City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. It includes a mix of housing styles including typical single family lots, single family airpark lots with hangars, single family detached townhomes (individual house lots located within a commonly owned yard lot) and attached townhomes. The original development consisted of 27 low density units and 223 medium density units on 85.3 net acres of land resulting in a net density of 2.93 units per acre. There have been five (5) final plats and one (1) PUD amendment to date. The first amendment allowed for the conversion of 16 single family detached townhomes to 16 single family lots. Five (5) of those single family lots were final platted as part of the 5th Addition. The current Land Use Application is for the following: • Rezone property located at 7880 Sunset Avenue from R-Rural to PUD-Planned Unit Development. • Amend the Development Stage Plan/Preliminary Plat of Century Farm North to expand project boundary, realign Robinson Drive and create new parcels. • Vacate dedicated parkland (City Council action) The applicant is requesting an amendment to the PUD Development Stage Plan/Preliminary Plat of Century Farm North to include a 0.991 acre parcel located 7880 Sunset Avenue owned by Jeff Morell. This parcel is currently zoned R-Rural and requires rezoning to Planned Unit Development to be consistent with Century Farm North. The project also includes the realignment of Robinson Drive. The proposed PUD preliminary plat boundary amendment occurs within Outlot A and Park area of Century Farm North 5th Addition. This will be the second PUD Amendment to Century Farm North. The preliminary plat of Century Farm North 5th Addition consists of 10 single family detached townhomes and 16 single family lots. Five (5) of those single family lots have been developed. The proposed Century Farm 6th Addition will include the remaining 11 undeveloped lots from the 5th Addition, convert the 10 single family detached townhomes to single family lots and create an additional 11 single family lots for a total of 32 single family lots. Outlot C is for future townhome development. A portion of dedicated parkland will need to be vacated to accommodate 3 proposed new lots. W A previous land use application to amend the PUD Development Stage Plan/Preliminary Plat for Century Farm North was submitted in May 2013 and the public hearing was continued through several Planning & Zoning Board meetings. The applicant formally withdrew the application in January 2014. A new public hearing was held by the Planning & Zoning Board on April 9, 2014 and continued to the May 14, 2014 meeting. The Planning Staff Report dated April 9, 2014 precedes this report. The following staff report is based on the revised plan set prepared by Plowe Engineering, Inc. dated April 25, 2014 and received by the City on April 25, 2014. ANALYSIS Rezoning The 0.991 acre parcel located at 7880 Sunset Avenue is currently zoned R-Rural. The PUD amendment proposes to amend the boundary of the Century Farm North preliminary plat to include this parcel. The property requires rezoning from R-Rural to PUD-Planned Unit Development to be consistent with the current development. Lot Summary The Lot Summary reflects changes from the approved original PUD Development Stage Plan/Preliminary Plat, final plats and amendments. The phasing plan has been reduced from 8 phases to 7 phases. At the time the original PUD was approved in 2003, the City's Comprehensive Plan for medium density residential development allowed for 3 to 6 dwelling units per acre and the original density was 2.93 units per acre. Although the current Comprehensive Plan for medium density requires 4.0 to 5.9 dwelling units per acre, the developer has the right to develop at a density consistent with the original PUD. The increased density to 3.81 units per acre moves in a direction more consist with the current Comprehensive Plan. Zoning Requirements and Standards The PUD provides flexibility from the strict standards of the zoning ordinance; however, the proposed development shall model the R-2 District regulations. Unless otherwise stated in the PUD resolution, the regulations and performance standards of the zoning ordinance and R-2 Two Family Residential District will be in effect. The building design standards as established in the R-2, Two Family Residential District shall apply to the single family lots except the following PUD criteria regarding garages and front porches shall apply: a. All single family dwellings shall have a minimum double garage. b. All single family dwellings shall include a front porch or stoop that is covered, unenclosed and a minimum of 3 feet in depth. c. All single family dwelling and garage elevations shall include a variation in exterior building materials such as brick, stone, rock face, concrete block, wood, stucco, vinyl, steel, fiber cement and aluminum siding. d. Side or rear loaded garages are permitted. The elevation facing the street shall require a minimum of one (1) window. e. The garage doors shall incorporate architectural design features such as decorative windows, panels, hinges, etc. C� f. Garages in excess of two stalls shall be broken up so the additional stalls are recessed from the main garage fagade. g. Garage width does not exceed 32 feet. The proposed development is not considered premature, is consistent with the original PUD and meets the performance standards of the subdivision and zoning ordinance. Blocks and Lots The preliminary plat amendment creates 5 blocks with 32 lots and 3 Outlots and will be final platted as Century Farm North 6th Addition. Outlot A and B protect wetlands, ACD 10-22 drainage ditch and stormwater management ponds. Outlot C is proposed for future townhome development and shall require final plat. Typical lots are shown as 62 feet wide and 130 feet deep. Streets and Alleys Robinson Drive is classified as a minor collector roadway and shall be constructed in its entirety the full length from CR 53 (Sunset Avenue) to Century Trail (approximately 1,600 feet) with this next phase of development. CR 53 (Sunset Avenue) is currently classified as a major collector and 60 feet right of way from centerline is being dedicated as required. Trail and/or sidewalk shall be constructed along Robinson Drive. Staff is considering traffic calming techniques in road design. The existing house and driveway location at 7880 Sunset Avenue will remain in place. It was the recommendation of both the City and Anoka County Highway Department to 7 relocate the driveway to Robinson Drive for safety purposes but costs and site design of a new driveway are prohibitive. A condition of the final plat will be if the house were ever to be demolished or lose its legal non -conforming status, the driveway will be required to be relocated off of Robinson. The final plat will also require right of access dedicated to the County. Easements Standard drainage and utility easements are shown around the interior perimeter of lots, wetlands and storm water drainage areas. A drainage and utility easement shall be dedicated over Outlot B which is a stormwater management pond. Storm Water Management and Erosion and Sediment Control A revised Stormwater Drainage Report was prepared by Plowe Engineering, Inc. on April 8, 2014 and has been reviewed by the City Engineer and Rice Creek Watershed District for compliance. The SWPPP has been reviewed by the City Environmental Coordinator. Utilities Public water, sanitary and storm sewer utilities will be installed in conjunction with the construction of Robinson Drive. The watermain will also extend south along CR 53 and connect with the existing watermain to loop the system for better fire protection and water quality. The property owners are requesting the city design, construct and assess the benefitting property owners for the road and utility improvement costs. The City has drafted a Petition and Waiver Agreement and it shall be signed by the property owners. Public Land Dedication The PUD amendment includes the creation of 11 additional lots and the vacation of approximately 0.545 acres of previously dedicated parkland. The vacated parkland would be used to create 3 additional lots along Robinson Drive. The newly created lots would be subject to the City's Park Dedication fee at $2,500 per lot. Additionally, the N. City would need to be reimbursed for the value of the land dedication established at the original time of approval which was $50,000 per acre. The following park dedication requirements shall be met: 0.545 gross acres — 0.00 acres wetland = 0.545 net acres 0.545 acres x $50,000 (value of land at time of dedication) = $27,250 11 lots x $2,500 payment in lieu = $27,500 TOTAL = $54,750 Note that any wetland on the vacated parkland shall be subtracted from the total area. Only upland can be used to calculate the reimbursement amount. The property owner is working with city staff on bringing in suitable topsoil and seed in to the existing park. Tree Preservation and Mitigation Plan A Tree Preservation and Mitigation Plan is not required since the site has been rough graded and any potential tree removal is within the basic use area (BUA) and the basic use area is not an environmental sensitive area (ESA). Landscaping Landscaping is subject to the approved PUD Landscape Plan. In previous phases of Century Farms North, the developer installed the required and additional trees along the boulevard. Staff recommends that the developer plant and guarantee for 1 growing season the required boulevard trees according to the submitted Landscape Plan. Staff also recommends that additional trees not be installed if there is conflict with underground utilities. It is recommended that the decision to not allow additional trees on any one site will be at the discretion of City Staff. A determination for the suitability of additional trees shall be made when the new tree locations are staked out for Gopher state one calls. The City shall maintain the right to reject any trees brought to the site for planting on City boulevards based on City horticultural standards. It is also recommended that additional landscape plantings on outlots and boulevards be installed by the developer, and not adjacent property owners. A clear vision triangle shall be maintained at the intersection of Robinson Drive and Sunset Avenue. Comprehensive Plan Resource Management System The Resource Management Plan identifies a greenway system, future neighborhood park, proposed designated bike route along CR 53 and the need for a future north -south trail in I the subject site area. The greenway and wetlands are being protected via easements or dedicated parkland. Additional right of way is being dedicated along CR 53. Six acres of parkland were deeded to the City as part of Century Farm North Fifth Addition. An 8 foot wide bituminous trail is proposed to extend north -south throughout the development and is consistent with the Park, Greenway & Trail System Plan. Land Use Plan The land use is guided for medium density residential development per the Comprehensive Plan and is within the I Utility Staging Area. Housing Plan Key goals of the Housing Plan are to ensure housing development is compatible with existing and adjacent land uses and provide accessibility to key community features and natural amenities. The PUD provides a variety of housing stock from standard single family lots to smaller single family lots and townhome development. Transportation Plan Per the Transportation Plan, Robinson Drive is a minor collector and shall be constructed the full length from CR 53 (Sunset Avenue) to Century Trail with this next phase of development. CR 53 (Sunset Avenue) is classified as a major collector and proper turning lanes shall be constructed. Staff is considering traffic calming techniques in road design. Transportation includes all multi -modal systems which accommodate pedestrians, bicycles, roadways and transit. An 8 foot wide bituminous trail is proposed to extend north -south throughout the development and is consistent with the Park, Greenway & Trail System Plan. A 5 foot wide concrete sidewalk is proposed along the south side of Robinson Drive. Alternative Urban Areawide Review (AUAR) The site is not within the I-35E AUAR Corridor. Wetlands A Revised Wetland Delineation Report was prepared by Wenck Associates in December 2013. One wetland area was identified within the project area. Rice Creek Watershed District (RCWD) reviewed and approved the delineation on January 2, 2014. Per the RCWD CAPROC letter dated April 16, 2014, the applicant is unable to fully meet the buffer provisions of RCWD Rule F.6(e)(2), which requires an average buffer width of 50-feet and minimum of 25-feet at all locations. The applicant has requested and received a variance from RCWD from the 25-foot buffer requirements. 10 Per RCWD Rule C.I0(d), projects within CWPMP areas, the wetland management corridor (WMC) boundary delineation, buffer and easement requirements found at Rule F.6 apply. The preliminary plat amendment indicates a wetland buffer and conservation line around the wetland areas. After discussion with the developer and RCWD, the wetland buffer has been revised. Those revisions shall be incorporated into the plan set. Floodplain There is no floodplain located within the project site. Growth Management Policy Per the Comprehensive Plan, an annual average of 230 units per year over each 5 year phasing period not to exceed 345 units in any 1 year is allowed. At the end of the 5 year phasing period unallocated units will be averaged out over the next 5 years. A phasing plan indicates 32 single family lots to be developed in Phase 6 and 12 townhome units to be developed in Phase 7. Final Plat A land use application for PUD Final Plan/Final Plat for Century Farm North 61n Addition shall be required. At such time, the developer shall enter into a Development Contract and other documents as the City deems necessary. The boundary of the proposed Century Farm North 61h Addition final plat shall include Outlot A, Century Farm North 5th Addition, the vacated parkland and the Morell parcel. The following items shall be addressed prior to approval by the City Council unless otherwise noted: 11 1. All comments from City Engineer letters dated May 7, 2014 and May 9, 2014 shall be addressed. 2. All comments from Environmental Coordinator letter dated April 1, 2014 shall be addressed. 3. All comments from Anoka County Highway Department letter April 21, 2014 shall be addressed except for the relocation of the driveway. 4. Approval from Rice Creek Watershed District shall be required at the time of recording the final plat. 5. A summary table created in Microsoft Excel by lot and block and outlots of lot sizes (gross, unbuildable and net area) and setbacks (front, rear and side) shall be required. 6. The original approved PUD Preliminary Plat for Century Farm North shall be incorporated into the plan set. 7. Drainage and utility easements shall be dedicated over stormwater drainage areas including Outlot B. 8. Conservation easements shall be dedicated over wetland buffer areas as required by Rice Creek Watershed District. 9. Conservation easement language shall include allowance for construction of trails, parks, storm water management facilities, retaining walls, etc. 10. Outlots A and B shall be deeded to the City at the time of recording the final plat. 11. The developer shall draft the deeds for Outlot A and B. 12. A Petition and Waiver Agreement regarding public improvement construction and assessments shall be drafted by the City and signed by the owners. 13. A condition of the final plat for Century Farm North 6th Addition will be if the house located at 7880 Sunset Avenue were ever to be demolished or lose its legal non -conforming status, the driveway will be required to be relocated off of Robinson Drive. 14. The final plat for Century Farm North 6th Addition will require right of access dedicated to Anoka County. 15. The applicant shall provide documentation from RCWD approving the variance from the 25-foot buffer requirements. 16. A separate plan sheet indicating the wetland boundary, wetland buffer and conservation easement and location of wetland buffer signs shall be included in the plan set. 17. The house located at 7880 Sunset Avenue shall immediately hook up to municipal water and sanitary services when available. 18. The existing well located at 7880 Sunset Avenue shall be properly abandoned per state and local regulations. 19. The existing septic drain field located at 7880 Sunset Avenue shall be properly removed per state and local regulations. 20. Sheet CO, Title Sheet: a. The following documents were provided for review: • grading and utility plans dated 04/25/14 by Plowe Engineering • Stormwater Drainage Report with HydroCAD output dated 03/10/14 and revised by Plowe Engineering on 4/8/14 • Drainage areas plans dated 04/08/14 by Plowe Engineering A review of these documents was completed to verify the extent that they are able to meet the City's ordinance for stormwater management and standard engineering practices for stormwater management. As you are aware, the City's Ordinance is currently being updated to reflect the new rules of Rice Creek Watershed District (RCWD). Revisions to the RCWD Rules offer the developer more flexibility than the old rules and, therefore, the proposed stormwater treatment facilities will be reviewed to the new rules of RCWD. Based on our review, we offer the following comments that should be addressed by the applicant: PROCEDURAL Operation and Maintenance Agreement for stormwater management facilities will be required. 2. The applicant must receive permits from other agencies prior to construction. Permits needed include the MPCA's NPDES Construction Stormwater Permit and RCWD's Stormwater Management and Erosion Control Permits. Environmental Memo To: Katie Larsen From: Marty Asleson Date: April 1, 2014 Re: Environmental Board Recommendations for Century Farms North The following recommendations were made by the Lino Lakes Environmental Board on March 26, 2014 concerning Century Farms North: Late in 2012 the Environmental Board reviewed this plan and determined that the boulevard trees would consist of alternating American Linden and Swamp White Oak. This is still part of the plan. The Environmental Board also stated that under no circumstances would any species of Green Ash be allowed in the plant pallet. Staff recommends the developer plant and guarantee for 1 growing season the required boulevard trees according to the submitted Landscape Plan. Staff also recommends that additional trees not be installed if there is conflict with underground utilities. It is recommended that the decision to not allow additional trees on any one site will be at the discretion of City Staff. A determination for the suitability of additional trees shall be made when the new tree locations are staked out for Gopher state one calls. The City shall maintain the right to reject any trees brought to the site for planting on City boulevards based on City horticultural standards. • Staff recommends additional landscape plantings on outlots and boulevards be installed by the developer, and not adjacent property owners. 0 Page 1 • The Storm Water Pollution Prevention Plan be as site specific as state law requires and include the following: 1. The permitees must, before construction begins, provide training documentation that the individuals listed as SWPPP overseers are certified by a MPCA approved training method. With that, the City would need names of the person or persons involved with SWPPP management, dates of training and the names of instructors of entity providing training, and the content of the training course or workshop including the numbers of hours training 2. The specific location of the SWPPP must be located on the map as well as where all required weekly and follow up inspections and corrections can be found. 3. The owner must identify who will have the responsibility for long-term operation and maintenance of the permanent stormwater management system. The owner must include in the SWPPP a chain of responsibility with all operators on the site, or if not known, the title or position of the responsibility of responsible party, to ensure that the SWPPP will be implemented and stay in effect until the construction project is complete, the entire site has undergone final stabilization and a "Notice of Termination" has been submitted to the MPCA. 4. Proposed erosion prevention and sediment control BMP's to control the discharge of sediment and/or other pollutants from the site, particularity at the point(s) of intended discharge. All surrounding stormwater inlet drains within 200 feet of the site that have water draining to them must have a city approved stormwater inlet protection device installed prior to construction. 5. The SWPPP must incorporate the requirements (MPCA Stormwater Discharge Design Requirements) including calculations for the project. 6. Site specific quantities must be included for all erosion prevention and sediment control BMPs. 7. Must include maps of all surface waters and wetlands and storm ponds or basins that can be identified on maps such as a USGA 7.5 minute quadrangle map, the NWI maps or equivalent maps within one mile (aerial radius) from the project boundary that will receive stormwater associated with construction activity during or after construction. This site is within one mile of a receiving lake. 8. As proposed, the plat would introduce a new city street intersection with the construction of the proposed Robinson Drive. It appears that there are deficiencies for the Case I Sight Distance Requirements at CR 53/Robinson Drive intersection, with the obstruction being an existing house and trees. The City/Developer should ensure that all applicable sight distance requirements are met to the fullest extent possible for this development. Please note that no plantings or business signs will be permitted within the county right of way, and care should be exercised when locating signs, buildings, structures, plantings, berms, etc. outside of the county right of way, so as not to create any new sight obstructions along this section of CR53. The access point for the existing house on Lot 1, Block 3 is to be removed from CR 53 and placed on the new Robinson Drive in conjunction with this plat. Following the removal of the existing driveway access for Lot 1, Block 3, the CR 53 ditch section is to be restored by the developer to match the adjacent ditch depth, slope, and grade. The Right of Access along the plat with an exception for the new local roadway (Robinson Drive) should be dedicated to Anoka County. ACHD would like to work with local governments in promoting compatibility between land use and the county highway system. It should be recognized that residential land uses located adjacent to County highways often results in complaints about traffic noise. Existing and/or future traffic noise from CR53 could exceed noise standards established by the Minnesota Pollution Control Agency (MPCA), the U.S. Department of Housing and Urban Development, and the U.S. Department of Transportation. Minnesota Rule 7030.0030 states that municipalities are responsible for taking all reasonable measures to prevent land use activities listed in the MPCA's Noise Area Classification (NAC) where establishment of the land use would result in violations of established noise standards. It is advised that the City and the Developer should assess the noise situation for this development as it is proposed to be located directly adjacent to CR53, and take the level of action deemed necessary to minimize the impact of any highway noise by incorporating the appropriate noise mitigation elements into the design and phasing of this plat as applicable. Affirmative Action / Equal Opportunity Employer The ACHD Engineering Plan Review process will apply to this development. Based upon the number of lots within this development, the construction of a NB CR 53 right turn lane and a SB CR 53 left turn lane (or possibly a SB CR 53 bypass lane) will be required to be completed by the developer/City in conjunction with this development. Calculations must also be provided along with a grading and erosion control plan that delineates the drainage areas for this site. The post -development rate/volume of runoff must not exceed the pre -developed rate/volume of runoff for the 10-year, critical design storm. The City Council approved the rezoning from R, Rural to PUD, Planned Unit Development with Ordinance 02-14 and the PUD Development Stage Plan/Preliminary Plat with Resolution 14-21. ANALYSIS Revisions to PUD Development Stage Plan/Preliminary Plat Resolution 14-21 approved the PUD Development Stage Plan/Preliminary Plat with conditions required prior to approval of the PUD Final Plan/Final Plat. The conditions have been satisfied unless otherwise noted in this report. The original Outlot A has been omitted reducing the total number of outlots from 7 to 6. The net density of the development remains at 4.01 units per acre. PUD Final Plan/Final Plat Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The PUD Final Plan/Final Plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance. Resolution 14-21 approved the PUD Development Stage Plan/Preliminary Plat with conditions required prior to approval of the PUD Final Plan/Final Plat. The conditions have been satisfied unless otherwise noted in this report. Blocks and Lots The final plat for Phase I, NorthPointe creates 21 new lots and I lot with an existing home at 2162 Cedar Street for a total of 22 lots. Outlots A through D are also being created for future development, stormwater management and wetland protection areas. Easements Standard drainage and utility easements are being dedicated on individual lots and over stormwater drainage areas. A drainage and utility easement is also being dedicated over the watermain and sanitary sewer utility extending north to Cedar Street. When Phase II is final platted, right of way will be dedicated over the easement and the roadway will be constructed. Public Land Dedication The City will require a combination of land dedication and cash in lieu of land. Phases I, II, IV and Outlot B (age -restricted multi -family complex) will pay straight park dedication fees per unit at the time of each final plat. Phase III will dedicate 5.04 acres of parkland, credit trail construction costs and collect any remaining cash balance associated with Phase III. The park land dedication and trail construction is anticipated to occur in 2015. Market value based on 2015 Anoka County Estimated Market Land Values (MKLND) is approximately $23,732 per acre. The developer purchased the property for approximately $26,500 per acre. An agreed upon market value for land dedication is $25,000 per acre. Zoning The City Council approved the rezoning from R, Rural to PUD, Planned Unit Development with Ordinance 02-14. 2 Comprehensive Plan Transportation Plan The City Engineer sent a letter dated March 11, 2014 to Anoka County Highway Department proposing that the construction of the right and left turn lanes on CSAH 54 at Cedar Street be installed at the time the property to the north and east develops. The City requests confirmation from the County regarding the request. Alternative Urban Areawide Review (AUAR) The project site is within the 2005 I-35E Corridor AUAR and is subject to the AUAR mitigation plan. The proposed development is consistent with development Scenario 1 for residential medium density and complies with the mitigation plan in regards to wetlands, water use, erosion and sedimentation, surface water runoff, wastewater and transportation. Noise Study Minnesota Rule 7030 states any municipality having authority to regulate land use shall take all reasonable measures within its jurisdiction to prevent the establishment of land use activities listed in noise area classification (NAC) 1,2, or 3 in any location where the standards established in part 7030.004 will be violated. The AUAR requires developers to follow all appropriate guidelines and policies related to traffic noise and noise mitigation. A Traffic Noise Assessment dated April 25, 2014, prepared by David Braslau Associates, Inc. was submitted. The following are excerpts from the 4.0 Summary of Findings: Homes along I-35E Predicted daytime sound levels at residential lots along Interstate 35E are below the daytime standards and no mitigation is required. However, "nighttime" levels between 6 and 7 am exceed the standards. Homes along CSAH 54 Predicted daytime sound levels at residential lots along CSAH 54 are just below the daytime L10 standards and no mitigation is required. However, limited improvements to the small berm along CSAH54 could provide a better margin for complying with the standards. The"nighttime" levels between 6 and 7 am exceed the standards. Proposed Park in Outlot D Predicted daytime levels are in excess of the NAC-1 standards which govern designated picnicking areas as well as residential land uses. Some benefits could be achieved with a 5 10-foot berm along the easterly boundary of the park activity area, but much of the area remains above daytime noise standards. Note: A 12 foot berm is being constructed along the easterly boundary of 'the park along I-35E. Staff consulted with the MPCA and MNDOT noise specialists and had the following comments: 1. The Traffic Noise Assessment applied certain exceptions to the state rules which brought those noise levels that exceeded standards into compliance; however, it is the opinion of both MPCA and MNDOT those exceptions do not apply to this project. Noise standards for nighttime levels along both I-35E and CSAH 54 exceed the limits. 2. Field monitoring data shall be collected to support the traffic modeling data in the study. 3. The developer/consultant shall provide a cost benefit analysis and documentation for avoidance and mitigation efforts. Factors to be considered include increased setbacks, higher berms and noise wall construction. Whereas full compliance with noise standards is certainly a goal of the City, it may not be achievable. The intent of noise mitigation is to minimize the effects of noise to the greatest extent possible but within reasonable costs and measures. The developer is installing berms and landscaping along CSAH 54 and in the park to minimize noise. The developer shall provide a cost benefit analysis to determine if additional or alternative noise mitigation techniques are feasible. Floodplain The 1982 FEMA Flood Insurance Rating Map (FIRM) indicates the southeast quadrant of the site is located within a designated Zone A flood plain district. Per the Stormwater Management Plan, the 100-year flood elevation is 909.7 which according the RCWD, this would also be the 100-year regulatory flood elevation. A Conditional Letter of Map Revision (CLOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any grading permits for land located within the floodplain. A Letter of Map Revision (LOMR) shall be obtained from FEMA prior to issuance of any building permits for lots located within the floodplain. Growth Management Policy Per the Comprehensive Plan (page 3-27), an annual average of 230 units per year over each 5 year phasing period not to exceed 345 units in any 1 year is allowed. At the end of the 5 year phasing period unallocated units will be averaged out over the next 5 years. Con Development Contract A Development Contract shall be drafted by the City, executed by the City and the developer and recorded by the developer. RECOMMENDATION Staff recommends approval of the PUD Final Plan/Final Plat for NorthPointe subject to the following conditions: 1. All comments from City Engineer letter dated May 8, 2014 shall be addressed. 2. All comments from Environmental Coordinator letter dated May 7, 2014 shall be addressed. 3. Approval from Rice Creek Watershed District shall be required prior to recording the final plat. 4. A Conditional Letter of Map Revision (CLOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any grading permits for land located within the floodplain. 5. A Letter of Map Revision (LOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any building permits for parcels located within the floodplain. 6. Conservation easements documents shall be drafted by the developer, approved by RCWD and the City and recorded by the developer. 7. Conservation easement language shall include allowance for construction of trails, parks, storm water management facilities, retaining walls, etc. 8. Outlot A of the NorthPointe final plat shall be deeded to the City. 9. The developer shall prepare the deed for Outlot A. 10. The developer shall grade the park in accordance with the approved grading plan and provide top soil and seed per City specifications. 11. A Development Contract shall be drafted by the City, executed by the City and the developer and recorded by the developer. 12. A Declaration for Maintenance of Storm Water Facilities shall be drafted by the City and executed and recorded by the developer. 13. Amendment to Section 1010 of City Code Regulating Signs APPLICANT: City of Lino Lakes REVIEW DEADLINE: Not Applicable — City Initiated BACKGROUND Following a City Council request to review the City's temporary sign regulations, the Planning and Zoning Board held a public forum to solicit comments from area businesses and institutional uses. Staff also completed a survey of sign regulations for surrounding communities. Nine (9) individuals brought forth suggestions regarding signage needs. In general the respondents requested more flexibility in the annual day allowance, location and duration of temporary sign permits. The board discussed several options in February of 2013 however staff has not made any final recommendations. In September of 2013 the City Council was approached by the pastor of Gethsemane Church requesting additional signage and expressing concern over the limited flexibility for multiple temporary signs on a property. The council directed staff to bring the issue back to the Planning and Zoning board for further discussion. The Board reviewed and discussed several proposed changes at its October 9, 2013 meeting. Comments were forwarded to the City Council and discussed at the November 4, 2013 Council work session. ANALYSIS Based on these comments, Planning and Zoning Board's discussion and direction provided by the City Council staff is proposing the following changes. The proposed changes are broken up into three sign categories — Definitions, Permanent Signs and Temporary Signs. Staff will also be proposing some minor technical clarifications. Definitions The term "Advertising Sign" was changed to Off -Premise Sign. The definition for "Non Commercial Speech" was changed to read as follows: 1 NONCOMMERCIAL SPEECH. Dissemination of messages not classified as commercial speech which include, but are not limited to, messages concerning political, religious, social, ideological, public service and informational topics or candidates. The definition for " Political Campaign Signs" is proposed to be deleted. These types of signs are considered "Noncommercial Speech" and are allowed as "Temporary Signs". A separate definition is not necessary. The definition of Sign Area was changed to read as follows: SIGNAREA. The entire area of a temporary or permanent sign within a single continuous perimeter enclosing the extreme limits of the actual sign surface, but excluding any structural or supporting elements such as uprights, aprons, poles, beams or standards. For the purpose of this chapter, maximum square footage of a sign shall be computed on the basis of one face of any double faced sign. Permanent Signs 1. Increase allowance for permanent signage for non-residential uses in residential areas i.e., schools & churches as follows: • Allow for both a wall sign and a monument sign for these uses. The ordinance does not currently allow for both. Maximum size is 32 square feet for ground signs and 50 square feet for wall signs. 2. Change the number of wall signs allowed to one per building wall. Size would be limited to 10% of the wall surface area for the front fagade of the building. Side and rear sides would be limited to 5% of the wall surface area. Signs on rear of building would be prohibited if facing residential property. Tempora . signs: igi s: 1. Provide for a temporary sign allowance of 90 days annually per property. This is roughly equivalent to one week a month. Business owners would determine dates but display would be limited to no more than 30 consecutive days. A single annual permit will be provided if all dates are predetermined. Otherwise an individual permit will be required for each sign. 2. Multi -tenant properties (3 or more businesses) will be allowed no more than three temporary signs displayed at one time. Sign allowance would be 90 days annually per property not sign. Property owner/manager will be required to obtain permit. 2 3. Sandwich board 6 feet and under in size located within 10 feet of the business fagade will no longer count towards the 90 day temporary sign allowance. Permit will be required annually. Sign can only be displayed during business hours. 4. One temporary off -premise sign will be allowed on any commercial, industrial or public -semi-public zoned property. Sign size shall not exceed 24 sq. ft. Sign shall be allowed for a maximum of 90 days total annually and for no more than 30 consecutive days. Sign allowance shall count toward that properties annual temporary sign allowance. RECOMMENDATION Staff is requesting public comment and discussion on the proposed changes. Based on comments received staff will develop the final ordinance language for presentation to the board and public. I operate a retail music store -school located directly on Lake Drive and streetside advertising is essential for us. 1.Simplify regulations 2. Allot each business a specific number of days per year of free sign display. (business gets to choose which days) 3. Each business can purchase more days if they wish. 4. Allow business a specific number of days that they can keep sign out for 24 hours. 5. Possible mode of enforcement- Similar to the purchase of driver's license tabs where citizens can purchase a color -coded "sticker" annually to be displayed on the corner of the sign.
