Studenski, City Engineer Re: Water Emergency and Conservation Plan Background Public water suppliers that service more than 1,000 people are required to have a Water Emergency and Conservation Plan approved by the Department of Natural Resources (DNR) (Minnesota Statutes 103G.291). The most recent Water Emergency and Conservation Plan update was adopted at the September 24, 2007 City Council Meeting. The Water Emergency and Conservation Plan adopted established conservation goals for the benchmarks listed below. The Department on Natural Resources (DNR) permit approvals will be based on meeting the specified benchmarks listed below. If water demands exceed Benchmarks for unaccounted water, residential per capita, and peak demands then permit approval will be contingent on implementation of one or more of the listed Conservation Goals until the benchmark is achieved. The City exceeds the DNR benchmarks for water use in three categories; (1) Residential Gallons Per Capita Demand (GPCD), (2) Total Per Capita Demand, and (3) Peak Demands. Below is phase one of the two phases of conservation goals established in the Water Emergency and Conservation Plan: 1. Residential Gallons Per Capita Demand (GPCD) a. Prepare an ordinance requiring rain sensors to be installed with all new automatic sprinkler systems. The cost for a typical rain sensor is usually $40 to $120 plus costs for professional installation. The savings in water charges from the use of a rain sensor could pay for the rain sensor in the first season. It estimated that a rain sensor will save 1,225 gallons of water per household on every rainy day. b. Rain sensor retro -fit program: The Toro Company offers a program where cities can purchase rain sensors at a reduce rate of approximately 50% of the listed price. As an example of this program in May 2007 the City of 1 Woodbury provided 200 rain sensors in at no charge to single - family residential property owners who wished to install them. The property owner was responsible for the installation and any associated costs. This program is funded by the City of Woodbury and the South Washington Watershed District. A program of this nature would satisfy conservation goals for the City of Lino Lakes. A rain sensor is operated by low output radio connection between the device, which is typically mounted on a part of the house that directly receives rainfall (such as the edge of a rain gutter), and a radio receiver, which is mounted with the irrigation controller. A disc in the sensor swells up when it gets wet and temporarily causes the irrigation system to be inoperable. The disc in the rain sensor dries out at approximately the same rate as the soil, so the system becomes operational again once the rain has stopped and the soil has returned to normal moisture. c. Provide public education to consumers regarding information on how to reduce water usage indoors and outdoors. 50% of water consumed by a household is used outdoors. The remaining 50% is used indoors and of that 75% is consumed in the bathroom. - A Water conservation section in the Lino Lakes Quarterly Newsletter and at www.ci.lino - lakes.mn.us, providing tips and information on water conservation. See attached Metropolitan Council web page example. - Attachments and flyers with water bills can also be used to provide information on how to use water efficiently. 2. Total Per Capita Demand a. Prepare a time of day lawn watering ordinances that restricts lawn watering during the daytime hours of 10:OOam to 6:OOpm. Attached is a copy of the draft ordinance. A public education program consisting of detailed information on the City website, the quarterly newsletter and a public notice will coincide with the implementation of this ordinance. This ordinance will require additional resources for enforcement. The penalties for violation of the ordinance will be $25 on a first offense and $50 for any subsequent violations in a year. Time of day lawn watering ordinances that restrict lawn watering during midday hours can lower water usage and reduce peak demands. Early morning is the best time to water for a healthy lawn. Public information programs and local ordinances that encourage lawn watering before 10:00 a.m. and after 6:00 p.m. can improve lawn watering efficiencies by reducing water lost to evaporation and wind drift. Wind and evaporation during midday hours can remove up to 65% of sprinkling water meant for your lawn. 2 3. Peak Demands a. Evaluate water rate structure. b. Finance has submitted a revised water rate structure to promote conservation. Revisions to the water rate structure are currently being evaluated by Springsted Financial, Inc. and staff. The goal of the evaluation of the water rate structure is to determine a rate structure that promotes conservation and is fiscally responsible. Conservation goal la. is addressed by the attached draft ordinance xx -08. This ordinance establishes a series of guidelines for the installation of lawn sprinkling / irrigation systems. Currently the City does not monitor or issue permits for the installation of irrigation systems. Ordinance xx -08 requires the installation of rain sensors on all newly installed lawn sprinkler / irrigations systems and sets standards for lawn sprinkler / irrigation installation. Conservation goal lc. can be met by creating a informational web page similar to the attached web page from the Metropolitan Council, which provides examples of some of the content that can be place on the Lino Lakes Water Conservation Page. Water Conservation information will also be placed in the quarterly newsletter and inserted with water bills. Conservation goal 2a. is addressed by the attached draft ordinance xx -08 amending the Lino Lakes City Code. Requested Council Direction Staff is recommending implementation of phase one of the conservation goals above. This would be: 1. Adding Ordinance xx -08. (Conservation Goal la.) 2. Further exploration of the possibility of implementing a rain sensor retro- fit program. (Conservation Goal lb.) 3. Implementing a public education program through additional water conservation related materials being placed on the City website, in the quarterly City newsletter and attaching water conservation tips and facts on utility bills. (Conservation Goal lc.) 4. Amending the City Code with Ordinance xx -08. (Conservation Goal 2a.) 5. Submit revised water rate structure that promotes conservation. (Conservation Goal 3a,b.) 3 1st Reading: Publication: 2"d Reading: Effective: Council Member moved for adoption of the following ordinance: CITY OF LINO LAKES ORDINANCE NO. - 08 AN ORDINANCE AMENDING THE LINO LAKES CITY CODE, CHAPTER 400 WATER AND SEWER, BY ADDING SECTION 401.37, LAWN SPRINKLER / IRRIGATION SYSTEMS The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: The City Code of the City of Lino Lakes, Section 401.37, Lawn Sprinkler / Irrigation Systems, is added as follows: Original Ordinance Amended Ordinance changes in bold italics. 400 Water and Sewer 401. Municipal Water System 401.37 Lawn Sprinkler / Irrigation Systems. All lawn sprinkler / irrigation systems connected to the municipal water system, shall require a permit for connection and is to be installed in accordance with the State Plumbing Code of the Minnesota State Statues (Chapter 4715). Subdivision 1. Purpose. The purpose of this ordinance is to promote efficient use of water for lawn sprinkler / irrigation systems to allow the City's Water System flexibility in meeting peak demands. Subdivision 2. Definitions. For the purpose of this ordinance, the following terms shall have the meanings given to them. a. "Backflow Preventer" means any mechanical or air gap system designed and installed in order to prevent the accidental backflow of water from one source to another. b. "Lawn Sprinkler / Irrigation System" means all pumps, lines or sprinkler heads which are located on private property or within adjacent public right -of -way that have a sole purpose of irrigating gardens, grass or landscaping. Subdivision 3. Construction of a Lawn Sprinkler / Irrigation System. The location of lines and sprinkler heads for a Lawn and Landscape Irrigation System may be located within private property or the city right -of -way or easement subject to the following conditions: a. A permit will be required for all Lawn Sprinkler / Irrigations Systems installed. The permit cost will be established yearly in the Lino Lakes Fee Schedule. b. If a Lawn Sprinkler /Irrigation System is to be installed by a contractor, the contractor must be licensed with the City and a licensed plumber must obtain the permit and make the connection. If a home owner is installing the Lawn Sprinkler / Irrigation System themselves, they may obtain the permit. c. An approved back flow prevention device must be installed as a part of all lawn sprinkler / irrigation systems. The device shall be installed per manufacturer installation instructions. The type of approved backflow device must be provided when applying for a permit. d. All newly installed lawn sprinkler / irrigation systems are required to have rain sensors installed as part of the system. This is in accordance with Minnesota State Statute 103G.298 and Federal Water Conservation Standards. e. The owner of the Lawn Sprinkler /Irrigation System is responsible for any maintenance or repair of the Lawn and Landscape Irrigation System. f. The owner of the Lawn Sprinkler /Irrigation System signs a written agreement with the city in which the owner agrees to assume all liability and responsibility for damages to the Lawn and Landscape Irrigation System that is caused by city activities, including, but not limited to, snow removal. g. All Lawn Sprinkler /Irrigation System lines located within city right -of- way or easement shall have a location wire installed in accordance with the city's specifications. h. All Lawn Sprinkler /Irrigation System lines that cross city streets or shall be encased in an oversized carrier pipe. i. The owner of the Lawn Sprinkler /Irrigation System shall provide the city with an as -built plan of the irrigation system. Water Supply Conservation Tips and Practices a Metropolitan Council. AA > Water > Water Supply Planning Water Conservation Toolbox: Tips and Practices Water use by residential customers ranges from watering lawns and gardens to showering and tooth brushing. This page discusses types of outdoor and indoor residential water use and provides tips and resources for efficient water use. Water suppliers can promote the water practices included on this page by implementing water conservation programs appropriate for their communities and by directing their residential customers to this page. Outdoor Water Use Water is used outdoors for residential turf and landscape irrigation, car washing, swimming pools, and other purposes. The rate of water use outdoors is highly dependent upon the climate. In the Twin Cities metropolitan area outdoor water use accounts for approximately 20% of total annual water use. In years with particularly hot and dry summers, outdoor water use may be as high as 30 %. Topsoil Preparation High - quality soil increases plants ability to absorb and hold water effectively, thereby reducing irrigation needs. Weil- prepared soil also facilitates deep root growth, which aids infiltration of water. 1. Topsoil preparation following construction activity During construction activity, subsoil may become compacted due to the use of heavy equipment and increased traffic over the site. If construction or grading activities occur on a site that will be landscaped, it is advisable to stockpile the topsoil and to return the soil to the site once the activities are completed. At least 6 inches of topsoil should be returned to the site before laying sod, seeding, or planting. This amount will help facilitate deep root growth and reduce runoff. Page 1 of 5 2. Testing soil quality Topsoil is the most fertile portion of the soil. A simple soil test will help you identify the pH of your soil and indicate whether an application of lime or acidic compound is needed to change the pH for better plant uptake of nutrients. Although some soils may benefit from the addition of some fertilizers, it is important to not over - fertilize the soil and to follow the application rates posted on the fertilizer bag. Excessive use of fertilizers can pollute water resources and can be potentially harmful to humans, wildlife and aquatic animals. Some soils may also benefit from the addition of compost, manure, or inorganic materials, to promote infiltration and water uptake by vegetation. In general, it is wise idea to add 2 to 3 inches of compost, shredded leaves, or other fine organic material to gardens annually,although this may vary depending on soil type and the climate. Native plants are hardy enough to survive winter cold and summer heat. Once established, native landscapes require little irrigation or fertilization. There are a variety of conceptual approaches to landscape design and management. All the approaches share the goal of reducing water demand, maintenance costs, and use of lawn or garden chemicals. They also attract native wildlife and can help to improve water quality and lower runoff. Water -wise, XeriscapeTM, native landscaping, rain gardens are common terms used to describe these conceptual landscape approaches. Deep infrequent, watering is generally better for lawns and plants than frequent lighter irrigations, which can cause shallow roots. Watering Tips • Water early in the morning to minimize evaporation. • Never water faster than the ground can absorb the water. • Know your soil and its watering needs. • Next time you water, place 3 to 5 empty tuna or cat food cans at varied distances from the sprinkler. (Back to top) Toilets, Sink Faucets and Showerheads The 1992 Federal Energy Policy Act required all toilets, sink faucets and showerheads manufactured in the United States after January 1, 1994 be low- volume fixtures. Toilets must use no more than 1.6 gallons per flush (gpf); sink faucets no more than 2.5 gallons per minute (gpm); and showerheads no more than 2.5 gpm, respectively. Fixtures installed before 1994 were not required to be retrofitted; therefore, 5 to 7 gpf toilets and 3 to 4 gpm sink faucets and showerheads are still in extensive use throughout the United States. Tips for reducing water use • If you still have a 5 gpf toilet, retrofit your toilet with a 1.6 gpf or less toilet. • Do not use your toilet as a waste basket. • If you have a 5 -7 gpf toilet, install a toilet tank dam or displacement ( "zip- lock ") bag and save up to 40% of your toilets water use. • Check your toilets for leaks. • Install a low -flow sink faucet or a sink faucet aerator. • Turn the faucet off while brushing your teeth or shaving. • Fill a pitcher when waiting for water to turn hot or cold and use the water to water your plants. • Install a Demand (Tankless or Instantaneous) Water Heater and water and energy. • Do not let the water run while washing the dishes; fill the sink instead. • Keep a pitcher of drinking water in the refrigerator rather than running the water from the faucet until it is cold. • Be sure to turn off sink faucets completely. • Fix leaks (calculate how much water you are wasting from a faucet leak). • Install a low -flow showerhead. • Take shorter showers. Clothes Washers and Dishwashers The efficiency of clothes washers and dishwashers installed between 1980 and the early 2000s are estimated to range from 27 gallons per Toad (gpl) to 51 gpl and 7 gpl to 14 gpl, respectively. Although recent models (since year 2000) are twice as water - efficient as those of 20 years ago (1980), water conservation measures are still important because as population increases so does total water use. Municipal Water System 401.01 General Operation. The city municipal water system (hereinafter called the water system) shall be operated as a public utility and convenience from which revenue will be derived, subject to the provisions of this chapter. 401.02 Use of Water Restriction to Authorized Persons. No person shall make, construct, or install any water service installation or make use of any water service which is connected to the water system except in the manner provided in this chapter. Section 1. 401.02 of the City Code of the City of Lino Lakes is hereby amended to include the following: Subdivision 1. Seasonal Sprinkling Restrictions. To protect the health and safety of the consumers and the general welfare of the City, and to encourage water conservation, the City hereby adopts the following permanent sprinkling ban. The sprinkling or watering of lawns and gardens is prohibited from May 15 to September 15 each year; provided, however, that odd - numbered property addresses may water on odd - numbered days, and even - numbered property addresses may water on even - numbered days. Subdivision 1. Annual Water Use Restrictions. To protect the health and safety of the consumers and the general welfare of the City, to encourage water conservation, and allow the City's Water System flexibility in meeting peak demands, certain limitations must be placed on the City's water supply. a. The irrigating or watering of lawns and gardens is prohibited from May 15 to September 15 each year; provided, however, that odd - numbered property addresses may water on odd - numbered days, and even- numbered property addresses may water on even- numbered days. b. Homeowner's associations, apartment complexes or any property that provide a common irrigation system may water only every other day. c. City water can not be used for the purposes of irrigating or watering lawns, gardens, sod or seeded areas between 10:OOam and 6:OOpm daily and year arouncL Subdivision 2. Authority to Restrict Use. The City of Lino Lakes hereby reserves the right to limit the use of water from the City water supply and distribution system and to prescribe emergency conditions for use of water. The City Administrator or Director of Public Services may in his/her discretion implement emergency measures if necessary supplementing the water use ban under Subdivision 1 with a total prohibition on sprinkling apply to: Subdivision 3. Exceptions. The sprinkling ban under subdivision 2 does not a. Property owners using a private well for sprinkling; b. Property owners who water new sod for the first twelve weeks after it is sodded or water new seed for the first twelve weeks after it is seeded; Subdivision 3. Exceptions. The water use restrictions in 402.01, Section 1, Subdivision 1 do not apply in the following situations. a. Hand watering of plants using a hose. b. Irrigating or watering of new landscaping, sod or seed within 28 days of installation. A permit for 28 Day New Landscaping, Sod or Seed watering will be required. c. Irrigating or watering from a source other than the City's water supply as stated in 401.16. Under this exception, the City may inspect the property to ensure compliance. Subdivision 4. Violation. No person shall cause water to be used in violation of the provisions of this section. The first violation shall result in a $25 citation, and a $50 subsequent citation for those individuals who repeat violations. Subdivision 4. Penalties. a. Failure to comply with restrictions or prohibitions imposed under this ordinance shall result in a citation for water service for each violation in an amount determined by resolution of the City Council, which will be added to the water bill for the property on which such violation occurs. (Or fee schedule) b. No person shall cause water to be used in violation of the provisions of this section. The first violation shall result in a $25 citation, and a $S0 subsequent citation for those individuals who repeat violations. Section 2. This ordinance shall become effective after adoption and upon thirty (30) days following its legal publication. Studenski, City Engineer Re: Ware Road / Birch Street Intersection Petition for Stoplight or Stop Sign Placement Background A petition for stoplight or stop sign placement at the intersection of Ware Road and Birch Street (County State Aid Highway 34) was received by the City on February 12, 2008. The petition consists of 42 pages of resident signatures from Lino Lakes and surrounding communities covering a time period of November 16, 2007 to February 11, 2008. Attached is the cover letter and petition dated February 11, 2008 from the Lino Lakes Quick Stop. The February 11, 2008 letter cites traffic safety concerns from Lino Lakes Quick Stop customers and commuters using Birch Street and Ware Road. The letter also cites several accidents, near accidents, and safety issues with both commuter and pedestrian traffic at the Ware Road / Birch Street intersection. In a February 27, 2008 report from the Lino Lakes Police Department Accident Database 14 accidents from January 1, 2002 to February 22, 2008 occurred in the area of Ware Road and Birch Street. Five of the 14 accidents in the area where specifically reported at the intersection of Ware Road and Birch Street. It is not clear from this data whether or not the accidents can be mitigated by traffic control improvements. A Traffic Analysis Memo dated September 23, 2002 was prepared for the Spirit Hills Commercial Development. The Traffic Analysis Memo found the intersection of Ware Road and Birch Street to be operating at an acceptable level prior to site development. The Traffic Analysis Memo also provides post development operation of the Ware Road / Birch Street intersection. While the post development operation of the intersection shows some congestion on the southbound approach of Ware Road to Birch Street, the Traffic Analysis Memo states that it does not indicate any safety problems at the intersection. The Traffic Analysis Memo made recommendations to construct left and right turn lanes from Birch Street to Ware Road to facilitate the development of the site and maintain 1 acceptable levels of service and safety at the Ware Road / Birch Street intersection. These recommendations were completed with the Spirit Hills Commercial Development. Birch Street (CSAH 34) is under the jurisdiction of Anoka County. The County has received a copy of the petition and will be reviewing the issue. With these types of requests, the County's first step is to define the problem. They will look at crash data, traffic volumes, turning movements, roadway geometrics, etc... to define the operation of the intersection. Secondly, the County will analyze the collected information by looking at traffic operations, traffic volume forecasts, facility needs, property impacts. Finally, depending on the results of the analysis the County will determine a solution. This could be a short term fix (signing and striping) and / or a more elaborate capital improvement (signalization, access controls, roundabout, etc...). The city will have an opportunity to provide input into this process. Please note that currently Birch Street (CSAH 34) is being used as a portion of the detour for the Main Street (CSAH 14) reconstruction project from 35W to 35E. Upon completion of the Main Street project traffic volumes on Birch Street will lessen and the County will be able to analyze intersection conditions based on typical Birch Street traffic volumes. Additionally, as identified in the 2008 City Council goals, Anoka County will conduct an Access Management Study on Birch Street (CSAH 34) this year. We are anticipating that the Request for Proposal for consultant services will go out in April or May with the study beginning in June. This study will assist in the evaluation of the need for traffic control along the entire Birch Street corridor. The issue of taxable versus tax - exempt bonds relates to whether the terms of assessments are the same all assessed persons. This situation of differing terms of assessments exists within the provisions of the charter exempt zones of some of the alternate amendments and in the case of having an assessment area which includes some properties located in a charter exempt zone and some outside of the zone. Mr. Bubul has provided a narrative description of tax - exempt bond status for each amendment alternative and has prepared a supplement to the alternative comparison grid previously provided to you. Following is additional information on that point. The general concern is that bonds secured in part with special assessments may be issued on a tax- exempt basis only if the assessments are not treated as "private loans" under federal tax law. Treasury Regulations, Section 1.141 -5(d) describe the requirements that must be met in order for special assessments to avoid treatment as private loans. Most significant is the "equal basis requirement," stated in Section 1.141- 5(d)(5) as follows: Owners of both business and nonbusiness property benefiting from the financed improvements must be eligible, or required, to make deferred payments of the tax or assessment ...on an equal basis (the equal basis requirement). A tax or assessment does not satisfy the equal basis requirement if the terms for payment of the tax or assessment are not the same for all taxed or assessed persons. Applying this rule to the five special assessment systems shown in the grid discussed on February 27, the result is as follows: Chapter 429: Meets the equal basis requirement, as all benefited persons are subject to the same rules. Bonds may be tax - exempt. 329677v1 SJB LN140 -86 Gordon Heitke February 29, 2008 Page 2 of 3 Existing Charter: Improvements located anywhere in the City outside the three "special areas:" the Charter meets the equal basis requirement, as all benefited properties have the same rights. Bonds may be tax- exempt. Improvements located within the three special areas: the equal basis requirement is not met, because one class of properties (those on which a single family owner - occupied residential unit existed on September 30, 1993) has the right to avoid assessments altogether. Bonds must be taxable. Improvements located partly in one of the three special areas and partly outside any of those areas: the equal basis requirement is not met, because owners inside and outside the special areas have different rights (e.g., business owners in the special areas may not file petitions against the improvement, while business owners in the rest of the city may file such a petition and prevent the assessment from being levied). Also, the single- family "opt out" described above gives different rights to owners of those properties. Bonds must be taxable. Task Force Proposal: Improvements located anywhere in the City outside the three "special areas:" the equal basis requirement is met, as all benefited properties have the same rights. Bonds may be tax- exempt. Improvements located within the three special areas: the equal basis requirement is met, because the single - family "opt out" is removed, and all benefited properties have the same rights. Bonds may be tax- exempt. Improvements located partly in one of the three special areas and partly outside any of those areas: the equal basis requirement is not met, because owners inside and outside the special areas have different rights (e.g., owners in the special areas may not file petitions against the improvement, while owners in the rest of the city may file such a petition and prevent the assessment from being levied at all). Bonds must be taxable. Charter Commission Proposal: As under the Existing Charter, improvements located entirely within or straddling the single remaining special area must be financed with taxable bonds. However, Section 8.01, subdivision 2, of the Charter Commission Proposal may violate the equal basis requirement for improvements located outside the special area, requiring the issuance of taxable bonds for improvements financed by special assessments anywhere in the City. 329677v1 SJB LN140 -86 Gordon Heitke February 29, 2008 Page 3 of 3 The problem is language indicating that all public improvements be "primarily designed to give a direct benefit to property currently occupied by residents or businesses in the City" (emphasis added). This language is difficult to interpret, but could give the owners of unoccupied property the right to avoid assessments in some circumstances. Depending on the facts, the result could be different rights regarding assessments for occupied and unoccupied property, which might violate the federal equal basis requirement described above. Citizen Proposal: Same as Charter Commission Proposal. Mayor Bergeson also asked how the proposed Charter amendments could be altered to correct the problem that requires issuance of taxable bonds. The only way to avoid the private loan problem for all improvement bonds issued by the City is to remove the three "special areas" from the existing Charter. That option might make sense if. the Charter is modified in a way that balances the City's various concerns, and avoids the need for special rules in particular geographic areas. The Task Force Proposal corrects the problem for improvements located entirely within the special areas; the only remaining problem is the financing of improvements that "straddle the boundary" of one or more of the special areas. Again, the Council might consider whether the special areas are still needed in light of the other changes in the Task Force Proposal. In the Charter Commission Proposal, the first sentence of Section 8.01, subdivision 2 would also need to be removed or revised to clarify that unoccupied property is subject to assessments on the same basis as all other property.
