Mayor Bergeson noted that the previous Friday the council received a letter from the Lino
Lakes Charter Commission asking that their request for additional funding be heard at
this meeting. Council Members Reinert and O'Donnell agreed to add the item to the
evening's agenda.
REVIEW REGULAR AGENDA ITEMS
There were no changes to the regular council agenda.
Item 6B, a public hearing regarding the I- 35E/CSAH Interchange Improvement Project,
was briefly reviewed. There was a discussion about how special assessments may be
deferred and that interest is charged when payment is deferred. The interest rate would be
determined when the assessments are finalized. The council discussed the cost of the
project to the benefited property owners, acknowledging that the project is desirable but
also that there must be consideration of the current economy and people's ability to pay.
Community Development Director Grochala explained that the council is being asked
only to hold a public hearing this evening.
Item 6D was reviewed by City Planner Smyser. This agenda item is first reading of an
ordinance amending the zoning code to allow public, educational and religious buildings
as conditional uses in general business and limited business zoning districts in the city,
and amending the liquor code so that separation distance for liquor licenses shall not
apply for a school or church in said zoning districts. When the city received an
application from a church wishing to acquire the former VFW site (in a business district),
it led to a review of uses in business districts. In consideration that similar uses should be
allowed in zoning districts, Mr. Smyser pointed out similarities between private
lodge/club use (currently allowed in business district as a conditional use) and church use
(not currently allowed in business district). Mr. Smyser then explained a federal law
prohibiting discrimination against churches (for land use) and pointed out that there have
been court cases that have found church uses similar to lodge/club use. He also pointed

1 out the current standards/conditions that apply to all conditional uses in the city as well as
2 the specific conditions for specific uses that apply to the "public, educational and
3 religious buildings" use. Based on analysis, staff is recommending the zoning ordinance
4 amendment that is included in the ordinance that will accomplish the allowance of

6 recognize that churches and liquor uses will be occurring in the same district. The
7 Planning and Zoning board held a public hearing on the application and unanimously
8 recommended approval of the proposed ordinance amendments.

10 The council commented:
11 - it was clarified that a conditional use permit is not required for churches in all
12 zoning districts;
13 couldn't the request relative to the VFW be considered as something like a
14 one -time variance (staff replied no since the law doesn't allow the city to
15 permit a use that isn't allowed in a zoning district);

17 Community Development Director Grochala noted that an application has been submitted
18 so there is a legal requirement to act within a specified time period.

20 CHARTER COMMISSION FUNDING REQUEST

22 Regarding the letter submitted by the Lino Lakes Charter Commission requesting
23 additional funding for 2009, Commission Chairperson Caroline Dahl reported. Ms. Dahl
24 suggested that based on the commission's vote to go with a charter amendment this fall
25 they are requesting additional funding in the amount of $4,000 for legal assistance in
26 preparing one amendment (or possibly more). The funding requested is based on an
27 estimate she obtained from the commission's attorney. The commission is very careful
28 with their budget

30 Charter Commissioner Connie Sutherland was also present and was introduced as the
31 chair of the subcommittee that reported to the Commission at their last meeting on a
32 possible amendment. The amendment under discussion relates to limiting property tax
33 increases. Several other cities have this type of language in their charter.

35 A council member asked if it would make more sense to take a different approach? A
36 general question could be posed to the public and then, with a basis of public support,
37 spend money to prepare an amendment

39 A council member suggested that the Commission confer with the city finance director to
40 look at budget information that could be helpful in preparing a proposal.

42 Commissioner Sutherland suggested that they are looking at the history of the tax levy for
43 the city and, knowing that the state imposed levy limits may end soon, want to protect the
44 citizens against unchecked increases. They need to know if they will be able to secure

81 to allow division of certain sites by a future administrative minor subdivision. This would allow
82 the parcels to be divided in the future and sold to adjacent property owners for combination into
83 existing parcels and allow Xcel Energy to update their transmission line easements. He pointed
84 out that the Planning and Zoning Board reviewed and unanimously approved the variance
85 requests.

91 6B. Public Hearing, I- 35E/CSAH 14 Interchange Improvement Project

93 Community Development Director Grochala reported that the council is holding a hearing for
94 the purpose of soliciting public comment on a proposed interchange improvement project. The
95 council has previously received a feasibility study prepared by SRF Consulting Group, Inc. that
96 lays out project details. He reviewed the estimated cost of the project (approximately $23
97 million), federal, state and county funding involved and noted that approximately $5 5 million is
98 proposed to be assessed to benefiting property owners. More work is being done seeking
99 funding sources and that may lower assessment amounts and would be a part of final assessment
100 consideration later in the process. He noted that there are provisions available for deferment of
101 assessments. He is asking that the council open the public hearing, accept public testimony and
102 then close the hearing.

104 When asked by a council member for a definition of the term "green acres", Mr. Grochala
105 explained that in this case it generally refers to a tax classification intended to encourage
106 continued agricultural uses.

108 The public hearing was opened at 7:10 p.m.

110 Jerry Filla, attorney representing the Rainier Family Farm LLP, thanked staff for their help in
111 answering questions about the proposed project and assessments. He expressed concern that the
112 project is a regional improvement and should not be funded locally. The council should
• 113 recognize that the assessments can be very large (possibly more than $500,000 for his client)
114 and there are significant additional costs attached to deferment.

116 David Graetzer, 7306 24th Av S, announced that he questions the fairness in how this project
117 will be funded. He is concerned that his assessment of approximately $20,000 could become as
118 much as $130,000 with deferment interest; he would like to know as soon as possible what the
119 interest rate would be. In the interest of fairness, he suggests that an entity should step forward
120 (perhaps the city and pay the deferment interest so that only the principal is assessed.

122 Jerry Broker, representing Eagle Brook Church, reported that the church was not informed of
123 hearings that were held previously, they would lie to ensure that they are informed of any
124 hearings in the future, especially the assessment hearing. (Mr. Grochala replied that there were
125 two informational meetings held previously that were sponsored by the consultant, SRF
126 Consulting Group. He also reviewed the entire schedule outline for a county based project).
127 Mr. Broker noted that Eagle Brook Church has already contributed $100,000 to roadway
128 improvements for the intersection area and there could be consideration of that In addition, he
129 reported that when the church's engineers looked at the determination of usable acreage, they
130 came up with a lower figure than is included in the project study.

132 Lee Perrault, representing the Rainier Family Farm, stated that the family is concerned that their
133 property (55 acres) is located in a second tier area of the project but the proposed assessment
134 ratio is the same as for property directly adjacent to the interchange. The zoning that causes the
• 135 inequity isn't appropriate. He suggests that the whole process being proposed to determine the

136 assessments for this project "smells" full of errors. He has spoken with a local city
137 administrator in another area of the country and has heard that they use a better and more fair
138 process for an improvement of this type.

140 Mark Vargo, representing East Lino Lakes LLC, owners of 360 acres, stated that they are in
141 support of the proposed improvements as it will assist with development in the area. They
142 reserve the right to offer additional comments in the future as assessments are considered.

144 Bob McNeal, 7389 24th Av, said that he has a ten acre property that is residential. He is
145 interested in the deferment process. The road on which he lives, 24th Av, has no industrial
146 access and he wonders if that is a project in the future. Staffresponded to Mr. McNeal that there
147 is an assessment deferment process available and that ultimately Otter Lake Road will be
148 extended but there is no project planned at this point and that too would probably be an
149 assessment situation.

151 Rosemary Storgard, 6978 Lake Drive, stated that she would like to speak on behalf of citizens of
152 Lino Lakes that will not benefit from the proposed project. She questions why the cities of
153 Hugo and Centerville are not contributing to the project when they will receive benefit? She
154 would like to know what the taxpayers of Lino Lakes will have to contribute to the project.
155 Staff responded that there is no direct Lino Lakes taxpayer costs at this time; if that were
156 included, the city charter process would engage.

158 Michael Trehus, 675 Shadow Court, remarked that this proposed project involves a county road
159 going over a federal highway and his research indicates that such a project would normally be
160 funded through 80-90% federal funds and 10-20% county or state funds. He suggested that it
161 makes no sense that other cities aren't participating. This is a regional project and he believes
162 that in time it would be fully funded without any Lino Lakes' dollars. (Mr. Grochala noted that
163 the project is not in the Minnesota Department of Transportation 20 -year Plan.)

165 Comae Sutherland, 889 Main Street, raised the question of who would pay if the assessments for
166 the project are not paid because they are appealed or for any other reason? (Mr. Grochala
167 explained that the city would not be issuing any debt for the project and also that assessment
168 rates include some consideration of appeaL He suggested that the impact in value is fairly clear
169 since it is well accepted that development in the area would not occur in some cases without the
170 improvements.)

172 Archie LeSard, owner of a Dairy Queen business on Northern Lights, commented that he very
173 much supports the improvement project. If the interchange isn't improved, he fears for the
174 future of his business and others in that area.

179 Staff offered comments in response to questions posed at the hearing. The proposal includes

Ill181 day waiting period following the public hearing applies to the charter governed area only. He
182 intends to continue discussions with property owners during the waiting period as well as
183 continue negotiations with Anoka County (including discussion about assessment rates). There
184 will be other agreements involved with the project such as for signals It is certain that more
185 answers about the project, including funding, will evolve as things move forward.

187 A council member stated that the council has heard questions about the fairness in the amount of
188 assessment and they are valid. It is anticipated that staff will continue evaluating the proposed
189 assessments and will work with those who would be impacted by them. The question of the
190 rate of interest that would be charged on deferred assessments is important and the city must do
191 what it can to make that consideration clear. Another concern is that the council is being asked
192 to be a part of this project before many of the elements are clear. Staff again outlined the
193 process involving a county road project. It was clarified that a key funding element of the
194 project, namely stimulus money, will not be available after November 15 of this year.

213 City Planner Smyser reported that the item before the council is first reading of an ordinance
214 amending the zoning code to allow public, educational and religious buildings as conditional
215 uses in general business and limited business zoning districts in the city, and amending the
216 liquor code so that separation distance for liquor licenses shall not apply for a school or church
217 in said zoning districts. The city has received an application from a church wishing to acquire
218 the former VFW site (in a business district). Staff has reviewed uses allowed in business
219 districts. In consideration that similar uses should be allowed within established zoning
220 districts, Mr. Smyser pointed out similarities between the private lodge/club use of the VFW
221 (that use is currently allowed in business district as a conditional use) and the possible church
222 use (that use is not currently allowed in business district). Mr. Smyser then explained a federal
223 law prohibiting discrimination against churches (for land use) and pointed out that there have
411 224 been court cases that have found appropriate church uses similar to lodge/club use. He also
225 pointed out the current standards/conditions that apply to all conditional uses in the city as well

226 as the specific conditions for specific uses that apply to the "public, educational and religious
227 buildings" use. Based on analysis, staff is recommending first reading the zoning ordinance
228 amendment that is included in the ordinance that will accomplish the allowance of churches in
229 business districts as a conditional use and change the liquor code change to recognize that
230 churches and liquor uses will be occurring in the same district. The Planning and Zoning board
231 held a public hearing on the application and unanimously recommended approval of the
232 proposed ordinance amendments.

234 A council member noted concern that the change seems odd and there is no certainly as to it's
235 impact in the future. He doesn't agree that a church use is the same as the VFW. This is a
236 further example of the federal government shoving things down the throat of cities.

Lino Lakes Lions Club is requesting approval of a 1 to 4 Day Temporary On -Sale Liquor
License, which is necessary to allow the Lions Club to mix and dispense liquor that will
be served as part of the dinner. The club is also requesting approval of an application
to conduct off -site gambling.
City policy requires a background investigation each time a permit or license application
is received; city staff has conducted an investigation of the applicant

After the discussion with the council and charter commission last Monday evening,
the city attorney prepared the following suggested language for the proposed charter
amendment:
All regular Council meetings, as well as any comments received during a
scheduled public comment period immediately prior to such meetings, shall
be televised. Should the Council determine that it is necessary to exempt a
meeting from this requirement, it may do so by motion.
This language was forwarded to the charter commission and at their meeting last
night, they voted to keep the charter amendment as originally written by the
commission. That language is as follows:
All regular open council meetings, the Open Mike portion, and council work
sessions shall be televised. Should the City Council determine it is necessary to
exempt a given council meeting or council work session from this procedure,
they may do so by motion.

Dear Honorable Mayor Bergeson,
On July 23, 2009, the Lino Lakes Charter Commission voted to develop Charter Amendments for the
November 2009 election. On behalf of the Commission, I formally request additional funding in the
amount of $4,000.00 for 2009, exclusively for legal services pertaining to amending the City Charter.
The pay proposal to be developed would be a Charter amendment that would include a limit on
property tax increases.
Currently, the Commission has less than $21.00 remaining in its budget. This situation occurs
despite letting our regular (professional) minute -taker go, and taking the minutes ourselves.
As you know, the Charter Commission Members do not receive any compensation. The 2009 budget
for the Charter Commission has been sharply reduced by the City Council, from over $7,000 in
recent years to $1,500 for 2009. Our current operating budget is now roughly one -third of the •
amount that the City budgeted to the Commission in the 1990's (without factoring for inflation).
During the 2009 budgeting process last fall, upon learning of the proposed budget cut, the
Commission requested that the Council allow sufficient funding for legal services pertaining to an
amendment in its budget. The Council denied that request at that time, while making assurances that
if the Commission needed additional money beyond what was budgeted for 2009, then the money
would be available and could easily be taken from the contingency fund (if the Council so
stipulated).
I respectfully request that this matter be added to the July 27, 2009 Council Work Session and
approved that same day.
Thank you for your consideration and attention to this urgent matter. I apologize for the short notice;
however, the City Council is allowed to make last - minute changes to the existing agenda.

Re: EDAC recommendation regarding amending GB and LB Zoning
Districts to allow religious, public and educational uses.
At the request of a council member, this proposed ordinance was brought to EDAC for its
consideration at its Thursday, August 6 meeting. EDAC members agreed that the
enactment of federal law that requires like uses to be treated equally was enough reason
to adopt the amendment to the ordinance. Beyond that members acknowledged that this
amendment would allow uses that could remove properties from the commercial tax
roles. However, such uses were reasonable within areas that had infrastructure to support
them and they attracted people who would use city amenities such as restaurants and
shopping. EDAC recommended unanimously to support the proposed amendment to the
GB and LB Zoning Districts.
A question arose regarding the need to include educational and public uses within GB and
LB Zoning Districts. EDAC requested staff opinion regarding the elimination of those
uses which are also not taxed from the amendment.
Staff' s recommendation remains that because these uses are similar in function and often
difficult to separate, they should remain within the same category in the zoning
ordinance.

The City Council approved the first reading of this ordinance on July 27. This is the second
reading. Once adopted, all ordinances must be published in the official newspaper. However,
state statute allows the City by a 4/5 vote to publish a summary of an ordinance as long as the
summary clearly informs the public of the intent and effect of the ordinance This saves on
publication costs. Resolution No. 09 -54 approves a summary of the ordinance
The zoning ordinance creates zoning districts to regulate the use of land and structures in the
city. We have received an application to amend the zoning ordinance to allow churches in the
GB district, which currently is not allowed. This led to examining other business districts and as
well as other statutes that might be relevant. This research led to the recognition that under
federal law, if similar uses are allowed in a zoning district, churches must be treated equally.
In addition, the existing City Code regulations for liquor licenses creates a separation of 1000
feet between a liquor license location and a church or school. If a church or school locates in an
LB or GB zone and this separation is applied, it would eliminate most of the city's commercial
zones as locations for restaurants or other uses that need a liquor license.
The application was submitted by a church planning to acquire the vacant site formerly owned
by the VFW. However, it is important to recognize that the submitted application only includes

amending the ordinance The application does not include review of a church plan or of the
conversion of a building into a church. A future application for a conditional use permit for a
church on the site will be required. Approval of the currently requested ordinance amendment
does not approve or imply approval of any future application that might be submitted.
ANALYSIS
Similar Uses in Zoning District
A zoning district should allow similar uses that will not create land use conflicts. If a zoning
district allow a use that is similar to a new one, it make sense to include the new one in that
district. The similarities referred to are the general type of activity, as well as factors such as the
traffic generation, parking, need for and impact on the city's utilities systems (water, sanitary
sewer, and stormwater management), and potential impacts on other properties.
In considering churches, it's useful to describe the general activities and impacts that coincide
with churches. Generally, a church is a place of assembly where people congregate for various
purposes. The group can be large or small and might participate in religious worship, weddings,
pancake breakfasts, dinners, and other social activities. Churches generate traffic and need
vehicle parking space. If available, it's best that churches connect to municipal water to
accommodate a fire suppression system for the building as well as water needs for groups of
people. Wastewater treatment also is needed.
Both the LB and GB districts currently allow private lodges and clubs as conditional uses. This
would include a VFW or American Legion. The activities that occur at such lodges and clubs
and the potential impacts on their surroundings are very similar to those of churches. Large or
small groups of people assemble for various purposes—social events, meals, etc. They need
parking, they generate traffic, they need water and wastewater treatment.
The city's responsibility is to protect public health, safety, and welfare by anticipating and
addressing the potential effects on the surroundings and the community as a whole. This is a
legitimate public purpose in regulating land uses with a zoning ordinance The exact nature or
purpose for which people assemble within a building is not the concern, as long as it's a legal
activity. Differences between the institutions purposes, beliefs, or activities— aren't relevant.
Religious Land Use and Institutionalized Persons Act of 2000
The "similarity of uses" concept is important in understanding the federal law that prohibits
discrimination against churches. The Religious Land Use and Institutionalized Persons Act of
2000, known by the acronym RLUIPA, requires a city to treat religious uses such as churches the
same as the city treats other similar uses. In the years since its enactment, a number of court
cases have been decided under RLUIPA which provide guidance for compliance with the law.
As discussed above, lodges and clubs are similar to churches in their activities and potential

impacts. In fact, they have been found to be similar uses under this law in several court cases
and therefore a city must regulate them equally. In addition, the courts have decided that
property tax revenue issues are not justifications for treating religious uses differently from
similar uses.
Amendments to Zoning Ordinance
Staff conducted an analysis of the current zoning ordinance Based on the analysis, which was
detailed in the July 27 report, the zoning ordinance should be amended to accomplish the
following:
• Add Public, Educational, and Religious Buildings as conditional uses to the LB and GB
zoning districts.
• Setbacks must be consistent within the same zoning district for both categories: "Public,
Educational, and Religious Buildings" and "Private Lodges and Clubs ". The normal
setbacks from residential districts in the LB and GB zoning districts should apply.
• Delete the term "commercial" from building requirements paragraphs in LB and GB to
clarify that all types of buildings are required to meet the requirements.
• Clarify that a lodge or club and public /educational /religious building must meet the same
screening requirements as business or industrial uses, as listed in Sec. 3, Subd. 4.Q
• Clear up ambiguity for parking screening: to avoid confusion, use consistent language
for requirements for lodge or club and public/ educational /religious.
Amendment to Liquor Code
The Lino Lakes City Code regulates liquor licenses in Chapter 700. It requires a separation of
1000 feet between a business getting a liquor license and a church or school. This is measured
from front door to front door. The Code exempts some types of schools and the separation is not
applied if the liquor license was granted before the church or school arrives.
The business zoning districts are not huge in Lino Lakes, and many of them stretch along
highway corridors. If a church or school locates in an LB or GB zone and the 1000 fl. distance
is applied, it would eliminate most of the city's business zones as locations for restaurants or
other uses that need a liquor license. This would prohibit many desirable businesses from
locating in Lino Lakes.
Since the business areas were established as locations for businesses, any church or school that
locates in these areas should be expected to be coexist with the business uses. The business uses
might include establishments with liquor licenses. Just as the property line setback distances for
churches/schools and businesses should be equal, other regulations should be equal.

Ordinance No. 04 -09 includes amendments to the zoning ordinance that address the needed
revisions and create the same conditions for similar categories of uses. Ordinance No. 04-09
also adds a clause to the liquor code that removes the distance requirement from schools and
churches located in an LB or GB zoning district. The amendments include text to be added,
shown as underlined, and text to be deleted, shown as seen.

Section 1 Findings

Limited Business and General Business zoning districts.
3. The Religious Land Use and Institutionalised Persons Act of 2000, known by the acronym

other similar uses. Lodges and clubs are similar to public, educational, and religious uses in
their activities and potential impacts.
4. Section 2, Subdivision l of the Zoning Ordinance requires consideration of possible adverse
effects of a proposed zoning amendment and that the judgment of a proposed amendment to
the Zoning Ordinance shall be based upon, but not limited to, the following factors:
1. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City Comprehensive
Plan.
2. The proposed use is or will be compatible with present and future land uses of the area.
The Policy Plan chapter of the 2002 Comprehensive Plan lists the following policies
that are relevant to the inclusion of institutional uses in business zones. Such policies
support consistent requirements for similar uses in business zones.
3. Require commercial development in Lino Lakes to meet architectural
performance standards which assure the creation of attractive, functional and
durable structures. Different standards may be established for different areas.
8. Develop commercial and service centers as cohesive, highly interrelated units
with adequate off-street parking.
9. Ensure that service and commercial uses are adequately and appropriately
landscaped according to community requirements as may be amended.
10. Ensure that all service and commercial uses are adequately screened or
buffered from any adjacent residential development.
17. In evaluating commercial sites, factors will be the physical implication of the
commercial land use related to traffic generation, sewer and water demands,
environmental issues and compatibility with neighboring land uses.
In addition, the Land Use Plan chapter of the 2002 Comprehensive Plan lists the
following strategies to be implemented to promote quality commercial areas. These
strategies further support consistent requirements for similar uses in business zones.
1. The City will utilize its zoning regulations to define the range of commercial
land use that may be appropriate for each proposed commercial location.
Through its commercial site planning, the City will require new commercial
development to be compatibly designed with surrounding land uses through
the use of transitional land uses, proper setbacks, building orientation,
screening and landscaping
2. Site access will be controlled to provide safe traffic movement and to reduce
the commercial traffic impacts on residential neighborhoods.
3. The City will promote commercial site designs that emphasize pedestrian
accessibility, shared parking, and green space in an effort to create a customer
friendly environment and promote a high level of business interchange among
local businesses when feasible.
4. Architectural and site standards will be developed and applied to City
commercial development in an effort to establish aesthetic pleasing, high
quality commercial buildings and streetscapes where they apply.
5. Commercial development will be required to be responsive to the
environmental concerns of the City with regard to site planning, landscaping,
impervious surfacing, and storm water management.

3. The proposed use conforms with all performance standards contained herein.
Section 2, Subd. 1 includes criteria that must be met by all conditional uses. These
will continue to apply equally to all conditional uses as will all other requirements in
official controls that apply equally to all uses. Each zoning district includes specific
conditional uses with conditions specific to the uses. With the amendments described
herein, the standards in the zoning ordinance will address similar uses equally.
4. The proposed use can be accommodated with existing public services and will not
overburden the City's service capacity.
5. Traffic generation by the proposed use is within capabilities of streets serving the
property.
Utility demand and traffic generation will continue to be addressed with new and
existing uses, as required by the subdivision, zoning, and other chapters of the city
code and official controls.
5. Residential and rural districts are not typically planned with the infrastructure and other
elements necessary to support higher intensity uses planned for in business districts. It is
appropriate that some requirements in residential and rural zoning districts may be more
restrictive than in business districts to protect the lower intensity residential and rural uses.
6. The Lino Lakes Planning & Zoning Board held a public hearing on the amendments on July
8, 2009, and recommended approval.

(3) Distance from school or church. No license shall be granted within 1,000 feet of
any school or within 1,000 feet of any church. The distance shall be measured from the
main entrance of the school or church to the main entrance of the applicant' s place of
business.
(a) For the purposes of the separation restriction in this division, a school is a
building that is principally used as a place where 25 or more persons receive a full course of
educational instruction and the educational instruction is provided on a daily basis by an
established school board or church. This does not include any post - secondary or post -high
school educational building, including any college or any vocational- technical college. Nor
does the separation apply to a daycare or early childhood facility, where children typically
are under constant supervision while at the facility and when traveling to and from the
facility.
(b) The establishment of a school or church within the separation distance after an
original liquor license application has been granted shall not, in and of itself, render the
premises ineligible for renewal of the license.
(c) This separation distance restriction shall not be applicable if a school or church is
located in a Limited Business or General Business zoning district.

Section 1: Findings: 1) The Zoning Ordinance allows public, educational, and religious
buildings as conditional uses in the Rural and Residential zoning districts. 2) The Zoning
Ordinance allows private lodges and clubs as conditional uses in the Limited Business and
General Business zoning districts. 3) The federal Religious Land Use and Institutionalized
Persons Act of 2000 requires a city to treat religious uses such as churches the same as the city
treats other similar uses. Lodges and clubs are similar to public, educational, and religious uses
in their activities and potential impacts. 4) The City Council finds that this ordinance complies
with factors required for amending the Zoning Ordinance. 5) Residential and rural districts are
not typically planned with the infrastructure and other elements necessary to support higher
intensity uses planned for in business districts. It is appropriate that some requirements in
residential and rural zoning districts may be more restrictive than in business districts to protect
the lower intensity residential and rural uses. 6) The Lino Lakes Planning & Zoning Board held
a public hearing on the amendments on July 8, 2009, and recommended approval.
Section 2: The Zoning Ordinance is hereby amended as follows (deleted text in strikcout, added
text in underline), and subsequent elements within the subdivisions shall be renumbered as
appropriate:

Section 3: The City Code is hereby amended as follows (added text in underline),
§ 701.07 PLACES INELIGIBLE FOR LICENSE.
(a) For the purposes of the separation restriction in this division, a school is a building that
is principally used as a place where 25 or more persons receive a full course of educational
instruction and the educational instruction is provided on a daily basis by an established
school board or church. This does not include any post - secondary or post -high school
educational building, including any college or any vocational - technical college. Nor does
the separation apply to a daycare or early childhood facility, where children typically are
under constant supervision while at the facility and when traveling to and from the facility.
(b) The establishment of a school or church within the separation distance after an original
liquor license application has been granted shall not, in and of itself, render the premises
ineligible for renewal of the license.
(c) This separation distance restriction shall not be applicable if a school or church is located
in a Limited Business or General Business zoning district.
Section 4: As above amended, said Zoning Ordinance shall stand as initially passed and
previously amended.
Section 5: This ordinance shall be in effect in accordance with the City Charter.

BACKGROUND
The City Council approved the first reading of this ordinance on July 27. This is the second
reading. Once adopted, all ordinances must be published in the official newspaper. However,
state statute allows the City by a 4/5 vote to publish a summary of an ordinance as long as the
summary clearly informs the public of the intent and effect of the ordinance This saves on
publication costs. Resolution No. 09 -53 approves a summary of the ordinance
The zoning ordinance includes requirements for a Planned Unit Development (PUD). The
"development stage plan" includes a preliminary plat. The final plat and other more defined
elements of a PUD are included in the "final plan ". The ordinance currently requires submittal
of the final plan within one year of approval of the development stage plan. Beyond this, the
ordinance limits an extension of time to six months. The proposed ordinance amendment would
eliminate this six -month limit on extensions.

SIX -MONTH MAXIMUM ON EXTENSIONS FOR SUBMITTING THE FINAL
DEVELOPMENT PLAN FOR A PLANNED UNIT DEVELOPMENT
Section 1 Findings
1. Section 2, Subd. 10 of the Lino Lakes Zoning Ordinance includes the requirements for a
Planned Unit Development.
2. Section 2, Subd. 10.F.8.g. includes the time frame requirements for submittal of the final plan
for a Planned Unit Development. This requires that the final plan be submitted within one-
year of approval of the development stage plan. It also allows an extension for not more than
six months.
3. Section 2, Subdivision 1 o the Zoning Ordinance requires that the City must consider
possible adverse effects of a proposed amendment to the Zoning Ordinance and judgment
shall be based upon, but not limited to, the following factors:
1. The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City Comprehensive
Plan. This amendment does not involve a rezoning of a property, but the removal of a
time extension restriction. The restriction applies only to planned unit developments.
Other platting projects, with timelines governed locally by the subdivision and platting
chapter of the city code, do not have such a restriction.
2. The proposed use is or will be compatible with present and future land uses of the area.
This removal of a time extension restriction will have no effect on the compatibility of
any project with its surrounding uses.
3. The proposed use conforms with all performance standards contained herein. This
removal of a time extension restriction is an amendment of a performance standard. No
compliance with other standards will be affected.
4. The proposed use can be accommodated with existing public services and will not
overburden the City's service capacity.

effects on City utilities or transportation infrastructure or other services.

plan limits City Council discretion and has the potential to prevent the initiation or
completion of a project deemed to have public value by the Council and the community

Section 2 Amendment of Zoning Ordinance Approved
The City Council of Lino Lakes ordains that Section 2, Subd. 10.F.8.g. of the Zoning Ordinance
is hereby amended to delete the text shown in strikeout and add text that is underlined:
Limitation on Development Plan Approval. Unless a Final Plan covering the area
designated in the Development Stage Plan as the first stage of the PUD has been filed
within one (1) year from the date the City Council grants Development Stage Plan
approval, or in any case where the applicant fails to file Final Plans and to proceed with
development in accordance with the provisions of this Ordinance and/or an approved
Development Stage Plan, the approval shall expire. The City Council may at its
discretion; extend for six -month intervals , the filing deadline
for any Final Plan when, for good cause shown, such extension is necessary. The City
Council may approve such an extension after the deadline date passes. In any case where
Development Plan approval expires and no extension has been approved, the City
Council may adopt a resolution repealing the Development Stage Plan approval for that
portion of the PUD that has not received Final Plan approval and re- establishing the
zoning and other Code provisions that would otherwise be applicable.
Section 3 Zoning Ordinance Stands As Amended
As above amended, the Zoning Ordinance shall stand as initially passed and previously
amended.
Section 4 In Force According to City Charter
This ordinance shall be in force and effect from and after its passage and publication according
to the Lino Lakes City Charter.
