The individual is a janitor at Centennial Middle 21 School. The Lino Lakes Police Department investigated and they do not believe there has 22 been any related problems at the school. 23 24 CHARTER AMENDMENT — Steve Bubul, Kennedy & Graven, was present and 25 outlined his most recent correspondence regarding clarification of the impact of various 26 charter amendment alternatives on the ability of the city to issue tax- exempt bonds for 27 improvements. Having exempt areas does create differing rights among property owners 28 and therefore the easiest way to deal with the question would be to remove the exempt 29 zones. Mr. Bubul was asked about the possibility of removing the zones from the 30 Charter Task Force proposal. 31 32 It was noted that historically the exempt zones were established due to the commercial or 33 anticipated commercial nature of those areas, to deal with the few residential properties 34 located therein. Those zones are exempt from the charter provisions and assessments are 35 basically handled under Chapter 429 rules. The Charter Task Force proposal would add a 36 right to those residential properties to opt out of an improvement project, a right they 37 don't have under Chapter 429 rules. If the zones were removed, the ability of those 38 residential property owners to opt out would change but if it is a situation that absolutely 39 does not benefit the property, generally they can and should not be assessed anyway. 40 41 The council discussed the implication of changes to larger land holders and was informed 42 that there are generally deferment provisions on undeveloped land. 43 44 The Mayor noted that the council will need to move in some direction if there is a desire 45 to forward a charter amendment to the voters this fall. 46 CITY COUNCIL WORK SESSION March 3, 2008 DRAFT 1 There was a short review of the discussion of the February 27 work session and 2 discussion to date on all the amendments. It was noted that there was not a clear reaction 3 of the Charter Commission but a commission member did ask what could be changed in 4 the Charter Commission proposal to make it workable. It was identified that, from a legal 5 standpoint, the existing Charter language would be preferable to the Charter Commission 6 proposal which would actually make it harder to fix roads in the city. Regarding the 7 Task Force amendment, it would conceivably make the improvement process easier 8 because it incorporates many of the elements of Chapter 429 but it also includes the 9 element of allowing benefited property owners to stop a project. The requirement for a 10 referendum is removed in both proposals. 11 12 It was clarified that when the Citizens Task Force approved their proposal, the vote was 13 unanimous. 14 15 A council member asked about concern that changing the charter language dilutes the 16 citizens' ability to participate in public improvement decisions; Mr. Bubul suggested that 17 could be a concern but also pointed out that Lino Lakes is basically one of only two cities 18 in the state that has charter provisions like the current (the other is Mounds View that has 19 a reverse referendum). 20 21 It was clarified that the implication of utilizing tax exempt versus non - exempt bonds 22 would be a significant cost difference. 23 24 It was opined by Mr. Bubul that the council couldn't send an amended version of the 25 Task Force proposal and still maintain the right to put the original proposal on the ballot. 26 27 On the question of removing the exempt zones, city staff indicated that the impact is 28 basically monetary on both the city and those assessed. The council discussed the 29 sensibility of removing the zones based on the change of the affected areas from the 30 1990's when the zones were created. They looked at possible objections from the few 31 residential properties that are included. Under the current Charter provision, the property 32 owners can opt out 011 their own. Under the Task Force proposal, they have no special 33 opt out because they would fall under Chapter 429. The council reviewed the maps 34 indicating how many properties could be impacted. 35 36 It was clarified that under the Task Force proposal, the city would remain one of only two 37 cities in the state that allows the affected property owners to petition out. The Task Force 38 proposal also includes a process to bring the city and the property owners together before 39 the final decision. 40 41 Staff was directed to draft a new ordinance for consideration by the Council on March 24, 42 2008. The ordinance should be the Task Force Proposal minus the exempt zones. 43 • • • • • • CITY COUNCIL WORK SESSION March 3, 2008 DRAFT 1 CONSIDERATION OF ADVISORY BOARD APPLICANTS — Council members 2 submitted the voting sheets they had received in the Weekly Update indicating their votes 3 for advisory board appointments. 4 5 The Mayor clarified that if the council approves four persons for the Economic 6 Development Advisory Committee they would in fact be increasing the size of that group 7 by one. There was no objection. 8 9 Administrator Heitke tallied the votes and presented the results. 10 11 The votes were accepted with the following clarifications: Richard Jensen will receive 12 the two -year term for the Park Board; Pamela Hartley will receive the two year term for 13 the Environmental Board; EDAC will be increased to allow for one additional member. 14 15 WATER EMERGENCY AND CONSERVATION PLAN IMPLEMENTATION - 16 City Engineer Studenski recalled that the city exceeds the DNR benchmarks for water use 17 in three categories. He is presenting recommendations to address those situations. In the 18 area of residential gallons per capital, staff is recommending an ordinance requiring rain 19 sensors with all new automatic sprinkler systems. The engineer is proposing to offer a 20 rain sensor retro -fit program whereby the city could offer some incentives; council 21 direction would be needed on incentives and how they are funded. Residents utilizing a 22 well system would not be impacted. The council requested more information on what an 23 incentive program would look like as well as associated costs and funding possibilities. 24 25 Engineer Studenski then reported on the public education aspect and how staff proposes 26 to implement an education program. 27 28 Staff is also proposing an ordinance that would restrict lawn watering during the daytime 29 hours of 10:00 a.m. to 6:00 p.m. Keeping the odd -even restriction is still recommended 30 because it deals with peak demand issues. When the council discussed the possibility of 31 losing the odd -even day restriction, Engineer Studenski explained that the city is 32 attempting to address not only the issue of conservation but also the peak usage issue that 33 drives the needs for more water services. The odd -even ordinance is already on the 34 books. Dear Mayor and Council members, Thanks for all of the work you do to make our city a better place to live. I know it is a big job and our current growth and development plans probably make it difficult to focus a lot of energy on the road reconstruction problem. I sincerely hope that in the next few months there will be some visible movement in the direction of an amendment that will be recommended by the council and advertised widely through the community about the importance of this issue for the entire city. I truly believe that this is a critical time and this process needs to go forward to a successful amendment in the fall. Many folks as you well know (especially yourselves) would like to put this issue to rest and move on to an operational process that will guarantee the protection of our city's current roadway system while continuing to improve our substandard roads. Not only is this an important issue from a financial stan dpoint but I believe has become an issue of equality in how we treat our citizens. How can we be ok with a system that allows some neighborhoods to get a road reconstructed and others not based on some random vote dictated by the whim of a public that will never understand the impact on the city or its citizens? I hope that all the time and effort that you ALL have invested in an opportunity to change this process will be fully addressed soon. I am sure there is a lot of talk about what the council should do but I say that it is time to do what is right for the city and its future...now. As I said, I believe this is an important juncture and I am confident that that the council has the city's best interest in mind. Whether you put together your own amendment or eliminate all the doubt and go 429 I believe it can and will happen! The referral followed the process established by state statute for amendments proposed by council. The Charter Commission elected to draft a substitute amendment that was received by the council in December 2007. A member of the Charter Commission (who has subsequently resigned from the Commission) also submitted a proposed charter amendment. The council received information at their February work session from the city's bond counsel, Stephen Bubul of Kennedy & Graven, and from the city's financial advisor, Terri Heaton of Springsted, on legal and financial concerns relative to the Charter Commission's substitute amendment. After discussing the detailed review, the council requested that a simplified "grid" analysis be prepared to assist in further discussion of the amendments submitted by the Citizens Task Force, Charter Commission and Mr. Bening, as well as Chapter 429. A special council work session was held on Wednesday, February 27, 2008 to continue discussion of possible charter amendments to be placed on the November, 2008 ballot. Additional clarification was requested and subsequently presented at the Council's March 3, 2008 work session regarding the impact of the various charter amendments on the city's ability to issue tax - exempt bonds for improvements, related to the inclusion of "exempt" zones in the charter amendment altematives. Staff was directed to draft a new ordinance for Council action on March 24, 2008, based on the charter amendment originally proposed by the Citizens Task Force, but with the exempt zone language removed. Such published and mailed notice shall include all the information provided in the initial mailed notice, along with a statement as to the number and percentage of affected owners who filed objections at or before the hearing. The most recent Water Emergency and Conservation Plan update was adopted at the September 24, 2007 City Council Meeting. The Water Emergency and Conservation Plan adopted established conservation goals for the benchmarks listed below. The Department of Natural Resources (DNR) permit approvals will be based on meeting the specified benchmarks listed below. If water demands exceed Benchmarks for unaccounted water, residential per capita, and peak demands then permit approval will be contingent on implementation of one or more of the listed Conservation Goals until the benchmark is achieved. The City exceeds the DNR benchmarks for water use in three categories; (1) Residential Gallons Per Capita Demand (GPCD), (2) Total Per Capita Demand, and (3) Peak Demands. Ordinance 06 -08 addresses the following conservation goal set in the Water Emergency and Conservation Plan: Total Per Capita Demand • a. Prepare a time of day lawn watering ordinances that restricts lawn watering during the daytime hours of 10:OOam to 6:OOpm. Attached is a copy of the ordinance. A public education program consisting of detailed information on the City website, the quarterly newsletter and a public notice will coincide with the implementation of this ordinance. This ordinance will require additional resources for enforcement. The penalties for violation of the ordinance will be $25 on a first offense and $50 for any subsequent violations in a year. Time of day lawn watering ordinances that restrict lawn watering during midday hours can lower water usage and reduce peak demands. Early morning is the best time to water for a healthy lawn. Public information programs and local ordinances that encourage lawn watering before 10:00 am and after 6:00 pm can improve lawn watering efficiencies by reducing water lost to evaporation and wind drift. Wind and evaporation during midday hours can remove up to 65% of sprinkling water meant for your lawn. The most recent Water Emergency and Conservation Plan update was adopted at the September 24, 2007 City Council Meeting. The Water Emergency and Conservation Plan adopted established conservation goals for the benchmarks listed below. The Department of Natural Resources (DNR) permit approvals will be based on meeting the specified benchmarks listed below. If water demands exceed Benchmarks for unaccounted water, residential per capita, and peak demands then permit approval will be contingent on implementation of one or more of the listed Conservation Goals until the benchmark is achieved. The City exceeds the DNR benchmarks for water use in three categories; (1) Residential Gallons Per Capita Demand (GPCD), (2) Total Per Capita Demand, and (3) Peak Demands. Prepare an ordinance requiring rain sensors to be installed with all new automatic sprinkler systems. The cost for a typical rain sensor is usually $40 to $120 plus costs for professional installation. The savings in water charges from the use of a rain sensor could pay for the rain sensor in the first season. The location of lines and sprinkler heads for a Lawn and Landscape Irrigation System may be located within private property or the city right -of -way or easement subject to the following conditions: a. A permit will be required for all Lawn Sprinkler / Irrigations Systems installed. The permit cost will be established yearly by Lino Lakes City Ordinance. b. The connection to the water system must be done in conformance with the Minnesota State Plumbing Code. c. The low voltage electrical wiring portion of the lawn sprinkler / irrigation system must be performed by a licensed Technology Systems Contractor who employs a qualified Power Limited Technician per Minnesota Statue 326.242. d. An approved back flow prevention device must be installed as a part of all lawn sprinkler / irrigation systems. The device shall be installed per manufacturer installation instructions. The type of approved backflow device must be provided when applying for a permit. e. All newly installed lawn sprinkler / irrigation systems are required to have rain sensors installed as part of the system. MEETING DATE: March 24, 2008 TOPIC: First Reading, Ordinance 04 -08 Amending Sign Ordinance BACKGROUND Dynamic display signs are signs with moving or changing images. These are being seen more and more around the Metro Area on billboards on freeways. The City adopted a moratorium on dynamic display signs in April 2007. The one -year moratorium expires on April 18, 2008. The City Attorney and staff have prepared an amended ordinance to address dynamic display signs and other issues. Changeable electronic billboards are being installed in various areas of the country and the Twin Cities. These billboards have large electronic screens that are programmed to change messages frequently, often every eight seconds. Because these large, flashing, changing billboards are very effective at grabbing the attention of passing motorists, they pose potential safety hazards. In addition, there are aesthetic and community character concerns with these billboards: they are very bright and many are in rural areas, where Lino Lakes residents value the dark night sky. As long as the sign ordinance was being amended in some major ways to address dynamic display signs, we decided to clarify other issues as well. The City amended its sign ordinance in 2005 specifically to address temporary signs and signage on buildings. The ordinance before you now, Ordinance 04 -08, is the first major overhaul in many years: probably since 1997. The Planning & Zoning Board recommended approval of the ordinance. ANALYSIS The old sign ordinance followed a clumsy format. The amended ordinance is reorganized and moves lengthy requirements for sign size and number into tables. This makes it much easier to determine the sign regulations in each zoning district. The old ordinance also included lengthy descriptions of the City's zoning districts, which is best done by the Zoning Ordinance. Of course, dynamic display signs are addressed in the revised ordinance. Section I of the amended ordinance is a new purpose and intent section, which establishes the foundations for requirements in the ordinance. This is followed by a re- organized list of definitions in Section II. Some definitions have been clarified, some new ones added, and they all are now alphabetized. A new Section III describes administration and enforcement. Section IV gives the findings for the City's regulation of dynamic display signs. There are significant public safety concerns. Drivers can be distracted by the large, lighted displays; by moving pictures; by changing messages; and by watching messages that are delivered a piece at a time with a series of displays. There also are aesthetic and community character concerns with a sign that flashes, has moving messages, and is brightly lit. The City amended the zoning ordinance to require 90 degree cutoff lighting fixtures to reduce unnecessary lighting in new developments. This was to minimize lighting the sky at night, which was a concern for residents, especially those in the rural areas of Lino Lakes. Most billboards along freeways are located in rural areas and dynamic display signs are very bright. If a sign is in a residential area, the bright displays can be a nuisance to homeowners in the vicinity. Later, in Section VI. paragraph X., dynamic display signs are prohibited except for a dynamic display area of less than 20 sf. We included this exception to allow for small signs with less potential for safety and lighting impacts. This exemption allows signs such as the horizontal "reader board" often seen at banks and public buildings. The P & Z considered if these small signs should have a limit on the frequency for changing the messages, but left it to the City Council to decide. Note that the definition of signs exempts road construction signs from regulation by the ordinance which allows for changing messages on road project signs. Section V lists the zoning districts and references the tables at the end of the ordinance for specific regulations in the different districts. Section VI is the general regulations. Some revisions are included. Some clauses were combined or moved . Dynamic display signs of any size are prohibited from being hung in windows. The P & Z Board considered the issue of banners versus flags, and how business flags differ from government flags. Banners are distinguished from flags in the definitions, and business and government flags are regulated differently in Paragraph Z. The intent is to prevent the use of numerous American flags as an advertising device. Sections VII and VIII are technical, legal statements seen in many ordinances. Section VIII is the tables of sign requirements —size, number, type —for different zoning districts. Some passages have been clarified or moved from elsewhere in the document for easier administration. • • • • • • PLANNING & ZONING BOARD The Planning & Zoning Board opened a public hearing on February 13, continued it, and finally closed it on March 12. PURPOSE, AND INTENT, AND FINDINGS It is not the purpose or intent of this sign ordinance to regulate the message displayed on any sign; nor is it the purpose or intent to regulate any building design or any display not defined as a sign, or any sign which cannot be viewed from outside a building. Rather, the purpose and findings of the sign ordinance are as follows: a) Purpose: the sign ordinance is intended to establish a comprehensive and balanced system of sign control that accommodates the need for a well - maintained, safe, and attractive community, and the need for effective communications including business identification. It is the intent of this seetionordinance, to promote the health, safety, general welfare, aesthetics, and image of the community by regulating signs that are intended to communicate to the public, and to use signs which meet the city's goals by authorizing: 1) permanent signs which establish a high standard of aesthetics; 2) signs which are compatible with their surroundings; 3) signs which are designed, constructed, installed_and maintained in a manner that does not adversely impact public safety or unduly distract motorists; 4) signs which are large enough to convey the intended message and to help citizens find their way to intended destinations; 5) signs that are proportioned to the scale of, and are architecturally compatible with, principal structures; 6) permanent signs which give preference to the on- premise owner or occupant and 7) temporary commercial signs and advertising displays which provide an opportunity for grand openings and occasional sales events while restricting signs which create continuous visual clutter and hazards at public right -of -way intersections. Further, the city finds: 1) permanent and temporary signs have a direct impact on and relationship to the image of the community; 2) the manner of installation, location and maintenance of signs affects the public health, safety, welfare and aesthetics of the community; 3) an opportunity for viable identification of community businesses and institutions must be established; 4) the safety of motorists, cyclists, pedestrians and other users of public streets and property is affected by the number, size, location and appearance of signs that unduly divert the attention of drivers; 5) installation of signs suspended from, projecting over, or placed on the tops of buildings, walks or other structures may constitute a hazard during periods of high winds and an obstacle to effective fire- fighting and other emergency service; 6) uncontrolled and unlimited signs adversely impact the image and aesthetic attractiveness of the community and thereby undermine economic value and growth; 7) uncontrolled and unlimited signs, particularly temporary signs which are commonly located within or adjacent to public right -of -way or are located at driveway /street intersections, result in roadside clutter and obstruction of views of oncoming traffic. This creates a hazard to drivers and pedestrians and also adversely impacts a logical flow of information; 8) commercial signs are generally incompatible with residential uses and should be strictly limited in residential zoning districts; and 9) the right to express noncommercial opinions in any zoning district must be protected, subject to reasonable restrictions on size, height, location and number; 10) light pollution creates negative impacts on the community, particularly in residential and rural areas. use of such devices. The noncommercial speech content of the sign shall not be reviewed or considered in determining whether to approve or deny a sign permit. The permit owner shall be responsible for all of the requirements of this Ordinance, including the liability for expense of removal and maintenance incurred by the City. Sign permit fees shall be as specified in the city fee schedule. B. Repairs. All signs shall be maintained in good condition and the areas around them kept free from debris, bushes, high weeds, and from anything else which would be an eyesore or nuisance. Studies show that there is a correlation between dynamic displays on signs and the distraction of highway drivers. Distraction can lead to traffic accidents. Drivers can be distracted not only by a changing message, but also by knowing that the sign has a changing message. Drivers may watch a sign waiting for the next change to occur. Drivers are also distracted by messages that do not tell the full story in one look. People have a natural desire to see the end of the story and will continue to look at the sign in order to wait for the end. Additionally, drivers are more distracted by special effects used to change the message, such as fade -ins and fade -outs. Finally, drivers are generally more distracted by messages that are too small to be clearly seen or that contain more than a simple message. Time and temperature signs appear to be an exception to these concerns because the messages are short, easily absorbed, and become inaccurate without frequent changes. In addition to safety concerns, light pollution creates negative impacts. particularly in rural areas and residential neighborhoods of the community. The City has adopted regulations of exterior lighting intended to reduce light pollution. Dynamic displays are by nature very bright and often are installed on highway signs, many of which are in rural and residential areas in Lino Lakes. In conclusion, the city finds that any sign containing, in whole or in part, a dynamic display, except signs solely displaying the time and/or temperature or similar, should not be allowed in any District except as otherwise as set forth in this Ordinance SECTION HIV. Other Election Years: In years when no state general election is to take place, signs announcing candidates seeking public political office and other data pertinent thereto shall be permitted up to a total area of eight (8) square feet in size and dimensions not greater than two (2) feet by four (4) feet. The permit owner shall be responsible for all of the requirements of this Ordinance, AA-VT. Multi- Occupancy Business and Industrial Buildings: When a single principle building is devoted to three (3) or more businesses, or industrial uses, a comprehensive sign plan for the entire structure shall be submitted and shall be of sufficient scope and detail to permit a determination as to whether or not the plan is consistent with the following regulations._ The plan shall be subject to the approval of the City Council._ No permit shall be issued for an individual use except upon a determination that it is consistent with the approved comprehensive sign plan. 1. The maximum individual tenant sign sizes for multiple occupancy structures and individual uses which may display signs shall not exceed the maximum provisions for single occupancy structures in the same zoning district. 2. Multiple occupancy structures may display an area identification sign consistent with the applicable district provisions. Individual freestanding signs identifying the tenants' business ball not be displayed. Twenty Five Percent (25 %) of the area identification sign must identify the entire site, the balance of the sign may be used for individual tenant identification. 3. Except as provided in this ordinance, individual tenants of multiple occupancy structures shall not display separate wall signs unless the tenants' business has an exclusive exterior entrance. It is the intention of this sign ordinance that nonconforming signs shall be allowed to City of Lino Lakes prior to the adoption of this Ordinance, may continue to exist but they shall not be enlarged upon, expanded or extended, nor be used as the grounds for adding other signs or uses prohibited elsewhere in the same district. It is further the intent of this sign ordinance to permit legal nonconforming signs existing on the effective date of this sign ordinance, or amendments thereto, to continue as legal nonconforming signs provided such signs are safe, are maintained so as not to be unsightly, and have not been abandoned or removed subject to the following provisions: 1. No sign shall be enlarged or altered in a way which increases its nonconformity. 2. Should such sign or sign structure be destroyed by any means to an extent greater than fifty (50) percent of its replacement cost and no building permit has been applied for within 180 days of when the property was damaged, it shall not be reconstructed except in conformity with the provisions of this ordinance 3. Should such sign or sign structure be moved for any reason for any distance whatsoever, it shall thereafter conform to the regulations for the zoning district in which it is located after it is moved. 4. No existing sign devoted to a use not permitted by the zoning code in the zoning district in which it is located shall be enlarged, extended or moved except in changing the sign to a sign permitted in the zoning district in which is it located. 5. When a structure loses its nonconforming status all signs devoted to the structure shall be removed and all signs painted directly on the structure shall be repainted in a neutral color or a color which will harmonize with the structure. For the purposes of this ordinance, a flag symbolizing a government or political subdivision, or a branch or department of a government or political subdivision, is considered noncommercial speech and is not regulated by this ordinance as long as there are no more than three such flags on an individual lot and the flags are on flagpoles that are permanently mounted in the ground or mounted on a building. More than (3) three such flags shall be considered advertising to draw attention to a commercial or industrial activity and thus commercial speech. In such a situation, flags numbering more than three (3) shall be regulated as permanent signage. Each lot may fly one flag that is not a symbol of a government or political subdivision, or a branch or department of a government or political subdivision, and that is on a flagpole that is permanently mounted in the ground or mounted on a building. More than one such non - government flag shall be regulated as permanent signage. SECTION VII. SUBSTITUTION CLAUSE The owner of any sign, which is otherwise allowed by this sign ordinance, may substitute a noncommercial speech copy in lieu of any other commercial or noncommercial copy. This substitution of copy may be made without any additional approval or permitting. The purpose of this provision is to prevent any inadvertent favoring of commercial speech over noncommercial speech, or favoring of any particular noncommercial message over any other noncommercial message. This provision prevails over any more specific provision to the contrary. SECTION VIII. SEVERABILITY If any section, subsection, sentence, clause, or phrase of this Sign Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Sign Ordinance The City Council hereby declares that it would adopted the Sign Ordinance in each section, subsection, sentence, clause. or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid. VOTE REQUIRED: Simple Majority BACKGROUND: A petition for stoplight or stop sign placement at the intersection of Ware Road and Birch Street (County State Aid Highway 34) was received by the City on February 12, 2008. The petition consists of 42 pages of resident signatures from Lino Lakes and surrounding communities covering a time period of November 16, 2007 to February 11, 2008. Attached is the cover letter and petition dated February 11, 2008 from the Lino Lakes Quick Stop. The February 11, 2008 letter cites traffic safety concerns from Lino Lakes Quick Stop customers and commuters using Birch Street and Ware Road. The letter also cites several accidents, near accidents, and safety issues with both commuter and pedestrian traffic at the Ware Road / Birch Street intersection. In a February 27, 2008 report from the Lino Lakes Police Department Accident Database 14 accidents from January 1, 2002 to February 22, 2008 occurred in the area of Ware Road and Birch Street. Five of the 14 accidents in the area where specifically reported at the intersection of Ware Road and Birch Street. It is not clear from this data whether or not the accidents can be mitigated by traffic control improvements. A Traffic Analysis Memo dated September 23, 2002 was prepared for the Spirit Hills Commercial Development. The Traffic Analysis Memo found the intersection of Ware Road and Birch Street to be operating at an acceptable level prior to site development. The Traffic Analysis Memo also provides post development operation of the Ware Road / Birch Street intersection. While the post development operation of the intersection shows some congestion on the southbound approach of Ware Road to Birch Street, the Traffic Analysis Memo states that it does not indicate any safety problems at the intersection. The Traffic Analysis Memo made recommendations to construct left and right turn lanes from Birch Street to Ware Road to facilitate the development of the site and maintain acceptable levels of service and safety at the Ware Road / Birch Street intersection. These recommendations were completed with the Spirit Hills Commercial Development. Birch Street (CSAH 34) is under the jurisdiction of Anoka County. The County has received a copy of the petition and will be reviewing the issue. With these types of requests, the County's first step is to define the problem. They will look at crash data, traffic volumes, turning movements, roadway geometrics, etc... to define the operation of the intersection. Secondly, the County will analyze the collected information by looking at traffic operations, traffic volume forecasts, facility needs, property impacts. Finally, depending on the results of the analysis the County will determine a solution. This could be a short term fix (signing and striping) and / or a more elaborate capital improvement (signalization, access controls, roundabout, etc...). The city will have an opportunity to provide input into this process. Please note that currently Birch Street (CSAH 34) is being used as a portion of the detour for the Main Street (CSAH 14) reconstruction project from 35W to 35E. Upon completion of the Main Street project traffic volumes on Birch Street will lessen and the County will be able to analyze intersection conditions based on typical Birch Street traffic volumes. Additionally, as identified in the 2008 City Council goals, Anoka County will conduct an Access Management Study on Birch Street (CSAH 34) this year. We are anticipating that the Request for Proposal for consultant services will go out in April or May with the study beginning in June. This study will assist in the evaluation of the need for traffic control along the entire Birch Street corridor. The attached resolution 08 -34 addresses the City's desire to provide input and work jointly with Anoka County throughout this process. The resolution covers the inclusion of the Ware Road / Birch Street intersection in the Access Management Study. A copy of the resolution will be sent to Anoka County.
