the bridge aesthetics to create a uniform treatment for bridges
along the I -35W corridor. However, staff was not satisfied with the Mn /DOT
preferred bridge exterior surfacing. SEH is preparing an alternative bridge
treatment for council consideration to forward to Mn /DOT for their approval.
Streetscaping options on Lake Dr are somewhat limited, but where applicable we
are carrying forward design elements from the Legacy at Woods Edge project.
Most of the landscaping efforts are being concentrated on the southeast corner
of Town Center Parkway and Lake Drive. The stormwater management design
dictated the placement of a stormwater pond in this area. The existing
coniferous trees on the site, that currently separate the Marshan Lane residential
area from Lake Drive and the Legacy development, will be removed for the pond.
SEH is working on a plan that will 1) reestablish this separation and 2) create an
entry feature for the Legacy development.

Staff is anticipating draft plans will be available for council review at the
November 6 work session.
Right of Way Acquisition
Dan Wilson, Wilson Development Services, has begun the right -of -way
acquisition process on behalf of the City. A total of sixteen (16) parcels are
affected by the project. The total appraised value of the right -of -way to be
acquired is approximately $1,300,000. Offer letters, accompanied with a copy of
the property appraisal, was distributed to property owners as of September 27,
2006.
We are nearing agreement on several parcels and Mr. Wilson will continue to
work with property owners to reach an agreement for direct purchase. However,
to insure that ongoing property negotiations do not jeopardize the project
construction or state and county funding staff will be requesting council
authorization, on November 13, 2006, for the City Attorney to commence with
eminent domain proceedings. Through this process the City Attorney will be
seeking District Court approval to acquire parcels by eminent domain and
authorizing quick take provisions that establish a possession date. Under the
current time line we would anticipate possession in March. There are several
steps to this process that will be more fully explained by the City Attorney.
Again, we are hopeful that all acquisition can be obtained by direct purchase and
we will continue to negotiate with property owners throughout the process.
Funding
The estimated project cost is approximately $10,200,000. This estimate includes
all anticipated costs (engineering, legal, construction, land acquisition) as well as
approximately $800,000 for contingency purposes.
Anoka County has provided $3.7 million in their 2007 budget for the project. The
City was recently notified that our application for Local Road Improvement
funding was approved by Mn /DOT in the amount of $400,000. This brings
Mn /DOT's total contribution to $800,000. City staff is working with Springsted
Inc., and Kennedy & Graven to evaluate funding options for the remaining $5.7
million. The City previously set aside approximately $2.5 million from the Legacy
at Woods Edge project. Funding sources being evaluated include the Trunk
Highway 49 Turnback funds ($955,000) and the use of Municipal State Aid
Street fund.
Staff is also continuing to work closely with Mn /DOT on additional funding
options including 1) in -kind contribution of construction engineering ($550,000)
and 2) eligibility for Mn /DOT's debt management program ($500,000).

At the October 23, 2006 City Council meeting the Hartford Group asked the City Council
to consider an amendment to the PUD for the Lakewood Apartments. Part of that
amendment was consideration of a request to remove the balconettes from the exterior
elevation of the building. Council did not approve the removal of balconettes and
requested that Hartford Group revisit options regarding the elevation of the building.
Attached you will find a memo from Hartford Group regarding the issue, plus an updated
rendering of the project.
Staff has worked closely with Hartford Group on the elevations of this project. Since
balconettes are not a requirement of the Lino Lakes Town Center Design and
Development Guide, staff does not believe that removal of the balconettes compromises
the architectural integrity of the building. Staff considers the change a positive one
considering the mixed use (residential and commercial) nature of this building, and the
fact that balconettes are not usable as balconies.
This item will be returned to the City Council at the November 13, 2006 council meeting
for consideration.

On Monday October 23, 2006, the City Council considered our request to amend the PUD Final plan for
Lakewood Apartments. Discussion at the meeting centered on the removal of the small balconettes from the
exterior elevation of the building.
For the past several months, Hartford has been working with MHFA, which is providing the tax credit and
mortgage financing for the project, and our general contractor to value engineer and trim construction costs
for this project. Given today's rising construction costs and the affordable nature of the rental units, margins
for the project are thin However, Hartford remains committed to preserving the building's overall
architectural integrity. During this time, MHFA indicated its concern as to the lack of usability and the
potential for unsightly storage on the balconettes. Given these comments, it seemed appropriate to both
address MHFA's concerns and provide for some cost savings by removing the balconettes from the design.
I would like to emphasize that that existing building architecture is of high quality and the cost savings
realized in removing the balconettes is more than offset by the additional cost of the inset windows required
by the Woods Edge design standards. Hartford has also added an additional color to the palate to further
accentuate the movement of building's "bays ", and has created a distinct central building element to front the
roundabout.
The Council tabled the matter and requested that we attempt to provide some additional architectural detail to
the building. I stated that we would try to address this request, but that any design change would have to be
cost neutral to the project, given the already high construction costs involved. Since then, our architects have
looked at a number of possibilities, including shutters, window boxes /planters, decorative coins, and
additional colors. However, we feel these options are not suitable with the building's architectural
characteristics, or added additional costs. We also considered retaining a few of the balconettes, but MHFA
prefers the units be treated equally. Accordingly, we respectfully request that our original proposal be
considered by the Council at the work session to be held on November 6, 2006.
Overall, we believe the project will provide a worthy addition to the Woods Edge development. To that end,
I attach a new 3- dimensional color rendering of the central and southwesterly elevation (across from the
park) that shows more clearly the movement and presentation of the building as compared to the 2-
dimensional drawings previously provided. Please note that there are a few additional changes that still need
to be incorporated into this new rendering, and I will bring an enlargement of the final product to the meeting
on November 6`h

Background
Attached is information regarding an upcoming vacancy on the Rice Creek Watershed
District Board of Managers. Interested persons may apply for appointment by the County
Board, or if the towns and municipalities within the district, either jointly or severally,
submit a list of at least three nominees, the County Board must appoint from that list. A
list of nominees must be submitted 60 days (November 17) before the end of the term
which is January 17.
In recent years, the City of Lino Lakes has not submitted a list of nominations to the
County Board, but has submitted letters of support for applicants.
Related to this issue, Mr. Harvey Karth has delivered the attached letter to the Council
soliciting the support of the Council for this position.
Requested Council Direction
Staff is seeking clarification as to whether the Council wishes to: 1) pursue the
submission of a list of at least three nominations from which the County Board must
appoint; 2) consider recommending to the County Board the appointment of an
applicant(s); or 3) take no action on this issue.

Dear Mayor Bergeson:
In accordance with the provisions of Minn. Stat. §103B.227, Anoka County in late October 2006 will
publish notice of a future vacancy due to the expiration of a term on the Rice Creek Watershed
District Board of Managers. The notice publication requirement applies because Rice Creek
Watershed District is considered to be a watershed management organization. The published notice
must state that persons interested in being appointed may submit their names to the appointing
authority which is the county board for a watershed district appointment. For your information, a
copy of the notice which is to be published is attached.
In appointing a manager to the Rice Creek Watershed District, Minn. Stat. §103D.311 is also
applicable. This statute requires a county board, upon the expiration of a term, to appoint managers
for a watershed district from a list of persons nominated jointly or severally by the towns and
municipalities within the district if a list(s) is submitted 60 days before the manager's term of office
expires or to appoint a manager who resides in a city or town that fails to submit a list. If there is a
desire to jointly submit a list for the manager appointment, you may wish to confer with affected
cities and town and jointly submit the list. The cities with territory located in the Rice Creek
Watershed District are Blaine, Centerville, Circle Pines, Columbia Heights, Columbus, Fridley,
Lexington, Lino Lakes, and Spring Lake Park.
In order for names submitted to the county to be considered a list under the statutory definition, the
list must contain the names of at least three nominees eligible to be appointed. To be eligible for an
appointment, a nominee must reside within the watershed district boundaries, be eligible to vote in
the district, and not be a public officer of the county, state, or federal government (except that a soil
and water conservation supervisor can be appointed).
In making watershed appointments, there is an additional factor which is to be considered by a
county board. Minn. Stat. §103D.311 requires watershed district managers to be appointed to fairly
represent the various hydrologic areas within the watershed district by residence of the manager
appointed.

At the end of this year the term of the Lino Lakes represenitive to the Rice Creek
Watershed District Board of Managers is up, I would appreciate your consideration for
this position.
In the past I have served Lino Lakes as City Council member, Mayor and several board
positions. I have also served as your represeitive to the Rice Creek Watershed Board of
Managers from January 2004 thru February 2005, as a Manager I did my best for Lino
Lakes and the whole of Rice Creek Watershed District, also during this time we did a lot
of work on Comprehensive Wetland Management Plans and now that Comprehensive
Wetland Management Planning is coming to Lino Lakes, I would make sure that Rice
Creek Watershed District and Lino Lakes get a well thought out and designed plan.
On a personal side I have lived in Lino for 32 years, married for 40 years next April, we
have two boys, both married and I am retired so I have the time this position can
sometimes demand.

Re: Request for Exception from City Code
Background
At the October 9, 2006 council work session City staff reported that they had received a
request to grant an exception from Section 402.02 of the City Code to not require the
connection of Old St. Joes Church to the city sewer system. A copy of the request with
reasons is attached. It has been explained to staff that the restored building will be used
for special events such as weddings.
Mr. Brausen has also inquired as to whether the code could be amended to accomplish his
request. Staff has no recommendation for amendment of this section of the code.
Staff was directed at the October 9, 2006 council work session to seek an opinion from
the City Attorney. His response is attached.
Staff finds that the proposed use of the facility, which includes human occupancy and
human use of the building, does not meet the grounds for exemption by the council as
allowed for in Section 402.02, first paragraph. Staff maintains the opinion that there are
no grounds for an administrative permit allowed for under Section 402.13
Requested Council Direction
Staff is seeking direction from the City Council as to whether it will consider action to
exempt the Old St. Joes Church building from the sewer connection requirement of
Section 402.02 of the City Code, or whether the Council wishes to consider amending
this section of the code to accomplish the request.

Dear Mr. Heitke,
After speaking with your staff regarding the issues with the renovation of
Old St. Joes Church, I am asking for you to make an exception to the
ordinance with special circumstances allowing us to install a storage tank
for the sewer system. While talking with your staff, it is my understanding
that if it is ok with the State; it is left up to the discretion of Lino lakes to
allow us to install it.
The renovation of this historical building has been done by volunteers
using limited funds that have been donated for portions of the project we
could not possibly do ourselves. This building was built in 1896 and is
considered the oldest building in this city. We have restored it to the
original design with the exception of a functional indoor restroom.
The reason I am asking for special circumstances is that the bathroom
may only used but once a month. Estimated costs for city sewer are over
$30,000.00. A storage tank would be considerably less and would also
allow us to have it or the labor to install it donated.
The volunteers of Old St. Joes will be most grateful if you would give our
cause special consideration.

402. Sanitary Sewer System
402.01 General Operation. The city municipal sanitary sewer
system shall be operated as a public utility and convenience from
which revenues will be derived, subject to the provisions of this
section.
402.02 Connections with Sewer Required. Any buildings used
for human habitation or for human occupancy, including all business
buildings, unless specifically exempted by the council on the
grounds that no human beings occupy or use such buildings and no
sewage wastes are generated therein, located on property adjacent
to a sewer main, or in a block through which the system extends,
shall be shall be required to petition for sanitary sewer service
and to connect thereto when their present on -site sewage system
fails. The owner of such property shall pay all assessments for
sanitary sewer in accordance with Lino Lakes assessment policies.
No permits will be granted for reconstruction or existing on -site
systems when city sanitary sewer service is available to such
property.
Agricultural buildings hereafter constructed within the city
on property adjacent to a sewer main or in a block through which
the system extends, shall be provided with a connection to the
municipal sanitary sewer system for the disposal of all human
wastes.
If water service is also available to the property, a petition
for and a connection to the water system shall also be required and
the owner of such property shall pay all assessments in accordance
with the Lino Lakes assessment policies. (402.02 was amended by
Ordinance No. 07 - 92 passed May 11, 1992)
402.03 Supervision. The city plumbing inspector shall
supervise all house sewer connections made to the municipal
sanitary sewer system and all excavations for the purpose of
installing or repairing the same and all persons doing or causing
such work to be done shall notify the city of the schedule for such
work to allow for supervision.
402.04 Permits, Licenses, Fees, Bond and Insurance.
Subdivision 1. Application. Any person desiring to make
connection to the municipal sanitary sewer system shall apply to
the city for a permit for such connection. The application shall
be submitted on blanks furnished by the city and shall be
accompanied by plans, specifications and such other information as
is required by the city to evaluate the application, together with
a permit and inspection fee of $75.00. All costs and expenses
incident to the installation and connection shall be borne by the
owner and the owner shall indemnify the city for any loss or damage
that may, directly or indirectly, be occasioned by the installation
of the sewer connection including restoring streets and street
surfaces.

I am responding to your memorandum of October 18, 2006 concerning the
request from St. Joseph's Church to be exempted from the requirement to
connect to the City sanitary sewer system. I have reviewed the background
memo prepared by the staff report and would offer the following comments.
Under Chapter 402.02 of the City Code, "a building used for human habitation or
for human occupancy, unless specifically exempted by the Council on the grounds
that no human beings occupy or use such buildings and no sewage wastes are
generated therein, located on property adjacent to a sewer main, or in a block
through which the system extends, shall be required to petition for sanitary sewer
service and to connect thereto when their present on -site sewage system fails.
The owner of such property shall pay all assessments for sanitary sewer in
accordance with Lino Lakes assessment policies. No permits shall be granted for
reconstruction for existing on -site systems when city sanitary sewer service is
available to such property."
It is my understanding that the church building will be used for human habitation
or for human occupation at least once a month so the exemption provided for in
Chapter 402.02 could not be used.

would point out to you that Section 402.13 reads as follows:
"402.13 Variances. The city plumbing inspector may
permit variations from the strict application of any
provision of this chapter if he is satisfied that there are
special circumstances or conditions affecting the
premises for which the variance is requested and that the
granting of such variance will not materially affect
adversely health, safety, or general welfare or public or
private property. Any variation permitted under this
provision must be noted on the permit."
It seems clear to me that Code Section 402.02 only allows an exception from the
sewer connection requirement if there was to be no human occupancy. Therefore,
don't believe limited human occupancy was intended to be a special
circumstance. Nevertheless, this language is found in the code section and would
be available for consideration by the City Council. I would be extremely cautious
to try to use any economic hardship as a justification for special circumstances.
This may open the entire City up to a claim by property owners to exempt them
from City sewer hookups based on their financial conditions.
Based on the information in your memo, I was not able to reach the conclusion
that there were any special circumstances beyond minimal occupancy and
financial hardships that would justify granting a variance from the hookup
requirement.

Requested Council Direction
Staff is seeking direction from the City Council as to whether it will consider action to
exempt the Old St. Joes Church building from the sewer connection requirement of
Section 402.02 of the City Code, or whether the Council wishes to consider amending
this section of the code to accomplish the request.

Attached is the staff report on a request from St. Joes Church to not be required to
connect to the city sanitary sewer system as required by code. The council asked that I
refer this matter to you for your opinion as to whether the Council has grounds to exempt
the building from the code requirement.
Staff finds no basis for an exemption, nor does staff know of any basis for amending the
code in order for their request to be granted. Another concern that staff has is the
estimation that the church will be used for human occupation approximately once per
month. I'm not sure how accurate that prediction will turn out to be once the building is
finished and starts being used and how demand for the building will increase in future
years as the population of the City increases.
On another issue, Council member Carlson removed herself from the discussion as she
holds certain positions in the congregation. She indicated that she would be contacting
you requesting an opinion as to whether she has a conflict of interest. Since I'm in no
position to explain her positions, this is probably the most efficient way to handle the
inquiry, however, I think that I should be provided a copy of the opinion in order for it to
be part of our records and in the case that it needs to be presented to other members of the
Council or public.

Dates for the council to consider interviews could be December 12, 13, 14, 19. The 7th might work also but
it would not give applicants a lot of time to schedule the interview.
Appointments could be made the 15t meeting in January.

Background
During discussions of the 2007 preliminary budget, it was suggested that the City Council
consider whether to issue a request for proposals (RFP) for professional services for
2007. This issue has been placed on this agenda at this time in order for this action to be
carried out in a timely manner, should the council wish to consider proposals.

Re: 2007 Council Meeting Schedule
Background
The City Council meeting schedule is established each year based on the requirements of the
City Code:
Section 202.01 Meetings. Sudivision 1. Regular Meetings. The city council
shall have regular sessions on the 2nd and 4th Mondays of each month at 6:30
o'clock p.m. and if such Monday shall fall on a holiday shall have its regular
session the next following day, and adjourned and special sessions at any other
time the council may deem proper.
The proposed 2007 schedule (attached) includes the required bi- monthly council meetings and
continues the current practice of holding a regular work session the first Monday of each month
and a shorter work session previous to the 4th Monday of the month council meeting.
Two regular council dates fall on holidays in 2007 (May 28 and November 12). In concurrence
with the City Code, these meetings have been moved to the next day after the holiday.
Two work session dates fall on holidays (January 1 and September 3). These can be rescheduled
at the Council's discretion.

presented.
